From the very beginning 11 years ago, organizers of the Pirates of Lanier Poker Run have always said “It’s for the kids.” “That is still true today in so many ways,” said Barkley Geib, president of Lanier Partners, who have sponsored the Pirates of Lanier Poker Run for the past 10 years. “I can honestly say that the majority of the people who participate in the event – and of course our many loyal volunteers – know that spending the day on the water in mid-July is for the bene-
fit of our children’s charities – Camp Twin Lakes, Camp Sunshine, the Boys & Girls Clubs of Lanier, and the Edmonson Telford Child Advocacy Center. We make that crystal clear.” From the very beginning, the group recognized that children in need can be supported through an event that’s also fun and family oriented. As the vision of the original founders, this approach is prevalent today. “Back in the day, Rea Williams and other founders put out the idea that we should focus on kids’ charities and everyone embraced the idea,” Geib said.
“He was quite a visionary about this event and all the good that it could do.” People dress in pirate costumers and decorate their boats to look like square-riggers and pirate ships. As they progress between card stops around Lake Lanier, crew members smile and wave – and make pirate sounds: ARGH! – at volunteers handing out cards, passersby and fellow boaters.

Water Safety Task Force prepares for July events

Keene Several times each summer, agencies from around Lake Lanier meet to prepare for major holidays and special events on Lake Lanier. “Safety has always been the top priority for all of us involved with Lake Lanier,” said Tim Rainey, project operations manager at the US Army Corps of Engineers Lake Lanier/Buford Dam office. “Coordination among all the agencies that operate on the lake and in counties adjacent to the lake is crucial to the safety of the more than 12 million visitors who come to the lake annually. When there’s a major holiday or special event, we are all on high alert.” In June representatives from fire services, medical and emergency services, the Georgia Department of Natural Resources, the National Park Service and law enforcement met at the Corps’ office to prepare of the Fourth of July holiday and the Pirates of Lanier Poker Run. The Poker Run meeting included representatives from Lanier Partners, organizers of the 11-year Pirates of Lanier Poker Run. “Safety is our No. 1 priority for our event and we have always met with officials in advance of the Poker Run, but this will be the first time that we have actually been included in the Water Safety Task Force Meeting,” said Barkley Geib, president of Lanier Partners. “To have all of the

relevant and vital agencies together will help us even better prepare for our event.” Rainey said that the task force meeting with Lanier Partners will allow the group to have a meaningful exchange with all the agencies and to ask questions. The Water Safety Task Force will also discuss safety plans and procedures for the Fourth of July holiday and the larger crowds expected at the lake for fireworks and large holiday crowds on the water and in parks. “The objective is to bring everyone together to assure that we are fully prepared,” Rainey said. “There will most likely be 35 to 40 people in the room so that we can touch base with all the agencies and resources around the lake. It is an excellent chance for us to communicate with each other and share information.” The group met in May to prepare for Memorial Day and will meet again in August to prepare for Labor Day weekend. DNR Law Enforcement Corporal Eddie Tompkins, who regularly patrols Lake Lanier, reiterated the need for all boaters to wear their life jackets whenever they’re on the water. “You would really be surprised about the number of boats we stop and cite for not having enough life jackets for each person on board,” he said. “It’s so unfortunate when we have to work a drowning because the person wasn’t wearing a life jacket.”

Dock permit and renewal fees to increase By Pamela A. Keene Dock permit and renewal fees will increase as of January 1, 2020. The South Atlantic Division of the U.S. Army Corps of Engineers announced the increase in June. “This increase in the administrative fee is effective across the South Atlantic Division, which affects more than Lake Lanier,” said Cesar Yabor, chief of public affairs and media relations in the Mobile District. “While Lanier is at capacity for new permits, this administrative fee will apply to all renewals or issuance of 5-year permits as a result of real estate transfers on or after January 1, 2020.” A spokesman for the Corps Mobile District said permits with terms ending on or before December 31, 2019 will be processed under the current fee schedule, provided all paperwork and payment are send to the Corps in a timely manner. “Those agreements will be set to a new 5year term,” Yabor said. “If the shoreline license holder’s agreement term ends on or after January 1, 2020, the license holder – should he/she decide to renew a shoreline license – will be charged according to the newly announced 5-year permit fee structure scheduled to take effect on January 1, 2020.” He said license holders will receive a 90-day notice indicating the upcoming expiration date of the current term. “The effective date of renewed 5-year term starts when the current term has reached its expi-

ration date, not prior,” he said. “If the expiration date of the current term is on or after January 1, 2020, when the new fee schedule has already replaced the current fee, the renewal will be processed in line with the new fee.” The new fee schedule applies to the transfer of ownership after January 1, 2020, as well. “When real estate is sold and the current owner has an active and paid-up dock permit, that permit is not automatically transferred to the new owner,” Yabor said. The new fee will apply to the following reservoirs and waterways: Okeechobee Waterway, Florida; Allatoona Lake and Lake Sidney Lanier, Georgia; Walter F. George Lake and West Point Lake on the Georgia-Alabama border; Lake Seminole on the Georgia-Florida border; Hartwell Lake and J. Sun goes down on weary cyclists on Lanier By Jane Harrison The sun set on hundreds of road weary cyclists at Lake Lanier Olympic Park June 2. Too worn out to shake a leg during the free rock concert in their honor, the exhausted throng uttered bragging rights to completing one of the most arduous segments in the 40-year history of the Bicycle Ride Across Georgia, BRAG for short. The 74-mile course from Ellijay to Gainesville took the perhaps the cruelest route possible, with a side trip up Burnt Mountain west of Ga. 136 and quadburning trek up one of the toughest climbs in North Hall County. “It was one of the longest and most challenging routes ever,” admitted Franklin Johnson, BRAG executive director. Plenty of participants would swear there’s another mountain between Burnt Mountain and Lake Lanier, he said. About 1,100 cyclists wheeled from the mountains to the sea and stepped out of their pedals for the final stop in Darien June 8. All done, most gave it positive reviews, Johnson said. He raved about the Lake Lanier stop. “The venue was wonderful. It was a real treat to stay on the water. Riders enjoyed seeing the sun set on the water and the concert at the Olympic grandstands,” he said. Most overnighted in tents on LLOP grounds or bedded down in the boathouse, according to LLOP Executive Director Robyn Lynch. “They cleaned up well after themselves. They were very well organized, bringing their own medical (crew), security and showers … We’d be glad to have them back,” she added. About 200 stayed in area hotels. Motorists courteously shared the road, even when the twowheeled tourists spun down

Almand, reached on his cell in Clermont after a 26-mile recovery ride, spoke proudly about logging his 25th BRAG. The Burnt Mountain ascent put a lot of folks off the saddle, walking. Almand, 69, pushed onward, he said, “but it was really hard.” Lloyd Unnold, known unofficially as the grandfather of road biking in Hall County, observed Support and Gear vehicles (SAG
wagons), toting loads of bikes, with other tuckered out riders looking to hitch a ride on the next SAG run. Unnold, who no longer bikes, said BRAG course-makers contacted him prior to mapping the anniversary tour. He advised alternate routes that didn’t climb the mountain or North Hall’s Hubert Stephens Road. He agreed those who made it indeed had something to brag about. Almand described LLOP as the “perfect place” for a BRAG night out. He commended Gainesville motorists and police department for getting the cyclists safely out of town and on to another 70-plus mile route into Covington. Almand called the third leg, through Georgia heartland from Covington to Montecello, the “15 hills of hell.” But it’s a journey that brings them back, no matter which roads are chosen across this diverse state. “The whole week there are more than 900 people around you. When I get home it sure is quiet,” Almand said. One of my favorite things to do on Sunday morning is to sit out on my deck with a cup of coffee and the Sunday Times crossword puzzle. Unfortunately, I have to do it early as about 9 a.m. the neighborhood leaf blowers fire up. I fondly remember the quiet days when people used to rake leaves. You could sit outside and enjoy the trees and the sky with the birds chirping and the other sounds of nature and concentrate on what you were doing. Now with the leaf blowers you need a set of ear plugs. I’m sure that all of the lawn services instruct their employees that if they finish a one hour job in 20 minutes, to put on their head phones, start up the leaf blower and walk around for the remaining 40 minutes. A distant relative of the leaf blower is the Jet Ski. Now you may think that this is like comparing a barge to a sailboat, but besides from both of them being things that float on the water, they are both required to display the same running lights after dark, i.e. red and green port and starboard and a white light on the stern. Jet Skis and leaf blowers both use gasoline engines to

make a racket in the otherwise quiet and pristine environment of the lake and are similarly annoying. I have ridden Jet Skis as well as Ski Doos (snow mobiles) and have been a long-time motorcycle rider so I can understand the mentality of having the power to go from point A to point B very quickly. The feeling of control with the rush of the wind going past and the centrifugal force of a turn taken at speed is exhilarating. The favorite sport of Jet Skis is to jump the wake of larger boats, the closer the better. This would be all right if they had full control of the craft and the boat making the wake was small enough that they could see what’s coming on the other side. When they try it with an 80-foot houseboat there are occasionally spectacular midair collisions. You can check
them out on YouTube. Now when I first moved to the lake about 25 years ago, my nextdoor neighbor was a fishing guide. He had been on the lake forever and knew an awful lot about fishing in general and fishing on Lake Lanier in particular. July is the busiest month for lightning strikes
Thunderstorms have been very frequent this summer. Yes, El Nino is still with us and will likely stay through fall. This means an increased risk of summer storms along with an increased risk of them being strong or severe. Rainfall in these storms has been exceptional as well. Tropical air contains a lot of water vapor and it does not take much for a summer storm to generate three to five inches of rain per hour. While El Nino may keep us in an enhanced summer storm pattern, it is also great news for the Atlantic hurricane season. The wind shear caused by El Nino makes it much tougher for a hurricane to form. Another bonus is the African dust layer. Over the past month we’ve see clouds of dust the size of states moving out over the Atlantic. Wind shear and Sahara dust teaming up really reduces the risk of hurricane formation. We will see. NOAA has predicted an above average season. I know there are many people that like to head to the beach this time of year. Some of you head to the East Coast and some to the Florida Gulf Coast. There are usually major storms this time of year. These storms will produce intense lightning. Some of that lightning will hit the beach sand. Since a typical lightning bolt is about 50,000 degrees hot – five times
hotter than the surface of the sun – the sand it encounters will melt, Glenn creating what is called a Burns fulgurite. I have seen quite a few on the beach after Lanier an intense lightning Outlook storm. They look like little trees with “spikey” branches. They can range in size from a quarter to a small tree. Next time you are at the beach and the opportunity of walking on the beach after a storm presents itself, do a little exploring. Fulgurites and like snowflakes. No two are every alike. They are always fun to discover. We always see trouble from lightning during the month of July. It’s our most active storm month and the wettest month of the year for north Georgia. We average 5.12 inches but, more often than not, we usually double that in spots. Lightning is always vicious, which always concerns me when lakes and boats are involved. We have two different types of lightning, positive and negative. The negative strikes, which make up about 90 percent of all lightning, can contain 300,000,000 volts with 30,000 amps of electricity. To put that into perspective, a typical light bulb is about 120 volts and 12 amps! However, the positive lightning bold can reach a billion volts with 300,000 amps! City of Gainesville now owns Lake Lanier Olympic Park
By Jane Harrison A new era began for Lake Lanier Olympic Park this month as the city of Gainesville assumed ownership of the venue that hosted 1996 Olympic rowing and paddling events. As of July 1, the 35.5 acre park was added to the string of outdoor jewels managed by the Gainesville Parks & Recreation Department. Prior to legal proceedings that allowed the city to annex the park from Hall County and increase the hotel/motel tax to support it, the venue was jointly managed by the city and Hall County. Each contributed $150,000 annually from 2014 until this fiscal year, which began July 1. The county has

Rentals of park facilities, such as the Olympic tower meeting room, Olympic plaza, and boathouse, still go through the LLOP website. Eventually, registrations may transition to the parks department. Q: Were the new programs offered this summer (open water swimming/water safety, yoga, and PaddleFit) initiated by the parks department? A: No. These are programs Lynch and the foundation have planned for years and they now have the resources to offer them.

By Jane Harrison ake Lanier seems to lure strong-willed adventurers who chase extraordinary goals its between its shores. Legends of the lake have put their bodies on the water for miles facing down challenges unfathomable to the average lake lover. A new one joined their ranks in June on a 400-mile journey-by-kayak around the lake in less than a week. “It was the toughest thing I’ve ever done,” Atlanta area adventure racer Joshua Forester, 37, said moments after he rolled out of his kayak at nightfall June 12 at Tidwell Park. Whitecaps reverberating against the boat ramp seemed to portray the lake’s unwillingness to give up the courageous journeyman who’d seen every cove, inlet and finger of the vast body of water. The endurance athlete who jumped from high school and college distance running onto bikes, kayaks and crampons described the Lanier Lap as more grueling than his 14-day ascent of Denali, the highest peak in North America. The night before he launched, he pondered the daunting task ahead. He expected “a lot of drudgery, suffering, highs and lows, and moments of euphoria when you see something that
strikes you as awe inspiring, like a sunrise, or the 20,000 canvasses God painted for you in nature.” But it was something totally unexpected that helped him complete his mission. The champion adventure racer admitted he underestimated the difficulty of the odyssey that began 6 days, 14 hours and 27 minutes before he met the cheers of erstwhile strangers at the park where he started. He’d been pelted by rain, flashed by lightning, tossed by waves, chilled by unseasonably cool nights, reddened by sun, wracked by nausea and made sore by the repetitive motion to keep alive his goal to complete the fastest ever circumnavigation of the lake in a kayak. His biggest surprise What surprised him most was the generosity of a lake community that fed him steaks, sushi, shrimp and tacos from shore and laid out cots and blankets on their docks for him to bed down an hour or two. Rallied by Gainesville resident Lu Treadway, friends in the Lanier Dwellers Facebook group adopted Forester as “our boy.” At the finish, he blinked back tears as he thanked the core group of supporters he’d never met before he took paddle in hand. Without them, he’s not sure if
he could have made it. “I truly didn’t know hard it would be,” he said as new friends congratulated him with champagne, beer, pizza and chocolate cake. “I had no idea 10 years ago that so many would help me chase down something like this.” Hundreds of Lanier watchers got caught up in Forester’s dramatic pursuit through Facebook and Strava, a social media network that tracks distance athletes and posts their progress through texts. He kept them enthralled with regular witty, good-humored and sometimes near-poetic posts that drew them into the journey. He shot photos and videos of “secret whitewater” surging after a downpour, hard rain falling like pellets, and unusual night sky illumination, which he dubbed “Aurora Lanieris.” He followed a notorious clip of him chugging a pint of cream with the revelation that he later vomited. Self-deprecating photos showed a weathered wayfarer looking out of it, cross-eyed and fatigued. Forester followers on Strava traced his whereabouts on cell phones and computers through a blinking dot on a Lanier map. They’d curl up in a comfortable bed at night, find the pulsing dot, and marvel “he’s still out there.” Tracking the Lanier Lap became a near addiction to folks who checked on Forester repeatedly, electronically or face-to-face. Other ‘legendary’ accomplishments
Following are a few recent endurance athletes who completed personal challenges on Lake Lanier. Many others, including Olympic rowers and paddlers and Ironmen triathletes, have felt the lure of the lake to test their mettle. • Mario Delgado, 2009: Lake Lanier Rowing Club member rowed a 30-mile solo round trip between Clarks Bridge and Browns Bridge. He later teamed up with doubles rowing partner Gary Sickinger to stroke to Buford Dam from Clarks Bridge. • Chris Shoup, 2012: Buford swim coach swam 23 hours to complete a 43.3 mile round trip between Buford Dam and Thompson Bridge. • Dana Richardson, 2015: The Hall County teacher paddled the circumference of the lake in sections to complete it within four months. The pancreatic cancer survivor raised thousands of dollars for Relay for Life.

The paddler edged in close to say hello. “It’s amazing what an hour of sleep will do,” he said, smiling and looking amazingly fresh as he dipped his cap into the water to cool his head. “My muscles are probably cannibalizing each other,” he added, alluding to searing pain in his arms. He turned down a couple of peanut butter and jelly sandwiches and set out for a sleep stop at Don Carter State Park. Dot watcher Peter Markey stopped at Lake Lanier Olympic Park to catch a glimpse of Forester paddling by. The south lake resident happened to be driving a delivery on the north end and checked Forester’s location on his cell phone. “I had to see if this guy is for real,” he said. He got out of his truck, waited, and yelled encouragement as Forester and a training partner paddled by. The two were overheard on the Olympic channel chatting about Olympic paddler Ivan Lawler, a British multi-medalist who Forester said taught him the sport. At the state park, Shanna Irving, Forester’s fiancée, welcomed
him to a lakeside campsite, an arm massage, and tacos. She later told Lakeside News she never doubted him. “I know him to do things like this. This is the biggest so far. He impresses me every day with his brilliance and stamina. He’s not one to give up. When he started, I knew he’d finish.” That finish came more than a day after Forester was expected back at work as a Georgia Tech research technician. Night fell as a couple dozen Lanier Dwellers mused about interactions with the sojourner. “Lake Mom” Treadway, who rode her jet ski like a aquatic food truck, said she’d open up a goodie bag of “things a mom would bring,” strawberry smoothies, orange juice, chocolate shakes, and he’d take his pick. She witnessed him in a few down moments, but “once he got his rhythm up and ready, he was in good spirits.” Self-described Lanier Lap “groupie” Diane Rothberg, who actually swam a veggie burrito out to Forester, described her inspiration as a “Navy Seal” type, someone with courage and integrity who practices serv-

For many of the dozen people who gathered in early June for America’s Boating Club Atlanta’s daylong Basics of Boating class, learning about safety on the water preceded their boat purchase. “Taking a basic boating class has many benefits, from helping you learn the Rules of the Road to getting a possible discount on your boating insurance,” said Margaret Sherrod, education officer for ACBA. “Taught by our trained members, the class covers quite a bit of material and gives attendees a good overview of responsible boat ownership.” ABCA offers the class frequently throughout the year for $20 per person. Participants can purchase the accompanying 270page full-color text for an additional $20. “Anyone can participate in the class, and in fact we frequently have new and experienced boat owners as well as youngsters around age 12, who are approaching the age to be able to drive jet skis if they have passed an approved boating course or with a

Instructors generally have several decades of boating experience on inland lakes, island cruising and even open-water
boating and/or sailing. Here’s what the class covers: boat handling, docking and anchoring; trailering; safety equipment and procedures; navigation basics and “Rules of the Road”; boat types and terminology. “One of the most important Rules of the Road is that both boaters, no matter who thinks they have the right of way, must do everything possible to avoid a collision,” Sherrod said. “On the water, it’s not a matter of who’s in the right; it’s all about safety.” Know the laws One of the most overlooked

Don’t take chances. And anytime you go out on your boat, let a responsible person back on shore know of your plans and anticipated return time. • Boating laws can be jurisdictionally specific. Some are federal laws that apply across the United States; others are state or locally applicable. Bonds help fund conference center work at Lanier Islands By Pamela A. Keene The state of Georgia will be selling $6.3 million in bonds to help fund the next phase of a new conference center at Lanier Islands. Officials at the June meeting of the Lake Lanier Islands Development Authority were updated about progress on the proposed project. The funding will become available as of August 1, 2019. It is part of the state’s FY 2020 budget. “Phase 2 is about 99 percent complete for the conference center,” said Bill Donohue, executive director of LLIDA. Phase 2 was funded for $4.3 million. Next steps include continuing to develop the design and meeting with officials from
Lanier Islands Management about next steps. “We are very excited about this project,” said Grier Todd with Lanier Islands, “and we’ve been working diligently with our partners. This is a project that Mr. (Virgil) Williams has envisioned for the past 10 years, and it will certainly take the islands to a bold new level.” Todd also reported that attendance at Lanier Islands and Margaritaville at Lanier Islands is up over the same time in 2019. “We had a great kickoff for the new season and the hotel has been performing very well,” Todd said. “We are looking forward to a great year.”

Convery, one of the course instructors. “I’ve seen cases where boaters have been taken to court and have been found guilty of negligence because of creating a damaging wake.” Be prepared The class covers what equipment is required on a boat, from visual distress signals and up-todate fire extinguishers to personal flotation devices and a copy of your boat registration. “One of the free services that ABCA provides here on Lake Lanier is our voluntary vessel safety checks,” Sherrod said. “We can spend a little time with you on your boat going over the

Hideaway Bay hosts Hall Firefighters

Keene Once a year or so, management at Hideaway Bay Marina invites members of Hall County Fire and Rescue to the marina for staff training, and inspections by fire personnel. “This is an excellent time for our own staff to brush up on their skills in case of an emergency, and for the fire department to help us make sure we’re prepared in case of any kind of emergency,” said Michael Duling, manager of Hideaway Bay. “We want them to come out and interact with us, to know the property, where the shutoffs for the gas and dock power are located, and generally be familiar with us.” Personnel from Fire House 8 and Fire House 5 were both on hand for the training. It gave them a chance to run some of their drills related to putting out boat fires
and managing rescues. Duling said that it’s an important time for the staff as well. “Our staff needs to know what to do in any sort of emergency and when the fire personnel and our staff know each other, it will be more smooth to respond effectively.” First-responders also became familiar with the facilities at Fish Tales Restaurant, identifying water sources, system controls and power for the popular restaurant located at Hideaway Bay Marina. “Everyone, including the first responders had a really good time,” Duling said. “But I tell you, I was so impressed with their professionalism and their seriousness about their jobs. They certainly know that what they do is serious and that people’s lives depend on them. We are glad to have this caliber of first responders here in Hall County.” Members of the Hall County Fire Department use their ladder truck to extend water flow over the lake at Hideaway Bay.

Lake Lanier CVB brings the world to Northeast Georgia By Pamela A. Keene The Lake Lanier Convention & Visitors Bureau helps bring the world to Lake Lanier and Northeast Georgia. Whether supporting the World Dragon Boat Championships or developing promotions and marketing campaigns, the CVB’s staff serves as the area’s biggest cheerleaders. But the work of the agency goes far beyond cheerleading. Funded by Hall County’s Hotel/ Motel Tax and monies provided by the Lake Lanier Islands Development Authority, the organization actively promotes Lake Lanier and attractions in Northeast Georgia through trade shows, media visits and regional and national media. The CVB recently held its annual meeting to recap the successes of the past 12 months. It has broadened its mission and service to include more local events for area citizens. “Our funding partners include LLIDA, Buford, Hall County, Flowery Branch and Oakwood, as well as income from our programs and events,� says Stacey Dickson, president of the Lake
Lanier CVB. “It’s our job to take their messages to marketing events, groups, tourism partners and media across the country and even the world.� For instance, the 2018 World Dragon Boat Championships brought international athletes, coaches and supporters from 14 countries to Hall County and Lake Lanier. “We are now on par with Moscow, which hosted the event in 2017, and India, which will host the championship in 2019. That’s saying quite a bit about us.� The bureau represents Lake Lanier and Hall County at regional, national and international tourism conferences for recreational visitors, business travelers, group sales and affinity organizations from those that specialize in RV tourism. In the past 12 months, the CVB has initiated or continued a number of programs, including its Mobile Marketing Vehicle that travels throughout the community to provide information to visitors and residents, a tourism ambassador hospitality training program and an area attractions council to
keep tourism partners in better communication with each other. The bureau has cited successes by booking a new kayak fishing tournament slated for August, a Boomers In Groups conference in partnership with Explore Gwinnett, and contacts with more than 450 new businesses through networking and one-on-one appointment. “The Margaritaville at Lanier Islands story appeared in more than 50 consumer, travel and trade publications,â€? Dickson said. “It has gotten a great deal of national attention for our area.â€? Several days of dry weather and high temperatures followed by several days of steady rain can wreak havoc on your landscape. Have you tried mulch? Mulch can work wonders to help hold in moisture and reduce the need to water frequently. A thick layer of mulch can also smother weeds and retard their growth. When the weather stays dry for more than four or five days, the ground gets hard and loses its ability to absorb water, either from human watering or rain. You’ll notice that you’ll get runoff pretty quickly when you water. Installing about three inches of mulch around plants, shrubs and trees will help hold the water where you put it. Experts recommend that you mulch any bare spots around your yard, covering exposed clay or dirt. Mulch will help control erosion and water runoff. Mulching your vegetable garden is helpful as well. We plant our tomato, okra and pepper seedlings in compost-rich soil, then fertilize and water. Next we spread one to two layers of newspaper across the exposed areas of

This year, our tomatoes are already more than six feet high and have outgrown our large circular wire cages. This newspaper and mulch technique has also helped hold tomato diseases at bay including the dreaded fusiliam. Using mulch to hold water in the soil helps reduce the chance of blossom end rot, because the plants stay evenly moist. Plus, we don’t need to pull weeds. Mulch materials vary from pine needles to shredded rubber tires. My preference is natural materials, particularly chipped wood or shredded cypress. Pine straw typically doesn’t last very long. Pine bark, while it looks
pretty, doesn’t stay in place very well. As for colored mulches and those made from rubber, I suggest staying away from these. Colored mulches fade and they don’t look natural. Mulch made of old tires, while it encourages recycling and repurposing in the truest sense, can hold excess heat and may not be safe for plants. Approach mulching your landscape as an ongoing gardening project. Do a bit at a time and it won’t be overwhelming. Here are some tips for proper mulching: Know the source: Be sure to use “clean” mulch that doesn’t include insects, weed seeds, chemicals or dirt. Mulch from unknown sources can do damage to your lawn and plants. Purchase larger quantities of bagged mulch when it goes on special at local box retailers. Mulch will not deteriorate in the bags if it’s stored in a covered area away from rain, so you can save unused bags until you need them. Check with local tree services to see if they are willing to dump their chipped trees and branches in an accessible place in your

yard. It may save them the expense of dumping excess chipped wood in the landfill, and you’ll get good quality mulch for free. Annuals and perennials can be mulched right up to their stems; however when mulching shrubs and trees leave several inches of bare ground, based on the size of the plants, between the trunks and the start of the mulch.
Keep mulch at least six to eight inches away from the foundation of your home to protect from inadvertent encroachment of insects and termites. Owner of abandoned boat is charged
By Pamela A. Keene For a couple of weeks, a 64foot Bluewater Yacht lay partially sunk in Margaritaville at Lanier Islands’ Sunset Cove. After an investigation by the Georgia Department of Natural Resources, the owner has been charged with a felony for unlawful dumping of hazardous waste into Lake Lanier. “As a result of our investigation, owner Sirone Devon Kearney, 20, of Williamson, Georgia, has been charged with unlawful dumping of hazardous waste and with failure to register his vessel,” said Corporal Eddie Tompkins, with the Law Enforcement Division of the Georgia Department of Natural resources who investigated the incident. “The boat started taking on water in Sunset Cove and numerous people on the boat had to be rescued by the DNR and the Hall County Fire Department.” The boat was left partially submerged at Margaritaville at Lanier Island’s Sunset Cove for several weeks. At press time, it was scheduled to be removed by the end of June. “In these cases, it’s the responsibility of
the owner to remove the vessel,” Tompkins said. “However, we understand that a private entity may be removing it then following up with the owner for compensation.” The Lake Lanier Association has been actively working to remove abandoned vessels and derelict docks on Lake Lanier when it is not possible to identify the owner. Because the owner of the boat in Sunset Cove was known, the removal did not fall under the association’s program. The association has been working with the Corps of Engineers, the Georgia DNR, law enforcement and various jurisdictions to research ownership of these abandoned vessels and docks and take them to court.

CRK initiates summer beach monitoring
By Pamela A. Keene Five popular beach and swim areas on Lake Lanier are being regularly monitored this summer for water quality. The Headwaters office of Chattahoochee Riverkeeper began the program around Memorial Day that will continue through Labor Day. The organization is using volunteers to check water quality on Tuesdays at five locations on the lake – Hall County’s River Forks Park and Wahoo Creek Boat Ramp and Park, Gainesville’s Longwood Park and Lake Lanier Olympic Park, and Don Carter State Park. In early June, the sampling showed elevated levels of E. coli at River Forks beach. “We contacted the proper authorities for additional testing and for a time the beach was closed,” said Dale Caldwell with the Riverkeeper’s Headwaters office in Gainesville. “The issue was attributed to geese and the current readings are showing improved quality. The beach has been reopened.” Riverkeeper has uploaded this data to www.theswimguide.org so that people can view water quality information. The side includes access to a mobile app.

And while the majority of participants return each year, new boaters join as well. “We have many loyal boaters – from locals to those who come in from out of town and out of state – who come back each year,” Geib said. “And in looking back over the years, I can’t think of a single person who has kept the money they’ve won from their poker hands. It’s just in their hearts to give back to the kids, and after all, that’s what it’s about, isn’t it?”

Hiring the right contractor can be a difficult task, but if you know the right questions to ask and red flags to look for, you’ll feel better prepared. Finding the best contractor can depend on a lot of factors, like what project you are looking to do, whether it be a large-scale renovation or just some light handyman work. It is also important to consider when you want the project completed and how much you’re willing to spend. Once you decide on the general scope of the project and your budget, it’s time to start searching for and interviewing contractors. Make sure you really take the time to do some research. Ask local friends and family for recommendations and search online for local professionals. A simple internet search will give you some great results to start with, but also check out sites like Houzz, or even Facebook, Pinterest or Instagram for pictures of projects and/or reviews. Once you find a contractor or two whose work you like, do more research on their specific companies. First of all, make sure they are licensed and insured. In the slight chance that something

Also, when it comes to the interview process, be up-front and don’t be afraid to ask questions about licensing, credentials, timing and budget. By Jane Harrison Special Master Paul J. Kelly is devoting time daily in attempt to resolve the water war between Georgia and Florida, according to staff in the federal court office where he is based. This is despite lack of any public filings on the case public docket since March 22. Neither court officials nor attorney generals from either state could give any explanation for the unprecedented delay in the nearly six year legal battle originating with Florida’s lawsuit in Oct. 2013. Florida alleges Georgia hoards water on the Apalachicola, Chattahoochee, Flint river system, causing ecologic and economic harm downstream in Apalachicola Bay. Lake Lanier is the largest reservoir on the river system shared by the states. Kelly’s most recent posting on the case docket is basically a change of address listing for legal parties involved in the case. As of late June, he had not responded to a March 12 Florida request for oral arguments. Special masters are required by law to record procedures, transcripts and correspondence from their cases on a public docket. The docket for Florida v. Georgia is linked to the website of the U.S. 10th Circuit Court of Appeals. Kelly, age 78, a 26-year judge with the appellate court based in Santa Fe, N.M., has heard and ruled on several other cases from the court’s six state region.
“I know Judge Kelly is not putting it aside,” said Tenth Circuit Appellate Court Clerk Betsy Shumaker. “He’s working actively on it every day.” She added that although her duties focus on the circuit’s cases, she assures that “everything is on the website” regarding the federal case’s orders and procedures. She could not explain the apparent delay in the long-running case. Attorney Jason Dunlap, hired as Kelly’s special assistant, said he is “not free to make comments on the case.” Dunlap’s tenure on the case goes back to its early days when he clerked for former Special Master Ralph Lancaster. The case docket under Lancaster shows activity nearly every two weeks, including monthly transcripts from teleconferences between him and states’ attorneys. His recommendations ultimately were remanded by federal judges, who appointed Kelly to succeed him last August. Since then Kelly has declined to accept additional evidence beyond the millions of pages already submitted electronically and on paper. He indicated he had sufficient evidence to decide the case. However, he posed specific questions to each state regarding water usage, needs and costs. Each has responded and offered counter-arguments, leading to Florida’s request for oral arguments to further plead its case. Georgia submitted no objections to that request. See Lawsuit, page 64

By Bev Knight For most sellers, the goal is to get their lake home under contract for as high a price as possible. They don’t realize that a binding contract is just the beginning of the sales process. Virtually every buyer will schedule a home inspection. Even on as-is offers, buyers want to measure their exposure before their due diligence expires so they can get their earnest money back if the needed repairs are too extensive. Most homeowners say, “They won’t find anything wrong with this house.” Trust me, they will. Even new construction has some type of issue. Knowing what to expect makes all the difference between a smooth closing and a contentious negotiation after the inspection. Buyers will submit a “Request for Repairs” asking the homeowner to fix certain problems identified by the inspector. The owner can choose what they’re willing to fix. If the two parties don’t come to an agreement, the buyer will have the right to terminate the offer and their earnest money will be reClub

funded. If you have an older home, it may be advisable to have a prelisting inspection to identify problems. Then you’ll have time to fix them. It is also important to disclose all known problems and especially, how those problems were resolved (if they were). When you disclose it (required by law) before you get an offer, you can make a case that they knew about it before they made their offer and you shouldn’t have to fix it. You don’t have to fix anything, but you may lose potential buyers if you don’t. Plus, once a problem is identified, legally you have to disclose it to all future buyers. With all this in mind, here are 10 problems often found in lake home inspections. Most buyers will ask for these to be repaired; so, if you can fix them ahead of time, you can avoid the time constraints and stress later and will have more time to shop around for the best deal with contractors. 1.) Rotted wood – In humid Georgia, the wood around doors and windows often starts to rot. This opens the door to leaks,
mold, pests and other issues. If the inspector can stick a sharp object into wood that looks rotted, they will recommend repairing it. This type of work is not that expensive, and most handymen can handle it. 2.) Compromised Window Seals – Most of today’s windows have two panes attached by seals between them. If that seal is broken, the window will start to fog. Inspectors will always report these broken seals and suggest replacement for maximum energy efficiency. With this problem in particular, it pays to shop around for the most cost-effective contractor. Replacing windows can be expensive, and some units must be ordered in advance. That can take weeks. 3.) Leaks – Sooner or later most homes have some type of leak. It could come from roof issues, gutter problems, or even overflows from sinks and AC units. Without a doubt, leaks are deal killers. Make sure the leak is fixed, paint over the evidence of the leak, and be sure to disclose that there was a leak and how it was fixed.

4.) Roof Issues – Most homeowners have insurance on their roofs. If your roof is old and/or damaged, check with a contractor who works with insurance companies to see if it has hail damage. If so, your insurance should cover it. In most cases, you’ll be asked when the hail storm occurred. This information is available on the internet. Then, go ahead and get that new roof. It may or may not add value to the home, but a bad roof can definitely kill the sale. 5.) Rodents – If you live on the lake, there are rodents who want to take up residence in your attic. Most likely you had this treated by a wildlife exclusion company, but most companies don’t clean up the evidence of the old infestation. Virtually all inspectors will report there are rodent droppings and recommend a professional wildlife inspection to make sure it isn’t current. First and foremost, disclose that you had an infestation and how you had it treated. If possible, vacuum up the droppings or have your wildlife exclusion company do it. This is just a matter of making

sure they know that this problem has been addressed. 6.) Decks Not Up to Code – You don’t necessarily have to bring everything in your home up to the current building codes. After all, they are constantly changing. But one element that inspectors key on is your deck. Many decks are simply nailed to the home, and that really is dangerous. Others are screwed in which is better; but, all inspectors strongly recommend that decks have a specific kind of bracketing connecting it to the structure of the home. This is an inexpensive fix and safer for your family anyway. 7.) Cracked Sheetrock – Remember the story of Chicken Little screaming “The sky is falling?” Sometimes when inspectors see cracked sheetrock, they scream “The foundation is crumbling.” OK, that was a gross exaggeration, but it does raise a question about the foundation. All homes settle, and sometimes that creates cracks in the sheetrock. These are easy to fix, and your painter can usually handle it. It is See Home, page 70

During two weeks in June, 46 students took part in the UYC Maritime Foundation’s Junior weeks. Although the weather was spotty, with numerous rain storms, students managed to spend plenty of time on the water in the club’s various types of sailboats while coaches provided instruction and encouragement from Zodiacs close by. The majority of this year’s instructors, all certified US Sailing Level I, were former students of the program. They earned their certification in a special US Sailing class this spring. When the weather kept students indoors, they learned about boating safety, knot tying and seamanship. Lisa Wilson with America’s Boating Club Atlanta brought the organization’s boating simulator for participants to have hands-on experiences about navigation and real-life situations. The program is sponsored by the UYC Maritime Foundation and is held at University Yacht Club each June.

As most of your readers probably know at this point, the administrative fee schedule for licenses associated with private docks and the shoreline management program will increase on Hartwig January 1, 2020. This means any license expiring

First, this new fee structure reflects an ongoing increase in administrative costs to deliver the shoreline management program for private uses of public property. These fees include the rise in staff time and costs to improve processing new applications, renewals and change of ownership inspections, as well as manpower required for other inspections and actions to further protect the public property around the USACE lakes in the region. To remain regionally consistent in our execution of this program, we have reviewed it in detail, using organizational concepts to ensure we were employing the most efficient process possible and assign a cost to these steps. We concluded that the cost for delivering the program at a reasonable level of service would be $835 per the five year term. The term fee is equivalent to $13.92 per month or $167 per year. The shoreline management real estate transaction involved in these private uses covers the entire process, from prerequisites to execution. These fees cover cost of labor, equipment, materials and supplies used to issue, reissue, or

change owners of a license. The fee is based on the regional average cost to issue a real estate license. Many people do not realize that until this increase, the majority of the costs of the shoreline management program was shouldered by all taxpayers. With this change, the administrative fee paid by the end-users will be applied toward management of the program, minimizing use of funds from the general budget, which had been supporting much of the administrative costs. As responsible stewards of public property, we can no longer continue to rely as heavily on taxpayer dollars when there is no public benefit. Due to competing mission needs at multipurpose reservoirs such as flood control, hydropower, navigation and recreation, USACE can no longer subsidize the entire shoreline management program with appropriations from our budget as has been common practice in the past. The redirection of appropriated funds to the shoreline management program leaves noticeable gaps in other critical mission areas where life and property may be at risk. It would also have a negative environmental impact to issue these licenses
without thorough consideration of natural resources. Without the end user covering the cost of administration, the service levels to the permit/license holders would be noticeably affected as we have to ensure other mission areas are properly addressed using appropriated funds. It is also important to note this fee structure only applies to the few USACE lakes where docks are allowed. Of the 33 lakes in the South Atlantic Division (which encompasses seven southern states in VA, NC, SC, GA, AL, MS and FL) only 11 lakes authorize these private structures to be placed on public property. The other lakes in this region, Carters Lake or Richard B Russell for example, do not allow this type of activity. Public land is for everyone’s use. There is no public benefit when the Corps issues a Shoreline Management Permit/License for individual private use on public property. It only benefits the person(s) to whom the instrument is issued. Every sojourn into the blue hills of Northeast Georgia awakens feelings of my Cherokee ancestors’ spirits. The beauty of these sacred mountains and all the stories of the past easily flow through my mind and body which makes me forever embrace every return trip. In my youth, my father and I would roam these hills and valleys seeking the wild, elusive native brook trout or track black bear to feed us through the winter. My return this time, however, was to chase a little white ball in one of the most picturesque places in Georgia: Sky Valley. Though this area along the Georgia/North Carolina border was once part of the Cherokee Nation, white settlers have been scattered throughout these mountains for more than 200 years. Before Sky Valley became a resort town in 1978, it had been the Square D Cattle Ranch. It was later known as the original Kingwood Country Club, but was converted into a ski resort that had a comfortable lodge with floor-toceiling wood burning fireplace. Some of the ski slopes continued to operate until a change of ownership in 2004 closed them down completely. The Sky Valley community continued to grow, but the largest change came when Atlanta-based golf architect, Bill Bergin, spent two years renovating the golf course. The final result is a golf venue with breathtaking views, challenging fairways and greens and the addition of tennis, swimming and many other activities. After the financial crash in 2008, the Sky Valley homeowners banded together and bought the golf course to protect it for the future. Following their purchase, the owners decided to build the new clubhouse to enhance the

course and provide a place to socialize and enjoy excellent food. Their investment in the golf and community has resulted in the Sky Valley Country Club being a successful and thriving place for the members and the public. less expensive to fix those ahead of time than it is to pay for a structural engineer to evaluate the foundation after an inspector raises the question. 8.) Dock Issues – More and more buyers are having docks inspected, and most docks have issues. Sitting out in the sun and rain, they all deteriorate. Most sellers don’t want to rehab their docks, so just be sure to disclose the items you know are wrong. If it needs a few boards replaced or new floatation, put that on the disclosure. That way there’s no new news in the inspection, and hopefully the buyers won’t ask you to fix it. It may also be advisable to put on the disclosure that the dock is personal property and will be sold as-is. Many buyers replace the dock anyway, so it usually doesn’t make sense to put a lot of money into it. However, if the dock is dangerous, make sure your agent advises people to stay off of it and puts up something to block access. 9.) Drainage Problems – Inspectors will report any current or potential drainage issues on your property. The most common is the condition where the soil around the home slopes down toward the foundation. This is an often-seen cause of leaky basements but an easy situation to fix. Just add soil by the founda-

tion so it slopes away from the house. 10.) Appliances That Don’t Work – Inspectors check every appliance to make sure it’s working. The most common failure is with ice makers. These are very expensive and almost always the first appliance to fail. You probably won’t want to replace it or have it fixed when you sell the house; so, be sure to disclose that it is not working. Then the buyer can budget for a new icemaker when making the offer. There are quite a few homes that go under contract but don’t close due to inspection issues. If you address these problems ahead of time, you have a better shot at making it to the closing table after an inspection.
