What is suretyship, and how it can be of great benefit to you when you're in a tricky financial situation…?

Don’t worry about insurance in sectional title schemes: it’s all covered by the levy. Or should you? Communal living with many shared liabilities and responsibilities is the essence of sectional title ownership. Many people assume that the levy they pay includes insurance for everything and that they need worry no further as they believe that the body corporate’s insurance policy covers movables such as furniture and curtains as well as the buildings, common property, and all fixtures within the sections.
Different excesses apply to different risk and the more a particular risk is claimed for, the higher the premium and/or excess is likely to be at renewal.
Apart from being incorrect, this belief is unwise and can lead to serious economic loss if an owner does not consider his or her insurance carefully at the beginning of ownership and at least once a year thereafter in respect of any unit owned. It may seem a small point but the economic consequences of not paying attention to it can be serious for an individual owner.
Management Rule 29(4) specifically provides that the owner of a section is responsible for any excess payment in respect of his or her section, which is due in terms of a contract of insurance entered into by the body corporate.
The insurance details for the current scheme insurance policy, especially the replacement value the owner’s unit is insured for, should be studied carefully at the time of each annual general meeting .Each owner should also reassess the need for additional insurance in respect of the unit as well as any separate insurance policy for items not covered by the scheme policy such as furniture, electronic equipment and clothing. Trustees are required in terms of Management Rule 29 to insure for full replacement value all buildings and other improvements on the common property such as tennis courts, clothes washing and drying facilities and suchlike. Full replacement value is a moving target, especially for individual units, and owners must consider if their unit is properly insured since the trustees may have a slightly different understanding of replacement value from an owner who may have made substantial improvements to the unit. Any insurance taken out by the trustees must insure the body corporate against loss in respect of the following risks: a) b) c) d) e) f) g) h) i) j)
Fire, lightning and explosion Riot, civil commotion, strikes, lockouts, labour disturbances or malicious persons acting on behalf of or in connection with any political organisation Storm, tempest and flood Earthquake Aircraft and other aerial devices or articles dropped from aircraft Bursting or overflowing of water tanks, apparatus or pipes Impact with any of the buildings or improvements on the common property by any road vehicle, horse or cattle Housebreaking or any attempt at housebreaking Loss of occupation or loss of rent in respect of any of the above risks and Such other perils or dangers as the trustees or any holder of mortgage bonds over not less than twenty five per cent of the total number of units in the scheme may deem appropriate.
Any such insurance policy must specify the full replacement value of each unit in the scheme and if any owner thinks that value should be higher, it is increased at the cost of that owner. How are excesses determined and who pays them? The excess is predetermined and negotiated with the body corporate’s insurance broker or insurer.

Excesses for claims relating to the common property are payable by the body corporate but excesses payable in terms of sections are payable by the owner of the section suffering the loss.
There is a provision that owners may by special resolution determine that the body corporate is responsible for excess payments, in respect of specified damage but this is rarely implemented. Since many cases are not clear cut, the continued application of the rule that each owner is liable for the particular excess if he or she suffers a loss seems to be fairer. What is not covered by the general body corporate insurance policy? Your individual furnishings, carpets, clothing, curtains, vehicles, electronic equipment and anything else that is movable and is owned by you as well as anything belonging to any guest .You need to consult your broker to review your own insurance for such items and risks and be sure about any fixtures such as built in cupboards that might be covered by the body corporate policy. Any other insurance? You should also check that there is a public liability insurance policy in force for any incidents on the common property and that you are comfortable with the amount of cover it provides for. Some schemes also have insurance against loss of funds due to fraud or dishonesty on the part of anyone serving the body corporate, any trustee and any managing agent. It is prudent to have such insurance and it is surprising that it is not legislatively compulsory at the moment In general, it is sensible to investigate insurance and to know how much it is, what it covers and just how much it will cost you even though it is included in your levy. Look at your own likely risks and make sure your movables are separately and adequately insured. Consult your broker or a broker with your mortgage lender’s insurance provider and be sure you’re not sorry later on when an event occurs and you are inadequately covered or not covered at all.
