SCATHING LIQUOR CONTROL AUDIT PRESENTED TO PEA COMMITTEE, REFERRED TO NEW COUNCIL Maui County Liquor Control Director Glenn Mukai strained a smile on Monday as he sat through a presentation of findings from a scathing performance audit of the Department of Liquor Control conducted by Harvey M. Rose Associates, LLC, a third-party consulting firm commissioned by the Maui County Council. Mukai, described in the audit as being allowed to operate his department with lax oversight and as having difficulties performing his job as director, reclined in his chair during the presentation by the firm’s representatives Fred Brousseau and Dan Goncher, who highlighted findings and recommendations from the audit report’s 104-pages and five sections for the Dec. 3 meeting of the Policy, Economic Development, and Agriculture Committee. “We are puzzled that the evaluation [of director Glenn Mukai by the LC

Commission] came back outstandBrousseau told the commiting,” Brou tee when discussing the opening sections of the op report. He added that re while the audit was not w intended as a job rein view, the commission’s v evaluation showcased e the t problems the auditors found with the t county’s liquor control: unclear criteria to guide actions and accountability measures, and a lack of effective oversight. The result has been an office culture, licensing policies, and enforcement c operations that have o been viewed as inefb ficient, overly punitive, and retaliatory. “Our review of license and permit processes found evidence that confirmed many of the complaints m that th had been aired at a public town hall that we pu hosted in June and that ho were provided privately to our audit team throughout a this project,” Goncher said. “The department’s enforcement of state and county liquor control laws is not appropriately focused on activities that reduce alcohol related risks,” he explained. “We also found that the department’s strategic plans and annual reports do not measure or discuss the impact of enforcement operations on public health outcomes.” Indeed, the audit states that 72 percent of all violations in fiscal year 2017-2018 were for minor violations “such as failing to clear tables in a timely manner and dancing while holding an alcoholic

drink.” The issuance of these kinds of violations is rising while those for major violations (like selling alcohol to a minor) are decreasing, the report says, meaning minor violations and non-violations consume almost one-third of the enforcement division’s time. The auditor’s report is drunk with shots like this that paint the picture of a department that is mismanaged and plagued by a breadth of shortcomings and failures. The report covers five sections of findings and recommendations: (1) Oversight of Liquor Control, (2) Commission Responsibilities, (3) Staffing and Human Resource Issues, (4) License and Permit Processes, and (5) Enforcement. Despite the damning data and needed reforms listed in all of these sections, the PEA Committee was reserved in its criticism of a department that’s over-served on power and has gone for years without appropriate oversight or guidance, collecting a wealth of community complaints and employee grievances along the way. “How the hell did even we allow a department to go 18 years without an update of an operations manual?” Councilmember Riki Hokama, who voiced the strongest criticism of the department, asked. “Private sector, I would say those people would be terminated in a heartbeat… This is a lot worse than I expected.” Hokama added that the performance audit could be used to inform a future fiscal audit of the department. Committee Chair Councilmember Sugimura expressed that she was “shocked” to see some of the reports, including a “ridiculous” case where a renewal was denied for an application submitted one minute late. Sugimura hoped the department would have more understanding. “It’s just providing customer service to the people who create all this income for the county and the department, and making it easier for them to interact with you,” she said. Yet, Mukai exited the meeting without being asked hard questions regarding his department’s performance and corrective steps being taken. “Many [of the audit’s recommendations] has been complied

He explained that issues with Sunshine Law compliance and public notice were Corporation Counsel’s responsibility, not his department's. In the rest of his answers, Mukai rambled around questions and justified LC’s activities by emphasizing the importance of the Liquor Control Department in regulating almost half-a-billion dollars in annual alcohol sales. The PEA Committee voted to refer the audit report to the next council for later action. Rules governing the Department of Liquor Control are a network of elements from the Hawai‘i State Revised Statutes, County Code, County Charter, and county-level Liquor Commission rules, leaving the council with the challenge of identifying appropriate action steps within its jurisdiction. “I’m working on a resolution to submit to the council to suggest some outcomes from the audit,” Councilmember Sugimura, who introduced the legislation to authorize the third-party audit, told me. Sugimura said she was unable to elaborate on the specifics of the language until its planned posting Tuesday, but indicated that she has also been looking at changes to the County Charter and to commission rules (which the council can only suggest and hold commissioners accountable for, but not implement itself). Councilmember Don Guzman noted that 100 rules from multiple sections are scheduled for discussion for revision at the Dec. 12 meeting of the Liquor Commission. The agenda for the meeting was made public on Wednesday, and invites the public to a hearing at 10am in the David K. Trask Jr. Office Building. The suggested revisions are viewable online. “What we really need to do is service the community, service the public,” Sugimura told me, while also stating the importance of focusing operations on major health and safety issues more than minor violations. “[The audit] puts sunshine on the Liquor Department,” said testifier Madge Schaefer. The historic Chattaway restaurant in St. Petersburg, Florida, is a welcoming place, but it was the scene of a lot of unexpected late-night activity in early November, according to the Tampa Bay Times. Surveillance video of a Nov. 6 break-in captured an intruder who “spent over an hour just milling around going room to room and eating and drinking,” said manager Amanda Kitto. In the process, he stole chicken wings and beer, along with computer equipment and cash tips. In the midst of their investigation, police were surprised to find yet another nocturnal visitor on tape from the night before: A man riding a bicycle cruised up to the restaurant and slipped in a back gate. After emptying a storage shed of all its contents, he went into the restaurant bathroom and emerged completely naked. Next he can be seen at a restaurant picnic table, digging into the meal he brought with him: Maruchan Instant Lunch ramen noodles. But Kitto said he was so tidy staff wouldn’t have even known he was there had police not been investigating the later incident. “We still don’t know where his pants are,” said server Chad Pearson. Officers identified the man, who is homeless, but the restaurant declined to press charges because he caused no real harm. Police are still looking for the other man.

Pastor John Lindell of the James River Church in Ozark, Missouri, took the opportunity presented by Halloween to compose a paranormal-themed sermon that warned against fortune-telling, Wicca – and yoga. According to the Springfield News-Leader, Lindell told parishioners on Oct. 28 that yoga positions were “created with demonic intent to open you up to demonic power because Hinduism is demonic.” He went on: “To say the positions of yoga are no more than exercise are (sic) tantamount to saying water baptism is just aqua aerobics.” Local yoga instructors were not amused, especially when fewer people started showing up to their classes. Instructor Amanda Davis said the pastor doesn’t have a thorough understanding of the practice. “Yoga doesn’t prescribe (sic) to any religion, and I don’t think people understand that, so they get false ideas about it,” she said. “It’s ignorant.”

COMPELLING EXPLANATION Christopher Greyshock, 57, of West Milford, New Jersey, used the old disappointed football fan excuse to explain how things went wrong after he was involved in a traffic accident in Wayne on Nov. 11 that injured two people: “I drank too much because the Jets suck.” According to News12, as first responders were attending to the injured, Greyshock staggered toward them

smelling of alcohol. A field sobriety test confirmed Greyshock was inebriated, and he was arrested. On the front seat of his car were a bottle of bourbon and marijuana. Buddy, there’s always next year.

COMPULSIONS David Rush of Boise, Idaho, has found a unique way to score his 15 minutes of fame. On Nov. 13, at the public library in Oak Brook, Illinois, Rush set his mind to achieving a new Guinness record for eating sweet corn kernels within three minutes with a toothpick. Rush, who holds 40 Guinness records, succeeded on his third try, downing 241 kernels. “It’s a ridiculous talent to have,” Rush admitted to the Chicago Tribune. “I practiced skewering a lot to prepare along with the size of the plate, spreading out the corn and best toothpicks to use.” Rush told the Tribune he got involved in breaking records to promote science, technology, engineering and math education (STEM), saying a lot of kids don’t feel confident about STEM subjects. “If you believe you can get better at something and work hard at it, you can get better at anything,” he explained.

INEXPLICABLE Police in Youngstown, Ohio, received an unusual call late on the morning of Nov. 14, according to WFMJ TV. A resident of the city’s South Side called 911 to report that four men appeared to be stealing the sidewalk along Ridge Avenue. Police arrived to find parts of the sidewalk were indeed missing, and following a tip from a neighbor, they soon caught up with four men driving a truck hauling six flagstone slabs. Thomas Clark, Andre Eggleston, Levar Riley and D’Vaille Williams were charged with theft.

BRIGHT IDEAS Like many recently untethered people, Kimberly Santleben-Stiteler, 43, wanted to celebrate her divorce with a party, so on Nov. 10, she hosted about 40 people at her father’s farm near Lacoste, Texas, about 25 miles west of San Antonio. The big bang of the party wasn’t the music or the food, though, according to the San Antonio StarTelegram. Santleben-Stiteler wanted to burn her wedding dress, which “represented a lie,” she said, and not just burn it, blow it up. Her dad and brother-in-law attached exploding targets to the dress, and to really take things up a notch, also rigged it with 20 pounds of Tannerite, the same explosive used in the targets. “We have a friend who is a bomb tech, and he kept saying, ‘That’s really a lot,’” the un-bride’s sister told the newspaper. Shooting from 200 yards away, Santleben-Stiteler hit her target on the first shot. “The explosion was huge,” she said. Residents of Medina County heard and felt the explosion as far away as 15 miles. “It was liberating pulling that trigger,” SantlebenStiteler said. “It was closure for all of us.” ■

oel Edgerton directs and stars in this adaptation of Garrard Conley’s 2016 memoir about the time he spent in gay conversion therapy. Lucas Hedges is “Jared,” a teen whose strict Christian parents (played by Russell Crowe and Nicole Kidman) send him to a gay conversion facility led by the charismatic Victor Sykes (played by Edgerton) and a bully named Brandon (played by Flea of the Red Hot Chili Peppers). During his time in “therapy,” Jared reflects on the events that brought him there, as his pastor dad and compliant mother wish to keep Jared under the care of Sykes but are unaware of what happens under his watch. Boy Erased is necessarily unpleasant, though there’s a heaviness to Edgerton’s approach that makes too much of this a dreary experience. The material is so hard to watch, we don’t need somber piano music, slow motion, and a gloomy blue tint to assist the actors, who are exceptionally good. If anything, the scenes that have no music and just settle for a documentary-like approach work far better than the moments Edgerton dresses up with TV-movie gloom. Did Edgerton really think the audience wouldn’t be impacted? There’s a scene where a member of Jared’s group is beaten by a Bible in front of (and by) his parents after breaking the rules – it’s presented in such an overdone manner, it plays like one of those ‘90s Seattle grunge music videos. Had Edgerton just kept his camera focused on the violence, cut the music, and allowed us to take in the horror, it would have been far more effective. When a director doesn’t trust his audience to be

shocked by a gay teen being whacked with a Bible, you sense a more confident filmmaker should have been at the helm. There’s an after-school-special quality to the lesser moments, which hurt the film. When Edgerton gets out of the way and just allows scenes to play in a straightforward manner, his film is undeniably powerful. When Jared belatedly lashes out against Sykes or must endure Brandon as he stalks him in a men’s room, the film’s goals are achieved. The flashbacks to Jared’s past are a mistake, as they break away from the riveting, claustrophobic scenes of “lessons” being taught at the facility. Especially ineffective are the scenes of Jared hiding his true self in high school – we’ve seen this done before and with far more passion and immediacy. Oddly enough, the far more mainstream Love, Simon from earlier in the year managed to evoke more clearly, and with a fresher perspective, what it’s like being a closeted gay teen in the 21st century.

Edgerton’s film is admirably messy in its depiction of Jared’s troubled journey but also problematic. Jared’s two onscreen lovers are portrayed in a vaguely sinister manner and we never get to know them or much of Jared’s inner life during that period. Hedges gives an exceptional performance, allowing an openness and unforced quality in his acting to convey the numbed horror Jared experiences. Despite Edgerton’s directorial missteps, Hedges resists making Jared a symbol, and creates a vivid, relatable character that succeeds at always maintaining our sympathy and rooting interest. Kidman is superb as Jared’s mother, whose gradual awareness of her son’s abuse is one of the film’s most satisfying subplots. Crowe is miscast and a distraction at first but he manages to find the right note for the sad concluding scenes. Edgerton is wonderful playing the persuasive, snake-like Sykes, offering a window into how anyone would be duped into believing the claims of someone who pres-

ents himself as a compassionate, educated healer. Flea has appeared in small roles before but here, in a vivid, scary character turn, his work is staggeringly effective. The final stretch of Boy Erased (detailing Jared’s final days in the therapy sessions and the aftermath) are so powerful, they elevate the rest of the film. Edgerton is an accomplished actor whose directorial debut, the pulpy but effective 2015 thriller The Gift, showed a filmmaker in control of tone and great at encouraging challenging performances. Here, Edgerton has a shaky time with the former but a true ability with the latter. Despite its imperfections, there is much here that is worth seeing and discussing afterwards. In May, Governor David Ige signed a bill that bans gay conversion therapy in Hawai‘i. Clearly, the topic is immediate and needs to explored further in film. Boy Erased likely won’t be the last word on the subject matter but, as a portrait of religious abuse and oppression, it's searing. ■

You’ll make mistakes all your life. That’s part of what life is. Some people react to their mishaps poorly. This is how people get convinced that they’re born losers with rotten luck. Others, however, choose to learn from their errors and avoid making them again. Even a relatively stupid creature, like a bird, can grasp the concept of a glass window – provided it survives its first collision with one. Here’s hoping that you outlive your mistakes. Provided you do, you can take the steps required to keep from reliving them – and keep them from overshadowing your existence from here on out. CAPRICORN (DEC. 22-JAN. 19)

Personally, I think a little healthy competition is incredibly fun. Of course, I’ve also seen it cross a line into distinctly ugly territory. There are invisible boundaries in all our play, and sometimes it’s possible to run afoul of them without realizing it. At the dog park, a slightly-too rough nip can transform a playful gambol into a serious fight. The same can happen – in less obvious ways – to us, when we’re competing with others. Even lighthearted banter can cause a serious wound if it strikes a spot that’s already raw and tender. Be wary of that kind of thing this week, and if it happens, be sure to rush in with apologies and balm for the wound, so that you can both happily go back to playing another day.

Even your good habits can mess you up. I have a friend who was so diligent about brushing her teeth after every meal and snack that she brushed the enamel right off. In all things, even those purported to be good for you, there must be balance, and, ideally, variety. Make sure that you don’t take your good intentions too far. Carried to extremes, they’re just as bad for you as a meth addiction. Your life should be about lots of things. If it feels like it’s down to only a handful, you may want to reassess and alter course. PISCES (FEB. 19-MARCH 20)

What is it with you and always opting for these complicated, twisted scenarios? Sometimes, the most simple, obvious solution is the best way, and your (perhaps unconscious) determination to navigate the issue into a murky gray area just makes things harder on everyone. Not everything has to be tricky and subtle. Some things are straightforward, and incredibly easy problems to solve, if you can just bring yourself around to taking the boring route of the straight line between points A and B. If you see people rolling their eyes or shaking their heads as you detail your next convoluted set-up, please take that as your cue: Come up with a plan that can be explained in 10 words or less, then implement it. ARIES (MARCH 21-APRIL 19)

This is one of those things that some people mistakenly believe is easier than it actually is. Attempting it anyway leads to the kinds of mishaps we see when people try to cut their own hair, for example. I love that you’re confident, and believe yourself capable of virtually everything. You are. Some things, however, are best tackled after a bit of training or preparation. Just jumping right in, though certainly in line with your usual m.o., would probably lead to disaster. Don’t give up on this dream; just set yourself up so you can properly bring it to fruition.

It’s all about listening and paying attention. Those you’re responsible for are actually pretty capable of letting you know, one way or another, how much they can handle. It’s probably a lot more than you’d guess. Trying to impose your hypothesized limits on them will just breed resentment and frustration, especially when they’re trying so hard, in their limited ways, to communicate the actual boundaries of the scenario. Can you please pay attention long enough to perceive them? Then your enforcement of them will be welcome and helpful, instead of intrusive and annoying.

Television scriptwriters have the luxury of making their characters do and say exactly what they want. Their challenge is to make those actions realistic enough to keep viewers interested. Producers of reality shows, on the other hand, have to cobble a story together out of whatever happens. You have neither of these quandaries to face, since you’re not producing a TV show, but just your life. I could see how you’d get confused – you’re so good at manipulating people and scenarios that you might feel you have an obligation to do so. You don’t. This week, just let things unfold as they will, even if the results would score really low Nielsen ratings.

It’s perilously easy to pull into the fast food drivethrough and pick up something insanely unhealthy for a bargain price. This is how so many people get fat. Leos, who combine a strong sense of entitlement with a natural languor, are especially vulnerable to temptations like these. You should be wary of inexpensive conveniences – they’re probably not very good for you. Nothing in your life should be terribly hard, but there’s no need to make things this easy – not when the unseen costs are so high. Drive by the drive-through, please, and go home and make something healthier.
