We have new law enforcement - it is now Harris County Sherriff and no longer the constable.

Please remember the rules regarding personal sign postings. The placing of private signs of any type onto county owned sign poles or Centerpoint owned lightpoles is expressly prohibited per Texas House bill. Please do not subject yourself to the embarrassment of having your signs removed by the HOA or having a deputy come tell you that they must be removed. The HOA is now levying civil fines related to the costs of clean-up. Lastly, a quick reminder that Steve Breard has volunteered to continue collecting aluminum cans for the neighborhood with all proceeds going to the capital improvement fund for our pool. In 2012 we collected $306 and $177 in 2013. However we only collected $114 in 2014, a pretty significant decrease. For 2015, we have collected $45 so far. Please rinse and bag the cans to minimize the attraction to bugs. They can be dropped at 6642 Cove Lake. SETTLERS VILLAGE HOA

At the writing of this article, construction of the pool has been completed and the account balance has resumed its decline now that 2015 maintenance fees are absorbed and bills and loan payments start coming due. For now, though, the account balance for July 2015 is down 16.7% from last year. The number of delinquent properties rose from last year with the dollar delinquency rising 7.9% from last year at this time. The dollar amount of delinquency translates to the equivalent of 487 delinquent properties even though there are actually 237 properties (as opposed to 163 in 2014) in delinquency. This latter figure is based on the current Maintenance Fee cost per property of $318. 3. Deed Restriction Violations July 2014 June 2015 July 2015

Settlers is continuing its policy to push for property upkeep as required by their deed restrictions. Property owners should, by now, understand that keeping your yard mowed and trimmed (and this includes trees and bushes) is one of the least expensive methods to maintaining your property value. As with maintenance fees, timely action and response to violations are your obligations as a resident and/or a property owner. Ignoring a problem will not make it go away but it will make it more expensive as the lawyers become involved. And if you know a house is abandoned and the yard in need of upkeep, please notify the HOA and we will handle the issue. PLEASE REMEMEBER: Commercial vehicles and trailers of any type are expressly forbidden to be stored on properties inside of Settlers Village. There also remain a number of fences that are in need of repair. This will also need to be addressed in the near term. The MUD has completed its repair project of the main sewer lines along Settlers Village and Whitwell and is preparing to inspect all of the others within the district. The project required no excavations so the HOA will be inspecting for sidewalks in need of repair.

Homeowners are responsible for sidewalk maintenance for those walkways that run along your property. Sidewalks in poor condition open the property owner to the possibility of significant lawsuits so repairs should be made as reasonably quickly as possible. Pavement repairs cannot just involving dumping asphalt into a collapsed area. The property owner will need to investigate the cost of having the pavement “pumped” up by the insertion of soil underneath or replacing the pavement altogether. Property owners do need to submit an ARC approval request for the work. 4. Ratio of residents to renters. Settlers Village has 1,048 residential properties. Resident/Owners currently number 85.03% of the total. Rental properties number 14.97% of the total.

Please remember to abide by the laws the legislature has put into place regarding personal signage. It is very embarrassing to have an officer show up at your home to remind you the practice of placing personal signage on county owned sign poles and Centerpoint owned streetlights is not allowed. The HOA is allowing officers to issue citations to offenders at the officers’ discretion. The HOA is also instituting fines for property owners for the clean-up of unauthorized or improperly mounted signage.

All residents need to be aware that the Harris County Sheriff’s Department will be assuming law enforcement duties for the MUD effective September 1st. The contract with the Harris County Constables terminated 31 August 2015. The MUD Board has not decided on a new contract at this time, but, those of you with home alarm systems need to be sure you have the police dispatch number changed for your system. Please also monitor for the changeover so you are calling the correct dispatch number should the need arise. However 911 will always accept calls for any emergency. While there is no security contract, there are no statistics for publication and I cannot predict they will be available at some point in the future. Unless circumstances change, this will be the last publication of Security stats.
HOMICIDE IN SETTLERS VILLAGE
August 29, 2015: On Saturday morning, Jordan Taylor 20 was found shot to death inside his girlfriend’s car which was parked in her driveway in the 21,000 block of Diamond Rock Court in Katy. Neighbors have indicated they have virtually no information about how or why this happened. According to Channel 2 KPRC news, however, many neighbors are not willing to talk on camera with some stating they are afraid to leave their homes. It didn’t take neighbors long, however, to show how much they care by leaving two stuffed animals - a rabbit and a tiger - along with a heartfelt message as a tribute. According to the Harris County Medical Examiner’s Office, Taylor was shot multiple times. Another neighbor told KPRC 2 News that Taylor wasn’t wearing shoes and part of his body was hanging out of the vehicle. A man at the home where Taylor’s girlfriend lives said he knew nothing about what happened and asked that people respect his family’s privacy.

Taylor’s family is desperate for answers and is asking for the public’s help. If you have any information, please contact the Harris County Sheriffs’ office. Remember crime prevention is everybody’s business.
SETTLERS VILLAGE COMMUNITY IMPROVEMENT ASSOCIATION, INC. BOARD OF DIRECTORS MEETING MAY 12, 2015
A Board of Directors meeting was held at the offices of Planned Community Management, 15995 N. Barkers Landing, Suite 162, Houston, TX 77079. Notice attached as exhibit “A.” Board Members in attendance were Rick Davenport, Tulibelle Igartua-Martinez, Kim Rogers, Kathy Cones and Aungela Thomas. Dolores Sue was in attendance, representing Planned Community Management (PCMI). With a quorum present, President Rogers called the meeting to order at 6:09 PM. Three homeowners were present. The homeowners present wanted to discuss a home with a deed restriction violation. The Board explained this was being addressed but could not discuss individual accounts. The Board offered to inform the health department again but this resident stated he is taking care of the issue. One resident was concerned about not having a shower at the pool area. He definitely wants a shower. The Board agreed to look into the installation of a shower.

A resident asked if a soil sample was going to be gathered for the playground kiddy cushion. The answer was no sample will be taken. He said he will be taking the soil sample himself. Minutes The Board unanimously approved the minutes of the Board meeting held March 24, 2015. Minutes attached as Exhibit “B.” Financials The Board reviewed the financials as of April 30, 2015. The money in the bank totaled $1,216,714.03. This includes checking, savings accounts and CD’s and is the money to cover both operating expenses and the necessary reserve to fund maintenance and replacement of the Association’s capital assets. Financial attached as Exhibit “C.” Pool/Recreational Center President Rogers reported no less expensive marque sign has been found. It may be that instead of a marque sign there will be just a nice sign stating Settlers Village Recreational Facility. The pool company is striving for completion for Memorial Day Weekend.

Pool Rules Sign The Board previously made changes to the pool rules sign and unanimously agreed to accept the pool rules sign as presented. Pool Opening Announcement PCMI reported they had sent the pool opening announcement for Memorial Day weekend and ask the contractor to sign off on it, they did not. President Rogers explained he will get with the general contractor. The Board is being told the pool will open Memorial Day Weekend.

Pool Contract The Board reviewed two (2) proposals for the pool maintenance contractor. After due discussion it was unanimously agreed to select Sweetwater Pools. They are the company installing the pool and this way if something should go wrong they are there and everything should be under warranty. The cost of this contract is $33,321.33. Pool Rentals for Private Parties PCMI has been asked the cost for renting both the pool and clubhouse. The Board unanimously agreed the pool and the clubhouse could not be rented at the same time for liability reasons. It was unanimously agreed that only cashier’s checks and money orders will be accepted. There will be a $100 deposit and a $100 usage fee. The deposit will be cashed, however, if the clubhouse is left in good condition they will receive a check for the deposit. There will be no alcohol allowed in the pool or clubhouse at any time. Engraving of Bricks The brick company will engrave the bricks for a cost of $15 per brick. The Board will sell the bricks for the walkway at the recreational facility. Proposals on Security System President Rogers reported he was able to come up with two (2) proposals for the new system. The Board unanimously agreed that Balmore Benitez was the best system. However, this will only be accepted with the stipulations on response time, back up in case of breaks, contact information and warranties. If this company provides all the needed items President Rogers will sign the contract. Pool Chairs, Lighting and Two Large Ceiling Fans The Board approved President Rogers purchase pool chairs, lighting and ceiling fans at Home Depot. The cost was $1,338.38.

HARRIS COUNTY MUD 105 MEETING
Steve Breard, an area volunteer with almost 20 years of service, has retired from the Board of Directors of the Harris County Municipal Utility District #105. Steve was a member of the Board when the district consisted only of a few hundred homes that was Settlers Village. Today the district has more than quadrupled and consists of 5 neighborhoods, commercial properties and schools. Steve has indicated that he plans to spend more time with his family who recently welcomed their third granddaughter. He is also a fulltime care-giver for his wife who has multiple sclerosis. The Board of Directors of Harris County Municipal Utility District No. 105 (“District”) met at 1825 North Mason Road, Katy, Harris County, Texas 77449 on July 20, 2015. Directors present, as follows: Pamela Brandenburg, President Charles LaConti, Vice President Kathy Cones, Secretary Stanley Craig, Assistant Vice-President Steve Breard, Assistant Secretary Also present were Jeff Vogler, Kristen Scott, Bob Ideus, Greg Dubiel, Robert Moorman, Parry Miller and G. The meeting was called to order and declared open for such business as might regularly come before it. The Board considered the minutes of the meeting held on June 22, 2015 and approved the minutes as presented. The tax assessor-collector’s report was unanimously approved by the Board as was the bookkeeper’s presentation and report. The Board then considered the District participation in the Water Wise program. It was noted that the cost to the District had increased substantially. It was also noted that it was unclear if both elementary schools were being sponsored or just one. It was decided that the item will be tabled pending a further investigation by the district’s attorney. The Board considered the operator’s report and reviewed the larger maintenance items with the board and noted the arsenic filter was shipped for regeneration. The operator submitted a list of delinquent accounts to the Board for termination of utility service and stated that the accounts in question have been given written notification of the opportunity to appear, either in person or in writing, at the Board meeting. The operator noted that the accounts listed had neither attended today’s meeting nor contacted the operator’s office or the District to contest or explain the charges. The Board unanimously authorized the District operator to proceed with termination of the utility service and approved the operator’s report as presented. Jeff Vogler presented the engineers’ report and presented a lengthy discussion regarding receiving bids for televising of the sanitary sewer lines. The Board authorized awarding the bid to Clean Services as the low bidder for the sanitary project and to advertise for bids for the Cypress Oaks, Section Two water, sewer and drainage project. The

Board also approved Camino Services proposal for Stockton Falls and Sandy Valley. The Board also considered the status of the Series 2016 bond application. Mr. Goodall reported that the developer, Jeff Vogler and himself will hold a July 29th meeting to review a proposed cost summary, calendar of events and a consultation with John Howell regarding the feasibility of the application. The Board considered the Interlocal Agreement with Harris County for Constable patrols and voted to terminate the contract effective August 3, 2015. A new contract has not yet been requested by the Board so any such a contract will be considered at a later date. The Harris County Municipal Utility District (MUD) Board #105 is an independent governmental agency that is completely separate from the Settlers Village Homeowners Association (SVHOA).

What to do with leftover paint, fertilizer or motor oil? Well, take them to the HARRIS COUNTY HOUSEHOLD HAZARDOUS WASTE FACILITY located at 6900 Hahl Road on the northwest corner of Gessner and 290. Household Hazardous Waste (HHW) is items that can become dangerous to your family, pets and the environment when they are old or no longer wanted. Best Trash picks up your trash on Tuesday and Friday. Your recycle collection day will be Friday. Please have trash and recyclables out to the curb by 7 AM. On each regularly scheduled collection day, Best Trash will collect residential refuse at the curbside. Trees, shrubs, brush trimmings and fencing must be bundled in lengths no greater than 4 feet with no branch diameter larger than 4 inches and bundles weighing no more than 40 lbs. The bundling is required to allow quick pickup and size limitations are required to avoid damage to the compacting equipment. Heavy/bulky items (appliances, furniture, carpet up to 1 room rolled up 4 ft. wide and weighing less than 50 lbs) will be picked up either collection day. item containing Freon must have the Freon drained and have an accompanying bill to validate such service was performed. Items excluded from normal collection are dirt, rocks, bricks, tires, cement, batteries, motor or cooking oil, waste generated from a private contractor or any items deemed to be hazardous materials. Best Trash will leave a tag explaining the reasons for non-collection of the item. An enhanced feature of the new provider will allow for collection of items excluded by the contract if notified in advance. • Dig and store caladiums before the foliage dies. Allow the bulbs to dry in the shade, shake off the dried soil and dust with sulphur to control fungus. Store by hanging in open mesh bags or old panty hose. • Flowers planted for spring can begin when the temperatures are going to stay cooler. Shrubs and trees can be planted now. Woody plants concentrate on root growth through the winter and the more headstart they can get before summer, the better. • October 15th is about the time for dividing and planting daylilies. • Watch out for brown patch in St. Augustine grass. These circular brown patches are caused by a fungus that is activated by moist cool weather. Control with Daconil. • If you need to do any pruning, do it early in the month. The re-growth stimulated by pruning needs to harden off before that odd-ball frost of Halloween. Prune fruit trees when leaves begin to fall. Remove all dead, weak and over-crowded growth. Tip back main branches to control size and shape. Spray w/dormant oil when temperature is between 30-60 degrees. • Cut back tops of perennials after they have bloomed. Divide roots and transplant anytime from now until March, the earlier the better. • Get the ant baits down. This will greatly reduce your spring populations. • Clover left over from last year may be growing. It’s best to hit it with the postemerge herbicides in October and November. At least two applications are usually needed, even if done this early. • For color throughout the winter, begin planting pansies.
