A free poster turned into a quick profit for some UK basketball fans. The Anthony Davis “wingspan” posters, which were passed out to everyone in Rupp Arena for free at Tuesday’s game, have gener-
ated buzz as fans have sold them on eBay. UK has issued a ceaseand-desist letter to those selling the posters online. DeWayne Peevy, UK Athletics spokesman, said it is a normal process to send cease-and-desist letters to anyone who is profiting off of the image or name of a cur-
rent student athlete. “We’ve been doing it for years,” Peevy said. “It’s something we’ve always done.” T h e standard procedure is done to protect student athletes’
eligibility, he said. According to an NCAA policy, a student athlete becomes ineligible if he accepts money or permits use of his name to advertise or promote sale or use of a commercial product or service, said Peter Rush, a Chicago attorney who has experience with See DAVIS on page 2

But the Cats (25-1) flipped Vanderbilt’s second-half surge into a late-game rally of its own and stayed undefeated in the AARON SEC with a SMITH 69-63 road win. It looked like they were on their way to padding that number in the first half, gaining a 13-point lead and calming a Vanderbilt crowd fueled by an ESPN
GameDay appearance. Then the Commodores did what they do — made 3pointers, 5 of 11 to be precise — and climbed back. They tied the game with 12 minutes to go, pushed itself to a lead with as little as 4:10 to go. And went scoreless the rest of the way. Vanderbilt missed its final nine shots of the game. “We just told each other in every huddle that we were going to lock up defensively,” Anthony Davis said. “We need the stops to win the game. That’s what we tried to do.” They succeeded, and they succeeded in proving they have the composure to withstand a good team’s best shot. Gloria Singletary, former first lady of UK and wife of UK’s eighth president Otis A. Singletary Jr., died Friday. She was 88. Singletary battled a brief illness before dying Friday. UK President Eli Capilouto and Dr. Mary Lynne Capilouto issued a statement letting the UK community

Dr. Capilouto got to meet Singletary and said she was a “grand lady.” “We are all — as members of this campus community — so much better and richer for having her with us,” the email said. Singletary was born in Alabama on Aug. 6, 1923 to Irma and Robert Walton, a Methodist minister. She grew up in Mississippi and attended Perkinston Junior College in Mississppi, where she met her husband in 1940. Just four years later on D-Day, she got married. According to her obituary, she graduated from Millsaps College with a bachelor’s degree in history and was an active member of the United States Navy along with her husband. Singletary was the first lady of UK from 1969 to 1987. During her tenure as first lady, according to her obituary, Singletary was full of UK spirit and always helping out around campus. “Whether delivering chicken salad sandwiches to students camped out in
the cold waiting in line for basketball tickets or delivering mail to patients at the Chandler Medical Center, she was a cheerful and warm presence wherever she appeared,” the obituary said. Singletary was also active in the Lexington community, helping out many organizations, especially those of the arts. The Living Arts and Science Center was one of her longest commitments, to which the center created “The Gloria W. Singletary Gallery” in the center of the space. Singletary was survived by her three children, Bonnie Singletary Robertson, Kendall Singletary Barret and Robert Scot Singletary; four grandchildren and five great-grandchildren along with her sister and brother. Visitation will be 5 to 8 p.m. on Monday at Milward Funeral DirectorsBroadway. A private burial service will be held at the Lexington Cemetery on Tuesday. The family suggests that instead of sending flowers, people contribute to The Lexington Living Arts and Science Center in her honor.

There is always a chance for an NCAA violation, Peevy said, but they do everything they can to prevent it. “We are taking the steps to show it isn’t condoned,” Peevy said. The NCAA states student athletes are amateurs, and if their image is used by someone not approved, then the student athlete loses his or her amateur status, Rush said. When that happens, “they become a professional … and cannot compete as an amateur,” Rush said. “That’s why Kentucky players cannot get paid.” Frank LoMonte, executive director for the Student Press Law Center, said if student athletes make a profit, it undermines the amateur nature of the sport. “The main concern is that the NCAA doesn’t want athletes getting any kind of kickback off of the use of their name or image,” LoMonte said. Let's picture Whitney Houston singing the 1985 chart-topper "Saving All My Love For You," soaring through the National Anthem at the 1991 Super Bowl, starring in the 1992 hit film "The Bodyguard" and winning three big trophies at the 1994 Grammy Awards. ance, image and reputation is being used to generate money, all from ticket sales, jerseys and other things. “That does not convert Mr. Davis into a non-amateur or professional for one reason — he doesn’t get any of it,” Rush said. While the student athlete cannot profit from the sale of the posters, it is legal for fans to sell the poster and make money. “It’s not illegal,” Peevy said, “but the NCAA says we can’t make a profit — their parents can’t and they can’t — so we try to prevent others from doing it as well.” Once the university learns someone is trying to profit, it is supposed to try and stop it, LoMonte said. He thinks the letters were reasonable, and said the university was probably doing what it needed to satisfy the NCAA. The NCAA doesn’t have jurisdiction over the average student, and “certainly not over some unknown buyer or seller on eBay,” he said. Schools have been giving free merchandise forever, LoMonte said, and with sites like eBay, the merchandise can be resold on a mass scale. “If they want to promote their athletes in this way, then they’re going to run some risks," LoMonte said. “People are going to see a moneymaking opportunity.” Unless the posters were given under some contractual agreement that stated the posters could not be resold, the owner has the right to sell it, he said. “(The university) can certainly issue threats and demands,” LoMonte said, “but I’m not sure if they’d be much in a position to make that stick.” The only possible action UK could take would be some sort of trademark infringement action, he said. “I’m not aware of anybody bringing one of those in regard to sports memorabilia," LoMonte said, “because you’re not claiming that this product is something it’s not.” Peevy said it isn’t really a legal issue. “We have to do that to be proactive instead of reactive. If it became an issue, at least we have on record the cease-and-desist letters and that we have been proactive," he said. Adam Ivetic, a UK junior and the Team Wildcat chair-
person, was one of less than 10 people who put posters in every seat of Rupp Arena on Tuesday. He said they were there from 7:30 a.m. to 3:30 p.m. handing them out. “I was there the whole time, seeing the way people were walking around and clearing away whole rows (of posters),” Ivetic said. Originally, the university was only going to print five to six thousand posters and send them to the media and others, Peevy said. They added 24,000 posters for fans at the game. “We try to give our fans something they can have that
maybe everyone doesn’t have,” Peevy said. He said this could decrease the chance of UK doing something similar in the future. “It sucked for other people because UK was trying to do something nice for (Davis) and the fans,” Ivetic said. As of Friday, people continued to bid for the Davis posters on eBay, with some bids more than $100. “You definitely sympathize with the school,” LoMonte said, “that they try to do something good with the athlete, and now are worried about jeopardizing his eligibility.”

Despite a season-high home score, the UK gymnastics team fell to defending NCAA Champions and second-ranked Alabama on Friday. Posting season-high floor scores, UK lost 196.0194.7. Sophomore Kayla Hartley earned a career-high 9.9 on floor exercise, the highest score on floor for either team. “She performed excellent,” head coach Tim Garrison said. “She nailed it.” Hartley is the eighteenth gymnast in school history to earn a 9.9 or higher on floor. She also now holds the title for highest score in any event for

Solid performances by sophomore Audrey Harrison with a 9.8, freshman Alexis Gross with a seasonhigh score of 9.775, freshman Kenzie Hedges with a 9.7, sophomore Kayla Sienkowski with a 9.675 and freshman Shelby Hilton with a 9.625 earned UK a season-high score of 48.85 on floor. Almost posting a season-high team score on bars with a 48.750, three UK gymnasts tied or set careerhigh scores. Senior Storey Morris tied her best score with a 9.8. Freshman Sarah Shipley scored a careerhigh 9.75, and senior Whitney Rose tied a season-high score of 9.725. Also on bars, Gross, Harrison and
sophomore Caitlyn Ciokajlo earned 9.75, 9.725 and 9.675 respectively. On vault, UK posted a team score of 48.775. Hedges scored a careerhigh with 9.85. Sophomore Holly Cunningham earned a 9.8, Morris earned a 9.775, Harrison earned a 9.725, and Gross a 9.55. Hilton earned a career-high with a 9.625. Lastly, on beam, UK earned a team score of 48.325. Morris scored a 9.8, freshman Shannon Mitchell scored a 9.725, Harrison a 9.65, Cunningham a 9.6, Gross a 9.55 and Sienkowski an 8.6. Gross said beam is one of the most nerve-wracking events. As an all-around
performer, Gross competed in all four events. “I thought I had a good night,” Gross said. From event to event, Gross was seen rounding the edges of the mats, cheering on her teammates. “I get really excited to compete,” Gross said. “I just want everyone to feel how I feel.” Garrison praised his team’s progress and development as a team. “Our goal is to get better, we can get rid of minor mistakes,” Garrison said. “I think we are right on track.” Next, UK travels to Athens, Ga. to compete against the No. 6 Bulldogs at 4 p.m. on Saturday.

UK Wildcat Service Dogs has teamed up with Naticakes to deliver gourmet decorated mini cupcakes for Valentine’s Day. A portion of the proceeds will help train and raise Wildcat Service Dog puppies. Naticakes owner Nicole Ernst said the dessert shop will be baking cupcakes the day before and the day of Valentine's Day. The service dogs and trainers will be delivering the cupcakes to campus. Ernst said she and her mother will make deliveries anywhere in Lexington on the day of the fundraiser. Anna Mynchenberg, UK Wildcat Service Dogs vice president, said to keep an eye out for the six service dogs that will be delivering cupcakes to campus. “Walk-ins are welcome and a portion of any of the cupcakes sold on Valentine’s Day will go to the Wildcat Service Dogs organization for their service dog puppies,” Ernst said. Naticakes will be open 11 a.m. to 10 p.m. on Tuesday. The cupcakes are $10 for six mini cupcakes, $20 for 12, or $30 for 12 jumbo cupcakes. ”Pupcakes,” edible cupcakes for dogs made with applesauce and carrots can also be ordered in advance.
A Spring ‘Break’ from driving UK offers rides home over break, prices range from $49 to $149 By Steven King news@kykernel.com
Some students will drive or fly back home for Spring Break, but UK Parking and Transportation Services is offering students the option to sit back and relax during their commute. Tickets are now available for the Spring Break edition of the Ride Home Express. The prices range from $49 to $149 depending on the distance from Lexington, UK Parking spokeswoman Chrissie Balding Tune said. With final destinations including Atlanta, Chicago and Cleveland, the Ride Home Express will have three routes with a total of 15 stops, according to the UK Parking website. Tune said the locations were selected by collaborating with the Registrar’s office to determine which locations contained the most UK students. Lance Broeking, director of Parking and Transportation Services, said the Ride Home Express is an initiative designed to provide alternative transportation outside of Lexington while helping solve the scarce parking issue. “We are realistic about the amount of parking we can build and afford,” Broeking said. “The SB Ride Home Express helps satisfy our initiative for alternative transportation for students.” Tune said this particular program is not only a viable travel option for students, but also an enjoyable experience. “We offer free Wi-Fi,
and satellite TV on the charter buses, which have plenty of room,” Tune said. Tune, who has been with UK Parking for seven years, said that UK Parking has studied similar programs at 20 other top universities to determine that offering a Ride Home Express would be beneficial because of the benefits it presented to the other institutions. Broeking also said the SB Ride Home Express has multiple benefits. “This program is a way to have reliable transportation that is relatively inexpensive, while letting students ride with other students,” he said. Samantha McNease, a communications and theater freshman, used the Ride Home Express for Thanksgiving to return home to Hopkinsville, Ky. “I thought it was really awesome,” McNease said. “The bus driver was really good and I would definitely do it again.” Broeking said students looking to purchase two-way tickets can purchase tickets online on Parking Account Manager with their LinkBlue ID. Students seeking a oneway ticket need to go into the UK Parking and Transportation Services office in Parking Structure No. 6 on Press Avenue. According to the website, space is limited and seats are sold on a firstcome, first-serve basis. She has had 31 radiation treatments and seven rounds of chemotherapy, her mom, Rebecca, said, and is now officially in remission. Reagan said she enjoyed the show, and her mom said she
didn't know when the trip to Florida would be. Oliver said planning for Greek Sing began in September, and said she couldn't
believe the night had already come and gone. “It's so much preparation,” Oliver said, “but the night just flies by.”

Presidential election crucial to environment The day after the Japanese attack on Pearl Harbor, President Roosevelt addressed the nation and said the famously powerful words: “Yesterday, December 7, 1941, a date which will live in infamy.” This PATRICK quote can and should be JOHNSON used to also describe Jan. Contributing 20, 2001, the date in which George W. Bush was columnist sworn in as the 43rd President of the United States. The impact this date has had on the world is immeasurable, and will quite likely never be recoverable. It is sometimes very difficult to imagine how different our world would be if the Gore-Lieberman ticket had been determined the winner of the 2000 election, but I think it is important we sometimes look at our mis-
takes to become better decision-makers and voters in the future. When Bill Clinton left office, the country was in a wonderful economic situation. He left the next president with a budget surplus and had improved foreign relations. With Gore stepping in, it is quite likely the U.S. would have continued to be prosperous. However, the Bush administration destroyed this surplus and turned it into a deficit by giving unfunded tax cuts to the wealthy. The largest and most detrimental impact of the Bush administration was the corrupt energy policy decisions that were made. Extremely dirty fossil fuel industries, such as coal and oil, were given huge tax breaks, and the people who were directly affected by the pollutants related to the extraction and combustion of these industries were completely forgotten. The policies made during the Bush administration are arguably man’s largest contri-
bution to global climate change, and those decisions can never be taken back. They were made with intentions of helping the wealthy, without any regard to the environment. Gore has shown time and time again his commitment to saving the world from the destruction that is going to occur from global climate change, and would have led this country to be a leader in the innovation of clean, renewable energy technologies. Not only would this have led to energy independence, it would have allowed the U.S. to be a responsible global steward of the earth. As young people, we are the generation that is going to determine the fate of the future of our species. If we stand up for the importance of protecting the environment, then global ecosystems will reward us by providing sustainable sources of energy that will produce the energy we need while not poisoning us in the process. For progressive decisions to be made for
the greater good of our planet, we need people like Environmental Protection Agency Administrator Lisa Jackson to stay in power and to be given more opportunities to push legislation like the Mercury and Air Toxic Standards. Jackson has shown time and time again that she will fight for environmental justice, and her role is vital in the Obama administration. As we prepare to enter the homestretch of the Republican nomination and subsequent presidential election, we need to bear in mind the horrendous mistake our country made in 2000. Another mistake such as this will hurt for generations to come. Do you want to be responsible for telling your grandchildren that your vote contributed to the continued destruction of the only global ecosystem we have? No. 1 UK (25-1, 11-0 SEC) closed out a win in Memorial Gymnasium to beat Vanderbilt 69-63 Saturday night in Nashville, Tenn. After winning the first possession on the tip-off, Vandy came out scoring the first bucket to take an early lead, but it switched leads with UK throughout the first 10 minutes of play and continued to go shot-for-shot for the bulk of the second half. “We need all this,� head coach John Calipari said. “I’d rather be up 23, but this was a good game.� UK strung together an 8-0 run to widen the margin to lead 18-11 with 8:05 to play in the half after sophomore guard Doron Lamb lobbed to sophomore forward Terrence Jones. The Cats continued to increase the lead 30-16 with 3:14 to play in the half. Jones led the Cats in the first half with 14 points and five rebounds. He finished with 14 points, nine rebounds and four blocks. Calipari said running the floor in Memorial Gymnasium would be a challenge, but Teague recorded eight points, six assists and three rebounds in the first 20 minutes. “All of the sudden he’s transformed into what one of our typical point guard plays like,� Calipari said. “He’s running the team; he’s defending, making layups, making good decisions and getting us in an offense.� He finished with 13 points, eight assists, four rebounds and one turnover. The Cats led at haltime 3623, but Vandy closed in by splashing back-to-back threes, trailing 41-44 with 14:05 left. “They’re a great three-point shooting team and they came out shooting threes,� freshman forward Anthony Davis said. “They got back in the game, so we knew we had to lock up de-
fensively.� Each time UK pulled up by a few possessions, Vanderbilt climbed back within reach. The Commodores tied the score at 48-48 with 11:57 to play after going on a 7-0 run. “We just needed a game where we had to fight,� Teague said. “This was a good game for us to build up on our experience.� The Cats have a week-long break before playing Ole Miss at Rupp Arena on Feb. 18., but Calipari said the team approaches home games the same way they approach games on the road. “This was another game for us.
