IRS changes to using the 1031 exchange and how you can benefit
A
Almost everyone reading this magazine has some degree of familiarity with the 1031 exchange law. The biggest benefit to
1031 effectively has put an end to this practice.
using a 1031 exchange is a tax deferral which allows the purchaser to free assets of one property and use toward a replacement property to avoid capital gains tax.
For property investors, 1031 is an essential tool in increasing value in their portfolio. Investors and property owners use exchanges of “like-kind” properties to increase the value of their portfolio by freeing up the capital from one property to use in the purchase of a higheryielding property, without paying taxes on the equity. They can diversify their portfolio by selling one large investment and using the capital to invest in multiple properties, including commercial property.
For the readers that are familiar with using the 1031 exchanges in business and real estate transactions, one major change to the 2018 law stipulates that now only “real” property (real estate) can be used. No longer are people able to exchange business assets (such as vehicles or machinery) or personal assets (such as stocks/bonds) and avoid capital gains taxes, by using the 1031 exchange.

In past articles, we have touched on cryptocurrency and how the IRS has defined cryptocurrency as “property”. Parties were using the 1031 exchange as a loophole to use cryptocurrency in transactions while avoiding paying capital gains taxes. The “real property” changes to

THERE ARE SOME RULES TO AVOIDING CAPITAL GAINS. 1. You must have held the property for more than 2 years. 2. You must identify a replacement property of “like-kind” within 45 days and close the deal in 180. 3. The new property being purchased must be equal or greater than the property sold (or capital gains tax will apply to the difference). 4. A qualified intermediary must be used to hold funds during the process between selling and purchasing the replacement property.
