Colin Loveday is a senior partner in the Clayton Utz product liability and class actions group. He is an experienced trial lawyer with particular expertise in the defence of class actions and complex commercial disputes. He has worked extensively with defence lawyers in other jurisdictions in the coordinated defence of multinational mass tort claims. Over the past two decades, Colin has been intimately involved in the development of Australia’s product liability laws and in the majority of class actions and mass tort cases in this area. His defence work includes a variety of prescription products and medical devices, infrastructure failures, financial products and other consumer products. Colin is internationally recognised for his work in the field of drug and device litigation. He has worked extensively with in-house counsel and lawyers in the US and Europe developing international defence strategies and working with international expert witnesses. Colin also has a special interest in advising manufacturing, pharmaceutical and medical device clients on regulatory requirements, clinical trials, labelling and advertising issues, product recalls and hazard alerts, and priorities management issues. He practised as a barrister in New South Wales between 1985 and 1990, when he became a partner at Clayton Utz. Colin was formerly on the board of directors of the International Association of Defense Counsel, a member of the IADC, the Australian Product Liability Association and the Defense Research Institute, and is former chair of the product law and advertising committee of the International Bar Association.
Greg Williams is an experienced practitioner with over 20 years’ experience in Australia’s premier product liability practice. He has been involved in the defence of product liability claims and class actions involving pharmaceuticals and medical devices, financial services and automobiles and, as a result, has significant experience in running large complex matters to a contested hearing. He was a member of the team that defended the Australian Vioxx class action. He led the team which defended and ultimately settled the Australian Volkswagen diesel emissions class actions. He is currently involved in the defence of Takata Airbag litigation and is acting for Bayer in the defence of the Australian Essure class action. In the regulatory sphere, he provides advice to Australian and overseas pharmaceutical and medical device companies on all aspects of the product lifecycle, including due diligence requests, product registration, reimbursement, advertising disputes, interactions with healthcare professionals, and product safety and recalls. Mary Catherine Way concentrates her practice on pharmaceutical and medical device litigation and other complex, multi-jurisdictional product liability and mass tort suits involving personal injury. She has successfully defended cases against hospitals and individual healthcare providers involving allegations of wrongful death or personal injury. In the last decade, Mary Catherine has been a member of several multidistrict litigation defense teams, serving in various roles, such as case workup counsel, taking and defending depositions; working with experts, including preparing for deposition and trial testimony; and preparing company witnesses and former employees for deposition and trial. She has also been part of several bellwether trial teams in complex litigations involving claims against drug and medical device manufacturers. Currently, Mary Catherine is defending product manufacturers against toxic tort claims involving contaminants found in soil that end up in the food supply; and serves on a multidistrict litigation team defending a product manufacturer against claims of groundwater contamination. Mary Catherine has actively participated in a variety of pro bono initiatives throughout her career. She has assisted the Innocence Project in civil rights actions impacting prisoners on death row in Arkansas and is currently participating in the National Veterans Legal Services Program discharge upgrade initiative, advocating for veterans seeking a military discharge upgrade or correction.
Mary Catherine believes that meaningful mentoring and active diversity programs are critical to the success of any professional organization.
