Restriction on your property... There has been a ‘lot to do’ in the media lately about the rise of student accommodation in the Scottsville area, as well as un-wanted B&B’s and other business operations around The City. The use of every privately owned property in The Country is subject to certain control measures, which may restrict you from making the changes you would like to make to your property. The title deed is a good place to start – it will show you any restrictive conditions on the property. These control measures are governed by:
Common and Statutory Law Common law is the law which applies if the parties to a contract have not reached agreement on a specific legal issue. Statutory law is the written law of The Country.
Spatial Development Framework Also referred to as a ‘guide plan’, these plans show how a town is laid out. i.e. Residential, commercial and industrial development areas, as well as public open spaces etc. A property may not be use for purposes conflicting with this guide plan.
Restrictions regarding the sale of the property There may also be restrictions regarding the sale of the property, which restrictions are registered against the Title Deed. i.e. in an instance where perhaps, a parent has left a property to their child in their will, and have stipulated that this property may not be sold until they reach a certain age.
Other restrictive conditions contained in the Title Deed The aim of providing such restrictions on a Title Deed is to create a property or neighborhood with specific characteristics, catering for or appealing to a certain market. i.e.

Only x% of the ERF may be covered by buildings The property may not be used for business use The property may not be subdivided The buildings may not be higher than 2 stories Restrictions pertaining to the exterior finish of a building.
For example, “all buildings must be white with grey roofs at 30degree pitch”
Town Planning Schemes The town planning scheme consists of a scheme plan and scheme clauses. The plan shows the zoning of the land, which must be read in conjunction with the clauses. Each local authority has its own town planning scheme.

That is the question… We often hear about emolument attachment orders or alternatively, garnishee orders, but do we really understand why it is implemented, by whom and who it effects? Furthermore, as a debtor, employer or 3rd party, where do our obligations lie and what are the consequences! What is an emolument attachment order in South Africa? Firstly, an emoluments attachment order is a court order which permits a judgment creditor to attach a part of a judgment debtor’s earnings. The employer of the judgment debtor, also known as the garnishee, is then obliged in terms of the granted court order, to pay the specific installments from the judgment debtor’s salary or wages to the judgment creditor on a continuous basis, until the full judgment debt has been settled.
What is the purpose of an emolument attachment order? Many judgment creditors utilize emolument attachment orders against a judgment debtor who does not have sufficient attachable assets to pay off a debt. The positive side of the emolument attachment order is that the money which is deducted from the debtor’s salary or wages by the employer, is paid directly to the judgment creditor, therefore the judgment creditor’s attorney does not have to worry about the judgment debtor spending his salary or wages before the repayment installment is required to be made to the judgment creditor. What are the general requirements for an emolument attachment order?
In the event a judgment debtor leaves his current employment - that of the garnishee, the judgment debtor must inform the judgment creditor of the new details (name and address) of his or her new employer. A certified copy of the order together with a certificate of balance of the debt owing by the judgment debtor may then be served upon the new employer. In this instance, the new employer becomes the new garnishee and is bound by the order. What is the employer’s liability who is now a garnishee?
The debtor's employer becomes compelled to deduct the sums specified in any emoluments attachment order which is served upon them by the sheriff of the court and who becomes liable to pay these sums over to the judgment creditor. What is the difference between an emolument attachment order and a garnishee order?
• There is often a lot of confusion with regards to what an emolument attachment order is and that of a garnishee order. It is in fact quite simple; an emolument attachment order, once granted, is served on the debtor’s employer - the garnishee who is then instructed to make regular monthly and / or weekly deductions from the debtor’s salary or wages towards the debt owing to the judgment creditor on behalf of the debtor’s. On the other hand, a garnishee order permits a judgment creditor to attach a money debt owed to the judgment debtor by a third party; which garnishee order once served on the third party attaches the money owed by the third party to the judgment debtor. In this case, the third party, also known as a garnishee, is required to pay the attached money debt over to the judgment creditor directly to satisfy the judgment debtor’s debt.
