THE PRESIDENT’S LETTER

(from the Settlers Village HOA Board) Settlers village is offering a $1,000 reward for information leading to the arrest and conviction of those responsible for damaging the neighborhood sign on FM 529 @ Settlers Village. Preliminary information has been received and it does not look like the marquis will be repairable. At a cost of some $20,000, the felony case of vandalism now means big jail time when the offenders are caught. In response to concerns, the late night deputy has been replaced by deputy Gina Williams. The Settlers Board is considering an LED light for that entrance and another sign for the Fry Road entrance but the priority is not to drain funds for the pool project. The annual delinquency review has been completed and 51 properties were referred to collections. It is strongly recommended that if you received a communication from the Settlers’ attorney, that you address it promptly to keep the expenses from shooting into the stratosphere. They add up very quickly and this past year, the Board’s duty to Settlers is protect the neighborhood to the best of please contact Dolores Sue at PCMI or the attorney if you get one their letters and set up a pay plan. But, above all, do not ignore this obligation that you signed for in your house sale contract. By the time we publish, the Board hopes to have the new Settlers’ website up and running. The preliminary version might be a work in progress as we determine what information we need to have on it. This bears repeating one last time. Every newsletter reminds our residents that maintaining your yard is one of the least expensive methods available to preserve both your personal and the neighborhood’s property values. Last summer, thanks to unexpected water issues, the loss to trees and lawns was substantial. It was unfortunate that some residents made little to no effort to try and keep things neat. While the HOA was lenient in 2011 in regards to yard issues, the management company will be instructed for 2012 to bring the leniency practice to an end. Whether water is available or not, it is a contractual requirement of all property owners to Settlers Village to maintain their property and homes by mowing and edging. Other simple things you can do are picking up litter from your yard and fronting street(s) and putting your trashcans and other objects, such as children’s’ toys, out of sight when not needed. Fences must be maintained whether it is a single broken board or a whole section hanging askew and trees and bushes need to be kept clear of sidewalks. As less money is needed for delinquent properties, more will be freed to push on property enforcement. And there are charges to the property owner if the HOA has to send letters or force mow a property. So please make the effort. The Board is now reviewing each and every one of the noted deed restriction violations. If a resolution has not been made or if there has been no contact with PCMI, the attorney will have to be involved so that your Board

keep in mind that the inspector(s) do not check backyards unless someone asks them to and gives them access to see the violation. Current monies saved toward the pool project have reached $323,067.45. Again, as a reminder, the original plan was to build the pool in stages to keep from straining the neighborhood’s budget. Unfortunately, replacing the pool requires the replacement of the plumbing and piping. That, in turn, requires immediate attention to rework would be needed to bring the electrical up to code which is legally required by any extensive renovation to the building, the project will have to be structured into a single, large project. The minimum needed in the bank before beginning the project would be $472,000 or 80% of the total projected project’s cost. Some of you might have noticed the ongoing work in the pool. This work is designed to buy an extra 2 years of life or so for the pool surface rather than investing money in re-plastering costing around $15,000 for something we expect to demolish in 2 years. Please note that Best Trash has been selected by the Harris County MUD #105 to replace the current trash provider. Not only will they offer recycling services at an affordable rate, but the base cost is reduced. Starting June 1st, the new trash days for Settlers will Tuesday and Friday in order to avoid the major overloads on Monday caused by holiday weekends without Monday pick up. Please see their letter in this bulletin for more information. Please also remember the rules regarding personal sign postings. The placing of private signs of any type onto county owned sign poles or Centerpoint owned light poles is expressly prohibited per Texas House bill. Please do not subject yourself to the embarrassment of having your signs removed by the HOA or having a deputy come tell you that they must be removed. Jurisdiction for enforcement is shared by the Harris County JP and District courts. While the deputies have been asked to be lenient toward illegal signage, a discussion is now underway to allow the deputies to cite offenders as more than enough time has passed to allow everyone to become familiar with the new rules.

Heavy/bulky items (appliances, furniture, carpet up to 1 room rolled up 4 ft. wide and weighing less than 50 lbs) will be picked up either collection day. By Federal Law, refrigerators, freezers or any other item containing Freon must have the Freon drained and have an accompanying bill to validate such service was performed. Items excluded from normal collection are dirt, rocks, bricks, tires, cement, batteries, motor or cooking oil, waste generated from a private contractor or any items deemed to be hazardous materials. Best Trash will leave a tag explaining the reasons for non-collection of the item. An enhanced feature of the new provider will allow for collection of meet with the customer prior to collection day to determine a price to haul the non-contract items. If a resident does not notify Best Trash of such a special pick-up before its scheduled day, Best Trash will leave a notice for the resident to contact Best Trash during normal business hours before the next scheduled pick up day. Please do not dispose of gasoline, motor or cooking oil, paints or any other liquid item in a container that is not visible to Best Trash personnel. THIS IS NOT AN EMERGENCY. The Board of Directors of the District, all District residents themselves, have taken several proactive steps to correct this situation. Currently, the District receives all water from neighboring districts with compliant water. The District is expected this problem within the next few weeks. The Texas Commission on Environmental Quality (the “TCEQ�) has that the drinking water being supplied to its customers has exceeded MCL for ARSENIC at 0.010 mg/L and that it is a health concern at levels above the MCL. Analysis of the drinking water in your community for ARSENIC indicates a level of 0.013 mg/L regarding the running annual average for arsenic. THIS IS NOT AN EMERGENCY. However, some people who drink water containing arsenic in excess of the MCL over many years could experience skin damage or problems with their circulation system and may have an increased risk of getting cancer. You do not need to use an alternative water supply. However, if you have health concerns, you may want to talk to your doctor to get more information about how this may affect you.
