Concerned about land expropriation? There’s no cause for panic.

Land expropriation without compensation (LEWC) has been a hot topic in recent months, with the effects of the uncertainty definitely reflecting in property decisions by both buyers and sellers. Much of the concern can be traced to a lack of understanding around what exactly such a policy – and change to the Constitution – would entail. This uncertainty had buyers and sellers nervous about the future of their properties (and perhaps rightly so), but as issues around this proposal become clear, it’s also safe to say that it is business as usual for the property market. The international market optimism around ‘Ramaphoria’ in South Africa would not be as

high if this policy was, in fact, likely to affect ordinary homeowners. President Ramaphosa has himself said that he would not allow the LEWC process to affect South Africa’s financial institutions that have billions invested in both residential and agricultural property. Not all doom, gloom and expropriation While it’s now clear that there is no cause for panic, there has certainly been a discernible shift in confidence in residential property markets. Silvana dos reis Marques, Manager at Leapfrog Property Group, Pretoria East, notes that home sales targets were noticeably down in March and April, and ascribes this to a reluctance by clients

to put pen to paper at the moment due to concerns around land expropriation. But it seems this panic is set to be short-lived. There’s been a major jump in positive consumer sentiment recently, notes John Loos, FNB Household and Property Sector Strategist. While FNB statistics indicate that emigration-related selling was still high in the first quarter of 2018 it is likely that the current high rate of emigration-related selling is due to a lag before the impact of improved sentiment becomes evident. Don’t get caught up in fake news Misleading reports and fake news on social media only serve to perpetuate the panic and appears to contribute to the decline in property sales, Marques notes as she urges people to confirm and verify information before sharing it on a social media platform. “There’s certainly a lot of uninformed hysteria being perpetuated, specifically on social media,� concurs Bruce Swain, CEO of Leapfrog Property Group. “At no point has government indicated that it would be

Expropriation of property (in general) without compensation also contravenes Section 25 of the Constitution, which is no small barrier. Yes, there is a chance that land could be expropriated, but even if this comes to pass there are many legal hoops to jump through. As far as residential property is concerned our message is that it’s business as usual.� The recent changes in our politics can generally be seen to be positive, and this will reflect in the property figures as well. “We really urge both buyers and sellers to educate themselves on the issue of land expropriation before making fear-based decisions about their futures,� believes Swain.


KICK ‘EM TO THE CURB - LITERALLY. The Landlord And Tenant Saga Dispelled. Being a landlord is a serious responsibility. Your property may be an income-earning asset to you, but to your tenants it is their home. So what do you do when your tenant fails to pay the rent and winds up in breach of the lease agreement? Tenants who refuse to pay their rentals to their Landlords are certainly a major issue for Landlords. South African law, it would appear on first glance, offers a vast array of protection for tenants but there is hope for the jaded Landlord who follows the correct legal processes. A recent research survey indicates that a little over 6% of tenants in South Africa were not paying rent as at the end of 2017. The survey also indicates that tenants who fail to pay their rentals vary depending on the rental category. Essentially, those who fall within the category of tenants who pay rental below R 3000 or above R 25 000 monthly have the highest percentage of default. At the very least, the Landlord should know that it is illegal to kick out his uncooperative tenant and change the locks to the access gate, even if the tenant has (in your opinion) become a squatter (i.e. an illegal occupier). The Prevention of Illegal Eviction from and Unlawful Occupation of Land Act (PIE Act) provides measures for the eviction of unlawful occupants and clearly frowns upon unlawful evictions. For an eviction to be lawful, certain procedures must be followed. The Consumer Protection Act (CPA) states that before you can cancel a lease, the tenant must be given 20 business days notice to rectify a material breach. Perhaps a good point to remember for the landlord is that where your lease makes provision for a month-to-month lease after the initial lease period ends then the 20 day notice period does

not apply as the CPA no longer applies. Also, where a written lease expires and is not formally renewed then the common law applies and you have to give your tenant one month's notice to vacate the property. So, you’ve been a law abiding landlord and followed the above procedures – now what? Well, assuming that your lease is in the initial fixed term you are entitled to send the tenant a letter cancelling the lease on the 21st day. Your letter must very politely notify the tenant that he is now occupying the property illegally and that he has, say, 48 hours to vacate. By that time, he would be well aware that you are not happy with him being there any longer. There is some debate as to when you can expect the tenant to leave the property – perhaps immediately if you’re lucky. You should definitely be cautious about granting the tenant further time on the property as you are you are tacitly agreeing that their continued occupation is valid. Perhaps a better route would be as stated above with the letter – that way you would be informing them that they have 48 hours to vacate failing which an application for eviction will be made. In terms of the Application to Court, the reasons for the application and the personal circumstances of the tenants must be set out. Upon hearing the matter, and if the Magistrate is satisfied that it is just and equitable to evict the tenant then it will give directions on how the tenant is to be served, which service is attended to by the Sheriff at least 15 days before the hearing. For obvious reasons, the tenant may oppose the application and explain why they should not be evicted. Here, both parties are given an opportunity to address the Magistrate or a Judge, either on their own or through their legal representatives. If the tenant chooses not to do anything, then an eviction order will be granted. Another tip for the landlord is where a tenant fails to move out despite the eviction order, the Sheriff of the Court can be authorised to evict the tenant immediately.

adequately set out the terms and conditions of occupation and how breaches will be dealt with in detail (after all, you want to make sure you’re in the clear). It should also set out the protection afforded to each party should either one drop the ball. If a tenant is a day or two late with the rent one month and they are otherwise a good tenant, try not to flip out but rather give your tenant a call and let them know you haven't received the rent. This usually sorts the problem. • A piece of the PIE Historically, “poor” tenants had the hardest times with keeping up with their rental obligations. The PIE Act now provides that "no one may be deprived of property except in terms of law of general application, and no law may permit arbitrary deprivation of property; and no one may be evicted from their home, or have their home demolished without an order of court made after considering all the relevant circumstances". The Act specifically refers to people groups that protection is essentially mandatory i.e. the elderly, children, disabled persons and households headed by women. • “I’m stuck, I need help” Apart from consulting an Attorney’s who have experience in these matters, like the folks here at Randles Attorneys, the Rental Housing Tribunal can advise you of your rights and responsibilities as a landlord and can help in the event of a dispute with a tenant.
