MERRY CHRISTMAS

Despite the dire predictions of these last few months and the shenanigans in Washington DC, we have prevailed and made it through to yet another Christmas! It’s good to realize that life goes on - irrespective of the antics of our politicians played up incessantly by the taking heads of our media. This is the time of year when we should be able to shut out such nonsense and remind ourselves of what is really important in life: Our families, our friends and our spiritual and personal values. It is a wonderful time to be with our families, especially the young ones and to enjoy the fellowship of our friends and neighbors. As we do so, let us yet again, not lose sight of the fact that we are immeasurably more fortunate than so many people in this World. This is a good time of the year to reflect on this, help as we can and never forget to give thanks in our own way for our many blessings. Whether you are staying home for the holiday or plan to travel, have fun and stay safe. Remember there is a whole new year awaiting just around the corner. Make sure that you and your loved ones are around to enjoy it! Your Board of Directors would like to wish all our residents a safe and very happy holiday.

CHRISTMAS YARD OF THE MONTH DECORATING CONTEST

One of the good things that Christmas brings us, is the opportunity to see and enjoy the beautifully decorated homes in our neighborhood in celebration of the Christmas Holiday. In accordance with our long tradition, we will once again be holding the Christmas Holiday Yard Contest. On the weekend of December 14th and 15th, we will choose a 1st, 2nd and 3rd place yard and put the corresponding award signs in these yards where they will remain for the remainder of the month. Photographs of these award winners will also be posted on our website and these winners will be mentioned in the February edition of the community newsletter. Williamsburg Settlement is such a beautiful subdivision all year long and at Christmas our residents really make the neighborhood sparkle. So be sure to put up your lights and decorations early and maybe your yard will be chosen this year!

PARKING ON SUBDIVISION STREETS

WILLIAMSBURG ANIMAL CLINIC Merry Christmas!

As many folks will be driving through the subdivision looking at all the decorated homes during this holiday season, it may be a good time to remind our residents about parking on our streets. The inconvenience caused by inconsiderately parked vehicles remains an ongoing problem. They also make it more difficult for your neighbors to get in and out of their driveways and for the mail delivery personnel to access mailboxes. But the more important issue is the obstruction that is caused especially when cars and trucks are parked on opposite sides of the streets restricting passage of large vehicles, of which school buses and fire trucks are examples. There is also a real concern about the danger that cars parked on the streets can cause to children who may not be sufficiently mature to exercise the required caution around parked vehicles. In addition to residents who just leave their vehicles parked in the street in the evenings, rather than moving them into their driveways, there are some cases in which vehicles are so parked for extended periods. As a reminder, Article 18 of our deed restrictions addresses this by stating in part “No auto, truck, boat, boat rigging, camper, motor home, mobile home or other trailer, vehicle or equipment of any kind shall ever he left parked on any street right-of-way adjacent to any lot or in any driveway on any lot, except for temporary parking incident to the contemporaneous use of such vehicle or equipment.”

The Yard-of-the-Month award for November goes to Ms. Mary Schlipf of 22411 Bucktrout. Mary is a long-time resident of the Settlement, having lived here since 1992, but has lived in the Katy area for 63 years. She has two children; Fred and Patti, who also live in the Settlement and she is also blessed with two grandchildren and two great-grandchildren. She loves the Settlement because it is so quiet and well kept. Her yard is stunning with blue hydrangeas, multi colored snapdragons, elephant ears and the front walkway is lined with pink and white begonias. The front beds are bordered in liriope. The trees in the front yard are beautifully lighted at night, along with the front walk. Mary’s side yard is as well-manicured as the front, with a large potted sego palm at the garage. The backyard has iron plants, variegated ginger, camellias and crepe myrtles. She also has a fruit-bearing orange tree. Thank you Mary for adding so much beauty to our wonderful neighborhood.

A meeting of the Board of Directors of the Williamsburg Settlement Maintenance Association, Inc. was held on Tuesday, September 15, 2013, at 5:30 PM, at the Williamsburg Settlement clubhouse, 1602 Hoyt, Katy, Texas 77449.

ATTENDANCE

Board Members present were Walter Smith, Gail Owen, Floyd Ball, Dave Ellis and Michael Wood. Also in attendance were officer Paul Wilburn and Dolores Sue representing Planned Community Management, Inc. (PCMI). With a quorum being established, the meeting was called to order at 5:30 PM.

MINUTES

The Board reviewed the minutes of the September 17, 2013 Board meeting. A motion to accept the minutes as written was made by Walt Smith, seconded by Gail Owen and unanimously approved.

HOMEOWNER CONCERNS

There was one homeowner, the president of MUD 61, present at the meeting.

Delinquency for the month ending September 30, 2013 was $17,418.91. There is an increase due to attorney costs being processed. Those fees have been placed on each individual account.

He mentioned that he has not heard the mosquito fogging truck lately and asked if it is still servicing the subdivision as the mosquitoes are still bad. Dave Ellis confirmed that the service is continuing and that after each visit, the driver stops and places a hanger on his door. To confirm that the truck is following the prescribed route, its progress is tracked by a GPS signal which is transmitted every few seconds back to the company office.

At this time, the Board agreed to re-arrange the Agenda to discuss a New Business Item that had arisen after the meeting agenda had been published. Mr. Wheeler BeMent, President of the MUD 61, had been invited to the meeting to elaborate on the MUD 61’s proposed project to reduce the impact of flooding such as that, which occurred on Bucktrout to Abby Aldridge in 2009.

PATROL SERVICE REPORT

Martin Spears was unable to attend the Board meeting. Officer Wilburn stated that again, it has been a quiet month. The officers are seeing a small increase in disturbances at certain residences. It was reported there had been an increase in “meet-the-citizen” events and checks on the clubhouse and school this month. The Board asked him to clarify the “meet the citizen” report entries. Officer Wilburn explained that these indicate meetings that can be initiated either by the patrolling officer or as a result of a resident stopping an officer while on patrol. This is usually done when the resident has a question or a concern that they wish to bring to the officer’s attention. He also noted that many residents are taking advantage of the vacation watch service provided by our patrol officers.

FINANCIAL AND DELINQUENCY SUMMARY

Dave Ellis presented the financials. As of September 30, 2013, the money in the bank totaled $590,980. This includes checking, savings accounts and CD’s and is the money to cover both operating expenses and the necessary reserve to fund maintenance and replacement of the Association’s capital assets.

MUD 61 FLOOD ABATEMENT PROJECT

To reduce future flooding, Mr. BeMent explained that the MUD 61 is in the process of contracting to purchase and then demolish a home on Bucktrout. The ground would then be graded and a 72” storm drain installed under the lot to carry excess water from the street then along the outside of the perimeter fence and across Colonial Parkway emptying into the detention pond. The MUD purchase agreement would be predicated on the Association signing an agreement giving the MUD exemption from paying the maintenance fees currently assessed by the Association against that lot and from the need for the Association’s approval of any structure that might subsequently be placed on the lot and any deed restriction issues that might subsequently arise. Further, the agreement would require the Association to “protect, indemnify and save the MUD harmless from any claims regarding losses, damages, cause of action, suits and liability of any kind and character including all expenses of litigation, court costs and attorneys’ fee on account of damages to the District in any way arising out of or relating to the breach of the agreement by the Association.” Mr. BeMent stated that the MUD has no current intention to erect any above-ground structure on the property and as the lot is deeded as

a residential single family dwelling, the MUD attorney feels that the agreement would supersede the need for a homeowners’ vote. In order to proceed with the project, this agreement is necessary as the lot must be extracted from the requirements of the deed restrictions which apply to a single family dwelling.

The Williamsburg Settlement Board expressed their appreciation to the MUD Board for making efforts to protect the homes in the subdivision from flooding and stated that it supports the aims of the proposed project. However, it has concerns, including whether it even has the authority to sign such an agreement. If the Association attorney confirms that such an agreement can be signed, before doing so, the Board would require modifications to the document as currently proposed. The first item would be an expansion of the Recital section to include a more definitive description of the project. Mr. BeMent stated that he could write a better description of the concept but the design will not be finalized until the Association has given its approval and the lot has been purchased. The next issue is that if the Association waives its rights to enforce architectural and deed restriction control, how it could be sure that the lot would not become an eyesore? Mr. BeMent stated that this could be accomplished by the MUD granting the Association a 50-year lease on the property for a nominal cost of $1 per year. This way, the Association would bear the cost of the on-going maintenance of the lot, but it would be able to ensure that the property would be maintained to community standards. The Board unanimously agreed that it would be prepared to consider such a lease agreement, but that the lease would need to be prepared and signed at the same time as the agreement required by the MUD. Mr. BeMent stated that at a later time, the subdivision could request funds from the MUD to make certain agreed-upon improvements. The approximate cost that the MUD would be spending to make the necessary flooding abatement provisions would be in the neighborhood of $800,000. This would be a saving of about $400,000 over the alternative plan of laying the extra storm drain along Bucktrout to Carters Grove. A motion was made in two parts: Motion A was that the Board would agree to the agreement/recital as long as it is expanded to include a more definitive description of the project and only after the Association attorney has reviewed and changes have been made. Motion B was that the Association would be prepared to accept a lease of the property which would begin after completion of the project and total cleanup of the site. This lease would be attached to the agreement/recital as part of the contract. Dave Ellis made a motion that when the above modifications to the agreement have been made, the lease prepared and all documents have been approved by the Association attorney, then motion A and B be accepted and the documents signed without the necessity of a further meeting. This motion was seconded by Gail Owen and unanimously approved.

OLD BUSINESS STATUS ON REPAIRS TO CARTER’S GROVE MONUMENT

The previous limestone slab that had been ordered was broken and had to be replaced. The new slab has now been delivered to the company, which will re-build the monument and the work should begin Monday, October 21, 2013.

TENNIS COURT GATE

Dave Ellis reported that a box containing a key to the gate has been installed inside the courts near the gate for use by anyone who might otherwise have been locked in. That key is under camera surveillance. This issue is therefore now closed.

NEXT WSMA BOARD MEETING

Dave Ellis reported the clubhouse water heater has been replaced since the last meeting. He also reported that the pool furniture was cleaned before being stored until the pool reopens next year. However, all attempts to remove the stains on the furniture’s vinyl straps were unsuccessful. The furniture company has advised that once these stains have been burned in by the strong sunlight they can’t be removed.

As there will be no meeting in December, the next meeting of the WSMA Board of Directors will be held in the clubhouse on Hoyt Lane at 5:30 PM, on Tuesday, January 21, 2014. If you wish to be placed on the agenda, please contact PCMI at 281-870-0585 at least three days prior to the meeting.

Further, the pool contractor will be submitting a proposal for items that need attention before the pool reopens prior to the 2014 swim season. The proposal will include new lifeguard stand platforms as both are badly cracked.

At 7:15 PM, the Board adjourned to executive session to discuss delinquencies, deed restriction matters and security issues.

DECISIONS MADE DURING EXECUTIVE SESSION DELINQUENCY

The Board reviewed the delinquency report. At the present time, no additional accounts need to be sent to the Association attorney.

DEED RESTRICTIONS

The Board reviewed the deed restriction list from the inspections performed October 2, 2013. It was unanimously agreed no accounts will be turned over to the Association attorney for legal action this month. With no further business, the meeting was adjourned at 7:21 PM. The next meeting will be November 19, 2013 at the community clubhouse.

IMPORTANT NOTE:

Subsequent to the meeting, the Association attorney informed the Board that after his detailed review of the proposed MUD 61 flood abatement project agreement, he has determined that the Board does NOT have the authority to sign the document. Such an agreement would require modifications to the Association’s dedicatory instruments, which would require approval of 2/3 of the membership.

This form is accessible via the Forms, Registration or Directory pages of our website www.wsmaonline.org. The webmaster uses the information submitted to maintain the directory database. If the resident indicates on the form that he or she is agreeable to having their information accessible via the online Residents’ Directory page, the update will be made as soon as possible - usually within 24 hours. New residents to our subdivision are requested to use this same form to register their information for inclusion in the directory OR TO CONVEY THEIR DECISION THAT THEIR INFORMATION NOT BE INCLUDED. But please remember that all such work does require Architectural Review Committee approval. This is obtained by completing a “Request For Home Improvement Approval” form and mailing it to PCMI. A blank copy of this form is included in this newsletter and is also available on the Board Notices and Forms page our website at WSMAonline.org.

The Clubhouse is available for rental for non-profit activities to all residents in good standing with the Association • The fees are as follows:

STREET LIGHT OUTAGES

To report a burned out streetlight, any resident may call CenterPoint directly at 713-207-2222. However, for those with Internet access, you may also make this report on-line. For those interested, you can go to http://cnp.centerpointenergy.com/outage. Then enter your contact details so that they can get back to you if more information is required. On the following page enter the details of the light(s) with the problem. Just as you would if reporting the outage via the telephone, you will need to provide the street address where the light is located and the 6-digit number that is prominently displayed on the front of the pole. Under normal circumstances the crew will be out to fix the problem within 7 working days. Anyone noticing a streetlight that is out or has some other malfunction is encouraged to report the problem to CenterPoint via either of these two methods without delay. Our Association is charged for every streetlight each month, irrespective of whether or not the light is functioning. So please help us get value for your hard earned money!

When no alcohol is being served but the event is attended by 50 or more people and continues past 6:00 PM or 20 or more people between the ages of 13 and 21 unaccompanied by their family members, one security guard is required. • The charge for the security guards, which is paid directly to the officers, is the responsibility of the resident requesting the rental.

• Also, if there are more than 20 young people between the ages of 13 and 21 unaccompanied by their family members the Association requires one responsible adult for every 10 of these young persons to act as chaperones.

• All deposits refundable upon passing the exit inspection. POOL RENTAL The pool is available for private parties during the swim season (only), subject to the posted pool rules and the following restrictions. During Pool Hours: • Only 1 group at a time. • Parties must be scheduled at least 2 weeks ahead of time. • Parties held during open hours are restricted to 20 or fewer persons (adults and children) who will be entering the pool and do not have their own pool tags. • In the event that the total number of persons in the pool (including regular pool users who are not in the party) requires an additional lifeguard then the cost of the additional guard will be deducted from the renter’s deposit. • Two responsible adults must be in the pool area at all times acting as chaperones to ensure the good behavior of all members of the party. • Party to be over and the area cleaned up by pool closing at 8:00 PM • A $100 refundable deposit is required. After Hours: • Parties must be scheduled at least 2 weeks ahead of time. • Fees: 1-49 people - $50; 50 plus - $75. • Private pool parties may start at 8:00 PM. They must end and the area must be cleaned up by the scheduled end of the party, either 10:00 or 11:00 PM as selected on the booking form. • One responsible adult for every 10 persons under the age of 21 must be in the pool area at all times acting as chaperones to ensure the good behavior of all members of the party. • Lifeguards will be booked by the Association. There will be a minimum of 2 lifeguards plus an additional guard for every 25 persons in excess of 50 who will be entering the pool. The perlifeguard hourly fee is $25. • The cost for the lifeguards will be added to the rental fee and will be payable by the renter to the Association at the time the booking is confirmed. • A $150 refundable deposit is required. For clubhouse and pool availability, refer to the Clubhouse Bookings page of the Association website www.wsmaonline.org and then to make a reservation, please complete the pool entries on the on-line Clubhouse Booking Form. Animals that are not properly restrained pose a threat to all our residents. While you may know your pet is friendly, an animal running at someone who is walking by is very scary for that person. Many children are afraid of animals and become frightened, which could result in the child getting hurt trying to avoid the animal. Veterinary Public Health (formerly called Harris County Animal Control) advises that “All dogs and cats must be kept under restraint while in the unincorporated areas of Harris County, Texas. THE LONE STAR SYMPHONIC BAND

The group recently recorded a Christmas themed CD, which will be available for purchase at all concerts this season. The Band is based in west Houston, with rehearsals and concerts held at CrossPoint Community Church off of Westgreen Blvd. and I-10 (The Katy Freeway). Five concerts are slated for the Lone Star Symphonic Band’s 21st Season, with tickets for all concerts available

on the Band’s website, www.lssband.org, for $5.50 each and will be available the day of the concert at the door for $10 each. All concerts begin at 4:00 PM and feature the Lone Star Dixieland Band for 30 minutes prior to the main performance in the foyer. All selections performed will feature life’s many colors. December 15, 2013 will be the Lone Star Symphonic Band’s Christmas and Hanukkah themed concert, titled “Celebrate the Season.” On March 2, 2014, the Band will perform “Lone Star,” a concert as big as Texas! The Lone Star Symphonic Band will perform on May 4, 2014, a spring-filled concert titled “Spring into Fun!” The annual patriotic concert, titled “We Hold These Truths,” will be held on June 29, 2014. The Lone Star Symphonic Band is a non-profit volunteer organization dedicated to bringing performances of artistic merit to the Houston metropolitan area. Founded in 1993 as the West Houston Concert Band, the band is comprised of musicians from all walks of life and instills the value that music is a life-long event, continuing well beyond high school and college. The Band is under the direction of Mr. Bob Bryant.
