Al Fukuyama is, by all accounts I’ve read, a great guy to have in the community. He’s a lifelong Hawaii resident, has what political candidates like to call “extensive private sector experience” and volunteers his time to organizations like Community Work Day and Big Brothers, Big Sisters. He’s just not a politician. He ran for the Maui County Council West Maui seat twice before, lost both times, then moved to Kahului to care for his aging mother and decided to run for termed-out Councilmember Joe Pontanilla’s seat. He has very little by way of campaign contributions and way too many bland, cliched assertions about what he’d do if elected (“My priority will always be making decisions for the betterment of Maui County’s long-term future,” he said in a November 2011 Maui Now story, as though other candidates openly call for Maui’s cataclysmic destruction).

And that would normally be the end of the story, except County Communications Director Rod Antone says the parking garage may come back as part of a new start-up incubator for the tech crowd that likes to windsurf and play on Maui. "We're hoping Wailuku will be a place where they can work," Antone told me. "We're trying to get federal money for an incubator/garage. We want this to be more than a parking garage."

JUSTICE FOR NA WAI ‘EHA STREAM FLOWS? This week’s cover story deals with the Hawaii Supreme Court from a generation ago, and the brave, often lonely fight for justice waged by the late Justice Edward Nakamura, so it was quite nice to read late last week that the current justices still seem committed to protecting those of us who don’t happen to run major agricultural conglomerates. Or at least, they were on Aug. 15 when they unanimously ruled that the state Commission on Water Resource Management hadn’t done a very good job of management back in 2010. The issue then, and now, dealt with how much water from the four Na Wai ‘Eha streams–‘Iao, Waiehu, Waihe‘e and Waikapu–goes to the sugar giants Wailuku Water Co. and Hawaiian Commercial & Sugar (HC&S) and how much goes to small families, taro farmers or just stays in the stream and flows all the way to the ocean. In 2010, the commission ruled that only a third of the stream water would be restored, which basically gave Wailuku Water and HC&S what they wanted and shanked the individuals and families whose reliance on that water predates the grand-scale cultivation of sugar in Hawaii. “The court found that the water commission’s June 2010 decision to restore little or none of the stream flows currently diverted by two private companies was lacking on every key point,” said an Aug. 16 press release from Isaac Mori-

NO PARKING IN WAILUKU? It’s been on, then off, then back on again and now it seems it’s off again, though it may come back on... again... sometime... maybe. It’s the proposed Wailuku Municipal Parking Structure, people, and though county planners were touting it as a done-deal barely a year ago, that project is now deader than former South Maui state Representative Joe Bertram’s political career. Seriously, they’ve been planning this thing for years, which was supposed to replace the current 210-space Wailuku Municipal Parking Lot with a 426-space parking garage. In fact, the county has already spent about $1.2 million of federal money on designs (of course, with the federal debt running at close to $16 trillion, $1.2 million is couch change). And now it’s no more. “There are no funds available for construction right now, and I don’t see in the foreseeable future that coming through,” Maui County Public Works Director David Goode (who used to be a land developer and Public Works Director under previous administrations) said in the Aug. 18 Maui News. For those of us who haven’t successfully incorporated public transportation into our lives, the parking lot is a sad fact of life. Originally built on land the County of Maui seized through eminent domain, the current Wailuku lot fills up every weekday before 8am with cars mostly belonging to county employees (MauiTime rents office space in a building that borders the parking lot). During most days, Maui Police Officer Keith Taguma rumbles through the lot on his new Harley-Davidson Motor Trike, chalking tires and writing tickets that impose greater fines than those incurred by parking more than two

hours on nearby streets. Seriously, think about that last paragraph a moment. A County of Maui police officer gives out an insane number of parking tickets every day to County of Maui employees who work for and with the people trying to develop a larger parking garage in Wailuku. And this has gone on, without interruption, for years. “[W]hoever has control over that lot has the moral obligation to do what’s best for the public’s interest,” then-Maui Redevelopment Agency (MRA) Vice Chairman Lloyd Poelman said six years ago, at a June 21, 2006 MRA hearing on–you guessed it!–proposals to develop the Wailuku lot into a parking garage. And I didn’t even mention the insanity of building a parking garage on the site of the only really accessible parking lot in town. Where the people who currently use the park were supposed to park during the year and a half of construction (assuming all goes well) was the biggest unanswered question at every

wake of Earthjustice, John Duey of Hui o Na Wai ‘Eha and Irene Bowie of Maui Tomorrow. “The court ruled the commission failed to give proper consideration to Native Hawaiians’ and the public’s rights to flowing streams. The court also ruled the commission needed to further pursue available alternatives to draining the streams such as using nonpotable wells and recycled wastewater and eliminating waste.” Of course, this is one of those process victories that merely sets up a new fight. Now, as the Aug. 19 Maui News reported, the commission will have to go back to come up with a new stream diversion plan, but it may not break in Earthjustice, et al’s favor. “The amount of water re-

turned to the streams could be higher or even lower, but either way, [new commission member Jonathan] Starr said that people with appurtenant water rights will have first dibs.” And that includes people with “traditional land practice claims dating back to the monarchy days.” When all this shakes out is impossible to say. Still, the court decision has plaintiffs nearly giddy with anticipation. “When I look at ‘Iao and Waikapu Streams, they’re bone-dry, nothing but skeletal remains,” said Rose Marie Ho‘oululahui Lindsey Duey of Hui o Na Wai ‘Eha in the Aug. 16 press release. “The supreme court’s decision restores my hope that the law stands for something, and that each of Na Wai ‘Eha’s four streams will flow like justice from mauka [mountain] to makai [ocean].” ■ anthony@mauitime.com + @apignataro To share or save this article, type: mt.hy.pr/1610n1

GOT CROWDFUNDING? Need some scratch for your community project? FundaGeek (FundaGeek.com) wants to be your source for crowd-sourcing funds on the Internet. Sites like Indie Go Go and Kickstarter are getting more familiar every day with successful crowdfunding of projects and creative products from idea to fruition linking clicks, credit cards and PayPal accounts. FundaGeek was launched with the same basic idea, but its goal is to help community ventures, research projects and inventions. “Unlike other crowd-funding sites that run projects on the ‘all or nothing’ concept (only receiving the pledges made if your goal amount is reached or exceeded by the end of your campaign period) we only apply that rule to ‘commercial’ projects,” says Cary Harwin, FundaGeek’s president and co-founder. “Projects that are ‘research’ or ‘community support’ receive all the pledges they acquire at

By 1995, Harwin co-founded his current software publishing company, Catalyst Development (catalyst.com) which he still runs. In 2010, he co-founded FundaGeek, LLC with Daniel D. When I discovered the concept of crowd-funding back in the summer of 2010, I was astounded. Public libraries, high schools, senior groups, historical societies and community organizations could all benefit. FIRST AMENDMENT BLUES A bar in Horry County, S.C., named the Suck Bang Blow filed a lawsuit in May challenging the county’s new ordinance prohibiting motorcyclists’ “burnouts� (engine-revving with back-tire-spinning, creating smoke–and enormous noise). The bar claims that burnouts are important expressions of its customers’ “manliness and macho� and as such are protected by the First Amendment. And Luigi Bellavite complained to reporters in Mountain View, Colo., in July that the theft of his “Vote Satan� yard sign ought to be prosecuted as a “hate crime� under state law as he is a member of the Church of Satan. Police called it an ordinary theft.

GOVERNMENT IN ACTION! Miniature golf is remarkably simple to play, requiring neither experience nor much exertion, and even toddlers can negotiate their own brand of fun on the course. But in March, a set of “accessible design� standards went into effect, under the Americans With Disabilities Act, governing such things as the “slope� of courses (maximum 1:4 rise on some holes), the maximum length of the blades if artificial turf is used, and the minimum area of the “tee-off� landing (48 inches by 60 inches, with a slope not steeper than 1:48).

CELEBRITY IMMIGRATION POLICY? The only unlimited-issue U.S. visa allowing fast-lane entrance for certain foreign workers is the O-1, available to those (e.g., scientists, technology engineers) who, in the opinion of the State Department, demonstrate “extraordinary ability.� Reuters reported in June that an O-1 recently went to British journalist Piers Morgan, whose extraordinariness seems limited to replacing Larry King on his CNN interview program, and another to Shera Bechard, Playboy’s Miss November 2010, whose other accomplishment seems to be the creation of an online photo-sharing experience called “Frisky Friday.�

FORGETFUL USA Today, quoting a Pentagon official, reported in July that, during the last decade, the Pentagon had paid “late fees� totaling $610 million for not returning leased shipping containers by the due dates. And a Government Accountability Office report in July revealed that the federal government’s vast properties include about 14,000 offices and buildings that are vacant (or nearly so), but which the government still pays to maintain (at about $190 million a year). A large building in Washington, D.C.,’s Georgetown -among the most valuable real estate in the city–has sat mostly unused for more than 10 years. Also, the Miami-Dade County,

POLICE BLOTTER New Mexico is an “open carry� state, with otherwise-law-abiding adults authorized to display loaded handguns in public. However, in the town of Vaughn (pop. 500, located mid-nowhere), perhaps the only ones not authorized to carry are the town’s two police officers. Chief Ernest Armijo had been convicted in 2011 of criminal nonsupport of a wife and two sons, and among the conditions of probation was the prohibition on gun possession. Deputy Brian Bernal has his own domestic issue: a conviction for family violence that bars him, under federal law, from carrying.

GOVERNMENT INACTION! Most people who call an FBI field office would be in serious trouble if they left an answering-machine message for a named agent, along with the caller’s name and telephone number, in a message consisting of at least 13 F-word epithets threatening to “break [the agent’s] [expletive deleted] neck.� But when Thomas Troy Bitter left the message at the San Diego field office, according to a July report in OC Weekly, the agency, after initially charging Bitter, quietly dropped the prosecution with no further repercussions. OC Weekly speculated that Bitter is a confidential informant whom the FBI was late in paying.

Talking Story with Tom Coffman, Author of I Respectfully Dissent, about former Supreme Court Justice Edward Nakamura’s often lonely but principled devotion to workers’ rights 10 AUGUST 23, 2012


N

ot long ago a local attorney told me that during Judge Richard Pollack’s recent swearing-in to the Hawaii Supreme Court, Pollack wore a robe that had earlier been worn by the late Justice Edward Nakamura. Not often spoken of today, Nakamura was a giant in Hawaii’s post-war labor and legal history. A powerful attorney and lobbyist for the International Longshore and Warehouse Union (ILWU) in Honolulu, Nakamura eventually found himself appointed to the Hawaii Supreme Court. He’s also the subject of a new biography from Tom Coffman, the former Honolulu Star-Bulletin reporter who’s written detailed and immensely readable history books like Nation Within, a sprawling 2009 work that thoroughly eviscerated the white missionaries–and their American military and political supporters–who toppled Queen Liliuokalani’s government in the 1890s. The new book, titled I Respectfully Dissent, discusses Nakamura’s stint in the 522nd Artillery Battalion (part of the famed 442nd Regimental Combat Team) during World War II, his time as a dedicated labor lawyer for the ILWU and his 10-year-term on the Hawaii Supreme Court in the 1970s and ‘80s, where he was known more for principled dissent than for majority opinions. Nakamura’s life was never easy. Being a young labor lawyer in 1950s Honolulu brought inevitable whispers of communist sympathy, but Coffman makes clear that Nakamura never strayed from working on behalf of working people or his own principles. While others from his law classes were racking up huge hourly rates, Nakamura was nearly as poorly paid as the laborers he represented–a product of his view that attorneys shouldn’t live better than their clients. It was often lonely, and Nakamura’s toughest fight came near the end of his life, when he worked hard to separate the Hawaii Supreme Court from its old ties to the powerful Bishop Estate, which he had long considered a terrible conflict of interest. Nakamura died in 1997 after a heart attack. He was 74. “His tenure on the Hawai‘i Supreme Court helped create a body of common law for a democratic, progressive, and liberal state on equal footing with the rest of the United States,” wrote Wailuku attorney Ben Lowenthal in an essay on Nakamura’s judicial philosophy that appears as the book’s concluding chapter. “His opinions have taught me to be sensitive to our state’s independent constitution and our relatively new common law.” On Aug. 17, I spoke to Coffman by phone: MAUITIME: Your most recent book was Nation Within, which I thought was very different than I Respectfully Dissent. Why write about Edward Nakamura? TOM COFFMAN: It was a commissioned biography, but my answer goes beyond that. I was a political reporter at the capitol during this whole period. I started in 1968 and found it very intensely interesting. I knew Nakamura–not well, but he had a great reputation, though it was very

understated. He fell equidistantly between [former Hawaii Governor] Jack Burns and [former ILWU leader] Jack Hall, the gigantic figures of that period. MT: What do you think was Nakamura’s legacy? TC: I was at a book launch event last night that was interesting. There were a lot of public interest lawyers and a lot of law school representation. There were a few jurists, like Judge Dan Foley. He’s still an inspirational figure for public interest law. MT: That’s interesting, because in the book you talk about how near the end of his life Nakamura was basically lamenting the fact that young lawyers weren’t going into labor law like he did. TC: I think that’s still the case. I see middle-aged public interest law people. I don’t see any young labor lawyers. It’s too much to hope for, but maybe the existence of this book will strengthen public interest law at law schools. Books don’t generally lead people to any specific action, but in this case, maybe it will. MT: What do you think was Nakamura’s greatest achievement? TC: The passage of the ILWU labor program in the late 1960s, early 1970s. He calmly kept his head and kept his eye on getting results. He worked his way through the back-biting and factionalism and finally saw it through. And in that, his biggest victory was prepaid health care. MT: Which is fascinating because it turned out to be a detriment to the union, since now everyone in the state–not just union members–had health care. TC: That did happen. It was not the way you’d think it would turn out. But I think it reflected great credit on the ILWU and on Nakamura.

TC: I knew a lot about Nakamura before I ever decided to take on this project. He had no big flaws. He had an upstanding personal life and was selfless in his work life. He was always focused, industrious. He did engage in a lot of drinking after the war–I wrote about that.

egotism. You know what covering a capitol is like–an environment of egos and posturing. Nakamura had absolutely none of that. He was purposeful, not manipulative in any way and not full of himself. I think he was a little bit enthused by the give and take of a given day. That was his indulgence. There’s a little passage in the book about how he had access to the press box at the capitol.

MT: Now you knew Nakamura when you were a reporter. Did you come across anything during your research that surprised you?

MT: Yes, I thought that was odd, having previously covered the state capitol in Sacramento. To have a lobbyist in the press box was very unusual.

TC: A lot of the things I learned. But I knew he had a tremendous impact on labor law. I knew he was a well-respected jurist. I was surprised that he was a such a force behind the “Broken Trust” movement–that he was behind the separation of the Supreme Court from the Bishop Estate trustees. I did know that he had been very upset about the employee retirement system. Jim Dooley had written about it. There were really interesting stories about his retirement, most of which I stumbled onto.

TC: It was unusual, but showed the ILWU’s extraordinary leverage at the capitol. There was an unwritten understanding that he had access to the box even though he was a lobbyist. But he played his part by sitting quietly and back and being very courtly and gentlemanly in his behavior.

MT: Did you find anything questionable or distasteful about Nakamura in your research?

MT: What was it like dealing with Nakamura, who was an ILWU lobbyist at the time, when you were a reporter? TC: He was very charming, very soft spoken. There was no posturing and no

MT: How do you think the Supreme Court has changed since Nakamura’s time on the bench? TC: I’m not enough of a court observer to really answer that. But I do think that the Supreme Court was somewhat healed and strengthened by separating itself from the Bishop Estate and that was part of his legacy. He was really obsessed

with achieving that. I went to the Supreme Court recently and was impressed with the justices. I think it’s doing better than some of our other institutions. MT: Well, thank you very much. That was pretty much what I want to ask you. TC: Let me ask you something. You said Nation Within and I Respectfully Dissent were different books. I think they’re very similar. Why do you think they’re different? MT: Well, mainly in terms of tone. Nation Within is a brutal takedown of those who seized power from the Hawaiian Kingdom, whereas your book on Nakamura is a positive story about someone in power who was doing good. Nation Within was about bad guys, and I Respectfully Dissent was about a good guy. TC: That’s interesting. You know, I’m working on a book now about the World War II home front. Were people back then collaborators with the martial law government or were they heroes? three-day culinary event called Ka‘anapali Fresh. For the first time, 11 hotels and condominiums as well as restaurants, chefs and an oceanfront shopping center will combine with local farms and farmers, non-profits, local beer and spirits producers and culinary enthusiasts in one world class event. On Friday, Aug. 31, the event kicks off with “Progressive Ka‘anapali,” a progressive dinner that will feature the Hyatt Regency Maui Resort and Spa, Hula Grill, Westin Maui Resort and Spa, Westin Ka‘anapali Ocean Resort Villas and Sheraton Maui Resort and Spa. Executive Chef Garret Fujieda of The Westin Maui Resort & Spa is co-chairing the event with Executive Chef Francois Milliet of The Westin Ka’anapali Ocean Resort Villas. “It’s a gathering of our community that showcases the partnerships we have with our local farmers and businesses,” Fujieda says. “When we talk about sustainability, this truly comes to life when you see the many hands that work together to bring it to life.” The philosophy is simple: island people love food, visitors love our island’s food, chefs love Maui agriculture and Ka‘anapali wants to showcase its amazing offerings. the Senior Skins Golf Tournament, the opportunity became available for us to present our dream culinary event. On Saturday, Sept. 1, farmers will represent their products at the Maui Farmers Market at the Whaler’s Village. Participants include Lynn DeCoite of L&R Ranch, Geoff Haines of Pacific Produce LLC, Bill Mertens of Anuhea Farm, Chauncy Monden of Kula Country Farms, Jamie Shishido of J. Shishido Farm, Darren Strand and Rudy Balala of Maui Gold Pineapple Company, Fernando Treje of Treje Farm, Sylvestre Tumbaga of Syl’s Produce, Cheryl Vasconcellos of Hana Fresh, and Heidi and Tommy Watanabe of Watanabe Vegetable Processing, LLC. Later that day, the farmers will appear again at the Ka‘anapali Food and Wine Festival at 6pm where they will be paired with Ka‘anapali chefs and their ingredients. “The goal for MCFB is to honor the farmers and chefs for the choices they make every day to grow and source local,” says Warren K. The Grand Finale of Ka‘anapali Fresh will be a Third Eye Blind concert at Royal Lahaina’s Beachside Lawn. There Maui Brewing Company will launch their Ka‘anapali Golden Ale paired with Chef Bernardo Salazar’s gourmet barbecue inspired gastropub dishes like fish tacos and BBQ pulled pork, sliders and flatbreads. Maui Brewing Co. is excited to be brewing one of their limited edition craft brews special for Ka‘anapali Fresh, and owner Garrett Marrero describes the ale as “a golden refreshing beer that is mildly sweet from the Belgian style yeast as well as the lilikoi and guava used in the brew.” Hula Grill Chef Christopher Schobel will present dishes at the progressive dinner, farmers market and the food and wine event. NO-KILL SHELTER CONFERENCE – 9th Life Hawaii is putting on Hawaii’a first No-Kill Conference this Saturday at the Kahili Golf Course. ate in The Expendables 2, soldier for hire Barney Smith (Sylvester Stallone) and his crew of anytime/anywhere warriors come across an armed adversary, who they simultaneously pulverize with bullets until he resembles Hamburger Helper. Smith admires his handiwork and quips, “rest in pieces!” If that sounds especially tasteless or off putting, this movie isn’t for you. On the other hand, I saw this with my wife and my Dad, and we were howling with laughter during this and many other scenes. Hilarious in ways both intentional and accidental, this bigger, far dumber sequel rarely takes itself seriously and, if you can look past the buckets of gore, is kind of charming. It plays like a violent western, filled with old but still capable gunslingers and lots of verbal jabs both self referential and at its own expense. Even with plenty of spectacular explosions and mayhem, the

biggest special effect remains the novelty of seeing this large group of action movie superstars working together. The characters all have silly names and possess as many corny one-liners as they do rounds of ammunition, but the “actors” (I use the word loosely for some of the cast members) are clearly having a blast and enjoying one another’s company. Stallone still has great chemistry with Jason Statham, and Dolph Lundgren is better used this time (out goes all the pathos, which is replaced with goofball jokes). Jet Li is on hand for an amazing battle involving kitchen utensils, then vanishes for the rest of the movie and Randy Coutre and especially Terry Crews (who’s proved elsewhere he’s especially gifted at comedy or drama) are underutilized. As with the last entry, seeing Bruce Willis and Arnold Schwarzenegger in the same movie next to Stallone offers a nostalgic and cinematically historic kick for action fans; while their roles aren’t exactly fleshed out, they both have a lot more to do this time around. As the recent additions to The Expendables, newcomers Liam Hemsworth (far better here than in The Hunger Games)

and Nan Yu, the lone female in the bunch, add considerable charisma and appeal. Having a blast I waited this long to mention the plot because it’s so unimportant: a despicable villain named Vilain, played by Jean-Claude Van Damme, is exploiting men, women and children in an effort to hollow out a mountain to realize his master plan. The story steals from both Three Amigos! and Indiana Jones and the Temple of Doom and, scene after scene, lacks logic of any kind (I’m still trying to figure out why Stallone crashes his plane for seemingly no good reason). However, no one who comes to see this will care about the story. The first movie peaked during the first hour, which never topped the gasp-inducing Schwarzenegger/Willis/ Stallone encounter and the awesome Stallone/Statham airplane ambush. The sequel is crammed with action and entertainment value from the start but really delivers the goods during the

extended climax; set in a tiny airport, it features both the former “Governator” and John McClane verbally roasting one another and a Stallone/Van Damme battle as earth shaking as the Batman/Bane matches from last month. Van Damme effectively nails his despicable character, a bad guy so vile, he almost never takes off his sunglasses. I’m not sure if I liked the sequel better than the first, as I missed Mickey Rourke (whose soulful monologue was one of the best things in the first movie). On the other hand, the follow-up does have Chuck Norris... an actor so awesome, I had to re-type his name three times, as my spell check auto-corrected him as Bearded God of Thunder. ■ To share or save this article, type: mt.hy.pr/1610f
