WRFL-FM 88.1, or Radio Free Lexington, UK’s student-run radio station, has decided after 22 years of broadcasting locally it’s time to expand its boundaries. June 17 marked the day WRFL went from broadcasting locally in Lexington to regionally to cities like Midway, Stamping Ground, Georgetown, Shelbyville and Lawrenceburg, Ky. Since the expansion, the station has been receiving numerous calls from listeners saying they have always wanted to get WRFL but were never able to, says Public Relations Director Anthony Taylor. “It’s all about giving people options, showing them this kind of music does exist,” Taylor said. “Maybe there is a teenager out there hearing something they never heard on the radio before and maybe that opens a door for them.”

WRFL shies away from music played on larger radio stations, giving listeners a more “indie” feel. It doesn’t specialize in a certain type of music, and the disc jockeys have the freedom to play music of their choice. The groundbreaking changes for the radio station didn’t happen overnight. For the past decade, students and faculty involved in WRFL have been fundraising to obtain the money necessary for the expansion. Through free concerts, donations and raising awareness of their situation, WRFL finally reached the amount of money needed to replace its 250 watt tower with one of 7,900 watts. “If anything else, this is a really big publicity move,” Taylor said. “This raises our profile with the bands we work with so we have some credibility nationwide.” And with more credibility comes more enforcement from the Federal Communications Commission. Previously, it may have been OK to make a minor mistake on air, Taylor said, but with the FCC watching WRFL now more than ever before, everyone is trying not to slip up. The frequency of WRFL also recently took over some frequency of religious programming. So there is extra pressure not to of-

The fear of the FCC won’t stop WRFL from broadcasting 24 hours a day, 365 days a year, though. “Our station is known nationwide as a model radio station,” said Kakie Urch, one of the founders of WRFL and a professor in the school of journalism. “It has run for 22 years for 365, 24/7. WASHINGTON — Supreme Court nominee Elena Kagan’s confirmation appeared almost certain Wednesday as she spent a third day assuring Senate Judiciary Committee members that she has no ideological agenda. “Solicitor General Kagan will be confirmed,” Senate Judiciary Committee Kagan Chairman Patrick Leahy, D-Vt., predicted during a break in the panel’s hearing. Republicans, who spent another frustrating day trying to portray Kagan as a die-hard liberal, conceded that theirs seemed a losing cause. “I assume she will be confirmed,” said Sen. John Cornyn, R-Texas, a committee member. “The arithmetic is not there. There would have to be some dramatic development to change that.” Democrats, who control 58 of the Senate’s 100 seats, often talked as if she were ready to take the oath.
“You’re a wonderful role model for women,” said Sen. Dianne Feinstein, DCalif. “We’ll forget whether you’re a Democrat or Republican. You know, you’re reasoned, you have a commitment, you have a dedication and a staying power, and you do us all well.” After spending 10 hours answering questions and fending off partisan thrusts Tuesday, Kagan returned Wednesday for what was expected to be her final day of testimony. The panel’s senior Republican, Jeff Sessions of Alabama, had said he hoped “we can learn more about the nominee,” but the hearing turned largely into a replay of Tuesday. At least one Republican, Sen. Lindsey Graham of South Carolina, seemed highly sympathetic to Kagan. Graham voted last year for Sonia Sotomayor, President Barack Obama’s first Supreme Court nominee. He’ll face no partisan punishment if he votes for Kagan, too. “We have no Republican position,” said Senate Republican Whip Jon Kyl of Arizona. “We are not trying to get Republicans to vote one way or the other.”

With the appointment of a new dean for UK Libraries, the university has only one remaining dean vacancy. On July 1, Terry Birdwhistell will begin his tenure as the dean of UK Libraries. Birdwhistell will Birdwhistell bring his 35 years of experience with the university to the position. He has an undergraduate degree from Georgetown College in American studies, two master’s degrees from UK — history and library and information science — and a doctorate in educational policy studies from UK. “I just feel so fortunate to have begun my career at a place like the University of Kentucky,” Birdwhistell said. “People in the academic world spend their whole careers trying to get into a place like UK and I was very for-

He has been credited with building programs and centers, obtaining archival collections and participating in scholarly research, publications and media productions during his time at UK. Birdwhistell also served as the University Archivist from 1985 to 2001 and as the executive secretary of the UK Libraries National Advisory Board since 2007. With his new posi-
tion as dean, he hopes to work more closely with the students. “The UK libraries depend a lot on students working in the library, and one of the points of emphasis we are going to be making over the next few years is to raise private money to increase our ability to employ students, both as undergraduate and graduate research assistants.” He said there are many initiatives underway at the libraries, and he hopes to move toward a more digital environment. “Dr. Birdwhistell brings a rich combination of experiences to his new post as the dean of UK Libraries,” said Provost Kumble Subbaswamy in a UK news release. “His extensive knowledge of current library and information access issues, and his deep knowledge of the Commonwealth will help advance the work being done at UK Libraries to better serve the university and its communities.” Birdwhistell has been serving as interim dean since January. He succeeds Carol Pitts Diedrichs, who served as dean from July 2003 to December 2009.

‘Last Airbender’ hard to follow "The Last Airbender" covers a lot of ground in just under two hours, and viewers who are unfamiliar with the popular Nickelodeon animated series that inspired the film may find themselves wishing the movie had opened with five minutes of maps, timelines and explanatory notes. Long story short, we're visiting a mystical world where geopolitics is a four-way rivalry among nations affiliated with Air, Water, Earth and Fire (insert 1980s funk band joke here). Psychically gifted citizens of each place can defend themselves by chucking quantities of their native element at adversaries. The fire nation is the most warlike, and its Napoleonic leader is determined to subjugate the others, with ash-belching battleships and ninja-clad warriors who are literal flame throwers. Against them stand Katara and her brother Sokka, teen warriors from the Water tribe, and Aang, a 12-year-old thawed out after a century encased in ice. He is an Avatar, capable of commanding all four elements and blowing evildoers to sparkling, satisfying smithereens. Groggy yet? Hold on, you haven't met headstrong Prince Zuko and his courtly guardian uncle Iroh, fierce Fire Nation Admiral Zhao, Fire Lord Ozai or Princess Yue, whose prematurely white hair somehow powers the moon. The plot here is like Hansel and Gretel's breadcrumb trail after a hurricane. This is pure introductory adventure, meant to immerse us in the series' richly complicated universe. In truth, there is more metaphysics and exposition in the movie than I could digest. At a certain point my brain ceased processing new input and simply switched to sensory input mode. From there on, I had a fine time. The story is at best incidental to the pleasures this film has to offer. Despite significant stretches of talky tedium, there is plenty here to hang a franchise on. "The Last Airbender" is one of the most visually luscious and exhilarating entertainments I have seen this year, full of giddy fireworks and kinetic pleasure. I suspect writer/ director M. Night Shayamalan has been watching intricately artdirected Chinese superproductions like "House of Flying Daggers" and the early "Star Wars" films. The film is chockablock with gee-wow marvels. The Asian-inspired sets are extraordinary. Aang and friends travel on a flying six-legged albino beaver; Fire Nation cavalrymen ride into battle on giant gekkos. The camera observes these psychedelic wonders casually, as George Lucas nonchalantly showed us the twin moons of Tatooine. And in the Lucas manner, the warfare is blood-

less, with fighters felled by special effects showers of ice or wind or sparks, so that combat has a sort of gorgeous grandeur. There are echoes of earnest young Luke Skywalker, and Harry Potter, too, in Aang. He is a Young Man of Whom Great Things Are Expected, who must train his telekinetic skills, and accept his fate as his world's savior among an order of mystic monks, though he'd rather snuggle into a normal family. His waterbending companion Katara is courageous and determined to help Aang fulfill his destiny (hello, Hermione.) Her overprotective brother Sokka is on hand to add a little adolescent heat in his flirtation with doe-eyed Princess Yue. Any decently powered laptop could cough up these characters given the right input of Joseph Campbell and Japanese comic books. But to his credit, Shyamalan focuses on their humanity, wedding emotions and effects. The ingratiating young cast does well in roles that are about 40 percent tai chi moves and determined scowls. Noah Ringer never camps it up as the bald, extensively tattooed Aang, and his martial arts moves could sweep new Karate Kid Jaden Smith right onto his keister. Nicola Peltz as Katara is required to regurgitate reams of fantasyland history, and somehow remains engaged and engaging. Jackson Rathbone (currently playing a much more mature vampire character in "Eclipse") makes Sokka sturdy and likable despite an unbecoming shaved-temples and ponytail hairdon't. The most ambitious performance award goes to Dev Patel as the Fire Nation's Hamlet-like Prince Zuko, inconsolably bitter because of his father's indifference. With his thousand-yard stare and eruptive rages he brings scorching intensity to his performance as an angry young royal. With its continent-hopping escapades and everescalating battles, the film feels rushed, with characters and situations whipping by so quickly that most feel underdeveloped. When we reach the climax, a smooth handoff to the next link in the series, we feel a key element is missing. For all its spine-tingling satisfactions, "The Last Airbender" hasn't staked a unique claim on our imaginations as it recycles set pieces from earlier blockbusters it tries so hard to emulate. Maybe that cohesive vision, that elevating passion, that soul arrives in the next installment.

UK basketball has made history yet again. As the Orlando Magic selected former UK forward Daniel Orton with the 29th pick of last w e e k ’s NBA Draft, the group of Wall Cats who guided UK last season added to its resume. The school had an unprecedented five players taken in the first round of the NBA Draft. It was the first time such a feat had been accomplished by one school since the draft began in 1947. UK had not had five players chosen in the same draft since 1984. As many expected, guard John Wall, who led UK offensively last season, was taken first overall by the Washington Wizards. The Sacramento Kings snagged forward DeMarcus Cousins fifth; forward Patrick Patterson went 14th to the Houston Rockets and guard Eric Bledsoe landed the 18th pick from the Oklahoma City Thunder. Then, Orton was drafted with the second-to-last pick of the opening round, ensuring UK’s place in history.

Success breeds repetition when it comes to the host of a sporting event. For the second time in three seasons, UK’s Memorial Coliseum has been selected as one of four host sites of the NCAA tournament regional round. The program will also hold the round in 2011, which was decided in February. The three remaining sites to host regional play in 2013 are Southern California, Illinois and Florida. The winner of each location will advance to the NCAA Final Four. UK has hosted a total of eight rounds in the first or second round of the tourna-
Griffiths is a former Griffiths UK midfielder who began his Major League Soccer career Sunday evening after being signed by the New England Revolution. He was a third-round draft pick in the 2009 MLS SuperDraft, officially signing with the Revolution last Thursday. Online piracy: As a mere host, YouTube is protected from liability LOS ANGELES TIMES EDITORIAL Entertainment companies have asked the courts repeatedly for help in coping with online piracy, but the results have been decidedly mixed. Although judges have come down hard on numerous filesharing networks and search engines that specialize in bootlegs, they've ruled in favor of several websites whose content is generated by users, even if it wasn't authorized by the copyright holders. The latest may be the most significant: Last week, a district judge in New York dismissed claims by Viacom and others that Google's YouTube had built its business by turning a blind eye to widespread copyright infringements. The ruling, which Viacom plans to appeal, reaffirmed the crucial principle that online companies should be held responsible for what they do, not what others do with their services. As Judge Louis L. Stanton explained, Congress recognized that the

Internet couldn't function if broadband providers, search engines and hosting services were held liable for every unauthorized copy made on their networks. The Digital Millennium Copyright Act of 1998 protected those companies from liability as long as they acted quickly to remove any infringing material identified by copyright holders. Viacom argued that YouTube didn't qualify for this protection because infringements were common and central to the company's fortunes. Echoing earlier rulings, however, Stanton held that the law doesn't require YouTube to police its network for bootlegged videos. Instead, it only has to remove the items singled out by copyright holders. That's sensible _ copyright owners are far better positioned to know whether a clip was used legally or not. In fact, many of the clips cited in the original lawsuit weren't infringing. At least 100 had been posted by marketers
employed by Viacom. Some analysts assert that the ruling increases the burden on entertainment companies, but it really just rebuffs another effort to shift copyright holders' responsibilities onto the middlemen who have opened new distribution pathways online. Those efforts are understandable, given how quickly works can spread around the world, and how many sites can become unauthorized sources. But speedy, lowcost distribution is one of the great advantages of the Internet, not a flaw. Many entertainment companies have come to accept that reality, striking deals with YouTube and others to generate revenue from the material that fans post online. Meanwhile, YouTube and its competitors are adding filtering technologies that enable this monetization, as well as giving copyright holders more say over what gets posted. That kind of cooperation in the marketplace is a more effective response to online piracy than years of futile litigation.

The road to backstage Bonnaroo UK employee shares festival experience Bonnaroo. Most music fans on this side of the country have at least heard of this festival. Between 80,000 and 135,000 attended this year’s installment, which marked the DONALD ninth goMASON around. For Guest me, it was columnist my first. Bonnaroo is one of those things you think you know, but until you go, you have no idea. With almost 200 performances over nine stages in four days, there is no way you can possibly make every show you might want. The mighty X-factor in the system: heat. With temperatures soaring over 95 degrees and the unrelenting humidity, you have to not only plan your time, but heat management comes
into play. With trying to cover the event, I was given a handicap in the beginning. It took me six hours of roaming around the grounds of Bonnaroo without a wristband, flashing my iPhone e-mail confirmation for a press pass like it was a badge. After talking to countless people and walking for countless miles, I finally met up with fellow presser Matt Jones from Under The Radar. Media wristbands intact, the Bonnaroo experience is locked and loaded. Though I missed my first interview with NEEDTOBREATHE due to the wristband fiasco, I was able to interview The Constellations and a get short interview with Jeff Raines, guitarist from Galactic. It’s a bird. It’s a plane. It’s Bonnaroo business! You cannot have a large festival with thousands of people without some commercial areas. What is known as
“Shakedown Street” consists of hundreds of businesses, ranging from food to glass wares, clothes to hand-made musical instruments. Food vendor Bearly Edible was one of the most popular destinations. The reason: $1 garlic grilled cheese sandwiches. Over 20,000 sandwiches were served to the Bonnaroo population, me devouring six over the weekend. With the heat bearing down, another hot spot was the lemonade stands. However, these aren’t your quarter lemonade stands. A large lemonade would cost you $6, though you could bring the compostable cup for free or cheap refills. For those who couldn’t stand the stench that a music festival grants you, there were showers set up for $7, with complimentary Garnier Fructis hair products. After the festival, I stayed for a couple of days after to volunteer with Clean

You never know what kind of talent you will find at a music festival. At Bonnaroo, music lovers of all kinds will surely find something new and fresh, it just depends on how well you can navigate Centeroo. I was fortunate enough to spend a little time with some members from The Constellations before their Thursday show at the Troo Music Lounge: Elijah Jones — lead vocals, Trevor Birdsong — guitar, Alania Terry and Shab Bashiri — vocals, claps and percussion.
Q. So, I have to ask
you about the “Perfect Day” video you had on Playboy.com. This was my first experience getting a taste of the group. It seemed provocative and edgy, yet was well directed and seemed to cater toward your demographic. Tell me what all went into the video.
A.
Elijah Jones: That video was shot in an old 1800s cool house in midtown Atlanta with about 70 friends of the band. It turned into a party with friends, not staged, all real. Eric De Fino was the director and did a great job capturing the moment. All that were involved were comfortable with their bodies, no hired video hos.
Q. There is one part of
the song that pulls it all together — the cowbell. There is a band, Here Come The Mummies, that uses a cowbell. Any chance that will be added to the instrument list?
A. EJ: We’ll definitely add cowbell in the future. No objects or materials are exempt from being used.
Q. Who are some of your influences?
A.
EJ: I grew up on funk, listening to Bootsy Collins. I would say that my two main influences are Cee-Lo and Tom Waits. I pictured CeeLo’s voice in the streets of Atlanta.
Q. Speaking of influ-
ences, you have a Tom Waits tribute on the album “Step Right Up”. When I heard this, it reminded me of Heath Ledger’s voice in “The Imaginarium of Doctor Parnassus”. Is there any correlation?
A.
EJ: Even though the voice sounds a lot like Heath Ledger in the “Imaginarium of Doctor Parnassus,” it was made a few years back. It was one of the first tracks to gauge outside interest. (I) changed lyrics and was nervous about writing a Tom Waits song, and that’s just what came out. I would love to meet Tom Waits, he is a great influence.
It took you a little Q. Trevor, what style Q. over two years to develop of guitar do you prefer?
A. Trevor Birdsong: I like Teles, prefer Fenders.
Q. Not often do you
get to work directly with one of your influences. How was the experience with Cee-Lo on the track, “Love Is A Murder”?
A. EJ: Cee-Lo actually approached and introduced himself. Having him work with us was a blessing from God. He has impeccable taste. TB: Individually hung out with crew. Couldn’t find a nicer, more genuine guy.
the album. Do you think the follow-up will be easier or more difficult?
A. EJ: (There are) no
expectations on the second album, just as there were no expectations on the first. (We’re) just having fun without worrying about the product. Pressure might actually be good, so bring it on! The Constellations’ album “Southern Gothic” is available in stores as well as on iTunes. They are on the road this year, and will be in Covington, Ky., on Nov. 5 at the Mad Hatter and be on the lookout for a stop in Lexington this fall.

Bonnaroo, held at Great Stage Park on a farm in Manchester, Tenn., is an annual four-day music festival first held in 2002. This year’s performers included Jay-Z, Stevie Wonder and the Dave Matthews Band. Vibes. The goal of Clean Vibes is to divert as much waste from landfills as possible through recycling and composting. Last year at Bonnaroo, there were 261,480 pounds of recycle waste. Though it’s not an easy job, it is rewarding to help keep the grounds clean and help the Earth. There was a large contingency from Kentucky working the fields for their Bonnaroo ticket, showing that the Bluegrass can go green.

Unfortunately, I did not meet my primary mission in interviewing Stevie Wonder. The runner-up prize was seeing his performance, which was worth it all. Next year will be the 10th anniversary, so I would imagine that the event planners will be pulling out all the stops.
Rumors are already starting to swirl about the 2011 lineup, par for the course for Bonnaroo. With around 340 days until the next festival, you have plenty of time to prepare and plan for your spot under the sun, surrounded by music.
