CRAZY WEEK That was some fun we had last week. First the Boston Marathon got bombed, which killed three and wounded more than a hundred. Then a fertilizer plant exploded in the tiny town of West, Texas, killing dozens and wounding hundreds more. Then a massive manhunt in Boston for the suspected bombers ended Grand Theft Auto-style, resulting in more death and destruction but finally ending that city’s terror. These are awful, horrific stories, regardless of whether you live in West or Boston. In fact, online video streaming and social media can make the stories appear a lot closer and more vivid than they appear. Online, I was able to watch minutes-old video footage of the explosions, listen to live police scanner transmissions and watch–in real time– a mix of journalists, scared citizens, yahoos and outright racists tweeting their comments on all of the above. Look, I don’t know if “crowdsleuthing”–the attempt by online sites like Reddit to post all sorts of security camera footage online and let people at home sift through it, looking for clues–will play an active, vital role in solving crimes in the near future. I do know that, in the case of the Boston terrorist acts, it led to the names and faces of innocent people thrown about cyberspace furiously (mainstream media sources like the New York Post , CNN and the Associated Press also made major errors), in a terrifying example of what a frightened mob can do at the speed of light (on April 22, Reddit posted a public apology for its actions). Oh, and those who think the vastness of the Pacific Ocean protects serene
Maui from such insanity are kidding themselves. Ask those who wanted a few relaxing (or exasperating) rounds of golf at the Maui Country Club in Spreckelsville on Sunday. There, according to a dramatic, frontpage, April 22 Maui News story, angry golfers confronted some guy with a pellet gun who was allegedly shooting at them near the 8th hole. “[T]hey didn’t seek cover in a sand trap,” Maui News reporters Brian Perry and Chris Sugidono wrote in the story. “Infuriated and armed with golf clubs, they charged their assailant instead.” As of press time, the pellet gun guy–who wounded one of the golfers–hasn’t been identified, though Maui Police tased and arrested him. What’s more, the cops didn’t shoot pellet gun man multiple times with real bullets, even though the paper reported that the guy allegedly fired his pellet gun at one of the officers. Now that is totally crazy.
REMEMBRANCE And now I’d like to indulge in a purely personal moment. This Saturday marks the fourth annual 4 the Luv of Arts benefit in Lahaina (see Picks, page 19, for more info). As always, it’s held in honor of Gianna Mitchell, an artist, surfer and writer who died in a single-car crash in Makawao on Nov. 1, 2009. Gianna was a friend of mine. I met her in 2003, not long after I started working as MauiTime editor. Back then, the paper’s office was located at 505 Front Street, in Lahaina. One day, Gianna walked in and asked if she could write for us. I was still very new, and very green, but I needed writers and gave her a shot. She ended up writing
an arts & entertainment piece on the Rebirth Brass Band, which was then doing shows around the island. Her story ran in our Oct. 23, 2003 issue. According to our online archives and my memory, that was her only story for us. But we kept in touch, mostly to talk about her painting. Like most transplants to Maui (Gianna was born in Tallahassee, Florida in 1978), she was working service industry jobs when I met her. But art was always very important to her, and she began finding ways to make money painting the waves and seascapes that she loved so much. In 2007, when she took over the Breakwall Cafe in the 505 Front Street complex, converting it into a combination painting studio and cafe, I wrote a story about her which ran in our Feb. 22, 2007 issue. In that story, I asked her about encounters she had with strangers when painting: “That’s what I like about painting,” she told me. “Someone will see a painting and talk to you, say something they’d never say to you otherwise. It’s a very cool way to make a connection. I don’t know what it is that gets them to tell me what’s on their mind, but I like it. I get that a lot with the surfers. I painted under the Banyan Tree one time. Even though I was listening to music and had

headphones on, people were not shy about coming up and talking to me.” Gianna ended up not owning the cafe very long, but she stuck with painting, eventually securing wall space on at least a couple Front Street galleries. In fact, I even contemplated purchasing one of her surf images when I was preparing to move

to Northern California in the spring of 2009, but moving expenses ultimately kept me from buying anything. And that was the last time I had any contact with Gianna, until the fall I guess, when I was hanging out at a friend’s house in Roseville when I randomly decided to check The Maui News webpage to see what was new. That brought me to a story on how Gianna had died shortly after a Halloween night car crash. I say all this not because I’m trying to get people to attend the Lahaina arts benefit (though it would be nice) but to show that, for a brief moment, Gianna was able to make at least part of her living doing something she loved– something creative that brought enjoyment to those around her. ‘Nobody Wants To Lose’ Why the demise of marijuana bills is bad news for everyone in Hawaii PHOTO BY LAURIE AVOCADO - WIKIMEDIA

his Saturday marked a sad 4/20 for tokers and hemp fans across Hawaii. Well, sad probably isn’t the word (tears won’t be the reason eyes are red), but the recent failure of our state Legislature to pass meaningful cannabis law reform should be enough to dampen anyone’s vibe. Even in the wake of Colorado and Washington’s Nov. 6, 2012 legalization of recreational marijuana and despite widespread public support for the age old plant, the Hawaii Legislature has played it safe this session, passing on numerous rational bills that took shots at the failed, trillion dollar, decades-old federal “War on Drugs.” The first of the cannabis-related bills to meet its demise swung the widest. HB699, introduced by House Speaker and Maui boy Joe Souki, D-Wailuku, followed Colorado and Washington’s example in aiming to authorize the use
and possession of recreation marijuana for persons 21 and over, regulating it in a manner similar to alcohol. The proposed bill also allowed for licensing of facilities, an excise tax and safety testing. SB472 was similar to HB699. The bills fell short of calling for the full legalization of cannabis, but nonetheless would have decriminalized the possession of 20 grams or less of marijuana by an adult. So, instead of going through the legal system song and dance only to get hit with a criminal charge that would damage chances at finding employment, earning student loans and grants and keeping your kids, the bill would have allowed your average gram-sack holder who got caught to simply pay a civil fine of $100. Medicinal use of marijuana also made a push this session after 12 years of being in effect as a state program. HB667 hoped to draw from the experience of this program and make modifications that would “fulfill
its original intent by clarifying provisions and removing serious obstacles to patient access and physician participation.” Specifically, that bill would have allowed for transfers of plants between patients and caregivers, increased the amount of mature plants a person could own, transferred the program from the Department of Public Safety to the Department of Health and allowed visiting patients from other states to participate in Hawaii’s medical marijuana program. All the bills held early promise. HB699 elicited a widespread response from the public, with more than 500 pages of written testimony from lawyers, social service professionals, professors and reverends, among others. Support for the bill was overwhelming and came at the heels of a recent study showing that 57 percent of Hawaii residents favor legalized, taxed and regulated marijuana. The study also showed that 69 percent of residents thought jail time for marijuana offenses is inappropriate, and a review of the written testimonies (interesting reads, actually) show that less than 15 percent of individuals writing in opposed HB699. SB472 and HB667 even made it out of their originating house. But the stories of how each of the three bills died are nearly identical. First, the bill gained public support. Then, police departments and district attorneys weighed in, vilifying marijuana, spitting arguments dating back to the 1920s while praising the status quo. Then the bill went to the respective judiciary committee, where it fizzled out, mysteriously and without reason.
For instance, try to decipher the final status update of SB472, the decriminalization bill. According to the Hawaii Legislature webpage, the bill was finally “Recommitted to JUD with none voting no and Representative(s) Ito excused.” In other words, the bill is dead. Even worse, all the above bills died without getting a formal vote. Instead, unofficial caucuses showed that since the bills, legislators wouldn’t bother holding an official vote. Politically, it was much safer for them to do it that way. “Would it be useful for voters to know whether their representative voted yes or no?” House Judiciary Committee Chairman Karl Rhoads, asked me rhetorically. “Yes. [But] It’s risky… nobody wants to lose.” We attempted to contact each of Maui’s representatives at least three times via phone and email over the course of the last two months. The only legislator who responded to answer how he voted on the bills was Democratic Representative Angus McKelvey of District 10-West Maui, Ma’alaea and North Kihei-who supported all three measures. No one else responded. The final distressing fact? Hawaii has no voter initiative process. Earth Day marks a special day to give back to our home planet, and this year even companies are getting into the spirit. This April, the Fairmont Kea Lani sponsored and participated in a community reef clean-up as well as donated $1,000 to the Coral Reef Alliance. The community reef clean-up took place on April 7 through the efforts of more than 50 Maui residents and visitors, Trilogy Excursion crew volunteers, representatives from the Coral Reef Alliance and members of The Fairmont Kea Lani’s Green Team. The clean-up was part of Trilogy’s Blue’aina Program, which was launched in 2010 by company employees who decided to volunteer their time and catamarans to clean a different reef each month. On April 7, the chosen area was the ocean floor off Wailea Point. The group retrieved rubbish and harmful marine debris by free diving and using SCUBA and snorkel gear. “It’s incredible to see the positive impact on our ocean environment when like-minded organizations and businesses join forces with Maui’s community,” said Charles Head, General Manager of The Fairmont Kea Lani in a April 22 news release. “We’re proud to work alongside Trilogy Excursions and Coral Reef Alliance to clean one of the beautiful reefs that we’re lucky to have in the hotel’s ‘backyard.’” On the excursion, the Fairmont Kea Lani’s Green Team presented a $1,000 donation to the Coral Reef Alliance in support of the group’s coral reef protection and visitor education efforts. Hawaii Field Manager for Coral Reef Alliance, Liz Foote, said in the statement, “Both Fairmont Hawaii Resorts have been strong advocates for responsible tourism
DERRICK KAHALA WATSON FINALLY CONFIRMED After five months of being stuck in nomination filibuster limbo, Derrick Kahala Watson is finally going to be a judge in the District Court for the District of Hawaii. On April 18, the U.S. Senate finally confirmed him, 94 to zero. President Barack Obama first nominated Watson for the seat on Nov. 13, 2012. When nothing happened before the end of the congressional session, Obama renominated him on Jan. 3. Watson fills the seat of now-retired David Ezra and will be the only person of Hawaiian ancestry on the bench. While a failure to receive confirmation votes would seem to be a poor reflection of Watson, in fact the Harvard graduate’s nomination delay was more symptomatic of an obstructionist right-wing in the U.S. Senate. “This is a problem that needs to be resolved for the sake of our judicial system, for the sake of the carrying out of justice in our country in an expedited and deliberate manner,” White House Press Secretary Jay Carney said in a March 5 Politico story. That report also highlighted Carney’s figures, in which he claimed “42 percent
of Obama’s District Court nominees have waited longer than 100 days for a floor vote, compared to only 8 percent of former President George Bush’s nominees… 78 percent of Obama’s Circuit Court nominees waited longer than 100 days, compared to 15 percent of President Bush’s.” In any case, Watson received overwhelming bipartisan support. What’s more, the Senate Judiciary Committee unanimously approved him for the judgeship two months ago. “Like almost all of the other nominees pending on the Executive Calendar, these are the kind of mainstream and consensus nominees who should be confirmed quickly,” Vermont Democratic Senator and Senate President Pro Tem Patrick Leahy

wrote in an April 18 statement posted on his senate website. “For nearly four years vacancies have been at or above 80, putting an unnecessary strain on our Federal courts. Sequestration cuts have added to the pressure on our justice system.” Obama, in renewing the nominations, also commented on judicial appointment stalling. “I am re-nominating thirty-three highly qualified candidates for the federal bench, including many who could have and should have been confirmed before the Senate adjourned,” he said. “I urge the Senate to consider and confirm these nominees without delay, so all Americans can have equal and timely access to justice.” Watson’s confirmation comes after sustained pressure by the Obama Administration and was welcomed by Hawaii’s representatives. “Derrick Watson’s confirmation today recognizes his eminent qualifications to serve Hawaii and our nation from the federal bench,” US Senator Mazie Hirono, D-Hawaii, said in an April 18 Star-Advertiser story. “Beyond his legal acumen, he brings sorely needed diversity and cultural perspective to the federal bench as the sole Native Hawaiian currently serving.” Watson is a Hawaii native and graduate of Kamehameha Schools. Since 2007, he had worked as an assistant U.S. Attorney for the District of Hawaii. He will fill a vacancy almost a year old. COMPELLING EXPLANATIONS In March, Washington state Rep. Ed Orcutt, apparently upset that bicyclists use the state’s roads without paying the state gasoline tax for highway maintenance, proposed a 5 percent tax on bicycles that cost more than $500, pointing out that bicyclists impose environmental costs as well. Since carbon dioxide is a major greenhouse gas, he wrote one constituent (and reported in the Huffington Post in March), bike riders’ “increased heart rate and respiration” over car drivers creates additional pollution. (Days later, he apologized for the suggestion that bicyclists actually were worse for the environment than cars.)

Maui Environment Status Report
Earth Day may have passed, but Maui County Environmental Coordinator Rob Parsons is busier than ever.

ust because Earth Day has passed, that doesn’t mean we can all go back to our fast food meals, sports utility vehicles and 15 gadget chargers. Sure, Maui seems more enlightened than many places on matters like protection for endangered species and clean energy, but on others we can use considerable improvement. To get a read on the county’s environmental situation, I recently sat down with Maui County Environmental Coordinator (and former MauiTime columnist) Rob Parsons. MAUITIME: So how is the County of

Maui doing on environmental matters? ROB PARSONS: First of all, I’d say we’re recognized in the rest of the state as being a leader in environmental efforts, conservation efforts and funding devoted to these efforts. We have five of the state’s 11 watershed partnerships. East Maui was the first–it’s 20 years old now. We also have the only watershed restoration partnership. Art Medeiros founded that 10 years ago. If you look it up on Google Earth, the Auwahi Preserve is a green oasis in the otherwise desolate, dry side of the mountain. And we’re celebrating the 10th year of having the environmental coordinator
position that Mayor Alan Arakawa established in 2003. MT: How’s the job treating you? PARSONS: In my estimation, it makes sense to grow it beyond just one appointed position. It’s not a new idea–it was something the mayor was concerned with a long time ago. But I think I’m bumping my head on the ceiling in terms of what one person can accomplish, even with one student intern. This is an area where I think we’re not up to speed with other counties. MT: So what have you been working on recently?
PARSONS: I met with a guy from the University of Connecticut. They purchased a machine, made in Japan, that converts plastic into a usable fuel. I’ve heard of these things, but I never knew anyone who followed through and got one. Anyway, it’s about the third generation of this device, and the first in North America. It’s a small model, and he’s been to conferences talking about it. It’s an element to our whole recycling discussion. MT: How so? PARSONS: Well, there are things that will never make sense to recycle here.

turning up in more and more places. MT: Ok, let’s talk about something slightly less inflammatory–cane burning. PARSONS: That continues to be at top or near the top in terms of the number of complaints I get, whether it’s open field burning, fugitive dust or emissions from the Pu‘unene mill. It’s such a polarized debate that it’s left little room for reasonable debate on meaningful alternatives. It’s dealing with conflict on the playground-level. I think having a robust discussion, through a sustainable ag workshop or series of workshops, might begin to bridge the gap. MT: Ok. How about marine issues? Anything to report there? PARSONS: It’s not so much the county’s kuleana–our jurisdiction stops

Because recycling out here really means collecting them and shipping them out. MT: Such as? PARSONS: Glass, for one. Cost is too high. But metals pay off. Recycling electronics pay off, too. What we really need to sort it all out is a sustainability summit. I’ve heard that so many times from so many people. We’ve talked about eco-tourism, ag-tourism–I see that as a logical focus. MT: Ok. What else is going on at the moment? PARSONS: I also see that there are basic, moral collisions in dealing with things here. Particularly with invasive species. MT: Which ones in particular? PARSONS: Axis deer. We have brought in state money–$73,000, and we made up the shortfall of what we originally budgeted. There’s also been a Maui Axis Deer Working Group for two and a half years. We have a draft management plan, and we’re hiring a coordinator position. Eighteen have applied, and we interviewed the top six candidates. It’s up to RCUH (Research Corporation of the University of Hawaii) to do the hiring. The Office of Economic Development also issued a grant for $37,500 to the Maui Axis Deer Working Group. Ultimately, they’re looking to establish whether it’s viable to set up a venison industry–to control such numbers so they can get USDA certification. It costs to get USDA inspectors, both in the field and in the slaughterhouse. We’d be taking an invasive species and turning it into an opportunity, a business opportunity, to address food here. MT: Sounds controversial. PARSONS: It is. But the Axis Deer Working Group had a helicopter pilot talk to us last fall. He said the number of goats on the backside, out by Kaupo, is in the neighborhood of 15,000–they’re just everywhere. From the helicopter, he said, they looked like fleas on a dog’s back. And that’s not even on our radar. MT: How do we deal with those kinds of numbers? PARSONS: Fencing is part of it, aerial hunting maybe. We definitely steered away from that in dealing with axis deer. The harvesting co-op has taken down about 200 deer so far, and they report that every doe they’ve found is pregnant. MT: Killing deer as part of environmental management... PARSONS: I like what Teya Penniman of the Maui Invasive Species Committee said: “Nature out of place, out of balance.” We’re trying to restore balance. MT: Where else are you trying to “restore balance?” PARSONS: Feral cats. There are probably 300 feral cat colonies here. Unless there’s a robust program to trap, spay and neuter, we’ll continue to see them grow and grow, at the expense of our bird population–our endangered bird population. Even feral chickens are kind of out of control. Some people don’t want to see any of them killed. But chickens are

at the shoreline–but that hasn’t stopped us from doing what’s important. We’re talking about things like aquarium fish collectors. We added oversight to our permitting and regulation process. For the first time, what you pay for a permit is commensurate with what it costs the county to issue licenses. It costs something like $650 if you want to be an aquarium fish collector. There might be some outlaws, but we’ve greatly discouraged that from happening. MT: How about fishing in general? PARSONS: About a year and a half ago, fishermen came to us talking about parrotfish. They said there were three fishing operations going out with scuba and spears, going after parrotfish. You can go into markets and
see coolers full of them. And they’re all head shots, shot at night. They’re also delicious–it’s kind of a bummer in natural selection. MT: They’re an endangered species. What can be done? PARSONS: There are restraints, but no one is checking. The state [Department of Land and Natural Resources] doesn’t have the staff to go to markets, check for size, licenses, etc. And once again, the cost of a license should be commensurate with the cost to the department to issue it. They could also say parrotfish are not for commercial sale. Parrotfish are the cornerstone of the coral reef ecosystem. But many snorkelers are saying they don’t see them anymore. MT: With the state DLNR overwhelmed, what can the county reasonably do about issues like that? PARSONS: Some of our Palau exchange partners are coming to Maui in June. We went there in February of last year. The president of Palau is one of those coming. He’s a strong conservationist. The Nature Conservancy is doing amazing things on coral reef protection in Micronesia. In Palau, they’ve managed to protect something like 50 percent of their ocean resources, as opposed to the two to three percent that are protected in the main Hawaiian waters. MT: How were they able to accomplish that? PARSONS: Palau is a sovereign nation of 21,000 people. They get 2,000 to 3,000 visitors a week, something like that. And they have a “green tax.” When you leave the country, you pay I think $35, which goes toward conservation efforts. In the past it’s been as high as $50. Then there’s “Jellyfish Island.” For over 10,000 years, jellyfish there have evolved and lost their sting, since there are no natural predators. But if you want to go to the Rock Islands, then there’s a user fee. There are also caps on the number of people who get a permit in any protected reef. Now we have things like that here–Molokini, for instance–but there are still something like 30 boats a day visiting there. It’s arguable that we’ve allowed too much already because there are so many stresses on our near-shore waters and coral reefs. MT: What are your feelings concerning the future? PARSONS: I’ve seen real successes with our environmental partners but I’m really concerned that the vast majority of those who live and visit here don’t realize how urgent this is. In 2007, David Suzuki spoke at the MACC. With the population increasing the way it is, he said, it’s like an experiment in a petri dish. The population will continue to expand until it toxifies its environment. I can look around and see a lot of successes. But the challenges are immense. ur planet has a lot going down right now, but I’m sure she is taking heart in all the celebrations around the world going on right now in her honor. Here on Maui, the 16th annual Earth Day Festival takes place this Sunday, April 28 at the Keopuolani Park Amphitheater, located behind the Maui Nui Botanical Gardens. There will be dual stage action and live entertainment all day as well as community forums, healthy food vendors and all the environmental and social awareness you can get for just a $7 admission price (kids get in free). The entertainment lineup includes Makana, Dr. Nat & Rio Ritmo, the Haiku Hillbillys, Poni Brendan, the Goddess Nectar Musicians, Spirit Tribe, Sacred Earth Bellydance and many more. They'll perform from 10am through 6pm. There will also be 21 food stands to satisfy your Earth Day hunger pangs. Look for Flatbread, Star Anise Indian Cuisine, Maui Coconut Kefir, Badua Creperie, Wow Wow Waffle and Aloha Bars Maui along with a fresh Farmers Market. Keiki get pony rides and friendly animals at the petting zoo along with favorites like Da Local Banana and other sweet frozen treats.
“The festival is held in gratitude for the beauty of our islands,” says event organizer Bruce Douglas. “It promotes a focused and informed ecological movement, to protect, sustain and nurture these precious ecosystems that our future depends on.” Community forum panel discussions start at noon and should fuel lively discussions on island issues. The schedule starts with smart meters, then goes to cane burning, ag industry sustainability, genetically modified foods and then ends with chemtrails and geo-engineering. What’s more, a few dozen local organizations will offer info on plenty of earth and Maui ecological matters. Other vendors will have jewelry, tees, art, massage, yoga gear, garments and gifts for sale. Douglas says the festival aims to bring the community closer with discussion on environmental issues that are important to Maui, but hopes the event proves to be a lot of fun for the whole family, too. ‘Pain & Gain’ Michael Bay turns real crime story into mediocre action comedy BY BARRY WURST II

ichael Bay’s first movie, Bad Boys, opened worldwide in 1995, introducing audiences to his style of flashily frenetic editing and deafening explosions, matched with awesomely moronic storytelling and dialogue. His brand of making louder, thrilling and infinitely stupid action movies was marked from the beginning. Meanwhile, at around the same time, a horrific crime was unfolding in Miami (the eventual setting of Bay’s Bad Boys II): three bodybuilders kidnapped and tortured a client from their gym, taking over his estate and bank account, and bullying their victim from turning them in. The efforts of a private investigator and the excessive, self-destructive actions of the “Sun Gym Gang,” who left a trail of bodies behind them, lead to their capture. Now, Bay is returning to the 90s with Pain & Gain, a black comedy depicting the crimes with, if we’re to believe the movie, a great deal of accuracy (based, apparently, on a three-part series that ran in Miami New Times in 1999). This true life story becomes so grotesque at times that, at one point, a subtitle admirably flashes across the screen that reads “THIS IS STILL A TRUE STORY.” Mark Wahlberg stars as Daniel Lugo, an under-talented but ultra-buff gym rat whose love for crime movies and desire to get ahead lead him to plan the abduction of one of his wealthiest clients. He turns to an imposing but emotional, vulnerable ex-con (Dwayne Johnson, never better) and a gym colleague (Anthony Mackie, reliably great) to assist him. The three have muscular super strength but little intelligence, as their plan goes south in wild and wildly disgusting ways. Bay does away with the strobe-like

editing for the most part and, for the first time since The Island (his best movie), lets the story and characters draw you in long before the carnage takes over. The early scenes and the initial attempts at the heist are so engaging, I thought Bay had pulled it off. Unfortunately, like most of his films, it’s overlong and stuffed with scenes so cartoonish and dumb in offensive, cringe-inducing ways, he pummels a morbidly fascinating crime story. The first sign the film is heading in a bad direction is a seminar that Luco attends, held by a sleazy, implausible self-help guru, played overboard by Ken Jeong; for a movie that insists what you’re seeing actually happened, it plays as falsely and over the top as any scene from Transformers. As a depiction of an especially horrific crime, Bay shows zero sensitivity or restraint, though, come to think of it, those are two words I have NEVER associated with Michael Bay. Littering his macho male fantasy movies with corpses is one thing but here, he turns a shocking caper with real victims into a crass music video that doesn’t know how or when to end. Bay also shows more contempt for overweight people than the characters ever do. In the film’s defense, it’s mostly entertaining, until the second hour, when I felt like Bay was trying to bludgeon me. Wahlberg and Johnson are excellent, giving even their most absurd scenes a conviction that is layered and even touching. Yet, as their plans unravel and their actions become truly monstrous, I grew tired of watching them, let alone root for them as “anti-heroes.” Some will view this as a comeback for Bay and they should. After three gigantic, idiotically offensive (but ludicrously popular) Transformers movies, even a mediocre movie would be a giant step up for him. Pain & Gain is better than that and I was impressed by Wahlberg and especially Johnson’s ability with pitch-black comedy. Unfortunately, the movie painfully pulls a muscle, even as its stars never do. ■
