It was a year ago tomorrow, 2 October, that we printed our first edition of KZN Property Pages. When that first edition landed in mailboxes the response was overwhelming…
So, things have changed a little bit since then – through our partnership with The Witness, our distribution network has changed, for the better, our layout has also evolved.
Check your mortgage rate before you buy-to-let When you buy a property with the intention of letting it out and eventually earning an income from it, the banks will most likely only approve the home loan you need at a higher rate of interest than you qualified for on your primary residence. In addition, they may require you to put down a 20% or 25% deposit before they will consider financing the purchase at all, says Shaun Rademeyer, CEO of BetterLife Home Loans, a South African mortgage originator. Many homeowners who are planning to buy a second property as an investment - or even just to rent out until they retire - make the assumption that because they are already a ‘known quantity’ with a good track record of home loan repayment, they will be able to secure a home loan for this purchase on the same terms as the loan granted to buy their current residence. However, even if the second property is in an area that the lender also considers a ‘good risk’, they will usually be quoted a higher interest rate, and very often asked for a substantial deposit. “In fact, this happened en masse during the 2008/09 recession, and the property market in many coastal towns is still recovering from the glut of repossessed holiday homes and flats.” In short, says Rademeyer, investment property or second home purchases represent more risk for the lender – and more risk will always be offset with higher rates, or more collateral, or both. What is more, if the lender believes that the repayments on the home loan used to finance the investment property will be heavily dependent on the buyer actually receiving rental income from that property, the interest rate quoted might be even higher. Consequently, if you want to negotiate a lower rate on a buy-to-let purchase or your retirement home, your best bet is to be able to show that you can comfortably afford the repayments on the new property in addition to your current commitments - and irrespective of whether you receive rental income or not. This is probably a prudent provision to make anyway, as is the payment of the biggest deposit you can afford, because it means that you will be less at risk if a tenant defaults or if interest rates rise as they are doing currently.

Community Schemes Ombud Service (CSOS) CSOS or the Community Schemes Ombud Service is an Act passed in 2011, and has been awaiting regulations to be formatted and thereafter to be given an implementation date. The implementation date has recently been given as the 7th October 2016. The intention of the Ombud Service is to resolve disputes in community schemes as speedily as possible at an affordable cost so that all members of society can be equally represented. The Ombud Service will also ensure good governance in complexes and community schemes. 1. Ombud will deal with disputes between, owners, owners and trustees, owners and managing agents and trustees and managing agents. a. The Ombud Service has indicated that before they can adjudicate on a matter there must first be a conciliation process. b.
c.
If the Ombud has to adjudicate, then the adjudication award can be made an order of the relevant court. All disputes that are not resolved in house by the scheme must be referred to the Ombud service, instead of referring the matter to attorneys.
d.
The Ombud Service has to resolve any disputes as soon as possible with out delay, either by conciliation or adjudication.
e.
Legal representation will only be permitted at adjudications if all the parties consent, including the adjudicator or if the adjudicator considers the nature of question of law raised in the dispute, the complexity and importance of the dispute and the ability of the parties to represent themselves warrants legal representation.
f.
Disputes referred to the Ombud Service will cost R50.00 and if adjudication is required a further R100.00 will be payable.
2. Ombud will keep copies of all rules of both, bodies corporate, Home Owners Associations and other relevant community schemes. 3. Should a scheme wish to change their rules, the Ombud Service is able to decline registering the rules if they are contrary to the relevant Acts which govern the scheme.

4. The scheme will then have to make adjustments to the rules and re-submit them for approval of the Ombud Service. 5. Returns have to be submitted to the Ombud Service on the following, a. Rules, Constitution, Regulations, Memorandum of incorporation, terms and conditions of the community scheme, other governance documentation as applicable. b.
Full names, ID number, contact details (Phone numbers and addresses) and date of appointment of the executive committee.
c.
Copy of the resolution appointing the executive committee.
d.
Full details of the managing agent.
e.
A copy of the annual financial statement, together with the schemes banking details, financial year end, municipal valuation and address were the records are kept.
f.
Full name, ID number, contact details of the person nominated to represent the scheme by special resolution, together with a copy of the special resolution.
g.
Levies to the Ombud payable by 30th September every year
h.
Interest is payable on arrear levies.
i.
Distressed Schemes or individuals may apply for a waiver of the levy.
j.
All documentation required by the Ombud service is to be submitted on the relevant form, together with the prescribed fee.
6. Returns will have to be submitted once a year as well as when there are any changes to the schemes details.
7. Duties of scheme executives (Trustees in Bodies Corporate and directors in Home Owners Associations) are as follows, a.
Schemes executives have to take reasonable steps inform and educate themselves about the scheme, its affairs and activities, legislation and governance documentation.
b.
Attend all meetings of the scheme, unless excused by the chairperson in writing.
c.
Exercise an independent opinion with respect to all matters
d.
Exercise due diligence in respect to any business and preparation for and attendance at meetings or any committee that the executive is appointed.
8. The Ombud service can appoint an administrator (now known as an executive managing agent) to run the affairs of a dysfunctional scheme, or a scheme with a record of bad governance.
We believe the new CSOS Act is going to add enormous value to community schemes and can not wait for the official implementation date which is 7th October 2016.. Currently the Ombud Services offices are open for assistance to owners and schemes. Are you dealing with a Licensed Property Broker? In the past, real estate agents have not received the most positive reception from the public and a recent trend has become evident in the Property Sector, which is the increase in trading of illegal Estate Agents and Property Brokers. The EAAB and the South African Property Owners Association (SAPOA) feel strongly about the use of legal agents and urge caution to consumers when dealing with agents and brokers and encourage the public to ensure their agents or brokers are in fact licensed and registered. “It is a legal requirement that all estate agents and the companies they work for hold a current and valid FFC in order to claim commission on a property transaction. These certificates are issued by the EAAB and are subject to review on an annual basis.” Once the estate agents are qualified, their requirements do not end as they are required to undergo Continued Professional Development Training. This training ensures the agents are up-to-date with industry related changes. Principal agents are also required to maintain designated trust accounts which must be audited on an annual basis in order for the company’s FFC License to be renewed. It is important for the public to note that in the event of there not being a valid Fidelity Fund Certificate, the transferring attorneys and property owners have grounds to not pay commission. Tourism, Airbnb growth boosts property demand in Cape CBD
While many areas are beginning to report a notable slow-down, Cape Town's CBD and City Bowl areas remain buoyant. The Airbnb growth trend is one of the factors driving demand for flats in the area, and, according to Warren Emett, Alan Screen and JP Ricketts, Seeff's CBD and City Bowl team, activity is at a notable high.

SA returns to stable rental growth -

The average South African rental for Q2 2016 was R6,570.50, a 6.4% increase from the same period in 2015, according to the quarterly PayProp Rental Index. PayProp Group CEO Louw Liebenberg says that the figures show a welcome return to stability after a 1% point drop from the 7.4% measured in Q4 2015. “This has been an extremely interesting quarter to watch – one in which we’ve dug deeper into tenancy dynamics than ever before, resulting in our view that the average tenant is far more financially vulnerable than previously thought.” In the period under review, tenants who earn below R10,000 per month used up more of their available credit than other tenants. But from this point onward the trend line flattens out until the R40,000 pay bracket – which is not as one would expect. The data shows that ‘in-the-middle’ consumers are all equally indebted – and that tenants’ use of available credit only really dips when earning above R60,000 per month.

Do You Have Aliens Living in Your Garden? Apart from the potential “threat” of invading extra-terrestrials our gardens and homes are often already under threat from a different kind of “Alien”, Alien Invasive Plants, which can have an effect on how well your garden flourishes and could have an effect on the sale of your home There are a number of plant species that can be found in the everyday garden that seem rather common, however they may well be Alien Invasive Plants (AIP’s) that are not allowing the growth of beautiful, indigenous trees or flora. The National Environmental Management: Biodiversity Act, 2004 was introduced to enhance and sustain South Africa’s indigenous biodiversity and eradicate the negative effects of Alien Invasive Plants. The AIP’s are split into 3 Categories. Category 1 being plants that must be removed and destroyed immediately and Category 3 being plants that may no longer be planted. Some category 1 plants
commonly found in our gardens are Bug-weed, Cat’s Claw Creeper, Lantana and Balloon Vine. The major negative effect of the AIP’s is that they use up large amounts of water compared to indigenous plants. They reduce the flow of water to other plants as well as to nearby springs and streams. The growth of indigenous plants is dramatically reduced and some streams have dried up due to invading alien trees. AIP’s also tend to grow and spread very quickly, because they do not have any natural occurring enemies, which results in uncontrollable invasions. Since the Act was introduced Home Owners need to ensure, when selling their home, they declare any Alien Invasive Plants found on the property. Failure to declare these plants may result in exorbitant monetary fines or even imprisonment. Although there still seems to be a fair amount of grey areas in terms of the laws regarding alien species, it is best to have all the AIP’s removed from your property whether you are looking to sell your home or not. I am sure by now you are wondering whether or not you are indeed able to make a will. To answer this question, you need look no further than section 4 of the Wills Act Number 7 of 1953. In terms of this legislation anyone who is: • •

In practice they would have to prove that you were possibly so drunk that you could not have known what you were doing, or that you were so ill that you were unable to express what you really wanted in writing. If you have disinherited your spouse, he or she may have a claim for maintenance against your estate.
5.
If you have disinherited your spouse he or she may have a right to claim certain assets or sums of money from your estate. This will be determined by whether you were married in community of property or out of community of property, and whether or not your marriage was subject to the accrual system.

BLACK TAX AND THE IMPORTANCE OF HAVING A WILL The term ‘Black Tax’ is defined as being the duty and responsibility that young, predominantly black, professionals have to ‘pay back’ for their upbringing towards their families during their first few years of working and some even for a life time. It is not a legally defined term, and not everyone is subject to this duty but often stems as a result of cultural and socio economic situations.
For a young professional this could mean supporting your siblings by way of putting them through primary/high school or even varsity in order to take the load of your parents. Sometimes even the parents will look to you to support their household above and beyond trying to establish your life. The duty is not limited to the immediate family but can also include the extended family depending on the composition of the family unit and the dynamics of the entire family. At a Black Lawyers Association (BLA) National General Meeting in May 2016, the outgoing Public Prosecutor, Thuli Madonsela, touched a little on the subject of ‘black tax’ expressing how the use of the word ‘black tax’ excludes other races from this topic. She raised a point on how important it is to make sure that one concludes a Will in order to
