created a positive momentum, and we need to ride that wave for as long as we can.” The Maui News seemed to love the notion of Arakawa’s administration creating “momentum,” even playing it up in their story’s headline. But momentum is an ancient concept in physics and politics–without some kind of forward, decisive motion, a political leader runs the risk of stalling or, even worse, getting tossed aside by other political leaders (county councilmembers, legislators, etc.) For that reason, Arakawa made clear in his speech that he still has big plans for the county– plans so big achieving them may not be possible in our lifetimes. “Eventually we hope to make Maui County a zero-waste community, where we reuse and recycle instead of trash and bury,” he said. Arakawa also noted that “we still have a ways to go before we hit our long term goal of 100 percent renewable energy.” The last point of the speech is the most important, and most delicate–so much so that few leaders will make it explicitly. It’s the belief that only the mayor/governor/ PHOTO COURTESY GOV. NEIL ABERCROMBIE FLICKR
The island of Maui is located approximately 5,000 miles from the original copy of the United States Constitution on display at the National Archives in Washington, D.C., but given the actions of the Maui Police Department, we might as well be five light years away. Don’t believe me? Go stand on a sidewalk– any public sidewalk around the county will do. Chances are that you’ll be in trouble if one of Maui’s Finest happens upon you. In the County of Maui, cops will bust you if you’re standing on a public sidewalk while carrying a sign that expresses some sort of political message. They’ll bust you if you try to take photographs of them doing their jobs–even if you’re just standing on a public right-of-way– as our publisher Tommy Russo found out in 2012. And they’ll bust you if you’re trying to hand out some sort of religious information to other people on the public sidewalk. Didn’t know about that last one? Well, neither did the ACLU’s Hawaii office, and now they’re suing the County of Maui over it, according to their Feb. 6 press release: “Maui County (“County”) is again in federal court, accused of violating the free speech rights of a Maui pastor and his wife,” stated the release. “In October, Pastor Strat Goodhue and his wife, Doreen, were peacefully handing out religious materials on the public sidewalk outside the Maui Fair when a Maui Police Department (“MPD”) Officer ordered them to leave. When Pastor Goodhue asked a second Officer whether this was legal, the Officer replied that it was–and, worse, that Pastor and Mrs. Goodhue could also be ejected from other public sidewalks nearby (including in front of the police station) if they attempted to distribute religious literature.” The case is in litigation, so county officials won’t comment on the suit. Attorney Matthew Winter with the law firm Davis Levin Livingston, which is handling the lawsuit for the ACLU, had no such qualms. “The fact is that the sidewalk is public space, and under the First Amendment, all are free to express
their opinions there,” he said in the Feb. 6 press release. “While government may set some restrictions on the time, place and manner of speech in order to protect public safety, they are not allowed to unilaterally squash the voice of peaceful, law abiding demonstrators. Pastor and Mrs. Goodhue did the right thing in obeying the commands of MPD officers, but those commands were unconstitutional– and so today we are in court to make sure this kind of thing doesn’t happen again.”
say, without a doubt, that our community is in a better place than when we first began this journey,” he said in his speech. “Then last lear I said that while we still have much more to do, the state of the County was GOOD. And things are still GOOD. In fact, things are even better.” Through his speech, Arakawa pointed to low unemployment numbers, ongoing road repairs and rehabilitation projects, water infrastructure improvements, installing solar panels on the roofs of county buildings, bus system expansion, affordable housing construction and park maintenance and restroom repairs as evidence that his administration is doing good. “[T]he County finally purchased 209 acres last year which will eventually become the Central Maui Regional Park,” Arakawa noted. “Once this park is complete, we will have space for everyone to play almost any sport.” The second, equally important part of the speech is to make clear that while the
MAYOR ARAKAWA SAYS STATE OF THE COUNTY IS GOOD! So last night Maui County Mayor Alan Arakawa delivered the fourth and last State of the County address at the Maui Art & Cultural Center’s McCoy Studio Theater. We couldn’t make it, but have a copy of the speech and the Feb. 6 Maui News, which described the attending crowd as “standing room only.” Speeches like this, whether they’re given by mayors, governors or presidents, have three main points. The first is to make clear to the audience that the mayor, governor or president has done a lot of good while in office. Arakawa returned to this point repeatedly in his speech. “As I stand before you, in the second month of our fourth year in office, I can

administration has done a lot of good, a lot more good has yet to be done. Things are great, the mayor/governor/president says, but they could be greater… “Looking towards our future, we want more than just to recover, we want this community to thrive,” Arakawa said in his speech. “We can do it because this community has

president making the State of Whatever speech has the capability to build on all those successes he/she just outlined. Coming out and making such a statement is too easily written off as immodest–which might as well be political suicide. Instead, the point has to be implied throughout the speech, strong enough that citizens get it, but not so strong that they’re repulsed by it. Arakawa’s use of the word “we” throughout his speech was definitely his way to approach this point. In his speech, Arakawa opted for an ending that, at first, sounds humble, but on further reading could only be expressed by someone who confidently exercises power. “In closing, may I just say that it has been an honor to be your mayor for the past three years,” he said. “I was given this honor once before and it has been a Godsend to have this opportunity once again. It would be an honor and a privilege to serve another four years, but this is not the time or place for that speech.” ■ anthony@mauitime.com + @apignataro For more news articles, visit our news blog at: mauifeed.com

Were County Workers Golfing On County Time? County parks director Glenn Correa on admin. leave

M
aui County Parks & Recreation Director Glenn T. Correa is on administrative leave pending the outcome of a Maui Police investigation into county workers' alleged golfing at Waiehu Municipal Golf Course on county time, said an official with the County of Maui who requested anonymity because of the sensitivity of the matter. A second employee with the Parks & Recreation department, who also requested anonymity, confirmed that Correa hasn’t been at the office since at least earlier this year. As for the Maui PD investigation, Lt. William Juan–the Maui Police Public Information Officer–did not respond to a request for comment on the investigation by press time. But an employee at the Waiehu Golf Course who did not wish his name used in this story confirmed that Maui detectives did recently visit the course. “They were here about two weeks ago,” the employee said. “I’m not really sure what they were looking for.” The employee said the police detectives did not mention anyone by name. A phone message left at Correa’s home wasn’t returned by press time. But a voicemail message left with Lisa Sakumoto, the director’s secretary led to a humorous, indirect confirmation that things aren’t quite right at the Parks & Rec department. When I first heard a tip about Correa on Feb. 10, I called his office, and was routed to his secretary’s voicemail. I left a message saying that I’d heard he had been suspended and wished to find out if it was true. Later that day, I learned from another source that Correa was actually on paid administrative leave and had not been suspended. That af-

ternoon, when I published a brief blog post on the matter at Mauifeed.com (two days before The Maui News published their story on the situation), I reported that my sources were telling me the County had placed Correa on administrative leave. Which is why I laughed a few hours later when Deputy Director Brianne Savage finally called me back. “Just wanted to confirm that he is not suspended,” Savage said in a voicemail message. Of course, Savage neglected to say why Correa couldn’t call me back himself and say the same thing, instead referring me to Rod Antone, the county Communications Director. Antone said that the situation with Correa was a “personnel matter,” which he couldn’t comment on. ■ anthony@mauitime.com + @apignataro For more news articles, visit our news blog at: mauifeed.com

All presentations from TED conferences are required to be available free to the public. Past presentations by the national organization are available TED.com. Videos from the first two years of TEDxMaui can be seen at tedxmaui.com. Tickets for TEDxMaui 2014 will go on sale via the MACC Box Office on April 15. News Of The Weird MODEST MEAT The International New York Times edition published in Kuala Lumpur on Jan. 22 carried a page-one story noting increased worldwide demand by meat processors for pigs raised in the fresh air rather than enclosed in pens–illustrated by a photograph of a cluster of pigs feeding in an outdoor stall. However, the Malaysian printer (who had downloaded the digital pages and set them to paper) had added black boxes to cover just the faces of each pig in the photo. “If there is picture of nudes or [the] like, this we will cover [up],” a publisher’s spokesman told the Malay Mail. “This is a Muslim country.” The story, headline and photo were otherwise identical to the versions that appeared elsewhere in New York Times editions.

“Does Germany really need a gourmet restaurant for dogs?” asked Berlin’s Bild newspaper. Regardless, the Pets Deli in the Grunewald neighborhood of Berlin offers servings for the equivalent of about $4 to $6, either takeout or arranged in metal bowls on Pets Deli’s floor. Said owner David Spanier, lauding his upscale, healthful treats, “Junk food is bad for animals.”
LEAST COMPETENT CRIMINALS Two 16-year-olds tried to pull off a street robbery at a housing complex in the Bernal Heights neighborhood of San Francisco in December, but one was arrested and the other is no longer with us. According to police, the victim cooperated fully with the two, but for some reason, one of the muggers fired his gun anyway. The bullet struck the victim (who was hospitalized, but will survive), ricocheted off his face and hit the shooter’s partner, who died at the scene.
THE JOY OF RESEARCHING A team of Czech Republic researchers led by Vlastimil Hart, writing in Frontiers in Zoology in December, reported
that dogs (among a few mammals), dealing with a nature’s call, spontaneously align their body axis with the Earth’s magnetic field. To reach that conclusion, the researchers said they observed 70 dogs of 37 breeds during defecation (1,893 observations) and urination (5,582) over a two-year period.
IF WE CAN DO IT, WE SHOULD DO IT ThinkGeek.com has introduced the Tactical Laser-Guided Pizza Cutter, at a suggested $29.95, for helping to achieve straight-line precision in those difficult four-cut (eight-slice) pizza formulations. And Japanese lingerie manufacturer Ravijour now has a bra whose front clasp can be locked unless its built-in heart-rate monitor signifies that the heartbeat is characteristic of “true love.” Ravijour said it is still testing the bra.
MAN’S BFFS The Battersea Dogs and Cats Home in Fulham, England, admitted in December that a rescued Staffordshire bull terrier, Barney, had a ladies’ underwear-eating habit and that potential adopters should keep him away from laundry baskets. In his first days at Battersea, officials say, he “passed” knickers three times. And the Cairns (Australia) Veterinary Clinic warned in December of several reports of dogs becoming addicted to licking cane toads (which notoriously protect themselves by a venomous secretion that can be hallucinogenic). One vet told Brisbane’s Courier-Mail of individual “serial lickers” treated for cane toad poisoning several times a year.
EASILY OFFENDED RACCOONS The Royal Society for the Prevention of Cruelty to Animals condemned a Pet Expo in Greenhithe, England, in October after reports emerged that a trainer had showcased “Melanie,” a raccoon that rides a bicycle-like device, apparently to great acclaim. An RSPCA statement denounced the expo for “degrading” a “wild animal” in such a “demeaning light.”
LEADING ECONOMIC INDICATORS A group of (legal) prostitutes in the Netherlands began a campaign in December to have their occupation officially termed so dangerous and physically challenging that they should be allowed (as soccer players are) to save in tax-free pension funds. They carry out “difficult physical work,” their lawyer said, and their careers are likewise short-lived–much better-suited for the young. Furthermore, he pointed out, prostitutes are not able, post-career, to earn money coaching or by endorsements.■

ello young lovers–the lovers ones who “were walking” the black and white dog on Sugar Beach the other morning. Perhaps, if you had actually been holding the dog’s leash, you would have noticed the deposit she left for those following you. Of course, even if you had your dog under control, you weren’t carrying a bag or anything, so it’s not like you would have done anything about it. Then a few days later, you came back to the beach with two dogs, both again off-leash, and were once again no better prepared than you were before. I can’t believe that the majority of Maui’s citizens like decorating the beaches with dog poop! ■

Here are 20 pieces of proposed state legislation that deal with law enforcement and criminal justice that you need to know about. By Anthony Pignataro
T
here must be hundreds of proposed bills floating around the state Legislature these days, dealing with all manner of topics. Some are vital, others (probably the majority) are considerably less so. Given the importance of law enforcement and criminal justice, we’ve gone through that vast pile of possible future laws and found 20 that we think our readers should know about. A few of these would make important checks on the power of cops and courts, while others would (in our opinions) further erode civil rights. Enjoy! HB 1660 HD1 - Obstructing Sidewalks This bill protects our valiant public sidewalks from being unjustly “obstructed” by members of the public. In a thinly veiled assault on being homeless, the bill “Specifies that the offense of obstructing includes, in addition to obstructing a highway or public passage, providing less than one meter of space for passage on any paved public sidewalk, except as authorized by law, or failing to obey a law enforcement officer’s order or request to cease any of the foregoing activities.” Status: Referred to Senate Judiciary and Labor Committee on Feb. 6 SB 2937 - ‘Relating To A Law Enforcement Standards Board’ For anyone who reads MauiTime on at least a semi-regular basis, the following sentences–taken right from the bill text–are not at all surprising: “Hawaii is the only state in the country without any state-level regulation of police. Regulation is left to the counties. Hawaii is only one of six states that does not establish minimum standards required to be a police officer and does
10 FEBRUARY 13, 2014
not have any procedure for revoking a police officer’s certification for serious misconduct.” For that reason, this bill seeks to set up a statewide “law enforcement standards board” that would certify cops (and any other public agency with police powers). Status: Referred to Senate Public Safety/Judiciary and Labor and Ways and Means Committees on Jan. 23. HB 2239 (SB 2788) - ‘Disclosing Public Health Statistics Records to Law Enforcement’ Unlike other states, in Hawaii it’s not just anyone who can get access to a person’s public health statistics records (like a birth certificate). Usually, it’s just the person named on the record or a close relative. This bill adds police officer to the list. Specifically, “A law enforcement officer, as defined by section 710-1000(13), who needs a public health statistics record as evidence in a criminal investigation.” Status: Referred to House Judiciary Committee on Feb. 11. HB 2661 - Homeless person bill of rights This creates “a homeless person’s bill of rights to guarantee that the rights, privacy, and property of homeless persons are adequately safeguarded and protected under the laws of this State.” It seeks “to ensure that their person, privacy, and property are safeguarded and protected. And the bill further makes it legal for people without homes to “Move freely in public spaces, including on public sidewalks, in public parks, on public transportation, and in public buildings without harassment or intimidation from law enforcement officials, in the same manner as other persons.” Status: Referred to Human Services, Judiciary Committees on Jan. 27
HB 2607 - Concealed Carry License of pistols or revolvers This bill sets out the legal steps Hawaii police chiefs can take to start issuing Concealed Carry Licenses. But before you grab your Glock and run to the police station (an act you might want to think twice before attempting), please note that the bill lists A LOT of steps that must be completed before anyone gets said license. Status: Referred to House Judiciary Committee on Jan. 27 HB 2550 - Internet Crimes Against Children Fund According to the bill’s summary, this “Establishes an internet crimes against children fee for each felony or misdemeanor conviction.” The bill summary also states that the fund would “provide training and resources for local law enforcement agencies’ and investigators’ use in investigating and prosecuting internet crimes against children.” Status: Referred to House Human Services, Judiciary and Financial Committees on Jan. 27. HB 2505 - Failure to report child disappearance Missing children are every parent’s nightmare, and this bill brings the hammer down on caregivers who don’t act as quickly as they should when a child disappears. It “Establishes penalties for caregivers who fail to report the death or disappearance of a child to law enforcement or who provide false information to law enforcement authorities.” Status: House Human Services Committee passed it on Feb. 4
HB 2033 HD1 - Exempts breast feeding moms from jury duty The bill text is pretty clear about why this is necessary. “Mother-child separation presents a serious challenge to continuing breastfeeding,” the bill states. “It costs nothing to exempt a breastfeeding woman from jury duty, and this exemption can make a bigg p
is one of the most important responsibilities of the State,” states the bill. “However, security positions are among the lowest paying in public schools, and additional incentives are needed to address increased security needs adequately.” Status: Referred to House EducaStat tion, Labor and Financial Committion tees on Jan. 27 SB 2591 - Law Enforcement Misconduct Reports Mis It’s not a repeal of the special exIt emption in the state’s public records emp law that protects the identities of bad cops, cops but this bill does at least call for more m detailed reporting of cases of police misconduct. p Status: Referred to Senate JuSta diciary and Labor Commitd tee on Feb. 11

HB 2609 - ‘Abuse of Family Member or Household Members’ H Call it the Officer Nelson Johnson Act. This bill “ReC quires the court to hold a separate probable cause hearquir ing, when a person is charged with the offense of abuse of a family or household member or refusal to comply with the lawful order of a police officer, to review the w charge and determine if there is probable cause to ch believe that the person charged will benefit from unb dergoing domestic violence intervention programs.” d (Note: Officer Johnson, who was indicted on two (N charges of abusing family members, has not yet been ch convicted of a crime.) conv Status: Referred to House Human Services, Judiciary and Stat Financial Committees on Jan. 27 Fina
difference in preserving the breastfeeding relationship. A woman should never have to worry about how she is going to feed her baby while required to sit in a courtroom, or while sequestered.” Status: Referred to House Judiciary Committee on Feb. 11. SB 2032 SD1 - Violence against health care personnel Because we can never have too many special crime categories, this bill “Adds intentionally or knowingly causing bodily injury to medical services providers to assault in the second degree offense,” states the bill summary. It also “Expands the medical services providers to which the offense would apply.” Status: Senate Judiciary and Labor Committee has hearing scheduled on Feb. 12. SB 2897 (HB 2347) - ‘Relating to Department of Taxation Criminal Investigators’ Much like the federal Internal Revenue Service, the state Department of Taxation employs criminal investigators, whose job is to track down people who show more than a slight hesitation to pay the taxes they owe. But apparently, the existence of this bill seems to show that people just aren’t respecting the state tax cops like they should. Hence this piece of legislation, which states that “Persons appointed and commissioned under this section shall have and may exercise all of the powers and authority and the benefits and privileges of a police officer or of a deputy sheriff, including the power to arrest.” Status: Senate Public Safety Committee passed it on Feb. 11. HB 2652 - Double Dipping Security Guards This bill makes it legal for retired cops, firefighters and National Guardsmen to “double dip”–collect their pension while still employed–if they go to work as a school security guard. The reason for this? “Ensuring safety in public schools
HB 2409 - ‘Relating To Disorderly Conduct’ The Hawaii statutes already list five ways in which a perTh son can engage in “disorderly conduct” at a bus stop. These include inclu fighting, subjecting someone to abusive language and making “unreasonable noise.” Anyway, this bill adds a sixth way to that list: lying down “at a bus stop shelter or other othe bus stop structure in a manner that impedes or obstructs the use of or access to the bus stop.” Gee, I wonder which socio-economic strata this bill is aimed at... Status: Passed Second Reading on Feb. 10.

the individual a danger to self or a danger to others.” Of course, how one doctor diagnoses “danger to self ” will be different from another’s, but hey, what do you expect from an explosively charged two-page bill? Status: Referred to Senate Public Safety/Health and Judiciary and Labor Committees on Jan. 23. SB 2938 - ‘Relating To Firearms Registration’ This bill brings the world of firearms registration–which is already mandatory for everyone in the state who owns a gun–into the 20th century. “Each county shall establish an online registration process for registering firearms that generally requires no more than two visits to the respective county police station per registration,” states the bill. “Any funds received from county firearm registration fees shall be used to pay for online registration processing costs.” Status: Referred to Senate Ways and Means Committee on Feb. 12. SB 2915 - Establishes State Highway Patrol Show of hands of those who loved the TV show CHiPs, which ran from 1977 to 1983 on the NBC network? Starred Erik Estrada and Larry Wilcox as two fun-loving but deadlyserious motorcycle officers with the California Highway Patrol? Anyway, this bill would set up the same outfit here in Hawaii, as a division of the Sheriff’s Department (though probably without Erik Estrada, which is sad).
HB 2421 - ‘Relating to Unmanned Aircraft Systems’ Here’s a timely bill governing the use of drones–especially in regards to law enforcement against citizens. The bill “Requires individual consent or a search warrant to track an individual through the use of unmanned aircraft systems,” states the bill summary. It “Prohibits the repurposing of data without a search warrant. [It] Prohibits the carrying of firearms aboard unmanned aircraft systems. [It] Prohibits the causing of a nuisance from the operation of unmanned aircraft systems and model aircrafts. [It] Requires the police departments to implement guidelines of the International Association of Chiefs of Police Aviation Committee.”
Status: Referred to Senate Public Safety/Transportation, Ways and Means Committees on Jan. 23.
Status: Referred to House Transportation, Judiciary and Financial Committees on Jan. 27.
SB 2590 - Cops can’t get drunk on duty In response to the recent Christopher Deedy trial, in which a federal agent visiting Hawaii was charged with getting drunk and then killing a local (and which ended in a mistrial), we have this bill that would prohibit any and all public safety employees (ie, cops) from consuming alcohol while carrying a firearm or an unspecified number of hours before carrying a firearm. Granted, we already thought it was illegal for cops to get drunk on duty, but that shows what we know.
SB 2957 - Doctor’s Note Required To Get a Gun Yes, you read that right. “Any individual applying for a permit to acquire the ownership of a firearm shall provide, as part of the permit application, a medical clearance by the individual’s primary care physician or psychiatrist who has examined the applicant no more than ninety days prior to submission of the application,” states the bill. “The primary care physician or psychiatrist shall provide a medical clearance for any individual who has no diagnosis, as of the time of the examination, of any medical condition that could make
HB 1983 - Silver Alert Program for missing seniors This bill would create a “Silver Alert” system for missing senior citizens, similar to the state’s Maile Amber Alert program for missing children. Oh, and the bill defines “senior citizen” as 65 years old and older, so any 60-year-olds who go missing are pretty much on their own. Status: House Human Services Committee passed with amendments on Feb. 11.
Status: Bill scheduled for decision making on Feb. 13. ■ editor@mauitime.com + @apignataro For more news articles, visit our news blog at: mauifeed.com

Tasting Rita’s steak and seafood in Kihei
Steve Warsh
RITA’S MAUI 1945 S. Kihei Rd. 808-214-5788 11am to 11pm
T
Steve Warsh’s Top 5 to Try 1. Prime Rib–The tenderness of slow roasted beef with a cabernet au jus will melt in your mouth. Served with gruyere and Swiss horseradish. 2. Bone-in Rib Eye–Not just for paniolos, their red wine demi glace is just the right touch of flavor for their robust rib eye. 3. Ahi Rita Style–Lightly seared with garlic panko and a balsamic reduction. 4. Baby Back Ribs–Somehow Warsh obtained the secret recipe for the sixth best ribs in the nation. Try these dry-rubbed, slow-smoked ribs as they drop off the bone. 5. House salad table side–The traditional salad at a steakhouse. It’s almost a dying art, but you can experience it here, and it’s included with all of their entrees or as a stand-alone dish. The salad features red onion, green olives, romaine and tomato, and the dressing is made table-side as well with fresh lemon and olive oil.

he story of Rita’s, the newest Kihei Kalama Village restaurant, begins with a romantic vacation getaway. It’s the vacation owner Steve Warsh took in 2005 that made him decide Maui was the place to be. “It’s pretty simple,” says Warsh. “My soul belonged here. I’m a Type A personality. Here on Maui is where I can relax.” Warsh spent the last 14 years in Las Vegas in another industry, but says he was ready to get back into food and beverage. “I hadn’t been in the restaurant industry in 20 years,” says Warsh. “Rita’s is the tenth restaurant I’ve been involved in.” Rita’s opened at the end of last summer, taking the spot left vacant by
Lulu’s Kihei. The second story, open-air restaurant is spacious, comfortable and offers great ocean views. There’s a large deck area, but also a significant bar with sports running on TV screens. As for the menu, Warsh says he was going for classic steak and seafood because he felt that niche wasn’t being filled. He selected the all prime menu personally and says he has the only allprime menu in town. “I know all about these cows,” says Warsh. “I sourced all grass-fed Iowa beef. They are all humanely raised. Our lobster comes live from Portland Maine–they are never frozen.” During a recent visit, I dove into their live Maine lobster, which is served with butter, lemon and sauteed vegetables. The presentation was amazing, but the lobster did all the work. There was barely any room for veggies! The lobster was served with the tail cracked open–you
just pull out that luscious meat and dip. Same for the claws. The menu is full of seafood and steakhouse standards done with a special twist. In November, Chef Josh Marten came on board to offer consultation to Rita’s–he tweaked the menu with his touch of sauces and pastas. The dinner menu highlights many select cuts of meat, from filet to porterhouse, and fresh catches from local fisherman. They have a fresh catch trio that Warsh says is one of the most popular entrees: three filets with three different sauces. There are also scallops and Alaskan king crab rounding out the seafood offerings. All of the seafood reappears in the salad menus (there’s a steak salad, too). On the sides menu, they spare nothing from cheese-infused spinach to garlic mashed potato. For pupus, you can expect lots of rich seafood starters like lobster bisque, steamed clams, crab and shrimp stuffed mushrooms, seafood wontons, coconut shrimp and fried calamari. Rita’s also of-

fers some raw items too, like the seared ahi Rita style and the poke platter. I devoured some of their poke, which is served on crisp triangles of fried wonton chips and stacked high into a tower. The fresh cubes of shoyu-seasoned ahi sprinkled with chopped green onion were flawless. Happy hour starts at 3pm and all pupus go on sale at half off till 6pm, with select Mai Tais and Margaritas for $3. Draft beer and wine is two bucks off and house martinis are $3.50. Live music each evening starts at 4pm, with rotating artists. I dropped in to listen to Aloha Bluegrass on Saturday afternoon. Bluegrass may have come from Kentucky, but I swear it’s better enjoyed over Mai Tais and sunsets. Speaking of which, the Mai Tai here is a bold concoction of rum and fresh pineapple juice that’s served in a pint glass like most of
their cocktails. Warsh says his favorite margarita is the “Kevin’s Coconut” but Rita’s has a mind stopping 17 different margaritas to choose from. Lunch starts at 11am and is more casual than their dinner. Choose from burgers and fish and chips, and a few of the dinner favorites like ribs and seared ahi. Dinner starts at 6pm, with a change over to white table cloths and napkins that add a bit of extra elegance to the dining room as the sun goes down. Warsh says that Rita’s is just a small mom and pop restaurant and he’s there every day. “Rita’s is for those of us who want Ruth’s Chris cuisine at Outback prices,” he says. ■ jen@mauitime.com + @jenrusso For more foodie news, visit MauiTime’s food blog at: mauidish.com

Talking Story With Oahu Trumpet Player DeShannon Higa PHOTO COURTESY DESHANNON HIGA
W
e hear a lot about big name Jazz artists coming to Maui, so it’s especially great to hear about one with Hawaii roots. DeShannon Higa, who grew up in Hilo, will be performing at Gannon’s on Saturday, Feb. 22, as a benefit to the Arts Education for Children Group. He’s one of Oahu’s most renowned trumpet players, and has sat in with so many bands it’s hard to keep track. Performing with Higa will be the select student combo Teal & Black Quintet, the Jazz instructor group Chop Suey Combo, Andrea Razzauti, Adonijah Imgrund, the King Kekaulike Jazz Combo, Mike Buono, Danny M and Sal Godinez. For reservations, call 808-879-8080. Higa was game to talk story with us: MAUITIME: What’s your earliest memory of the trumpet? DESHANNON HIGA: I was nine years old when I started playing trumpet. Drums was my first choice but my band teacher denied me, saying there were enough drummers already. A lot of my friends were playing trumpet at the time, so I decided to join them. It was the best decision I ever made. MT: How did you meet your band? DH: Not sure which band you mean, but if you’re talking about my own personal band, I have several. [There’s the] Jazz quartet Quadpod, quintet Bop Tribal, sextet Deep 6, eight-piece Subtonic Orchestra: Ear Candy, a hip hop/club band Subtonic Orchestra: Bump! and The DeShannon Higa Big Band. All musicians in my bands are friends. I start there and look for the best musicians I can get who can also mix it up, who also have good chemistry with other members of the band, including myself.
When that happens, you’re able to discern good music from bad; you’re no longer getting spoon-fed–you are feeding yourself. MT: Aside from your trumpet, what are three things you must have with you when doing a show? DH: Oh that’s easy. First, a plan. Any good show has to have an arc: a beginning, a middle and an end. When I put a show together, I carefully select my songs and the order they go in. It has to flow. When done right, it takes the listener on a journey–one that they will want to go on again and again. Second, a killer rhythm section. ‘Nuff said. Third, good sound. You can have #1 and #2, but a bad sound man can kill your show. If I can’t hear myself right, or hear the other instruments how I need to, I’m dead in the water. Good sound is critical to my success.
are all fun in their own right, but it’s the final product that brings me the most joy. To hear a composition performed live to an audience that “gets it” is the most rewarding feeling. For me, it is the harvest celebration. MT: We stalked you on Twitter (@deshannon808). You have a taste for seafood... do you have a favorite spot on Maui? DH: It’s gotta be Mama’s. Is there really any other spot? MT: Maui’s Jazz community is growing. Do you have a dream local musician you’d like to play with? DH: Well, Bruno [Mars] is a local musician turned superstar. I’d like to play with him, but not in the pop, neon lights kindof-way. I’d like to do an unplugged session with him. I think that would be cool, and very interesting.
MT: Can you list one favorite thing about each band member?
MT: There’s nothing like a live trumpet. How does that fit into our modern, digital world?
MT: Do you have any new projects we can look out for?
DH: Let’s go with my quartet, Quadpod. It’s a modern Jazz quartet. My drummer, Konrad Kendrick: wicked grooves. Bass, Jon Hawes: extremely musical. Keys, Reggie Padilla: swings his butt off.
DH: How true! There is nothing like the sound of a live trumpet. That’s the pull that keeps me coming back for more. CDs, MP3s, even vinyl, can’t quite do it. Something about the way the acoustic sound vibrations move through the air. There’s an extra dimension present that the best equipment still cannot reproduce. When I hear the sound of a great trumpet player, it affects me in a way few things do. It hits me in my core. It’s as if it is speaking to me in a language that only I understand.
DH: Look out for my band, Subtonic Orchestra, to do a Snarky Puppy-type live performance/ recording, but with localstyle kanikapila flair!
MT: How did growing up in Hilo influence your music? DH: I don’t know, to be honest. It must be something in the soil. The Big Island grows some of the best food in Hawaii, it also produces some of the finest musicians. Some of the best musicians I know are from the Big Island, particularly Hilo. Come to think of it, Hilo is such a rainy, sleepy town, back in my day, if you couldn’t play outside ‘cause it’s raining (which happened a lot), there wasn’t much else you could do. So I’d stay inside and practice. Turned out to be a good thing.
MT: Do you have a dream venue? DH: The Superbowl would be nice. I would love to play the National Anthem a cappella at the Superbowl. MT: What’s your favorite part of the music process? DH: Composing, arranging and producing
MT: What piece of advice do you have for an up-and-coming musician? DH: First, pursue your dream. Second, find a mentor–someone who is living your dream. Third, be genuine in everything you do. MT: Complete this sentence: When people listen to my music, I want them to walk away feeling… DH: ...Like a secret part of them has been awakened, and will never be the same. ■ jen@mauitime.com + @jenrusso For more A&E news, visit MauiTime’s food blog at: mauivents.com
MT: Who is your biggest musical inspiration? DH: Ah, I knew this one was coming. It’s hard to pick just one. But if I had to, I would say Miles [Davis]. A truly uniquely talented individual. He was more than a great musician, he was a visionary, not afraid to do what no one else had thought to do yet. In that way, he continues to inspire me. MT: The Gannon's concert is a benefit for music education. Can you tell us why that’s important to you? DH: Without music education, kids would be left to discover music on their own. Very few would get past the pop music of their generation. It takes good teachers, educational programs, mentors and role models to expose kids to the wonderful, colorful, historically rich and diverse world of music. The more music you’re exposed to, the more inspiration you have to draw from.

Rage Against The Machine ‘Robocop’ is new, but not an improvement over the 1987 version Robocop ★★★★★ Rated PG13 / 102 Min.
W
hen I saw the original 1987 Robocop in a movie theater, a funny thing happened. During the final scene of the film, the title character commits a heroic act and saves a wealthy old man. The man says, “Nice shooting son, what’s your name?” Robocop turns to the man, and us, and replies, “Murphy.” For a character whose identity was stripped from him, it’s a triumphant, rousing declaration. Someone in the audience was so caught up in the moment, he yelled, “You’re damn right it is!” Everyone else in the auditorium started to cheer. As the end credits began to roll, you could feel the theater buzzing from the experience. Paul Verhoeven’s classic sci-fi action/drama may be absurdly violent, viciously satirical and thrilling in its spectacle but the human story at its center is still what makes it a masterpiece of its genre. At no point during Jose Padilha’s remake did I feel any kind of emotional connection to
anyone in it. Halfway in, there’s a sequence set to “If I Only Had a Heart” from The Wizard of Oz which made me wonder if everyone involved realized what was missing here. The story is mostly the same: Officer Murphy (played here by Joel Kinnaman) is murdered, re-born as a cyborg and fights crime in futuristic Detroit. The details of his high-tech resurrection reveal corruption at the highest levels, though Murphy’s greatest battle is to maintain the part of himself that is still human. To compare the remake to the original only points to where the screenplay made wrong turns and found missed opportunities. In the original, Murphy was executed in horrifying fashion by a memorably colorful gang of criminals we grow to despise. Here, Murphy’s demise is brought on by an impersonal car bombing. Also, the bad guys he pursues are uninteresting and scenes of his police work before donning the suit feel like outtakes from tired TV police dramas. Much emphasis has been put on Murphy’s wife (played by Abbie Cornish) trying to reconnect with her slain husband. Cornish has the same sleek hairstyle in every scene (it appears she is always ready to attend a gala) and doesn’t find the heart of her character.
Since when does Detroit have the budget for this?
Most critically, neither does Kinnaman. The man in the suit simply isn’t very interesting. Imagine Iron Man without Tony Stark and it might look like this movie. Sections of the Robocop remake are so promising that I thought the film would get better. The supporting cast is well chosen, with Michael Keaton (in a serious turn) and Jackie Earl Haley providing outstanding villainy and Gary Oldman gives his halfbaked scientist role some passion. As a TV personality on a FOX News-like show, Samuel L. Jackson brings welcome showmanship, though the most interesting thing about the character is the man playing him. Unlike the propulsive pace of the first film, the remake stops and starts without finding a rhythm. Padhila may not build a better machine but his action sequences are
impressive. When Robocop battles not one but three ED-209s, I was giddy with excitement. Likewise, a motorcycle attack on bad guys, set mostly in pitch black, is a stunning sequence. If only the quieter scenes had as much juice. The sight of Robocop without his suit is a shocker, though the special effect becomes overused. Shaky hand-held cameras during the action makes sense but serves no purpose during a scene with two people talking in a living room. While preferable to the totally awful Total Recall remake from two years ago, this Robocop makes the same mistake of shoehorning moments and sound bites for fans, demonstrating how much better they were done the first time. If someone wants to remake another Verhoeven film, will they please stay away from his sci-fi classics and just remake Showgirls? ■

Horoscope
Sign Language AQUARIUS (JAN. 20-FEB. 18)
Mission accomplished. Sometimes good things happen that way, like this week, when your best successes will occur almost totally by chance. If only all accidents were this happy. Don’t kick yourself for not thinking of the brilliance you stumbled on. You manifested your serendipitous circumstance somehow, if only subconsciously, and you deserve it. There’s plenty of time to plot a host of genius coups later. For now, enjoy your unplanned triumphs. No one else need know they were mostly unintentional. PISCES (FEB. 19-MARCH 20)
Second chances rock. Usually my initial stab at something is sloppy and terribly imperfect. But I gladly and gleefully repeat the activity as many times as it takes, each time improving and expanding on the last version, until I’ve refined my method. However workable my approach is, it’s also time-consuming and frustrating. That’s why I envy you weeks like the next two, where not only is any ambition easily within your reach, but you can conceive of accomplishing it in a way I can hardly imagine: Doing it once, without practice, and getting it exactly right, the very first time. ARIES (MARCH 21-APRIL 19)
The phrase, “too much freedom,” does not compute, in your world. Unfortunately, you’re in the minority; many people fear the great responsibility that comes with space and choice, and the self-motivation required; Most people just don’t know what to do with themselves most of the time, sadly. It’s a failure of courage and imagination I hope you’ll never be guilty of. However, don’t be too disparaging when people fall short of your standard. Excite and instigate, don’t judge and condemn. Your role as arbiter: tired. Your role as catalyst: inspired.
phans in your life. It’s misleading to think that you can make anyone mentally healthy, but you can facilitate healing by eliminating other distractions or obstacles to successful life strategies. For having such a selfcentered reputation, Leo, you sure feel good about helping other people—and in so doing, you help yourself. I guarantee you that for every person you lend a hand to, your peace of mind will increase accordingly.
Trust the universe, my beloved Bull. Before you pawn your precious heirloom jewelry to pay the rent, or sell your tender ass on the street corner to keep the electricity on, take a deep breath. Don’t panic, or sink into a doldrums of regret, deploring past extravagances. You will be taken care of before you’re forced to resort to extremes like those I mentioned. However, you might have to skimp—for a little while—on the lifestyle to which you’ve become accustomed. So what? Tighten your belt and console yourself that at least you’re thinner and cooler (poverty builds character) than you were before.
Impatient skepticism will be your predominant feeling this week, as you’re forced to endure annoyingly pointless events like canine birthday parties or poorlyorganized protest marches. Futile exercises like these don’t accomplish anything besides wasting time— something you chronically have too little of. However, I suggest you endure them with good grace, saintly patience, and a smile. Since they’re unavoidable (especially because shirking them would lead to more tedious or awful scenarios down the line), you might as well make the best of them. And who knows? They might do somebody, somewhere, some good. CANCER (JUNE 21-JULY 22)
It’s your party, and you’ll cry if you want to. Fine. But that’s been your attitude about a lot of things lately, and some of us are a little tired of it. Your adamant determination to feel bad about things that aren’t, in the grand scheme of things, all that bad, is confounding. I yield the point that you’ve had to deal with some shit lately, and you have every right to grouse about it. But keep in mind this one fact: The lousy times will continue as long as you whine about them—and only that long. LEO (JULY 23-AUG. 22)
Robin Hood, save us. Although no one expects you to actually steal from the rich to give to the poor, something akin to that feat is demanded of you this week, at least on an emotional level. Borrow from the well-adjusted (namely, you) to care for the spiritual or-

At 35 degrees Fahrenheit, the weather makes you crazy. The charcoal sky dumps chill rain over a perfectly good snowfall, converting those perfect, clean, beautiful expanses of pure white to foot-soaking gray slush piles for you to plod in. Don’t fret too much about the miserable state of your soul’s streets, since there’s nothing you can do about it until the frigid sludge makes its languid way into the sewers. In the meantime, slip into some hip-waders so you can do what you gotta do, slush or no.
Few take life more seriously than Scorpios. That’s why it seems odd that so many of you are so funny. You effortlessly elicit more smiles than whole hordes of clowning Geminis. I believe it’s because you’ve tapped into one of the essential truths of existence; if you can’t laugh at futility and unknowability—and, ultimately, tragedy—you might as well die now. Scorpions know venom; that’s why you make such amazing healers. Work your magic on the people around you— they need it more than usual right now. Make them laugh, cry, and laugh some more. Walls can be built many different ways. You can stack stones, mortar bricks, or pour concrete. Some are cheaper or faster, others are more durable but more painstaking to construct or too expensive. This week, although you feel compelled to erect an internal barrier against theoretical dangers, I suggest using the cheapest, fastest, most slapdash method you can conceive of. I predict that in a couple weeks you won’t feel so threatened by those perceived perils. Spend less time now, so you can spend less time later demolishing the suddenly useless blockade. If it needs emotional dynamite to come down, it’s too sturdy. If it’ll blow down under a strong sneeze, it’s just about right.

Before you embark on this whole trip about feeling persecuted, examine the circumstances surrounding your supposed discriminatory maltreatment. You may have reason to feel singled out, but the universe is not out to get you. During an extended visit at my friend’s house, his puppy chewed both pairs of shoes I’d brought with me, leaving the dozens of other sneakers, boots, and slippers next to them un-gnawed. I may have been the only one who suffered from his teething rituals, but I’m not feeling like Job. Nor should you. Accept that your solitary tribulations were unplanned and move on, already. CAPRICORN (DEC. 22-JAN. 19)
Cappies are hardly the most innocent sign of the zodiac, but you’re so closemouthed about your exploits that sometimes you come off that way. The truth is that there’s almost nothing you won’t try, given the right circumstance—and a certain amount of discretion. Often, the most important factor determining whether or not you’re up for something is “who’ll find out.” I urge you to discard that inhibition, at least temporarily, because it’s very important that you explore some interesting and slightly controversial stuff, in a setting where people will certainly notice. Instead of letting others’ potential knowledge thwart you from what you really want to do, assume everyone will find out, and…“So what?” To contact Caeriel send mail to sign.language.astrology@gmail.com.
