Lawsuit followers await special master’s next move

By Jane Harrison The man chosen by the Supreme Court to divvy the waters between Florida and Georgia wondered aloud years ago if he’d live to see the end of their dispute. Now, a month after the Supreme Court remanded his hard wrought decision, all eyes are on Ralph Lancaster’s docket to see if the 87-year-old veteran court appointee will continue as Special Master over the lawsuit Florida initiated in 2013. Lara Flower, water litigation specialist for Supreme Court blogsite SCOTUSblog.com, said she is among lawsuit followers who check Lancaster’s site and the Court’s docket daily to find out Lancaster’s intentions. “I have not heard of a schedule” for resumption of court proceedings, “it’s all incumbent on the special master, she said. She added that Lancaster may decline to continue or that Florida may request a new special master. Reached by phone in late July, the special master gave no hint about whether he would resume work on the case. “From the beginning I’ve had a policy of not commenting, even on something as innocuous as that,” Lancaster said, politely offering his apology.
But Lancaster’s docket discloses for public view his feelings about the case from the get go. Transcripts of teleconferences with states attorneys brim with warnings of future unhappiness. Nearly two-and-a-half years before the court’s remand, the special master voiced a measured prediction of a joyless conclusion: “I am not very good at predicting things; but at the risk of – at the risk of prognosticating wrong, let me say that I think that when this matter is concluded – and I hope I live long enough to see it happen – when this matter is concluded, at least one and probably both of the parties will be unhappy with the Court’s Order.” Now, the court appointee who repeatedly warned the states of an unhappy conclusion to their long fought battle probably isn’t happy himself with the continuing saga. Fowler, a Pennsylvania State water law professor, water lawyer and mediator, speculated that it might take at least another year of data and evidence collection, plus another evidentiary hearing before the case returns to the Supreme Court. She said it’s Lancaster’s prerogative whether to continue; it’s also possible that
Florida, unhappy with Lancaster’s recommendation, may ask the court to dismiss him. In the meantime, there appears no end in sight for the legal battle over water in the ApalachicolaChattahoochee-Flint river system where Lake Lanier is the largest reservoir. Florida claims that Georgia hoards water needed to nourish the environment and economy downstream in the panhandle where oyster fisheries depend on fresh water. The Sunshine State sought to limit Georgia’s water use in hopes of sending more water across the state line. After two years of discovery and a month-long evidentiary hearing, Lancaster recommended the Court deny Florida’s claim on the basis that Florida could not prove meaningful benefit from capping Georgia’s consumption. He added that the U.S. Army Corps of Engineers holds the spigot through its control of dams and that the Corps could not be bound by a court order to release more water into Florida. In what both sides thought would be the final word in the case, Supreme Court justices instead sent it back to the Special Master. The 5-4 decision in the
complicated, data-heavy case came on June 27, the session’s final day. It was the last ruling of the day and also the final vote for Justice Anthony Kennedy who announced his retirement that afternoon. Kennedy voted with the majority. Writing for the majority, Justice Stephen Breyer stated Lancaster had required “too strict a standard” for Florida to prove it might benefit from capping Georgia’s water consumption. He added that the Corps, in its ACF water management plan signed about a month after Lancaster’s report, indicated that it would consider a court order to revise the plan to potentially increase the flow to Florida. But, the majority also stated that Florida could only be entitled to a decree if it shows the benefits of apportioning the water would outweigh the harm caused to Georgia. Justice Clarence Thomas countered in the minority opinion that Georgia would suffer greater harm than Florida if its water use is cut. He contrasted a Georgia regional population of more than 5 million and an annual gross regional product of $283 billion with Florida’s regional count of See Lawsuit, page 43

Lakewood 400 turns 15 this summer

Keene For more than 15 years, the Lakewood 400 Antique Market in Cumming has brought vendors and customers shopping for antiques, vintage items, collectibles, furniture and décor to Cumming and Forsyth County. The one-weekend-a-month upscale shopping destination turned 15 earlier this summer, and owner/managers Ed and Barbara Spivia have plenty to celebrate. Lakewood is open on the third weekend of each month – Friday through Sunday – except for December, when it hosts its holiday market on the first weekend of the month. “We continue to grow and bring in customers and vendors from across the Southeast,” Barbara Spivia said. “With the
incredible variety and more than 200 vendors, shoppers can find quality and friendly people.” The 75,000-square-foot enclosed market is climate controlled. It offers a food court, plus jewelry repair, restoration and appraisal services, onsite framing and furniture restoration. This year’s holiday gift market will take place from November 30-December 2. Swim Across America/Atlanta coming to Margaritaville

Keene With two practice sessions at Margaritaville at Lanier Islands in August and September, local swimmers will be able to prep for one of the nation’s largest Swim Across America events, which raises money for local cancer research. The open-water swim will take place at the resort on Saturday, Sept. 22, when nearly 600 swimmers from across the Southeast will raise money for the AFLAC Cancer and Blood Disorders Center of Children’s Healthcare of Atlanta. Open-water swim practice sessions are scheduled for Saturday, August 24, and Saturday, September 9, from 10:30 to noon each day at Landshark Landing. Registration is required at $50 per session and people can sign up when they register online. “For first timers planning to participate, these practice sessions will help them acclimate to the open-water swim,” said Nancy Tao, event director of Atlanta’s Swim Across America event. “This type of swimming is very different from doing laps in a pool. We’ll have experts on hand to provide tips and clinics for our swimmers.” The program is expected to draw more than a dozen Olympians, including Atlanta’s Gold Medalist Steve Lundquist, plus several hundred volunteers on the land and in the water. Spectators and supporters are invited to the event and a chance to mingle with athletes and
Olympians. Swim Across America Atlanta began six years ago at Lake Spivey, Lundquist’s home lake. Officials moved the event to Lanier Islands three years ago to accommodate more swimmers. “This is our third year on Lake Lanier and we’re excited to return there,” said Kristine Croft, director of safety. EMS and lifeguards for the Atlanta installation of the national event. “So many people have been affected by cancer, either themselves or a loved one, that they willingly participate.” Swimmers can register as individuals or as a team for the open-water swim. Four events are available – a half-mile swim, a 1-mile swim, a 5K swim and a 2-mile team relay with each of four swimmers taking a half-mile leg. There’s also a Duck Splash area for children and adults to play in the water. “We’re still looking for people volunteer and/or offer their kayaks to help us out with our water-safety team,” Tao said. Those interested can email Tao at nancytao@swimacrossamerica.org. September 22’s Swim Across America will be the next to last event for 2018. The series began in April in Tampa and will have taken place in 18 locations in the country, from Nantucket to Seattle, from Denver to Richmond, Va, where the 2018 campaign will conclude. LAKE LANIER OLYMPIC PARK USA dragon boaters hope for World Cup win on Lanier
By Jane Harrison Dragon Boat Team USA and their coaches predict USA paddlers will stroke their way to top honors in next month’s ICF Dragon Boat World Championship at Lake Lanier Olympic Park. A large contingent of local paddlers chosen for the National Team could chop their way to gold medals in the waters where they honed their skills. Upbeat team members mingled with their supporters and spoke enthusiastically about their world potential at a July 21 fundraiser hosted by GainesvilleHall ’96 at the Brenau University Amphitheatre. The event, featuring party rock tunes, dinner and beer, exceeded the fundraising goal of $100,000, according to organizer Dixie Truelove. The party, entitled “The Legacy Continues,” celebrated the upcoming paddling competition organizers claim will be the largest international sporting event on Lake Lanier since the 1996 Olympics. About 1,000 athletes from 16 countries will compete on the Olympic course where paddlers and rowers raced in the 1996 Atlanta Olympics. “We’re super, super excited” that the first ICF Dragon Boat World Championship in North America is coming to Lake Lanier, said Mimi Collins, GH ’96 executive director. Organizers named a slew of local businesses who’ve thrown their support behind the event contributing toward the $600,000 total budget. While sponsors and organizers strive for high marks on the world stage, athletes and coaches training for the championship look for top finishes among long boat competitors. Dragon Boat Southeast Region Coach Jim O’Dell and National Team Coach Mike
Blundetto spoke about the strength of the U.S. team in a team sport that is still relatively new in this country. “I think there’s a potential to win the Nation’s Cup,” the award for the most overall team points, Blundetto said. “The caliber of athletes and confidence has never been higher,” said the 30-year dragon boat veteran. “In a decade (working with) the national team, this is the best group I’ve ever seen,” O’Dell said. He and Blundetto, along with other Team USA officials, evaluated paddlers from around the country in a training camp at LLOP during the week of the party at Brenau. At camp’s conclusion, they confirmed 113 paddlers to fill 10and 20-person boats in men’s and women’s juniors, seniors, and masters competition. About onequarter of the team hails from LCKC. The 13-year dragon boater hoped to make the women’s masters 50+ years team. “Some have been paddling just a year, some for 17 … and we’re all joining together to represent the USA.” Geri Nuevo, also from Tampa, said having the world championship on American waters gives Team USA an “amazing opportunity” to be the best in a sport that emerged more that 2,000 years ago in China. “Of all the nations, it took the longest to take hold in the United States,” Blundetto said, noting the rise of dragon boat popularity in the U.S. The sport attracts hundreds of thousands of recreational paddlers who only board a boat at festival time, such as the Atlanta Hong Kong Dragon Boat Festival the weekend before the world competition at LLOP. The contrast between festival paddlers and world class dragon boaters is like “apples and oranges,” Blundetto said. Festivals

But, it wasn’t gold dust in the water that put them on course to stroke for Team USA; old school coaching, grueling workouts, and the drive to excel – elements that historically exude from the Lanier Canoe & Kayak Club – will put
them on potential gold medal boats. Sixteen-year-old Caleb Copper expressed traditional LCKC mentality on the eve of Team USA selection. “I have a really good goal … I’m going for gold,” said the young paddler who’ll strive for a top finish in a junior men’s boat. Copper is among 29 current or former LCKC athletes who’ll race on the 113- member Team USA in the ICF Dragon Boat
World Championships Sept. 1316 at Lake Lanier Olympic Park. “I’m so very proud of our athletes here at LCKC,” said Jim O’Dell, who has helped train club athletes for more than a decade. Blundetto contrasted fest participants with high caliber athletes on the U.S. team “who paddle118 strokes a minute in complete precision … that’s about two strokes a second.” The world championship on Lanier will combine serious athletic competition on the water with the all color, fun and entertainment dragon boat festival fans expect in the grandstands. Vendors, food, and entertainment will create a fest-like backdrop to the fast, furious competition on the Olympic channel.
The races, rooted in ancient Asian fishing village tradition, create a spectacle unlike that of any other watersport. Boats more than 30-feet long outfitted with carved or plastic dragon boat heads and tails get propelled by paddlers chopping in rhythm to a drummer pounding in the back of the boat. Sometimes photo finishes declare the winners. The world event opens with a parade of nations at LLOP Sept.12 with greetings from ICF officials and local officials. Food truck dining and entertainment will follow. There is no charge to attend the opening ceremony or the competition. Parking is $10 a day, with multi-day passes available.

One of my best friends is Harry. The two of us are really the “Odd Couple.” He came from a northwestern state where you are almost born in the saddle and he knows everything there is to know about riding in rodeos and punching cows. I came from the Jersey shore, where my family owns a marina so I know an awful lot about boats and docks. she thought he had. Then I said they would take the number off the bow of the boat and call the DNR and get his name. He said that was also a problem because when he bought the boat there was still two years left on the registration sticker, so he hadn’t bothered to change the title. After that I kept my ideas to myself. We spent several days looking everywhere with my Tartan, but were constrained by the seven foot draft and the 50 foot mast so we couldn’t get into shallow areas or under electrical wires or bridges. Finally, he borrowed a power boat from another neighbor and did some more looking to no avail. Then one morning I woke up and there was the dock, back in our cove, within 100
yards of where it was supposed to be. I ran down and secured it so it couldn’t escape again and later that day we pulled it back where it belonged. This time I secured it with a steel cable to an iron spike in the shore as well as the spuds. All we could think of was that it had drifted just around the point into another cove, and we had missed it on all of our searched because it was right under our noses. But like Little Bo Peep’s lost sheep, it came back on its own, wagging its tail behind it! Mendes has been sailing all his life and on Lake Lanier for the past 25 years. His family owns a marina/bar/restaurant so he has plenty of real life experiences to draw from. His favorite line: “You can’t make this stuff up.”

‘Anything goes’ is the term for this summer’s weather To say we’ve seen some bizarre weather this summer is an understatement. Every few years we get a very wet summer but this one has been over the top. Deep tropical moisture has smothered the Southeast since June. It used to be, 1-2 inches of rain over a two- or three-day period was a lot. This summer, it’s been very common to see that amount of rain with our heavier showers and storms, in 2-3 hours! Nice to the lake at full summer pool. We are now getting closer to the active part of hurricane season. I think we would all cringe at the prospect of more tropical rainfall. Just before the 2018 season began, dire predictions came out. An above average season was likely and it could be mayhem. However, a few weeks ago, the National Oceanic and Atmospheric Administration did a complete reversal on its prediction. We had been watching an immense area of cold sea surface temperatures off the west coast of Africa remain in place. In addition to the cold water, large plumes of Sahara dust were blowing off the African coast, across the Atlantic, making their way all the way to Texas. Cold water and the Saharan dust layer are not conducive to hurricane formation. Thus, the reversal in the prediction. I know the residents of eastern Caribbean, especially
Puerto Rico, are extremely happy with that as well. As you may reGlenn call, Hurricane Maria decimated the island and Burns surrounding islands last season. Lanier So here we are in the Outlook Dog Days of Summer. This is the time of year when Sirius, the Dog Star, rises with the sun. In ancient Egypt, this would signal the flooding of the Nile River. So what kind of weather pattern are we expecting this month? Normally I would say smoggy, hot, humid, and temps in the 90s. Normally. However, given what has happened this summer, it is anyone’s guess. Normal summer patterns are not there. Last month we had a set up like mid spring with powerful tornadoes in Iowa and the Ohio Valley. We had cooler than average temperatures here in July! I guess anything is possible and as a meteorologist, I can’t wait to see! For those of you who have emailed me to messaged me on Facebook, asking what kind of weather we might see this Fall and Winter, there are signs of another developing El Nino. Normally, El Nino brings us a cold and wet late fall and winter with freezing rain being the primary form of precipitation in the colder months. We shall see. One thing I can say for now, anything goes!

This premise is described with precise detail in Rule 8, Actions to Avoid Collision, in the Navigation Rules of the Road: (a) Any action taken to avoid collision shall be taken in accordance with the Rules of this Part and shall, if the circumstances of the case admit, be positive, made in ample time and with due regard to the observance of good seamanship. (b) Any alteration of course and/or speed to avoid collision shall, if the circumstances of the case admit, be large enough to be readily apparent to another vessel observing visually or by radar; a succession of small alterations of course and/or speed should be avoided. (c) If there is sufficient searoom, alteration of course alone may be the most effective action to avoid a close-quarters situation provided that it is made in good time, is substantial and does not result in another close-quarters situation. (d) Action taken to avoid a collision with another vessel shall be such as to result in passing at a safe distance. The effectiveness of the action shall be carefully checked until the other vessel is finally past and clear. (e) If necessary to avoid collision or allow more time to assess the situation, a vessel shall slacken her speed or take all way off by stopping or reversing her means of propulsion. (f) (i) A vessel which, by any of these Rules, is required not to impede the passage or safe passage of another vessel shall, when required by the circumstances of the case, take early action to allow sufficient sea-room for the safe passage of the other vessel. (ii) A vessel required not to impede the passage or safe passage of another vessel is not relieved of this obligation if approaching the other vessel so as to involve risk of collision and shall, when taking action, have full regard to the action which may be required by the Rules of this Part. (iii) A vessel, the passage of which is not to be impeded remains fully obliged to comply with the Rules of this part when the two vessels are approaching one another so as to involve risk of collision.

There are ways you can maneuver to avoid a collision with another boat; • Turning Right – Except when necessary to pass someone in an Overtaking Situation by going Left and passing up their Port side. This substantial turn also provides the visual reference to the other vessel that you are taking the appropriate action in accordance to the Rules of the Road. • Slowing Down – Does give the intended result of missing the
other vessel but drastically reduces the relative speed and extends the time to process avoidance. A primary point of professional boating is to slow down to bare steerageway or stop if necessary to further assess the situation. In other words … When in doubt, slow down. • Combination of Speed Reduction and Turn – Considered by professional Navy and Coast Guard Deck Officers as “Backing Out” and frequently utilized in tight formations with multiple ships in close proximity. Not a preferred method to apply unless you are in congested traffic and a large turn would cause an issue with another vessel in close proximity. An important component of Boating Safety is taking Action to get the desired Outcome; Rule 8 is the remedy to that goal. Be Informed and have a great time on the water! Lake Lanier Association’s signature program turns 30 this year

From the fascinating to the remarkable, Lake Lanier harbors many personalities and places along its shores. Lakeside presents “Shore Lines” – stories about people who live, work and play around the lake and the places that make the area special.

By Pamela A. Keene his year, Shore Sweep celebrates its 30th year of lake clean-ups. To commemorate the program, which over its life so far has collected more than 1,000 tons of trash, garbage and debris from the lake and its shorelines, the Lake Lanier Association is hosting a big birthday party at Lake Lanier Olympic Park on Saturday, August 25, from 1 to 4 p.m. “Our theme this year is 1000 Tons of Fun,” said Bonny Putney, chair of the association’s Shore Sweep committee. She’s also known around Lake Lanier as the trash lady because of her years of working on the event. “The party is all about celebrating what our volunteers and members have done over the past 30 years. It will also be the official kick-off of our advance drop
program and a chance for volunteers to sign up to participate in our 2018 event, set for Saturday, September 15, a littler earlier than in previous years.” The 1000 Tons of Fun party will feature entertainment by the Fly Betty Band, food, children’s activities and prizes. “We’re encouraging people to wear their oldest Shore Sweep Tshirt,” said Joanna Cloud, executive director of the association. There will be a gift given to everyone wearing a Shore Sweep T-shirt at the event and a prize for the person wearing the oldest Shore Sweep T-shirt. Over the years, Shore Sweep has evolved from a lake clean-up conducted mostly by homeowners to a concerted initiative that in 2017 had more than 1,000 volunteers and collected nearly 60 tons of trash.
Other LLA programs
Shore Sweep is one of many programs supported by the Lake Lanier Association throughout the year. Other programs include: • Adopt-a-lake, a lake-wide water testing program managed by volunteers to regularly monitor and report water quality at designated sites. • Solar Lights program, begun in 2013 to install solar lights atop navigation hazard markers. To date, more than 260 lights have been installed. • Shoreline Rip-Rap helps slow erosion of the islands many lakes. Since it began in 2016, more than 3,150 lineal feet of island shoreline control have been installed on six islands. This initiative involved the installation of more than 6,200 tons of rip rap stone at a cost of almost $320,000. Other at-risk islands are on the project’s list. • Abandoned and Derelict Docks and Vessels, which to date has removed more than a half-dozen docks and vessels from the lake. In 2017, the Georgia General Assembly earmarked $25,000 to the Georgia Department of Natural Resources to provide the association with funds to remove these safety and environmental hazards. Recently, the program has expanded to include work with the solicitor’s offices in Hall and Forsyth counties, allowing for legal action against owners of these docks and vessels. • An annual meeting is held each spring to bring the membership together for yearly reports on all projects and to update them about the association’s work. It is typically a social occasion and a chance for members and people interested in its Full Lake, Clean Lake, Safe Lake initiatives. • Member Socials take place periodically at various places around the lake. They are announced to members via email and are listed on the group’s website. • Property Owners Pledge, a user-friendly contract that property owners can voluntarily sign to use best practices when managing their lakefront land to protect water quality. Those who sign receive a small metal sign signifying their participation in the initiative.

Adding days Until several years ago, Shore Sweep took place on a single Saturday, with volunteers gathering at designated locations to collect trash in the morning, then convening for a thank-you party that afternoon. About six years ago, thenboard member Gordon Brand suggested creating a zone program to more effectively and efficiently collect trash around the lake. “Creating the zones helped us decentralize Shore Sweep, to get more people involved closer to home and to have more coverage area,” Brand said. “It was easier to plan by tackling many smaller areas. We set up a scouting program so that people could let us know the areas that needed the most attention and we began advance drop-offs for those who wanted to help but weren’t available on the day of the event.” Since the changes, the annual clean-up has more than doubled in its number of volunteers, the area covered each year and the amount of trash collected. “We have zone captains who manage each of our designated day-of collection points,” Putney said. “And we’re building a large contingent of repeat volunteers who bring their neighbors and friends each year, so we’re continuing to grow our participation and our success.” Putney said that social media has become a powerful tool in the expansion and success of Shore Sweep. “Everyone has a camera on their phones and we often get photos sent to our Facebook page
of particularly trashy areas,” she said. “We’ve gotten pictures of people on the beaches who walk off and leave their beer cans and other garbage. We really appreciate that the public is keeping an eye out for us.” Map coordinates This year there are eight advance drop off locations. from the lake and the shorelines, no personal trash please, as well as larger items,” she said. “Signs designate when these locations are open to accept trash and we’re asking people to leave the trash near the signs. Volunteers with boats will pick up from these areas on September 15.” This year’s 11 zone headquarters are Aqualand Marina, Bald Ridge Marina, Gainesville Marina, Lanier Islands, Port Royale Marina, Balus Creek Boat Ramp, Big Creek Boat Ramp, Don Carter State Park, Gwinnett Park, Longwood Park and War Hill Park. The event will take place from 8 a.m. until 1 p.m. Volunteers should report to a participating location to pick up trash bags and a shoreline-area assignment for trash collection. All volunteers turning in at least one full bag of trash receive a T-shirt. Many of the sites will provide snacks or other festivities. Year-round effort Shore Sweep has grown to be a year-round initiative. “In addition to our work in August and September, we’ve reached out to the all the boat-rental fleets and providing them with trash bags to encourage boaters to collect their garbage and bring it back to the dock,” Putney said. The Lake Lanier Association has been an active and visible advocate for Lake Lanier, previously bringing legal actions on behalf of the lake in the Tri-State Water Negotiations and other issues. One of its public platforms focuses on raising the full-pool lake level to 1073. “We are advocating for a feasibly study,” Cloud said. “That would be the first step.” Additionally, the association
works closely with a number of government and public organizations. “We are in regular contact with the U.S. Army Corps of Engineers and the Georgia Department of Natural Resources,” Cloud said. “We were among the founding members of the Apalachicola-ChattahoocheeFlint Stakeholders, providing leadership to this organization. We also work with local governments, area businesses and various non-profit groups to protect the lake.” Each year the association has a booth at the Atlanta Boat Show, not only for bringing in new members but to talk with boat owners, lake users and homeowners about the work of the group. The association is conducting a membership outreach campaign this year. It is mailing information to all dock owners offering a free six-month membership to the association. The mailing will include a refrigerator magnet that lists frequently called phone numbers related to the lake. “It’s our hope that people will take advantage of the complimentary membership and when their six months is complete that they will join the association,” Cloud said. Membership in the association starts at $50 for individuals/families. Everyone who joins receives the group’s quarterly email newsletter, invitations to the annual meeting and member socials. Before announcing the cuts, O’Dell said they faced a difficult task winnowing the team from the best athletes they’ve seen in a decade. He said it took more than “eight hours pouring over data, videos, and notes from selection camp” to decide who’ll race for the US on juniors, seniors and masters teams. All but two of junior team members are current LCKC paddlers, O’Dell said. “A couple others used to paddle at the club though half of those selected are stand-alone dragon boaters who have come up through our festival to the next level,” he added. O’Dell credited old school training and assistant coach Charlie Tisle for LCKC athletes’ success. “We are some of the best, if not the best, prepared athletes for Team USA. They get

Giving back comes in all forms at Pirates Charity Poker Run
By Pamela A. Keene on’t diss the Pirates of Lanier Charity Poker Run on Facebook. When someone who lives on Lake Lanier did just that on the Friday night of the 10th anniversary of the event in mid-July, within minutes boaters, participants and volunteers responded with more than 200 positive messages and a challenge. “We all saw it and replied back right away,” said Steve Thompson. “All of the comments were so positive, mentioning how fun the event is and how it raises money for the great children’s charities. “I took it a step further and responded with a challenge,” said Thompson who has participated for the past eight years, both as a boater and as a sponsor through Steve Thompson Insurance Solutions in Cumming. “I told him that he needs to come out and join the fun next year, and if he comes back to me and says he didn’t enjoy it, I would personally pay him back his registration fee. I hope he takes me up on it.” Thompson crossed over this year. “I’d been doing the Poker
Run as a participant for several years, so I thought it was time to come to the other side of the dock and volunteer at a card stop.” The rookie recruited family from North Carolina and Cumming to manage the stop at Lazy Days at Holiday Marina. He transformed himself into a pirate for the day, complete with all kinds of pirate talk, dreadlocks and his own sword. “We’re from Blackbeard’s territory in Washington, NC, and the Beautiful boats on the water at the Poker Run. home of the Pirates of Eastern Carolina University, so we’re right at home here,” said Thompson’s sister Suzanne, who with her husband Wes Crawford and daughter Sierra Southerlin, made up half of the Lazy Days’ crew. “We’re having a great time.” Thompson’s fiancé Kristie Brightwell and her daughter Michaela rounded out the crew. “I love being out here,” Michaela said. “I babysit an autistic kid, so it means a lot to me to get involved and help out.” Right around the corner Alex Laidlaw and his crew from Holiday and Lazy Days manned the Singleton Marine service dock in See Poker Run, page 48

Corps allows drone flight over Lake Lanier with a permit
By Jane Harrison Eyes in the sky over Lake Lanier have transmitted images of awesome waterfront mansions, cool tricks on wake boards, and family outings on private boats. With 59 square miles of water at full pool, the lake offers a gorgeous blue backdrop for photographs on the fly. Until last month getting those shots via drone was illegal. But it seems few people knew it. Few were cited and fined during the U.S. Army Corps of Engineers ban of drone flight over Corps property. But most didn’t get caught. In early July the Corps initiated a new permitting process for flying drones at Lanier that requires a 30-day advance request to put a drone in the air over Corps property. The policy prohibits random fly-overs of hobbyists with spur-of-the-moment whims to document their lake exploits or spy on boaters. Chris Arthur, Corps Chief Ranger for Lake Lanier, said the policy requiring a written request and certificate was instigated after the Corps commander issued guidance on drone use over Corps property. While they awaited offi-
cial guidance, Lanier Corps officials had prohibited drone flight. “We have written some warnings and citations when drones were flown in an area they’re not supposed to be,” Arthur said, such as near the dam and powerhouse. He also mentioned that officers responded to numerous calls about drones harassing people at the former Sunset Cove, now Margaritaville. Permit requests must be presented in writing to the Corps office and include the date and location of the intended flight, plus documentation of the operator’s licensing and training. The permit, which the applicant will receive in the mail, is only good for the event named in the application and will not transfer to other outings. Arthur said in late July he had not gotten any requests. He expects water sport organizers, real estate companies, dock builders, and lake homeowners will apply for permits. Wake surf enthusiast Jenny Serwitz didn’t realize the midsummer videography captured by drones hovering over wave tricksters was produced by prohibited
means. “I didn’t know that,” she replied when a reported asked her about a permit. “We will go ahead and get a permit.” Serwitz, husband Perry and their two children ride deep in board culture through their Cumming watersports store and former involvement in a Georgia wake boarding series. Recent video on their Pull Watersports Facebook site shows wake surfers in the soup and boaters waiting their turn in a clip entitled “Thursday Night Surf From Above.” The aerial perspective shows moves, twists and crests not visible by boat. Another sport that begs for a new visual perspective launches from the Lake Lanier Olympic Venue. Fans of flatwater paddling and rowing only get to see their racers when they’ve nearly finished their run. With drone videography beamed to big screen, they can watch the action from start to finish. Spectators at next month’s ICF Dragon Boat World Championship will likely get a view from above of 10 or 20 sets of paddles steadying their hulls at the starting line 2,000 meters away and
watch as they dip in unison toward the finish tower. LLOP Assistant Manager James Watson said once the organizers identify a pilot, they will apply for a permit to fly over the event. He noted benefits of shots by air, rather than by boat. “Being as the majority of our events take place on the water, it is hard to provide spectators with a good viewing experience. The way our course is designed, spectators only get to see the finish of a race and always miss the start. Drone video opens up the entire race course to spectators, coaches and athletes. “In the past in order to get onwater video, someone had to operate a camera boat. This causes additional wake and often times the footage is not the best. Drones allow the LLOP (spectators) to follow races without additional boats and provide great video quality.” American Collegiate Rowing Association President Kurt Butler also praised drone coverage for its potential to enhance spectators’ experience without encroaching on participants. “It would … give great over-head
shots as well as side shots without making a wake” he said. He said ACRA has looked into getting a drone permit to fly over its national championship at LLOP in the past, but there was come confusion about who, if anyone, could get a permit. Butler mentioned that drone video at other rowing events, particularly the Royal Henley Regatta in London in England gave spectators “great shots” impossible from land or water. Expect to see drones over ACRA on Lanier next year. Cumming entrepreneur Stan Jessen probably isn’t the only non-sport business owner who uses unmanned aircraft to take pictures. The former U.S. Navy pilot said he “had no idea” that the Corps formerly did not permit drone flight over Lanier, where he frequently gets called upon to photograph lake property for sale. He said the new permitting process will change the way he does business at North Georgia Drones. “I’m a stickler about making sure everything I do is legal … I will definitely go to the Corps (website)” to learn about See Drones, page 42

Gardening maintenence hacks for late summer, early fall Sure, it’s hot outside. But that’s no excuse for neglecting your garden. If you’ve been watering regularly through the summer, you’ll still be rewarded with late tomatoes, green beans, peppers, squash and cucumbers. If the heat has gotten to your crop, there’s still time for a late summer/fall replacement garden. Plant squash and cucumbers seeds directly into the ground in raised mounds by the end of the month. Since they mature around 55 to 60- days after planting you’re safe from the threat of first frost, which is typically around early to mid-November. Just be sure to keep them well watered as they grow and keep an eye out for insects, such as squash borers that affect the stems of the plant. If you find insects, treat with Sevin dust, following the directions on the package. Yes, you can use Sevin on edible plants. The packaging will give you quantities, methods of application and cautions. You can also start seeds for your cool-weather crops, such as broccoli, collards and kale in Au-

gust. Choose a shady place outdoors and use seeding flats, peat pots, or egg cartons and fill with good soil. Make sure the containers have adequate drainage. The late summer heat, with the plants in the shade, will provide the warmth and humidity that the seeds need to sprout, and by starting the seeds early, they will be ready to set out into the garden in September and October. Fill the containers with good moist soil, then place one to two seeds in each pot or section of the egg carton, just barely covering them with soil. Water gently and thoroughly; using a mister is best. Be sure to
label the containers when you plant the seeds, so you’ll know what you have planted. Go ahead and prepare your garden space so that when it comes time to transplant the seedlings, you’ll be ready. Break up any large clumps, add organic matter and a light application of 10-10-10 fertilizer. When the seedlings have grown at least two pairs of leaves, not including the initial two that are the result of the seed sprouting, you can set them out in the garden. Plant them in rows and space the plants according to the instructions on the seed packets. Apply a little starter solution as you transplant. Kale will mature in 55-70 days; collards will be ready to pick at between 60 and 85 days. Broccoli will be ready to harvest from seeds at between 100 and 150 days. Other plants to consider include cauliflower, chard, cabbage and turnips. Don’t worry about these vegetables being affected by frost or freezing temperatures. The foliage may become a bit burned, but the plants will survive.
If you’re not sold on starting your vegetable plants from seeds, fall will be here before you know it. Then you can buy starter plants for your cool-season vegetables at area box retailers. The Court wants the Special Master to answer two questions: 1) would a cap on Georgia’s water use provide a significant increase of stream flow into Florida; and 2) would the amount of extra water significantly redress the ecological and environmental harm that Florida suffered. Breyer affirmed Florida proved it suffered harm from Georgia taking more than its share of water from the Chattahoochee and Flint rivers, which flow into the Apalachicola at the state line. Florida officials and Apalachicola Riverkeeper interpreted the Court ruling as a second shot at getting the water they need, while on the Georgia side, the governor said the state remains confident on its legal position. However, some environmental groups and stakeholders cried for settlement of a lawsuit that has already cost both states upwards of $40 million. Chattahoochee Riverkeeper supports an interstate compact to equitably apportion the water, increased involvement of the Corps,
and greater conservation by all water users. “If a robust culture of conservation does not take hold in Atlanta, the Flint River basin and across all economic sectors, we’ll be back in court again another day,” Water Policy Director Chris Manganiello said in a CRK statement. ACF Stakeholders, a privately funded group of environmentalists, business people, and public works officials that produced a scientific-based plan to share the water, begged for attention. “In 2015, this group unanimously adopted a Sustainable Water Management Plan, which points the way forward for equitable water allocation across the ACF basin, and it’s time for Georgia, Alabama and Florida to collaborate and adopt the recommendations of this plan,” said Deron Davis, The Nature Conservancy in Georgia’s executive director. ACF Stakeholders attending the Special Master’s evidentiary hearing in December 2016 saw a dog-eared, tab marked copy of the SWMP on Lancaster’s desk. He’d apparently read at it, but
did not mention it in his recommendations. When contacted by Lakeside News, officials from Georgia and Florida declined to say whether they had seen the plan. Fowler, the SCOTUS.blog water litigation specialist, strongly recommends negotiation over continued legal battles. “Go figure this out,” she advised. “If you negotiate a solution, you’ll like it better.” Coming up with creative solutions to water puzzles takes tough compromise and often political involvement, she added. “It takes both parties willing to sit down and work with each other … it’s hard work,” she said. This is what the Special Master repeatedly urged Florida and Georgia to do from the beginning. And, it is what ACF Stakeholders already did in tension filled rooms where they labored to reach consensus. States’ officials who negotiated with the help of an unnamed mediator failed to reach agreement. Georgia Gov. Nathan Deal told an Atlanta newspaper he regretted he and Fla. Gov. Rick Scott could not settle the case.

HGTV comes to Lake Lanier 48 LAKESIDE

Keene Monica and Bryan Pope found their dream home on Lake Lanier, thanks to an episode on HGTV’s “Lakefront Bargain Hunt” and Keller Williams Realtor Teresa Smith. “It was a really hard decision because there were things we liked about each home we saw,” Monica Pope said in an interview after the program aired on HGTV in late May. “We had a definite price range and were really pleasantly surprised by the choices.” In the televised episode, Smith, who has been selling homes on Lake Lanier for more than a dozen years, showed them four homes that were in their price range of $400,000 or less. They varied from a newer home with soaring ceilings to a more cozy cottage with a recently renovated kitchen. The couple, both formerly in the Air Force, had spent a little time on Lanier. Monica rented a lake house for Bryan’s 40th birthday. “I really wasn’t much of a lake person, but because Brian loves the lake so much we decided to seek a home there,” she said. “We worked with Teresa,
who was such a help and knows so much about the lake. We had a great time house-hunting.” The chance to be on HGTV’s “Lakefront Bargain Hunt” was kind of a bonus for Brian and Monica, who celebrated their ninth anniversary last month. “We couldn’t tell anyone we were going to be on television, except for our immediate family, and they got to be with us at the end of the shoot.” Monica said the process was very different than she anticipated. “I expected to be terrified, that they would tell us what to say and where to stand, but we were pretty much on our own,” Monica said. “The four days of filming were the most fun ever, and we had a blast. Everyone was so nice. The hardest thing was that we had to say things over and over so that they could film it from different angles.” The program, Episode 809, showcased many features of Lake Lanier, including its having been the site of Olympic canoeing, kayaking and rowing in 1996. The show was interspersed with facts and figures about the lake, including the 39,000 acres of

Plan your kitchen remodel with design trends that have staying power
People ask me often what the current trends are in kitchen design, but my response is not always what they are expecting. As a designer, it’s obviously important to follow trends to keep up with what’s new. But, on the other hand the word “trend” makes me think of a time-stamp. Most trends are likely to go out of style in five to 10 years; think wood paneling, gold and avocado green of the ’70s or country blue, dusty rose, and floral wallpaper everywhere in the ’90s. I like to recommend trends that have proven the test of time and become classics, but maybe incorporate a trendy material here and there that can be changed out easily, like lighting or backsplash. There are several current trends in kitchen design that I see as having staying power and won’t require another remodel in 10 years. Incorporating technology While technology in the kitchen obviously isn’t new to 2018, it has been advancing and continuing to go mainstream. People are requesting more docking stations or USB chargers for their devices in the kitchen. This allows them to still be in reach, but you can easily hide the devices and

I already mentioned indrawer charging stations, but we also install a lot of pull-out trash and recycling cabinets, tray and cutting board dividers, spice drawers, and hidden or multilevel utensil storage. Another place where we’ve seen more em-
phasis on organization is in the kitchen pantry. When your pantry is organized, it’s much easier to keep an inventory of what you have and know when things are going bad to help prevent food waste. Organization and better storage in the kitchen also helps keep away clutter. When you don’t have clutter on your countertops, you can much more easily use and enjoy your space. Trends come and go, but functionality, ease of use, and beauty in the kitchen will never go out of style. Keep up with trends to know what’s out there, but most importantly, make sure your space is functional and true to your personal style. Day Use Parks The Corps operates 35 day use parks at Lake Lanier. Facilities range from parks with boat ramps to those with designated swimming areas, picnic tables, shelters and playgrounds. All day use parks close daily at 10 p.m. Boat launching is allowed at all hours unless otherwise posted. Alcoholic beverages are prohibited in all parks. Kiwanis hosts golf tourney at Lanier Islands

Keene To raise money for area high school scholarships, the Kiwanis Club of North Gwinnett is hosting its annual Fall Golf Classic at Lanier Islands’ Legacy Golf Course on Tuesday, Sept. 25. “This is one of our major fund-raising events each year,” said Cal Andrews, this year’s classic chair. “We award college scholarships to high school graduates from five local Gwinnett County high schools – Mountain View, Mill Creek, North Gwinnett, Buford and Lanier. Each school houses local Key Club chapters to help students learn the value of serving their community and gives them a chance to hone their leadership skills.” Registration for the event is $560 per foursome until September 19; after that date, registration, if available, is $600 per foursome. Individual registration is $150 per player. It includes range balls, green fees, cart, lunch, soft drinks, on-course contest entries and a golfer’s gift.
Play is four-man scramble format. The shotgun start is 9:30 a.m. The practice range and registration open at 8 a.m. Prizes will be given for the two lowgross teams and the two low-net teams, as well as individual prizes for closest to the pins and longest drives. The event concludes with an awards banquet, raffle and silent auction. Sponsorships are still available by contacting Andrews at 678 4727166. The club was originally chartered in 1939 as the Kiwanis Club of Buford. Today is has nearly 50 members, small business owners who live around and on Lake Lanier. The club meets every Tuesday at the Buford Community Center at noon for lunch and a speaker. Interested potential members are encouraged to come to a meeting. The mind of a Cherokee Warrior surveying the lush valley below from atop the 4,784-foot summit of Brasstown Bald (Georgia’s highest mountain) must have been running wild as he contemplated the multitude of possibilities below. water sports exist nearby in Lake Chatuge or Lake Nottley. The most impressive part of Brasstown Valley Resort, however, is the championship, Scottish links-style golf course. CAST for Kids/Lanier will take place at Little Hall Park on Lake Lanier on Saturday, August 11. The inaugural event will host 40 youngsters, and while registration for participants is filled, event organizers are seeking additional volunteers. “Jackson needed service hours for school, and he loves to fish, so we found this event in Alabama,” said Laurie Morgan, his mom. “We went to Lake Guntersville to participate with two of Jackson’s friends, Jakob Cowart and Evan O’Neill, and they had such a great time. When the organizers found out that I was from Lake Lanier, they asked if I would be the coordinator for a program in Georgia.” For the past several months, Morgan, plus Laura and Jerry Cowart have been finding sponsors, organizing volunteers and managing details for the 40 youngsters who will participate in
