Jonathan Midgley has practised as a criminal defence lawyer for over four decades.

In the early 1980s, Jonathan was involved in the very first commercial crime prosecution brought in Hong Kong. He was retained by the defendant, who was acquitted at trial.

White-collar crime, from those early begin nings, has been an important part of Jonathan’s practice. His work also involves a wide range of offences, from the very minor to the most serious, spanning dangerous drugs, assault, theft, robbery, sex offences, driving cases, murder and rape.

An additional part of Jonathan’s practice is the defence of Commercial Crime Bureau (CCB) pros ecutions. It has also meant the frequent defence against allegations of money laundering and the freezing of bank accounts.

Jonathan has always considered it important for a criminal defence solicitor to have experience as an advocate. He has appeared at every level of Hong Kong criminal courts. In 2013 he was honoured to be one of only two criminal defence solicitors to be made solicitor advocate, with the right to appear in the criminal High Court.

Over the years, Jonathan has built up a strong relationship with barristers in both Hong Kong and London and can call upon them for speedy and effective support.

Jonathan considers himself fortunate in the recognition that he has received in the criminal law directories published over the years.

Jonathan still finds criminal defence work exhilarating and looks forward to the future.

He has assisted in the prosecu tion and detection of crime, and advised compa nies on possible criminal conduct by directors or employees.

Andrew is a member of the International Bar Association commercial crime group. He is also a speaker at IBA and other conferences on whitecollar crime, and comes recommended in Expert Guides: Fraud and White Collar Crime (2014–2020) and Who’s Who Legal: Business Crime Defence (2014–2020).

After being admitted to practice in 2014, Paul Wang has specialized in handling complex cases involving white collar crime, from securities and regulatory issues, to corruption, money laundering and fraud.

Paul is highly experienced in representing clients involved in investigations by statutory bodies like the Securities and Futures Commission (SFC), the Stock Exchange of Hong Kong (SEHK), the Commercial Crime Bureau (CCB), the Independent Commission Against Corruption (ICAC), the Hong Kong Police Force, the Department of Justice, the Immigration Department and the Customs & Excise Department.

A native Mandarin and Cantonese speaker, Paul passed the first Greater Bay Area Bar Exam ever held and becoming eligible to practise both People’s Republic of China (PRC) and Hong Kong law in nine cities in the Greater Bay Area of Mainland China.

This, together with law degrees from both Civil Law and Common Law jurisdictions, gives Paul a considerable advantage in helping firms with a PRC focal point deal with commercial or regulatory investigations against them.

Among notable recent cases, Paul represented a defendant in a 70-day money laundering trial which partly took place in Mainland China using Hong Kong laws under a Letter of Request and involved examination of witnesses in a PRC court room before a Hong Kong and PRC Judge.

He also defended clients in a major money laundering case involving over one billion Hong Kong dollars and represented a prestigious construction consultancy firm in the first case in which the prosecution tried to hold the consultant, instead of the contractor, liable for a site accident on the basis it was a “proprietor”.

Honghuan Liu

FenXun Partners

Ms Liu heads the dispute resolution group of FenXun Partners in Beijing, and is an arbitrator at the China International Economic and Trade Arbitration Commission, Beijing Arbitration Commission and Shanghai International Arbitration Center. Before becoming a lawyer, Ms Liu worked in the commercial litigation division of the Beijing Higher Court to supervise and guide the cases appealed from lower courts within its jurisdiction.

During more than 20 years of practice, Ms Liu has been litigation counsel for many multina tional companies. She is good at handling complex commercial litigation and arbitration, especially technology-related product liability, trade secrets, patents, standard essential patent portfolio royalty disputes and related anti-monopoly litigation, and other infringement or cross-border disputes related to case strategies and procedures, settle ment negotiation, and also public relations crisis for multinational companies in China.

Ms Liu is good at clarifying the core and hierar chical interests of clients in complex and influential cases involving multiple procedures, battlefields and cross-jurisdictional areas. She has unique insight into the differences between, and coordi nation among, various legal battlefields, and can accordingly determine the best action plan to be executed in China.

With her excellent logical ability, imagination and creativity, Ms Liu can quickly break into any cutting-edge technology field.

China has not yet formed a fact discovery system; against this background, Ms Liu is good at finding any possible clues, quickly tracing back the core facts, and establishing the evidence. She is also the first lawyer to use expert witnesses in the courts of mainland China. Many of Ms Liu’s lawsuits – covering such matters as trade secrets, product liability, trademarks, and other complicated and frontier cases – have become guiding cases for the Chinese courts to deal with such disputes.

Thanks to her outstanding ability in fact-finding and court defence, none of the product liability liti gation cases Ms Liu has handled for Japanese, German and American automobile manufac turers have ever resulted in a finding of a defective product.

Ms Liu graduated from China University of Political Science and Law in 1986 with an LLB degree.

FenXun Partners established a joint opera tion office with Baker McKenzie in April 2015. The Baker McKenzie FenXun (FTZ) joint operation is the world’s leading Chinese legal platform, delivering integrated international and PRC legal services. The joint operation is staffed by both locally admitted and foreign-licensed lawyers from Baker McKenzie and FenXun Partners, advising leading Chinese and multinational companies on Chinarelated domestic and cross-border issues across the full spectrum of corporate and commercial law.

Xi Zhou FenXun Partners

Mr Xi Zhou is a partner in the dispute resolution group of FenXun Partners. Mr Zhou is mainly engaged in litigation, arbitration and other dispute resolution matters. During his 18 years of practice, he has participated in many complex commercial lawsuits representing multinational companies and large domestic enterprises, and has appeared in court for many times as the chief trial counsel. The typical types of cases Mr Zhou represented include product liability, trade secret infringement, contract disputes, company equity, construction project, financial derivatives, administrative litigations and anti-commercial bribery government investigation. Before joining FenXun Partners, he was a partner in the dispute resolution department of Junhe LLP.

As the chief trial counsel of a large number of complex technology-related product liability and commercial litigation matters, Mr Zhou is good at comprehensively using clear logic and intuitive visual explanations, in accordance with charac teristics of the case and the adjudicator, to suffi ciently demonstrate and argument points to the adjudicator.

Mr Zhou is especially good at quickly deter mining core disputes and technical focus in complex cases; establishing and ranking the liti gation interests of clients; developing hierarchical and three-dimensional litigation plans according to said interests; comprehensively using various systems to promote and implement these plans; and realising clients’ interests to the greatest extent possible.

Mr Zhou graduated from Peking University with LLB and LLM degrees.
