MAUI SEN. ENGLISH PROPOSES ‘STEVEN TYLER ACT’

and Oahu blogger Ian Lind all reported last week that the state Legislature is working very hard to damage the current “shield law” that protects us reporters from having to reveal confidential sources to authorities. “The [House Judiciary] committee on Tuesday [Jan. 29] inserted new exceptions that reduce the protections journalists have under the shield law,” Civil Beat reported on Jan. 31. “The committee passed amendments over the objections of a coalition of media outlets that want the Legislature to just make the law permanent in its current form. The law will expire June 30 unless lawmakers take action.” According to Civil Beat , the state’s current shield law says “reporters only have to reveal their sources if there’s enough evidence that the source or protected information is critical to an investigation, a felony case or a defamation case.” That makes it one of the strongest in the nation. But Lind says the new bill HB 622 would

Credit Malia Zimmerman of Hawaii Reporter for breaking this one on Thursday, Jan. 31: “State Senator Kalani English, a Maui Democrat, introduced the Steven Tyler Act, which would make it a tort to invade the privacy of celebrities,” Zimmerman reported. “The bill aims to ‘encourage celebrities to visit and reside in our State by creating a civil cause of action for the constructive invasion of privacy.’ It could be used to prosecute a reporter or photographer ‘if the person captures or intends to capture, in a manner that is offensive to a reasonable person, through any means a visual image, sound recording, or other physical impression of another person while that person is engaging in a personal or familial activity with a reasonable expectation of privacy.’” According to Zimmerman’s story, 25 of the state’s senators have already signed onto the bill, which is listed as SB 465. Bill introducers include English as well as Maui Senators Roz Baker and Gil Keith-Agaran. And yes, it’s actually called “The Steven Tyler Act.” Here’s a quote from the bill text itself: “Steven Tyler, the lead singer of Aerosmith for over forty years, former ‘American Idol’ judge, and world-renowned celebrity has recently purchased a home on Maui. He will now be sharing his time between Boston, Los Angeles, and his new home on Maui. In honor of Steven Tyler’s contribution to the arts in Hawai’i and throughout the world, this Act shall be known as the Steven Tyler Act.” Contribution to the arts in Hawaii?! Wow, what lips English has for him to be able to kiss Tyler's ass all the way from the Legislature in Honolulu. Clearly, this bill is nothing more than a big "Move Here" sign for wealthy rock stars and Hollywood starlets. What's more, the U.S. Supreme Court

has already ruled that people can photograph or film police officers on public highways and roads because they have no reasonable expectation of privacy in these public spaces. Beaches and ocean are also public, but this bill would seem to create a special class of citizen–the celebrity–who would enjoy special privacy rights even in such public spaces. So what will all that mean in real terms if the bill passes? Lots of trouble, according to Zimmerman: “Hawaii attorney and legal blogger Robert Thomas said there are a number of problems with the legislation, and its impact could be far reaching,” she reported. “Even people who use a smart phone to take photos of celebrities or stars of the locally produced Hawaii 5-0 could be held civilly liable.” It’ll be really interesting to see how far this goes. Oh, and one more thing, which is supremely ironic given that English’s bill is about celebrity. As you noticed at the beginning of this blurb, I credited another publication with first reporting on this bill. Given that the bill is part of the public record, I didn’t have to do this. I could have simply called up the bill text online and proceeded to report the story as though I’d discovered the bill on my own. But I chose to because Hawaii Reporter

discovered and wrote about the bill by doing actual reporting–it didn’t simply hit “Publish” first after receiving a press release from some government official, which often seems to be the overriding impetus for breaking news these days. True breaking news is when an outlet reports a story that officials aren’t publicizing. That’s what Hawaii Reporter did in this case, and other reporters following behind them should credit them. But over the weekend after the Hawaii Reporter’s story broke, I couldn’t help but notice other, larger, news outlets run with their own stories on English’s bill–the Associated Press, Hawaii News Now, the Los Angeles Times. But so far, I’ve only been able to locate stories in the New York Post and USA Today that actually credited Hawaii Reporter with first reporting the story. In the days before online aggregation of news, that kind of behavior from news outlets who should know better was easy to hide. That they would continue such pettiness these days is beyond callous.

“cripple the law by dramatically limiting the circumstances under which its protections would apply.” Ironically, the original shield law came about while Republican Linda Lingle, a former Molokai journalist, was governor. As for current, supposedly liberal, Governor Neil Abercrombie, he’s apparently a bit less enthused about shielding reporters. “It’s also disappointing that the push to strip away journalists’ protections is coming from Democratic Governor Neil Abercrombie’s administration,” Lind wrote on Jan. 31. “I think a lot of us expected and continue to expect more from Neil.” Then again, if most news outlets these days are just passing off other reporters’ work as their own while waiting for government officials to tell them what to publish, what is there really to shield? ■ anthony@mauitime.com + @apignataro To share or save this article, type: mt.hy.pr/1634n1

ROTARY CLUB ASSISTS MAUI YOUTH AND FAMILY SERVICES The Maui Youth and Family Services historic Ka Pono building in Makawao was the recipient of a well-deserved and needed interior and exterior maintenance and landscaping last weekend, courtesy of good-willed Rotarians content to spend a Saturday in service. The project was part of the Weinberg Friends Program, in which Rotarians perform a community service project and in return the Harry and Jeanette Weinberg Foundation donates $10,000 to a local nonprofit chosen by the Rotary Club. This year, the Rotary Club selected Maui Youth and Family Services to be the recipient of the award. “We chose Maui Youth and Family Services not only because of our Club’s dedication to youth support programs, but also because [MYFS] is the only agency on the island that provides outpatient substance abuse services for adolescents,” said Rotary Club of Kahului President Robert Kawahara. “This project is well-matched with the Weinberg Friends Program because the organization meets an important need in the community by increasing access to health care for at-risk populations, which is one of the Foundation’s main goals.” Maui Youth and Family Services is a nonprofit that works with adolescents and families affected by addiction, substance abuse and mental-health related issues. The organization plans to use the funds in the operation of their Adolescent Intensive Outpatient Substance Abuse Program, which treats approximately 80 adolescents per year suffering from drug and alcohol addiction and helps them reconnect with their families as part of the recovery process. “We are extremely grateful to both The

Weinberg Foundation and the Kahului Rotary Club for this help,” said Deborah Gouveia Couch, Program Coordinator at Maui Youth and Family Services. “Having an environment that is cheerful, welcoming and professional reflects how much we respect and value our clients. We want our clients to feel comfortable while they are here, and this project will go a long way in doing just that.” The Ka Pono building in Makawao, which houses the Adolescent Intensive Outpatient Substance Abuse Program, was constructed in 1920 and received a much needed “face-lift” from approximately 25 Rotarians. Described as “quaint, yet highly functional,” the facility now has a completely repainted interior and clean surrounding grounds. The Harry and Jeannette Weinberg Foundation, founded in 1959, is one of the largest private charitable foundations in the United States and grants funding to nonprofits that provide direct services to low income and vulnerable individuals. On Tuesday, Feb. 12, Professor Puakea Nogelmeier, acclaimed songwriter, Kumu Hula and UH Manoa Professor of Language, will talk to the Maui Native Hawaiian Chamber of Commerce on the status of the ‘Ike Ku‘oko‘a project. That aims to convert 116 years of Hawaiian language newspapers into digital, searchable, online files. The project extends Nogelmeier’s work as executive director of Awaiaulu, an educational organization that makes Hawaiian historical resources available to students and historians. ‘Ike Ku‘oko‘a, the Hawaiian Language Newspaper Initiative, received help from hundreds of Maui volunteers in 2012 who wordprocessed thousands of Hawaiian language newspaper articles to contribute to the nowlargest collection of native language literature in the western world, totaling 60,000 pages of Native Hawaiian knowledge, opinion, vital statistics, customs and historical fragments from monarchy to territory days. These files will all be uploaded into searchable public databases such as the Office of Hawaiian Affairs’ Papakilo Database.

The newspapers are artifacts from old Hawaii, spanning from the Hawaii Kingdom through the time of the overthrow to the territorial era up to and including World War II. Hawaii may have been sans-hotels in this time, but it also boasted a highly literate society. These newspapers fed the avid public; between 1834 and the late 1940s, there were more than 100 newspaper publications, which added up to approximately 125,000 pages of text in the native Hawaiian language. “Articles in these papers included data on fish prices and catches, traditional and introduced fishing practices, climatic conditions, storms and other significant weather events, marine ecosystem management and changing legal environments in Hawaii,” stated a UH press release on the project. “This newspaper archive has been virtually inaccessible due to their storage media (paper, microfilm and microfiche), the lack of any funding aids, and the paucity of Hawaiian-language scholars.” Now the Maui Native Hawaiian Chamber of Commerce is inviting everyone interested in Maui and Hawaiian history to join them for cocktails and networking at 5:30pm, followed

CULTURAL DIVERSITY The U.S. Congress may suffer dismal popularity ratings (less savory than head lice, according to one survey), but it’s saintly compared to India’s legislatures, which contain six accused rapists at the state level and two in the national parliament. Thirty-six local officials, as well, have been charged with sexual assault (according to India’s Association for Democratic Reforms). In fact, the association reported in December that 162 of the lower house of Parliament’s 552 members currently face criminal charges. The problem is compounded by India’s notoriously paralyzed justice system, which practically ensures that the charges will be unresolved for years, if not decades.

GOD AND SHOES “Prophet” Cindy Jacobs said in a January Internet broadcast that God has revealed Himself to her by mysteriously removing critical shortages in her life, such as her car’s well-worn tires that just kept rolling. “I remember one time that I had a pair of shoes that I wore and wore and wore and wore and wore and it just–for years, these shoes did not wear out.” And Dublin, Ireland inventor David Bonney recently decided to change the marketing of his new shoes to “Atheist Shoes.” Two years earlier, he had started the business with the idea of selling “Christian” shoes that contained water in the soles so that wearers could walk on water.

decided it would be a good time for a fullblown lockdown drill–with no advance warning. Though P.S. 79 is a high school and not an elementary school, it’s composed of about 300 students with special needs (autism, cerebral palsy, severe emotional disorders) who, with their teachers, were startled to hear the early- morning loudspeaker blaring, “Shooter (or, possibly, “intruder”), get out, get out, lockdown.” One adult said it took her about five minutes to realize that it was only a drill. Still, said another, “It was probably the worst feeling I ever had in my life.”

INTERESTING GUY In November, Tokyo’s Kenichi Ito, 29, bested his own Guinness World Record by a full second (down to 17.47 seconds) in the 100-meter dash–on all fours. Ito runs like a Patas monkey, which he has long admired, and which (along with his self-described monkey-like face) inspired him nine years ago to take up “four-legged” running. He reported trouble only once, when he went to the mountains to train and was shot at by a hunter who mistook him for a wild boar.

FETISHISTS ON PARADE William Michael Martin, 45, was charged in January with burglary of the East Texas Medical Center in Lufkin, Texas, where he went apparently in search of women’s underwear and employees’ personal photos, which police said he used as masturbation aids. n Thanksgiving, my husband was seized and interrogated at a resort just as he came out of the elevator. He was apparently not “looking” like he fit in. This was the second time he was judged there because of his looks! And we were paid guests both times! Do resorts think that Hawaiians can’t afford to be guests? SMALL TOWN LIFE Talking story about Wailuku’s future with MRA members Katherine Popenuk and Bill Mitchell By Anthony Pignataro

T

he Wailuku Redevelopment Area covers about 68 acres of Central Maui. Its approximate center is the Vineyard/ Market Street intersection. Like many small towns in America, the area’s narrow streets and cramped storefronts seem to be a relic of an older age. Its heyday took place in the final decade of Hawaii’s territorial history. Most people call it Wailuku Town, though that might change in the near future. As new shopping complexes and residential neighborhoods continue to pop

up in places like Kehalani and Maui Lani, and more nonprofit organizations providing services to poor and mentally ill people open in the old town core, more residents and merchants are pointing to homeless people and broken (or nonexistent) sidewalks and asking what’s happening to Wailuku Town. The island’s old center of shopping and living is increasingly home to smaller stores and pawn shops. The Maui Grand Hotel on Main Street, once the pinnacle of luxury accommodations on the island, is now a Chevron. Near the end of every month, the

Maui Redevelopment Agency–created by state law–meets to address this question. The five-member board attempts to do something exceedingly difficult–make life nicer in the town for those who live and work there, as well as visit. There are lots of projects swirling around the town right now–some moving towards completion, others in limbo. And though nothing particularly major has changed in Wailuku (with the exception of the First Friday Town Parties, which started organically), those small redevelopment changes that have occurred have varying degrees of popu-

larity. Most people seem to like the big, colorful mural at the corner of Main and Market Streets, but merchants are still complaining about the beautification efforts made to Market Street a few years ago that decreased the number of parking spaces in town. To get a handle on what’s happening now, and how it will all affect Wailuku Town, I recently sat down with Katherine Popenuk and Bill Mitchell, the chairperson and vice chairperson, respectively, of the MRA at the Maui Architectural Group office where they work, which overlooks the town.


MAUITIME: So why did both of you join the MRA board? KATHERINE POPENUK: I moved here in 1979. I’m an architect, and I wanted to do something to give back. We have the benefit of having some strong talents on the board–Bill is a landscape architect. BILL MITCHELL: I’ve been involved in Wailuku Town stuff for 15 years. Someone called me, said there was an opening and asked if I was interested. I said yes. MAUITIME: How does the MRA compare with other of the county boards and commissions? MITCHELL: It’s a little bit different function than the typical boards and commissions. We can also go out and do things within the MRA [Maui Redevelopment Area]. We can be a little proactive. MAUITIME: Why do redevelopment at all? Why not simply let market forces dictate the makeup of Wailuku? POPENUK: We’ve seen Wailuku come back, recede, come back again, and recede again. The last few years have been difficult. It’s a great local town–an authentic place. We’d like to see more activity, for local people as well as tourists. It’s more of a local place, though tourists are certainly welcome here. MITCHELL: It’s a niche market. We no longer have the Crest Store, Ooka’s. The Iao Theater has been renovated, but the big anchor tenants are no longer there. We’re left with boutique businesses that can function in smaller spaces. The way I see it, the Planning Department only has so much time to focus on any small town. We can focus on this town. We know there’s a parking issue, trash, pedestrian circulation issues. It’s primarily a daytime-use town. How can we make pedestrian circulation more safe and more pleasant? We don’t just review plans–a planner could do that. We look at the whole project, and how it fits into the MRA area. It’s a pretty common model in a lot of towns. Kona has one. They actually go out and do street improvements. Wailuku is a funky town, but it has all the history that goes with it. And it’s unique. But we have a fairly narrow window–we don’t go out and buy property and do redevelop them. POPENUK: It’s a unique place that’s worth preserving. We really don’t want Wailuku to turn into New York City. MITCHELL: Nobody has a grandiose vision of doing something beyond what’s there. But Wailuku has changed over the last 10 years. We have more social service organizations now, and the things that go with those. MAUITIME: What do you see as Wailuku’s greatest need? MITCHELL: If you talk to most merchants, it’s parking. The proposed Municipal Parking Garage is on the books, but there’s no will to fund it. And that may be a good thing. There is a parking management plan done by a consultant with a lot of great recommendations. So now we’re asking what can we implement to help the situation. We have underdeveloped parking in satellite lots [around town], issues with the timing of spaces in the municipal lot–the garage is on hold, as it’s been for the last 20 years. MAUITIME: The parking plan you speak of contains a lot of suggestions: metered parking, changing the time limit on some parking lot spaces from 12 hours to

six hours, things like that. What do people in town, both residents and merchants, feel about these suggestions? MITCHELL: We have not yet sent out a survey, that’s something we will do. Certainly on Market Street, we’re looking at shorter-term parking. We’ve talked about a mix of free and metered parking. Now what authority does the MRA have to implement these suggestions on its own? My understanding is that we have no authority. New fees have to go through the County Council. All of these things have to go through the Council process. We’re sort of the middleman. POPENUK: We are looking at all options we can think of to relieve stress on the parking situation. The repaving of Wells Street is coming up in the near future–how can we squeeze out an extra stall here or there? We’re trying to alleviate the parking shortage in every way we can. But parking’s not the only issue–we’re not a one-trick pony. Other issues are pedestrian safety, sidewalks, crosswalks, shade trees. We’re sharing ideas with other agencies and organizations. MAUITIME: What about other non-car

Anything to do with trees, benches, food vendors–people said they love that. People in general are interested in the whole package–not just parking. There’s certainly enhanced value in someone staying; they’re likely to spend more money. That’s like shopping center 101. All of these things bring value to merchants. POPENUK: Not just merchants. Residents, kids walking to school. We want to hear from the whole county and address those needs as much as possible. MAUITIME: One of the issues that seems to come up now and then is crime. Now there is a Maui Police Substation on Market Street, but it’s hardly ever used. Maui Police Lt. Wayne Ibarra told me that they need to replace the current windows with bulletproof glass and add air-conditioning. Is there any kind of timetable for this? POPENUK: That is a current topic we have. We recognize the importance of manning the police substation. We are willing to contribute a portion of our budget, but it’s expensive. We currently have one community police representative assigned to Wailuku. MITCHELL: Even if he’s not full-time,

solutions to Wailuku’s parking situation? MITCHELL: Absolutely. These were heavily discussed in the parking structure plan, so we’ll need to revisit it now. POPENUK: We’re planning to put in bike racks on Market Street. MAUITIME: Nice. When? MITCHELL: Good question. We’ll have to ask, but it should be soon. MAUITIME: About a year ago, ReWailuku–which brought a lot of citizens in and asked them what they wanted to see in town–started up. How has that affected you? POPENUK: We’re not sure what happens next with it, since it’s not an MRA thing, but it was extremely informative. A broad section of the town came out to say what they were interested in. They want more street trees–right now, the streets really discourage people to get out on foot. They want a grocery store. That was a well-supported issue. MITCHELL: It validated that people put value in amenities–shade, streetscapes.

if they move in and out of the space at night, that would be beneficial. POPENUK: There’s also the Clean and Safe Program that would help: making sure garbage cans aren’t overflowing; there’s not litter on the street; people not getting harassed at the ATM. We’re checking into it. MAUITIME: It sounds like a neighborhood watch. POPENUK: It could be an individual or a contracted service. MAUITIME: Next to the substation, there’s a lot people use for parking that’s supposed to become something that I think is called Iao Square. About two dozen cars fit in there now, and the plans are quite controversial. MITCHELL: It’s gone through a lot of names, and it’s called Iao Plaza now. It’s not currently a parking lot–it’s a vacant lot. Under the Parks Department plan, there would be no parking there. POPENUK: The controversy is that people are comparing it to what is there–

which is not up to code. The guidelines on parking aren’t being followed. The advantage of developing it is to make it safe. It’s going to be gravel or paved. MITCHELL: People have already fallen there. The plaza is just a small place. A place for people to hang out, have lunch. POPENUK: Keeping it the way it is is not an option. In the final option, there will be 24 stalls and a plaza. If you take out the plaza, you would just gain an additional stall. MAUITIME: Right now there are two or three dedicated spots in that lot for police. Will that be the case at Iao Plaza? MITCHELL: We assume so, but we’re not sure if they want parking in the lot or on the street. POPENUK: There will also be at least three in the upper plaza. MITCHELL: And four trees in the lower lot, to comply with county code. POPENUK: And Maui Nui Botanical Gardens, which takes care of the planters on Market Street, will be involved there, as well. There is a possibility of having food vendors there. The space will be available on First Fridays. It could also be used for overflow parking for theater-users. MITCHELL: I believe it will be the first redevelopment project that the MRA has actually built. POPENUK: I’m not sure about that. MAUITIME: That actually raises a good question. Looking back over the minutes for the meetings you’ve had over the last year, it sometimes seems that all you do is accept reports and commission studies. Do you ever feel that’s the case? POPENUK: It’s not all we do. I’ve been on the MRA for about five years, and a lot of my early meetings were taken up by looking at projects seeking our approval. We’d offer suggestions on zoning and so forth. Then everything sort of stopped [with the economic downturn in 2008]. Since then, it’s given us some time to study other things that in the past we didn’t get a chance to sink our teeth into. We get a modest budget from the county. Ideally, we might be more self-sustaining. Maybe implementing paid parking will recycle money into more parking in Wailuku Town. MITCHELL: And not into the General Fund. MAUITIME: Another thing that came out of ReWailuku was this notion of “rebranding” the town. Saedene Ota of MauiThing is handling that. Why is that necessary? POPENUK: We’re looking at creating a more unique, universal identity–icon, logo–that represents Wailuku Town. It’s not something that’s been done in the past. MITCHELL: We have bits and pieces [of a town identity], but it’s not cohesive. MAUITIME: How do you see Wailuku changing over the next few years? POPENUK: Gradually. We’re doing what we can, when we can. Safety, beautification–it’s an ongoing effort. MAUITIME: What advice would you give to new comedians? MARGARET CHO: Keep going, don’t be discouraged. It’s a discouraging business, but press on. MT: You have addressed racial, bullying and gay rights in a lot of your material. Over the years, do you think we have made progress in these areas? CHO: I hope so. It’s always existed. I think when kids are different, it scares people, and it makes them stand out, and then you get into problems. I think that it’s very hard to grow up in general, but if you are not the same as other people, it can be much harder. MT: You were bullied as a child. How has that experience affected your career?

Some of our other films have won Sundance, too.” The Lanai Cultural and Heritage Center will also show some films from its “Voices of Lanai” series, which was established in 2009 to create video oral histories of the island. The 20-minute short Chief, chosen as one of the must-see films of Sundance in 2008, weaves the story of a Samoan chief living as a taxi driver in Honolulu. The collection of films will be shown in screenings over two days in the Great Hall, Music Room and Library at the Lodge at Koele. Of course, the Lanai Film Festival is also a music festival, with several live music appearances around the island and a nose flute workshop. “Grammy winner Sonny Lim and Calvin Hou are in my Aunty Nona Beamer film,” says Martinez Burgmaier. “They will be performing live at the festival along with Paula Fuga and Kevin Brown.”

he theater in Lanai City has stood empty and unused for years, but that won’t stop visitors and residents from gathering around premier feature films this weekend at the free Lanai Film Festival, hosted at the Lodge at Koele. Filmmaker and event producer Ken Martinez Burgmaier will bring the independently produced festival back for its third year. Highlights include the premier showing of his film Aunty Nona Beamer–Malama Ko Aloha and live music from Paula Fuga, Kevin Brown and Sonny Lim. “We understand the importance of the arts and are privileged to be able to assist with bringing the festival back to the island for all to enjoy,” says Tom Roelens, the Four Seasons Lanai general manager. “We are honored to host the Lanai Film Festival with such revered filmmakers and artists presenting their works to the Lanai Community and resort guests.” The festival features many hard to find Polynesian films. The short Fish Bowl by Kiyo Hatta was shown briefly on Independent Lens, but Hatta–best known for her film Picture Bride–died abruptly right before the film’s premiere. Fijian Vilsoni Hereniko won the Hubert Bals Fund award (International Film Festival Rotterdam) to create his and Fiji’s first feature length film– The Land Has Eyes–which stars Fijians. Of particular local interest to Maui, there’s The First Glide, the first feature length film on stand up paddleboarding. Directed by Mike Waltze, it features Laird Hamilton, Dave Kalama and other Maui watermen at the sport. “Filmmakers Shawn Hiatt and Mike Waltze and myself will be on hand for introductions and Q & A for our films,” says Martinez Burgmaier. “It shows that we do have a film industry here and many of our films go on to big festivals and national broadcast TV. Deceptively Simple ‘Side Effects’ is one of Steven Soderbergh’s best films BY BARRY WURST II

ome movies sneak up on you and have ad campaigns that reveal little to nothing about their content. The deceptively simple poster and trailer for The Sixth Sense is a great example of under-selling and a rare case of the studio understanding that, when it comes to promoting a film like that, less is more. A similar approach is being made by Warner Brothers with Side Effects, the latest thriller from director Steven Soderbergh. Even with a cast that includes Jude Law and Channing Tatum, the film is getting an unheralded release and the promotional materials have been vague and mysterious. Hopefully, this will draw in curious audiences who don’t need trailers to summarize the entire plot, as most coming attractions previews tend to do. The less you know going into the theater about Side Effects, the better. All you need to know is that this is the year’s first great

thriller and not to be missed. Rooney Mara (the star of the American remake of The Girl with the Dragon Tattoo) plays a sweet but troubled young woman whose life has been plagued by a series of bad incidents including a miscarriage and the incarceration of her husband (played by Tatum in a small, supporting role). When her doctor (played by Law) prescribes her some new medication, the initially promising results come with some scary consequences. Here’s a movie that evokes Rosemary’s Baby in its first half, as Mara gives an unforgettable portrait of an isolated, lonely soul and her internal suffering; as in Dragon Tattoo, her decision to underplay (whereas lesser actresses would have gone over the top) demonstrates what an intelligent actress she is. This is a performance that is worthy of mention for awards consideration at year’s end. Law is superb, as is everyone else, in an impressive ensemble cast that includes Catherine Zeta-Jones (who’s terrific), Vinessa Shaw (the only actress to ever work with Stanley Kubrick and Rodney Dangerfield), Mamie Gummer, and Laila

Robins (fondly remembered as Steve Martin’s wife in Planes, Trains and Automobiles). Creepy! Soderbergh is a fascinating and wildly versatile filmmaker who easily ping pongs between making big, audience pleasing studio films and personal, challenging fare. Here, his one artsy touch is having a scene take place in French without subtitles. He also, as in his recent Contagion, shows the first and most crucially revealing scene in the story last. The surprises in store are big and shocking, as the screenplay rewards the patience of the audience after a creepy, unsettlingly quiet and slow first act. Once all is revealed and the truth is in full view, you’ll be glad you watched carefully. You won’t get any spoilers from me, though it’s difficult to discuss the film’s shortcomings, as they involve the narrative secrets. Without giving anything away, the full reveal of Zeta-Jones’ character involves a detail that feels

awfully familiar to movies made in the 1990s (you’ll see what I mean), and it felt like the biggest misstep here. Aside from his upcoming HBO movie about Liberace, Soderbergh claims this is his last movie. I seriously doubt it, as he’s too young and too bold a cinematic experimenter to turn his back on filmmaking for good. This is the man who gave us Sex, Lies and Videotape, the five-hour CHE, Out of Sight, the Danny Ocean trilogy, Traffic, a slew of small but brilliant art movies AND Magic Mike! His work has been so consistently good, richly creative and well received, it would make little sense for him to end his winning streak now... but if I’m wrong, he went out with one of his best films. ■ To share or save this article, type: mt.hy.pr/1634f
