To invest in student accommodation or not to invest in student accommodation, that is the question? Investing in student accommodation remains a highly attractive option provided you buy the right kind of property in the right location, says Bill Rawson, chairman of the Rawson Property Group. The disruption of studies and exams is obviously a worry for investors as well as students and parents. In recent times some students prefer staying at home and studying online or by correspondence, and some - those who can afford it - opt to attend private institutions here or overseas where they will be unaffected by protect actions.

Identifying and acquiring suitable properties The question now becomes not ‘whether to invest’, but ‘how quickly can one identify and acquire suitable properties?’ This is becoming increasingly obvious in the major student accommodation markets like Stellenbosch, Pretoria, the Southern Suburbs of Cape Town and the parts of Johannesburg surrounding Wits and the main UJ campus. In order to ensure the best returns, it is essential to take heed of what students - or their parents – are most likely to rent. This can generally be summed up as clean, safe accommodation within easy reach of campus at an affordable price. It seems that the most consistent demand is for newly built and pre-owned one and two-bedroom sectional title apartments with high-tech security, parking and good access to shops and other amenities as well as campus.

Rawson says prospective investors should also research the most popular areas and comparative prices and potential rentals with the help of experienced agents specialising in student accommodation. “They may find, for example, that apartments that are further away from campus but have good access to transport routes will rent just as well as those closer to campus but are more affordable to buy and will actually generate a higher percentage return.” It is also important to include rates and taxes, sectional title levies, insurance, maintenance, advertising and any management fee applicable when calculating potential returns. If they intend to build up a portfolio of student apartments, investors should also seriously consider appointing a professional management agent to take care of advertising, tenant screening, legally compliant leasing, deposit and rent collection, inspections and damage prevention.

A Tenant’s Guide To Renting A Home

The Rental Housing Act of 1999 governs the letting of residential property in South Africa. The Act allows a landlord to take a deposit from a tenant , but it does not oblige landlords to require a deposit, prior to the tenant moving into the property. The amount of the deposit must be stipulated in the lease agreement. It is conventional practice to pay an amount equal to one month’s rent as a deposit. However, due to defaulting tenants and the lengthy process involved to evict a tenant in default, some landlords are now asking for two months’ rent as a deposit. While the Act allows a landlord to take a deposit it imposes an obligation on the landlord to deposit this money into an interest-bearing account, held with a financial institution. The tenant must require that interest be paid at the end of the lease and has a right to request a statement of interest earned on his money at any time .The tenant is also entitled to receive the deposit and all interest earned on the money over the period it was held for, at the end of the lease agreement period subject to any lawful deductions that the landlord is entitled to make.

1. Return the dwelling in a neat and clean condition. A landlord is more likely to take a broad view about “fair wear and tear” if it is evident that you have treated his or her property with respect. For instance, ensure that carpeting, cupboards and built-in hobs and ovens are clean and remove any mildew from bathrooms.

It is therefore advisable not only for the tenant but also for the landlord to conduct a pre-occupation inspection and record all defects to ensure that both parties are aware of the condition of the property prior to the tenant take occupation.Take photographs as a record and include them in any recording of defects.If the landlord does not do anything, submit a written statement of defects and keep a record of it.

2 .You must put all communications with your landlord about damage or repairs and maintenance in writing, supported by photographic evidence. Not only will this help to prevent misunderstandings or “things falling through the cracks”, but a well-documented paper trail will also be invaluable if a dispute arises.

At a pre-occupation inspection, the landlord and tenant must carefully go through the property (including outbuildings) that will be subject to the lease and make an inventory of any defects. This inventory will be of vital importance at the end of the lease period for both parties when determining what amounts,if any, should be deducted from the deposit to repair the damage caused by the tenant. The tenant should ensure that a copy of any mutually signed and dated inventory is given to him/her and store it carefully.

5. Do not make any changes to the dwelling, including painting walls a different colour or knocking nails into walls, unless the lease agreement allows you to do so, or you have obtained the landlord's consent in writing .

If you damage the dwelling and arrange to have the damage repaired before the lease expires, ensure that you do not expose yourself to further liability by using unqualified contractors and inappropriate materials. You should therefore also include provisions in your lease agreement about: • The number of quotations that should be obtained; • Whether you or the landlord will decide which contractor to use & on what basis (price, references, quality of finishes); and • What will constitute restoring the property to its original condition. Tenants can only be held liable for repairs and not improvements, unless expressly agreed with their landlord.

The landlord has a right to deduct any expenses (from the deposit) incurred for repairing any damages to the property which occurred during the period of the lease agreement and which were caused by the tenant.

“Within 7 (Seven) days after the commencement of this lease the tenant must notify the landlord in writing of any defects in the premises. Save in respect of any defects indicated to the landlord in writing within this period, the premises will be deemed to have been in good order and condition at the commencement of this agreement”

3. Report damage to the landlord when it occurs and do not hope that it will go unnoticed or that you can leave the problem until the end of the lease. Being open and upfront will increase trust between you and your landlord and lead to a harmonious relationship .

While such deductions are permissible, the tenant has a right to request that the landlord provides him with receipts showing what the costs were in repairing the damage that was caused by him. Your money isn’t easily earned and you should do your best to ensure it is used effectively for your benefit so any tenant should ensure that he/she carries out all his/her obligations in accordance with the terms and conditions contained in the lease agreement to ensure he/she receives the full deposit as well as interest back after the lease ends.

Read the agreement you are about to sign carefully and get clarity, including taking advice, on any issues you are uncertain about.
