Sexual assault degrades the effectiveness of the military to fight wars, and failures to hold offenders accountable have truly hurt mission readiness.” A great deal of the problem here is that the military justice system is very different than that in the civilian world. “The military puts fighting a war before processing its own criminals–less bad PR for a commander or unit, more missionoriented work accomplished, a Win-Win seemingly,” said my friend. “This bill would remove what is effectively considered a nuisance to some extent. When you consider the fact that sex offenders within the military who are hit with nonjudicial punishment basically will not be registered sex offenders moving forward, the military puts the same society it is charged to protect at risk.” The key then is to get as much of prosecution of sexual assault cases as possible out of the hands of the military. This, as is

both victims and the attorneys prosecuting these crimes and the failure to hold offenders accountable,” she said. “But I think completely removing sexual assaults from the jurisdiction of the military would better address the issue.”

AG FINALLY CLOSES BIG LEASH LAW CASE I think we all can now breathe a little easier that Hawaii Attorney General Doug Chin’s office has gotten justice in the big Case of the Maui Resident Who Didn’t Properly Leash His Dogs. That’s right–today Lady Justice’s hammer fell on Maui Deputy Prosecuting Attorney Mark Simonds (granted, it was a tiny hammer, but still). “The defendant pled no contest to one count of violating Maui’s leash law,” said AG spokesperson Joshua Wisch in a Nov. 17 email. “He was convicted and sentenced to a $50 fine. The offense is

News about sexual harassment and assault seems to be everywhere right now. And why not? It’s rampant all through society, and it’s high time that men–especially powerful men who’ve spent their entire lives cruising on a sense of entitlement–felt at least some heat. Entire institutions and industries–Hollywood, Congress, the White House, etc.–are currently making major headlines as cesspools of assault against women, but in terms of sheer numbers of sexual assault cases, few elements of society can stand next to the might of the United States Military. “Repeated testimony from survivors and former commanders proves that there is widespread reluctance on the part of survivors to come forward to trial,” states a Nov. 16 news release from the office of U.S. Senator Mazie Hirono, D–Hawaii. “Last year, the Department of Defense announced a record number of sexual assaults reported against service members, and the lowest conviction rates for their assailants on record, at just 9%. The most recent Pentagon survey found that nearly 6 out of 10 survivors say they have experienced some form of retaliation for reporting the crime.” These statistics paint a picture of an out-of-control bureaucracy, in which survivors of sexual assault have virtually no incentive to do anything other than remain silent. Since 2013, Hirono has pushed for legislation that would reform this monstrously unjust system–legislation that always seems to go nowhere. On Nov. 16, she and U.S. Senator Kirsten Gillibrand, D–New York tried again by re-introducing their Military Justice Improvement Act in hopes that maybe this year, lawmakers in Washington will finally do something constructive. “We have institutionalized and protected a process that does not result in justice for

victims. I continue to call for the passage of the Military Justice Improvement Act to address this injustice, and thank Senator Gillibrand for her leadership on this critical issue,” said Hirono in a Nov. 16 news release from her office. “The Military Justice Improvement Act would professionalize how the military prosecutes serious crimes like sexual assault and remove the systemic fear that survivors of military sexual assault describe in deciding whether to report the crimes committed against them,” said Gillibrand in the same news release. “I urge all of my colleagues who want to do something to combat sexual violence in our society to join me in cosponsoring this bipartisan bill to create a justice system worthy of the sacrifice of our service members. To do less is to knowingly perpetuate a failed system.” Hirono’s staff told me the text of the proposed bill isn’t available yet, but did provide additional details on what the bill seeks to do. Basically, it would “grant the authority to send criminal charges to trial (disposition authority) to designated judge advocates (military lawyers) in the rank of O-6 [Colonel in the Army, Air Force and Marines; Captain in the Navy] or higher who possess significant criminal justice experience.” These judge advocates would be “outside the chain of command of the accused, exercise professional prosecutorial discretion when deciding whether to proceed to court martial and render decisions to proceed to trial that are free from outside influence and binding upon the Convening Authority.” While this sounds good, I gave all the information provided by Hirono’s office to a friend of mine, a former military officer who’s dealt with sexual assault–both her own and that of soldiers under her command. Her assessment was simple–while the bill makes good progress, it should go further. “This tackles a big portion of what’s wrong, but I think the military has failed to address the issue and should have zero jurisdiction over sexual assaults,” she said. “They have failed for decades to address the problem effectively, and I see the argument for good order and discipline as cutting against the military and not for it.

a violation, so the maximum penalty is $500 and there is no jail time. In return for defendant’s plea, the State agreed to dismiss the remaining charges.” Of course, this is a considerable step back from the 14-count indictment Chin’s office handed down back in July. That 11page document detailed 13 counts of leash law violations and one count of possessing an unlicensed dog, each of which could have brought a $500 fine. And that would have been very bad for Simonds and his dogs… um… you know, I don’t think I ever found out his dogs’ names. “I think I will decline in the interests of his/her privacy,” Simonds said when I asked him for the name of his dogs. “Thanks for understanding.” ■ editor@mauitime.com + @apignataro For more news articles, visit: mauitime.com/news

A presumably humiliated opossum “ran off” in late October after three Pennsylvania men posted photos on social media of themselves giving it beer and kissing it. The Pennsylvania State Game Commission was unamused by the antics of Michael Robert Tice, 18, of Newport; David Mason Snook, 19, of Reedsville; and Morgan Scot Ehrenzeller, 20, of McAlisterville, and charged them on Nov. 2 with unlawful possession of wildlife and disturbing wildlife. According to TribLive, Tice kissed and held the animal while Snook poured beer on its head and into its mouth. The men couldn’t be reached for comment.

Donna Byrne, 53, of Polk County, Florida, was charged with driving under the influence on Nov. 2, but it was her mode of transportation that earned her an animal neglect charge. Byrne was riding her horse, Boduke, down a busy road in Lakeland in the middle of the afternoon. When officers reached Byrne, she was staggering and had red, watery eyes–explained by her breath alcohol level, which was more than twice the legal limit, Polk County Sheriff’s Office spokesman Brian Bruchey told the Orlando Sentinel. Boduke got a ride to the sheriff’s Animal Control livestock facility, but Bruchey said he’d most likely be returned to Byrne, whose rap sheet includes cruelty to animals and drug possession.

Minot Daily News reported that Young yelled at the brother, punched him in the face and knocked him into a wall after he had turned up the thermostat in the trailer, according to a Minot Municipal Court affidavit. When the brother threatened to call police,Young brandished a knife, as his fiancee jumped on his back and bit his ear “to distract him.” Two children were in the trailer during the fight but were uninjured.

A Chicago wiener stand was the scene of a crime gone south on Oct. 31 when Terrion Pouncy, 19, accidentally discharged his gun, which he was trying to conceal in his pants, and shot himself in a most sensitive location. The Chicago Tribune reported police were called to the Original Maxwell Street Polish at about 6 a.m., after a hooded man threatened employees with a small-caliber pistol. One of the employees gave him money from the cash register, according to the complaint against Pouncy, after which the robber stole the man’s cellphone and wallet, and ran outside, stuffing the gun in his pants, but it went off twice, striking his “groin” and thigh. Pouncy kept running and eventually called 911 to report that he’d been shot. He was charged with two counts of armed robbery with a firearm, but couldn’t appear for his bond hearing, as he was recovering at a local hospital.

The unnamed man was carrying on a loud, drunken argument with another man when police were called, reported The Guardian. Officers took the man and the snake to the police station, where the snake was put in a box, and authorities considered whether the “non-species-appropriate transport” could be a violation of animal protection laws.

A family of three were taken from their home and forced into a car on Nov. 7 in Leduc County, Alberta, Canada, by five naked people. The man, who was placed in the trunk, quickly escaped, and his wife and baby also managed to get away, according to The Canadian Press. A passing truck driver picked up the three victims, but then the naked kidnappers’ car rammed his truck from behind, sending it into a ditch. Royal Canadian Mounted Police caught up with the criminals; of the five, two were minors and were not charged. The adults faced charges of kidnapping and resisting arrest. The RCMP gave no explanation for why the five kidnappers were naked, but posited that drugs or alcohol may have been involved.

SMOOTH REACTIONS Tempers flared in Minot, North Dakota, before 33-year-old Cornelius Marcel Young was charged with terrorizing after attacking his fiancee’s brother at a trailer park on Nov. 3. The

WHO KNEW? Poland has one of the lowest birth rates in Europe, so the Polish Health Ministry is using the example of rabbits to encourage its citizens to multiply. The ministry produced a short video with a rabbit “narrator” who explains that members of the Leporidae family enjoy exercise, a healthy diet and little stress. “If you ever want to be a parent, follow the example of rabbits,” the video suggests. The ministry said in a statement to the Associated Press in early November that it was looking for a way to increase public awareness about the low birth rate that “did not offend anyone and was not vulgar.” ■

They protect habitat for 40 rare plants species and 11 native birds. The partnership actively manages 40,000 acres of fragile high elevation forests on the windward slopes of Haleakala. They do this by building and maintaining ungulate-proof fencing in order to protect what is left of our native pristine forest from cattle, goat, pig, and deer damage. In managed areas their crew controls invasive weeds and monitors the forest’s health. They also have an extensive outreach program that works with the community on watershed education. EMWP ensures East Maui’s upland watershed function and protects habitat for native species. They provide opportunities for school kids to learn about watershed function both in and outside of the classroom. They help host an annual juried native species art exhibit at the Hui No eau each fall showcasing local artists and native Maui Nui species. And they partner with other conservation agencies to provide trainings to tour guides about Maui’s natural environment.

HALI‘IMAILE COMMUNITY GARDEN WHO THEY ARE

The mission of Hali‘imaile Community Garden is to build community around food self-sufficiency. Through educational outreach and provision of garden space, Hali‘imaile Community Garden aims to increase access to fresh and healthy produce, encouraging food self-sufficiency and reducing hunger. Organic gardening and the food that it pro-


vides families goes a long way towards bettering the environment, building community involvement, improving family finances, increasing good health and reducing stress through better nutrition. To the community, the garden is an important resource for physical, material, mental and social health. The allotment garden project serves the Maui, Hawaii Island and includes 200 direct program participants, over half of whom are low-income working minorities. Over 18,000 more indirect recipients benefit from the fresh produce grown by their Goodwill Garden project to feed the hungry. WHAT THEY WANT

Ka Lima O Maui’s mission is “Enhancing Lives through Self-Reliance” for persons with disabilities through employment related services. MAUI NUI MARINE RESOURCE COUNCIL WHAT THEY DO

Maui Nui Marine Resource Council is working to protect coral reefs, promote clean ocean water, and restore native fish to the near shore waters of Maui County. This Maui-based non-profit organization was created 10 years ago by the late community visionary Edwin Lindsey and marine biologist Robin Newbold, along with other Maui residents concerned about our island’s declining coral reefs and fish populations. Maui Nui Marine Resource Council oversaw the creation of the Maui Coral Reef Recovery Team, a working group of Hawaii’s top coral reef management experts, scientific researchers, fishers and community representatives, who wrote the Maui Coral Reef Recovery Plan, which lays out a pathway for restoring our coral reefs. The team continues to meet yearly to advise MNMRC staff on implementing the Plan. Recognizing that clear, clean water is essential to the health of coral reefs, Maui Nui Marine Resource Council partnered with The Nature Conservancy, West Maui Ridge to Reef Initiative, and University of Hawaii Maui College to implement the first citizenbased water quality testing program in Hawaii. This program, Hui O Ka Wai Ola, trains volunteers to help regularly test water quality at 12 sites in South Maui and 24 sites in West Maui, and share the results with the State Department of Health. North Beach West Maui Benefit Fund is currently funding much of the West Maui effort; Maui County Office of Economic Development and National Fish and Wildlife Foundation are funding the South Maui program. HUI O WA‘A KAULUA WHO THEY ARE

Hui O Wa‘a Kaulua is committed to developing an conducting model educational programs using voyaging to excite and challenge students and their communities to learn about, respect, and care for the natural and social environment. It’s their vision to have a healthy, productive, safe Hawaii and Earth. In 1975, Hui O Wa‘a Kaulua was formed on Maui to support the construction of a wa‘a Kaulua (double hull canoe). Mo‘olele is a 42-foot canoe with a traditional crab claw sail. It was built on Maui and has voyaged to the islands of Hawaii, Lanai, Molokai, Kaho‘olawe and Oahu. It has been their floating classroom for several decades. On July 11, 2014, the launch of Mo‘okiha O Pi‘ilani took place at Mala Wharf. The 62-foot wa‘a Kaulua is their trans-oceanic voyaging canoes. This wa‘a has been to all the major islands from Hawaii Island to Kauai, including Kaho‘olawe. It currently serves as a floating classroom to students on Maui, Lanai and Molokai. It’s their goal to work with all high schools in Maui Nui and start Jr. Voyaging Clubs with in the high schools. WHAT THEY NEED

MAUI FOREST BIRD RECOVERY PROJECT WHAT THEY DO

They’re a research and management organization dedicated to the recovery of Maui’s native forest birds. They focus their efforts on the most endangered bird which is the Kiwikiu (Maui Parrotbill). There are only 500 of them left in the world and they are only found on Maui. They study their breeding biology, population status, and productivity. They’re also working hard to restore high elevation native forest on leeward Haleakala where Kiwikiu were once found. They will reintroduce them here once the forest is ready for the birds. They have already planted almost 50,000 trees. Not only do the forest and birds benefit from what they do, so does Maui’s watershed and island community. The water on Maui mostly comes from native forests replenishing our aquifers and streams. By helping to restore our native forest, this will in turn help our water resources. This water comes from the forests at the top of the mountain and goes all the way down to the ocean. We need clean water going to our coral reefs and forests help to filter it. Habitat for Humanity Maui has been providing low cost housing and repairs for almost 20 years on Maui. Recently, Habitat expanded its geographic area to include Lanai so that they can help deserving families on Lanai and Maui. They’ve completed more than 108 homes since 2003 and have plans to start a 10-house subdivision in Lahaina next year. They also continue to do small critical repairs and major repairs for those families whose income doesn’t allow them to finance these repairs. All projects done by Habitat are at no profit and no interest, making it affordable for families earning below 80 percent median income. The Lahaina Arts Association provides no-cost art education for children on Maui and Molokai who need it most, through the Maui Youth Art Outreach program. Plus, it’s a casual, fun, family environment.”

Maui has a couple other food truck pods like this in Kahului, by Costco and Home Depot. Chef Ray Santos of Pua‘a and the coming Mediterranean Grill and Bait & Hook trucks thinks this is something that will bring new life to Kihei. “This pod is something very creative,” said Santos. “Something that Kihei has

The space, known as Kihei Station, has become the home for six food trucks, with space for possibly two more. Live music and entertainment is in the works. David Hanley, owner of Island Kiosk, a company that manages this pod, describes it as a, “centralized eatery.”

“A great aspect of food trucks is that you can change them out based on customer demand,” said Hanley. from more obvious suggestions like horror and western, to teen vampire drama or even stoner comedy. “The audience is the gas for our engine,” said Williams. “Their input and also their energy.” This kind of improvisational comedy can’t really be rehearsed, so the flock practices together in what they describe as “drills.” Running through games, and deconstructing them. But there’s truly no preparing for what might happen once they get on stage. The audience helps keep their shows fresh by bringing unpredictable ideas, week after week. “You get spoiled once you do short form improv,” said Stavash. “It’s been measured that you actually get more

passed in the scenes being acted out,” said Scott. A classic example is a fill-in-the-blanks style of play, known in the improv world as “Pillars.” Actors are placed on stage with two pillars from the audience–volunteers who stand by and when called upon supply the actors with the next word in their sentence. Once the Mad Libs are filled in, the improv actors must keep acting, regardless of whether it makes any sense. “We might get turkey, but it depends on who the players are and how you use it,” said Scott. “It could be about cooking a turkey, could be about raising turkeys, it could be about the fact that I just called you a turkey.” “Or that you are turkeys, waiting for Thanksgiving slaughter,” said Williams. “We’re given these hoops to jump through,” said Stavash. “So, watching us be challenged is what makes it funny. We’re constantly being surprised, and the audience is throwing obstacles at us.” Another game they play is called Scene Three Ways. This is where the group will act out a random scene neutrally, and then ask someone in the audience to blurt out a genre. Then the actors must redo the scene, in the style of said genre. Anything goes,

he people at Free Range Comedy work hard each week to produce chicken and farm-related puns for their Facebook page, even though these have nothing to do with the shows they actually perform. This improv comedy group consists of six members, otherwise known as “the flock:” Kristi Scott, Matt Brass, Gabby Anderman, Karen Stavash, John Williams and Chris Rose. The name “Free Range” comes from the feeling of freedom a person has on stage. “Freeing yourself from the cage,” said Stavash. “Freedom to lay your eggs wherever.” They met each other through the larger community of Maui Improv and banded together to pursue their love for short form improv. Short form improv differs from traditional long form improv, not surprisingly, because it consists of a series of much shorter scenes, or “games.” This rapidfire style of comedy is most recognizable from the long-running television series Whose Line Is It Anyway?, which the flock says inspires them. “These games are essentially a set of rules or parameters that must be encom-

Not necessarily for those with aspirations of getting on stage, but also for people who simply want to learn about improv, or get in on the fun. “We’re starting to aspire to get into business and help with team building,” said Stavash. “[Improv] helps in building rapport, building creativity and spontaneity. It’s not about the individual, it’s about how you listen and bounce off of each other.” The flock believes that the skills involved with improv are not only fun, but also valuable on and off the stage.

I looked over at Williams, who shook his head. “We need to strap you

Free Range Comedy performs three times a month. The first Saturday of the month is what they consider their all-ages, familyfriendly performance, taking place at the Maui Coffee Attic in Wailuku. On the third Saturday they perform at the Temple of Peace in Haiku. And then on the fourth Saturday they perform in Kihei at the Pro Arts Playhouse–the theater where the group first met. Shows are $10 and are guaranteed to leave you in stitches. Injustice League Zack Snyder’s new ‘Justice League’ is a waste of everyone’s time ★★★★★ Rated PG-13 / 120 Min.

T

he Super Bowl of comic book movies for the DC Comics universe has finally arrived and it’s a major bust. Years of laying down the narrative groundwork, establishing the classic comic book characters in their film forms and finding a way to wrap them all together in one big cinematic tamale has led to an event that isn’t so special, after all. At the start of Justice League, Superman is dead and Bruce Wayne (played by a tiredlooking Ben Affleck) searches the globe to put together a money-making franchise for Warner Brothers–I mean, a team. Having already recruited Wonder Woman (the effervescent and better-than-this-moviedeserves Gal Gadot), Wayne tracks down Arthur Curry/Aquaman (an ill-used Jason Mamoa) and Barry Allen/The Flash (played by Ezra Miller, in an apparent effort to be as irritating as Jesse Eisenberg’s Lex Luthor). There’s also Victor Stone/Cyborg (played by a charisma-free Ray Fisher) and the appearance of a monster named Steppenwolf who, strangely enough, isn’t introduced to “Born

to Be Wild” playing on the soundtrack. The pacing and momentum are off from the beginning, as the editing suggests that, at best, we’re watching a work in progress. Every cut to another character feels like a channel has been changed abruptly to yet another lousy movie. The blame can be shared by original writer/director Zack Snyder, as well as the un-billed second writer/director Joss Whedon. There’s also the slew of writers and producers attached, who took a sure thing and mishandled it. Despite how good the actors appear posing alongside one another, none of them have any chemistry with their teammates. The camaraderie between The Expendables is a raging bromance in comparison. Affleck was exceptional before as Wayne but now seems unengaged. Mamoa’s lively Aquaman appears on loan from a far more interesting movie and it’s easy to forget that Amy Adams, J.K. Simmons and Diane Lane are also in this. This is clearly Gadot’s movie, if only because it’s such a flimsy vehicle to steal. Steppenwolf is a terrible villain, one of the lousiest bad guys to wreck havoc since Sharon Stone in Catwoman. The CGI baddie is voiced indifferently by Ciaran Hinds and wears a helmet somehow sillier than the one

David Thewlis brandished in Wonder Woman. Loose ends, pointless bits, ill-timed sequences and scenes cut too short litter the oddly too-brief 120-minute running time. After an early, useless found-footage interview with Superman, Snyder indulges in his staple of a slow motion music montage for the opening credits. It worked great for Watchmen but falls flat here. Subplots about a Russian family and the state of Martha Kent’s real estate dealings (?!) are especially baffling. The Wonder Woman portions work best, while the chatty Superman bits are especially

lackluster. Justice League isn’t a disaster like Suicide Squad but isn’t better than Batman V. Superman: Dawn of Justice, which at least had a first rate Affleck turn and a climactic tussle that was suitably earth-shaking. Here, someone powerful knocks a superhero into a wall, leaving an impression of rubble and cracked cement, until the fallen hero gets up and it happens again, and again. We have a year before the Mamoa-starring, James Wan-directed Aquaman. I hope it’s not as poorly constructed and painfully corny as Justice League. ■

This is a terrible time to crash diet (as if any time was great for that kind of thing). I know you just had Thanksgiving and all, and with the holidays approaching, you’re worried about the extra pounds piling up. But the drastic measures you’re likely to be drawn to at the moment are a really awful idea. Feel free to implement any sensible, moderate plans of action, but anything that smacks of a get-rich-quick scheme, designed to get results fast, just won’t work, and it’ll probably leave you worse off than when you started. CAPRICORN (DEC. 22-JAN. 19)

The days are getting mighty short–depending on your schedule, you might not get much sunlight in any given day. That’s depressing–literally. Please don’t underestimate how much good a little natural daylight could do for you. So many of your problems would be easier to contend with, if you had more vim and vigor. Where do vim and vigor come from? Not from fluorescent lighting, that’s for sure. Go outside! A daily morning walk could do wonders for your mental health. Specifically block out some time in your schedule to get your dose of sunlight-induced happiness.

Although it’s sometimes a good idea to call someone’s bluff, I wouldn’t advise trying it this week. What seems like a possible put-on designed to manipulate people might just be the real deal. The only way to find out for sure is the hard way, and you really can’t afford that at the moment. Keep your head down, soldier on, and see what happens a little ways down the line. Leos are hardly renowned their patience. This is an abysmal time for big changes, Aries. You’re always capable of drastic action, but at the moment it’s not likely to get you where you hoped to go. There are simply too many factors you can’t control; by the time you’re done zanily swerving around them, you’ll have driven yourself to a location you’ve never heard of, not on any map. That, of course, could be its own adventure, but I’m guessing you’re more focused than that right now, and would actually like to arrive within hitchhiking distance of your actual destination. If that’s the case, foot-to-the-floor acceleration and crazy stunt car maneuvers are a terrible idea–slow and steady will win this race.

When Virgos see a problem, they try to solve it. It’s almost a compulsion. Other signs can watch the houseplants wither away from day to day and never get around to actually watering them until it’s too late. That’s all admirable–right up to the point where your entire life consists of putting out fires, and just running from one blaze to the next. Is that what your life’s become? Perhaps since you can’t see problems without trying to remedy them, you should give yourself a break and find a refuge where those problems will be out-of-sight, and at least half out-of-mind. LIBRA (SEPT. 23-OCT. 22)

I’m not a big proponent of the whole soulmate thing. But sometimes you do just meet someone and you get them, right off the bat. They can see right through you– in a good way, because they like what they see. This, my dear, is rare. This should also be easy. You’d actually have to try hard not to forge a connection. But some Libras, sadly, are just self-sabotaging enough to screw it up by suddenly becoming insanely shy or disappearing right when things are just getting good. Don’t worry if you act like an idiot–either they can handle that or they can’t, and if they can’t, the connection wasn’t what you thought it was, anyway. Go out there and be your great goofy self. Do that, and you can’t screw it up.
