Please take a moment to visit the neighborhood’s new website located at www.settlersvillagehoa.com. The Board is very interested in any and all feedback. While this will likely get published after the holidays, on behalf of the Settlers Village HOA, we wish the happiest of holidays and the best of the New Year to all of our residents in Settlers Village. Around 2 thousand years ago, the world was blessed with a small child that represented a profound change in the way people thought about themselves and the world around them. That child represented the hope of Peace on Earth, goodwill toward men/mankind. Unfortunately, the world of that time had a lot of trouble grasping this new way of thought and it had to grow through the work of individuals. Although Americans tend to view events in a local or even a national sense, the world continues to experience turmoil through any number of ordeals. There has been civil unrest, politicians who have lost the trust of constituents, terrorism and economic problems. Every day seems to bring some new challenge in a virtual never-ending litany. But, ever so faintly, that message of 2,000 years ago is still heard. Americans are the most diverse people that have ever existed in a single country. It is this country, regardless of the views of no small number of people, that continues to embrace that message - the very spirit of the Christmas season. Incredibly, that outlook has persisted regardless of race, religion and a host of other differences too many to count. There is no other country in the history of mankind that has contributed more in time and treasure, blood and life, to the betterment of man in every corner of the world. It is no secret that our country is not perfect. No country or instrument of mankind is or ever will be. To think any differently is delusional. But I invite every one of our Settlers residents to try and keep a piece of that Christmas message with them throughout 2016. The coming year looks like it will be no less trying as the last. But the message of Christmas is timeless and can be a massive source of consolation as one faces the world’s challenges. Merry Christmas to All!!! Happy New Year!!!

The HOA has begun deed restriction enforcement on fences that are in disrepair and on sidewalk pavement it considers a hazard to the neighborhood’s residents. These items are the responsibility of the property owner. If the HOA becomes involved, the cost to the property rises rapidly if the owner elects to do nothing. When you have a fence that faces the street or a common area, a property owner is contractually required to maintain that fence. When you have a fence shared by neighbors, contact your neighbor and work out a share agreement. Pavement issues will need to be evaluated for either having soil pumped in to bring it level or complete replacement. Dumping a load of asphalt will not be considered a valid repair and will be a waste of money when the HOA requires its removal while still requiring the original repair. Please remember the rules regarding personal sign postings. Because your HOA is now responsible for the upkeep of sign and light poles, placing of private signs of any type onto county owned sign poles or Centerpoint owned lightpoles is expressly prohibited. Please do not subject yourself to the embarrassment of having your signs removed by the HOA or receiving a ticket from the sheriff who now patrols the district. The HOA can now levy civil fines related to the costs of clean-up. Lastly, a quick reminder that Steve Breard has volunteered to continue collecting aluminum cans for the neighborhood with all proceeds going to the capital improvement fund for our pool. In 2012 we collected $306 and $177 in 2013. However we only collected $114 in 2014, a pretty significant decrease. For 2015, we have collected $65. Please rinse and bag the cans to minimize the attraction to bugs. They can be dropped at 6642 Cove Lake.

PLEASE REMEMBER: Commercial vehicles and trailers of any type are expressly forbidden to be stored on properties inside of Settlers Village. There also remains a number of fences that are in need of repair. This will also need to be addressed in the near term. The MUD has completed its repair project of the main sewer lines along Settlers Village and Whitwell and is preparing to inspect all of the others within the district. The project required no excavations so the HOA will be inspecting for sidewalks in need of repair. Homeowners are responsible for sidewalk maintenance for those walkways that run along your property. Sidewalks in poor condition open the property owner to the possibility of significant lawsuits so repairs should be made as quickly as possible. Pavement repairs cannot just involving dumping asphalt into a collapsed area. The property owner will need to investigate the cost of having the pavement “pumped” up by the insertion of soil underneath or replacing the pavement altogether. Property owners do need to submit an ARC approval request for the work.

Settlers will be continuing its policy to push residents for property upkeep as required by the deed restrictions. Residents should, by now, understand that keeping your yard mowed and trimmed (and this includes trees and bushes) is one of the least expensive methods to maintaining your property value. As with maintenance fees, timely action and response to violations are your obligations as a resident and/or a property owner. Ignoring a problem will not make it go away but it will make it more expensive as lawyers will become involved. If you know a house is abandoned and the yard in need of upkeep, please notify the HOA so the issue can be addressed.

With construction of the pool completed, the account balance has resumed its decline to something closer to normal levels. The Board reports that they anticipate the note on the pool to be paid off in 2016 or 2017. As of August 2015, the account balance is down 19.3% from last year. Of concern, though, is the number of delinquent properties, which rose from last year. The dollar delinquency is up 5.9% from last year at this time. The dollar amount of delinquency translates to the equivalent of 458 delinquent properties even though there are actually 229 properties (as opposed to 162 in 2014) in delinquency. This latter figure is based on the current Maintenance Fee cost per property of $318.

As Harris County Sheriffs’ deputies move to make their presence known, they have sought to increase visibility in the area. By targeting suspicious vehicles and persons, the deputies seek to be pro-active by encouraging potential issues not to bring their activity to the district. Traffic stops, aside from the fact that issues with people ignoring stop signs have become a problem again, also make that presence known. The numbers continue to show Settlers activity to be on the low side. Please remember to abide by the laws the legislature has put into place regarding personal signage. It is very embarrassing to have an officer show up at your home to remind you the practice of placing personal signage on county owned sign poles and Centerpoint owned streetlights is not allowed. The HOA is allowing officers to issue citations to offenders at the officers’ discretion. The HOA is also instituting fines for property owners for the clean-up of unauthorized or improperly mounted signage. Anyone 16 years of age and younger is subject to the county’s curfew and must be off the streets between midnight and 6 AM. All residents need to be aware that the Harris County Sheriff’s Department will be assuming law enforcement duties for the Harris County MUD #105. Those of you with home alarm systems need to be sure you have the police dispatch number changed to the dispatch number for the Harris County Sheriff for your system. However 911 will always accept calls for any emergency. Taylor Goodall, Jr. The meeting was called to order and the Board first considered and approved the minutes of the meeting held on September 21, 2015. The tax assessor-collector’s report was presented and unanimously approved by the Board as was the bookkeeper’s presentation and report. The Board discussed the District’s security contract implementation with Harris County Sheriffs’ Department Sergeant Wine, Deputy Hernandez, Deputy Riviera, Deputy Andrajda and Deputy Weatherall. There was discussion regarding the need for more street lighting on West Little York and a resident from Lakeville noted his appreciation in the change from the constable contract to the Harris County Sheriff’s Deputy contract. The tax assessor-collector had published notice of the District’s intent to hold a public hearing and set the 2015 tax rate at this meeting. The Board then called a public hearing on the District’s proposed 2015 tax rate. The Harris County Appraisal District appeared to have prepared and certified to the District’s tax assessor-collector the final 2015 appraisal roll of the District. The Board then considered the amount of taxes to be raised based on said valuation in order to meet debt service requirements on the District’s outstanding bonds and for maintenance purposes. The Board then passed and adopted an Order accepting the final appraisal roll and setting a tax rate of $0.56 for each $100 of assessed valuation shown on the appraisal roll for the purpose of debt service and a rate of $0.29 per $100 valuation for maintenance purposes. Greg Dubiel presented an operator’s report and reported that it appeared that the District’s water accountability issue has been resolved. The operator then submitted a list of delinquent accounts to the Board for termination of utility service and stated that the accounts

in question have been given written notification of the opportunity to appear, either in person or in writing, at the Board meeting to contest, explain or correct the charges, services or disconnection. The operator noted that the accounts listed had neither attended today’s meeting nor contacted the operator’s office or the District to contest or explain the charges. After discussion, the Board authorized the District operator to proceed with termination of the utility service and also approved the operator’s report as presented. The Board considered the modification of the interconnect agreement with Northwest Harris County MUD No. 12. Mr. Goodall reported that, prior to modification of the agreement as previously discussed and authorized, the engineers shall prepare a new exhibit noting the interconnect locations. The Board was also presented with an acknowledgment of assignment of reimbursables to Preferred Bank. Mr. Goodall reported that such acknowledgment was necessary for the developers of the industrial park. The Board approved the acknowledgment as presented. Jeff Vogler presented an engineer’s report and Mr. Vogler discussed the options regarding additional sanitary sewer line televising. It was decided that Mr. Vogler and the operator should proceed with more televising before beginning repairs. The owner of the home at 6222 Pleasant Stream noted that there has been a depression in his sidewalk since the District operator did some work in the area and Mr. Dubiel promised to address the situation. Mr. Goodall reported that his office had reviewed the proposed signs as provided by Penny Miller. It was noted that the total for removal of the old signs and installation of the new signs would be $7,900. The Board instructed Mr. Goodall to give Mr. Miller notice to proceed subject to Mr. Miller confirming with Director Craig the correct Sheriffs’ Department phone number on the signs. Mr. Goodall presented proposed changes to the District’s Order Establishing Code of Ethics, Policies and Procedures for District Financial Affairs and Management. The attorney noted that during

CHIROPRACTIC HEALTH and WELLNESS CENTER the last Texas legislative session, the law regarding disclosures of potential conflicts of interest was amended effective September 1, 2015 and will now require disclosure of family relationships between local government officers and vendors. The law also decreases the value of gifts a vendor may give to a local government officer without triggering a disclosure requirement to $100, down from $250. The law now provides that the only gifts that may be accepted by a local government official without triggering an obligation to file a conflicts disclosure statement are political contributions and food accepted as a guest. In other words, lodging, transportation and entertainment accepted as a guest are no longer exempt and are now required to be disclosed. Finally, the law expands the definition of local government officer to include agents. An agent is anyone who exercises discretion in the planning, recommending, selecting or contracting of a vendor. Agents include employees and can include consultants. The Board unanimously adopted the attached Order Establishing Code of Ethics, Policies and Procedures for District Financial Affairs and Management. The Harris County Municipal Utility District (MUD) Board #105 is an independent governmental agency that is completely separate from the Settlers Village Homeowners Association (SVHOA).

Best Trash picks up your trash on Tuesday and Friday. Your recycle collection day will be Friday. Please have trash and recyclables out to the curb by 7 AM. On each regularly scheduled collection day, Best Trash will collect residential refuse at the curbside. Trees, shrubs, brush trimmings and fencing must be bundled in lengths no greater than 4 feet with no branch diameter larger than

4 inches and bundles weighing no more than 40 lbs. The bundling is required to allow quick pickup and size limitations are required to avoid damage to the compacting equipment. Heavy/bulky items (appliances, furniture, carpet up to 1 room rolled up 4 ft. wide and weighing less than 50 lbs) will be picked up either collection day. By Federal Law, refrigerators, freezers or any other item containing Freon must have the Freon drained and have an accompanying bill to validate such service was performed. Items excluded from normal collection are dirt, rocks, bricks, tires, cement, batteries, motor or cooking oil, waste generated from a private contractor or any items deemed to be hazardous materials. Best Trash will leave a tag explaining the reasons for non-collection of the item. An enhanced feature of the new provider will allow for collection of items excluded by the contract if notified in advance. Best Trash will meet with the customer prior to collection day to determine a price to haul the non-contract items. If a resident does not notify Best Trash of such a special pick-up before its scheduled day, Best Trash will leave a notice for the resident to contact Best Trash during normal business hours before the next scheduled pick up day. Please do not dispose of gasoline, motor or cooking oil, paints or any other liquid item in a container that is not visible to Best Trash personnel. Best Trash will collect paper, plastics, aluminum and tin cans and glass (all colors) that are placed within the provided recycling bin, if items exceed container capacity, please place them adjacent to the bin marked as recyclable materials. If you find items left in your bin, it means they are not recyclable and the items should be disposed of in your trash container for the next scheduled pick up. Best Trash will provide each residence with one recycling bin and will replace any bins that are defective or otherwise become unusable through normal wear and tear. Theft, lost or additional bins can be purchased for $9 each by calling Best Trash. CFISD 2016-2017 & 2017-2018 BOUNDARY CHANGES
CFISD held a special-called Board meeting on Monday, Nov. 16, 2015 to propose high school and middle school boundary changes for the 2016-2017 school year and the 2017-2018 school year as a result of opening Cypress Park High School and High School No. 12. To review all proposed boundary changes and/or to provide input, visit the district website at www.cfisd.net and click on “Boundary Updates.” For additional information or questions regarding the proposed boundary changes, call 281-517-2187. The Board of Trustees will be reviewing all community input before making a final decision. The final decision will be made at the regularly scheduled board meeting on January 19, 2016.
CFISD MENTOR PROGRAM
The CFISD Mentor Program is a cooperative effort of volunteers from businesses, faith-based and/or non-profit organizations, the community and the school district designed to encourage students (elementary through high school) to finish school and focus on future education and career goals. A mentor is a suitable role model committed to helping a student with his/her academic and

social development. Currently, over 500 mentors are matched with students. To become a mentor, you must attend a training session (REGISTER); complete a global volunteer/mentor application and consent to a criminal history record check. On February 13, 2016, the Cy-Fair Educational Foundation (CFEF) will hold its 8th Annual Salute to Our Heroes Gala at the Omni Hotel. Joe Myers Ford Lincoln is generously underwriting this gala that honors the brave men and women who have served to protect our freedom and liberty. Salute to Our Heroes has raised more than half a million dollars over the past seven years. Proceeds from this event have funded three endowed scholarships. CFEF was established in 1970 as a non-profit to raise money to fund a scholarship for high school graduates in the area. Over the past 45 years, the Foundation has grown tremendously through the efforts of the Board of Trustees and the generosity of the Cy-Fair Community. The Foundation has awarded more than $6 million in scholarships to 1300 graduating seniors. CFEF is a 501(c)3 non-profit organization, all contributions are tax deductible, as allowed by the law. It only takes a few minutes for us to run them through the drills and then we will contact each player the week before they begin practices. After Monday, February 29th, we cannot guarantee a place on a team. They will practice for one hour a week on a Monday, Tuesday, Thursday or Friday. Practices begin the week of March 21st and the league runs through May 21st. The early cost will be $80 for those registering before February 23rd. After February 23rd, the cost will be $90. FORWARD BASKETBALL - HIGH SCHOOL GUYS Be a part of one of our basketball leagues. Practice/Games will be on Monday, Tuesday or Thursday nights.
