ADDITIONAL CONTEXT ON WHO STOPPED OLOWALU SEAWALL I was glad to see MauiTime featured the story on how activists helped the DOT rethink a project for a 900 foot rock revetment just north of Olowalu (“Move The Road,” Dec. 22, 2016). This is just one of several erosion hotspots that has drawn attention since a seawall project at Ukumehame resulted in a large plume of red silt, and numerous calls to government officials. One of those calls was from marine biologist Mark Deakos, whose special area of study is manta rays, which congregate in the waters off stretches of the Honoapi‘ilani Highway. Deakos called and emailed numerous offices, including mine and County coastal planners Tara Owens and Jim Buika. He also called state officials and learned that several projects were planned, most with reduced public input because they were “emergency declarations,” with federal funds acquired by gubernatorial request after the Japan tsunami in 2011, then Hurricane Iselle in 2014. It should also be noted that Mayor Alan Arakawa, recognizing the need to move the highway mauka, brought forth the Pali To Puamana Master Plan in 2005. Since that time large tracts of land have been acquired by the County; 100 acres at Ukumehame; and 148 acres at Launiupoko. Arakawa told me that he had told DOT-Highways Director Ford Fuchigami he was “crazy” to pursue shoreline hardening projects,

and that moving the road was what’s needed. But nothing coalesced until activists vowed to hold signs and camp at the construction site as long as necessary. The Maui Tomorrow lawsuit filed in conjunction with Malama Olowalu surely brought the issue onto DOT and Governor David Ige’s priority list, but was never ruled upon due to Circuit Court being absorbed in a lengthy murder trial. Without any court action taken, the sign waving troops settled in for the long haul. In addition to Tiare Lawrence, West Maui resident Kai Nishiki, Frankie Caprioni of Olowalu and countless others should be credited for the effort. Another marine biologist and long-time Trilogy employee, Cynthia Matzke, traveled to the signwaving site with another Akaku producer to do interviews. While driving back to central Maui, she called one of Governor Ige’s aides whom she had met at the World Conservation Congress and urged him to alert the governor to direct DOT to seek alternatives. Back in July, Deakos and a planning consultant with West Maui Land (Peter Martin et al) drafted a letter to the State Environmental Council, asking them to assess the project and to advise the governor of its short-sightedness. OEQC (which oversees the Council) Director Scott Glenn did so, and accompanied DOT’s Fuchigami, Deputy Ed Sniffen, and Attorney General William Wynhoff to the site in midSeptember. It was at Peter Martin’s beach front home at Olowalu that an alternate plan was quickly agreed upon, in an all-too-rare example of how citizens and government can work together to find solutions. Maui Tomorrow’s Albert Perez and Tiare Lawrence of Malama Olowalu were indeed vital to the outcome of stopping a larger shoreline-hardening project. And they no doubt will be equally involved with the ultimate solution of highway realignment to move traffic out of harm’s way, while protecting the near shore coral reefs and their inhabitants. -Rob Parsons Maui County Environmental Coordinator

M

aui County Council Chairperson Mike White has made aggressive moves against the Office of Council Services (OCS), asserting his authority as chair to place various staffers on paid leave, as well as replace Director David Raatz, we learned. White’s moves, made just a week before Christmas, left many of those still at the office uncertain whether they’ll have jobs come Jan. 2, 2017, when the new County Council is sworn in (the public can testify starting at 2pm). On Friday, Dec. 16, White sent a two-page memo outlining his reasoning and authority to the councilmembers-elect and naming his preferred successor to Raatz. That memo, which we obtained, is both vague and disin-

genuous. Four days later, during a series of meetings held on Tuesday, Dec. 20, White placed two OCS staffers–Sharon Brooks and Ross Izumigawa–on “paid administrative leave.” It’s unclear under what authority allowed White to remove the staffers from OCS, who are legally full-time employees of the entire County Council (White’s office didn’t return a phone message left on Dec. 22 asking for comment for this story). While Rule 6A(2) of the Rules of the Council gives the chairperson the right to appoint employees of the council, it also stipulates that the the Council as a whole must approve any full-time employee appointments. In any case, sources on the 8th floor of the County building said that both staffers were escorted out of the building after being

told they were being placed on leave. “With no reason or warning to the employees or to the other OCS staff members, it is safe to say everyone is very shaken up,” one county employee familiar with the OCS shakeup told me. “Morale is low on the 7th and 8th floors.” The importance of the OCS–and the need for it to operate independently of political influence–can’t be overstated. “The Office of Council Services provides administrative services to the Council Chair, the councilmembers’ individual offices, and the council’s district offices,” states the OCS website. “In the county’s legislative process, the role of the Office of Council Services is to staff the county council’s committees and subcommittees, and provide objective assistance to individual councilmembers.” But for reasons that aren’t clearly articulated in his memo, White is clearly unhappy with the OCS–and especially Raatz. This is troubling because Raatz has a reputation in the county for being an honest stickler for ethics. “I’ve known him for years,” said longtime Maui activist Lucienne de Naie. “I was really happy to see him appointed head of Council Services. He’s an attorney, and I’ve never seen him take sides. He’s the consummate public servant, very professional and a really smart guy.” As it is, the portion of the memo detailing White’s problems with the OCS is just ambiguous doubletalk: “After a thorough operational review of the Office of Council Services (“OCS”), along with obtaining feedback and input from members on the operations of OCS, it has become clear that operational change is both needed and desired,” White wrote in his memo. “A high level of member services with an attention to detail is the most important role of OCS and I believe this mission can be enhanced through new leadership in staffing.” High level of member services? New leadership in staffing? What does all that even mean? In any case, White says in the memo that he wants Sandy Baz, most recently Mayor Alan Arakawa’s budget director, to take Raatz’s place. On Dec. 2, White asked that the County Council immediately approve Baz as a “temporary” addition to the OCS staff, even though usual appointments there require lengthy interviews and an entrance test. Though Councilmember Guzman vehemently disagreed, saying there was no reason to dispense with the usual hiring procedures, the council approved Baz’s employment. At that hearing, Councilmember Riki Hokama both approved Baz’s appointment

and attacked the OCS. “I’m not so much tied into the hiring process that I feel doesn’t serve the pleasure of the members,” Hokama said. “So, I say that because I want to be clear with our current employees, too: you’re only guaranteed until January 1. Don’t make assumptions you’ll be here on January 2nd… And I’ll be upfront: I am not a happy member.” In his Dec. 16 memo, White said that “Currently, he [Baz] serves in the position of Supervising Legislative Analyst in OCS,” but he didn’t mention that Baz had only held that title for two weeks when he issued the memo. White added that Baz “brings a unique perspective and a collaborative approach in his management style that I believe will be beneficial.” White’s memo also states that he would like the Council to approve Gregory Garneau to be the new OCS Supervising Legislative Attorney, saying that he “believe[s] he will compliment Mr. Baz’s vision for OCS.” But most disturbing of all, the memo also includes this curious statement about Raatz: “I would also like to announce the departure of David Raatz,” White wrote. “He was asked to remain with the office, as his institutional and legal knowledge have been impeccable, but he has decided to pursue other opportunities.” Though Raatz wouldn't comment for this story, White’s characterization of Raatz’s agreeing to exit his job appears to be untrue. In fact, two employees on the 8th floor of the County building told me that Raatz never agreed to leave, has no other job lined up and intends to show up for work on Jan. 2 with every expectation of continuing to work at OCS. Though Raatz is still OCS Director (at least until Jan. 2), two county employees familiar with the staff shakeup said that on Friday, Dec. 23, White and Baz convened an OCS staff meeting in the County’s Corporation Counsel office. In an unrelated matter, earlier this month Mark Sheehan of the SHAKA Movement filed an ethics complaint against White with the Board of Ethics, alleging that White abused his authority by issuing a press release “declaring unequivocally that the Maui County Council had organized for the upcoming term and that he will again serve as Chair for the next council session” (the full Council has to vote on who gets to be Chairperson and Vice Chairperson at their first meeting on Jan. 2). Evolution, according to scientists, likely explains why some “prey” develop defense mechanisms to avoid “predators,” i.e., the prey who fail to develop them are unable to procreate (because they’re dead), but a team of scientists from Sweden and Australia recently concluded that something similar happens in a species of fish in which males mate basically by huge-appendaged rape. Growing nine generations of the species in the lab, the researchers concluded that the females who can avoid the “rapist” evolve larger brains than those who fall victim. Whistleblower goes to jail; responsible industry executives make millions. Long-time Mississippi environmental activist Tennie White is 27 months into a 40-month sentence (for “falsifying” three $150 tests in her laboratory), but high-ranking executives at the Kerr-McGee chemical conglomerate made millions on the case White helped expose: leakage of cancer-causing creosote into communities, including White’s Columbus, Mississippi, neighborhood. A detailed investigation by TheIntercept.com in November noted the executives’ brilliant response to the 25,000 creosote lawsuits nationwide: put all the liability into one outlying company (eventually going bankrupt) but selling off, highly profitably, the rest of the firm.

When police in Port Orange, Florida, arrested Anthony Coiro, 76, in November, he admitted that he had a stash of “crazy” pornography, some featuring children. However, he adamantly insisted, “I’m not a pedophile. I’m just a pervert,” adding, “a law-abiding pervert.” He faces 52 counts. And in November in Osaka, Japan, an unnamed arrestee apparently had his sexual molestation charge (against a woman on a crowded train) dramatically downgraded. “Actually,” the man indignantly told the judge, he is not a pervert–but just a pickpocket (a lesser crime). The victim had testified that the man had brushed against her for “3 seconds” and not the “30” she originally told police.

HARDLY NEED A BREATHALYZER Michelle Keys, 35, among those joyously caught up in Iowa’s upset win over highly ranked Michigan in football in November and celebrating that night in Iowa City, was slurring and incoherent and told police she was certain she was standing in Ames, Iowa (120 miles away), and had just watched the “Iowa State-Arizona” game (a matchup not played since 1968). (She registered .225.) And a 38-year-old woman was arrested in Springwood, Australia, in November when police stopped her car at 3 a.m. at an intersection–with a children’s swing set wedged onto the roof of her SUV. (She had shortly before mistakenly driven through someone’s back yard and through the swing set.) (.188.)

PERSPECTIVE “Sexually-based offenses,” a TV show intones, are “particularly heinous,” but to the small Delaware liberal arts Wesley College (according to the U.S. Department of Education) even an accusation of sexual misconduct is so heinous that there was no need even to interview the alleged wrongdoer before expelling him. (An informal meeting did occur, but only after the investigation was completed.) The expulsion occurred even though the victim herself had not originally accused that particular student.The expelled student’s offense was to have helped set up video for a consensual sex encounter that was (without consent) live-streamed. (The Department of Education accepted a settlement in which Wesley agreed to revamp its code of student rights.)

LEAST COMPETENT ARTISTS Apparently the plan by a 33-year-old unlicensed, un-car-registered driver in Perth, Australia, in November to keep from being stopped by police was to print “POLICE” in large, “official”-looking letters on the sides of her white Hyundai, using a blue dry-erase board marker. (She was, of course, quickly stopped by police.) And a woman in a quiet north Minneapolis neighborhood told reporters she became fearful after seeing a large swastika spray-painted on a garage door down a nearby alley (just after election day!). Problem: The base “X” of the correct design has “hooks” that should always extend to the right, clockwise; three of the Minneapolis “artist’s” awkwardly hook left.

THE PASSING PARADE In November, a court in Christchurch, New Zealand, ordered the local police to “undo” the 493 bottles’ worth of liquor they had recently poured down the city’s drain after raiding an unlicensed bar. The court said the police must pay a pumping company to recall the hooch because of environmental regulations. And in November, the Littleton, Colorado, city government, faced with the need to “blot” sticky tar on 120 streets whose potholes it was filling, bypassed expensive “detackifiers” in favor of stuffing toilet paper over the tar, causing the streets to have a trick-or-treat look. ■

ven without the election of Republican Donald Trump to be President of the United States, this was a monstrous year. We’ve had to deal with job losses, outrageous giveaways to big business and just a general slide away from democratic protections and open government assurances. We like to think of Hawaii (and Maui especially) as existing outside the world’s troubles, but it’s clear that FEAR has truly been the watchword for 2016. And it’s likely 2017 will be even worse. So sit back, relax, maybe take a swig of something strong and revisit with us the year’s highs and lows (way more of the latter than the former) in Maui County.

and, yes, joy at the impending end of cane burning. But have no fear, says anthropologist Carol MacLennan–the plantation mill may be closing, but the plantation itself will stay. “Sugar production is ceasing, but A&B is still there,” she tells me. “You still have a major company with say over the acreage”... Speaking of A&B, an Oahu judge smacks them good this month, ruling that for the last 15 years or so, the state has been illegally granting permits to the company so it can divert East Maui stream water, The Maui News reports. The next logical step is to stop the diversions, but no one can say when (or if) that will happen… County of Maui officials release a $70,000 report saying the county needs to start a public power utility co-op. On Jan. 1, the legal smoking age in the State of Hawaii rises from 18 to 21 years of age. State officials say that much of the reason for this change comes from Centers for Disease Control (CDC) studies showing that “one in four high school students and one in 13 middle school students are current users of tobacco products” (though even state officials admit that the use of tobacco in Hawaii has been declining since 2000)... Though Komoda’s Bakery in Makawao won’t officially celebrate its centennial until November, we celebrate early with a cover story on the venerable sweet shop. “We are so blessed with the loyalty of our customers,” bakery patriarch Calvin Shibuya tells us… Just six days into the new year, Alexander & Baldwin (A&B) announces that it will close the Hawaiian Commercial & Sugar (HC&S) mill–the last sugar operation in Hawaii–at the end of the year. This single announcement will touch off a year of complex feels: nostalgia, worry over the fate of the mill’s nearly 700 workers, hope that A&B really will keep to its promise to convert much of its 37,000 acres into “diversified agriculture”

I’ve got a bad feeling about this… A mere 26 years after the Hawaii State Auditor recommended modernizing the state’s payroll system, the Hawaii Department of Accounting and General Services (DAGS) announces that it will do exactly that. We’re assuming this means the state will finally stop using payroll form D-55, last revised in 1977 (the 1989 Auditor’s report specifically mentioned this form, saying using it instead of computers made payroll accounting unnecessarily burdensome). Hey, better late than never, right?... Maui Police officers arrest Maui Police Officer Carlos Frate for “violating a Warning Citation [that] was issued as a result of an Abuse of Family and or Household Member investigation,” states a MPD news release issued on Feb. 17. And so it goes… On Feb. 18, Maui Rep. Kaniela Ing, D– Kihei, is scheduled to appear in Second District Court on a citation for allegedly lacking auto insurance. Richard Zeebe, a professor at University of Hawaii’s School of Ocean and Earth Science and Technology says that new findings show that the earth’s climate is changing at a rate 10 times faster than during any event in the last 66 million years. “Everyone is focused on what happens by 2100,” Zeebe says in a Mar. 21 news release. “But that’s only two generations from today. It’s like, If the world ends in 2100 we’re probably OK! But it’s very clear that over a longer timescale there will be much bigger changes.” Don’t you feel better now?... On Mar. 26, Hawaii Democrats decide that they prefer Senator Sanders to Secretary Clinton, by a pretty wide margin, in the Hawaii Democratic Caucus. That’s right–Sanders wins with 71 percent of the vote. Given that at this point in the race Clinton is still leading Sanders in both pledged delegates and Superdelegates, it’s looking increasingly likely that Hawaii voters are going to be disappointed when the Democratic convention rolls around this summer… Makena Beach & Golf Resort officials announce on Mar. 29 that the resort will close in July to make way for luxury condos. This seems to contradict a letter the resort sent to its nearly 400 employees just two weeks earlier, assuring them that there would likely be no sale in 2016. “It is important to confirm that no date has been established and as things stand right now we do not expect to have a date before the end of this year,” Makena Resort GM Declan McCarthy says in the letter. I can already see that there will be many casualties this year, but irony won’t be one of them.

APRIL Retired Maui News reporter and columnist Ron Youngblood dies at the age of 73. When he retired from the paper in 2009, he “averaged writing about 320 editorials a year [and] edited the 4,000 or more letters to the editor the paper received annually,” according to the paper… Maui Tomorrow releases a new report that shows how the county can create more agricultural jobs while still providing effective and environmentally responsible stewardship of the land (it’s viewable at FutureOfMaui.org). “This is an opportunity to go back to the values that Maui people were raised with,” says Alika Atay, an activist and Maui County Council candidate… Olowalu Town developers

It’s the first such canoe built on Maui in 600 years… The U.S. Postal Service issues a new stamp honoring Haleakala National Park, as part of a news series of stamps dedicated to national parks. The stamp shows the dormant volcano covered in clouds, with a rainbow cascading over it. “Much of Haleakala’s beauty comes from its rainbow-colored rocks,” says Kevin Ebi, the photographer who took the image that graces the stamp. “The rainbow in the sky complemented that nicely”... MARCH Two days into the month County Planning Deputy Director Michele Chouteau McLean sends letters to six Ka‘anapali resorts telling them to get their public parking in order. It’s about damned time!... On Mar. 8, Hawaii Republicans hold their presidential caucus and maybebillionaire Donald Trump wins. Well, he took the largest share of the vote, 42 percent, which means he wins the state. Notably, none of the state’s Republican elite had backed Trump–former Lt. Gov. Duke Aiona wanted Senator Marco Rubio to win, while former U.S. Rep. Charles Djou had backed Ohio Governor John Kasich. As for state Senator Sam Slom–the only Republican in the Hawaii Senate–he first wanted neurosurgeon/loon Ben Carson before switching to Senator Ted Cruz. See, everybody loses!... There are many celebs (Woody Harrelson!) and power-brokers (David Cole!) applying for a medical marijuana dispensary license, but none are quite like drug warrior Don Shearer. Since the 1980s, his company Windward Aviation has flown marijuana eradication flights in Hawaii for the police and federal government. What’s more, he agreed to sit down with us to explain why he wants to open a medical marijuana dispensary. “Almost everyone I know in law enforcement would want to do this if they could,” he says…. Well, the Liquor Commission does it again: After meeting for nearly half an hour in closed session during its early March hearing, it utterly fails to vote on a clear choice to be the new director. So they do what all good panels of political appointees do: they give up and threw the whole thing into the lap of the new Liquor Commission, which formally starts work in April… A new study in Marine Pollution Bulletin seems to show that waste from South Maui injection wells is forming a plume in the waters just off Kihei that’s a threat to coral. “Of particular concern is Cove Park, directly next to Kalama and and the center of the wastewater plume from the Kihei WWRF [wastewater reclamation facility],” states the study. “Cove Park remains a popular beach for tourists and recreationists

The National Oceanic and Atmospheric Administration (NOAA) announces on Feb. 2 that it’s discovered four entirely new species of marine algae (“limu”) in Hawaiian waters deeper than previously thought possible. “These findings redefine our understanding of algal distributions in Hawaii, and hint at the great number of other new species that are likely to be discovered in the future from these amazing deep-water reefs,” says Papahanaumokuakea research specialist Daniel Wagner… Given that last year’s search for a new County Liquor Control Director is completely trashed, the Liquor Commission decided to start over with new applicants. Tulsi Gabbard, D–Hawaii, endorses Senator Bernie Sanders, D (but normally I)–Vermont to be the Democratic Presidential candidate. Though most pundits are predicting that former Secretary of State Hillary Clinton will be the nominee, Gabbard insists that Sanders “will usher in a new era of peace and prosperity.” At the same time, Gabbard resigns her post as Vice Chairperson of the Democratic National Committee, which was leaning hard for Clinton.

JULY A big brushfire apparently caused by a downed power line in Ukumehame leads to the closure of the Pali and calls from Mayor Alan Arakawa for a new West Maui road. “Last night’s brushfire was a perfect example of why we need an alternate route to and from West Maui, “Arakawa says on July 3. “Our residents and visitors can be cut off at any time due to a brushfire, rockslide or even a bad traffic accident, as they were yesterday. Even I was stuck in Lahaina last night and was forced to take the back road out, which is not made to handle heavy traffic.” All good reasons, and here’s another: rising sea levels due to climate change are already eating away at the the coast, and will sooner or later force the road to move inland… During a deadly active shooter situation on July 7, Dallas Police attach explosives to one of the bomb-defusing drones, then launch it a sniper who’s killed five cops and wounded five others (as well as two civilians). It’s an unprecedented act for a municipal police department in the U.S. and there needs to be serious, national discussion on whether it’s a good idea for cops to use robots for this purpose. Curious, the next day I ask the Maui PD if they can do the same thing with their Avatar II drone, which they got in 2014. “Our robot has that same capability,” MPD Lt. Gregg Okamoto tells me. Oh, joy… The state Public Utilities Commission (PUC) kills the proposed NextEra/ Hawaiian Electric merger in a 2-0 vote (one commissioner abstains). The panel did so,

Apparently after getting that call, Ing surrenders himself to the MPD, where he’s booked and released with a new court hearing on Aug. 25.

AUGUST When it becomes clear to just about every Democrat in the nation that Hillary Clinton will clinch the presidential nomination, Rep. Gabbard steps away from Sanders and endorses Clinton for president. “Now, given the remaining choices, I–like Bernie Sanders–will be

Gabbard is very popular in Hawaii’s Second Congressional District, and is widely expected to cruise to reelection, Maui activist and author Shay Chan Hodges files to run against her in the Hawaii Democratic Primary Election. Her reason–Gabbard isn’t nearly as liberal as her constituents, noting specifically that Gabbard has introduced legislation in the House of Representatives that’s backed by far-right-wing billionaire Sheldon Adelson, has repeatedly criticized the Obama Administration’s military actions in the Middle East and has supported legislation that would make it more difficult for refugees from the murderous Syrian civil war to seek refuge in the U.S…. In a story right out of a cheap detective novel, news breaks that Alexandria Duval (aka Alison Dadow) allegedly murdered her twin sister Anastasia Duval (aka Ann Dadow) by driving their Ford Explorer off a cliff in East Maui. Turns out both sisters reportedly used to live high in Palm Beach while running some sort of yoga studio that may have gone bad. On June 7, Maui Police arrest the surviving sister, who was driving the SUV at the time, on suspicion of murder… Wow, that was fast: not long after her arrest, Judge Blaine Kobayashi throws out the arrest of Alexandria Duval (Alison Dadow), citing a lack of evidence. For reasons I suspect we can all understand, Duval/Dadow immediately boards a plane for New York… Brian Kohne, maker of the great 2010 movie

according to KITV, because the companies “did not demonstrate that the application is reasonable and in the public interest.” So it goes… The Hawaii Democratic Party’s LGBT Caucus issues a statement of “strong support” for Democratic Second District congressional candidate Shay Chan Hodges, but not for incumbent Tulsi Gabbard. There is much back-and-forth arguing between Gabbard’s campaign and the caucus, but ultimately Gabbard’s people say no big deal because they already got an endorsement from the Human Rights Campaign, so there.

It’s apparently a grim day. “As human population increases on islands with highly visible limitations on the ecosystem, it is important to understand factors such as wastewater that can alter the ecosystem,” states the program on the talk by marine ecologist Dr. Eric Brown. “Over the past 20 years numerous studies have examined the impact of human wastewater in coral reef ecosystems and identified several key stressors that negatively influence coral reef organisms when present in excess quantities. These stressors include freshwater, dissolved inorganic nutrients, endocrine disrupters, pathogens, solids, heavy metals, and toxins”... What, you’re still here? Cool, because we got some juicy stuff coming up… In case you were worried, the state Senate votes to approve HB 2501. “The most important thing to understand about HB 2501 is that the Legislature is circumventing a January state court ruling that found A&B had been illegally diverting water for 15 years,” Civil Beat’s Chad Blair writes. Nonetheless, Maui Senators Keith-Agaran and Roz Baker vote for the bill, while J. Kalani English votes against it… Speaking of English, an arsonist fire-bombs his Hana home for who knows what reason. No one is injured, but it’s an unsettling attack… Bad news for Maui County Corporation Counsel Pat Wong–his latest financial disclosure form indicates he only won between $1,000 and $9,999 gambling in Las Vegas last year. Given that he was raking in at least $50,000 a year playing cards in the years up to my June 2015 cover story on Wong’s love of Vegas gambling, I can’t help but think that maybe I jinxed him… The Liquor Commission finally chooses a new director! They end up selecting Glenn Mukai, but at least the got someone (former director Frank Silva retired last fall). Of course, the commission opted for someone with a nepotistic connection to the office (pretty much a

Oh, and Mukai also admits that he broke the office of former Deputy Director Tracy Fujita-Villarosa (Mukai gave her two-days notice when he took over), and still can’t explain the room’s “foul odorâ€? that even a Haz-Mat team failed to get rid of‌ There’s another firebomb attack of state Senator English’s home in Hana, this time causing $2,500 in damage (though again, no injuries), Maui Now reports on Aug. 16‌ The Hawaii Primary Election happens, and once again, incumbents lead the way. In the closely watched races, Gabbard beats Chan Hodges (not a surprise) while Ing handily beats back challenger Deidre Tegarden (kind of a surprise, given the recent revelations about Ing’s bench warrant). In fact, after crunching the numbers, it’s clear that during the race Ing’s campaign spent $19.30 per vote and won while Tegarden’s campaign spent an astonishing $79.15/vote and lost. Oh, and in the open race to replace Maui County Councilmember Mike Victorino in the Wailuku seat, County Managing Director Keith Regan loses badly, even though he spent a whopping $111,473 on the race. That’s good news (Regan’s view that what’s good for Mayor Arakawa is good for the county is completely incompatible with honest government) but even better news is that Shaka Movement activist Alika Atay makes it through the Wailuku Council seat primary. He still has to beat former Councilmember Dain Kane in November, but given that Kane hasn’t won

an election since 2006, there’s at least a fair chance of that, right?... Pacific Whale Foundation announces that they’ve spotted the first humpback whale of the season in Maui waters, but given the fact that it’s still August, it’s clear that something is off. And sure enough, the whale is encrusted with whale lice, which are naturally occurring but usually only appear on sick or injured whales.

Yes, Kaiser Health Systems is supposed to take over all Maui hospitals, but delays mean that MMMC will likely have to cut services‌ From fear, we shift to anger: on Sept. 8, the Associated Press reports that much of the fish we eat in Hawaii comes from foreign crews working under near-slave conditions. “Hundreds of undocumented men are employed in this unique U.S. fishing fleet, due to a federal loophole that allows them to work but exempts them from most

basic labor protections,â€? states the AP report. “Many come from impoverished Southeast Asian and Pacific nations to take the dangerous jobs, which can pay as little as 70 cents an hour.â€? Many local restaurants buy fish from this fleet‌ You should take a break and get a sandwich or some musubi–you’re going to need it for what’s coming up soon‌ The U.S. Congress passes the Native American Tourism and Improving Visitor Experience (NATIVE) Act, sponsored by our own Sen. Brian Schatz. Because really, what possible harm could come from further commodifying native Hawaiian culture for tourists?... Big demonstrations of residents protesting seawall construction in Olowalu help convince state officials to restripe the highway instead of doing a bunch of construction that would have been harmful to the coast... Republican Presidential Candidate Donald Trump finally says that he believes President Barack Obama was born in the United States (no shit, dumbass!) but then says Hillary Clinton started the slander that Obama is from Kenya, which is just another outrageous lie. Look, since it’s likely we’re going to have to deal with Trump for at least a few more months (if there’s a god, it will just be a few more months), then everyone should understand something: Every thing Trump says for public consumption is a lie. Everything. He’s a small boy trapped in a greasy game show host’s body, and to get attention he lies and throws around petty, stupid insults. Councilmember Riki Hokama uses the occasion to deliver a vague, rambling series of threats to the OCS staffers, insinuating that many of them won’t have jobs come Jan. 2… New crime stats show that though overall crime in Hawaii has slightly dropped this year, property crime and violent crime rose (the latter somewhat significantly) in Maui County. “Maui County’s crime rates increased for six of the ten Index Crime offenses, with a notable increase of 86.4% for arson,” states the new 2015 Crime in Hawaii report from the state Attorney General’s office. “Maui County reported the highest statewide rates for total, violent, and property crime indexes, as well as rape, aggravated assault, and larceny-theft”… Haleakala National Park announces that they’ve started an online reservation system for those wishing to view the sunrise from the summitt. Needless to say, many people aren’t particularly pleased with the plans… This year, being what it is, Baby Donald gets elected president (though he manages to do so while losing the popular vote count to Clinton by more than two million votes–an astonishingly poor performance that robs him of whatever “mandate” he may choose to assume). Here’s to four years (assuming we’re all lucky enough to avoid global nuclear holocaust and Republicans find it in their hearts to continue letting us have elections) of childish rants, monumental conflicts of interest stemming from the businesses he owns, racist appeals to white supremacists and endless lies about even stupid shit. But that’s America, right?... In other election news, most Maui County incumbents once again win reelection (including Kaniela Ing, who’s still dealing with the case of his alleged expired auto insurance), with one notable exception: Maui County Councilmember Don Couch, who represents South Maui, loses to Pacific Biodiesel cofounder Kelly King. Councilmembers Mike Victorino and Gladys Baisa were both termed out, and their replacements will be Alika Atay (aka not Dain Kane!) and Yuki Lei Sugimura. This means a whole new reality on the Maui County Council, which starts on Jan. 2. This is, assuming County Council Chairperson/tourist industry shill Mike White doesn’t become even more power-mad… Maui County Planning Director Will Spence and Deputy Director Michelle Chouteau McLean pen an op-ed in The Maui News stating that the planning process “is broken” and they need to start “evaluating our governing statutes.” The fear from activists is that this means they want to start chopping into County Code Chapter 2.80B, which gives community plans the force of law. Given the new County Council members that just got elected, Spence and Arakawa don’t have a lot of time to play with… A federal appeals court throws out the

Shaka Movement’s anti-GMO ballot measure, which was approved by the voters two years ago. “The 9th U.S. Circuit Court of Appeals concluded Friday [Nov. 18] that Hawaii state pesticide law is comprehensive, and that the Legislature intended it to be ‘uniform and exclusive of additional, local rules,’” Civil Beat reports after the ruling… For reasons she never chooses to explain publicly, Rep. Gabbard doesn’t sign a letter with 169 of her Democratic congressional colleagues denouncing President-Elect Trump’s decision to make white nationalist Stephen Bannon his “chief strategist.” But Gabbard does meet with Trump on the morning of Nov. 21. Though the Washington press corps tweets that Gabbard is under consideration for a host of jobs, she emerges from the meeting to say they talked about foreign policy and the war in Syria… Former Ku Klux Klan Imperial Wizard David Duke tweets that he wants Rep. Gabbard to be Trump’s Secretary of State, but Gabbard tweets nothing but scorn back at him (though in a way few of her followers probably saw): “No thanks. Ur white nationalism is pure evil”... A handful of Maui High teachers and students rally against

Through a Freedom of Information Act request with the Federal Bureau of Investigation (FBI), MauiTime learns that U.S. Army Intelligence maintained a brief but classified file on then-Speaker of the House Elmer Cravalho in the late 1950s. The reason? Cravalho’s close ties to the International Longshore and Warehouse Union (ILWU). See, the commies scared the army and FBI so bad they considered unions like the ILWU a threat to national security. Gabbard writes to Attorney General Loretta Lynch asking her to for more information on news that Yahoo scanned hundreds of millions of personal emails at the behest of the U.S. Intelligence community. Can we even consider ourselves citizens of a democratic republic anymore, instead of mere subjects to corporate-military oligarchy? Yeah, thought so… The Maui News obtains a letter from Maui Mayor Alan Arakawa to Councilmember Don Couch saying that he will “suspend” the county Planning Department’s work on community plans because, as he believes, the planning process is broken (Couch tells The Maui News that he agrees with Arakawa). Missing from this story is any reasonable discussion about how the process isn’t broken, but the Planning Department–hobbled by a bad plane crash last year and staffing cuts–is clearly broken. But that puts responsibility for the slow roll-out of community plans on Arakawa’s desk, and we can’t do that… State Rep. Angus McKelvey, D–West Maui, gets a far easier reelection campaign when the Maui PD arrests his Republican opponent Chayne Marten on five charges of first degree sexual assault, three charges of third degree sexual assault and one charge of endangering the welfare of a minor… Here’s more good news: University of Hawaii researchers discover that ocean-level records may actually have been leading scientists to underestimate the magnitude of sea level change during the 20th century. That’s right kids, the world’s oceans are rising at a faster rate than previously thought… But Chef Sheldon Simeon of Tin Roof and old Migrant is returning to the new season of Top Chef in December, Bravo Network announces. So at least there’s that… The Grand Jury in Maui County votes to indict Alexandria Duval for allegedly killing her twin sister back in May. Given that Duval long ago flew to New York

e has a legendary record collection, plays with children’s toys during sets, and nearly became an X-ray tech instead of a musician. But you probably know him best as one of the guys behind the turntable in Jurassic 5. DJ Nu-Mark will be flying out to join us for New Year’s Eve, while he enjoys a bit of respite from the music industry grind. I caught up with him on the car phone while he was driving his girl to dinner: MAUITIME: Have you been to Maui before?

DJ NU-MARK: I’ve been here for vacation but this is my first time playing on Maui. I thought it would be a great way to cap off 2016. Too many deaths of too many great people. All of them sucked. Bowie sucked terribly. I keep telling everybody we better shrink-wrap/bubble-wrap Stevie Wonder because he’s one of the last ones left. We have to preserve him. MT: What gets your blood pumping as a DJ?

NM: The complete autonomy that I have. I can jump to any song I want I can move to any tempo. I’m not stuck in my own catalog or tied to songs with my group, or anything like that. It keeps things fresh as a musician. We have a tendency to rehearse our own songs or listen to our own catalogue 19 million times when we record it, we mix it, we master it, and then we got to perform it. So by the time you perform a tour’s worth of your own material, you get burned out on your own songs. So playing other people’s songs is great! Finding out similarities and levels of contrast between Song A and Song B is just so much fun for me. I’ve been doing it for 29 years now and it never ceases to amaze me the types of similarities that still exist out there that I never paid attention to. MT: Vinyl or electronic? NM: Lately I’ve been doing these DJ mixes on my Facebook that I call Zodiac Tracks,

where I gather all the tracks from artists that are in the same zodiac sign and I mix all their music together, whether it’s young or old. All this time that I have been on technology, Serato is the tech I’ve been using that is as current as I can get. I’ve been thinking, “Oh yeah this is very similar to vinyl.” But then when I went back to vinyl, I was like, “Holy shit, this is nowhere near–this is much harder than I remember it being.” I remember all the little blunders and the records skipping, or you might have a slight warp in a record. All those little, you know, obstacles really woke me up again to DJing. I think, “Wow, I really appreciate all the technology that’s around me but I also have newfound appreciation for vinyl again: how precious it is, how delicate it is.” I really love the tools that are out there now. I’m the last person you will hear judging someone on what they use to move a crowd. I won’t say, “Oh, they’re not using turntables, and they’re wack!” I’m not that guy. I’m more like, “Hey, how is this person using the tools?” Because there’s a lot of amazing technology out there. We have it at our fingertips, it’s just how you use it. MT: What are you looking forward to doing on vacation? NM: Mama’s Fish House is my first destination–planning to do the backstroke in some wonderful seafood. I’m moving so much throughout the year that I like the time to kick up my feet and do nothing. My girlfriend, however, is different. She likes to climb mountains and swing off trees, run barefoot naked through the woods. I know nothing about that. My idea of camping is the Marriott.

Best of the Wurst Here are the top 10 films of 2016

A

fter a promising spring, moviegoers endured the lousiest summer movie season in memory. The “big dumb fun” movies didn’t deliver but several great, challenging fall dramas and a few sleepers from earlier salvaged the movie year. The great runner-ups that got pushed outside of my Top Ten are A Monster Calls (opening next month), Kubo and the Two Strings, Snowden, The Magnificent Seven and the surprisingly great Ouija: Origin of Evil. When a Ouija sequel winds up being far better than Jason Bourne, you know it’s been a weird year. Here are ten to discover, look forward to or re-watch from 2016.

SILENCE Martin Scorsese’s years-in-the-making historical drama, about Jesuit priests in 17th century Japan, haunted me more than any other film this year. Nothing Scorsese has ever made (not even his faintly comparable The Last Temptation of Christ or Kundun) can prepare you for this. The filmmaker’s deeply personal, grueling and rewarding portrayal of a harrowing test of one’s faith has the cinematic craftsmanship, perfect performances and narrative pull of his finest masterpieces. Scorsese doesn’t go easy on his audience: the deadly-serious exploration of faith and shocking, intimate scenes of violence demand a prepared filmgoer. Brave ticket buyers and Scorsese’s fans will find an engrossing, unpredictable story, brilliant filmmaking and one unforgettable scene after another. Here’s a movie to experience, discuss, re-visit and cherish for years to come. (Opens everywhere in January) NOCTURNAL ANIMALS This Amy Adams/Jake Gyllenhaal-starring puzzle creates two dueling narratives and

asks if men are allowed to appear “weak.” Numerous moviegoers told me how much Tom Ford’s intense mystery/thriller angered them. When it ended at the recent First Light film fest, a friend of mine stood up and yelled out, “What the @%&# was that?”You know what? Good! Ford’s movie intends to tantalize, provoke and leave its audience with an unforgettable experience. Mission accomplished.

KNIGHT OF CUPS Terrence Malick’s 21st century take on 8 and a Half and life in Hollywood is rich with feeling and beauty. Like all of Malick’s films, it’s gorgeous to watch and plays like a cinematic poem. Savor the internal pull of Christian Bale’s lead turn and the scene stealing work from Teresa Palmer and Wes Bentley in support. Many of my favorite movie moments of the year are scattered throughout this under-appreciated gem. MOONLIGHT Barry Jenkins’ debut film is a total surprise. This unique portrait, of a man whose childhood and teen years are marked by three very different identities, has dramatic power and poetic filmmaking to spare. Jenkins modifies our expectations from the first scene, taking his story in unexpected and devastating directions. The concluding scenes are both suspenseful and deeply moving. Everything about this movie is a discovery. 10 CLOVERFIELD LANE A perfect thriller, centering around three characters (including one played by a powerhouse John Goodman) in a single setting. Not a moment is wasted, the tension never stops building and one surprise on top of another awaits us. No one even knew this movie was coming and it arrived with an unprecedented aura of secrecy. It opened in

March and offered imagination than every subsequent summer movie and lived up to its hype. Somewhere, Rod Serling is smiling.

FENCES Denzel Washington’s third time as a director results in his finest work yet behind the camera. He stars alongside Viola Davis in this deceptively quiet, volcanic character drama about the competitive nature of father/son relationships. The wonderful performances and Washington’s polished, un-showy filmmaking compliments August Wilson’s devastating family drama. Leaves a bruise but also a hopeful message of bridging generational gaps. DE PALMA My favorite documentary of 2016 is this brisk, giddy treat for movie buffs. Brian De Palma, the controversial director of Carrie, Scarface, The Untouchables, Carlito’s Way and Mission: Impossible (to name a few) goes over his colorful, rollercoaster career. An insightful watch, even for non-fans, it showcases the spectacular, never-before-seen original (and far better) ending of Snake Eyes and offers an unguarded soapbox for its uncompressing subject.

THE LITTLE PRINCE Despite being one of the top grossing films worldwide, Paramount Pictures abruptly dropped this half CGI/half stop motion animated fantasy from its schedule. Netflix came to the rescue and now you can savor this funny, wondrous and compassionate fantasy. I also loved Kubo and the Two Strings, Moana and Zootopia but this is the year’s best animated film. EVERYBODY WANTS SOME!! Richard Linklater’s latest came and went without much fanfare. The lives of goofball jocks in the days leading up to the start of their college semester, this ‘80s-set comedy is a worthy companion to Linklater’s Dazed and Confused and has some big laughs but there’s also real insight and a big heart. MIDNIGHT SPECIAL Critics rallied around writer/director Jeff Nichols’ Loving but this sci-fi gem, released early this year, is the better film. Mysterious and surprising, it features great turns by Michael Shannon, Adam Driver and Kirsten Dunst and exceptional visual effects. Best of all, it elicits a love for ‘80s genre movies (shades of Stranger Things) and takes its trippy premise as far as it could go. ■

If you really want to feel it, go with celebrating this coming weekend. If it’s as good as it ought to be, you can always stage an encore performance (of at least the sex) on Tuesday. You suck with money. I’ve never met a Leo who could stick to a tight budget for any length of time. Your motto is basically: spend it when you have it, and go without when you don’t. Somehow, you’ve managed to make this zany financial plan work so far–but not without pissing a few people off. This week’s choices, while perhaps not quite so loaded with far-reaching consequences, are similarly tempting and morally confusing. In terms of your day-to-day experience at the moment, don’t underestimate the effects of your environment. It’s more powerful than you think. For example, that warmer winter weather I got last week made me unquestionably happier, more productive, and spontaneous. Your focus on making big changes in your life is well-intentioned but misguided, at the moment. Concentrate on all the little things you can do to make your life–especially regarding your surroundings–better. I believe you’ll find that when you’ve improved all the subtle peripheral stuff in your life, all the big stuff will fall much more easily into place.
