Law Divorce In Massachusetts you can file for a no-fault divorce or a fault based divorce. A no fault default is regarded as an irretrievable breakdown of the marriage. For no fault divorces either spouse can file a divorce petition on their own or a couple may file a joint petition for divorce. A fault divorce is usually filed in situations of domestic violence, adultery, or abandonment. If you file for a fault based divorce, it will be your burden to prove the case. In either situation, you will need a divorce attorney.
Custody In Massachusetts there are two types of custody: legal custody and physical custody. Legal custody allows parents to make important decisions in a child’s life such as schooling, religious upbringing and medical decisions. Physical custody determines where the child actually lives. It is not uncommon for divorced parents to share both legal and physical custody. If you cannot come to a custody agreement on your own, the courts do so based on what is in the best interest of the child.
