Laws for Divorce in CT

Author: lousie smith For the purpose of the dissolution or annulment of a marriage, a couple in Connecticut should possess certain qualities, to have the legal rights to appear in front of a court judge. Either of the two should have been a registered resident of CT for at least 12 months, prior to the filing of the divorce. Also, both of them should have been residents or returned as permanent residents at the time of marriage. Only these conditions give a couple a rightful legal grounds to apply for an uncontested divorce in ct. There are widely two types of divorce cases that are filed in courts of the Connecticut state area. The first is the ‘no-fault based grounds’ case and the other is the ‘fault-based grounds’ case. In the former type, the divorce is uncontested. The parties applying for divorce have no arguments or debate over any clause of the filed divorce application. If any in the couple do have any dispute then it falls under faultbased divorce. Uncontested divorce is mainly agreed upon and given for two reasons mainly—firstly, a broken marriage that is irreparable and which both parties have mutually agreed to break and secondly, a long separation caused due to incompatibility or other such reasons (the period of separation should exceed 1 year 6 months). An uncontested divorce in ct is usually kept away from regular court room proceedings. This is basically done to keep things simple. Both parties have agreed that there is no way to save the marriage and have agreed upon settlements over property, child custody, alimony etc. in an ‘out of court’ settlement. Only if there are issues over these factors does the court proceed with a civil court proceeding. After hearing both pleadings will a judge pass his verdict. The fault-based divorces are usually given in cases of adultery, separation of over 12 months, fraud, no contact for over 7 years, mental and/or physical torture, mental disability of either of the two parties and imprisonment exceeding 12 months. Divorce is a very painful experience for any couple. Most issues are agreed upon but some remain like thorns. What one requires at these times is an understanding, patient, experienced and well-versed divorce lawyer who will help you to smooth the creases. Just as dealing deftly with ct labor laws, these lawyers will make your divorce into a peaceful settlement rather than a conflict which will probably last for years.
