HAWAII SUPREME COURT DISMISSES CASE AGAINST MAUITIME PUBLISHER There is no more State v. Thomas Russo. Maui County Prosecutor J. D. Kim’s five-year effort to punish MauiTime’s publisher for photographing two Maui Police Officers back in November 2012 is finally over. Very long, stupid story short, Russo was coming down Haleakala Highway on the morning of Nov. 20, 2012 and encountered unusually heavy traffic. In fact, he’d run into the Maui Police Department’s “Operation Recon,” a big crackdown on illegally lifted vehicles and tinted windows. Pulling to the side, Russo got out his smartphone and began walking towards two police officers who were stopping cars. After a few minutes of back-and-forth with the officers, during which Russo repeatedly insisted that he was a journalist and had every right to stand on the side of the road and photograph them, the police officers arrested him. In 2014, Maui District Judge Kelsey
Kawano had dismissed the whole ridiculous case (Maui prosecutors were insisting that Russo’s arrest was because he had “failed to comply” with the officers’ orders). Kim could have left it there, but decided to appeal to the Intermediate Court of Appeals (ICA). In the spring of this year, that court overturned Kawano’s decision, which threatened to start the entire prosecution over from the beginning. Instead, Russo and his attorneys–Ben Lowenthal, Jake Lowen-
thal and Samuel MacRoberts–then appealed the ICA decision straight to the Hawaii Supreme Court. On Nov. 9 of this year, Jake Lowenthal argued Russo’s case before the Supreme Court, which heard the case in front of students at University of Hawaii at Hilo’s Performing Arts Center (Richard Minatoya argued for the state). On Dec. 14, the Hawaii Supreme Court issued its 40-page opinion, which was written by Justice Richard W. Pollack. “[W]e vacate the ICA’s May 1, 2017 Judgment on Appeal and affirm the district court’s July 9, 2014 Notice of Entry of Judgment And/Or Order dismissing charges against Russo with prejudice for lack of probable cause,” states the opinion. Dismissing the charges “with prejudice” means the ruling is on the merits of the case and the state cannot bring action again on this claim. It means the case is over, though J. D. Kim could still ask the Hawaii Supreme Court to reconsider the case (which is rare). Anyway, the Hawaii Supreme Court’s reasoning was simple: Maui Police Officers Rusty Lawson and John Fairchild should never have arrested Russo because he wasn’t doing anything wrong and had, in fact, complied with Lawson’s and Fairchild’s instructions. Page 37 of the opinion makes all this abundantly, explicitly clear: “The video footage stipulated into evidence by the parties shows that Russo did, in fact, comply with the officers’ order,” states the Hawaii Supreme Court opinion. “When Officer Fairchild instructed Russo to return to his vehicle and turn on his hazard lights, Russo complied. When Officer Fairchild waved his hand and directed Russo to “step off to the side” to avoid getting “run over,” Russo likewise complied–responding, “Okay,” and walking away from the general area to which Officer Fairchild had gestured. When Russo was subsequently approached and ordered by Officer Lawson to “stand back there,” Russo complied by taking a few steps away from the area and asking whether he could stand on private property. When Officer Lawson responded that he could not and ordered him to ‘stand back there,’
Overheard “Our Christmas decorations will be made out of tampons and cigarettes.”
Russo took several steps back towards the highway and asked, ‘Can I stand on public property?’ When Officer Lawson then threatened Russo with arrest, Russo immediately began walking backwards, away from the area and towards the general direction to which Officers Lawson and Fairchild pointed. For the remainder of the video, as the police officers persisted in walking towards Russo and commanding that he ‘stand back there,’ Russo continued to walk backwards and away from the traffic stop area. It appears from the video recording that Russo only stopped walking backwards when he was physically prevented from doing so and arrested by the officers.” Commenting a few hours after the Court handed down its opinion, attorney Jake Lowenthal was ecstatic. “We’re very pleased with the results,” he said by phone. “We are happy that the Hawaii Supreme Court has adopted the path that we advocated for. And we believe this is a significant ruling and it’s going to help the citizens of Hawaii understand what exactly their First Amendment rights entail.” And now I’m going to say something as Editor of this paper, a job I’ve held for 11 years. In that time, people have often asked me questions like “Why do you hate cops?” We–this paper, its publisher, staff and myself–do no such thing. We have never hated cops, and never will. But we do hate stupidity conducted at taxpayer expense. We hate clearly unjust actions taken by the state against members of the public. And we hate petty, vindictive prosecutions–again carried out at taxpayer expense–that are designed to intimidate both the press and public. This entire five-year ordeal–this monstrous “State v. Thomas Russo”–fits all of that. That it took so many years and a ruling by the Hawaii Supreme Court to show that Russo was simply doing his job as a journalist back on Nov. 20, 2012 and should never have been arrested is why we publish the stories that we do about Maui law enforcement, and why it’s so important that all news organizations out here do the same. By the way, the reporting on Russo’s case from The Maui News–the only daily “paper of record” in Maui County–has been less than stellar. Though the paper immediately reported Russo’s arrest, covered his trial and the subsequent Appeals Court reversal, it never reported that Russo appealed to the Hawaii Supreme Court, much less their decision. And earlier this year, the paper’s story on the Appellate court ruling also reported that Russo had merely been “detained” by the Maui PD, rather than arrested, booked and prosecuted, as was actually the case. ■ editor@mauitime.com + @apignataro

FILMMAKER BRIAN KOHNE TO TEACH UH MAUI COLLEGE CLASS Filmmaker Brian Kohne will teach a digital storytelling class for the new Creative Media Program at University of Hawaii Maui College in spring 2018. In the class, Storytelling–Find your voice in digital media, Kohne will introduce students to the core principles, methodologies and creation of digital storytelling; the curriculum will encompass various avenues of storytelling include movies, literature, spoken word, television, commercial art and online media. The filmmaker, and head of Hawaii Cinema, has written, directed and produced two Hawaii-made films. The most recent, Kuleana, debuted earlier this year at the Maui Film Festival, where it earned the 2017 Audience Choice Award. The mystery-drama, featuring an all-Hawaii cast and crew, has since screened at film festivals around the world, garnering several other Audience Choice awards. Kohne also wrote and directed the 2011 Maui-made indie Get a Job which features some of Hawaii’s top entertainers including Eric Gilliom and Willie K in the starring roles. Get a Job also was recognized in more than a dozen film festivals. UH Maui College’s Creative Media Program Coordinator Daniel Kruse said the addition of Kohne to the faculty will inspire students who want to be in the creative media industry. “A lot of people are unaware of this new creative media program at the college,” Kruse said. “Students will be able to start building their portfolios, reels and contacts in the industry while taking these courses.” Inspired to become a writer, director and producer while growing up on Maui, Kohne is in an ideal position to share his path with UHMC students. “I’m excited to share some of

everyone, and they are being used more frequently in a widening number of fields,” Kohne said. “A career in this industry is exciting, challenging and highly stimulating.” The creative media program offers a twoyear associate in science degree in digital storytelling (film), computer graphics or web design at UH Maui College, with a transfer opportunity to a two-year bachelor’s degree in creative media at UH West Oahu. For more information, contact Creative Media Program Coordinator Daniel Kruse at krused@hawaii. edu or 808-984-3324. -Suzanne Kayian

After a search lasting nearly seven months, ACLU Hawaii has finally chosen a new executive director. Vanessa Chong, who has run the office since 1984, is retiring next year. Her replacement, ACLU Hawaii officials announced on Dec. 13, is Joshua Wisch, currently a Special Assistant to Hawaii Attorney General Doug Chin. According to the ACLU Hawaii announcement, the position had more than a hundred applicants from all across the country. But in the end, they selected Wisch, whose most recent work as AG Special Assistant including acting as a spokesperson for the office (I have worked with him in this regard on a few occasions, and always found him competent and professional). “Wisch, who has most recently served as Special Assistant to the Hawaii Attorney General, has over 15 years of cross-sector professional experience in Hawaii,” stated ACLU Hawaii’s announcement. “Wisch’s management background in addition to his understanding of Hawaii, the legislative process and past experience leading political campaigns and issue advocacy is expected to significantly advance the ACLU’s agenda statewide. Wisch earned his bachelor’s and master’s degrees from Carnegie Mellon University and his J.D. from the Georgetown University Law Center.” This is a critical time for civil liberties in the U.S., and the ACLU as a whole. In its Dec. 13 announcement, the organization said it’s “facing a barrage of challenges on multiple fronts including erosions to the rights of immigrants and LGBTQ individuals, attacks on reproductive health services for women and ensuring free speech and protest rights for all points of view. Additionally, the organization continues
what I’ve learned on a journey which began at Baldwin High on Maui where I made my first Super-8 movie in 1981,” Kohne said. “We’ll be joined in class by a number of professional storytellers, and together will explore a colorful array of media and methodologies which empower our creation and presentation of digital media products.” Kohne is a graduate of San Jose State University with degrees in art and radio, TV, video and film. His professional experience includes sales and marketing, corporate video production, sports broadcasting and interactive television software development. “Technology changes daily and access to media-related tools are available to almost

to press for much-needed reforms of the criminal justice system.” For his part, Wisch said he’s “humbled” to be joining ACLU Hawaii. “Vanessa Chong’s work for more than thirty years building the Hawaii affiliate and safeguarding our civil liberties has been extraordinary,” he said in the Dec. 13 announcement “Her legacy is an inspiration and I am grateful for all the support she, the Board, and staff have provided during this transition. I am proud to join a group of people dedicated to protecting the constitutional rights of everyone in our state, and assure you that my heart is in the work.”

A MESSAGE FROM GOD?
Cai, a 28-year-old man in Lianyungang, Jiangsu Province, China, had plenty of time to consider traffic patterns as he waited for the lights to change during his daily commute. So much, in fact, that he decided to take matters into his own hands on Sept. 27 and paint new traffic arrows on the roadway. A traffic camera captured the whole project as Cai carefully added a straight arrow to the existing left-turn and U-turn arrows. “I saw the straight lane was always packed with cars, while the turning left lane has a lot of space,” Cai told police. “So I thought changing the signs would make my commute smoother.” The BBC reports that police fined Cai the equivalent of about $151, and crews removed the new straight arrow from the road.
An 18th-century statue of the crucified Jesus that was removed for restoration from the church of St. Agueda in Burgo de Osma, Spain, held a surprise in a most unusual spot. As historians removed from Jesus’s backside a section of the carving meant to look like a cloth, they discovered two handwritten letters dated 1777 and signed by Joaquin Minguez, then-chaplain of the cathedral. Minguez details life in the community, including harvest reports and diseases, and tells about the sculpture’s artist, Manuel Bal. Historian Efren Arroyo told the Spanish newspaper El Mundo it appears Minguez intended his letters to be a sort of time capsule. The original letters were sent to the Archbishop of Burgos for archiving, but copies were returned to Jesus’s hindquarters to honor Minguez’s intent.

Timothy Colton, 28, is cooling off in the Clark County (Nevada) Detention Center after being charged with arson and the attempted murder of his 66-year-old mother, who has limited mobility. The Nov. 27 altercation apparently started over a laundry dispute, but North Las Vegas police said Colton became aggressive and threatened to kill his mother and burn the house down. Fox News reports that Colton set fire to the front door and then ran away to hide under a car in a nearby parking lot, where officers found him. Police said he was “kicking the back seat door and hitting his head on the plastic partition between the front and rear seats” in the patrol car during his arrest. He was being held on $100,000 bail.

A man in Australia couldn’t wait for Santa to deliver his Christmas wish: a 5 1/2-foottall “Dorothy model” sex doll. So, according to the Victoria Police Kingston Crime Investigation Unit, he broke into an adult entertainment store in Moorabbin on Dec. 4 by cutting through a fence with bolt cutters and smashing his way through the door. After quickly loading Dorothy into the back of his van, he took off. Security cameras caught the event, but the thief was disguised with stockings and a balaclava pulled over his head.
A suburban parking lot in Calgary, Alberta, Canada, has been the scene of repeated crashes, as drivers there can’t seem to avoid the Sage Hill Rock–a large boulder surrounded by yellow cement curbs. At least three photos of cars that have collided with the rock–two hung up on it and the third tipped over on its side–were posted on social media over the weekend of Dec. 2, according to the CBC. “I don’t know how you miss this big rock,” said Brangwyn Jones, who lives in Sage Hill. An employee of a nearby business said the rock was placed in its spot to keep people from driving over the curb. The management company of the retail center had planned to remove it, but an uproar from community members (“It’s far too entertaining!”) may have stalled those plans.
THE PASSING PARADE Faye Preston of Hull,Yorkshire, England, loves her neighborhood–even the homeless folks who gently ask for change, or, in Preston’s case, make love in her driveway. She stepped out one night in November to smoke a cigarette and saw a couple under a blanket in her drive, and decided to let them be. But when she went out the next morning, “They were having actual sex on my driveway. The movement going on under the cover was unmistakable,” Preston wrote in the Hull Daily Mail. Still, she was worried about running over them, so she called police, who eventually removed them. “If I was homeless, I’d come here too,” Preston wrote. “Where else can you go for a posh meal, followed by cocktails in a swanky bar and finish the night stepping over some frisky homeless people fornicating on your driveway?”
Chuck E. Cheese restaurants are undergoing an evolution of sorts, and employees at the location in Oak Lawn, Illinois, were only following company protocol when they took sledgehammers to the plastic head of the animatronic mouse on Nov. 28. In a video recorded by a reporter with the Oak Lawn Patch, two female employees half-heartedly strike Chuck’s head for several minutes before it finally breaks apart. Meanwhile, other workers load furniture and games into a moving van. The Oak Lawn location has closed after experiencing a particularly difficult period, as it became the scene of violent brawls and gang activity. But they won’t have Chuck E. to kick around anymore.
UNCLEAR ON THE CONCEPT The Jilin Daily newspaper in eastern China has provided a handy guide for residents about what to do in case of a nuclear attack from North Korea. Cartoons illustrate how to wash radioactive contaminants from shoes with water and use cotton swabs to clean out ears. “If war breaks out,” commented the statebacked Global Times, “it is not possible to rule out the Korean Peninsula producing nuclear contaminants, and countermeasures must be... spoken openly about to let the common folk know. But at the same time, there is absolutely no reason to be alarmed.” ■

’ve bought and sold items on Facebook’s Marketplace a few times, and it was great until you came along. You were selling a $310 Tiffany bracelet for just $90. I thought it was good deal, especially after you said it was a gift from an ex that you didn’t want anymore. I drove all the way to Paia to meet you, and you certainly looked the part: fancy lady in a silver luxury car. Of course you were a fraud–I discovered that when I took the bracelet to Tiffany to have a couple links removed, and the clerk very graciously pointed out how the bracelet was a fake. ZERO WASTE!
How Maui Huliau Foundation and others are trying to keep us from drowning in garbage. By Lantana Hoke
W
e’ve all noticed it. We see it at our favorite beaches and surf spots, waterfalls and hiking trails. It’s becoming as common as tourists. It’s scary and ugly. It makes most of us angry and some of us hopeless. Trash. Specifically, plastic. Whether washed up on our shores or in our workplaces and homes, it’s a difficult problem with not always simple solutions. Living on an island makes us all more keenly aware of pressing environmental issues we face, but it’s not always easy to know what to do. While it’s tempting to stick our heads in the sand in shame and despair, some
10 DECEMBER 21, 2017
of our island residents are doing the exact opposite. One of the local nonprofits that’s dedicated to addressing this challenge is the Maui Huliau Foundation. Executive Director Malia Cahill and Program Assistant Ashley O’Colmain are the two-woman show running the Huliau Foundation. Their programs seek to address environmental issues on Maui through empowering youth. These women and kids they work with have some amazing ideas about how we can deal with our trash problem. There’s a lot of trash happening on this island. The Central Maui Landfill will be at mass capacity in 2026, just eight years from now. With more than 165,00 residents (and growing), and many visitors
at any given time that do their share of waste-creation, trash is an issue that affects us all. According to the EPA, the average American create 4.4 pounds of waste per day. So what can we do to keep from being an average American? At local events around the island, you may have seen them. If you’re one of the more than 9,000 people who’ve attended “Green Events” like Ho‘omau, Punana Leo O Maui’s annual event, then you’ve definitely seen them. Posted at zero waste stations, Cahill, O’Colmain and their youth and volunteers help attendees sort their waste into compostable foodware, food waste, recyclables and trash. Having consulted with planning committees
and vendors beforehand, all the singleuse containers and utensils at the Green Events are compostable. So far, these events have diverted over 2,000 pounds of waste from landfills. “It’s about living your values,” said O’Colmain. “If you value your environment, you have to do these things that aren’t really that hard to do, it’s just about knowledge and changing our views. And it’s effective… We man the stations because part of it is that we want to educate people. They want to talk. People want to know that there are things they can do, and that we’re in it together.” So far, this little team with huge drive has done many popular events around the
island, such as Paddle Imua, Haleakala Waldorf Faire, the Indigenous Crop Biodiversity Festival and Kula Festival, Ulu Festival and the Local Wild Food Challenge, with tentative plans to do this year’s Maui Film Festival. This month, they even did their first private event–a wedding. It’s a long day for the Huliau team, which started before the event to set up and ended long after everyone went home. O’Colmain told me she clocked a 14-mile day at the recent Haleakala Faire, checking out stations, coordinating volunteer shifts and hauling waste. Through its work, the Huliau team hopes they can inspire others in their personal lives. Taylor Redman, a Huliau student and junior at Kamehameha who’s involved in the Green Events, said that “It’s important for everyone to know where their waste goes and the alternatives when they separate their compost and recyclables so they don’t all just end up in the landfill. It’s even more important for people in Hawaii because we only have so much land for those landfills to be.”
tributed more than 15,000 bamboo sporks to promote the use of reusable utensils in place of single-use plastic utensils. The foundation sells the sporks at Tin Roof in Kahului, Product of My Environment surf shop in Paia, Jaws Country Store in Haiku, Designing Wahine in Makawao and Baya Bowls, Hale Zen and Honokowai Farmers Market in West Maui. Huliau students also worked with partners on a program called Foam Free Future, which led to the launch of Surfrider Foundation’s Ocean Friendly Restaurants in Hawaii, to help support restaurants to reduce styrofoam and plastic waste. The students visited restaurants to give them information about alternatives to styrofoam food service items.

After each event, with gloves and grit, the women of Huliau and their volunteers sorted and weighed the waste so they could record and report on what’s happening. I worked with them at the recent Waldorf event, as they and their kids sorted huge bins of food waste and compostables. “It’s just the right thing to do,” said O’Colmain. “That’s why I have so much conviction about sorting through trash. Sometimes I feel like it makes me look a little insane, but it’s the right thing to do so I’m going to keep doing it. We all want to live in a world where we’re more in tune with our environment.” Cahill picked up a huge bag of compostable products and stood on a scale. “Thirty pounds” she called out, and a kid recorded it on a spreadsheet, while we sorted food waste and compostable containers into different bins. The food waste and compostables went to O’Colmain’s farm, Kupa‘a Farms or farms near the events. The Green Events started back in 2015, when Lahaina Plantation Days approached the Huliau Foundation about reducing waste at their event. The Aloha Aina event was also happening around that time. The Huliau Foundation designed zero-waste stations and helped the events with their efforts to reduce waste. Event planners and community organizers were looking at ways to lessen the trash impact at these large-scale events, and the idea grew from there. The Maui Huliau Foundation now works with vendors and planning committees for ideas for compostable and reusable products, provide volunteers to work the stations, and weigh all the waste after the event to measure impact. The biggest event they’ve done so far is Ho‘omau, which attracted more than 3,600 Maui residents this year. In a short film that Huliau youth made about the Green Events, Trish Ishikawa, the Coordinator for Ho‘omau, said that “At the school we’re always teaching kids about malama‘aina and aloha‘aina, and we thought it would be really important to show them and the public that this is something that is possible. We had a lot of positive feedback from the public.”
They also did a trash audit last year for the Made in Maui County festival, one of Maui’s biggest events, attended by over 10,000 people. They sorted trash, weighted what could have been recycled or composted, and went around to the vendors to see what products could be replaced with compostables. They made recommendations to the event planning committee about how it could go zero-waste next year, which would have a huge impact on reducing the amount of trash that goes into the landfill. The Green Events concept is generating a lot of interest. It’s a no-brainer for events and festivals that generate huge amounts of waste, and therefore have huge impact, but sometimes planners don’t know where

to start. Huliau can’t do every event, but the Foundation also does consulting, and it hopes to pass the knowledge on by loaning the zero-waste stations and training workers to use them. As interest grows, Cahill and O’Colmain are searching for ways to make Green Events more accessible to every event. One thing they currently need is a place to store their zero-waste stations and equipment in central Maui. “We’re so used to trash cans and throwing things away,” Cahill said. “That has been part of the challenge of this program, to break this habit that is so ingrained in us, but at the same time that’s a big part of the opportunity that this program provides. It can be really empowering to work as a community to see how much of our waste we can reduce. We’ve gotten very positive feedback. It’s a little more effort at first, but people always feel great about the end result. It’s been really exciting to see some of our biggest events on Maui stepping up.” The Green Events are just one of the projects the Huliau Foundation takes on. Huliau students are increasingly concerned about the growing problem of plastic in our oceans, and have started several other creative projects to address it. For the past three years, Huliau students have gone to the Plastic Ocean Pollution Solutions (POPS) Youth Summit, where they meet with youth from all over the world, share ideas, and get fired up about ways they can address plastic reduction on Maui. One of these ideas is a project called #sporkitup, which has produced and dis-
And all of that isn’t even the bulk of what the Huliau Foundation does. Cahill and O’Colmain also teach middle and high-school students to make environmental films, which have been screened at film festivals. The videos, which can be found on YouTube, are clever and charming. They use whiteboard or claymation, music videos, and storytelling shorts. In some videos, kids act as “Sea Police,” educating viewers about coral-killing sunscreens and using plastic forks. One popular video parodies Maklemore’s “Thrift Shop,” with lyrics like “You want some sweet potatoes, I got some sweet potatoes, Mexico guess what, don’t send us your tomatoes!” Huliau is currently enrolling for its Westside spring program, which is now in its second year. Students can apply at Mauihuliaufoundation.org. “When people see you taking big action, it inspires them to take action on whatever scale they can,” said O’Colmain. This is a sticking point for some when it comes to the daunting environmental problems we all face. There’s sometimes a defeatist attitude when it comes to personal responsibility and the efficacy of changing personal behavior. What good, the thinking goes, does not using a plastic fork do in the face of industry and corporate waste, which pollutes at a far more vast rate than an individual ever could? While it’s true that policy is essential to solving the environmental crises we face as an island and a planet, it’s not true that our day-to-day actions don’t have an impact on
our island community. From the plastic lids on to-go cups and forks at parties, each individual’s choices do make an impact. “Plastic is going to last a long time, and you’re only going to use it for a few minutes,” said O’Colmain. “We just want people to be mindful and aware about how much plastic is in their daily lives.” Or as Huliau student Redman said, “Our lives as consumers have become suffocated by plastic and in this generation we barely use reusable utensils and containers. We all need to realize that we do have a huge impact on our environment and we can change our ways to help ourselves and our environment.” Committing to not using single-use plastic is a great first step. Carrying around a Huliau spork, or even just a set of utensils from your house, is just a matter of developing a new habit. It can be hard to be the first, but attitudes are changing, awareness is growing, and we can all be a part of that shift. Many people already carry around their reusable water bottles–consider the amount of plastic bottles saved from just the proliferation of the Hydroflask. The next level is assessing our everyday plastic use. There are all kinds of products, from reusable “ziplock” bags to beeswax sandwich wrappers (check out local brand Bee Akamai by Lani Monroe) aluminum straws, insulated coffee cups and mason jars for cold drinks. While these things can mean an initial investment, they save money and plastic use in the long run. It’s all about mentality and behavior change. Back when the plastic bag ban was up for hearings, some residents gave passionate testimony about the essential nature of these single-use nightmares, which were choking our shorelines and roadsides and killing sea life. Now that they’re gone, we hardly notice the difference, and what a difference it’s made. If you must buy single-use products for your office or classroom event, birthday party or barbeque, buy compostable ones– they aren’t much more expensive. If your favorite plate lunch place or smoothie shop doesn’t use these products, speak up and ask for them. Native Hawaiians lived sustainably, while the American nation creates more waste than any other in the world, and consumes more resources than most. American consumer culture teaches us that we need newer and better things all the time, that we are imperfect so need to buy this and that to become better, and that the way to show love is through giving people stuff. None of this has to be true. If you surf, dive, enjoy the beach, hike our mountain trails or breathe air, this is your concern. It’s all of our kuleana. We all want to protect our island, and we cannot wait for our leaders to tell us what to do. So compost. Shop at your farmer’s market. Buy a Huliau spork and bust it out the next time someone hands you a plastic fork. And when you see the Maui Huliau team at a local event, helping to save thousands of pounds of waste from going to our landfills, say hello. ■ editor@mauitime.com For more news articles, visit: mauitime.com/news

'Star Wars: The Last Jedi' The latest chapter is bold, but problematic ★★★★★ Rated PG-13 / 152 Min.

here are no spoilers in my review of Rian Johnson’s Star Wars: The Last Jedi. Here’s the loosest of plot summaries: Rey (played by Daisy Ridley) is still on that island with a long-gone Luke Skywalker (Mark Hamill). While the other rebels are fighting against the newly assembled evil Empire, Kylo Ren (Adam Driver) remains angry as ever. For the first time since George Lucas stopped making these movies, we have a writer/director of real vision at the helm who’s unafraid to take major risks. After the enjoyable fan film that was Star Wars: The Force Awakens and the needless footnote of Rogue One: A Star Wars Story, we get Johnson’s take on this series, which has been made with passion and designed to shake things up. The strongest portions in The Last Jedi are enough to elevate it past an iffy start and how, at times, this resembles the most expensive toy commercial ever made. While the strangely unloved Ewoks in Return of the Jedi made some accuse Lucas of selling out to the toy companies, they were genuinely integral to the plot. Here, the cute and squeaky Porgs are introduced in a funny but very forced manner. There’s lots of scenes here where the camera pans across vast new ships, with new characters standing around... I kept waiting for an announcer to declare, “Each Sold Separately! Batteries Not Included!” Johnson’s dialogue is often quip-heavy, a choice that doesn’t always feel genuine. Laura Dern makes a striking entrance playing a pivotal role, but she’s misused, as her character arc is seriously confused. Likewise, Benicio Del Toro shows up and, rather than energizing his limp subplot, gives an overly
Where are the Porgs? All hail our new Porg overlords!
mannered, self-consciously “quirky” performance. The late, great Carrie Fisher gets the worst of it, as her final performance requires her to do some frankly laughable things. Rather than deciding whether to kill off Princess Leia or have her remain in the series, Johnson essentially chooses neither option. Fisher deserved a better swan song than this. Of the subplots that don’t work, a side trip to a gambling casino is a disaster, with imagery that reminded me of the grotesque Lucasfilm Strange Magic from a few years back. For all the undeserved flack Lucas’s prequels still get, nothing in them was as cringe-worthy and out of place as this section of The Last Jedi. It doesn’t help, either, that the powers of the Jedi are played fast and loose; at times, those strong with The Force can survive a torrent of laser
blasts, being ejected into space, having boulders and rubble land on them or, basically, anything rooted in science and logic. By this point in the movie, I feared that, like the characters on screen lament, all hope was lost. Yet, when the focus is on Rey and Luke on the island, it works beautifully. These scenes are so riveting, they carry the rest of the movie. Numerous confrontations between Rey and Ren (Driver’s excellent performance is the best in the film) are stylishly crafted and complex enough to make this more than just a children’s fantasy. A flashback with a Rashomon approach and a reveal of a steam iron are just two examples of how playful and visually dynamic Johnson’s approach becomes. There are two massive climactic sequences, both full of big reveals and thrilling action.

While the second set-piece comes late in the film, both of these crucial showdowns are both so rousing and emotionally rich, I didn’t care about the overextended running time. Johnson’s film may be a fantasy but it’s also a political film about rising above those who exploit the downcast and rule by bullying. The final image even suggests the birth of an activist. There’s also my favorite moment in the film, where Luke acknowledges an old friend with a wink; it stirred the lifelong Star Wars fan in me. The Last Jedi has big peaks and valleys but left me satisfied overall for being so bold. For all the calculated corporate hands on deck, this is the work of a real writer/director. Not since Luke Skywalker cut off his own head on Dagobah have these movies seemed so weird–and that’s a very good thing. ■

Horoscope
Sign Language SAGITTARIUS (NOV. 22-DEC. 21)
Things aren’t as dire as you think. Yes, you’re caught in the grip of a fast current with a potential lethal and certainly unavoidable waterfall up ahead. However, you have some time. You don’t need to grab at the first paddle or lifesaver thrown at you. You have a few minutes to pick and choose and consider your various options. They’re all better than your current situation, but one is probably a lot better than the others. Avoid having to go over the falls in a barrel or an inflatable raft. Head for the helicopter. CAPRICORN (DEC. 22-JAN. 19)
Surprise, surprise. One of those people who’s always opposed you has decided to speak up again this week to tell everyone how wrong you are. You’re used to this by now, so hopefully you’ll be able to defend yourself without getting huffy or petty. Making a good impression right now is an especially good idea because someone you’ve never teamed up with before is considering hopping over to your side of the fence. I don’t need to tell you what a great ally they’d be, but it might motivate you to know this: if you get them to come around, you’ll get everyone to come around.
GEMINI (MAY 21-JUNE 20)
You’ve worked hard to get to where you are. Let’s be realistic, though; most of your motivation has been mostly selfish; you did it to make yourself better off in some way. There’s nothing wrong with that, of course. However, here you are, and because of all that hard work, you’re in a position to help another–perhaps many others. It might not immediately occur to you, because it’s not exactly in line with your original intentions, but I hope you’ll consider doing it anyway–not because it’s the holidays, but just because it’s a really good thing to do.

CANCER (JUNE 21-JULY 22)
In conflicts like the ones you’ll face this week, there is no right and wrong. Because of your loyal nature, you’re likely to see things in stark moral black and white, but in actuality all of this stuff is cast in shades of gray. You’re not exactly in the best position to mediate these kinds of fights, because of your strong personal opinions on the subject, but it would be brilliant if you could take yourself out of the equation as much as possible (since it has very little to do with you, anyway) and try to be an unbiased negotiator. If you can help both sides get along–or amicably agree to disagree–you’ll have done your job, and then some.
AQUARIUS (JAN. 20-FEB. 18)
You’ve never been gung-ho for instant gratification (just find a Leo or Gemini if you need an expert on the topic), but you do fall prey to its charms occasionally. You’ve learned that there are often consequences that come with demanding what you want, now, and they’re only occasionally worth the satisfaction of having your whims granted. This week, beware the temptation to push too hard to get what you want as soon as possible. Letting things unfold at a more natural pace may take patience but is more likely to result in success. What’s more, if you allow events to happen that way, they’re also likely to come with at least one or two pleasant surprises.
LEO (JULY 23-AUG. 22)
You’re a creature of routine. Don’t deny it. Although you’re perfectly capable of rolling with surprises and breaking from your rhythms, secretly you’re quite attached to certain things you do every day, and miss them when you don’t have the chance to indulge in them. The holidays are full of fun but that’s mitigated somewhat by being away from your tried and true, reliable sources of comfort and joy. This week, try not to be too attached to your pleasurable old habits– though recreating some might be possible, finding new (and possibly better) ones is even more likely.

VIRGO (AUG. 23-SEPT. 22) PISCES (FEB. 19-MARCH 20)
A friend of mine is taking some medicinal drug whose side effects often include intense, frequently unpleasant dreams. You, of all people, should know what they’re going through, since you often have these without the help of any pharmaceutical substance. Their strategy for shaking them off as quickly as possible is to have a sense of humor about them. Follow their lead. Making things funny (even when they’re awful) is your best weapon this week against unpleasantness of all sorts, both inside your head and out in the world. Make jokes of everything that bothers you; the worse they are, the more you ought to make fun of them. Laugh long, laugh hard, and laugh often. It’s better than crying. ARIES (MARCH 21-APRIL 19)
It’s so easy to get distracted, I know. And all those distractions are such great fun, since whatever you’re supposed to be paying attention to really isn’t all that thrilling. It might even be a drag. However, toeing the line now will result in more excitement later than can be had from indulging even your wildest whims now, so it’s well worth it. In other words, put up with the drudgery of doing your job, whatever it may be, and wait until later to be whimsical and carefree, when you can afford to, and have a clear conscience, besides. TAURUS (APRIL 20-MAY 20)
Misery loves company. In this case, someone else’s misery would love your company. Don’t go over to their dark side, though, no matter what tactics they use to get you to come there. You don’t need to sever your connection with whatever sad sack is trying (probably unwittingly) to drag you down, but you need to be sure to dig in your heels and resist being sucked in. Tugging them free of their doldrums might be an option, and is certainly worth a try, but don’t be too hard on yourself if it’s not possible. You may have to settle from waving to them from your side of the fence, where the grass is greener, and making sure they know they’re welcome to clamber over and come hang out.
On a long plane ride, blood pools in your feet, causing them to swell. If you can, it’s a good idea to get up and walk around periodically, or raise your feet a little. Your emotions can settle like that when unstirred for long periods, becoming sluggish and hard to cram into your shoes. Exercising them, too, so you can stay limber and open, is a good idea this week. How to do that? Crying and laughing (even at the same time) is a good warm-up, even if it takes a movie to get the tears flowing and the giggles jumpstarted. But don’t stop there. There’s plenty of tragedy and hilarity in your real life. Maybe now you’ll notice. LIBRA (SEPT. 23-OCT. 22)
Remember that every gift has a dark side, including yours. Being able to see both sides of an argument means you’re a brilliant mediator, but it makes it difficult to take an unequivocal stand on anything that’s the least bit questionable. I’m sure you wish you never had to face another “it’s us or them” situation, but this week is likely to present you with one. Here, seeing the positive and negative aspects of both sides’ positions will make choosing one over another seem nearly impossible. However, neither party will allow you to abstain from this one. Quit begging everyone to “just get along,” pick the boat that seems least likely to sink, and hop on board.

SCORPIO (OCT. 23-NOV. 21)
One of the things I like about you is your attitude: “I am what I am. Love it or leave it.” It’s clear and honest and open. But the truth is you’re not quite as badass as you make yourself out to be. There’s room for flexibility and compromise. You don’t need to bend yourself over backwards to accommodate someone, as your Libran neighbors might, but allowing a hint that other possibilities are even possible is a fantastic idea. Contortionist, you’re not. We know that already. But can you be a little bit flexible? Let’s see if you can touch your toes, or agree to give something new a try this week. That, at least, would be a start. To contact Caeriel send mail to sign.language.astrology@gmail.com
