facing labour market strain in fulfilling jobs in key sectors. 8 The set of active labour market policies (ALMPs) that countries offer should be flexible and responsive, to allow quick and proportionate reactions to economic shocks.9 What we find, in the global recovery methodology moving towards a COVID-free or more so a COVID-resilient labour market, is the accommodation of migrant workers. What COVID viciously taught the global economy, was the reliance countries have on the international workforce and the domestic need for their skills, to cultivate and act as a strong player in the ecosystems of local labour and local business.

DOMESTIC (AUSTRALIAN) PERSPECTIVE Preface

“COVID-19 travel restrictions brought migration to Australia to a virtual standstill, and over the course of the pandemic about 500,000 temporary migrants have left our shores. Now many Australian businesses are screaming out for more workers.”10 Australia is intrinsically known for our multicultural population and our welcoming of skilled migrants who seek to work here. Providing transparency in where we go moving forward is key for businesses and business owners alike, to prepare for solutions and to find a way out of the dire situation our Australian economy finds itself in, namely, Australia’s estimated $1 trillion debt.11 Now although it is often assumed that with unemployment on a steep rise, skilled migration will ultimately effect local job seekers and provide a displacement and discrepancy on Australia’s interests. However, modelling and research carried out by the Committee for Economic Development Australia (CEDA) has in fact shown that previous waves of migration have not had an impact on the wages or participation rates of Australian-born workers. 12

In fact, despite Australia’s unemployment rate, “this shortfall of migrants from the uncapped temporary migration program Anne O’Donoghue

is hurting some businesses more than others. Before the pandemic about 17% of workers employers hospitality were here on temporary visas… Demand for these services remains high, so it’s little wonder employers in the hospitality industry are screaming out for staff. The most recent data from the Australian Bureau of Statistics shows about 33% of hospitality businesses in February 2022 were advertising for extra staff, compared with 15% in February 2020.”13 Despite Advertisement efforts, to appeal to the Australian local worker demographic, these spots remain unfulfilled.

It is clear that Australia’s migration sector recovery lies in our ability to cater for the influx of skilled migrants and the criterion for which will allow for their return and our capacity to process their visa applications as they are lodged. Australia’s focus is currently working with Governmental Departments to ensure that sufficient allocations are made to accommodate for businesses who are struggling to find skilled workers to assist in their post COVID-19 recovery and to ensure visa processing times are an absolute priority in addressing these very skills shortages.

Australia Skills Shortages

Australia’s skilled worker shortage saw record breaking decrease in migration from 2020 to 2022. The skills and labour shortages Diane Markantonakis

are occurring at a time of historically low unemployment and high rates of participation and despite this skills shortage, employer sponsored visa applications, both temporary and permanent streams are increasing, but at a very slow rate.14

Three major recommendations which we suggest, to address these labour and skill shortages are: 1. Given the fact that we have a labour market shortage, both Subclass 482 &

ENS applications should be processed on a demand driven basis without the need for limit on visa applications. 2. The Government should commit to processing all decision ready Subclass 482

Temporary Skilled Visa Applications for approved employers within a guaranteed timeframe, for example 4-6 weeks and permanent Employer Nomination Scheme (ENS) applications within a guaranteed timeframe, for example 10-12 weeks. This approach can be proven successful and in the footsteps of our U.K counterparts’ approach to the visa backlog. 3. Given the fact, Labour Market Testing (LMT) has been described as an artificial process, by certain sectors, and business communities, we believe that LMT is designated for occupations that are not in national shortage, and should not be imposed for occupations which are.

Prime Minister, Anthony Albanese has stated “Short-term, migration will need to be a part of the solution to skill shortages, and we will work with the business community as well as working cooperatively to address those issues.” The commitment addressed by the Australian Government gave rise to questioning and concerns, regarding how this welcomed influx of skilled migrants, will be processed and how an unaddressed processing delay, will deter skilled migrants in their journey to work on our shores.

Below we outline how the Australia government is addressing these visa processing times.

Visa Processing

On 20 June 2022, “the National Cabinet affirmed its shared commitment to urgently addressing skills shortages. It will urgently work to address a backlog in processing visa applications in areas of skills shortages, reduce visa processing times and prioritise training and migration… it’s also recognised that short-term visa shortages mean that we need work on clearing the backlog that’s there from people who have visas that have been granted and they’re waiting 12 or 18 months before they are actually able to take their place in workplaces around the country.”15

In saying this, Australia has only 96,000 skilled temporary visa holders in Australia which is a decrease of nearly 100,000 migrants since 2014. Prime Minister Anthony Albanese has certainly acknowledged this and we assume given the vitality of skilled migrants in our economy at present, an increase and intent focus on resourcing to support a slight change in administrative processes, or a possible change to the design of internal Sophie Gao

processing, may be the solution we require in the migration industry, to tackle the issue of visa processing and the inundated visa backlog we must address, before we begin to see a true increase in skilled migrants, to the extent where business will be able to get back on their feet.

Potential Solutions

The suggestions, which can be held mutually with many who work in the migration sector are as follows:

Department of Home Affairs directions and policies need to be revised, in particular, outlining the order of priority allocation and consideration of nomination and/or visa applications as these are no longer relevant in a climate where there are significant labour and skill shortages in all industries.

Transparency in visa processing and priority lists such as the Priority Migration Skilled Occupation List (PMSOL) are key areas in need of revision and change. Given that Australia is entering a post-COVID era, all industries across the country are experiencing a steep degree in skill and labour shortages finding the PMSOL to be irrelevant as not only does it promote the idea that one sector has priority over another, it may give false hope to the priority sectors listed, in thinking their visa applications will expedited when in fact, there is no transparency surrounding processing time.

Promotion of Permanent Visa Pathways for skilled migration. A possible solution and/ or suggestion could be reducing the threeyear requirement for TSS visa holders to be employed with their sponsoring employer before being eligible for applying for permanent residence. This change, if adopted, would reduce the current requirement which may be a deterrent to potential migrants from accessing the permanent residency pathway.

Removal of barriers for visa entry for clearly highly skilled Visa Applicants and reputable employer/sponsors.

Moving forward, the Australian Government has made swift decisions currently, to remain competitive with “more than 58,000 applications for skilled visas including permanent and temporary skilled places, have been lodged with the Department since March and nearly 25% have already been finalised… and more than 1.4 million visas have been granted in total since Australia’s border reopening got under way, including 1.22 million visas to applicants overseas” which demonstrates Australia’s global network of visa officers are at work on the problem of visa approvals and processing. 16 This is a strong indication that change is occurring.

CONCLUSION

The tourism sector lost 610,000 jobs, the retail sector has had 60,000 open job vacancies recorded in February of 2022, the health care sector is struggling with the quality of services and care for its patients, the hospitality industry has increased its job advertisement in a cry of desperation for workers to support there attempt of saving their business post COVID-19 so ultimately the burden lies on the Australian Government’s ability to remain internationally competitive by addressing its skilled migration intake but more importantly, attracting skilled migrants by ensuring visa processing times are reasonable and enticing, so not to deter a possible skilled worker from choosing Australia as its temporary home due to the door not opening quick enough.

The Australian Government has promised its priority to address this, as an omen to businesses and industry sectors who have struggled throughout COVID-19 and rely on international travellers and skilled migrants as the main inhibitor of their recovery.

Colin Loveday is a senior partner in the Clayton Utz product liability and class actions group. He is an experienced trial lawyer with particular expertise in the defence of class actions and complex commercial disputes. Anne O’Donoghue is an accredited immigration law specialist and registered migration agent, with over 27 years of experience. She is the director and principal lawyer of Immigration Solutions Lawyers (ISL). Anne is acknowledged as one of Australia’s leading immigration law specialists.

Anne was admitted to practise in the Supreme Court of Victoria in 1981, the Supreme Court of New South Wales in 1987 and the High Court of New South Wales in 1982. Given Anne’s extensive experience in this area, she will also be chairing an LCA Webinar on Modern Slavery as part of the ILS International Law and Practice Course on modern slavery scheduled for 17 November 2020.

On the 1 January 2019, Anne was appointed Co-Chair of the Immigration and Nationality Law Committee of the International Bar Association (IBA). Anne has been an IBA member since 2002. In 2019, Anne was appointed a member of the IBA’s Presidential Task Force on the Refugee Crisis Initiative, A Child Rights Response to Child Migration and Migrant Children at Risk. Anne was a Co-Moderator of the Showcase session which was presented at the 2019 IBA Conference in Seoul. On the 24 October 2019, Anne achieved a high commendation for the NSW Law Society’s Presidents Medal for her work on the IBA Presidential Taskforce in Seoul. Anne was also awarded the Lawyer’s Weekly Migration Partner of the Year Award in 2019. Anne was subsequently invited to chair a session on modern slavery at the Law Council Australia Migration Conference in Melbourne in March 2020. Given the positive feedback received on the Presidential Showcase session in Seoul, the Presidential Taskforce has secured a continuation of this project for the IBA 2020 – Virtually Together Conference (26 November 2020) titled Presidential Task Force continuation: the emergency evacuation visa and protocol for migrant children.

On 24 January 2020, Anne O’Donoghue was appointed as a member of the Professional Ethics Committee Advisory Board of the IBA.

During 2020, Anne has hosted and organised key international Webinars on the topic of global modern slavery under COVID-19. Anne has completed 2 series of webinars on Modern Slavery, including one which focused on the effects of Covid-19 on Modern Slavery: Migrant Smuggling and Human Trafficking from an Interpol Prosecutions perspective. On 6 August 2020, Anne participated in a Webinar on the topic of Social Justice and Development under Covid-19 (International Perspective). This featured notable international speakers Francisco Roggero and Bianca Jagger as it explored the impact of Covid-19 on modern slavery in Central America. Anne has been invited to participate in a Virtual Roundtable event for Corporate Livewire which will be live in September 2020. The event focuses on the effects of Covid-19 on the victims of modern slavery and how corporate supply chains have been impacted.

Anne is also an experienced writer and co-authored the Australia chapter of The Corporate Immigration Review, now in its tenth edition.
