A Pair of Monumental, Rare and Important Chinese Imperial Stone Dragon Spouts QIANLONG PERIOD

the boldly carved stone dragon heads each having two water spouts to the right and left of the tongue, connecting to a large hole to the rear, the dragon’s mouth carved with finely detailed teeth and fangs with raised whiskers protruding from the nose, the neck carved with three levels of beard and flames, the neck and belly carved with raised scales, the top of the head with single long horn. Overall length approximately 48 inches. Provenance: Ex-collection of H. Medill Sarkisian (1909 – 1993), Denver, Colorado, acquired in 1941 in England, then passed through the family to the current owner, grandson Medill Sakisian. Note: It is believed that these monumental carvings were used at a temple or palace. Almost identical stone dragons appear at the Luguo Bridge, and were used to commemorate Qianlong’s rebuilding of the bridge in the 50th year of his reign (ca. 1785). Another similar example is the bixi stele sculpture at Harvard University, Cambridge, Massachusetts, dated to the 18th Century. $80,000-120,000

Guide for Prospective Sellers Evaluation of Property If you have property you wish to sell, please call our Consignment Department at 312.280.1212 to arrange for a consultation. At that time, you may make an appointment to bring your property or photographs, along with any other pertinent information, to Leslie Hindman Auctioneers, Inc. and we will be happy to provide you with complimentary estimates and advice. If you have a large collection, an appointment may be made to evaluate the property on-site. Fees for on-site visits may vary. Standard Commission Rates Our standard rate of commission is equal to ten percent (10%) of the hammer price on each lot sold for $5,001 or more; fifteen percent (15%) of the hammer price on each lot sold for $2,001 or more but less than $5,001; and twenty-five percent (25%) of the hammer price on each lot sold for $2000 and less with a minimum commission of $25 per lot sold. If your property fails to reach the reserve price agreed upon between you and Leslie Hindman Auctioneers, Inc., you may be obligated to pay a reduced commission rate of five percent (5%) of the reserve price. Shipping Arrangements Leslie Hindman Auctioneers, Inc. can advise you as to how to have your property delivered to our galleries. Packing, shipping and insurance are payable by the seller. In certain instances, packing and shipping costs may be paid by Leslie Hindman Auctioneers, Inc. and deducted from the proceeds of the sale. We may recommend packers and shippers, but we are not responsible for their acts or omissions. AT THE SALE Refusal of Admission Leslie Hindman Auctioneers, Inc. has the right, at our complete discretion, to refuse admission to the premises or participation in any auction and to reject any bid. Registration before Bidding A prospective buyer must complete and sign a registration form and provide identification before bidding. We may require bank or other financial references. Bidding as Principal When making a bid, a bidder is accepting personal liability to pay the purchase price, including the buyer’s premium, all applicable taxes and all other applicable charges, unless it has been explicitly agreed upon in writing with Leslie Hindman Auctioneers, Inc. before the commencement of the sale that the bidder is acting as agent on behalf of an identified third party acceptable to Leslie Hindman Auctioneers, Inc., and that Leslie Hindman Auctioneers, Inc. will only look to the principal for payment. Absentee Bids We will use reasonable efforts to carry out written bids given to us at least 24 hours prior to the sale for the convenience of clients who are not present at the auction in person, by an agent or by telephone. Bids must be placed in U.S. dollars. If we receive written bids on a particular lot for identical amounts, and these are the highest bids on the lot at the auction, it will be sold to the person whose written bid was received and accepted first. Execution of written bids is a free service undertaken subject to other commitments at the time of the sale and we do not accept liability for failing to execute a written bid or for errors and omissions in connection with the written bid. Telephone Bids On lots with a low estimate of $300 and above and if a prospective buyer makes arrangements with us prior to the commencement of the sale we will use reasonable efforts to contact them to enable them to participate in the bidding by telephone and we do not accept liability for failure to do so or for errors and omissions in connection with telephone bidding. Online Bids We will use reasonable efforts to carry out online bids and do not accept liability for equipment failure, inability to access the Internet or software malfunctions related to the execution of online bids. Reserves Some lots in the sale are subject to a reserve which is the confidential minimum price below which such lot will not be sold. The reserve will not exceed the low estimate of the lot. Reserves are agreed upon with consignors or, in the absence thereof, the absolute discretion of Leslie Hindman Auctioneers, Inc. The auctioneer may open the bidding on any lot below the reserve by placing a bid on behalf of the seller. The auctioneer may continue to bid on behalf of the seller up to the amount of the reserve, either by placing consecutive bids or by placing bids in response to other bidders. With respect to lots that are offered without reserve, unless there are already competing bids, the auctioneer, in his or her discretion, will generally open the bidding at half of the low estimate for the lot. In the absence of a bid at that level, the auctioneer may proceed backwards at his or her discretion until a bid is recognized, and then continue up from that amount. Auctioneer’s Discretion The auctioneer has the right at his or her absolute and sole discretion to refuse any bid, to advance the bidding in such a manner as he or she may decide, to withdraw any lot, and in the case of error or dispute, and whether during or after the sale, to determine the successful bidder, to continue the bidding, to cancel the sale or to reoffer and resell the item in dispute. If any dispute arises after the sale, our sale record is conclusive. Successful Bid The highest bidder acknowledged by the auctioneer will be the purchaser. In the case of a tie bid, the winning bidder will determined by the auctioneer at his or her sole discretion. In the event of a dispute between bidders, the auctioneer has final discretion to determine the successful bidder or to reoffer the lot in dispute. If any dispute arises after the sale, the Leslie Hindman Auctioneers, Inc. sale record shall be conclusive. Title passes upon the fall of the auctioneer’s hammer to the highest acknowledged bidder subject to the Conditions of Sale set forth herein, and the bidder assumes full risk and responsibility.

AFTER THE SALE Buyer’s Premium In addition to the hammer price, the buyer agrees to pay Leslie Hindman Auctioneers, Inc. a buyer’s premium and the applicable sales tax added to the final total. The buyer’s premium for all purchases except via live online bidding is twenty-five (25%) of the hammer price up to and including $100,000; twenty percent (20%) of any amount in excess of $100,000 up to and including $1,000,000; and twelve percent (12%) of any amount in excess of $1,000,000. The buyer’s premium for purchases made via live online bidding is twenty-six (26%) of the hammer price up to and including $100,000; twenty-one percent (21%) of any amount in excess of $100,000 up to and including $1,000,000; and thirteen percent (13%) of any amount in excess of $1,000,000.

Payment The buyer must pay the entire amount due (including the hammer price, buyer’s premium, all applicable taxes and other charges) no later than 5 p.m. on the seventh (7) business day following the sale. Payment in U.S. dollars may be made with cash; bank check or cashier’s check drawn on a U.S. bank; money order; or wire transfer unless other arrangements are made with Leslie Hindman Auctioneers, Inc. Leslie Hindman Auctioneers, Inc. reserves the right to hold merchandise purchased by personal check until the check has cleared the bank. The purchaser agrees to pay Leslie Hindman Auctioneers, Inc. a handling charge of $50 for any check dishonored by the drawee. Tax Exempt Notice Lots marked with an asterisk (*) are tax exempt as permitted by law.


Collecting Purchases Once Leslie Hindman Auctioneers, Inc. has received all funds due to us, the buyer shall collect purchased lots within seven (7) business days from the date of the sale.

LIABILITY

Packing and Shipping If your bid is successful, we can provide you with a list of shippers. We will not be responsible for the acts or omissions of carriers or packers whether or not recommended by us. Property will not be released to the shipper without the buyer’s written consent and until payment has been made in full. Packing and handling of purchased lots by us is at the entire risk of the purchaser, and Leslie Hindman Auctioneers, Inc. will have no liability of any loss or damage to such items.

Condition Reports Leslie Hindman Auctioneers, Inc. is not responsible for the correctness of any statement of any kind concerning any lot, whether written or oral, nor for any other errors or omissions in description or for any faults or defects in any lot. Neither the seller, ourselves, our officers, employees or agents, give any representation, warranty or guarantee or assume any liability of any kind in respect of any lot with regard to merchantability, fitness for a particular purpose, description, size, quality, condition, attribution, completeness, authorship, authenticity, rarity, importance, medium, provenance, exhibition history, literature or historical relevance. Except as required by local law any warranty of any kind whatsoever is excluded by this paragraph. Items under $1,000 are collated upon request.

Non Payment If we do not receive payment in full, in good cleared funds, within seven (7) business days following the sale, we are entitled in our absolute discretion to exercise one or more of the following measures, in addition to any additional actions available to us by law:

Purchased Lots If for any reason a purchased lot cannot be delivered in the same condition as at the time of sale, or should any purchased lot be stolen, mis-delivered or lost prior to delivery, Leslie Hindman Auctioneers, Inc. shall not be liable for any amount in excess of that paid by the purchaser.

Legal Ramifications The rights and obligations of the parties with respect to these Conditions of Sale, the conduct of the auction and any matters connected with any of the foregoing shall be governed and interpreted by the laws of the jurisdiction in Illinois. If any part of these Conditions of Sale is found by any court to be invalid, illegal or unenforceable, that part shall be discounted and the rest of the conditions shall continue to be valid to the fullest extent permitted by law.

Leslie Hindman Auctioneers, Inc. shall have no liability for any damage to property left on its premises for more than seven (7) business days following the sale. 本圖錄說明的拍賣物品是本公司所有的,或是賣家委託本公司進行拍賣的物品。 凡參加本公司展示的文物,藝術品等收藏品的拍賣活動者,應依照本規則進行。 競買人參加本公司拍賣活動,作出了競投,均等於同意本拍賣規則。 拍賣前 本公司鄭重建議,競投人應於拍賣進行之前親自鑑定拍賣之物品。 本公司於目 錄或鑑定意見書中對任何拍賣品之作者、來歷、日期、年代、尺寸、材質、歸 屬、真實性、出處、保存狀況或估計售價之陳述、或另行對此等方面之口頭或書 面陳述、純屬意見之陳述、不應作為確實事實之陳述。 本公司及其工作人員或 其代理人對拍賣標的任何說明中引述之出版目錄僅供競買人参考。本公司不提供 著錄書刊等資料之原件或复印件,并保留修訂引述說明的權利。 Leslie Hindman Auctioneers, Inc., 及賣家不陳述買家取得拍賣物品圖片版權,而且本公司保留圖 錄所擁有的著作版權。 拍賣時 拒絕入場 本公司有權拒絕任何人進入拍賣現場,或拒絕任何人參加本公司的拍賣活動, 或拒絕任何競投。 拍賣前登記 準買家在作出競投前,必須填妥及簽署登記表格,並提供身分證明。準買家應 注意,本公司亦有權要求對買家作出信用核查,亦有權對買家收取一定成數之 保證金。 以當事人身份競買 除非某競投者在拍賣日前向本公司出具書面證明并經本公司書面認可,表明其 身份是某買家的代理人,否則每名競投者均被視為買家而須承擔所有個人法律 責任。 委託競投 書面競投且經本公司確認,本公司將會盡力代其競投。書面競投應拍賣24小時前 登記,由當事人或代理人在現場,或經電話傳真送達書面競投應用美金登記。若 某一拍賣品收到多個委託競投之相同競投價時,而此等競投價乃該拍賣品之最高 競投價,則該拍賣品將歸為其委託競投書最先送達本公司之人。除非在競投時有 其它委託,此項書面競投的執行是本公司的免費服務。本公司不會對未能執行之 書面競投, 或在當中出現任何錯誤或遺漏負任何責任。 電話競投 若競投者對底價$300以上的拍賣品感興趣時,應於拍賣前與本公司完成委託競 投的相關作業,本公司將會盡力聯絡競投者,使其能以電話參與競投,但在任何 情況下,若未能聯絡上時,本公司對賣家或任何競投者均不負任何責任。 本公 司保留權力錄音電話競投過程 。 網路上競投 本公司將會盡力執行網路上的競投。若是技術故障,無法上網,或者軟體故障而 出現任何錯誤或競投遺漏,本公司將不負任何責任。 保留價 若拍賣品有保留價,保留價指保密的不得以低於拍賣底價的價格。 保留價不 會超過競投之物品的低價。保留價預先與出賣人已說明,或由 Leslie Hindman Auctioneers, Inc. 公司決定權。 拍賣官保留權力,任何競投之物品可於低於保留 價的價格開始接受競投,然後為出賣人繼續競標到保留價格。 無保留價的拍賣 品拍賣官通常自低價的一半價格開標,除非已有競標登記。 如無競標,拍賣官 保留權力降低開標價格。 拍賣官之決定權 拍賣官具有絕對決定權,亦即有權拒絕任何競投、以其決定之方式推動出價、將 任何兩件或多件拍賣推動出價、將任何拍賣品撤回或分批、將任何兩件或多件拍 賣品合併,假如遇有誤差或爭議,將拍賣品重新拍賣。若在拍賣後有任何爭議, 將會以本公司的拍賣紀錄為依歸。 成功競投 在拍賣官之決定權下,下槌即顯示對最高競投價之接受,亦即為賣家與買家之成 功拍賣合約之訂立,即表明競投人成為拍賣標的的買受人。若有競投人之間爭 議,成功競投者由拍賣官決定,或拍賣官有權力重新拍賣有爭議的競投之物品。 若拍賣發生爭議時將以公司的拍賣紀錄為依歸。拍賣官落槌時所有權和風險責任 均轉移到買家。

拍賣後 買家支付之酬金 買家應支付本公司酬金。網上實時競投購買以外的拍賣品落槌價為$100,000 或 以下,酬金以落槌價之25%計算;超過$100,000至$1,000,000之部份,則以20% 計算;超過$1,000,000之部份,則以12%計算。 網上實時競投購買的拍賣品落槌價為$100,000 或以下,酬金以落槌價之26%計 算;超過$100,000至$1,000,000之部份,則以21%計算;超過$1,000,000之部 份,則以13%計算。 付款時間 買方須自拍賣成交日起7日內向 Leslie Hindman Auctioneers, Inc. 公司一次性支 付 (包括落槌價、酬金、 稅費、出境鑒定費用、以及其它各項費用)。支付時可 用私人支票、現金、美國銀行本票、匯票、其它付款方法應預先於本公司洽談。 Leslie Hindman Auctioneers, Inc. 保留權力等支票兌現後交付買受人所購得之物 品。 如支票無法兌現,買受人應付本公司$50的服務費。 注意免稅 有 * 的競投之物品法律規定免稅。 領取競投之物品 買受人向 Leslie Hindman Auctioneers, Inc. 付清購買價款以及資金清算了須在拍 賣成交日起7日內領取拍賣標的。 包裝及搬運 若您競投成功,本公司可推薦包裝公司及搬運公司。對於本公司向買受人推薦的 包裝公司及搬運公司所造成的一切錯誤、遺漏、損壞或滅失,本公司亦不承担責 任。本公司不釋放未付清以及未經買受人書面授權搬運公司可領取的競投之物。 不付款 如買家未在7天內付款,本公司即有權行使下述一項或多項權利或補救辦法: a.) 每30天按日收取依賣價(含酬金)1.5% 計算之違約金 b.) 對買受人提起訴訟,要求賠償本公司因其違約造成的一切損失,包括因買受 人遲付或拒付款項造成的利息損失 c.) 交易取消 d.) 再行拍賣或以其它方式出售該拍賣標的。原買受人除應當支付第一次拍賣中 買受人及委托人應當支付的佣金及其它各項費用並承担再次拍賣或以其它方式出 售該拍賣品所有費用外,若再行拍賣或以其它方式出售該拍賣標的所得的價款低 于原拍賣價款的,原買受人應當補足差額。此外,留置本公司向同一買受人任何 拍賣標的,以及因任何原因由本公司占有該買受人的任何其它財產或財產權利, 留置期間發生的一切費用及/或風險均由買受人承担。若買受人未能在本公司指 定時間内履行其全部相關義務,則本公司有權留置拍賣物。若處分留置拍賣物的 所得不足抵償買受人應付本公司全部款項時,本公司有權另行追索。 e.) 本公司有權另行追索任何費用 f.) 從此不接受原買受人的競投 g.) 任何本公司視爲適當的行為 未領取之已購拍賣品補救辦法 若已購得之拍賣品未能在成功拍賣7天內領取,不論是否已付款,本公司有權按 日收取依賣價(含酬金)每日$5計算之違約金,或將安排貯存事宜,費用由買 家承擔。關於未能在成功拍賣7天內領取的拍賣品, Leslie Hindman Auctioneers, Inc. 不承担損壞或減失的責任。此外,若沒有按造此規則付款本公司有權按月收 取依賣價(含酬金)1.5% 計算之違約金。未能在成功拍賣30天內領取的拍賣品此 外會造成$75的手續費。已付款而60天內未領取的拍賣品本公司有權以公開拍賣 或其它本公司認為合適的方式及條件出售該拍賣標的,處置所得在扣除本公司因 此產生之全部保管費,其它非等候,若有餘款,則由買受人自行取回。 負債 拍賣品狀態說明 出賣人、本公司員工、代理人等的意見對任何拍賣品之作者、來歷、日期、年 代、尺寸、材質、歸屬、真實性、出處、保存狀況或估計售價之陳述、或另行對 此等方面之口頭或書面陳述、均僅屬意見之陳述,不應依據為確實事實之陳述。
