THE PRESIDENT’S LETTER

(from the Settlers Village HOA Board) Please take a moment to visit the neighborhood’s new website located at www.settlersvillagehoa.com. The Board is very interested in any and all feedback. (The HOA received a new complaint in October. The President has asked the exchange be shared with the entire neighborhood with the thought that if one person voices a concern, there are probably a dozen who have the same concern but do not voice it.) ••• On October 15, 2013 I spoke to Dolores Sue for HOA about the water restrictions and that irrigation around the pool area was on at 11 o’clock on the morning with a broken sprinkler head the was watering to concrete. How is it that the HOA is exempt from the water restriction because of extensive landscaping? Who voted for that? I’m sure it wasn’t the homeowners. Being a homeowner in Settlers Village and pay my dues, I have put a lot of money into landscaping I’m not exempt and because of the restrictions I have lost several plants and hedges. The restrictions are voluntary, yet we are being threatened with a $5,000 fine if we don’t follow the restrictions. The HOA SHOULD NOT be exempt and should follow the same restrictions. ••• Your question/comments have more facets than you may realize. I will try to address as best as I can. First, the HOA and the MUD are 2 different Boards and each has its own set of duties and

obligations towards a different base of customers. The HOA is part of the MUD, but the MUD is not obligated to the HOA in any way. The MUD’s Board has the fiduciary duty to provide dependable water and wastewater supplies/ capacity to MUD district 105, which is comprised of Settlers, Lakeview, Eagle Ranch and Jasmine Heights. Someone else asked about the water fines the other day and I referred the question to the MUD attorney. He explained that while everything is in stage 1, the water restrictions are strictly voluntary and no fines apply. Those fines will not apply until the district reaches stage 2. Formal enforcement is not yet in place at stage one and the district relies on call-ins or something they see as they go by. Last year, the Board had complete leeway to grant exemptions, but any exemption had to be formally requested in writing to be valid. This year is new to the MUD Board since the water restrictions are state ordered, specifically by the governor’s office and exemption power is restricted. While the district continues to follow its stage 1 water plan, we do not know what the state can or will do regarding enforcement. So “declaring” yourself exempt will have no merit in a court if it ever came to that. Your MUD taxes and water billings fund the MUD. Lakeville has independent water well and is able to continue irrigation as it sees fit - the MUD has no power over an individually owned well. The MUD also has limited authority over any of the schools’ use of irrigation.

Settlers HOA has the fiduciary duty to maintain the overall neighborhood’s appearance in order to protect the neighborhood and its property values. After losing thousands of dollars worth of trees in the park and entrances, the HOA formally applied for and received exemptions for irrigation that were good through 2012. As the dry weather set in this year, the HOA made the same application, which was rejected in late August. That was when the HOA discovered the source of the water restrictions was the state instead of the MUD. The HOA has a limited authority to irrigate over weekends/evenings. The Controllers are set accordingly and do have locks to prevent tampering. There are few issues with the entrance controllers, but the park controller is a constant thorn. It is old and runs off the pool building’s power grid. If power is interrupted to the building, whether by throwing the junction box switches (there is no lock there) or just one of the frequent power interruptions, the controller goes back to its factory settings and the HOA will not know unless someone either calls in or a director goes by and happens to see the issue. Since the Settlers HOA is virtually devoid of volunteers - it’s not the most efficient method. The building’s electrical system is less than reliable due to its age, but the HOA has plans coming together to replace the building in the next few months and with that, update the park’s electrical systems - that should bring power interruptions down. The maintenance fees paid to the HOA pay for everything from the water the HOA uses to electricity to power street lights to the upcoming replacement of the pool facility. They have no bearing on the MUD’s actions at all.

color, but doesn’t have the time to fix what is important. Water is a very precious commodity and should not be wasted. You can’t drink landscaping or concrete. Watering concrete is wasting water, plus the fact with the rain we have been getting there should be rain sensors in place and the time clock should not be running at all. The HOA is not setting a very good example for the community. Exactly what is the HOA doing with all the money that is supposed to be used to “keep up appearances” and maintain the grounds. ••• All we, as directors, can do is the best we can. All of the directors are strictly unpaid volunteers and have outside jobs and families. Using me as an example - I’m generally gone by 5:30 AM and back home by 6 PM. From that point, I’m the primary caregiver for a family member with MS, with all that entails, plus the cooking and cleaning. The management company does the drive-around you have indicated but only once a month for deed restriction issues. We thought more than that was too aggressive. One director volunteers her time for the yard of the month to do her drive around. She and her husband use it as some “together” time. But each director has their own issues that they deal with yet still find time to volunteer for a neighborhood where precious few volunteers exist.

For what it’s worth, when the building comes down, the irrigation will stop until the project is completed. Hopefully, we can put in the system upgrades you have suggested as part of the renovation if the cost is not too much for the budget. Again; Thanks.

Thank you for getting back to me so quickly. The fact still remains that the HOA is the keeper of the grounds and is required to abide by the water restrictions. The fact that the irrigation around the pool was running at 11 o’clock in the morning is not abiding by the water restrictions and that one sprinkler head was broken is the responsibility of the HOA, which is obvious that the HOA is not doing their job. HOA can drive around the neighborhood pick the prettiest house or tag a house because it is painted the wrong

odd-numbered addresses. Outdoor water use shall be prohibited between 6:00 AM and 9:00 PM. In the event no street address exists, only Customers living on the north and west side of a street may use water outdoors on Tuesdays and Saturdays with those on the South and East sides able to use outdoor watering on Wednesdays and Sundays. The Board is empowered per the water code to issue a penalty for violation of the drought contingency plan; not adhering to the voluntary measures would not technically be a “violation.” But if we go into stage 2 or 3 then it would be violation and subject to penalty. Penalties can include disconnection of service and fines up to $5,000 for each violation. Please also remember the rules regarding personal sign postings. The placing of private signs of any type onto county owned sign poles or Centerpoint owned lightpoles is expressly prohibited per Texas House bill. Please do not subject yourself to the embarrassment of having your signs removed by the HOA or having a deputy come tell you that they must be removed. Jurisdiction for enforcement is shared by the Harris County JP and District courts. While the deputies have been asked to be lenient toward illegal signage, a discussion is now underway to allow the deputies to issue citations to offenders as more than enough time has passed to allow everyone to become familiar with the new rules. The HOA is also considering levying civil fines related to the costs of clean-up. Lastly, a quick reminder that Steve Breard is still collecting aluminum cans for the neighborhood with all proceeds going to the capital improvement fund for our pool. In 2010 we collected $278, $297 in 2011 and $306 in 2012. We have collected $160 so far in 2013. Please rinse and bag the cans to minimize the attraction to bugs. They can be dropped at 6642 Cove Lake.

Settlers will continue giving increased attention toward property upkeep. While the HOA is also closely monitoring the water well situation with MUD #105, property owners will be expected to maintain their property as required by their deed restrictions. Property owners should, by now, understand that keeping your yard mowed and trimmed (and this includes trees and bushes) is one of the least expensive methods to maintaining your property value. As with maintenance fees, timely action and response to violations is your obligation as a resident and/or a property owner. Ignoring a problem will not make it go away but it will make it more expensive as the lawyers become involved. 4. Ratio of residents to renters. Settlers Village has 1,048 residential properties. Owners who are residents number 854 or 83.24% of the total. Rental properties number 172 or 16.86% of the total.

CHIROPRACTIC HEALTH and WELLNESS CENTER Please remember to abide by the laws the legislature has put into place regarding personal signage. It is very embarrassing to have an officer show up at your home to remind you the practice of placing personal signage on county owned sign poles and Centerpoint owned streetlights is not allowed. The HOA is allowing officers to issue citations to offenders at the officers’ discretion. The HOA is also instituting fines for property owners for the clean-up of unauthorized or improperly mounted signage. Anyone 16 years of age and is subject to the county’s curfew and must be off the streets between midnight and 6 AM. Also included are daytime school hours between 8 AM and 2 PM. This applies to home schooled children as well. Officers have instructions to either arrest offenders or take them home to their parents. As always, if you see anything or anyone that looks suspicious or out of place, please call the deputies to investigate at 713-463-6666 or use 911 if it is an emergency. Deputies do not need to come by your house is you feel that might cause problems or endanger your family.

HARRIS COUNTY MUD 105 MEETING

The Board of Directors of Harris County Municipal Utility District No. 105 (“District”) met at 1825 North Mason Road, Katy, Harris County, Texas 77449 on August 19, 2013. Directors present, as follows: Steve Breard, President Charles LaConti, Vice President Stanley Craig, Assistant Vice President Pamela Brandenburg, Assistant Secretary The meeting was called to order and declared open for such business as might regularly come before it. The Board considered the minutes of the meeting held on July 15, 2013 and approved the minutes as presented.

The tax assessor-collector’s report and SPA report noted that 2012 taxes are 98.4% collected. After further review and discussion, the Board unanimously approved the tax assessor-collector’s report as presented as well as the bookkeepers report. The Board reviewed the operator’s report. The latter indicated the District has 2,361 active connections and 91.9% water accountability. The operator then submitted a list of delinquent accounts to the Board for termination of utility service and stated that the accounts in question have been given written notification of the opportunity to appear, either in person or in writing, at the Board meeting. The operator noted that the accounts listed had neither attended today’s meeting nor contacted the operator’s office or the District to contest or explain the charges. The Board unanimously authorized the District operator to proceed with termination of the utility service and approved the operator’s report as presented. The Board also approved some changes in the District’s rate order. Sewer rates will be rising on October 1st. Additional fee hikes are expected at some point from West Harris County Regional Water Authority and from Best Trash. Jeff Vogler and Norm Scholes presented an engineer’s report. With respect to Well No. 4 to located at the Liberty Valley Water Plant, the plans have been submitted for agency review at an expected cost of construction of $600,000. As noted previously the TCEQ granted the request to negotiate bids for the new well on an emergency basis. The Water Plant #3 design phase is well under way with a projected construction cost of $3,500,000. It is expected to be located on the new school site off FM 529. TXDOT is requiring the district to remove an older interconnect along FM 529 to accommodate new road construction. The expected cost is unknown but undid the plan to abandon the line and leave it in place at a much lower cost. With respect to the Well No. 2 rehabilitation, the cleaning and chlorination

system is underway and the district has authorized the payment of $211,893 plus another $11,900 in change orders. 173. Water well number 3 expansion is expected to be completed October 17th. On each regularly scheduled collection day, Best Trash will collect residential refuse at the curbside. Trees, shrubs, brush trimmings and fencing must be bundled in lengths no greater than 4 feet with no branch diameter larger than 4 inches and bundles weighing no more than 40 lbs. If a resident does not notify Best Trash of such a special pick-up before its scheduled day, Best Trash will leave a notice for the resident to contact Best Trash during normal business hours before the next scheduled pick up day. On December 12th, 13th & 14th the Cy-Fair Educational Foundation will host the Cypress Hoops Invitational. A boys varsity basketball tournament including the 10 CFISD boys varsity teams and 14 out of district teams. Games will be played at Cy-Lakes High School, Cy-Ranch High School, Langham Creek High School and the Berry Center. This year’s tournament will feature five of the top twenty teams in the state including the number one ranked team in the state.

Cypress-Fairbanks ISD was consolidated on Dec. 9, 1939, which means our 75th Anniversary is around the corner. The actual anniversary date is Dec. 9, 2014 and various projects are currently underway to make it a memorable 2014 - 2015 school year. During this event, we will identify 75 honorees and we need your help. The anniversary honoree designation committee is looking for people or families who have significantly impacted the CFISD community and district during the last 75 years. We want to particularly identify those that have truly captured the anniversary philosophy: “Our children. Our schools. Messiah Lutheran Church is hosting “A Night in Bethlehem” on Saturday and Sunday evenings, December 7th and 8th, 5-8 PM. The event is free, Messiah’s gift to the community. Messiah’s Night in Bethlehem is an outdoor, interactive event where individuals and families are invited to stroll through Bethlehem at their own pace, visiting with the citizens of Bethlehem. There are opportunities to pet the sheep and meet the village craftsmen, even say hi to BC the camel from the East, and of course, see the Baby Jesus and His family in the stable. • On Saturday, December 7th, the church will present a “live” Nativity Scene from 6 to 8 PM. At both the 8:30 and 10:45 AM services, the Chancel Chimes will be performing their Christmas music. At the 9:30 AM worship service, the Journey Praise Band will be leading worship with celebrative music. At all three services, Dr. Dave Meadows will be bringing an inspiring Advent message. • On Sunday, December 22nd, the Cornerstone Chancel Choir, accompanied by an orchestra, will be presenting a special Christmas music program entitled “Heaven’s Child” at both the 8:30 and the 10:45 AM services. At the 9:30 AM service, led by Journey Praise, the message will be a special “Advent-themed Readers Theater.” • On Christmas Eve, Tuesday, December 24th, Cornerstone will offer three worship opportunities: 4:00 PM, 6:00 PM and 11:00 PM. In addition to the singing of carols and Communion, children will be invited to the front of the church to hear the Christ Story and receive a special “Christmas” gift from the church. At 6:00 PM and 11:00 PM, there will be a traditional “Candlelight and Communion” service. It will include the retelling of the “Birth of Christ” through Scripture readings and hymns. All three services will include a “Candle Lighting Ceremony” with everyone lighting candles during the singing of “Silent Night.”
