Sidewalks
All sidewalks within Common Area shall be maintained by the Association. All other sidewalks shall be maintained by the Owner of the Lot on which the sidewalk is situated. If any section of your sidewalk is uneven, which may cause someone to trip and hurt themselves, you are responsible for repairing or replacing that section of the sidewalk and liable for any injuries incurred.
VEHICLE PARKING ON THE STREET
It is not a violation of our deed restrictions to park a vehicle on the street as long as it is not being stored, is fully operational and has current tags. However, the Transportation Code of Texas, Title 6, Chapter 545, Section 302, states that .a vehicle cannot park closer than 15 feet to a fire hydrant. .a vehicle cannot park closer than 20 feet to an intersection. .a vehicle cannot park closer than 30 feet to a stop sign. The Board has asked our Constables to take the appropriate action whenever there is a violation of the Transportation Code. The parking of vehicles on the street has become a big problem in our neighborhood. School buses can’t pull close to the curb to pick up and let off students. In some cases, emergency vehicles may not be able to reach their destination if traffic flow is inhibited, especially when two cars are parked directly across from each other. Plus, vehicles parked on the street are those that are vandalized the most. Some of the worst areas are the cul-de-sacs where it’s hard enough to back out of a driveway or navigate the circle even when there aren’t any vehicles parked on the street. Be considerate of your neighbors and don’t park your vehicle in front of their house or block their mailbox. Also, think of the neighbor across the street and park so that you’re not making it difficult for them to back out of their own driveway. All of our homes have at least a two or three car garage and room for several cars in the driveway. We respectfully request that you refrain from parking on the street.
BOARD ELECTION
One position is up for election to the Board of Directors for a threeyear term beginning January 1, 2012. No one came forward requesting that their name be put on the ballot, so we have just one candidate, Mike Brahm. Mike has been active in our Association for many, many years, having been chairman of the Recreation Committee, Vice President and currently, the President. He would like to stay on the Board so that he can use his experience to make responsible financial decisions for our homeowner, assure that our property values are maintained and go forward with new projects that will enhance our neighborhood. A proxy was mailed to each homeowner in mid-August, along with a self-addressed stamped envelope.

STREET GUTTERS AND DRAINS
We ask that you keep the street area in front of your home clean, so that leaves, pine needles, grass clippings and dirt won’t accumulate in the gutters next to the curb and end up being washed into the drains causing them to back up and flood the streets. If you see someone putting grass clippings, oil or other debris down the drains, please contact the MUD District and the County at 281-463-6300.
TRASH COLLECTION
If you are having any problems with getting trash picked up or want to register a complaint, please call WCA at 281-368-8397 if you are a customer of Memorial MUD. If you are a customer of MUD 81, you may call Royale Disposal and Recycle at 713-526-1536.
TRASH CANS
The HOA has received complaints about trashcans being stored in front of the home, left at curbside, and not being stored out of sight. In the past, the deed restriction committee has not been writing letters to homeowners about proper storage of trashcans. Since this has become a problem in the neighborhood, we are now sending letters to homeowners if their trashcans are not properly stored out of sight. Trash cans should be placed at the curb the morning of trash pickup and the cans should be stored away out of sight by the end of the day. If your trashcans are visible from the street on any day other than trash day, you will in violation of the deed restriction. Thanks to all of you who have started storing your trash receptacles out of public view. It really has made a big difference in the overall appearance of our neighborhood and we appreciate your cooperation.

2011 Maintenance Fees
If you have not paid your 2011 maintenance fees, we have either filed a lawsuit against you in Small Claims Court and/or turned your account over to our attorney for handling. Contact the office if you need more information.
2012 Maintenance Fees
On October 1, 2011, we will be sending statements to all Memorial Parkway homeowners for 2012 maintenance fees, which will be due on January 1, 2012, and will remain the same as last year - $315. You may start paying ahead when you receive the bill by sending your payment to our lockbox address: This is a new address, so please don’t use any old envelopes you may still have. MPCA P. O. Box 670612 Dallas, Texas 75267-0612 You may pay by Visa, MasterCard or Discover credit card. Contact the office for information about the authorization statement that must be completed before payment will be accepted by this method. You can also go to our web page (mphoa.org) for a copy). We do not accept any cash payments. Payment plans are available at no cost if you sign up before January 15, 2012. Please do not drop your payment off at the office or send it to 21600 Cimarron Parkway, as it only delays the process and could cause late fees to accrue on your account. Allow several days for your payment to reach the bank. The date that the bank deposits your payment into our account is the date we use as your “paid date.”
GARAGE SALES
MPCA would like to suggest that garage sales be conducted the first Friday and Saturday of each month. This will eliminate the many signs that are out each week and also makes for a stronger turn out. Most area communities only allow sales twice a year. Memorial Parkway could be known for its “Once a Month” garage sales.
November 2011
Memorial Parkway
Do not attach your garage sale signs to the STOP signs, as it is against the law and the County can issue citations for this. If a sign is on a public right of way, like the esplanades), they may be subject to fines of $500-$1000 per occurrence per day. We also ask that you do not post your signs on the property of another resident. When your sale is over, please go back and pick up all of your signs.
DEED RESTRICTIONS
Memorial Parkway Community Association has inspectors that drive through the neighborhood checking for violations of our deed restrictions. They are not permitted to get out of their cars and/or trespass on your property. They only take pictures of violations that can be seen from the street. If you see one of our inspectors stopped in front of your home, please do not approach their vehicle to confront them, but call the office to confirm whether it is our employee or not.

While you may know your pet is friendly, an animal running at someone who is walking by is very scary for that person. Many children are afraid of animals and become frightened, which could result in the child getting hurt trying to avoid the animal. Harris County Animal Control advises, “All dogs and cats must be kept under restraint while in the unincorporated areas of Harris County, Texas. The custodian of a dog or cat is not authorized to have, harbor or keep any unlicensed dog or cat nor to allow any dog or cat to become a stray.” Restraint is defined as “the control of a dog or cat under the following circumstances: 1. When it is controlled by a line or leash not more than six (6) feet in length, if the line or leash is held by a human being who is capable of controlling or governing the dog or cat in question. 2. When it is within a fully enclosed vehicle. 3. When it is on the premise of the custodian and the animal does not have access to sidewalk or street. While it may be nice to have your animal out in the yard while you work or play, it is against the law, unless the animal is properly restrained. Let’s all help keep our community a safe and comfortable place for all our residents by being responsible pet owners. This will not only protect anyone who may be walking or bicycling in the area, but also the pet owner who could be held legally responsible or possibly sued for failing to properly restrain their pet.

DOING REPAIR WORK ON YOUR HOMES EXTERIOR????
The ACC is receiving record numbers of requests to make improvements or changes to the exterior of homes. We thank you for your cooperation in filling out the forms before starting any work. If you are planning to do any repairs, re-roofing, re-painting, additions, pools, storage sheds, fencing or patio covers please turn in a request form for approval. Forms can be found in the newsletter or online at our website WWW.MPHOA.ORG. You may also pick up a form from the office during office hours.
RESIDENT COMMENT FORM
If you have noticed a problem in the subdivision you think needs taking care of, please complete the resident comment form and turn it in to the office. The subdivision gets a drive through inspection twice a month. Some problems may not be noticed at that time. It is helpful if residents can inform the office in writing of such problems. Having complaints in writing is helpful, if the association has to take legal steps in enforcing deed restriction violations. Our subdivision was formed 35 years ago and we need to take steps to keep it looking nice so the value of homes will continue to increase.

Katy ISD’s tradition of increasing student participation and strong performance on Advanced Placement (AP) exams continues as the district recently learned that each one of its six high school campuses showed an increase in the number of students participating in the exams. In addition, every high school campus exceeded the state and national percentage of AP students making a qualifying score of 3 or better on the exams. Katy ISD is among the 388 U.S. public school districts (one of only 23 in Texas) to be listed on the 2011 College Board AP Achievement List. This list identifies districts that simultaneously achieved increases in access to AP courses while maintaining or improving the rate of students earning a score of 3 or better on the exams – the score that generally qualifies a student for college credit. In May 2011, more than 3,000 Katy ISD students took more than 7,200 AP exams, with 79 percent of the exams earning a score of 3 or better. This reflects a 24 percent increase from 2010 in the number of exams earning these high scores. Advanced Placement and PreAP courses are designed to challenge students beyond grade level academic courses and prepare them for success in future advanced coursework. Katy ISD recognizes that support and encouragement from the campus, the teacher, and parents are critical to student success. Therefore, the district follows an inclusive enrollment model for AP and PreAP courses that provides support systems for student success. Katy ISD offers AP courses in English, mathematics, science, social studies, fine arts, computer science and languages other than English. For more information about AP or PreAP, visit www.katyisd.org/gt.

PLUMBING IF YOU MENTION THIS AD
Chamber members and non-members are invited to participate in the discussion on how the region addresses mobility challenges in the face of continued growth. There will be two sessions with a luncheon in between. The featured speaker is Commissioner Ned J. Holmes. Holmes is a commissioner of the Texas Transportation Commission, which oversees statewide activities of the Texas Department of Transportation. Additional forum speakers will be: Steve Clark, PE, ARUP; Mark Ellis, Gulf Coast Rail District and Texas State Representative Allen Fletcher. Currently, the chamber is working with the Texas Department of Transportation on the re-designation application process of U.S. 290 to an interstate status. The status change could possibly allow additional federal funds toward the proposed improvements of U.S. 290 along with allowing greater visibility for domestic and international firms seeking to relocate in the Cy-Fair Houston market sector. In addition, the construction of the SH 99; Segment E (I-10 West to U.S. 290) has begun with an anticipated completion over the next 18-24 months. Once completed, Segment E will allow an alternative route for commuters and businesses along U.S. 290 traveling to the West Houston Energy Corridor. The Mobility Forum will be Thursday, November 3rd from 10:30 AM to 2:00 PM at the Berry Center, 8877 Barker Cypress. Individual tickets are $60 and sponsorship tables of 10 range from $600 to $2,500. Lunch will be served. For more information, contact Casey Cargle at 281-373-1390 or casey@cyfairchamber.com or visit www. cyfairchamber.com.
