Out Of Business Were consignees left holding the bag when Bohemia Boutique in Wailuku closed?

R

ecently, a little consignment shop called Bohemia Boutique closed in Wailuku. This sort of thing happens all the time. But with Bohemia, there’s a slight wrinkle: a number of consignees are claiming that owner Carey Sutherland never mentioned to them she was closing the store. Their first notice of the closure came when they stopped by and found it mostly empty, with just a few piles of clothing littered around the premises and multiple signs on the window saying “Closing Sale” and “Blow-out Sale.” “Everyone has been ditched by Carey, as well as I,” said Phoenix Stone, one of the consignees. “There is now a ‘Leasing’ sign on that store, while items are still all strewn all over the place inside. She has not done anything to make this right for any of the consignees.” Consignees, understandably concerned about their items, apparently began calling Sutherland. Their potential losses ranged from a few hundred dollars to a few thousand. Those we spoke to said no one answered the store phone. Sutherland’s cell phone also quickly filled up with voicemails (when I called for this story it was still full). Those consignees who were able to contact Sutherland received mixed responses. “It was the consignees’ fault that the store had to close” was one reason she allegedly gave them. “Everyone will get back their items and what is owed to them” was another. When I finally tracked down Sutherland by texting her, she offered still more reasons. “I was locked out of the store for a few weeks,” she said. “My laptop was taken. Everyone will be taken care of,

probably in a week or two. I can understand the panic to a point, but it went a little too far. Everyone’s things should be packed up in a couple of weeks and they will be contacted.” As for not responding to consignees, Sutherland said she hasn’t been answering them because she was overwhelmed, but is working on clearing her voicemail. She added that her cell phone is still the best way to reach her. Doug McLeod, Bohemia’s landlord, wasn’t able to provide much insight into the situation. “She tells me she’s returning stuff to people,” he said. “I don’t know what she’s really doing, though.” All this was little solace to one consignee, who also requested anonymity. “Right now I’m off island, but, when I get back, I might take her to small claims court,” said the consignee. “Even then, I don’t know what will happen because she might just file for bankruptcy. And it says in the contract that the store will not be responsible for lost, stolen or damaged goods.” According to Sutherland, the main reason she couldn’t contact the consignees about her impending closure was that she was locked out of the store and couldn’t access her computer, which held all her contact information. Sutherland said her landlord would not give her keys, something McLeod denies. “I never did lock her out,” he said. “We threatened to change the locks, but we never did actually lock her out. I gave her another set of keys because she said she lost hers. I never took any keys away from Carey. I remember one day we left a key for her in an envelope. One day I met her and gave her an extra set of keys.” Luckily for some, when Sutherland was behind on her rent payments and close to being evicted, McLeod allowed a few consignees into the store, where they were able to retrieve a some of their items. But one consignee alleges that not all the consignment items were there. McLeod said he documented everything by taking photos and getting the contact information of anyone he let in to the store, to ensure they could be found at a later time. “There is a security system that monitors everything,” he said. “She has every ability to see what’s happening unless she deleted that information herself.” ■ To share or save this article, type: mt.hy.pr/1623n1

MEGA MALLS ‘DIFFERENT’ FROM LIGHT INDUSTRIAL PARKS Here’s some more fun with zoning. According to The Maui News, on Nov. 16, state Office of Planning official Rodney Funakoshi testified before the state Land Use Commission that Eclipse Development, which wants to build mega malls on land in Kihei originally designated as Light Industrial, should have gone to the LUC when it changed plans because those projects are “different.” This isn’t exactly a surprise, and is welcome news for those opposed to the massive retail malls, but The Maui News story did contain the following revelation that

does lend some sympathy to Eclipse. “[Developer attorney Jonathan] Steiner then asked Funakoshi what percentage of the project needed to be in light industrial to comply with the 1995 conditions,” The Maui News reported on Nov. 17. “Funakoshi replied that there was no exact proportion, to which Steiner asked: How is the landowner supposed to know if it is in compliance or not?” Neither the paper nor Funakoshi nor the LUC apparently provided an answer, which is also not surprising.

MY THANKS In honor of the holiday this week, I’d like to give thanks to a few individuals over on Oahu, where I spent last weekend for a much-needed vacation. First, thank you to the individuals at the Bernice

We’re reaching what will hopefully be the end of the Maui Island Plan approval process. The last Maui County Council utterly failed to pass the plan in their two years, so the fact that this council seems on the cusp of approving the sweeping document–which will outline the course of land development for Maui over the next generation–by Dec. 31 seems to be a laudable achievement in itself. Of course, this is the not the plan first drawn up by the General Plan Advisory Committee (GPAC) just a few years ago. That much was clear to me just by reading various news accounts and periodic email updates from activists during the County Council’s General Plan Committee from the last few months. But then I received a concise email from Dick Mayer, a longtime good-government activist and GPAC member. His take on just how far the plan has come is both informative and depressing: First, Mayer wrote that the plan’s “Implementation chapter” as well as the Appendix, which contained a list of necessary capital improvement projects, is no longer in the plan. According to Mayer, this means that “the plan has no financial component.” Secondly, Mayer said that “most of the maps at the end of each chapter have been reduced in importance by renaming them ‘diagrams.’” What’s more, Mayer wrote that the plan now includes language “stating that these maps have no force of law and are merely for ‘informational purposes.’” Third, the plan’s ‘Protection Areas’ [what should have been the strongest part of the plan] on the maps now include designations that Mayer says “aren’t enforceable by law.” This includes terms “Greenways,” “Green Belts,” “Parks,” “Preservation Areas” and “Sensitive Lands.” Lastly, and most depressingly, came this paragraph: “GPAC and the Maui Planning Commission worked hard to construct Urban and Rural Growth Boundaries that would provide more than enough area to accommodate all of the needed demand for housing units, but NOT so large that it would become very costly for the County and State to provide the needed infrastructure,” Mayer wrote. “Unfortunately, The General Plan Committee has not bothered to consider infrastructure costs and has greatly expanded those growth boundaries to satisfy the requests of a number of developers, none of whom provided any details on what they are planning to do within these expanded boundaries.” Mayer then included a few examples of development acreages above and beyond the original GPAC proposals: • 390 additional acres for Makena Resort’s luxury homes

• 200 acres above the Waikapu golf courses for luxury homes • 230 acres around the Ulupalakua Ranch headquarters • All the remaining open space between Wailuku and Waikapu • 330 acres around Haliimaile for Alexander & Baldwin and Maui Land & Pineapple Co. So yeah. The Maui County Council public hearing on all all this at 9am on Tues., Nov. 27. There had been talk about holding the hearing at night so working folks could attend, but like a lot of the Maui Island Plan, that turned out to be just talk.

Overheard “Is it the beer or is she getting cuter?”

Pauahi Bishop Museum, who showed much wisdom and courage when they decided to exhibit a particularly remarkable bowl in the Hawaiian Hall. The bowl, which is off in the corner of the second level, is made mostly of wood. I say mostly because bored into the bowl are about a dozen human molars. The bowl, the card at the exhibit says, was a spittoon or refuse container, used by someone who wished to “denigrate” the memory of a slain adversary. That, to put it mildly, is hardcore. It’s funny how pervasive the marketing of Hawaiian culture truly is: we see so many luaus and other examples of the generosity and compassion that it’s quite easy to forget that ancient Hawaiian warriors were susceptible to the same brutal impulses that govern soldiers around the world today. Okay, my second thanks is not so solemn. It goes out to the two workers over at Honolulu International Airport who made hanging out in the terminal so much fun. So much of flying commercially these days (really, over the last decade or so) has become a drudgery that it often hardly seems worth the effort. Tickets are expensive, and airlines are great at finding ways to charge travelers ridiculous fees for services once considered free. Security procedures seem both deadly serious and laughably arbitrary. Which is why it was such a joy to see these two workers on break, hanging out in the terminal with a dollar bill hooked to a length of fishing line. One would drop the bill casually in the middle of a high-traffic corridor, then sit down a few yards away and wait. When an unsuspecting traveler would walk by, see the bill and reach down to grab it, the worker would yank on the line. Immature? Probably. Unprofessional? Almost certainly. But sitting and watching those guys this weekend pull that bill away from people as they grabbed for it, I felt happy, and it’s been a long time since I’ve felt that inside an airport terminal. ■ anthony@mauitime.com + @apignataro

OAKLEY OPENS FIRST STORE AT WHALER’S VILLAGE Oakley’s first Maui store opened with much fanfare and crowds on Friday, Nov. 16 at Whaler’s Village in Ka’anapali. The Oakley brand is synonymous with sport sunglasses and performance. HULA O NA KEIKI RESULTS The 22nd annual Hula O Na Keiki hula competition held at the Ka‘anapali Beach Hotel concluded earlier this month with more than 15 participating keiki. The competition hosted talented children aged five to 17 who competed for nearly $14,000 in cash and prizes. The contestants were entered as soloists or palua (boy and girl pairs), and performed their traditional or personal interpretations of kahiko (ancient) and auana (modern) hula styles. They were judged on their style of chanting, interpretation of dance and cultural relevance to their costume and adornment. They also had to undergo an interview with judges who asked about costume selection, dance and Hawaiian language. “We’re thrilled to congratulate our 2012 Hula O Na Keiki winners and proud of all the children who took part in this year’s competition,” said Ka’anapali Beach Hotel GM Mike White, who is also a Maui County Councilman. “Hula O Na Keiki is an honored tradition that helps perpetuate and preserve different aspects of the Hawaiian culture that we love to share with our guests, community and family alike.” Here are the winners: Overall Wahine Award

(They meet at bars and restaurants, where management gives winners token gifts in exchange for the increased business.) A prosecutor told the Tampa Bay Times that Florida law defines illegal “gambling” as any game that permits players to win something–even if they don’t have to “ante up.” The raid (during which players were ordered to keep their hands where the officers could see them) came after a monthslong undercover investigation.

TIL DEATH CERTIFICATE DO YOU PART India’s notorious bureaucracy records deaths particularly ineptly, to the advantage of men seeking an alternative to divorce. They find it easier merely to swear out a death certificate on one wife so they can marry another, but that means the first wife will face years, and maybe decades, of campaigning to convince officials that she is not dead. BBC News chronicled the plight of Ms. Asharfi Devi, now 64, in September as she was finally declared “alive” after being deserted by her husband at age 23 and ruled dead at age 40. CAMPAIGN STOP Former U.S. Sen. Larry Craig of Idaho, who made the “wide stance” famous when he explained his alleged, notorious restroom encounter with another man in June 2007, has been sued by the Federal Election Commission because he used $217,000 in campaign donations to fund his legal defense to the resulting indecent exposure charges. Craig pointed out that visiting the restroom (irrespective of any alleged activities there) occurred during the ordinary course of Senate travel and thus that he was entitled to spend campaign funds.

UNDERWEAR BOMBER TACTICS EXPOSED Two FBI agents, providing a backstory to “underwear bomber” Umar Farouk Abdulmutallab’s Christmas-time 2009 attempt to bring down an airliner in Detroit, said they believe the man accustomed himself to the tricked-out scivvies beforehand by wearing them full-time for the three weeks leading up to his flight (except for bathing). nd here we are at another holiday season on Maui. Radio stations start playing Jawaiian versions of old Christmas standards, the beaches started filling up with evermore tourists and store owners start lining their shelves with Santa in beach shorts trinkets. Oh, and the island’s nonprofit organizations– which increasingly have to take up the slack left when government shrinks at all levels– find that, once again, it has to do a little more with a little less. Once upon a time, we all sat around the TV and watched that Charlie Brown Christmas Special where little Linus tells us to knock it off with all the commercial BS and start showing some damned charity for those who really need it. Seriously, now’s the time to get generous. As we’ve done in years past, we offer this wish list from a few dozen of the county’s nonprofit organizations. They all need money, sure, but many would like other things–stuff you might even have at home, gathering dust in the closet. So go through the list, and see what you can give. The American President Spielberg’s Lincoln should get your vote BY BARRY WURST II

A

t last, Steven Spielberg’s long-promised Abraham Lincoln biopic finally arrives. The long awaited matchup of two gigantic personas seemed impossible to live up to: the life of Lincoln, arguably the most famous and beloved of all American presidents, depicted by Spielberg, the most successful filmmaker of all time. The end result is mostly great, even spellbinding at times, but it’s also as overstuffed as it is missing key biographical ingredients. Lincoln puts us at the end of the President’s life, as we witness his struggle to get the 13th Amendment passed, in order for African-Americans to live in freedom following the end of the Civil War and into the Reconstruction period. Many historical points are touched upon, such as the Gettysburg Address, the Emancipation Proclamation, the surrender at Appomattox, the sad, grisly aftermath of the war and its wounded soldiers and the need for slavery to be abolished once and for all. One of the film’s considerable strengths is how fully it immerses the audience into this world, as the settings, clothing and manner of speech transports us fully into the 19th century. Yet, the film’s dense authenticity is also something of a drawback. The screenplay was written by Tony Kushner, the brilliant playwright of Angels in America and Munich, Spielberg’s last great film. The dialogue is full of quotable, stirring lines and tells the story adequately but doesn’t entirely engage. Most of this feels like a filmed stage play, as the dialogue dominates the action and over-explains the story (even Lincoln’s assassination is oddly kept off camera). There’s also the problem of how inaccessible this will be to those not immediately familiar with this period of history, as only one scene provides title

cards to explain who we’re looking at and why they’re important. In a film with a cast of characters this vast, more background can only help. Also, skipping Lincoln’s younger, log cabin years makes the film shorter but denies the audience a greater connection to the man. Most of the film takes place indoors and it isn’t until the last half, with the rush to pass the 13th Amendment, that it finally gathers momentum. Daniel Day Lewis’ performance as Lincoln is the film’s greatest, most towering success. This is neither an overly glamorized portrayal, nor a dark bit of revisionism. Playing him as a gentle, good humored, soft spoken and driven man of the people, Day Lewis creates a fascinating portrait that isn’t showy or demonstrative but still commands your attention every time he’s on screen. After a barely awake turn in last summer’s Men in Black 3, Tommy Lee Jones comes roaring back as abolitionist Thaddeus Stevens. It’s his best performance in years–ferocious, scene stealing and tremendously enjoyable. The massive supporting cast is mostly solid, though Joseph Gordon-Levitt is distractingly modern as Lincoln’s eldest son and Gloria Reuben, as a former slave who is at the center of many scenes, is playing more of a symbol than a fully developed character. Spielberg fills many scenes with vast spaces, dozens of extras and intriguing background details. But he relies too much on the “Spielbergian Glow,” his oft-criticized tendency to film characters bathed in a heavenly light. Longtime fans will recognize his directorial trademarks, like a scene of Lincoln and his youngest sitting on a rocking chair, silhouetted by sunlight, replicating the most famous image from The Color Purple. Daredevils rush the madly stampeding beasts and risk getting gored to retrieve tokens from a bull’s back or ears, or spear him. Although you tend to think of cows as peaceful, cud-chewing, non-threatening animals, seeing a black ton of horned muscle rushing at you may convince you otherwise. Of course, you’ve secretly known all that strength lurked beneath your docile surface. But it’s kind of a surprise to be reminded of it, after all this time. Since you’ll need some horns and might this week to get what you want done, brush off your temper and put it on, like a flashy red cape. GEMINI (MAY 21-JUNE 20) Stop flitting around, you damn pixie!
