Commentary on the Housing Rental Act.

Most landlords who let residential property as a sideline, and are not what one may call professional lessors of residential property, are blissfully unaware that legislation exists which regulates the renting out of residential accommodation. This legislation, the Rental Housing Act No 50 of 1999, imposes a number of obligations on lessors, which, if contravened, can have pretty serious consequences. Firstly, a lessor may not discriminate against a potential tenant on the basis of sex, age, religion, race or creed. Furthermore, tenants have a right to privacy, and so the lessor, in exercising his right of inspection, must do so on reasonable notice to the tenant. He may not just pitch up and barge in to inspect the premises!

The lessor may demand a deposit from the lessee prior to his taking occupation. There is no statutory limit to the amount of the deposit which may be called for. However, the deposit may not be paid by the lessor into his normal bank or rental accounts.

The Act is not all inclined in the lessees favour. The Act specifically recognises the lessors rights as being entitled to expect prompt and regular payment of the rent without deduction, the right to recover arrear rent and damage to the premises (provided he has not failed to inspect further) the lessor has the right to terminate the lease on grounds other than non payment of rental for conduct that may be deemed unfair conduct. A new Quasi judicial body has been created known as the Rental Housing Tribunal, and a Tribunal has been appointed in each Province. These tribunals have certain administrative and advisory functions, but, in addition to these, it has the power to adjudicate on complaints lodged with it by a lessor or lessee who feels aggrieved by what the complainant considers to be an unfair practice by the other.

Unfair practices as far as a lessee is concerned may vary from overcrowding to exploitative rental, and so are not determined by the lease agreement itself. A tribunal, in these circumstances, might order that the overcrowding cease or a less exploitive rental be changed.
