Sidewalks

All sidewalks within Common Areas shall be maintained by the Association. All other sidewalks shall be maintained by the Owner of the Lot on which the sidewalk is situated. If any section of your sidewalk is uneven, which may cause someone to trip and hurt themselves, you are responsible for repairing or replacing that section of the sidewalk and liable for any injuries incurred.

MPCA I.D. INFORMATION

Every resident must have a MPCA I.D. CARD to use the pools, clubhouse and tennis courts. Complete the I.D. Registration form in this newsletter and return it to the office at least 3 days before coming in to the office for pictures taken. If you are renting your home, please provide us evidence that you live in the subdivision, i.e. a water bill with your name on it, etc. ID’s are for residents only. Homeowners who do not live in Memorial Parkway are not eligible for a MPCA I.D. CARD. Once you have the card, turn it in to the office the following year for validation. If you already have an ID card, please turn them into the office so that we can validate them for 2012 and you’ll be ready to use the pools when they open this summer.

The Cimarron Parkway Pool will be open on weekends in May per the schedule below: May 5th through May 31st. Saturdays 10 am - 6 pm Sundays 12 pm - 6 pm Monday, May 28th (Memorial Day) 12:00 pm - 6:00 pm

MEMORIAL PARKWAY COMMUNITY ASSOCIATION POOL RULES

Anyone violating the following rules is subject to losing privileges with the Memorial Parkway Community Association. 1. Memorial Parkway Community Association swimming pools and pavilion are restricted for the use of residents and their guests. 2. Resident must present their valid MPCA ID card before admittance to pool area. 3. Guests must be accompanied by a resident and must sign in. Five guests are allowed per family at one time. Guest may not be a Memorial Parkway resident. 4. Lifeguards have the responsibility for maintaining discipline and enforcing rules in the pool area. a. Lifeguard shall call infraction of rules to the attention of the offending individual (s). b. Lifeguards have the authority to deny the use of pool facility to residents and guests up to three (3) days as a disciplinary measure. 5. Swimming is allowed only when lifeguards are on duty in the stands. SWIM AT YOUR OWN RISK. 6. Swimmers must wear property swimsuits. 7. Children not toilet trained must wear protective rubber pants or equivalent, under their swimsuits. 8. Children under twelve (12) years of age are not allowed in pool unless accompanied by an adult at least 18 years of age or older. EXCEPTION: Notarized parental permission is submitted to lifeguard allowing designated 16 years old-18 years old to accompany and child under age 12. Form is available from lifeguard. 9. Baby pool is reserved for children five (5) years and younger and supervised by responsible parent/adult. 10. No running or shoving allowed in the pool area or on diving board. 11. No pets are allowed in pool area. 12. Anyone with open sores or wounds is prohibited from using the pool. 13. Floating devices may be allowed at the discretion of the lifeguard. No floating devices allowed in diving area. No large floating devices (example: rafts, boats, etc.). 14. Throwing toys, Frisbees, small hard balls, tennis balls, water

guns, etc. are strictly prohibited. 15. No standing or sitting on safety ropes. 16. All children under eighteen (18) including infants, must vacate pools the last fifteen (15) minutes of every other hour for adult swim. Children must be a least four feet from pool during adult swim. 17. Glass containers are not allowed in pool area. 18. Drinking, smoking and eating are not allowed within four feet of pool. 19. Smoking or drinking of alcoholic beverages is strictly prohibited except by persons of legal age. Proof of age may be required. Drunkenness and obscene language will not be tolerated. 20. Two (2) long blasts of lifeguard whistle requires everyone to immediately vacate pool. 21. MPCA and pool contractor are not responsible for lost or stolen items. 22. No bicycles, skates, skateboards or tricycles are allowed in the pool area. Bicycles must be parked in bicycle rack. 23. Guard phone is for business use only. No personal phone use by guards/gatekeepers while on duty. Phone in box is for emergency use only. 24. MPCA or the pool contractor may enforce other rules deemed necessary for the safety of the residents/guests. 25. NO PARTIES DURING POOL HOURS. POOL CAN BE RENTED THROUGH THE OFFICE. 26. One guard must be on deep end stand when diving area is open. Otherwise this area is closed. 27. No loitering. 28. Only lifeguards/gatekeepers allowed at the check-in table. DIVING POOL RULES 1. The diving pool area is to be used for diving only. No swimmers allowed unless authorized by lifeguards. 2. No more than one person is allowed on the diving board at one time. 3. Only two bounces on board are allowed before diving. 4. All diving shall be from the end of the diving board and straight forward, never off the side. The water in front of the board must be clear of swimmers before entering the pool. Swim directly to the ladder after diving. 5. Anyone using the diving pool must be able to swim across the pool twice to the satisfaction of the guard.

VEHICLE PARKING ON THE STREET

It is not a violation of our deed restrictions to park a vehicle on the street as long as it is not being stored, is fully operational and has current tags. However, the Transportation Code of Texas, Title 6, Chapter 545, Section 302, states that .a vehicle cannot park closer than 15 feet to a fire hydrant. .a vehicle cannot park closer than 20 feet to an intersection. .a vehicle cannot park closer than 30 feet to a stop sign. The Board has asked our Constables to take the appropriate action whenever there is a violation of the Transportation Code. The parking of vehicles on the street has become a big problem in our neighborhood. School buses can’t pull close to the curb to pick up and let off students. In some cases, emergency vehicles may not be able to reach their destination if traffic flow is inhibited, especially when two cars are parked directly across from each other. Plus, vehicles parked on the street are those that are vandalized the most.

Some of the worst areas are the cul-de-sacs where it’s hard enough to back out of a driveway or navigate the circle even when there aren’t any vehicles parked on the street. Be considerate of your neighbors and don’t park your vehicle in front of their house or block their mailbox. Also, think of the neighbor across the street and park so that you’re not making it difficult for them to back out of their own driveway. All of our homes have at least a two or three-car garage and room for several cars in the driveway. We respectfully request that you refrain from parking on the street.

If you are having any problems with getting trash picked up or want to register a complaint, please call WCA at 281-368-8397 if you are a customer of Memorial MUD. If you are a customer of MUD 81, you may call Royale Disposal and Recycle at 713-526-1536.

The HOA has received complaints about trashcans being stored in front of the home, left at curbside, and not being stored out of sight. In the past, the deed restriction committee has not been writing letters to homeowners about proper storage of trashcans. Since this has become a problem in the neighborhood, we are now sending letters to homeowners if their trashcans are not properly stored out of sight. Trash cans should be placed at the curb the morning of trash pickup and the cans should be stored away out of sight by the end of the day. If your trashcans are visible from the street on any day other than trash day, you will in violation of the deed restriction. Thanks to all of you who have started storing your trash receptacles out of public view. It really has made a big difference in the overall appearance of our neighborhood and we appreciate your cooperation.

STREET GUTTERS AND DRAINS

We ask that you keep the street area in front of your home clean, so that leaves, pine needles, grass clippings and dirt won’t accumulate in the gutters next to the curb and end up being washed into the drains causing them to back up and flood the streets. If you see someone putting grass clippings, oil or other debris down the drains, please contact the MUD District and the County at 281-463-6300.

2012 Maintenance Fees

The 2012 maintenance fee of $315 is now past due. On or about February 3rd, a late notice was sent to each owner who had not paid the fee and a $25 late fee, plus interest, was added to their account. This mailing was sent by Certificate of Mailing. If the mailing was returned to us marked “unclaimed” you still are responsible for paying the fee. If the fee was not paid by February 28th, another late notice was sent with an additional $25, plus interest, added to their account. This notice was sent by Registered Certified mail. If this letter was returned to us marked “unclaimed,” you still are responsible for paying the fee. Delinquent accounts will either be turned over to our attorney for collection or a lawsuit in Small claims Court will be filed on April 1, 2012. In some cases, we may have to take both actions. This arrangement protects you from getting late fees and possible legal action as long as you do not default on your monthly payments. The down-payment is $100, followed by a payment of $50 due the first of each month until your account has a zero balance. If you did not receive a statement, notify the office immediately.

GARAGE SALES

MPCA would like to suggest that garage sales be conducted the first Friday and Saturday of each month. This will eliminate the many signs that are out each week and also makes for a stronger turn out. Most area communities only allow sales twice a year. Memorial Parkway could be known for its “Once a Month” garage sales. Do not attach your garage sale signs to the STOP signs, as it is against the law and the County can issue citations for this. If a sign is on a public right of way, like the esplanades), they may be subject to fines of $500-$1000 per occurrence per day. We also ask that you do not post your signs on the property of another resident. When your sale is over, please go back and pick up all of your signs.

ARCHITECTURAL CONTROL

All exterior changes to your property must be submitted to our committee for approval before you start any work. This includes, but is not limited to, painting, re-roofing, sheds, patio covers, fences, etc. All requests must be on our request form that can be found in this newsletter, online at our website www.mphoa.org or at the office. Please give as much detail as possible, so there is no delay in getting your request reviewed. Except for painting and re-roofing, it would be best to include a plat of your property that shows property lines and easements in relation to the location of your project.

DEED RESTRICTIONS

Memorial Parkway Community Association has inspectors that drive through the neighborhood checking for violations of our deed restrictions. They are not permitted to get out of their cars and/or trespass on your property. They only take pictures of violations that can be seen from the street. If you see one of our inspectors stopped in front of your home, please do not approach their vehicle to confront them. Their vehicles are indentified with a mpca sign on the car door. If you still have questions, call the office. If you get a notice of violation and you feel it was sent to you in error, please call the office. Our staff will look at the picture taken of the violation and confirm whether the address is correct or not. Our inspectors make every effort to make sure they’ve got the right violation logged to the right address with the right picture to go along with it. But with 2,219 homes to inspect and over 25 miles of streets, they sometimes get it wrong. If that’s the case, we apologize for the mistake, and will remove the violation from your record. As you can see from the following list, we have many un-resolved deed violations that are ruining the over-all appearance of our neighborhood. Storing miscellaneous items in view from the street can easily be remedied by just moving those items to another location - no cost involved. Storing trash receptacles and recycle bins in view can easily remedied by just moving them to another location that can’t be seen from the street - no cost involved. Correcting these two violations alone would greatly improve the appearance of your property. The next big item is lawn maintenance. We understand that the drought took its toll on our yards. When the rains finally came, so did the weeds that seemed to sprout up over night. Many of our residents mow every two weeks, but at certain times of the year, yards may have to be done every week to maintain a neat appearance.

Animals that are not properly restrained pose a threat to all our residents. While you may know your pet is friendly, an animal running at someone who is walking by is very scary for that person. Many children are afraid of animals and become frightened, which could result in the child getting hurt trying to avoid the animal.
