Mexico ha cambiado su ley de tenencia para los extranjeros, para que estos mismos puedan ser dueños o propetarios de un pedazo de tierra. Existen dos vías legales para que un extranjero pueda tener una propiedad en Mexico.
La primera es formando un FIDEICOMISO, donde se hace una busqueda de título de propiedad de manera apropiada y la venta de la propiedad sera cerrada ante un notario, registrada y llevada a una institución bancaria para que maneje la propiedad por usted en fideicomiso con una serie de leyes y regulaciones que con calma se tienen que observar.
Otra manera de adquirir propiedad en México es formando una corporación mexicana que vaya acorde a las leyes de corporaciones mexicanas. Estas corporaciones son amplias en tema y tienen ventaja al no estar sujetas a un banco para su manejo, así usted decidirá cual es la mejor opción para la actividad de su negocio.

Mexico has changed its foreign land tenancy laws so that non nationals can own land within the restricted zone, that is, 100 kms from the borders and 50 kms from the ocean. There are two legal ways a foreigner can own land in Mexico, one being via a Trust or a FIDEICOMISO, where the title has been properly searched and the sale has closed before a notary, the property dully registered and taken before a banking institution to manage the land for you in a TRUST that in turn has a series of laws and regulations you must observe.
Another way to own land in Mexico is by forming a Mexican Corporation with a promise to abide by the Mexican corporate laws in which case any appeal to a foreign government becomes null. The Mexican Corporation can be wide in its scope and has the advantage that it is your personal independently run business hence are not paying a bank to hold a Trust. You must decide which way is best for your business activity.
We can refer you to experts on land tenancy, guide you along the way to a successful transaction and offer you the assurance of dealing with very honest individuals. Land holding in Mexico is no longer a risk, provided you do your homework and surround yourself with persons with the correct know how. Land in the Cape area is not cheap so beware of offers that look too good, keep away from those, as the days of honest promises, fantastic deals, good hand shakes and promises are no longer.
One thing is true…..As soon as you become a land owner in Mexico you will be protected by the Mexican Constitution it self . Not once has the Government of the Municipality or the State intervened to expropriate, attack or change a legally recognized and registered property. Not once a hotel, tourist complex or home owner been deprived of its lawfully registered property.

ABOUT LOS FRAILES AREA PROPERTIES
It is incredible to believe the fantastic history of these lands that go so far back that the ownership get lost in time. It is not until the year 1823 that first sings of legalization began by this family that leaved in San Francisco, Alta California, province of Mexico and it was during this year that a branch of the Fiol family obtained, legal Title for the predio San Juan.
These lands were ceded by the then Roman Catholic priest authorized to approve such land tenancies. It was not until 1850’s during at the time that president Benito Juarez was president of Mexico that this land obtained it’s title from the Mexican president, by then Mexico has lost alta California to the United States of America.
The history of this predio is important and historical because of it’s beginning and the fact of documentation to that remote time exist still on it’s original documentation and in my possession.
The area known as predio Los Frailes, actually encompasses three predios which where titled by president Porfirio Diaz in 1885. Los Frailes is then divided in those three sections called El Cirhuelo, El Salado and Los Frailes in that order, Fraction I, Fraction II, and Fraction III. There is abundant amount of documentation also in regards to these Predios also owned by the Fiol family and most of them in my possession.
I started managing Hotel Palmilla, in San Jose Del Cabo, Baja California Sur, Mexico in December 1966 for Señor Abelardo Rodiriguez Montijo, the first pioneer that ventured in purchasing land and the first to construct and operate the first resort hotel facility of this type in the entire Territory of Baja California Sur, Mexico.
At that time there were no signs at all of a tourist boom as we know it now as we had no paved roads at all, no commercial airlines or paved airport or adequate food supply to run a tourist complex.
1969 I was manager of Hotel Palmilla and was offered first, one ranch property called Los Frailes, by the representative of the owners.
Owning a ranch had never crossed my mind so I was reluctant to purchase…so I did. The ink was not still dry on this first documents when the same representative of the same family Fiol visited me anew at the hotel…
In 1970 I was offered to purchase another ranch called El Zalatito( now Coral de Frailes), part of Predio San Juan., also owned by the same family that sold me Los Frailes. This time I said a definite no to Dr. Cirilo Mondragon Ochoa, a prestigious doctor in this State and representative of the seller; however, his persuasive powers won over my very weak resolve and ended up being the owner of another ranch.
Both properties have and additional title of “INAFECTABILIDAD AGRARIA” which means the only person that can change, affect, modify, expropriate is the President of Mexico provided it is done according to Constitutional laws and pays the affected owner the going value of the land at the time that would be affected. I mention this to assure a potential buyer of the importance of having such title as Inafectabilidad Agraria.
The portion of land known as Los Frailes Mountain, which is between San Juan and Los Frailes is the most eastern point of land of the three California’s. So this is the first portion of land of the California’s that gets the first sunrays every morning and the energy travel as far throug the land of the three California’s to the North Pole.
One of the reason the area is called Los Frailes, is because, some observers out in a boat at a certain distance of the los Frailes mountain can distinguish, or observe in the rock formations a figures of three Friars. I considered my self a fortunate individual to have had the privilege of owning and operating as ranches these unique and wonderful properties with their unsurpassed unequaled calm tempting beaches with their beautiful white very healthful clean ocean breezes.

Escalera Náutica
A escala regional, entre los Centros Integralmente Planeados se encuentran la denominada Escalera Náutica, que plantea el desarrollo de 27 escalas náuticas en el Mar de Cortes, abarcando los Estados de Baja California Norte y Sur, Sonora, Sinaloa y Nayarit. El programa esta dirigido al turismo vinculado con la navegación, la cultura, asi como al desarrollo socioeconómico de las entidades a incluir.
DECRETO ÁREAS NATURALES PROTEGIDAS
PARQUE NACIONAL CABO PULMO
El Parque Nacional Cabo Pulmo (PNCP) establecido en 1995, está situado en el Cabo del Este en Baja California Sur. El parque, Área Natural Protegida, está ubicada dentro del mar, mide 7.111 hectáreas, e incluye el único arrecife coralino en el Mar de Cortés. Cabo Pulmo es uno de tan sólo tres arrecifes vivos en el occidente de Norteamérica.
Aquí habitan miles de diferentes organismos marinos, cuanta con 236 especies de peces y se protegen grandes y varias escuelas de éstos. Arrivan de manera temporal grandes animales marinos como la ballena, y muchos otros que son especies protegidas por la legislación mexicana e internacional, como el tiburón ballena y animales en peligro de extinción como las tortugas marinas. De las siete especies de estos reptiles marinos que existen en el mundo, cinco llegan a anidar en nuestras playas, o comer o reproducirse a nuestro mar.
Por considerar a la cultura ambiental y normativa, la pesca comercial está prohibida en el área núcleo y alrededores. El parque es un espacio de protección para las especies marinas comerciales y no comerciales, y en algunos casos un espacio de regeneración para cientos de especies marinas más.
La cadena de montañas y las aguas que rodean el Parque son realmente hermosas, playas tranquilas en una perfecta combinación con el desierto, que invita a diferentes actividades como disfrutar el paisaje, sumergirse en un mundo marino fantástico y colorido, realizar pesca deportiva o hacer caminata entre la naturaleza terrestre y descubrir la maravillosa y diversa flora y fauna del desierto.
El Parque Nacional Cabo Pulmo es un verdadero y emocionante paraíso de colores y formas, donde se desborda la belleza de la naturaleza y donde el estudio y la investigación del ecosistema y las relaciones complejas entre los organismos humanos, animales y vegetales que ahí habitan, contribuyen al saber ambiental y científico.
