MORE HALEAKALA TELESCOPE ARRESTS

MRA TALKS PAID PARKING IN WAILUKU THIS WEEK Early this year, I wrote about the distinct possibility that parking meters might be coming to Wailuku Town in the near future. It’s something planning consultants have been talking about for some years now. “[B]ecause there is currently a high level of dedicated parking enforcement, we believe the meter collection rates will be high in Wailuku Town if meters are installed,” consultant Andrew Miller wrote in his 2013 report Wailuku Town Parking Study And Parking Management Plan Analysis. “Also, if meters or some other form of paid parking technology is deployed on-street and in the County public lots, the current enforcement operation will be more efficient resulting in a higher level of compliance and maximized parking revenues.” Well, looks like that future is getting closer. On Friday, Aug. 28. the Maui Redevelopment Agency (MRA) will take up a number of issues, all of which are parking-related. The agenda shows that the big new item involves the potential

“use of Capital Improvement funds for the construction of additional parking at the Wailuku Municipal Parking lot” but “old business” includes items like the “Parking Pricing RFP” and discussion on “Revisions to Parking ordinance” that will involve parking meters. The meeting takes place at 1pm at the Planning Department Conference Room, which is located on the first floor of the Kalana Pakui Building (250 S. High St.) in Wailuku.

WHICH MAUI COUNTY TOWN HAS THE MOST ASHLEY MADISON USERS? So earlier this week OC Weekly put up a great little blog post about Malfideleco, a Spanish website that uses data visualization to break down last week’s massive Ashley Madison data dump (for those still new to the Internet being on computers, Ashley Madison is a (theoretically, now since disproven) anonymous dating site for people who want to cheat on their spouse). In no time at all, I clicked over to Malfideleco, searched for Maui,

users and the male percentage of those users for 15 Maui County towns (10 on Maui, one on Lanai and four on Molokai). Given the county’s relatively small population, the user numbers are also small. But they break down in pretty interesting ways: MAUI Kihei: 1,504 users Lahaina: 1,075 users Kahului: 954 users Wailuku: 924 users Makawao: 569 users Haiku: 392 users Kula: 369 users Paia: 175 users Pukalani: 60 users Hana: 42 users LANAI Lanai City: 60 users MOLOKAI Kaunakakai: 62 users Maunaloa: 24 users Hoolehua: 15 users Kalaupapa: 11 users

The Daniel K. Inouye Solar Telescope (DKIST to its friends in the astronomy world) that will sit with the other scopes at the Haleakala summit is nearly complete. In the planning and construction stages for easily the last decade, the life of the DKIST has largely been quiet and peaceful. But that ended a few months ago when native Hawaiian activists on the Big Island began protesting the proposed Thirty Meter Telescope atop Mauna Kea. It wasn’t that long ago that crews driving big tractor-trailer rigs loaded with telescope gear and equipment could expect an uneventful early morning run from the Maui County Baseyard to the Haleakala summit. But those days are over. Now, every announcement from Haleakala National Park that Haleakala Crater Road will close for a day or two to allow construction equipment and supplies up the mountain is a call to arms for local protesters, who say the new scope is an affront to the sacred mountaintop and native Hawaiian culture in general. The most recent such run-in took place on the night of Aug. 19. According to the Maui Police–which sent a large contingent of officers to the Baseyard–about 150 protesters showed up before the DKIST trucks could get up the mountain. Still, the cops didn’t arrest anyone and the trucks were able to leave the Baseyard. Protesters much further up the mountain had different ideas. “Once the convoy reached the area of Haleakala Crater Road (378) police encountered trees, rocks, and glass on the roadway,” stated the official Maui PD news release on the incident, which was sent out on Aug. 20. “Protesters were also seated on the roadway in attempts to block the convoy from passing. Police officers made multiple requests for the protestors to abstain from blocking the roadway, but, some refused. As a result, seven (7) adult males and one (1) adult female were placed under arrest. No juveniles were arrested.” To me, this is fascinating–especially when I think of a few events that have happened in Maui County over the last year that could have invited serious road-closing, slap-thecuffs-on protests: new hotel resort construction in Ka‘anapali; the state Legislature making it possible for Maui Memorial Medical Center to partner with a private

hospital provider; Maui Police shootings. The last one–two shootings, actually, in the last couple of months–are especially problematic. Not because the officers involved may have acted inappropriately (on the contrary, news accounts make clear that both shootings were most likely justified) but because the MPD never identified the officers who were involved. Cops in most cities and towns who use deadly force end up getting their names in the paper–it’s called being accountable to the general public–but not out here on Maui. And judging by what gets people outraged and into the streets, that’s perfectly fine.

Kihei has the most users? Sure, we believe it. But 11 users in Kalaupapa? The population at the former Hansen’s Disease colony barely reached 90 in the 2010 census… In any case, the data shows that Ashley Madison users are about 80-90 percent male across the county (which must make for some fascinating encounters for the few females who’ve joined the site). As for which town has the highest percentage of male users, that would be Hoolehua on Mokokai with 93.3 percent of their 15 users (that would about 14) being male. UH MAUI COLLEGE GETS EARLY CHILDHOOD ED. ACCREDITATION Want to receive an associate degree in Early Childhood Education in a nationally accredited program? Don’t want to leave Maui? Then here’s some good news: the ECE associate degree program at University of Hawaii Maui College was recently accredited by The National Association for the Education of Young Children (NAEYC). This year, 10 institutions across the country were granted accreditation for an associate degree; the total number of accredited programs nationwide is now 180. The program accreditation is the first for the state of Hawaii. “We are proud to be the first in Hawaii to achieve NAEYC accreditation for the associate degree,” said Elaine Yamashita, Professor and Early Childhood Program Coordinator at UH Maui College. “The process of improvement that we continue to engage in and validate by accreditation assures our students, college, and community in our tri-island county that we value and support student learning and

What started with much fanfare has now seemingly ended in flames. When restaurateur and chef Beverly Gannon announced her partnership with Chef Roger Stettler and Greg Shepherd of Island Restaurant Management in January, I had dreamy expectations of a new restaurant trifecta on Maui. But as we all know, reality can bite. And today it bit hard, according to the press release from Ten Foot Design that popped in my email on Aug. 19: “Earlier this year Ms. Gannon entered into a business arrangement with Greg Shepherd and Chef Roger Stettler, of Island Restaurant Management, that provided them with full autonomy of the Wailea location and plans for a full buy-out in Fall 2015,” stated the news release. “Mr. Shepherd and Chef Stettler decided to re-concept the restaurant as Joe’s Nuevo Latino, featuring foods inspired by Latino communities around the world. The restaurant opened on May 6, 2015. “Unfortunately, after less than 4 months, the concept and management proved unsuccessful and the new team was unable to meet the financial obligations of the restaurant. As leaseholders of the Wailea location, Bev

and Joe Gannon were obligated to step in and assess the situation. After careful review, the Gannon’s determined that Joe’s Nuevo Latino must close effective immediately, they have terminated all business agreements with Mr. Shepherd and Chef Stettler, and resumed control of the restaurant space.” The restaurant had been transformed from Joe’s Bar and Grill–a comfort food bistro–and rebranded into Joe’s Nuevo Latino, which celebrated Latin food fusion. For now the restaurant is closed, but the Gannons are looking at options for reopening, including possibly retaining a “working relationship” with Chef Gary Johnson, the executive chef of Joe’s when it closed. Bev Gannon continues to operate her restaurants Hali‘imaile General Store, Gannon’s, A Pacific View Restaurant and her catering company Celebrations Catering & Events. Stettler and Shepherd continue to run their restaurant Cow Pig Bun in Kihei.

NEW MAUI ARTS LEAGUE WANTS WESTSIDE FINE ARTS MUSEUM The West Maui Cultural Council is trading in its name for an ambitious vision that could (would?) rival the Metropolitan Museum of Art. The new Maui ARTS League aims to open a visual fine arts museum in Lahaina that would showcase wonderful pieces on its walls that you won’t even need to feel bad about for not buying. “Lahaina has several art galleries and has become an art mecca for visitors and residents,” said Maui ARTS League President Lois Reiswig in an Aug. 19 press release. “We have historical museums, but we believe a permanent arts museum, open to the public, will be a very positive addition to our community.” Museum visitors can be the connoisseurs they know they truly are and take chic pictures in front of the permanent collections and

event spanning a week of art that’s known as the Maui Plein Air Painting Invitational. This isn’t just a humble gathering of artists who share brush stroke and clay kneading techniques in a circle. The event sells around “$100k worth of freshly painted original artworks” to the large crowds who come to witness artists painting on site. Twenty-six individuals will manifest their imaginations onto the canvas for spectators in next year’s event from Feb. 13-21, 2016. The critically appraised artists do more than flaunt their creativity for the crowd; they also relay their expertise to local artists in workshops, a rare learning experience for those with financial constraints that hinder them from buying plane tickets for mainland workshops. The success of the last 10 events serves as evidence for the promise of the upcoming visual fine arts museum. “The worshipful treatment of pets may be the thing that unites all Americans,” wrote an Atlantic Magazine blogger in July, describing the luxury terminal for animals under construction at New York’s JFK airport. The ARK will offer shower stalls for traveling horses, “conjugal stations” for ever-horny penguins, and housing for nearly 200 cows (that might produce 5,000 pounds of manure every day)–and passengers traveling with dogs or cats can book the Paradise 4 Paws petpampering resort. The ARK is a for-profit venture; said one industry source, quoted in a July Crain’s New York Business report, “You hear stories about the crazy money that rich people spend on their [animals]... they’re mostly true.”

GOVERNMENT IN ACTION Officially, now, it is “unreasonable” for a federal agency (the Bureau of Land Management, in this instance) to fail to say yes or no for 29 years to a drilling permit application. (Before July’s federal court decision, BLM had been arguing that 29 years was not too long.) A company had requested to drill just one exploratory well in Montana for natural gas in 1985, but the bureau had delayed the proceeding six times since then. The judge ordered the bureau to set a deadline for deciding.

GEORGIA NEEDS TO LIGHTEN UP Georgia, one of six states that make taxpayers shell out huge fees to access its databases of public records, tries so relentlessly to control its archive that, recently, in a federal lawsuit, it said opposition to its policy was basically “terrorism.” Activists (Public.Resource.org) have been establishing workarounds to free up some databases for citizen use, and Georgia demands that they stop. Georgia even claims “copyright” protection for one category of important legal documents that were initially drafted by state bureaucrats, audaciously calling them “original” and “creative” works.

In July, the mayor of the town of Ador, Spain (pop. 1,400), officially enacted into law what had merely been custom–a required afternoon siesta from 2pm to 5pm. Businesses were ordered to close, and children were to remain indoors (and quiet).

POLICE REPORT At a traffic stop in Rockingham, Vermont, on July 26, both driver and passenger were charged with DUI. Erik Polite, 35, was the driver (clocked at 106 mph on Interstate 91 and, according to police, with drugs in the car), and while he was being screened for intoxication,

passenger Leeshawn Baker, 34, jumped behind the wheel and peeled off in reverse across the highway, nearly hitting the trooper, who arrested him.

LOADED SNAKE ATTACKS Nathaniel Harrison, 38, was arrested in July in a Phoenix suburb on several charges, including possession of a deadly weapon during a felony, but he escaped an even more serious charge when a second “deadly weapon” failed to engage. Harrison reportedly intended to retaliate against a “snitch” and arrived at the man’s home carrying a rattlesnake, which he supposedly pointed at the man, hoping it would bite him. However, the snake balked, and Harrison’s attempted payback failed.

LAME DEFENSE IN LAKE COUNTY, FLORIDA Daniel Baker, 40, and Robert Richardson, 19, were arrested in Altoona, Florida, in August after getting caught loading appliances from a vacant house. According to the arrest report, both men appeared incredulous to learn that items in a vacant house aren’t just “free.” And six days earlier and about 20 miles away in Tavares, Florida, Corey Ramsey, 23, was arrested for burglary when a police officer caught him sitting on a toilet in a vacant, for-sale house attending to a need. Ramsey’s extensive petty-crime rap sheet belied his explanation for being there–that he was contemplating buying the $299,000 house and wanted to try it out first.

STILL MORE ‘INTELLIGENT DESIGN?’ Zoologists at the University of Basel in Switzerland, publishing recently in a prestigious British journal, reported the likelihood that a certain flatworm species has overcome the frustration of not finding a mating partner in its lifetime. The scientists believe the flatworm exploits its hermaphroditic qualities and injects its sperm into its own head, from which the sperm sometimes migrates to its reproductive facilities. (Flatworm researchers are aided on their projects by the species’ transparent bodies, facilitating the tracking of the sperm.)

PROTEST! About 200 protesters gathered in front of Hong Kong police headquarters on August 2 to denounce the three and a half month jail sentence given to Ms. Ng Lai-ying, 30, who was convicted of assault for shoving a police officer with her chest. Power Game The case against the Hawaii Electric Industries/NextEra merger By Anthony Pignataro

I

n Hawaii, a chain of islands in the middle of the largest ocean on Earth, the vulnerability of our power generation couldn’t be more apparent. Shipping in fossil fuels isn’t a mere luxury–it’s a potential disaster. Cut off the oil, and in no time at all our state returns to the 19th century. It’s a weak point state officials finally addressed this year with the passage of House Bill 623, a bold mandate that 100 percent of the energy used by the state’s utilities will be from renewable sources by the year 2045. “Hawaii’s dependency on imported fuel drains our economy of billions of dollars each year,” states the bill, which Governor David Ige signed into law in June. “A stronger local economy depends on a transition away from imported fuels and toward renewable local resources that provide a secure source of affordable energy. The legislature further finds that alternative energy technologies have ad-

vanced significantly in recent years, leading to an explosion of new markets, jobs, and local energy sources.” For this reason, everyone seems to take notice when the parent company of the state’s public power utilities announces that it wants to merge with a corporation headquartered 5,000 miles away. In February, Florida-based NextEra Energy (NEE) announced that it wished to merge with Hawaiian Electric Industries (HEI), which owns the state’s power utilities, including Maui Electric (MECO). It’s a controversial plan, facing considerable opposition (Ige, Maui Mayor Alan Arakawa and Sierra Club Hawaii all want the merger rejected). Then on Aug. 10, the office of the Hawaii Consumer Advocate weighed in with 548 pages of testimony on the merger. The testimony (a small portion of which was redacted because of “confidentiality” reasons) came from five consultants hired by the

Consumer Advocate, and all had extensive experience in the world of public utilities and mergers. Though long and often repetitious, the massive package made one thing perfectly clear: despite the NextEra’s and HEI’s insistence that the merger would lead to at least $60 million in rate-payer savings over the first four years, the deal would likely be bad for the public (after the Consumer Advocate released the testimonies, NextEra announced that, in fact, the merger would lead to a billion dollars in consumer savings). The state Public Utilities Commission (PUC) still has to approve the merger, and they’ve scheduled a few hearings to take testimony from the public. The first will take place on Maui on Sept. 4. Reading 548 pages of testimony on a utility merger is a lot to ask of working people, so we did the heavy lifting and read through the whole damn thing.

Consider this a Top 40 list of the reasons why the merger may not be in the best interests of Hawaii consumers: 1. Ian Chan Hodges, a Maui resident and managing member of Responsible Markets LLC, started right off by throwing cold water on why the merger should happen in the first place. “The Applicant has neither offered a credible rationale for why the proposed transaction would be a net benefit to the state’s economy nor provided a plan for how the post-transaction entity will better serve the diverse communities within the five islands where the HECO companies operate,” Chan Hodges said. 2. It’s also an open question as to whether NextEra even understands the state it wants to start doing business in. “Because Hawaii is an island society with mauka (mountains) and makai (ocean) providing orientation for navi-

There’s no evidence, according to Brosch, that such a rate hike moratorium would really help ratepayers. “[Applicant consultant John] Reed’s claim that a moratorium is beneficial to ratepayers presumes, with no supporting analysis, that present rate levels are not excessive today and will not become excessive throughout at least four future years, even after realization of the significant costs savings that he has estimated will be enabled by the proposed Transaction,” Brosch testified.”

gation as well as natural separation between many of Hawaii’s neighborhoods, very distinct communities have developed with specific needs,” Chan Hodges said. “NextEra has also not put forth a plan that demonstrates that it understands this basic reality of Hawaii.” 3. Merger documents show company officials like to talk about the concepts of kuleana, malama pono and aloha, but Chan Hodges doesn’t really buy that these are anything but buzzwords to NextEra. “Kuleana, malama pono and aloha are not just a triple bottom line for Hawaii,” Chan Hodges testified. “They are values that when lived out will provide a foundation from which to embrace the disruptive innovation necessary to achieve the hopes and dreams for Hawaii’s energy future identified by the governor.” 4. And out here in Hawaii, these ideals resonate strongly with both residents and public officials. NextEra would do well to respect that. “In order to be successful overall in Hawaii (not just with its Change of Control Application), NextEra needs to make it clear to HECO employees, HECO customers (95% of the state’s population), the Commission, as well as state and county leaders, that it understands, embraces and is willing to be held accountable for upholding Hawaii’s values,” said Chan Hodges.

Chang also found it disconcerting that “the Applicants have claimed a benefit for its charitable contributions by maintaining the status quo of the Hawaiian Electric Industries’ (“HEI”) current contribution levels. While it is laudable that NextEra has committed to maintain charitable donations for the Hawaiian Electric Companies at

The Consumer Advocate testimonies are largely concerned with the savings NextEra and Hawaiian Electric Industries promise, which at the time were confined to about $60 million (not the $1 billion figure the companies threw out after the testimonies were made public). Nonetheless, Steven G. Hill–a self-employed financial consultant from Virginia–said that “while it is possible that there could be financialrelated cost reductions realized as a result of the proposed transaction, those cost reductions are not certain and, if realized, are likely to be less significant than depicted by the applicants.”

14. Oh, and electricity consumers in Hawaii already pay excessive rates. “Twice in the annual decoupling filings with the Commission over the past three years, HECO and then MECO submitted calculations showing they earned in excess of their authorized return on equity in the prior calendar year, resulting in earnings sharing credits to ratepayers,” Brosch testified. 15. Brosch even has evidence for this: “The recent actions taken by HECO and MECO, in filing rate case applications and then not asking for the revenue increases supported therein, also undermines the credibility of any assumption that large future rate increases would suddenly be needed.” 16. What’s more, Brosch said the timing of the end of that rate hike moratorium just doesn’t make a lot of sense. “The expiration of Applicants’ proposed rate credits in year five would be occurring about when integration work is be-

For that reason, Brosch suggests that the Public Utilities Commission impose a real rate reduction on the companies. “If the Transaction is approved by the Commission, I recommend that presently effective base rate levels for each of the three Hawaiian Electric Companies be permanently reduced, across all rate schedules, by 0.7 cents per kWh ($0.007) effective at the date the proposed Transaction is consummated,” Brosch said. “This level of ‘up-front’ rate reduction would impact annual revenues across the three utilities by about $62 million annually, reducing a typical residential customer bill by about $4.20 per month.” 18. Hill agrees. “It is appropriate to reduce rather than freeze the utilities’ existing base rates, if ratepayers are to participate in lower capital costs and be credited with a reasonable share of projected merger cost savings.” 19. The companies also project cost savings in regards to corporate debt. But Hill says this is also problematic. “For example, the debt cost savings estimates are based primarily on the Companies’ focus on one credit rating agency (Standard & Poor’s or “S&P”) that expects an improvement in HECO’s bond rating if the proposed Transaction proceeds,” he testified. “However, the two other major credit rating agencies expect no change in bond rating for HECO.” 20. And that’s not good. Neither is this, says Hill: “NEE has more financial risk than HECO because, on a consolidated basis (i.e., including all of the companies owned by NEE) the parent company uses more debt to capitalize operations than HECO does.” 21. Because, Hill testified, it means that “NEE does not need HECO to issue debt or to use HECO assets to secure that debt. If the proposed transaction is completed, NEE will own the revenue Continued on page 13

Financial consultant Michael Brosch, the president of the firm Utilitech in Kansas City, Missouri, agreed that pinning down cost savings isn’t easy. “The Applicants’ cost savings estimates are not detailed, are not broken down by year, and have not been netted against the costs that must be incurred to achieve such savings.” 10. Of course, Brosch also points out that “there is a meaningful difference between realized cost savings for the utility and realized cost savings that are translated into tangible benefits for utility customers.” 11. Much of the savings that NextEra and HEI are promising to pass on to consumers comes in the form of a four-year moratorium on future rate hikes that would commence after the companies merge. Hill testified that this moratorium “would suspend increases that would otherwise occur” but “the Applicants state that the

result from future use of NextEra’s aviation fleet for travel to and from Hawaii, adding significant new costs that may be sought for recovery from ratepayers,” Brosch testified.

22. Hill discusses corporate debt at length in his testimony because “NEE’s financial engineering requires regulated ratepayers to shoulder some of the operating risks of its unregulated operations through capital costs that are higher than they need to be.”

For this reason, Hill recommended that the PUC call for additional protections–which he called “ringfencing”–for the utilities from corporate influence. “In order to ensure that the financial risks residing at the parent company level do not affect the operations of the HECO Companies it would be necessary to include additional ‘ringfencing’ requirements that would prevent parent company access to Hawaii utility subsidiary assets in the case of financial distress or bankruptcy by the parent,” Hill testified.

23. Hill added that once the merger is approved, the new company will be able to issue new debt without regard to Hawaii’s utility needs or the PUC. “Once it owns the assets, NEE does not require any action of this Commission or guarantee by HECO in order to issue debt,” Hill testified. “Therefore, the pledge that HECO will not make loans to NEE or will not se-

more difficult for the Commission.” 30. But transparency means more than simply providing everything to investigators. The layout of the postmerger company may simply be too complicated to understand. “As the corporate operation becomes more complex, through the addition of one or more parent company levels, the transparency of the financial and accounting processes that ultimately affects utility rates dwindles,” Hill testified. “[F]ollowing approval of the pending transaction, it would be much more difficult for this Commission to assess, in the same manner that it now does, the operating and financial influences on HECO and its rates.” 31. And we haven’t even got to the fact yet that, for much of the state, the reliability of the electrical utilities has been pretty poor through the years. In fact, in his testimony Chang couldn’t help but point this out. “While the Hawaiian Islands have unique circumstances and challenges with reference to reliability, that should not be an excuse for the Hawaiian Electric Companies to have third or fourth quartile reliability relative to other utilities consistently year to year,” Chang testified. 32. And the merger’s supposed to make reliability issues better, right? Right? Chang would agree, but he’s just not seeing that commitment in the documents the companies have handed over thus far. “My concern is that the Applicants’ reliability commitment is unknown at this time and is contingent upon the Commission’s approval of the merger.”

33. Chang also testified that NextEra’s commitment to using renewable energy–a requirement given the mandates laid out in the state’s new law cited above. “I am concerned that while NextEra does have a large renewable energy portfolio, almost all of the portfolio is associated with NextEra’s unregulated business and almost none of the renewable energy assets are located in FPL [Florida Power & Light–the utility NextEra already owns], with the exception of 35 MW of utility-scale solar.”

This kind of arrangement spells trouble for Hill. “As HECO witness Sekimura noted, I believe correctly… ‘there may be situations in which upstream NextEra subsidiary activities could impact their credit ratings which in turn could affect the credit ratings of Hawaiian Electric,’” Hill testified. 25. Brosch was even concerned that NextEra execs could try to pass off their costs of doing business in Hawaii on consumers. “The Consumer Advocate is concerned that significant new charges to the Hawaiian Electric Companies may

Should HECO ever wish to declare bankruptcy, Hill said it shouldn’t happen without the approval of that independent director. 28. If it’s starting to seem like corporate transparency might be an issue, it’s because it is. “The Applicants have not provided any information satisfying the Consumer Advocate’s concern that the HECO Companies could see higher shared services costs post-merger,” said Steven Carver, who also works with Brosch at Utilitech. 29. Oh, and Hill also testified that he believes “Applicants are making access to the parent company’s books and records

Because, damn: “I am concerned that of the 44,670 MW of generation in the combined NextEra Energy and FPL portfolio, only 35 MW of renewable energy in the form of solar PV is currently located in Florida,” Chang testified. 35. Chang also found it “difficult to accept Applicants’ assertions that they will be willing to advance Hawaii’s clean energy goals, when one considers that in Florida, where NextEra is headquartered, very limited renewable energy resources are incorporated in its generation mix.” 36. Oh, and NextEra’s holdings also include a number of nuclear reactors. Chang testified that the upkeep–and eventual decommissioning–of these may become factors even out here in Hawaii because of the merger. “Although it is not known whether or when any of the

identified units will retire prematurely, and the Applicants assert that Hawaiian Electric Companies’ ratepayers will not bear any liability for decommissioning costs, the decommissioning process is allowed to take up to 60 years for any one unit,” Chang testified. “Thus, for the two units with 2030 nuclear license expirations, the decommissioning process could extend to 2090. This time period extends well beyond any commitments made by the Applicants.” 37. So what to do about all this? Chan Hodges had an interesting solution: he proposed that merged companies become a “Sustainable Business Corporation” that exists to promote public benefits like providing low-income or underserved individuals or communities with beneficial products or services, preserving the environment and promoting the arts, sciences or advancement of knowledge. Company officials would meet frequently with officials and residents in Hawaii. Provide regular reports on how they’re meeting the above goals. 38. Green Mountain Power in Vermont is a corporation set up along these lines.

According to a statement the Vermont utility company provided Chan Hodges, “Green Mountain Power is part of a community of more than 1,100 companies across 60 industries with one unifying goal: redefining success in business. We meet rigorous standards of performance, accountability, and transparency, and are using the power of business to alleviate poverty, address climate changes, and build strong local communities and great places to work.” 40. All of them took place on Oahu, just out of my reach. But this year, they’re celebrating five years of exemplary food festivals by bringing Maui and Hawaii into the fold of their 15-day festival that celebrates sustainable cuisine with interactive dining parties, farmers markets, cooking demos and industry panels. “The expansion of the Hawai‘i Food & Wine Festival on Maui gives visitors the opportunity to participate in an entire weekend of new and immersive culinary activities, including a

'Straight Outta Compton' A compelling look at the compelling rap artists who made up N.W.A. ★★★★★

The sequences depicting the infamous Detroit concert, their run-in with cops outside their studio and the hospital-set conclusion are undeniably powerful. It’s well into the running time when we realize that the focus isn’t on the group itself but the unique, troubled father/son relationship between Eazy-E and Jerry Heller, their manager. Many will be surprised that N.W.A., who famously flaunted their rebellious attitude and took aim at racist authority figures, had a white manager. As played with intelligent layers by Paul Giamatti, the character isn’t some cheap ploy to appease the mainstream by adding a sympathetic Caucasian character. In fact, the role grows more complex as the story progresses and Giamatti has many great scenes to showcase his craft. But is the film self-congratulatory? A little bit, particularly at the end. Over the closing credits, there’s all sorts of plugs for Cube’s movies and the Beats Like Dre headphones, when a postscript, telling us what happened to everyone, would have worked just fine. While there’s no glossing over the group’s bad, raunchy behavior in their heyday (we see hotel rooms get trashed and women getting used), we also see Cube, Dre and E in committed relationships with

hree years ago, I was interviewing Ice Cube when the N.W.A. movie came up. He was doing promotional rounds for 21 Jump St. and I was thrilled to be speaking with an actor and artist I’d been a fan of for most of my life. A good, open conversation ended with the inevitable question of what he had coming up and Cube brought up making a film about his younger life. There was something about the way he said it, a weight in his voice, that made it obvious how much the idea meant to him. The film in question, F. Gary Gray’s blazing, energetic Straight Outta Compton, isn’t a feature-length rap video but a real movie and a great one at that. Gray, who’s made everything from Friday to (my personal favorite) Set It Off, gives this a wide scope and a seriousness that matches what Curtis Hanson brought to 8 Mile. The story of how five rap artists (Cube, Dr. Dre, MC Ren, DJ Yella and EazyE) became enormously popular, influential and controversial makes for an entertaining ride, with a handful of terrific scenes.

their spouses. There’s no sense of why these party animals decided to settle down and only one scene addresses the concern a girlfriend has in dating a controversial rapper. Much of this becomes redundant after a while, with scenes of the group recording, partying and their tense confrontations with racist cops occurring seemingly on rotation. At two and a half hours, the running time flies by, though this could and should have been three hours long. There’s a lot of ground to cover, many characters who required more attention and sequences that didn’t need to be cut as tightly as they appear. Gray may have assembled too much of a good thing but a potential Director’s Cut on DVD/blu-ray could sharpen what he already makes so fascinating. O’Shea Jackson Jr. plays his father well, though the real Cube has always come across

even more forcefully and with more blinding charisma than his son can manage. Corey Hawkins is pretty good as Dr. Dre and, while both Neil Brown Jr. and Aldis Hodge do what they can as DJ Yella and MC Ren, the roles mostly fade into the background. The film belongs to Jason Mitchell, who is sensational as Eazy-E, and Giamatti. There are also juicy supporting roles for stuntman-turned actor R. Marcos Taylor–mesmerizing as Suge Knight–and Keith Stanfield, in a funny cameo as Snoop Dogg. Marcc Rose’s resemblance to Tupac Shakur is so strong that I gasped the first time I saw him. N.W.A. needed either three hours, tops, to fully tell its story or go the documentary route. Still, all involved should be proud of the end result, which is good enough to make even Ice Cube crack a smile. ■
