TERMS

OF TENANT LEASE AGREEMENT

1. CAPE CHARLES REALTY LLC, AS THE AGENT OF THE OWNERS, IS THE RENTAL MANAGER OF THIS VACATION PROPERTY WHICH IS AVAILABLE FOR WEEKLY OR SEASONAL RENTALS THE LANDLORD OF THE PROPERTY (THE OWNERS) HAS GVIEN THE AGENT THE AUTHORITY TO ENTER INTO THIS AGREEMENT. THIS AGREEMENT SETS FORTH THE TERMS UNDER WHICH YOU, AS TENANT, WILL LEASE THE PROPERTY FOR A SPECIFIED PERIOD OF TIME THROUGH THE AGENT THE TENANT UNDERSTANDS AND AGREES TO ALL RIGHTS AND OBLIGATIONS AS SET FORTH IN THE VACATION RENTAL ACT.

2. THIS LEASE MUST BE SIGNED BY THE TENANT. TENANT MUST BE 25 YEARS OLD REPRESENTING A FAMILY GROUP AND THAT TENANT WILL OCCUPY THE PROPERTY THOUGHOUT THE DURATION OF TENANCY. THIS LEASE AGREEMENT IS CONSIDERED, VALID AND ENFORCEABLE ONCE TENANT HAS RECEIVED IT AND MET THE FOLLOWING CONDITION: SIGNED THE AGREEMENT AND SUBMITTED PAYMENT OR SUBMITTED PAYMENT AND TAKEN POSSESSION OF THE PROPERTY TENANT UNDERSTANDS THE EMAIL ADDREESS AND PHONE NUMBER ON FILE WILL BE USED FOR COMMUNICATION ABOUT THIS RESERVATION.

1 TENANT AGREES TO PAY $35 00 PROCESSING FEE FOR ANY CHECK RETURNED BY THE FINANCIAL INSTITUTION. 2. NORTHAMPTON COUNTY CHARGES 5% TRANSIENT OCCUPANCY TAX THAT ARE ADDED TO THE RENTAL FEE.

PLEASE REPORT ANY DAMAGES, SAFETY CONCERNS, MAINTENANCE NEEDS TO THE AGENT ON CHECK IN. TENANT IS RESPONSIBLE FOR ALL DAMAGS TO THE OWNER’S PROPERTY CAUSED BY THE TENANT, HIS OR HER FAMILY, GUEST INVITEES AND SUCH PERSON AND VEHICLES TENANT SHALL REPORT ANY BREAKAGE OR DAMAGES UPON OCCURANCE, REGARDLESS OF THE CAUSE TENANT AGREES TO SUBMIT PAYMENT WITH IN 10 DAYS IF AGENT DETERMINES THAT THE TENANT HAS DAMAGED THE OWNER’S PROPERTY AND AGENT CONTACTS TENANT AND REQUESTS PAYMENT FOR THE DAMAGES

REFUNDS: NEITHER LANDLORD /OWNER NOR AGENT WILL PROVIDE REFUNDS FOR UNFAVERABLE WEATHER, LATE ARRIVAL, EARLY DEPARTURE, INTERUPTION OF UTILITIES OR CONSTRUCTION IN THE AREA, GOVERNMENTAL ACTS OR OTHER ACTS OF GOD.

NO CANCELLATION OR TRIP INSURANCE IS PROVIDED

CANCELLATION POLICY: IN THE EVENT TENANT CANCELS A RESERVATION OF THE LEASED PROPERTY AND SAID PROPERTY IS NOT RE-RENTED DURING THE ENTIRE TERM SET OUT ABOVE, THEN ALL CONSIDERATION PREVIOUSLY TENDERED WILL BE FORFEITED BY TENANT AND RETAINED BY THE OWNER ALL PAYMENT ON THIS LEASE ARE DUE IN FULL OWNER RESERVES THE RIGHT TO FILE CIVIL ACTIONS TO RECOVER ANY UNPAID RENTAL. ALL CANELLATIONS MUST BE IN WRITING/EMAIL IF THE PROPERTY IS RE-RENTED, THEN RENT, TAXES, AND /OR SECURITY DEPOSIT CONSIDERATON PREVIOUSLY TENDERED BY TENANT WILL BE REFUNDED LESS THE ADMINSTRATIVE FEE TENANT SHALL NOT SUBLET THE PROPERTY IN PART OR IN WHOLE.

CHECK-OUTS: TENANT WILL VACATE THE PREMISES BY 11 AM ON THE CHECK – OUT DAY TENANT IS RESPONSIBLE FOR WASHING DISHES, TAKING OUR TRASH (COUNTY TRASH RECEPTICLES ARE AVAILABLE IN EASTVILLE) , EMPTYING REFIGERATOR, LEAVING THE A/C SET ON 80 DEGREES IN THE SUMMER AND 65 DEGREES HEAT IN THE WINTER SECURE ALL DOORS AND WINDOWS, AND LEAVE THE UNIT GENERALLY CLEAN, DAMAGE FREE AND IN GOOD SHAPE FOR THE CLEANERS ALL BED LINENS MUST BE STRIPPED AND LEFT IN BASKETS AVAILABLE. PILLOWS, BLANKETS & SPREADS CAN BE LEFT ON THE BEDS. A WASHER & DRYER ARE AVAILABLE FOR LIGHT LOADS OF CLOTHES WASHING DO NOT WASH BEACH TOWELS IN THE UNITS THERE IS A CLOTHES-LINE AVAILABLE DRYING BEACH TOWELS.

4 PERMITTED OCCUPANCY AND OCCUPANCY LIMITS: TENANT SHALL TAKE POSSESSION AND MAINTAIN POSSESSION OF PROPERTY FOR THE FULL LEASED PERIOD TENANTS SHALL NOT PERMIT THE PROPERTY TO BE OCCUPIED BY MORE THAN THE MAXIMUM NUMER OF OCCUPANTS ALLOWED UNDER THE LAW STANDARD OCCUPANCY IS 2 GUESTS PER BEDROOM OVER OCCUPYING OF PROPERTY OR MISREPRESENTING OCCUPANY IS GROUNDS FOR IMEDEIATE EVICTON WITHOUT REFUND.

BEDS ARE QUEEN AND 2 TWIN BEDS: CRIBS OR BEDDING FOR SMALL CHILDREN ARE THE RESPONSIBILITY OF THE GUEST/ TENANT. ABOSUTELY NO HOUSE PARTIES ALLOWED.

PROHIBITTED CONDUCT: ABSOLUTELY NO HOUSE PARTIES, BEER KEGS, FIREWORKS OF ANY KIND. VIOLATION WILL RESULT IN THE TERMINATION OF THE LEASE AND IMMEDIATE EVICTION WITHOUT REFUND MISREPRESENTATION, FAILURE TO PAY IN FULL, OBTAINING SUBJECT PROPERTY UNDER FALSE PRETENSES, FRAUD OR MATERIAL BREACH OF THIS AGREEMENT SHALL RESULT IN EVICTION

SPECIAL EVENTS: TENANT SHALL NOTIFY CAPE CHARLES REALTY OF ALL LARGE GATHERINGS IN OR ON PREMISES SPECIAL EVENTS

PETS: NO PETS ARE ALLOWED ON THE PREMISES.

4. PROPERTY IS A NON-SMOKING PROPERTY: NO SMOKING INSIDE THE PROPERTY.

5 RIGHT OF ENTRY, ACCESS AND SECURING THE PROPERTY: AGENT RESERVES THE RIGHT TO ENTER AND INSPECT PROPERTY WITHOUT PRIOR NOTICE TO TENANT. AGENTS RESERVES THE RIGHT TO SCHEDULE PROFESSIONAL SERVICES DURING TENANCY INCLUDING MAKING REPARIS, OR INSTALLLATIONS TENANTS MAY NOT DULPLICATE THE KEYS AND IS RESPONSIBLE FOR SAFEGUARDING THE KEYS LOST OR UNRETURNED KEYS WILL BE A MINIMUM OF $100 00 FOR RE- KEY SERVICES.

6 NEITHER AGENT OR LANDLORD WILL BE LIABLE FOR DAMAGES AND NO REFUNDS WILL BE GIVEN FOR INOPERALBE APPLIANCES OR MAINTENANCE PROBLEMS PROVIDED THE AGENT IS

SEEKING TO SERVICE, REPAIR OR REPLACE SAID FAILURE IN A REASONABLE MANNER UPON RECEIPT OF NOTIFICATIN FROM THE TENANT DIFFICULTIES WITH UTILITIES, SERVICES OR AMENITIES PROVIDED BY A THIRD PARTY ARE NOT THE RESPONSIBILTY OF THE AGENT OR LANDLORD.

7 GRILLING: GRILLING IS PERMITTED AND IT’S THE TENANTS RESPONSIBILITY GRILLS MUST BE ATTENDED AT ALL TIMES AND CLEANED ON DEPARTURE.

8 SHEETS & TOWELS: SHEETS, TOWELS AND SPREADS ARE PROVIDED PLEASE DO NOT WASH BEACH TOWELS IN THE WASHER/DRYER. BEDS MUST BE STRIPPED ON DEPARTURE AND ALL SHEETS; TOWELS SHOULD BE LEFT IN THE BASKETS PROVIDED. SPREADS AND PILLOWS CAN REMAIN ON THE BEDS

9. THE AGENT AND LANDLORD IS NOT RESPONSIBLE FOR ANY ACCIDENTS OR OCCURENCES RELATED TO SWIMMING OR BOATING NO LIFEGUARDS ARE ON DUTY ON SMITH BEACH

10. INDEMINIFICATION AND HOLD HARMLESS: ASSIGNMENT: THE TENANT, THEIR FAMILY AND GUESTS, AND ALL OCCUPANTS OF THE VACATION HOME AGREE TO RELEASE, HOLD HARMLESS ANND INDEMNIFY THE LANDLORD/AGENT FROM AND AGAINST ALL CLAIMS FOR DAMAGES AND OR PERSONAL INJURIES TO ANY PERSON ARISING OUT OF THE USE OF THE PROPERTY INCLUDING DECKS, STAIRS, INTERIOR AND ALL EXTERIOR AREAS.

11. OTHER TENANT OBLIGATIONS: TENANTS MUST INSPECT THE PREMIESE UPON ARRIVAL AND NOTIFY THE AGENT IMMEDIATELY OF ANY ISSUES. DUE TO HEALTH DEPARTMENT REGULATIONS, OCCUPANCY IN HOMES SERVED BY SEPTIC SYSTEM IS LIMITED TO TWO PERSONS PER BEDROOM.

12 MANDATORY EVACUATION: IN THE EVENT THE TENANT IS REQUIRED BY STATE LAW TO EVACUATE THE PREMISES: THE TENANT AGREES TO SECURE THE PROPERTY AND LEAVE WITHIN 4 HOURS OF NOTICE. TENANT SHALL NOT BE ENTITLED TO A REFUND. LANDLORD/AGENT IS NOT RESPONSIBLE FOR ANY ACTS OF NATURE

13. NOTICE: THIS IS A LEGALLY BINDING CONTRACT. TENANT UNDERSTANDS THE AGENT WILL BE REPRESENTING THE BEST INTEREST OF THE OWNER OF THE PROPERTY
