The proposed new state tax on investment real property has been described by supporters as applicable only to out-of-state millionaires and developers, as posing no threat to the counties, and as being necessary to properly fund our public schools. As written, this proposed constitutional amendment would empower the legislature to define investment real property to include every apartment building, every farm, every small business, or even personal residences. There is no limit on the tax rate, and no thresholds to protect the owners of properties worth less than a million dollars. It also concerns us that this new tax would impact owners of businesses and rental properties who would likely shift the burden to consumers by increasing the price of essential goods and services, and raising rents. The proposal also adversely impacts Hawai‘i’s counties as real property taxes are the counties’ primary and largest source of revenue to fund county programs. The counties must accommodate rising expenses such as salary increases for all employee bargaining units, which are firm obligations. The legislature should accept the responsibility and appropriately fund education without causing financial

challenges for counties. Authorizing the state to impose property taxes also would set in motion a perverse dynamic in which county officials would end up taking the heat for decisions made by O‘ahu-centric legislators, and Maui County’s excellent bond rating would likely be negatively affected. There also is the question of whether public education is as severely underfunded as proponents of the new tax contend. The Maui County Council recently passed a resolution urging the state to do a full financial audit of the Department of Education (DOE) as Hawaii spent $13,748 per pupil for operations alone in 2015-2016 (the most recent school year for which national comparisons can be made), 17% above the national average. The truth is that significant improvement in education will come when the existing top-down, bureaucratic DOE is transformed into a schools-centered system in which more money gets to the schools and the members of each school community can adjust it to the needs of their students. Stigmatized gender minorities can be empowered by traditional culture

HAWAI‘I’S TRANSGENDER YOUTH EXPERIENCE HEALTH AND SOCIAL INEQUITY, DOH REPORTS When foreigners came to Hawai‘i, they found practices and beliefs that disagreed with their world view. The dissonance created by the Westerners’ rigid assumptions and sense of righteousness was a problem, missionaries thought, that could be solved through conversion. So began the process of colonization: the imposition of Western culture on native people, establishment of white supremacy, and displacement of indigenous practices, people, and identity. Colonization persists today. A report from the Department of Health illustrates one example. The Hawai‘i Sexual and Gender Minority Health Report 2018: A Focus On Transgender Youth, released last week, discusses the inequity of the health and risk factors experienced by Hawai‘i’s transgender public high school students, but not before giving context to the controversial topic of gender identity, an “individual’s personal sense of their gender.” Essentially, the report states, while gender identity has been largely considered to be binary (man or woman), these constructs are culturally informed. Cultures worldwide have embraced a number of non-binary gender identities. In pre-colonial Hawai‘i, mahu were a third or “middle” gender that embodied the characteristics of both sexes, and society accepted sexual and gender diversity to the extent that mahu “were respected as spiritual and cultural leaders, especially in the preservation of Hawaiian traditions such as hula chants.” As colonization warped culture in the image of the West, mahu and other sexual minorities struggled to maintain respect within society, becoming shamed and stigmatized instead. The result is “minority stress.” Minority Stress Theory states that people in stigmatized minority groups, such as gender nonconforming individuals and sexual minorities, experience a number of additional stressors, including “discrimination, rejection, and victimization based on gender minority identity or expression; non-affirmation of gender identity (e.g. wrong pronoun use); expectations of future experiences of discrimination based

on gender minority identity; internalized transphobia; and concealment of one’s [transgender] identity,” the DOH report states. The prevalence of transgender individuals in Hawai‘i is highest in the nation, 0.8 percent, the report adds; among high school students, more than three percent of public high school students (approximately 1,260 students) identifying as transgender. Half of the youth who identified as transgender were Hawaiian or Filipino – cultures with a tradition of socially and culturally integrated non-binary genders that were colonized by the West. Minority stress for gender non-conforming people, a result of supplanting a sexually and gender diverse society with rigid and binary Western conceptions of gender, has been linked to higher rates of mental health issues, “suicidality, depression, anxiety, substance use, and HIV diagnoses” when compared to cisgender people (those whose gender identity is the same as their sex assigned at birth). The Hawai‘i Sexual and Gender Minority Health Report 2018 focuses on a number of self-reported health-risk behaviors and experiences transgender public high school students in Hawai‘i encounter in comparison to their cisgender peers. The results are shocking, and show a population that’s disproportionately at-risk and victimized. Here are some of the report’s findings:

• Half of transgender youth have attempted suicide in the past year, compared

• 29 percent of TG youth were bullied on school property in the past year, compared to 17 percent of cisgender youth. • A quarter of TG youth skip school because they feel unsafe, compared to seven percent of their cisgender peers. • TG youth are three times more likely to binge drink than cisgender youth. • 25 percent of TG youth have injected illegal drugs, compared to 1 percent of cisgender youth. • 46 percent of TG youth have misused prescription pain medication versus 10 percent of cisgender youth. • TG youth are four-times more likely than cisgender youth to have been raped. • More than half of TG youth do not have an adult in school they can talk to about important things. Despite these numbers, the report concludes, “Recognizing and building upon the strength and resiliency of our local [transgender/gender non-conforming] communities is an essential component to improving the health and wellbeing of the population statewide.” The advice Danielle Bergan, author of It’s Always Okay To Be Me, wrote in the Aug. 9, 2017 issue of MauiTime (“What it’s like to be transgender…”) is pertinent: “I want to ask all of you in our Maui community to support our transgender population on Maui and in Hawai‘i, especially the children. They are the bravest and the most susceptible of all of us in regards to lack of acceptance and potential for bullying or harm… Remember, an idle bystander can be just as dangerous as a bully.” Bergan recommended support organizations for transgender youth: Empower’d Maui LGBTQ Youth Group (tiare@mauiaids.org) or Maui Pride (Mauipride.org).

Last week we talked about a study that found demand for prostitution in Hawai‘i was higher than anywhere measured in the US. We asked readers on Facebook and Mauitime.com if they think sex buyers should be more aggressively penalized. 56% of you voted “Yes, end the demand.” This week we ask: Do you think gender is a spectrum?

Hawaii’s transfer of $600,000 to the Affordable Hawai‘i Coalition PAC, a political action committee formed in opposition to the proposed state constitutional amendment to give the legislature the power to implement a surcharge on investment property to support public education. The contribution does yet not appear on the political action committee’s Campaign Spending Commission report which lists contributions until Sept. 26 totalling almost $155,000. Affordable Hawai‘i states on its website that the constitutional amendment will raise the cost of living for everyone, and the amendment “would give the legislature the authority to create one of the largest tax increases in Hawai‘i’s history,” despite the fact that the constitutional amendment includes no specific language regarding types of properties or rates of the surcharge – those terms would be crafted by legislators if the ballot question is approved by voters in November. “We need to protect our small business community because they’re the ones who are going to be impacted,” chamber president Sherry Menor-McNamara told Civil Beat. “It’s really disappointing that the Chamber of Commerce has decided to come out against funding public schools,” HSTA Maui Chapter vice president and teacher Lisa Morrison countered. “This ballot question is simply asking people to say it’s OK to make a property tax law that would fund education.” “We would welcome them to come to the legislative session in the spring and bring their concerns to help make sure that the law gets crafted in such a way that there isn’t this penalty on the businesses,” she said. “Passing this constitutional amendment is not going to affect consumers; it’s just saying ‘yes, it’s ok for us to make a bill’ – that’s it.” The news of Hawaii’s Chamber of Commerce funding of Affordable Hawaii Coalition PAC came the evening before teachers across Hawaii organized a walk-in protest on Tue., Oct. 2. “Hawaii teachers are joining what’s called the ‘red for ed’ movement around the country” to raise community awareness of the lack of funding in public schools, the Hawaii State Teachers Association stated. HSTA added, “Hawaii schools rank last in teacher pay and 45th in per pupil expenditures, adjusted for cost of living.” “Specifically, our kids need smaller class sizes so they can get more individualized attention,” said Morrison, who participated in the walk-in at Maui High. “In order to get smaller class sizes you need more classes to put them in, and you need more comfortable classrooms for example with AC, and you need qualified teachers to put in front of the kids, and all of that takes money.” HSTA has stated they are planning more demonstrations in support of the constitutional amendment and teacher funding; Morrison said the group will have an information booth at the County Fair. ■ editor@mauitime.com + @axelbeers

NEW KIPAHULU PLAN DESIGNED TO IMPROVE VISITOR ENJOYMENT, PUBLIC INVITED TO COMMENT

PACIFIC WHALE FOUNDATION OFFERS PLASTIC POLLUTION SOLUTIONS PROGRAM A new Plastic Pollution Solutions program is available to all middle and high school students in Maui County. The program is a product of a grant awarded to Pacific Whale Foundation through the County of Maui Environmental Protection and Sustainability Division. The goal is to familiarize students with the environmental issue of plastics in the ocean and introduce them to real solutions. “As the future decision makers and consumers of our world, these students are a critical part of the outcome,” said PWF Marketing and Development Director Kelly McHugh. Plastic Pollution Solutions includes a

screening of the 22-minute film A Plastic Ocean as well as curriculum and activities appropriate for varying subject areas. The program is available to teachers in three curriculum delivery options: a school assembly to share and discuss the film (better suited for large groups), a classroom presentation and customized workshop (better suited for smaller groups), or a leave behind, for teachers that prefer to present the program in their own way. The PPS program is run by PWF Education Manager Robyn Ehrlich, a state certified educator with 10 years of teaching experience. Ehrlich said they want to reach all middle and high school students in Maui County with a message that inspires them to make positive, lasting changes and to become stewards of the ocean. Ehrlich runs the nonprofit organization’s premiere keiki offerings: Ocean Camp, featuring hands-on science activities and daily field trips for children in grades 1-5, and Keiki Whalewatch, a boat and classroom-based program offered during the months of January through April for students in pre-K to grade 12. Paiva – a graduate of Kula Kaiapuni, King Kekaulike High School’s Hawaiian immersion program – completed her high school career with a 4.02 GPA and began her first semester at Pacific Lutheran University in Washington to further her education in environmental studies. The new scholarship – named Kaunaloa I Ka ‘Imi Na‘auao (determined perseverance in seeking education) – was founded to honor the resort’s core values of commitment to community and Hawaiian culture. The resort will award the annual academic scholarship for excellence to a Hawaiian immersion high school graduate of Maui who has received acceptance and will attend an accredited college

Haleakala National Park has released its Kipahulu Comprehensive Plan and Environmental Assessment for public review. The purpose of the KCP/EA is to improve visitor access to and enjoyment of the Kipahulu District while reducing visitor-caused impacts to the park’s resources, to improve safety, and to ensure adequate operational capacity and facilities given the area’s remote location. The plan provides guidance on improvements to areas including the visitor center, trails, and campground, as well as improvements to supporting National Park Service operational facilities such as the maintenance area buildings, fee station, staff housing, and staff offices. The KCP/EA will be available for review online from Oct. 1 to 31, 2018 at Nps. gov/hale/learn/management/publicinvolvement.htm. Hard copies will also be available to review at the Park Headquarters Visitor Center and the Kipahulu Visitor Center. A public meeting is scheduled for interested individuals to learn about actions proposed in the plan and the NPS’s preferred alternative. or university in the fall. “I am extremely happy and thankful to have received this scholarship because it is helping me attend school on the mainland, expand my knowledge and share how important it is to represent and be proud of our culture and language,” said Paiva, who is looking forward to making new friends and volunteering within the surrounding community. The lessons that she learned while attending Kula Kaiapuni will be carried on for the years to come, she said. “Kula Kaiapuni doesn’t just teach academics. They also teach Hawaiian values like working together, compassion, learning how to forgive others and malama ‘aina (taking care of the land),” she said. After completing her education in Washington, Paiva plans to move back to Maui and find an occupation that focuses on giving back to the land and community. Her passion for perpetuating the Hawaiian culture, nurturing the environment, and volunteering within the community directly reflects the values of The Westin Nanea Ocean Villas, said a resort spokesperson.

News Of The Weird SMOOTH REACTION A naked man opened the door to firefighters responding to a house fire in Niceville, Florida, on Aug. 27 and said “I’m sorry” before closing the door in their faces. James Cunningham, 53, later admitted to police he’d had two liters of vodka and had smoked marijuana before trying to bake cookies on his George Foreman grill, reported WPLG Local 10. The experiment went wrong when the grill and cookies caught fire, so he covered them with a dry towel, which also caught fire. Firefighters said if he’d been in the house any longer, he could have died from smoke inhalation.

Djuan Lewis, 23, landed a new job at Benada Aluminum Products in Sanford, Florida, on Aug. 30, a Thursday. On Sunday morning, his boss fired him. WFTV reported that following his dismissal, Lewis waited for his boss for two hours outside the business, then chased him and his girlfriend for a mile and a half, shooting at their car and hitting the rear bumper, trunk and right rear tire. Neither the supervisor nor his girlfriend was hurt. Sanford police arrested Lewis and changed him with attempted murder.

At Kirby High School in Memphis, Tennessee, things are quiet as a mouse... or a rat. Shelby County Schools Superintendent Dorsey Hopson told the Memphis Commercial Appeal he’s looking for a temporary home for Kirby’s 800 students after closing the school Sept. 5 due to a rat infestation. The problem started in midAugust, when district personnel uncovered a rat’s nest during a renovation project. Eighty rats were trapped at the school and poison was set out. When students returned after Labor Day, poisoned rats began dying within the school’s walls and the stench became overwhelming. Calling the situation an “unavoidable act of nature,” Hopson said he expects students to return in early November.

IRONY Lona and Joseph Johnson of Bellingham, Washington, survived the Las Vegas mass shooting last October and decided to get a dog to help with the trauma that haunted them after the incident. “We heard that dogs are good pets to help with the healing and PTSD... and got Jax,” Joseph told the Bellingham (Washington) Herald. But on Sept. 2, neighbor Odin Maxwell, 49, shot and killed Jax, telling police the dog was chasing his chickens. An investigation showed no chickens were harmed, and Maxwell was cited for discharging a firearm.

Patricia Ann Hill, 69, of White Hall, Arkansas, called 911 on July 28 to report she had shot her husband, Frank, 65. But she had a motive: Patricia told Jefferson County Sheriff’s investigators she had previously

disagreed with her husband’s purchase of a pornography channel on Dish Network, and she canceled the channel, telling Frank that if he reordered it, he’d have to leave. That day, reported the Pine Bluff Commercial, the Dish bill arrived, revealing that the channel had been re-added, so Patricia confronted Frank in his “man cave” and told him to go. When he refused, Patricia fetched a .22-caliber pistol from the house and shot him twice, killing him. Hill was charged with capital murder and held without bond in the Jefferson County adult detention center.

BRIGHT IDEA It’s one way to get a ride to lunch: Knox County (Kentucky) Sheriff’s deputies responded on Aug. 24 to a home in Corbin, where Kenneth Ray Couch, 35, had reportedly stolen a handgun. As they searched for Couch, they learned he had been transported to the hospital in an ambulance after staging a heart attack at nearby Dixon’s market. When police arrived at Baptist Health, Corbin, WYMT reported, they found Couch in the cafeteria, which had apparently been his goal all along. Couch was arrested and charged with first-degree burglary and falsely reporting an incident.

LEAST COMPETENT CRIMINAL Taiheem M. McKay, 23, of Riverhead, New York, made it easy for Suffolk County officials to track him down after suspecting him of breaking into 10 different homes over the course of seven months, stealing cash, jewelry and designer accessories. According to Newsday, the Suffolk County Department of Probation traced McKay to the burglary locations through his GPS ankle monitor, which he was wearing as a result of a February 2017 second-degree reckless endangerment conviction. McKay has additional pending indictments in other burglaries.

THE PASSING PARADE Known for his blond mullet and numerous social media rants, zoo owner Joe Exotic (real name: Joseph MaldonadoPassage) of Wynnewood, Oklahoma, has been cooling his heels in a Florida jail since his arrest Sept. 7 for allegedly attempting to hire two people in late 2017 to kill an unnamed woman. According to the Orlando Sentinel, one of those “killers” was an undercover FBI agent, and Exotic was indicted on federal murderfor-hire charges. It all started “many, many years” ago, said Carole Baskin of Big Cat Rescue in Tampa, who claims to be the “unnamed woman” Exotic was hoping to off. She said Exotic has threatened her repeatedly and posted online a video of himself shooting an effigy of Baskin in the head. Tangentially, Exotic was also a candidate in a three-way Libertarian primary run for governor in Oklahoma this summer. He finished third. ■

o I was buying lumber for the fourth deck replacement on my house, sweating and grunting to load the needed 2x6 lumber. No employees available to help, several men driving by, successfully not seeing me. Then he came in his already loaded truck. He looks and says “Eh, you need help?” I nod gratefully and he jumps out, asks me how many of each length I need and loads them all while telling me about his grandpa who taught him to always help “everyone that needs help, no matter who they are.” Then he ties my load and offers me a bottle of water from his cooler in the back of his truck. Horror Fest: Pet Sematary Ka‘ahumanu Mall’s Consolidated Theatres plays a different Stephen King film adaptation every Wednesday for the month of October ★★★★★

or the month of October, the Queen Ka‘ahumanu’s Consolidated Theatres is throwing Horror Fest: Stephen King Edition, with a different classic King film adaptation every Wednesday night at 7pm. The offerings are Brian De Palma’s Carrie (Oct. 3), Rob Reiner’s Misery (Oct. 10), Mary Lambert’s Pet Sematary (Oct. 17), David Cronenberg’s The Dead Zone (Oct. 24), and Stanley Kubrick’s The Shining (Oct 31). The lineup is solid all around but I’m especially excited to revisit Lambert’s Pet Sematary, which is among the scariest movies I’ve ever seen. Louis and Rachel Creed (played by Dale Midkiff and Denise Crosby) move to Ludlow, Maine, along with their two children and cat named Church. While Louis takes up his new practice as the town doctor, his daughter begins asking him a lot of pointed questions about death. Not long after, Church winds up roadkill. A friendly neighbor, Jud Crandall (played by Fred Gwynne), instructs Louis to take his late pet to the nearby pet cemetery. We learn that Louis buries Church within the mystical Micmac Indian burial ground, which explains why Church comes back the next day… with glowing eyes and a rotten attitude. I have a long history with King’s tale, which was the first novel of considerable length I ever read (at the too-young age of 10, no less); it gave me nightmares for months. Then came the movie, which I didn’t see for years but, thanks to glimpsing a pictorial in Fangoria Magazine, invoked another season of lost sleep. In grade school, I heard stories of kids being taken to see the film at the

Maui Theater in Kahului, with reports of kids fleeing the theater and crying in the parking lot. For my college senior project as a theater major, I wound up writing, directing and starring in an adaptation of W.W. Jacobs’ 1902 story The Monkey’s Paw, upon which Pet Sematary is based. There’s something about King’s tale that holds a fascination with me, continues to bother me, and tumbles around in my imagination. While the film was harshly criticized for its violence upon its initial release, the performances by the two leads are the main point of criticism that, unfortunately, does hold up after all this time. Roundly dubbed “bland,” the acting by Midkiff and Crosy is actually worse than that: As hard as they try, neither is up to the emotional demands of their characters. Thankfully, Gwynne is excellent (in fact, this is the best performance of his career) and little Miko Hughes is

unforgettable as Louis’s son, Gage. The art direction and cinematography are excellent, creating a vivid mood and unsettling vantage points to witness the horror. The editing is quite brilliant – note how the horrifying second act-inciting incident is marked by a primal scream and contrasting series of family photos. Likewise, how a quick shot of a young boy at play flashes over the screen during the peak of the film’s macabre climax. Detours including Rachel’s traumatic childhood and flashbacks to other unfortunate souls resurrected via the pet cemetery are truly horrifying. The character of Victor Pascow (well played by Brad Greenquist) poses a problem; Pascow is a dead patient who materializes as a ghost after Louis fails to save him. While his initial appearance is jolting, the characters overstays his welcome (unlike Griffin Dunne’s character in An American Werewolf in London, who

Pascow is clearly modeled after). A remarkable, undervalued aspect to Pet Sematary is that it is one of the very few American horror films directed by a woman (in fact, the other horror titles made by women are hybrids). Mary Lambert took up directing duties after horror legend George A. Romero passed on the project. Lambert, best known for helming dozens of iconic MTV videos (including Madonna’s “Like A Prayer” and “La Isla Bonita”), creates an understated but distinct style and never shies away from visceral impact. Pet Sematary is imperfect but Lambert’s uncompromised shaping of King’s vision isn’t merely frightening, but emotionally crushing. The superb, somber score by Elliot Goldenthal provides perfect accompaniment – as much as this is based in the supernatural, it’s a tragic tale about a family’s inability to deal with death. Old Jud remains correct: “Sometimes, dead is better.” ■

I’ve heard red cars get pulled over more often than staid gray or beige ones. Whether or not it’s actually true, I’m inclined to believe it. Some faiths and traditions consider it bad luck to buy anything for a baby until it’s born. Historically, in some places and times infants were so fragile that they didn’t even get names until a year or two after their birth, when their parents could have more confidence that they might survive. Similarly, I wouldn’t invest too much emotion in your fledgling newborn until it’s got enough wherewithal to stand on its own two feet and claim a life of its own. Don’t give it a name, don’t get too attached, and don’t cry if it doesn’t make it. It’s not a baby, after all, just an idea – and there are plenty more where those came from. LEO (JULY 23-AUG. 22)

As if ending up alone would be the worst scenario imaginable, I frequently see people settling for whatever partner they can get. I don’t know why a solitary life isn’t preferable to shackling yourself to some idiot you don’t even like much. What’s so great about limiting yourself to unhappy mediocrity? You of all people should avoid this scenario like the plague. If what you’re involved with isn’t fantastic (at least a good portion of the time), then it’s just not the right thing. I recommend ditching it, fast – the sooner you do, the sooner you can make room for something better; or discover that making your own happiness (instead of hoping it’ll come from someone else) is best of all.

Beauty fades, more quickly than should be possible. Feel sorry for those who have little else. You know who I’m talking about; they were the lameass cheerleader and jock types back in high school. That was their peak; shortly thereafter their youthful good looks and athleticism faded and their lives settled into mediocrity. You encounter more like them throughout life. Don’t waste energy envying them or wishing them ill. They are what they are. Eventually, their genes won’t carry them anywhere special, and they’ll have to learn, just like you did, some other way to navigate through life. That’s no easy task, and some of them won’t manage it well at all. In other words, practice compassion, not contempt, for the pretty people you encounter this week.
