We have new law enforcement - it is now Harris County Sherriff and no longer the constable.

Please take a moment to visit the neighborhood’s new website located at www. settlersvillagehoa.com. The Board is very interested in any and all feedback. Please see the minutes of our Board meeting in August further in the newsletter. All residents should be aware that the annual property owners meeting is around the corner. The HOA will send letters to all of the addresses it has on record to notify everyone of the meeting particulars. Please make plans to attend. It will be a good time to tour your new recreation center. Your votes and input are incredibly valuable. Please make plans to attend. The HOA is preparing to move forward and begin deed restriction enforcement on fences that are in disrepair and on sidewalk pavement it considers a hazard to the neighborhood’s residents. These items are the responsibility of the property owner and should be attended to before the HOA becomes involved. The cost to the property rises rapidly if the owner elects to do nothing. When you have a fence that faces the street or a common area, it is up to the property owner to maintain that fence. When you have a fence shared by neighbors, contact your neighbor and work out a share agreement. Pavement issues will need to be evaluated for either having soil pumped in to bring it level or complete replacement. Dumping a load of asphalt will not be considered a valid repair. Please remember the rules regarding personal sign postings. The placing of private signs of any type onto county owned sign poles or Centerpoint owned lightpoles is expressly prohibited per Texas House bill. Please do not subject yourself to the embarrassment of having your signs removed by the HOA or having a deputy come tell you that they must be removed. The HOA is now levying civil fines related to the costs of clean-up. Lastly, a quick reminder that Steve Breard has volunteered to continue collecting aluminum cans for the neighborhood with all proceeds going to the capital improvement fund for our pool. In 2012 we collected $306 and $177 in 2013. However we only collected $114 in 2014, a pretty significant decrease. For 2015, we have collected $55 so far. Please rinse and bag the cans to minimize the attraction to bugs. They can be dropped at 6642 Cove Lake. ~ SETTLERS VILLAGE HOA

At the writing of this article, construction of the pool has been completed and the account balance has resumed its decline now that 2015 maintenance fees are absorbed and bills and loan payments start coming due. For now, though, the account balance for July 2015 is down 16.7% from last year. The number of delinquent properties rose from last year with the dollar delinquency rising 7.9% from last year at this time. The dollar amount of delinquency translates to the equivalent of 487 delinquent properties even though there are actually 237 properties (as opposed to 163 in 2014) in delinquency. This latter figure is based on the current Maintenance Fee cost per property of $318. 3. Deed Restriction Violations July 2014 June 2015 July 2015

Settlers is continuing its policy to push for property upkeep as required by their deed restrictions. Property owners should, by now, understand that keeping your yard mowed and trimmed (and this includes trees and bushes) is one of the least expensive methods to maintaining your property value. As with maintenance fees, timely action and response to violations are your obligations as a resident and/or a property owner. Ignoring a problem will not make it go away but it will make it more expensive as the lawyers become involved. And if you know a house is abandoned and the yard in need of upkeep, please notify the HOA and we will handle the issue.

PLEASE REMEMEBER: Commercial vehicles and trailers of any type are expressly forbidden to be stored on properties inside of Settlers Village. There also remain a number of fences that are in need of repair. This will also need to be addressed in the near term. The MUD has completed its repair project of the main sewer lines along Settlers Village and Whitwell and is preparing to inspect all of the others within the district. The project required no excavations so the HOA will be inspecting for sidewalks in need of repair. Homeowners are responsible for sidewalk maintenance for those walkways that run along your property. Sidewalks in poor condition open the property owner to the possibility of significant lawsuits so repairs should be made as reasonably quickly as possible. Pavement repairs cannot just involving dumping asphalt into a collapsed area. The property owner will need to investigate the cost of having the pavement “pumped” up by the insertion of soil underneath or replacing the pavement altogether. Property owners do need to submit an ARC approval request for the work.

SECURITY STATS
There are no statistics available for publication at this time. Please remember to abide by the laws the legislature has put into place regarding personal signage. It is very embarrassing to have an officer show up at your home to remind you the practice of placing personal signage on county owned sign poles and Centerpoint owned streetlights is not allowed. The HOA is allowing officers to issue citations to offenders at the officers’ discretion. The HOA is also instituting fines for property owners for the clean-up of unauthorized or improperly mounted signage. Anyone 16 years of age and younger is subject to the county’s curfew and must be off the streets between midnight and 6 AM. All residents need to be aware that the Harris County Sheriff’s Department will be assuming law enforcement duties for the MUD effective September 1st. The contract with the Harris County Constables terminated 31 August 2015. The MUD Board has not decided on a new contract at this time, but, those of you with home alarm systems need to be sure you have the police dispatch number changed for your system. Please also monitor for the changeover so you are calling the correct dispatch number should the need arise. However 911 will always accept calls for any emergency.

Financials The Board reviewed the financials as of July 31, 2015. The money in the bank totaled $999,052.87. This includes checking, savings accounts and CD’s and is the money to cover both operating expenses and the necessary reserve to fund maintenance and replacement of the Association’s capital assets. Financial attached as Exhibit “C.” Pool/Recreational Center President Rogers reported the facility is now complete. The alarm will be monitoring twenty four hours a day, seven days a week. The Board will have training on the system. There is one back light that needs a ballast and that should be completed soon. It was reported there have been six (6) inquires on clubhouse rentals. The Board discussed the deposit and usage fee. It was agreed by a majority of the Board the rate will continue to be $150 usage fee and $100 deposit for the remainder of this year. The Board will discuss the charges for 2016 in their budget meeting. The Board reviewed a draft of the rental contract and with changes it was accepted. NEW BUSINESS Community Events The Board discussed various community events. 1. Movie Night: With a vote of 4 approving and one abstention the vote carried to have a community movie night. 2. Holiday Party: There was discussion on having a holiday party with Santa Claus. With a vote of 4 approving and one no vote the vote carried. 3. Spring Festival: The Board agreed unanimously on a spring holiday event and eggs can be decorated for hunting. 4. National Night Out: The Board unanimously agreed this would be

a good event for the community. 5. Veterans Day: With all community events, it was decided to have November 11, 2015 celebrations for Veterans showing appreciation to all veterans. Future Plans: President Rogers asked the Board if they thought it would be good idea to have walking trail around the recreation facility. It was discussed but no vote was taken. Next Board Meeting The next Board of Directors meeting will be September 22, 2015. It will be the 2016 budget meeting. The Board unanimously agreed to have this meeting at PCMI as all of the invoices, paperwork and history are easily accessible from the office. Open Forum for Homeowner Discussion A resident asked what happened to the Neighborhood Watch. It was explained that there was simply not enough volunteers. He reported seeing a suspicious person walking down the street at 4:30 AM. The Board reminded him to call the constable’s and/or sheriff’s department to report suspicious activity At 8:25 the Board adjourned to Executive Session. Decisions Made During Executive Session The Board reviewed the deed restriction violations and the disposition of same. All business being concluded, the meeting adjourned at 8:30 PM.

Director Steve Breard presented his resignation from the Board of Directors. The Board considered the appointment of a director to fill the vacancy and it was moved, seconded and unanimously approved appointing Barbara Lynch for the remainder of the unexpired term. Ms. Lynch took her oath of office and was included under the District’s Directors Performance Schedule Blanket Bond. Director Lynch participated in the remainder of the meeting.

The Board considered the Interlocal Agreement for Harris County sheriffs’ deputy patrols to begin October 3, 2015. Mr. Goodall reported the agreement had not yet been received but sought Board approval to execute the agreement upon receipt and consistent with the terms previously approved by the Board. The Board also approved the engagement of Brian Krueger to produce an Agreed Upon Procedures Report. An additional $250 should be authorized for Harris County sheriffs’ deputies to monitor out of contract patrol deputies and Director Craig shall be the primary liaison in that regard with relevant items copied to Mr. Goodall. The tax assessor-collector’s report was unanimously approved by the Board as was the bookkeeper’s presentation and report. The Board further declined to participate in this years’ Water Wise program due to the significant increase in cost. The Board then reviewed the draft budget for 2016. It was noted that the budget will be adopted in the September meeting. The Board considered the operator’s report and noted the water accountability is once again becoming an issue. A leak detection survey was recommended. Monthly operations invoices were not received by the directors and the operator agreed to forward those as soon as possible. Director Craig also requested the operator to check into a vacant house that appear to still have water service and water theft might be an issue. The operator submitted a list of delinquent accounts to the Board for termination of utility service and stated that the accounts in question have been given written notification of the opportunity to appear, either in person or in writing, at the Board meeting. The operator noted that the accounts listed had neither attended today’s meeting nor contacted the operator’s office or the District to contest or explain the charges. The Board unanimously authorized the District operator to proceed with termination of the utility service and approved the operator’s report as presented. Jeff Vogler presented the engineers’ report and contracts have been submitted for the televising of the sanitary sewer lines. The waste discharge permit amendment has been submitted to the TCEQ. Bids are anticipated to be received for the wastewater treatment facility expansion project in September of this year. The Engineer will resubmit the elevated storage tank request waiver request after 36 months of non-interconnect flow data is available. The Board authorized the execution of a buffer zone easement as part of the wastewater treatment plant discharge permit process and there was an extensive discussion regarding upcoming Harris County plans to widen West Little York. A District fence will need to be replaced due to

The Board approved payments totaling $44,508.14 towards the sanitary sewer line report along Whitwell and Settlers Village. The Board also authorized the engineer to reach out to his contacts in Harris County for the placement of a 4-way stop or stoplights at the intersection of Whitwell and West Little York. The Board also considered the status of the Series 2016 $6,500,000 which the Board approved bond application resolution and authorized filing of the application with the Texas Commission on Environmental Quality. Mr. Goodall reported that the developer, Jeff Vogler and himself will hold a July 29th meeting to review a proposed cost summary, calendar of events and a consultation with John Howell regarding the feasibility of the application. Director Lynch abstained. John Howell presented an analysis regarding the DR Horton request for the District to issue a Bond Anticipation Note by the end of September 2015 for approximately $1,700,000 in reimbursement. The Board approved moving forward with the Note issuance upon the schedule and terms provided by Mr. Howell. The Harris County Municipal Utility District (MUD) Board #105 is an independent governmental agency that is completely separate from the Settlers Village Homeowners Association (SVHOA).

Never wash cooking fats, oil or grease (FOG) down the drain, as they can cause the sewer line to back up into your home. If the drain clogs and causes a sewer line blockage it may cause the back up to flow onto the street and into the storm drains, which flow to our bayous and eventually Galveston Bay. The Harris County Household Hazardous Waste Facility provides a free residential FOG drop-off site for easy disposal. FOG items can be recycled into bio-diesel fuels, a feed additive for animals and other processes that save natural resources. Please do NOT mix FOG with any other items, such as automotive waste (no auto oils or lubricants) because if these are mixed they cannot be recycled. Also, please bring your FOG in a container that we can keep. This service is for residents of Harris County only. No restaurants will be serviced. PROPER DISPOSAL HELPS EVERYONE! Storage • Keep the lid tightly closed and place the containers in an area where they will not be affected by heat, cold or moisture. • Keep the product in its original container. If you need to transfer some of the product to another container, make sure the new container is properly labeled with the product information. • Store similar products together and do not store flammables (gas, oil, paint thinners, etc) next to pool chemicals or bleaches. • Store pool chemicals in a well ventilated location and never mix pool chemicals together. Also, never add products to an empty pool container. • Never mix any household cleaners together. Some may contain chemicals that will react with one another causing harmful fumes or a fire. • Strong acids, like battery acid or pool acid (Muriatic Acid), may corrode or damage their container. They can even damage the garage floor. It might be wise to place these in a plastic pan so you will have a secondary container if the original container breaks. Disposal Some products that you think may not be harmful could actually be dangerous to you, your pets and the environment. Always check the products label to see if it has proper disposal information listed. Bring HHW that you no longer want or use to your local HHW Collection Facility to dispose of them responsibly. If you have a product in good condition that you no longer want, ask a neighbor or a family member if they can use it.

What to do with leftover paint, fertilizer or motor oil? Well, take them to the HARRIS COUNTY HOUSEHOLD HAZARDOUS WASTE FACILITY located at 6900 Hahl Road on the northwest corner of Gessner and 290. Household Hazardous Waste (HHW) is items that can become dangerous to your family, pets and the environment when they are old or no longer wanted. This facility disposes of them in a safe and environmentally responsible manner. Approximately 70% of the material collected at the facility are recycled or used for energy recovery. Items that are accepted include household cleaners, yard products (pesticides, fertilizers and herbicides), automotive products (oil, antifreeze, gasoline), pool chemicals, paints and paint related products, batteries, aerosol cans, small and BBQ propane cylinders, tires and items containing mercury (thermostats and thermometers). Items that will not be accepted include electronic waste from businesses, ammunition and firecrackers, household appliances, municipal trash and medical/biological/radioactive wastes. This service is free and the facility is open on Wednesdays from 9 AM to 3 PM and the 2nd Saturday of the month from 9 AM to 2 PM. Collections are also held on the 4th Sunday of the month (location and schedule can be seen on www.eng.hctx.net/watershed/hhw_home.htl). Best Trash picks up your trash on Tuesday and Friday. Your recycle collection day will be Friday. Please have trash and recyclables out to the curb by 7 AM. On each regularly scheduled collection day, Best Trash will collect residential refuse at the curbside. Trees, shrubs, brush trimmings and fencing must be bundled in lengths no greater than 4 feet with no branch diameter larger than 4 inches and bundles weighing no more than 40 lbs. The bundling is required to allow quick pickup and size limitations are required to avoid damage to the compacting equipment. Heavy/bulky items (appliances, furniture, carpet up to 1 room rolled up 4 ft. wide and weighing less than 50 lbs) will be picked up either collection day. By Federal Law, refrigerators, freezers or any other item containing Freon must have the Freon drained and have an accompanying bill to validate such service was performed. Items excluded from normal collection are dirt, rocks, bricks, tires, cement, batteries, motor or cooking oil, waste generated from a private contractor or any items deemed to be hazardous materials. Best Trash will leave a tag explaining the reasons for noncollection of the item. An enhanced feature of the new provider will allow for collection of items excluded by the contract if notified in advance. Best Trash will meet with the customer prior to collection day to determine a price to haul the non-contract items. If a resident does not notify Best Trash of such a special pick-up before its scheduled day, Best Trash will leave a notice for the resident to contact Best Trash during normal business hours before the next scheduled pick up day. Please do not dispose of gasoline, motor or cooking oil, paints or any other liquid item in a container that is not visible to Best Trash personnel. If not visible and results in spillage that causes a stain, Best Trash will not be responsible for clean-up. Best trash takes great pride in our recycling efforts ensuring the best program for our customers. Please remove caps, liquids and food products from inside containers. Please use the provided recycle bins for recyclable material and not as extra trash bins. Best Trash will collect paper, plastics, aluminum and tin cans and glass (all colors) that are placed within the provided recycling bin, if items exceed container capacity, please place

them adjacent to the bin marked as recyclable materials. If you find items left in your bin, it means they are not recyclable and the items should be disposed of in your trash container for the next scheduled pick up. Best Trash will provide each residence with one recycling bin and will replace any bins that are defective or otherwise become unusable through normal wear and tear. Theft, lost or additional bins can be purchased for $9 each by calling Best Trash.
