The Effect of Age on a Child’s legal status Capacity can be defined as having the mental ability to use the information in order to make a rational choice. According to the Children’s Act, a child is any person that is below the age of 18 years. A child may be classified as an infant or as a minor as follows: infant as being 0 months (birth) – 7 years (no capacity in most aspects), and a minor between 7 years - 18 years. A person above the age of 18 years is considered a major. What is the link between the “best interests of the child” principle and the capacity of a child? Our Constitution provides that the best interests of the child are of paramount importance. The link between creating a provision for the best interests of the child and the capacity of a child, is to determine if the current legislation in terms of the age of the child in various categories actually does consider the best interests of the child? The various categories where capacity is considered are in turn discussed in this article.
Contractual capacity… Under the common law, a contract with an unassisted minor is of no force. That means he/she can derive rights but no obligations; for example he/she can receive a gift but cannot fulfil obligations
to a contract. The minor’s guardian or parent is left with the option to ratify the agreement or not to. In terms of the Mutual Banks Act; a minor above the age of 16 can be a depositor at a bank unless the deed of establishment or statutes of the bank stipulate otherwise. That means that the minor can, without the consent of the guardian, invest in general and withdraw money and in general carry out any transactions that are normally undertaken by a depositor.
Wills…. According to the Wills Act, a person of the age of 14 years or over is regarded as a competent witness to a will. However, in terms of the Act; competency to make a will “Every person of the age of sixteen years or more may make a will unless at the time of making the will he is mentally incapable of appreciating the nature and effect of his act, and the burden of proof that he was mentally incapable at that time shall rest on the person alleging the same.”
Criminal Capacity…. The previous position was that a child under 7 years did not have criminal capacity. The current position is In terms of the Child Justice Act “[a] child who commits an offence while under the age of ten years does not have criminal capacity and cannot be prosecuted for that offence” Instead, this Act requires that such a child should not be arrested, but should rather be handed over immediately to his/her respective parents or an appropriate adult or a guardian.
The Child as a Witness… Contemporary research indicates that child victims and witnesses
struggle with various difficulties in the criminal justice system - this is attributed to the lack of maturity and developmental shortcomings. Children may therefore testify in Camera in terms the Criminal Procedure Act or via an intermediary in terms of the act.
Delictual Capacity… In terms of the common law, the age of seven years remains as the age of absolute immunity, that is, anyone seven years or younger is irrebuttably culpa incapax (not accountable). Between 7 till the age of puberty, a minor is said to be rebuttably presumed to lack delictual capacity.
Health matters… The Children’s Act provides that every child is entitled to have access to information on health promotion, the prevention and treatment of ill-health and disease, sexuality and reproduction, and health status. The act provides that a child aged 12 years may have access to condoms and other contraceptives. Previously, the Child Care Act stated that children can only consent to medical treatment and surgery at 14 and 18 years respectively. The current act has lowered the age limit to 12 years for medical treatment and 12 years with the consent of a parent/guardian for surgery.
