Term & Conditions

TERMS Terms of the sale are cash or cheque, payable at par at the sale location. The right of property shall not pass until after settlement has been made, no invoicing on buyers in attendance unless previous arrangements have been made. Every animal sells to the highest bidder.

DISPUTES The Auctioneer Shall control the bidding at all times. In case of disputes the Auctioneer’s decision shall be final.

PURCHASER’S RISK Each animal becomes the risk of the Purchaser as soon as sold. Insurance will be available sale day from Canadian Farm Insurance Corp.

ANNOUNCEMENTS Announcements from the auction stand will take precedence over any printed matter.

ACCIDENTS All precautions possible will be taken to protect the safety of the buyers. All persons, attend the sale at their own risk.

GOMACK and WHITELAW AG SOCIETY nor any owner assumes responsibility in this matter and disclaims any liability, legal or otherwise, in the event of accidents or loss of property.

BREEDING GUARANTEES All bulls offered will have passed a semen evaluation and are warranted to be sound by a certified veterinarian, however, the seller is not responsible for damage caused by foreign objects after the bull has been sold nor sickness that was not apparent at the time of the sale. Bulls that are not breeders need to be reported to seller within 5 months of sale.

EXCEPTION TO GUARANTEE In cases where the animal is subjected to any hormonal or surgical reproduction techniques after the sale, the guarantee shall be null and void. In the cases of bulls, they are guaranteed to breed naturally according to applicable Canadian breed Association guarantee, but no guarantee is given that semen from any bull will freeze.

CERTIFICATE OF REGISTRY A certificate of registry duly transferred to the buyer will be furnished for each registered animal after settlement is made.

RIGHTS & OBLIGATIONS The above terms and conditions of the sale shall constitute a contract between the buyer and seller and be equally binding to both. The seller has privilege of making one bid.

SHIPPING Assistance will be given in making shipment after the sale, but no risk is assumed by the seller. Free delivery within 350 Km from the Bulls home herd location, beyond will be cost shared. Any additional expenses incurred are the responsibility of the purchaser. Purchasers are required to furnish shipping instructions when making settlement. Any bull(s) staying at the ranch must have insurance to cover death and injury. Bulls can remain free of charge until March 20th, 2022. To which a charge of $5.00/ day will be charged after that date.

RETAINED INTEREST Seller reserves the right to collect “Owner’s Use” semen from any bull in this sale (at the seller’s expense and at the buyer’s convenience).
