Pi‘iholo Zipline course

DOES UPCOUNTRY ZIPLINE FATALITY SIGNAL COMING REGULATION? It was a tragic death. Shortly before 10am on Thursday, May 1, Patricia Rabellizsa (29) of Kihei fell about 150 feet to her death on the Pi‘iholo Zipline course in Makawao. She was a company employee, and was working on that course when she fell. A May 6 Maui Police news release indicates that she wasn't wearing a safety tether when she fell. Though Rabellizsa’s status means that this was a workplace incident, and places it under the jurisdiction of the state Department of Labor and Industrial Relations (DLIR)’s Occupational Safety and Health (HIOSH) division, the state doesn’t regulate the zipline industry as a whole. But not surprisingly, just a few hours passed before state officials began calling for exactly that. “I did introduce a bill a year before the last accident [in 2011] and it is only after the accident that the bill got some traction,” Representative Mark Nakashima, D–Hilo, told KHON2 News the night of the accident. “We are back here once again and perhaps this is what it takes to get interest from the Legislature.” But like Thursday’s fatality, the 2011 accident on Hawaii Island involved employees working on an as-yet unopened zipline course. One person died and another was badly injured when a tower collapsed. HIOSH investigated that accident and concluded that the tower had been placed in soil that was too weak to hold it .(Experiential Resources Inc., which operates that course, disputed that finding.) One bill that would have regulated the zipline industry died in the Legislature in 2012. Called SB 2433, it would have called on the state DLIR to oversee the industry. In October 2012, the Hawaii

Auditor’s Office released a report on the bill and the possibility of regulating the zipline industry. Titled Sunrise Analysis: Regulation of Ziplines and Canopy Tours, the report concluded that even given the 2011 fatality, “there was insufficient data of serious harm to the public to warrant regulation.” It also reported that the two Hawaii agencies mentioned as possible regulators lacked the resources and expertise to do so. Concerning the DLIR the Auditor’s Office found that it had “a multi-year inspection backlog of 5,000 elevators and is not inspecting attractions that fall under its jurisdiction for amusement rides” and was “not capable of handling its current duties let alone another inspection program, especially without significant additional resources.” That alone is a scandal. But to be fair, that was also two years ago. According to Bill Kuntsman, the DLIR’s spokesperson, the passage of Act 103 that year added 10 positions to the department, allowing it to make progress in catching up on its inspection backlog. It also placed the department’s Boiler and Elevator Branch, which handles those inspections, on special funding. The result is that they’ve

“made significant progress on reducing the elevator inspection backlog,” Kuntsman told me. “In 2011, there was a 75 to 80 percent backlog in annual inspections. Last year, I think we were at about 30 percent.” The other agency mentioned as a possible regulator was the Department of Commerce and Consumer Affairs (Rep. Angus McKelvey, D–West Maui, mentioned this as late as the KHON2 news article cited above). The state Auditor said that this agency “lacks the capability and authority to inspect accident sites, assessing cause and operator culpability in the event of significant accidents or fatalities.” But even if the state were to find a suitable regulator, does the industry, which has about 22 companies statewide, need it? “[W]e estimate that around 2,000 people ride on ziplines and canopy tours each day in Hawaii, or more than 700,000 per year,” the 2012 Auditor’s report noted. As far as customer fatalities go, there haven’t been any. While customers (who must sign liability waivers, and in any case are engaging in a “thrill-seeking” activity that’s popular precisely because of its perceived dangers) have been injured on Hawaii ziplines, the Auditor’s report found that “some of the worst injuries experienced by some operators occurred to people walking on the property.” What’s more, “the most common cause of injury is human error, primarily participants’ failure to follow instructions.” Only about a dozen states nationwide regulate zipline companies, according to the Auditor’s report. Of those, just Florida actually includes state inspections as part of its oversight. The rest conduct “paperwork reviews” only. According to the Auditor’s report, “The DLIR believes industry inspections lack rigor, and a paper review would provide a false sense of security to the public.” What’s more, the Auditor’s office reported that the DLIR estimated that paying for regulations would require “$400,000 initially and $350,000 each year”–money that would come from a “fee per operate of about $18,000, and $15,000 each year thereafter.” If that seems steep, it’s only because it is: the Auditor’s office dryly noted that license fees for zipline operators in other states

typically ran between $25 and $2,000. Though the next Legislative session doesn’t start for another eight months, expect to hear a lot more about this before then.

A&B SOMEHOW FORGETS BIG DONATIONS FROM A&B PR Leave it to Alexander & Baldwin to tell us what wonderful, charitable souls they are. On Apr. 29, the company sent out a news release saying that from July 2012 (when the company divested itself from Matson Navigation) to the end of 2013, their Kokua Giving Program had donated $1.3 million to various organizations dealing with health, education, culture and the arts. The news release quotes Meredith Ching, A&B’s senior VP for government and community relations, on the donations: “A&B’s roots are in Hawaii. It’s where we have a responsibility and an opportunity to help shape the community, and where we believe we can make a positive impact. In addition to our corporate charitable giving, A&B employees volunteered countless hours of their time to numerous charitable causes including building playgrounds, cooking and serving meals, cleaning parks, leading fundraising walks and providing leadership for a broad range of charitable organizations. These are just a few ways A&B makes a difference throughout the state and, are reflective of our commitment to our friends and neighbors.” That’s all fine, but I think the company’s really selling itself short, so to speak. I mean, during that same time period, A&B’s two political action committees (PACs) donated a little more than $80,000 to various political candidates, incumbents and organizations. For instance, Federal Election Commission records show that during the same period, A&B’s federal PAC gave $39,000 to committees representing Democratic U.S. Senator Mazie Hirono ($2,500), Democratic Representative Tulsi Gabbard ($2,500), U.S. Senate candidate Colleen Hanabusa ($10,000) and the Democratic Party of Hawaii ($4,000). What’s more, State of Hawaii Campaign Spending Commission records show A&B’s HI Pac donated a little over $41,000 to a wide variety of state and local candidate committees during that same period, including every Maui County Council member except Elle Cochrane. Oh, and on Oct. 5, 2012, the PAC also gave former County Council member Dain Kane $100. They gave $100 to Kane, who hasn’t won an election since 2004? In April, Haagen-Dazs announced it will introduce two new ice creams (thankfully, only in Japan): carrot orange (with bits of pulp and peel) and tomato cherry (made from tomato paste). Cornell University graduate student Michael Smith, disappointed at the paucity of research on the pain of honeybee stings, decided to evaluate the stings himself (but in line with the Helsinki Declaration of 1975 on safe selfexperimentation). Smith’s protocols required five stings a day on various body locations for 38 days–at least three on each of 25 body areas. The worst, according to his pain index, were the nostril (9.0) and the upper lip (8.7).

And once again this year, the Toads on Roads charity in Sleaford, England, called for volunteers in February to police a highway where post-hibernating female toads carry horny males on their backs across a road to mate in marshes. Without help, said the charity, up to two-thirds of the amorous toads would not survive oncoming cars.

LEAST COMPETENT CRIMINALS An unnamed “gangland” bomber was killed in March in Dublin, Ireland, when the payload exploded prematurely. The detonation occurred on the morning of March 30, which marked the daylight saving time change in Ireland, and police concluded that, most likely, the bomber had forgotten to set the timer ahead that morning, which would have given him up to 60 more minutes to plant the bomb and leave. In 1999, two Palestinians, operating on West Bank time, but carrying bombs to the Israeli cities Haifa and Tiberius, which had already advanced their clocks that morning, were blown up–along with only one bystander instead of the dozens or hundreds planned for. ■

2014 Summer Movie Preview Hope you like sequels... It’s been 25 years since the landmark Summer of Sequels swept America. The movie season of May-September 1989 had a then-record eight sequels in theaters (including Indiana Jones and the Last Crusade) and created lines that famously stretched far outside the theaters. Most memorably, Bat-Mania took over the world, as Tim Burton’s Batman set the standard for the Comic Book genre, bringing enough prestige, artistic integrity and gigantic success to make a Joker smile. Here’s a dozen of this season’s most promising looking entries to keep us laughing and clutching our seats (in air-conditioned theaters) all summer long... NEIGHBORS (Opens May 9) The Gist: Responsible slob/middle aged dad (Seth Rogen) vs. chiseled/party animal frat boy (Zac Efron). The Good News: Test screenings had audiences roaring and the trailer suggests another raunchy Bridesmaids, The 40Year Old Virgin or Superbad. The Bad News: Will the hard-R rating deliver the goods or will this be a bigger put-off than The Hangover Part III? Can the skit-worthy “story” sustain 96-minutes? GODZILLA (Opens May 16)

EDGE OF TOMORROW (Opens June 6) The Gist: It’s Groundhog Day meets Starship Troopers. Tom Cruise and Emily Blunt star, action ace Doug Liman directs. No joke–the original title was All You Need is Kill. The Good News: Liman helmed The Bourne Identity and Mr. and Mrs. Smith. Cruise needs no introduction and the trailer looks exciting. The Bad News: Could play like Liman’s previous high-concept, f/x-driven thriller Jumper. Should Cruise be doing another sci-fi blow-’em-up so soon after Oblivion? THE SACRAMENT (Opens June 6) The Gist: Horror film fictionalizes the nightmarish atmosphere of the Jim Jones cult. The Good News: Acclaimed film festival entry finally makes its way to theaters. Writer/director Ti West is terrific with suspense and creating anticipation. This is also the only horror film opening this summer. The Bad News: West’s endings have famously fallen short and don’t live up to the build-up. Will this one actually open or, like his others, barely play in theaters before premiering on iTunes VOD? 22 JUMP STREET (Opens June 13)

Another day at work for Hercules

JERSEY BOYS (Opens June 20) The Gist: Based on the smash Broadway musical, the troubled life of pop star Frankie Valli. The Good News: The soundtrack is terrific and director Clint Eastwood knows how to tell a great story. A musical where everyone knows the songs and Valli’s story is a compelling underdog tale. The Bad News: No-name cast and an odd choice for summer (feels like a Christmas movie). Rock of Ages supposedly couldn’t miss, either. The CD sales might be mightier than the box office. X-MEN: DAYS OF FUTURE PAST (Opens May 23) The Gist: Time travel allows the original Mutants to share the screen with the cast of X-Men: First Class . Hugh Jackman, Patrick Stewart, Ian Mckellan, Michael Fassbender and Jennifer Lawrence star.

The Gist: Gareth Edwards, director of the wonderful Monsters, helms this nononsense, large scale revision of the classic Japanese monster mash.

The Gist: Jonah Hill and Channing Tatum are back. More importantly, so are Ice Cube and Rob Riggle.

The Good News: Almost the entire cast of the series returns to bring the franchise back to the glories of the first two entries.

The Good News: A strong, all-star cast, including Bryan Cranston and Ken Watanabe, along with Edwards’ skillful blend of story and vivid f/x, make this a must-see.

The Good News: The original was hilarious. With the same cast, crew and writers, it appears lightning could strike twice. Cube’s beefed up role (and Tatum’s surprise flair for comedy) will keep ‘em laughing.

The Bad News: Patient fanboys have endured more than one lousy X-Men sequel. The planned X-Men: Apocalypse in 2016 sounds more like a threat than a treat.

The Bad News: Looks awfully serious and heavy-handed. If it stomps with heavy feet and is even less “fun” than the idiotic 1998 reboot, fanboy adoration could give way to shattered expectations (and buildings).

The Bad News: Legally Blonde 2 , Big Mamma’s House 2, The Whole Ten Yards, Beverly Hills Cop II, Miss Congeniality 2 and Ghostbusters II were not as good as the original. Comedy sequels are tough.

BOYHOOD (Opens July 11) The Gist: Starring Ethan Hawke, director Richard Linklater’s one-of-a-kind comedy/drama of a young man’s baby-topreteen stage has been filming for years. The Good News: The rave reviews, gimmick of a film shooting for 12 years (so the little boy actor could age on screen) and Linklater’s reliable skill make this the gotta-see-it art film of the summer. The Bad News: Will the puberty years be as painful to watch as it was for most of us to experience? DAWN OF THE PLANET OF THE APES (Opens July 11)

Matt Reeves and Andy Serkis as You Know Who are the MVPs. The cast includes Jason (Zero Dark Thirty) Clarke, Keri Russell, Gary Oldman and Judy Greer. The Bad News: Rise of the Planet of the Apes was surprisingly terrific and a tough act to follow. Any sci-fi fan knows the ending is a given. Serkis is a genius but can CGI Caesar carry his own movie? HERCULES (Opens July 25) The Gist: Dwayne Johnson is Hercules! Brett Ratner directs, swimsuit model Irna Shayk co-stars The Good News: Johnson is typecast playing a God Among Men. No one will remember or care about The Legend of Hercules flopping back in January. The trailer is gloriously silly and full of CGI beast battles. The Bad News: Is Ratner really the guy for this pulpy material? John Hurt and Ian McShane have roles but is anyone expecting Shayk (or anyone else here) to put in a real performance? LUCY (Opens Aug. 8) The Gist: Scarlett Johansson stars as a chemically enhanced super agent in this action/thriller. The Good News: The Director is Luc Besson, “the Spielberg of France” who gave us La Femme Nikita, The Professional and The Fifth Element. Looks like the perfect solo action vehicle for Johansson. The Bad News: Besson writes piles of hit screenplays but hasn’t directed a good movie in years. THE EXPENDABLES 3 (Opens Aug. 15) The Gist: Sylvester Stallone, Jason Statham, Arnold Schwarzenegger, Jet Li, etc. The Good News: Harrison Ford, Wesley Snipes, Mel Gibson, Antonio Banderas, Dolph Lundgren, some kid from Twilight, a couple of tanks, small mountains of TNT, shattered glass and triumphant fist-bumping. The Bad News: Plot? And how come they’ve done three pictures, but we still haven’t seen Steven Seagal or Jackie Chan? C’mon, Sly! ■
