DAVID CAIN BLASTS DEFERRAL AGREEMENTS Back in our Jan. 17, 2013 issue, we ran a cover story on “deferral agreements”– deals the County of Maui used to strike with those who wanted to divide up their land into three lots or less. The landowners could pay for sidewalk, pavement, curb and/or gutter improvements right then or defer the payment. How many of these agreements exist, and the amount of money owed to the county are huge unknowns, which is what spurred our cover story. What helped us was that West Maui resident Chris Salem, who has spent a dozen years researching the issue (largely because he says he’s in danger of losing his home due to problems associated with these agreements), have us an inch-thick stack of documents detailing just about everything we ever wanted to know about deferral agreements. Turns out Salen has also retained attorney David Cain of the Wailuku firm Cain & Herren in a bankruptcy case. At the Aug. 2 Maui County Council hearing,

councilmembers took up County Communication 13-238, which consisted of an extraordinary letter from Cain to the council calling for a full investigation into deferral agreements. “Over the last decade, vast amounts of public funds have been unnecessarily spent defending illegitimate decisions by County Directors,” Cain wrote in his June 25 letter to the Council. “The loss of public funds could have been avoided.” According to Cain’s letter, “the immense personal expense of exposing the exploited loopholes in the Maui County code, conflicting relationships between the County administration, Corporation Counsel, and private interests, has my client’s family on the verge of losing everything they have worked for, including their home through foreclosure.” Cain added that “While the public interest has been served by my clients’ unveiling of the previously unaccounted for developer financial obligations, the unnecessary damages my client has suffered are unacceptable. My client and my firm do not seek recourse against the County of Maui to cause further harm to the people of Maui County. The recovery must occur from the parties responsible.” Cain’s letter went on to detail much of the same deferral agreement history Salem relayed to this paper. It pulls no punches. “For decades Corporation Counsel has prevented the Council from performing their duties established under the Maui County Charter,” Cain wrote. “By conceal-

We still care about things like “civil rights,” right? Do all of us still hold notions of personal privacy and government accountability dear? When we watch or read the news, does our nation still really, honestly, believe that power corrupts and, except in rare instances, secrecy does little more than hide criminal acts? I’m just not feeling it anymore. Lately, we seem to be just going through the motions on the whole issue of government overreach in the arena of “national security” because we think that’s what everyone expects of “Americans.” In fact, I think the majority of us are really just scared of the world (especially the poor parts) and deep down would do everything we can and put our boots down on however many throats it takes to make sure that we can get the iThing and gas up our crossovers every Saturday. I thought about all this over the weekend after Hawaii Senator Brian Schatz’s office emailed over a note saying he was signing on as a cosponsor to something called the FISA Court Reform Act of 2013. The bill, which already has 14 sponsors (all Democrats) seeks to reign in some (but not all) of the excesses in the current secret “court” that approves (it never denies) the federal government’s surveillance requests. “The right to privacy is one of our country’s most valued democratic rights, and I am committed to making sure government does not encroach on that right,” said Senator Brian Schatz, D–Hawaii, in an Aug. 1 press release. “I opposed reauthorization of the Foreign Intelligence Surveillance Act because it failed to provide transparency, accountability, and reasonable limits on surveillance. With this bill, we will begin to make this process more transparent, and have the opportunity to reinvigorate trust and confidence in our country’s respect for privacy and civil liberties.” Schatz is right, but given recent events, it’s clear that FISA is just one portion of the massive national security state that we’ve allowed to create in this country. Though journalists
are pleased that the government didn’t find U.S. Army Private Bradley Manning guilty of “aiding the enemy” after he gave a boatload of secret documents to Wikileaks, the young man who just wanted Americans to know what their government was doing with their tax dollars in places like Iraq is still facing more than a century of imprisonment. And by now, everyone on the planet with access to a TV and/ or Twitter has heard of Edward Snowden, who traded his cushy post as a National Security Agency contractor here in Hawaii for Russia after making public PRISM, a government surveillance super-program that shows safeguards like FISA do virtually nothing to protect normal citizens from surveillance. Though Russia has a brutal reputation for dealing harshly with its own whistleblowers, Snowden probably thought life there would be preferable to that spent in an American solitary confinement prison cell. Can we even have America these days without massive government secrecy and espionage on, well, everyone? This is, after all, a nation that without discussion or any sense of irony decided long ago that contract law trumps the Constitution’s guaranteed protection of the Freedom of Speech. Seriously, there is no surprise that the NSA is as large or as powerful as it is–this is the land of Non-Disclosure Agreements (NDAs), where the term “public document” is a bitter joke. “No one thinks about non-disclosure contracts as a NatSec State weapon because they aren’t as sci-fi sexy/scary as the cutting-edge technologies used to spy on people,” Mark Ames wrote in the superb essay “Nondisclosure Nation,” which ran in the July 2013 issue of NSFWCORP and details the sad history of American courts using NDAs to squeeze whistleblowers who tried to leak secret information about crimes and corruption carried out by the U.S. Government. “Non-disclosures don’t have that techno-dys-

ing developer contractual agreements and conflicting private developer client relationships, Corporation Counsel is responsible for the ongoing frustration of legitimate functions of the Maui County Council.” At the County Council Hearing on Aug. 2, members voted to defer the matter over the Policy and Intergovernmental Affairs Committee, which Riki Hokama chairs (Hokama also originally placed Cain’s letter on the County Council agenda). Ranked 37th, she earned the title “Sunny Side.” The feature is meant to be fun, said Hugo Gurdon, The Hill‘s editor in chief, in a July 31 news release: “For the last ten years, we’ve enjoyed letting our hair down in showcasing people who, some high-profile, some not so, most importantly have great personal stories to tell. We’re extraordinarily proud to mark a decade of what’s become a mainstay for DC and political enthusiasts, and look forward to ten more years.” Most of the write-up on Gabbard focused on her relative youth and Hawaii National Guard service, but a portion also dealt with her love for Hawaii: “Gabbard was born in Leloaloa, American Samoa, but moved to Hawaii when she was

Island Hospice recently received approval to begin operations on Maui. As one of Hawaii’s largest nonprofit providers of hospice care and with a growing location on Oahu, Island Hospice says it's ready to provide Maui with compassionate and capable end-of-life care. With a mission of providing their patients with the highest quality care, Island Hospice seeks to serve the “physical, emotional and spiritual needs of their terminally-ill patients,” states at July 31 press release from the company. “We realize the immediate need to care for those who cannot have care otherwise, whether due to family or financial resources,” said Dr. Michael Duick, CEO of Island Hospice, in that news release. “That is why we are determined to open a beautiful hospice home in central Maui as quickly as possible. The addition of an inpatient hospice unit will without doubt improve health care on Maui.” Hiring for hospice staff will begin in the fall, with job fairs starting soon. Another firm, Hospice Maui, has operated here for the last 30 years. -Rebecca Nakashima
has been awarded two grants through the Hawaii Community Foundation FLEX grants program to support their involvement with the local youth. As a free service, this nonprofit relies on grants, donations and fundraisers to continue the work they’re doing in the community. So the $25,000 they received from the Omidyar Ohana Fund and the $5,000 from the Rev. Takie Okumura Family Fund will help them achieve this. Started 20 years ago by a group of Northshore boys and girls, the Paia Youth and Cultural Center at Paia Bay now enjoy a membership of over 500 youths. Offering a fun recreation center, as well as the StoneWave Skate Park and programs such as a youth-run radio station and the agricultural Malama Pono Project Venture, they seek to provide a safe place for boys and girls to build community through these social, educational and vocational activities. -Rebecca Nakashima
the purchase agreement, the other partners do not have the authority to complete the sale. It also alleges that the $35 million transaction is priced below market value. Hana Ranch went on sale in September 2008 with a price tag of $65 million that was later lowered to $55 million. After some communication, it was announced in August 2012 that an agreement had been made between the two companies for Bio-Logical Capital to acquire the property from Hana Ranch Partners. Since then, the property was undergoing a due diligence investigation period pending the sale. Bio-Logical Capital does business as a sort of master developer of ecosystems and believes that large-scale conservation and resource protection can create money. They purchase large properties that have been damaged by deforestation or the like and explore the sustainable capabilities they offer. When the sale was green-lighted last year, Bio-Logical Capital had plans to preserve the Hana Ranch property as a working cattle ranch while expanding its

operations to include organic farming. BioLogical Capital senior vice president and director for Hawaii Guy Kaulukukui was reportedly hopeful for what they would accomplish there. “It is at once a privilege and a great responsibility,” said Kaulukukui in an Aug. 15, 2012 Pacific Business News article. “Hana is one of the last, best places in Hawaii untouched by urbanization, rich in abundant natural and cultural resources, and with the potential to become a model for sustainable ranching and farming practices in the state.” Now, Bio-Logical Capital’s dream of becoming the fourth Hana Ranch owner in the past 30 years looks bleak as they wait it out while the litigation takes its course among the Hana Ranch Partners. -Rebecca Nakashima

GOVERNMENT IN ACTION The National Security Agency is a “supercomputing powerhouse,” wrote ProPublica. org in July, with “machines so powerful their speed is measured in thousands of trillions of operations per second”–but apparently it has no ability to bulk-search its own employees’ official emails. Thus, ProPublica’s Freedom of Information Act demand for a seemingly simple all-hands search was turned down in July with the NSA informing ProPublica that the best it could do would be to go one-by-one through the emails of each of the agency’s 30,000 employees–which would be prohibitively expensive. ProPublica reported that companywide searches are “common” for large corporations, which must respond to judicial subpoenas and provide information for their own internal investigations.
BRAINY TWEET To commemorate its 500th “deep brain stimulation” surgery in May, UCLA Medical Center live-Tweeted its operation on musician Brad Carter, 39, during which he was required to strum his guitar and sing so that surgeons would know where in his brain to plant the electrical stimulator that would relieve his Parkinson’s disease symptoms. Carter had developed hand tremors in 2006, but the stimulator, once it is properly programmed and the surgery healed, is expected to reduce his symptoms, restore some guitar-playing ability, and reduce his medication need. And, yes, patients normally remain conscious during the surgery.

Firefighters are often called on to extricate adventurous men from sex toys, but one “armor-plat[ed]” device, six inches in diameter, into which the 51-year-old German entrapped himself in July in Ibiza, Mallorca, was especially challenging, according to the Diario de Mallorca newspaper, and took two hours and a dose of anesthesia toward the end. The saw blade the emergency workers used wore out during the rescue and had to be replaced, along with two sets of batteries. The man was kept overnight at Can Misses hospital, but was otherwise OK.
STILL UNCLEAR ON THE CONCEPT Briar MacLean, 13, of Calgary, Alberta, was reprimanded by school officials in May (and then also lost an appeal) after he stepped between two students because one, holding a knife, was bullying the other. The vice principal appeared to regard Briar’s action as equal to that of the bully, telling Briar’s mother later that the school does not “condone heroics,” and that it was “beside the point” that Briar might well have prevented a slashing (which could have occurred if he had left the boys behind to go find a teacher).
FIRST WORLD CRISES It’s not quite to the level of the $15,700 Japanese melons, but the behavior of women descending upon New York City stores in June for the annual “sale” on designer shoes is nonetheless a spectacle. The event makes the city’s upscale commercial district look like “an insane asylum of very well-dressed women,” reported The New York Times. The shoes’ everyday prices require, wrote the Times, “the willful suspension of rational thinking.” The average transaction at Barneys is $850, still far below, for example, a pair of wicker-basket-like sandals ($1,995 by Charlotte Olympia) or a certain Christian Louboutin pump ($1,595–$4,645 if in crocodile). Prices are so unhinged, according to the Times, that standards from the iconic Sex and the City designer Manolo Blahnik are now low-price leaders, holding at about $595.
CLASSIC! Among the oldest classic stories in News of the Weird is the hapless burglar or bank robber who inadvertently incriminates himself at the scene of the crime. Recently, (1) Korey Harris, a defensive lineman for West Virginia University’s football team, was arrested in July for a home invasion he allegedly committed while wearing his practice sweatpants emblazoned with his jersey number (96). And police in Boston are confident that Zachary Tentoni is the man who robbed a woman in the yard of Harbor Middle School in June because, as he grabbed her purse and fled, he dropped two bags he was carrying. Among the contents: Tentoni’s birth certificate and a letter from his mother.
ZERO-TOLERANCE ALIVE AND WELL Second-grader Josh Welch’s two-day suspension in March was upheld on appeal in June by Park Elementary School officials of Anne Arundel County, Md., even though his offense was that he had nibbled a pastry into the shape of a gun, which he then waved around. Said Josh’s attorney: “If this (school system) can’t educate a 7-year-old without putting him out of school, how are they going to deal with 17-year-olds?”
UPDATE! It took a year and a half of legal wrangling over a technicality, but Marshall University was finally dropped in June as one of the defendants in Louis Helmburg III’s lawsuit for his injuries when fellow party-goer Travis Hughes shot bottle rockets out of his posterior in 2011. Helmburg, some will recall, was so startled by Hughes’ stunt that he fell off the rail-less deck at a fraternity party staged by Alpha Tau Omega of Marshall University. Hughes and the fraternity remain as defendants in the January 2012 lawsuit. ■

have a bone to pick with you adults (said loosely) who ride stand-up at Cove Park. The other day my son and niece, ages six and eight, were trying their best to ride two-foot waves when you two on stand-up boards cut them off, knocking their boards with their paddles. You laughed and didn’t even apologize. When my dad, who was out knee-deep with them, finally had enough he spoke up, asking you why it was necessary to cut off six-year-olds. You two were ignorant, rude and embarrassing. It’s a sad day when kids are being knocked around by stand-up paddlers with an attitude who think that this two-foot-wave is their epic ride, no matter what little kids they take out on the way. Maybe if you could act your age you would see that this break is for kids, beginners and anyone else who is willing to share it in the best interest of staying safe and encouraging kids to get out and get their surf on. ■

ocals call it Airport Beach, but its true Hawaiian name is Kahekili Beach, which honors the last king of Maui. Located just north of Black Rock on the Westside, Kahekili Beach is a gorgeous stretch of white sand that’s pop-

ular with sunbathers, swimmers, snorkelers and divers. The beach would exemplify everything natural and wonderful about Maui’s shoreline, except for one small problem: a new University of Hawaii study says submarine springs just offshore from the beach are
bringing in sewage that’s been injected into the ground at the nearby Lahaina Wastewater Reclamation Facility (LRWF), which is run by the County of Maui. “In sum, our results conclusively demonstrate that a hydrogeologic connection exists between LWRF Injection Wells 3
and 4 and the nearby coastal waters of West Maui,” states the giant 502-page Lahaina Groundwater Tracer Study report, which was released in late July. “Eighty-four days following injection, FLT [Fluorescein] tracer dye introduced to these wells began to emerge from very

facts and has to give a fat check to the federal government that will never come back to the community.

is warmer there. You don’t need special equipment to see these springs. MT: Why has the issue regarding the treatment plant injections gone on so long? COLLINS: I think from the state’s perspective, I think it’s better for them to do something instead of nothing. Injection is better than direct discharge into
scientific evidence of sewage coming up. And remember that there are injection wells in Kahului and Kihei as well.
MT: Where do you go from here? COLLINS: WMPA and Earthjustice are in settlement discussions with the County in the lawsuit. There aren’t really any details on that. We’re hopeful, and if not we’ll

MT: How serious would that judgment be for the County of Maui? COLLINS: For the County, a violation of the Clean Water Act is pretty serious. The money goes to the federal government. It would be very sad if the County won’t face

nearshore seafloor along North Kaanapali Beach, approximately 0.85 km (0.5 miles) to the southwest of the LWRF.” For the last two decades, various researchers have been studying the injections from the Lahaina facility, trying to discover if material was in fact getting into the delicate near-shore environment. The new UH report has a strong conclusion–one that should give pause to everyone who dives into the waters at Kahekili Beach. What’s more, though the wastewater plant injects “treated effluent” into the ground and not untreated sewage, the UH report discovered tangible changes in the ocean near the submarine springs: “Waters discharging the fluorescein dye from the submarine springs are warm and brackish, and have a temperature >28ºC, and an average salinity of 4.5 and a pH of 7.5.” Of course, none of this is news to the West Maui Preservation Association (WMPA). For about a decade now, the group of Westside residents has been speaking out about both the rampant construction throughout that part of Maui and the possibility that material from the wastewater plant was making its way to the ocean (in our Nov. 15, 2007 issue, I wrote a story titled “Change the Channel!” about WMPA’s research into possible bacteriological contamination in the nearby Honokowai Channel). In April 2012, Earthjustice filed a lawsuit in federal court on behalf of WMPA, Surfrider Foundation, the Sierra Club and Hawaii Wildlife Fund alleging that pollution was making its way from the wastewater treatment plant to Kahekili Beach. For more information about the context and importance of the recent UH tracer study, I spoke with Lance Collins, the WMPA spokesperson and attorney. MAUITIME: How long has your organization been speaking out against the Lahaina wastewater facility? LANCE COLLINS: Since it was formed [in 2003]. We’ve sent stuff to the EPA [Environmental Protection Agency] and DOH [Department of Health]. Nothing happened with DOH but the EPA wanted to hear what the public had to say. But that wasn’t until a couple years later. MT: What’s the significance of the UH study? COLLINS: WMPA has always said that it doesn’t take a biologist to see that the treatment plant has a negative impact on the near-shore waters. This [study] shows that conclusively. The water has to go somewhere. It’s not like there’s a big black hole under the ground. Would a tourist snorkel there knowing that 60 percent of the injection from the treatment plant is bubbling up there? The water they’re shooting into the ground is coming up. We have to figure out how best to eliminate the problems that’s causing. MT: Sixty percent seems high. Did the results surprise you? COLLINS: It did, though the exact amount is 65 percent. I thought [the result] was low. In my mind it was 100 percent, it’s at least consistent with my experience. In 10 to 15 feet of water, you can see these submarine springs. The water

When Earthjustice distributed the study in late July, the County of Maui’s press office declined to comment. But what the various media outlets (including this one) missed was that one county official had commented on the results in writing. Buried at the end of the 502-page report is a copy of a four-page letter dated June 10, 2013 from Scott Rollins of the county’s Wastewater Reclamation Division to UH Geology Professor Craig Glenn, the study’s principal author (the UH researchers’ response to Rollins is also included at the end of the report). In his letter, Rollins makes dozens of comments and critiques about the study, including his belief that the report is just too damned long. “This is one of the longest and most detailed executive summaries we have ever seen,” Rollins wrote. “Seems like it might be a good idea to move the report index ahead of it so we can find things like the acronym table, and understand the layout of the entire 450+ page report.” In response, Glenn dryly noted, “Good idea. We did that.” But Collins, who admitted that he hadn’t known about the county’s letter until asked about it for this story, couldn’t get over Rollins’ critique. “I find it amusing that the County is trying to tell scientists how to typeset their report,” he said. For the most part though, Rollins disputed the certainty that sewage from the Lahaina plant is in fact making its way to the nearshore waters–and repeatedly asked researchers to water down their conclusions by using terms like “possible cause” instead of “primary cause” when discussing the dye tracer results. “Where is the physical proof that this is true?” Rollins asked at one point. “Isn’t this the best guess cause for the data collected and the models that were developed[?]” But the report shows Glenn and his fellow researchers weren’t buying Rollins’ skepticism. “We strongly dispute the contention that no evidence was provided to support our conclusion,” they noted in response to Rollins’ question. Indeed, the EPA seemed to back them up (though that agency made many technical comments and criticisms of the report as well). “The Lahaina Groundwater Tracer Study Draft Final Report (June 2013) (the ‘report’) is informative and interesting to read,” noted that agency in a comment letter on the report dated June 10, 2013. “The report provides important and useful information on the fate of effluent from injection wells and on Submarine Groundwater Discharge (SGD) in West Maui. We now know that Lahaina’s effluent discharges 3-25 m from shore in two fairly discrete areas off the Marriott and that it takes 3 months to under a year for most of the plume to reach the ocean. Whoa! I didn’t have the appetite to attack the kanak so I compromised with a mushroom Swiss burger for $6 (adding fries and a drink makes it $8). The mushrooms and Swiss are just what the burger needs to spice up the flavor of

Their menu is simple–grilled meats plus salad and steamed rice. The proteins range from the Kronos traditional beef and lamb to other impressive converted bus options like ribeye, short rib and pork chop. The platters cost $8-12. You can order just a gyro sandwich, but for $2.50 more I made my lunch into a platter. A sandwich is gyro meat, onion and tomato on a fresh grilled pita bread, and they serve Greek

They also have desserts like floats for $3 and deep fried Oreo sundaes for $5. You may even recognize Kalama’s from their little restaurant at Kau Kau Corner on Dairy Road. They have since gone mobile and only do the food truck, but it offers of the biggest menus I’ve seen hit the road. The little spot in front of the Kahului Boat Ramp is famous for collecting the food truck scene in Kahului–it’s hot and dusty, but
katsu, fish and chips, coconut shrimp, barbecue chicken, Kalbi, sirloin with sautéed mushroom and kalua pork with lomi salmon. The lunch plates all come with a cold drink, rice and mac salad and they run you around $8-10. You can sub in crinkle cut fries or green salads, too. We sampled the kalbi and the chicken katsu, and subbed in fries instead of rice for $2 more. The katsu was just how you want it: crisp, trimmed and cut in slices. The book has a chapter for each creature, each with an introduction by Morey about the beast, and then the artists’ renderings of the creatures. Submissions include art from Horiyoshi III, Horitake, Ade, Horishin and Horiken. “I figured if people were going to do these pieces for a show, then I would do a book, too.” says Morey. “We took these paintings to

ot everyone has the balls to make studying monsters their life’s work, but Crystal Morey isn’t everyone. Exchanging her Texas homeland for Japan a few years ago with the goals of making sure her daughter was bilingual and opening a school were just the opening acts in her international adventure. Since then she’s become an expert on mythical creatures and Japanese imagery, a publisher of books and cultivator of art from around the world. Now Morey is in town to present her latest collectionof art at the Gomineko Crew Show opening at Paia Tattoo Parlor and will be teaching a seminar this Saturday as well. “This show took me about three months to put together once I knew I was coming,” says Morey. “I travel all around the world. I am in a different location on the globe every month. It’s incredible to have these pieces from a group of artists that are very talented. We have art from Japan, New York, Arizona, Colorado, Australia and Texas.” The Gomineko Crew of artists has been born from from Morey’s book publishing company, Gomineko Books and her travel. Her books and bookstore (found at Gominekobooks.com) are an amazing resource of Japanese art and subculture that can’t be found anywhere else. Morey travels around the globe to build these books, and meet artists and enthusiasts hungry for the information she shares. “I want to form a network that allows people to travel and be well received,” she says. “If you have a good attitude, then we can include you. I meet people who are creatively brilliant and are good characters and that’s what this is about.” Her most recent book features the work of Adam Kitamoto, titled Myths, Gods and

Besides curating books and shows, Morey also does tours for adventurous visitors to Japan, who can watch tebori (traditional Japanese hand-poked) tattoo and meet artists. She can also negotiate
tattoo appointments for folks on her tours. The Gomineko Crew art show opening is Thursday at 8pm at the Paia Tattoo Parlor. That night the shop will also be debuting their new gallery space and you’ll be able to meet some visiting artists like William Thideman of Kaze Gallery and Tattoo in Colorado and Moses Garcia from Contra Tattoo in California. Paia Tattoo will also be revealing their permanent collection from in-house artists like Nate Rose, Tony McAboy, Tania Arens and Justin Yates. Other featured artists include Mike Nomy of South Shore Tattoo in New York; Scott Ellis of Triple Crown Tattoo in Texas; Adam Hays of Lost Texan in Texas and New York; Thomas Asher of Iceland; Horimasa, Horishin and ONEQ from Japan; Cat Bijoux of Tattoo Mania in Montreal; Clint Steele from Brisbane, Australia; Nick Alvarez of Guru Tattoo in CA; and Cissy LaLa from Los Angeles. On Saturday at 8pm, Morey will be doing a two-hour lecture on the meanings behind Japanese tattoo imagery. Her talk will include discussions of the symbolic meanings behind animals, flowers, gods and characters from Japanese lore. “Horiyoshi III taught me that if you have time to give, it’s going to come back to you,” says Morey. “So I feel like I have to share what has been given to me. Elysium Simplistic space parable isn’t even interesting to see
Elysium

I
n the year 2154, Los Angeles resembles a massive trash pile with its citizens living in poverty. The space station Elysium houses all of Earth’s wealthy citizens and is so massive, it’s visible in the sky during the day. We meet Max, played by Matt Damon, on a bad day, in which he’s harassed by cops, his parole officer punishes him for something he didn’t do and he’s treated horrifically at his job. Sensing his days are numbered, he agrees to having a robotic, performance-enhancing apparatus grafted onto his body and partakes in a mission to sabotage Elysium’s elite borders. The central flaw of writer/director Neil Blomkamp’s sophomore slump is an inability to make any human connection. His debut film, the terrific District 9, brilliantly engaged our emotions by making us care deeply about a scientist and his young boy, despite the fact that they were hideous aliens. In addition to the amazing visual
effects and unique scenario, that movie presented complex, sympathetic characters whose fate gave you great concern. The maudlin attempts in Elysium to tug our heartstrings, with flashbacks to the protagonists’ childhood, are as obvious and heavyhanded as everything else in the movie. Alice Braga plays the love of Max’s life (we know this from the ample flashbacks), a doctor and single mother with an adorable, doe-eyed, but sickly daughter. The way these characters are introduced and forced into the tale is arguably the screenplay’s greatest contrivance. Damon’s everyman charm makes him a good choice for the lead, especially during the first half. While he isn’t believable as a tattooed car thief (Eminem was the understandable first choice for the role), Damon is endearing in scenes of Max struggling to maintain his composure and survive a grueling existence. His sarcastic, one-way conversation with a robotic bureaucrat is the film’s best scene. Once Max becomes a roboenhanced Franken-Bourne, Damon’s performance and his character lose the relatable vulnerability and is no longer interesting. Sharlto Copley, the star of District 9, plays

Kruger, an especially repellent villain. Copley makes an impression simply by going more over the top than his co-stars and, like Jaden Smith in After Earth, makes the bizarre choice of using a sword as his futuristic weapon of choice. Jodie Foster and William Fichter play the powers-that-be in Elysium’s social ladder. They both share annoying, faux snooty-speak accents, meant to show, just in case you missed it, that they’re big jerks. The design of Elysium and the NASA footage-like clarity of the outer space shots are remarkable, as are the anythinggoes action sequences. But many shaky, hand-held shots blur some scenes, while others are frequently shot in slow-motion that have a look-at-this importance akin to a Zac Snyder movie. Neither the post-apocalyptic earth nor the bland, Beverly Hills-like Elysium look all
that appealing and the whole movie is very L.A.-centric in its scope and attitude. We never get a good look at what the rest of the earth looks like, as all humans are depicted as malnourished, desperate Mad Max extras, while the majority of the Elysium population appear to be white J. Crew models (what, no African Americans? Asians? Hawaiians? Not even Dwayne Johnson III?!). As a blatant political commentary, it’s too transparent and obvious. One character has a computer read out that declares her “illegal alien,” then pivotally corrects her status as “legal alien.” We get it, as though the Us vs. Them story, nods to the plight of the 99 percent, use of the term “Homeland Security” and analogy of Elysium as a giant border weren’t already so blatant. Is this a liberal Hollywood sci-fi parable? Possibly, but not a very good one. ■

Yes, you may fall a little short of rearranging reality to this extent, but then again—why not try? I predict you’ll be happy with the results, either way. SAGITTARIUS (NOV. 22-DEC. 21) Tag-team wrestling sucks when your partner is already out for the count, while your pair of opponents are still in tiptop shape and raring to go. Don’t be bitter. The past couple weeks you were blessed with generous amounts of backup support and inspiration. This is the universe’s way of making sure you can still kick ass on your own. Don’t worry; you can—without even resorting to playing dirty. Your many partnerships have taught you some surprising and effective moves. Use them, and don’t dwell on your apparent abandonment. It’s not incompetence, simply the virtual impossibility of seeing things from an outside perspective. Don’t compound your suffering by dwelling on your cluelessness. PISCES (FEB. 19-MARCH 20) Astrophysicists get excited about events that happen over billions of years, because the more we learn about them, the closer we come to understanding the basic structure of reality itself. But why should we care about the collision course of two incredibly colossal black holes an incomprehensibly vast distance away? Unfortunately, your inner workings, although as arguably important as intergalactic dynamics, are similarly hard to relate to, for other people. They don’t necessarily understand what’s going on, or—more importantly—how it affects them. This week, clue people in, even if it means simplifying things.
