‘Honor the Process’ The Wailea 670 project has stopped. But for how long? Wailuku attorney Lance D. Collins can now get a decent night’s sleep. On April 23 Judge Joseph Cardoza granted Collins a preliminary injunction in a case that challenges the Maui County Council Land Use Committees’ compliance with state Sunshine Laws in their discussion of zoning changes for the proposed Wailea 670 (“Honua‘ula”) development. The move freezes any county action involving the proposed development until the court rules on the overall case. Five Kihei residents brought the case against the county. Their complaint questioned the legality of the county’s holding of several “recessed” meetings—which carry no public testimony requirement since they’re technically continuations of a prior meeting—to discuss crucial changes to the county plan, the county’s failure to issue a proper agenda for these meetings, and the inappropriate passing of memos among committee members concerning the issue. “They should honor the process at the very least,” Danny Kanahele, one of the five, said. During his argument Collins cited more than 30 court cases and about a dozen attorney general opinions from across the country in his April 14 argument for the action. He even cited Thomas Jefferson. Scoffing at such extensive referencing of out-of-state cases, county Corporation Counsel Mary Blaine Johnston said the county gave proper notice, that there was no violation of
state Sunshine Laws, that Kanahele, et al (who have the burden of proof and must show harm on the part of the county) did not furnish enough evidence to the contrary and that the plaintiffs requested injunctive relief 16 days after the 90-day deadline for filing a complaint. “We’ve gone through and shown that the public was allowed to testify,” Johnston told Judge Cardoza, though a number of Kihei residents say they were denied the right to testify at the recessed meetings. As for the memos, Johnston said that there “is nothing in the Sunshine Law that precludes this kind of behavior.” Given the County Council’s passing of two Wailea 670-related bills, she added, the plaintiff’s request for injunctive relief was rendered moot, then “mooter” once Mayor Charmaine Tavares approved the project. Cardoza, who had presided over the Hawai‘i Superferry case and is known for going by the book, was not convinced. “While the Court does not make light of the work of members of the Maui County Council, the Court concludes that there are stronger things at play here,” he said in his opinion. For his part, Collins said he hopes the court will eventually void actions taken by the county Land Use Committee as a result of “marathon recessed meetings” and that the county will have to start the process over. In the meantime, last Wednesday’s outcome bars the county from any further Wailea 670-related actions. Though Charlie Jencks, who represents Wailea 670 Associates, said the injunction will not impact the company’s cur-

Drastic Plastic Local company wants to move beyond Styrofoam and plastics Styrofoam bento box take-out containers are as familiar to locals as surfing. Whether packed with noodles, sushi or loco moco, the Styrofoam bento is a local institution for the convenience of a grab-and-go meal. But one upstart local company wants to change all that. Honolulu-based Styrophobia opened in January 2007, supplying biodegradable food service products. Beyond the catchy name and dazzling website, it’s apparent that they’re determined to make waves in Hawai‘i and beyond as a green business advocating for sustainable local solutions to environmental problems. Entrepreneurs Krista Ruchaber and Mike Elhoff, tired of seeing plastic containers and drink cups on beaches and around Oahu, created a company dedicated to earth-friendly packaging. They feature products made from cornstarch “bioplastics”—cutlery made of potato starch and plate lunch containers made of bagasse (sugar cane fiber). Unlike plastics, which may take eons to break down, these materials compost in just 30 to 180 days. But more than providing a “green” renewable alternative to plastics and polystyrene—which are manufactured from petrochemicals—Styrophobia wants to educate the Hawai‘i community. They want consumers to know about the toxicity of styrene and benzene, both contained in certain plastics, and ultimately help people make informed choices about what they purchase and consume. To that end, Styrophobia has engaged in community outreach through schools, community events, beach cleanups, their website (www.styrophobia.com) and by talking with legislators. They recently provided biodegradable materials for Oahu’s Kokua Festival— the annual highlight of Jack Johnson’s Kokua Foundation, a non-profit organization focusing on environmental education—making it a “zero-waste” event. In short, they are “doing a lot of extra-curricular things, and being philanthropic with our time,” according to Ari Patz of Styrophobia. I recently spoke with Patz while he was on Maui: MAUI TIME WEEKLY: What can you tell me about Styrophobia’s mission, and what you hope to accomplish? ARI PATZ: It’s about Aloha ‘Aina, or love of the land. We want to help spread social awareness, really a better way of living. No other companies

LC Watch All in a Name Deputy Prosecuting Attorney Evans Smith had his first appearance before the Maui County Liquor Control Adjudication Board on April 3, and during that meeting he made a small error that made me smile. All Smith did was say a name, a simple name, during a public hearing. Timothy Heard. I’m not sure of the spelling—I didn’t ask Smith for confirmation, but he wouldn’t have told me anyway—and there’s no listing in the phone book. That last part isn’t surprising, because Heard was a “minor decoy”—a guy aged between 18 and 21 that the LC used in 2007 to attempt to buy drinks from various establishments.

MAUI TIME WEEKLY: You’ve also been involved in supporting legislation that would ban Styrofoam.
MAUI TIME WEEKLY: Part of your goal is to avoid throwaways, as we know that all the islands have landfill issues. How are you approaching this issue?
ARI PATZ: It’s already happened in San Francisco and Portland, but has met with resistance here. But Styrofoam is not made from a renewable source, and leaches the chemicals it contains. Though the ban on Styrofoam didn’t go through this year, they [the state Legislature] did adopt a resolution. If that leads to PSAs [Public Service Announcements], that would be sexy.
MAUI TIME WEEKLY: Where are your biodegradable products made? ARI PATZ: We are using materials made in Indonesia, Taiwan and China. Ideally, we’d like to produce these products locally. We’re interested in talking further with [sugar cane companies] Gay & Robinson and Hawaiian Commercial & Sugar to see about using their bagasse for local manufacturing. Sugar is also grown in the U.S. in Florida and Louisiana, but they aren’t producing these products yet, either.
MAUI TIME WEEKLY: Are your products well received on Maui? ARI PATZ: Our biggest customer is Pacific Whale Foundation. We just got a

In the early days of this column, deputy prosecuting attorneys always named the minor decoys that successfully purchased alcohol from licensees during public Adjudication Board hearings. Then, after this column began publishing the names of the decoys, the deputy prosecuting attorneys suddenly clammed up and stopped giving out the names. Smith, who is new to prosecuting liquor violation cases, wasn’t really up on that rule at the April 3 hearing, and blabbed Heard’s name with reckless abandon. It got so bad that at one point Chief LC Investigator Bill Pacheco leaned over and whispered something to Smith, who then started referring to Heard as “the minor decoy.” Well, he did that for the most part, but every now and then would forget and mention Heard’s name again. Anyway, the upcoming May 1, 2008 Adjudication Board hearing will present Smith with plenty of time to practice what to say and not say: the agenda lists five minor decoy cases. My guess is Smith will have gotten LC procedures down and will be just as discreet as they want, but in case he isn’t, we’ll be there listening very carefully with notepad open to make sure.

Two German air force sergeants were suspended in December after being caught in a side venture selling sausages based on an old family recipe requiring human blood. Their first batches were made with their own, but as they began mass-producing, they had allegedly asked their colleagues because, according to instructions from one of the men’s grandmothers, all blood must be “fresh.” “Do not use too many breadcrumbs,” she had written, “but if the blood starts to curdle, stir in a teaspoon of wine vinegar.”

Lawyer confidentiality rules kept one man improperly on death row for 10 years and a probably innocent man in prison for 26, according to news that surfaced in January (in Virginia) and March (in Illinois). Daryl Atkins (sentenced to death in 1997) was the victim of probable prosecutorial misconduct, according to his co-defendant’s lawyer, Leslie Smith, who said he witnessed the misconduct but could not report it because a lesser sentence for Atkins would have exposed his own client to greater punishment. In Illinois, Alton Logan was convicted of a murder during a 1982 robbery. However, shortly afterward, Andrew Wilson admitted to his lawyers that he was the murderer, but bar association rules prohibited them from revealing that. When Wilson died in 2007, the lawyers went public, and Logan’s case has been re-opened.

This goes out to the irritating lady I recently met at the theater. First, the line at the concession stand was long enough to give any reasonable person more than enough time to figure out what you wanted by the time you got to the counter. Then, when you finally did figure out what you wanted, you took forever to find your wallet, as if it was some big surprise that you needed to pay actual money for your food. WEDNESDAY, Apr. 23 How’s this for a way to start the week: “The CEO of Delta Air Lines Inc., Richard Anderson, said Tuesday that domestic airlines need to raise fares by 15 to 20 percent,” Pacific Business News reported yesterday. Anderson made his comment at a press conference in our nation’s capital, where he was meeting with legislators over his company’s planned merger with Northwest Airlines—both of which are in the dumps, with stock prices for each running between $6 and $8 a share. According to an MSNBC report on the press conference, Anderson added that airlines—not just Delta and Northwest—need to raise fares because “an airline ticket has got to reflect the full cost of fuel.” See? It’s not just us hurting at the pumps.
THURSDAY, Apr. 24 Today I got a call from a reader asking if I could publicize Michael Moore’s latest newsletter. It points out that even though the mainstream media keeps attacking Democratic presidential hopeful and Senator Barack Obama (D, Illinois) for having ties to the iconoclastic Reverend Jeremiah Wright, few are highlighting the fact (first reported by Politico.com) that back in the depths of the Monica Lewinsky/impeachment crisis, then-President Bill Clinton invited Wright and a bunch of other pastors to the White House to hear him “repent.” I’m sorry, but this really isn’t the space to comment on matters like that. Nor is it the space to

mention how completely non-shocking it is to hear that Wright—an AfricanAmerican—feels some degree of bitterness and anger towards America. Nor is it the proper venue to point out that all this talk about Obama and Wright is a phony issue anyway—that the real story (written about by Slate.com and, as far as I can tell, no one else) is that Obama’s rival Senator Hillary Clinton (D, New York) has shown herself to be all but completely amoral by accepting an endorsement from the Pittsburgh Tribune-Review, a “newspaper” owned by “Vast Right-Wing Conspiracy” chief Richard Mellon Scaife that’s so deeply embedded in the lunatic fringe that in the early 1990’s published wild, completely unsubstantiated filth that Hillary Clinton killed White House Counsel Vince Foster. But now, for reasons that remain completely mysterious because no one’s really asking her about it, Clinton is best buddies with Scaife. You know, it’s kind of a shame that I’m not going to talk about any of that stuff here, because it’s rather interesting.
FRIDAY, Apr. 25 Looks like the take-over of Hawai`i Superferry, Inc. (HSF) by J.F. Lehman & Co. is nearly complete. Today McNeil Wilson Communications announced that HSF President/CEO John Garibaldi is out—no reason given, but given the company’s service record over the past year, I think it’s pretty obvious—and Admiral Thomas Fargo (U.S. Navy, ret.) is in. Fargo, a former U.S. Pacific Fleet commander, is apparently J.F. Lehman & Co.’s managing director. As you might recall, J.F. Lehman & Co. is a private equity firm run by John F. Lehman, President Ronald Reagan’s first U.S. Navy Secretary. The rough-speaking, aviator-loving secretary was known as a bureaucratic infighter who sparred with admirals and dug up dirt on pacifist Catholic Church officials, all as he attempted to balloon the navy to 600 shops—an impossible, budget-busting goal. In recent years Lehman slightly softened his image by sitting on the bipartisan 9/11 Commission, but mostly his efforts have focused on his equity firm. And that meant exerting increasing control over Hawai‘i Superferry, Inc. Even before today, six of HSF’s 10 directors were connected in some way with J.F. Lehman & Co.: Lehman (founding partner), Tig H. Krekel (vice chairman), C. Alexander Harman (member), Louis N. Mintz (member), George A. Sawyer (founding partner) and John W. “Bill” Shirley (consultant).

SUNDAY, Apr. 27 Did I call it or what? Today’s Maui News reports that not only did Fargo move over from J.F. Lehman to HSF, but he also brought a chunk of that firm’s money with him to save the foundering Superferry. “We’ve had an increase in the capital base from J.F. Lehman & Company that bodes well for taking us through the difficult times and really supplements the commitment,” outgoing HSF President/CEO Garibaldi told the paper. Of course, Garibaldi “declined to detail the amount of the capital infusion provided by J.F. Lehman to keep the business operating,” but at this point, does it really matter?
MONDAY, Apr. 28 Speaking of foundering, the County of Maui finally has official archives! At long last, the county’s boxes and boxes of crumbling, decaying records—some dating back to the Great Depression—will get the treatment they deserve. They’re going to be housed in a few Conex containers in the parking lot of the Old Wailuku Post Office, according to today’s Maui News. If this sounds rather crude, I will say that it’s better than their old home, which was the Old Wailuku Post Office itself: a crumbling, decaying building full of toxic mold and even more
toxic asbestos that the county, in its infinite wisdom, is leasing for $75,000 a year through 2026.
TUESDAY, Apr. 29 Just a load of good news today. Looks like the cargo remnant of Aloha Airlines is now folding up. That puts another 400 people out of work, and demolishes 85 percent of our state’s inter-island cargo carrying capacity. This is very bad news, and nearly–but not completely–eclipses the bombshell that Honolulu blogger Ian Lind dropped this afternoon on Hawai‘i Superferry, Inc.’s appalling disregard for honest disclosure of its 2007 lobbying efforts. After Lind complained to the state Ethics Commission, saying the $21,792.56 the company put down for lobbying expenses last year seemed low, the commission made HSF go back and “amend” their old statements. The new reports, just posted online, show Lind was spot-on: in 2007, Hawai‘i Superferry, Inc. actually spent an astonishing $381,693.30 on advertising, lobbyist salaries and the “preparation & distribution of lobbying materials.” Anyone still wondering why the state Legislature exempted HSF from state environmental laws? Look, reporting $21,000 when the company actually spent $381,000 goes way beyond mere error. HSF officials are showing real contempt towards the public, and given the way the state Legislature rolled over for them last year, it’s only going to get worse. RESORTS GO DOWN Maui Land & Pine and Dowling—developers of fine resorts across the island—drop a notch this week on news that sale prices for fine, upscale vacation resorts are dropping. Fast. “Sales of new and previously owned condominiums, single-family homes and house lots at masterplanned resorts statewide such as Wailea and Hualalai declined 20 percent last year to 1,535 properties,” reported the Honolulu Advertiser on April 23. Still, the Advertiser added that “developers of million-dollarplus resort homes are betting that there are plenty of wealthy individuals seeking Hawai`i vacation property to keep demand relatively strong.” While undoubtedly true, homes for the ridiculously wealthy are the bread and butter of Hawai`i’s land developers, and any drop in sales, temporary or not, isn’t good.
MONSANTO IS GOOD PLACE TO WORK?! According to the April 2008 issue of Hawaii Business, the giant maker of herbicides and genetically modified plants immune to those very same herbicides is. With an average salary of $64,500, 559 full-time Hawai`i employees, 13 paid holidays and a mere three percent voluntary turnover, the company is ranked eighth of the 24 “large companies”—employing 150 or more people—that made the list. “If an employee of this agricultural company must travel,” the mag says, “the company will reimburse travel costs for a relative to care for children, up to what a local caregiver would have cost.” Wow. Can you believe that? Hawaii Business called Monsanto a mere “agricultural company.” Stunning. MTW

MAUI TIME WEEKLY: You’re aware that Maui has tried to implement a limited ban on plastic bags, and that there is a public awareness campaign in Paia called the “No Mo’ Plastic Bag Paia Project?” ARI PATZ: Yes. That’s great. Haleiwa is doing something similar and Kailua is just getting started. Also Kauai. There’s really a growing awareness and we want to do our part with all of that. olystyrene is one of numerous petrochemical plastics derived from petroleum, a non-renewable resource. Styrofoam is actually a brand name for a Dow Chemical polystyrene product patented in 1941, and has entered our vocabulary the way Kleenex and Xerox have done, as a generic term for the product or process. In one form, polystyrene may be rigid, such as CD “jewel” cases and plastic cutlery. Foam “expanded” polystyrene, produced to trap up to 95 percent air within, was designed to provide insulation from heat and moisture, rendering it especially useful for food and beverage containers. Produce, fish, meats and prepared foods may all be commonly packaged in polystyrene foam trays, baskets, or containers, which then are dropped in

the trash, destined for our landfills. Maui County’s proposed 2009 budget contains a $12 million request from the Solid Waste Division of the Department of Environmental Management, to implement Phase V of the Central Maui Landfill. It seems that Phase IV-B is filling up far more quickly than was projected. Perhaps as much as 35 percent of items thrown away could be composted or recycled, especially if our county government invested in regional green waste dropoff/composting sites. One such pilot program has been operating in Central Kihei, operated by Maui Earth Compost. But county funds provided through a recycling grant are due to run out on May 31. Meanwhile, Solid Waste Division is spending more than $150,000 each year to clean windblown debris at the landfill, much of it through contracts with Ka Lima O Maui. Maui’s strong tradewinds regularly take plastic bags airborne and deposit them in nearby kiawe trees and cane fields. You can also find plastic and Styrofoam on roadsides, in county parks and in the filters at wastewater treatment facilities. Councilmember Michael Molina introduced draft legislation in June 2007 that would include a partial ban on plastic bags from large retail and commercial outlets
throughout Maui County. After languishing in the council’s Policy Committee for seven months without a hearing, it was moved to the Public Works and Facilities Committee. Council members heard testimony in one meeting already this year, and invited a panel discussion in a second meeting in February. It’s likely the proposal may come up for deliberation and possible action in June, according to Gary Saldana, Councilman Mike Molina’s staff aide. Had a bill at the state Legislature survived this year’s session, Maui County wouldn’t have had the ability to legally limit proliferation of plastic bags. Senate Bill 651, draft legislation supported (some say introduced) by the plastics industry, would have effectively banned counties from imposing bans of this sort. Fortunately, it failed to pass out of committee last Friday and died. lastics have been vilified for years because of their harmful role in marine debris. Floating bits of plastic, large and small, fill our oceans and wash up on our shores. The North Pacific Gyre is a large area created by prevailing winds and currents, one of five large ocean gyres worldwide. Because of all the plastic flotsam and other debris, it’s been nicknamed the Great Pacific Garbage Patch.

Ranging over 500 miles in length, and studied since the mid 1980’s, the gyre is estimated to hold 100 million tons of trash. Ocean researchers believe that 80 percent of the debris is land-based, while 20 percent comes from ships at sea. Bits of plastic resemble ocean zooplanktons and are ingested by jellyfish, which are, in turn, consumed by sea turtles. Sea birds also scoop up colorful bits of plastic. Autopsies on birds in the Northwest Hawaiian Islands reveal that shearwaters, albatrosses and boobies sometimes have hundreds of pieces of plastic in their gullets, eventually leading to their death. A certain amount of “gloom and doom” may be necessary to help motivate people to change their ways, “but it sells the least amount of plates,” says Patz. “Our every action impacts the whole of interconnected life on Earth,” the Styrophobia website says in a section attributed to WorldCentric.org. “Our every day decisions of what we do, what we consume, where we buy, how we choose to live, what values we hold and promote creates the world and the communities we live in… Another world is possible and it is up to us to make it happen!” Here in Hawai‘i, we can choose to make that happen one bento box at a time. few weeks ago I went to Kalama Park in Kihei to see the Maui Roller Girls. It was public skating day at the rink. The sun was setting while pop music played in the background. I curled my fingers around the chainlink fence as I watched about two-dozen derby girls wearing black shorts or skirts, fishnets and green tank tops deftly skated around a handful of children. I found myself surprisingly excited to hear the sound of roller skates on concrete. After a few minutes a commanding voice came over the loudspeaker. “Please be careful,” the disembodied voice announced to the girls. “There are children here.” Over the course of the next 30 minutes, the voice telling the girls to “slow down” or “skate with the rest of the people” became more frequent and, to the girls, more exasperating. Roller Derby is new to Maui, but not to Hawai‘i. In the 1960’s the old Civic Auditorium on Oahu was often packed with fans during televised bouts. A recent resurgence has hit the islands with zeal, creating two teams on Oahu and one on Maui. Though the Maui Roller Girls are ready to contend

with the other island teams, they still have no place to practice. “That is really the problem,” Kelly “Killah Kelly” Galvez, who formed Maui Roller Girls, told me. “With us only being able to skate here on the open skate nights, we’re not gonna be able to train and our skills won’t get any better. We can’t run a real practice. Until we find a permanent venue or even if we find a confined, flat slab of nice concrete that is safe and well lit, that is open for public use, we really won’t be doing much of anything.” But for a variety of reasons—some of them depending on who you ask—the county won’t allow Maui Roller Girls use of the Kalama Park skating rink, except during the 6 p.m. to 8 p.m. public skating time on Wednesdays. Galvez, who says the area would benefit from the good crowd the Roller Girls would bring, can’t understand the county’s refusal. “It’s an organized women’s sport,” she said. “It’s a family friendly event. The practices and bouts are clean and open to the public to watch. It really could only help them.” elly Galvez moved to Maui from Sacramento, California in October 2007. There she skated with the Sac City Roller Girls. “I really missed derby and after training with the Oahu derby girls I knew it was a

roller derby, and that wasn’t going to happen. (Insurance concerns don’t seem to affect the Kalama Skate Park, where kids fly through the air on skate boards just 50 feet from the Kalama roller rink). In any case, I called Floyd Miyozono, the county’s Chief of Recreation, to get his take on why the girls couldn’t get practice time. Miyozono said he was not aware of any decision to deny rink access to the Maui Roller Girls and said he’d follow up with Ortiz. Then I asked if the county needed to be in the loop as to decisions Ortiz was making regarding rink access. “Yes, definitely,” Miyozono said. “I don’t think he [Ortiz] should be making these decisions, especially when he makes his own schedule and is also making it difficult for others.” The next day, after conferring with Ortiz, Miyozono called me back with a new explanation. “According to Rick, the girls were not willing to come up with any insurance to also cover the Inline Hockey Association,” he said (emphasis added). “Rick Ortiz did speak with the insurance carrier and they had strongly recommended that, in this particular case, if they wanted to use it they would need to come up with some kind of insurance policy. He mentioned to me that they were not willing to come up with an insurance policy. But just with the idea
that they were not willing to come up with an insurance policy kinda was a deal breaker for them.” In light of Galvez’ insistence that she’d offered to get the girls insured, this made no sense. So I called Ortiz back. “The issue around it is liability insurance,” Ortiz told me. He said he knew that the girls had individual insurance, which was similar to what the hockey players have, but that there was also liability insurance for the rink, which the girls did not have. The rink’s liability insurance covers hockey but not roller derby? Yes, Ortiz said: “We pay an enormous amount of money each year to have that insurance.” So why can’t the girls just pay this “enormous amount” so they can get on the rink, too? “I asked the exact same question to my insurance company and the insurance for the rink to find out if another policy could be had on that rink,” Ortiz said. “The county does license this rink to us for use so I need to find out from the county as well what is involved with that.” But Ortiz brought up another reason. He said that all of the nights at the rink were already reserved for hockey—“most importantly, youth hockey”—as well as public use. That meant there was no time for any roller derby. He added that he’d suggested some other slabs of concrete to Galvez for the girls to practice on.

great time to bring it to Maui,” she said. “Girls I had talked to got really excited and because it was new to Maui, I just felt it would be a good idea.” Galvez set about organizing a team. One of those who joined was Susan Ponoton, who recently moved to Maui from New York and heard about the Maui Roller Girls on the radio. “I’ve never even roller-skated but it sounded like something fun to learn, something totally new,” Ponoton said. “They also sounded like the kind of girls I would want to hang out with. They really are amazing. I felt welcomed 100 percent. It’s like a new family. I love it.” Eventually Galvez contacted the county, asking about arranging practice time at the Kalama Skating Rink, the only rink on the island. Officials told her to contact Rick Ortiz, who manages the rink and handles scheduling. Ortiz told Galvez that Sunday evenings were possible, but that he first needed to check with the Maui Inline Hockey Association’s Board of Directors. As will be seen, the arrangement between the hockey association and the county Parks and Recreation Department over who actually controls access to the rink is curious and confusing. The association leases the rink from the county. But for rea-
sons that never really became clear, they seem to be calling the shots as to who gets to use the rink during the vast majority of the week when they’re not playing hockey. A few months went by with no word from Ortiz. So Galvez called him back. That’s when Ortiz said the hockey association board of directors had denied the Maui Roller Girls practice time because of “liability issues and scheduling.” This surprised Galvez, who explained that all the girls on the team would be covered by USA Roller Sports—the national governing body for all competitive roller sports in the U.S.—for practice as well as special events and that it would be chartered to the rink. Ortiz insisted that the Maui Inline Hockey Association’s insurance would not cover roller derby. He explained that the girls had to be on the rink’s insurance if they wanted to practice

ther rinks in the nation don’t seem so resistant to giving women’s roller derby teams practice time. According to Cort Whalig, who owns the Cristiana Skating Center in Newark, New Jersey and is the son of past president of USA Roller Sports, said derby teams that skate in his rink have insurance that covers them as well as the rink owner. He also provides a general waiver that all derby girls and hockey players sign which handles liability. “I really saw the potential that roller derby brought to the rink,” he said. “It brings crowds here that I wouldn’t reach otherwise. The girls have really been an asset.” This is because, as Galvez explained, roller derby has changed a lot since the 1950’s and 60’s. “People always think that derby is clotheslines, elbows, fights, throwing people over rails, and that it’s staged like wrestling,” Galvez said. “People think it’s fake or ask us if we fight and that’s not how it is at all. We follow a strict set of rules. There are

over 300 leagues now in the U.S. that are going by the WFTDA [Women’s Flat Track Derby Association] rules. I mean, there are renegade leagues that don’t play by any rules, but we follow the WFTDA and we want to be nationally recognized. “We do depend on our refs to call certain things but we also depend on the code of honor with the girls not to fight and not to throw elbows,” she continued. “That’s how we train, too—I mean, if we could. We would use plates under the arms or a sock on both of your hands to keep the arms in because the minute you throw your arm out, it’s considered an elbow and then you’re penalized.” Roller Derby actually dates back to the Great Depression. With dance marathons sweeping the nation, Chicago promoter Leo Seltzer decided that a skating demonstration would be the next craze. He was right—on Aug. 13, 1935, twenty thousand people filled the Chicago Coliseum to watch 25 teams skate in the Transcontinental Roller Derby. Seltzer later took his show on the road, performing for crowds of thousands. Two years later, after watching two skaters get into a scuffle during a speed skating match, sportswriter Damon Runyon changed the sport

into what we are more familiar with today. What had begun as an endurance race involving several teams changed into a sport where two teams of five circled the rink, gaining points by passing members of the opposing team. Because certain physicality was now allowed, skaters began jostling each other with a passion. Although players exaggerated these moves to draw ever-bigger crowds, violent behavior eventually became part of roller derby’s trademark. By the 1970’s, roller derby was a roughneck theatrical exhibition on wheels. Anyone who’s seen the classic 1972 film Kansas City Bomber with Raquel Welch knows the rowdy action in the rink and melodrama was part of the game. Then roller derby went away for a few decades. But it returned in 2001 with all-female teams driven by a new professionalism that wanted to see roller derby accepted as a serious sport. Of course, today’s roller derby still has much of the old attitude and remains an aggressive sport. Most women who play derby are tough; they proudly sport their bruises and display a certain “punk” attitude that gives them an edge. The best have nicknames sporting double entendres: Slammy Faye, Sheeza Brickhouse, Shenita Stretcher, allowing them a bit of the old school drama.

On Wednesday, April 23, as the women began to practice during the Kalama rink’s public skating time, Ortiz and a few hockey association board members approached Galvez and asked to talk. During a sit-down meeting on a park bench just outside the rink, Ortiz told Galvez that the association has an exclusive contract with the county: the lease says half the rink’s time goes to hockey and the other half is for public use. He said adding another sport to this agreement would breach their contract. And he went back to his original story, saying their insurance wouldn’t cover another sport for the rink. He did offer one bit of helpful advice: he and the association could help the Maui Roller Girls cut their own deal with the county so that they could get their own rink built somewhere else on the island. Then there would be two skating rinks on the island that would be closed for most of the day. For her part, Galvez isn’t sure what she and Maui Roller Girls are going to do. “We have some options that we’re looking into,” she said. “There is a possible warehouse we can rent but that costs money we don’t have. We are just trying to stay focused and move forward. I mean, I’m not even sure if we want to work with the park with all the drama that’s happened but we’re definitely not giving up. That’s not the kind of women we are.” MTW

Cooking Show How Cucina Bella indulged my Food Network addiction Like millions of Americans, I am a loyal Food Network fan. Each night I get some deranged kind of pleasure from watching famous chefs prepare meals I will probably never make. The shows always give me a flicker of hope that I, too, can cook.

My boyfriend Dave knows well of my Food Network addiction, so he put up no resistance when I told him we were going to a cooking demonstration at Cucina Bella in Kahului. In fact, he actually likes to
cook, so he was excited to learn a few new recipes. We entered our culinary classroom with big appetites and eager minds. Six perfect rows of desks—the kind with little wooden writing surfaces wrapped around plastic chairs like I used to nap on during high school biology classes—were set up between tall shelves of pots, pans and cooking equipment. At the head of the class was a working demo kitchen. I think I was having serious high school flashbacks, because we instinctively grabbed two seats in the back row. Chef de Cuisine Jojo Vasquez was our fearless leader on this cooking adventure. He brought three of his favorite recipes from the Banyan Tree Restaurant at the Ritz Carlton in Kapalua, along with the intention to teach the group of 30, mostly novice cooks, how to prepare restaurantstyle cuisine for a dinner party of four. His focus, he said, would be to show us simple and elegant presentations for the dishes and a few tips and tricks about his ingredients along the way.
“I could talk about food for a very long time,” Vasquez said. His menu began with a salad. First he macerated Kula strawberries with lavender from Ali‘i Lavendar Farm, which is also in Kula. A simple but elegant champagne vinaigrette came next as Vasquez argued against ever buying bottled salad dressing. The salad came together with hydroponic watercress greens from Waipoli, little spoonfuls of Surfing Goat Dairy chevre and toasted macadamia nuts. My eyes rolled back into my head with pleasure when I tasted the perfectly sweet, creamy and crunchy mixture. I’m not sure that I could duplicate his fancy plating technique, but even a cooking idiot like me can whip up this delicious salad. Miso-manila clams were next on the menu. I’m a shellfish fanatic and was stoked with the bowl of tender, shelled clams and shitake mushrooms in miso broth that came my way. Vasquez taught us to “bruise” a stalk of lemongrass to
bring out the bright, intense aroma, which was totally news to me. The main course was a filet of Kona kampachi, which our personal celebrity chef prepared simply with Enoki mushrooms, diced Roma tomatoes, ginger and green scallions. He presented the dish on a bed of baby spinach wilted in a lime vinaigrette and topped with a fresh mango puree. Then Banyan Tree pastry chef Ashlie Koehler taught us to make a dulce de leche gelato, apple cider beignets and a rum dipping sauce. She explained every step of the dessert slowly and thoroughly, but I think I’ll leave this one to her and head to the restaurant the next time the craving for sweets hits. The evening was like one long, satisfying Food Network show, without the commercials. Next week, Sam Choy will present his own flavors for a new crowd that gets to indulge in some delicious dishes and exciting culinary knowledge. MTW

Hawaiian Music Kings Friday (May 2) 7:30 p.m., Castle Theater, MACC [MUSIC] The words “Hawaiian contemporary music” and the Brothers Cazimero are pretty much synonymous. These guys have been creating and performing together for over 30 years and have had a major hand in shaping the sounds of the islands. Their newest album, Some Call it Aloha, Don’t Tell, was nominated for a Grammy in 2004. With only two classical instruments—a stand up bass and a 12-string guitar—Robert and Roland have released 37 recordings and three DVDs that combine their majestic music with amazing visuals from Hawaiian culture. Their live shows always honor their heritage by incorporating hula and chants. Harold and Kumar are back! The marijuana-fueled sequel Harold and Kumar Escape From Guantanamo Bay carries on the tradition of stoner buddy comedies, starting with Cheech and Chong, up to Bill and Ted (not drug users, but definitely dumb) and Wayne and Garth (whose drug use was presumably offcamera, as there is no way those guys were EVER sober). Whether you’re against smoking that five-leafed plant and hope it never becomes legal or you’ve just torn out this page and are using it as Mary Jane rolling paper, it can’t be denied that pot comedies can be funny, or, well, just dopey. This time, Harold and Kumar (played by the fearless John Cho and Kal Penn) are mistakenly accused of being terrorists, sent to America’s prison at Guatanamo Bay, make a daring escape and then become highly sought-after fugitives. Sorry to be a buzzkill, but the movie is sometimes uproariously

guard with a series of racial jokes that have unexpected punch lines: ethnic stereotypes are brought up, then ridiculed, in outlandishly inventive ways. The post9/11 jokes (involving racial profiling, airport hysteria, government paranoia and power abuse) would court bad taste if they weren’t so funny and cleverly satirical. Neil Patrick Harris, playing a twisted version of himself, stole the first movie and does the same here. His scenes are a riot and his speech about how he lost “Taronda,” the love of his life, provides one of the biggest laughs in the movie. But for every joke that kills, like a bizarre nod to “The Goonies” or when Harold and Kumar meet real terrorists in prison who hate America AND donuts, there are far more that are duds or funny merely in theory. It comes close to being a guilty pleasure, but if you want that, Forgetting Sarah Marshall is a far funnier and better comedy and it’s still playing. MTW

Touchy/Feely Café Marc Aurel invites people to paw art Each time the art changes at Café Marc Aurel in Wailuku the atmosphere transforms a little, too. As soon as I grow accustomed to the shocking, complicated and thought-provoking pieces of one exhibit, a new show arrives, jolting me awake when I wander in for a midmorning cup of coffee. There’s nothing serene, lovely or ordinary about the art on the walls at Marc Aurel. At least in the traditional sense, the majority of the exhibits there do not blend with Maui’s typical art scene. There are no paintings of humpback whales, peaceful Upcountry pastures or plein air seascapes. Café co-owner Adrianne Martinez’s desire to put her hands on the pieces of art that really move her inspired “Touchy/Feely,” the theme of this month’s group exhibit. It’s an eclectic collection of two and three-dimensional pieces centered on texture. Martinez has been dedicated to underground and experimental art on the island since 1999 when she opened and co-owned Wild Banana, an alternative art gallery in Wailuku that has since closed. She loves seeing local artists “thinking outside” and now curates the always edgy and unique shows at the café. “In the art world there’s a lot of com-
petition and egos, a lot of pretension,” she told me. “I’m trying to inside out the whole system. This is not Art Maui.”

Exhibits are open to anyone and everyone and are not juried. She doesn’t select or reject any particular piece of art; after she decides on a theme, the first 20 artists who submit their work get a place on the wall. Also, every piece of art on display must be for sale and priced $200 or less. One large installment by Jackie Goring—scattered pieces of red and black fuzzy fabric are placed in no identifiable pattern on a pink background—nearly covers an entire wall and commands attention from pretty much any part of the café. It seems to be the deconstructed pieces of a very unusual-looking skinned cat. The piece looks soft and repulsive at the same time. On the opposing wall several pieces hang on a background with painted hand-
prints. One titled “Distortion of a Contorted Heart” hangs heavily near the center and features pieces of a broken-down, rusted metal machine of some sort sitting on a bed of dirty sand. A sad love note printed on the back of a postcard is stuck into the sand. It looks cold and the whole thing left me a little uncomfortable and depressed. A few of the other pieces of art were less complex. “Scratch My Itch” has a pricklylooking, twisted, dirty wire brush and “You Are What You Eat” is a straightforward piece inviting the viewer to peek inside a toilet seat. I lifted the lid gingerly, pondering the nearest place to find soap and hot water to sanitize my hands, then laughed when I saw a reflection of myself looking more than a little scared. It’s not often that I can put my hands all over a piece of artwork without setting off alarms or seriously pissing off an artist, but Café Marc Aurel’s unique gallery space and Martinez’s unique vision have combined for a show that compels me to reach out and touch some very interesting art. VIRGO (AUG. 23-SEPT. 22) Who cares what kind of grunge is lurking behind your fridge or under the stove? Your problem: you have to get at least one or two other people fired up about stuff they really don’t care about. LIBRA (SEPT. 23-OCT. 22) Make yourself scarce. I rarely answer my phone so when I bother to log into my IM account, I’m suddenly deluged with friends who will jump at the chance to say hi and check in, in real time rather than via phone texts or emails. Too much saturation makes people take you for granted. Make them a little hungry for the delight and wonder that is you. And if you don’t believe you’re delightful and wonderful enough to have people missing you and seeking you out, wherever you are, I’d spend this time alone figuring out why.
SCORPIO (OCT. 23-NOV. 21) Move in, already. Months into this thing you’re still living out of boxes. The walls are bare of decoration and you’re digging through a backpack for the day’s wardrobe. You still haven’t made yourself at home. You haven’t let yourself get used to this new situation. What’s it going to take for you to unpack your stuff, hang up some art, and really start living in this moment? I’d spend this week figuring that out, because otherwise you could continue as you have indefinitely. Move in or move out. Living in Limbo is just a waste of time.

While other little girls dream of birthday parties packed with ponies, hearts and princess tiaras, my daughter requested a pirate-theme–skulls and crossbones–for her seventh birthday bash. And I’m not talking “Pirates of the Caribbean,” either: just swashbucklers, planks and ships full of booty. Not that this bothers me. Part of me would like to think that this is a sign that she won’t grow to be a cheerleader or the president of the home-ec club. Not that those are bad things. Okay, yes they are. Usually my parents organize and throw her birthday bash down at the Country Club. But this year the hubby and I decided to organize the shindig ourselves. Initially, we went into it with brave faces and square shoulders. How bad could it be? We’d put a few dollars on the side here and there and in no time at all we’d have a great party. Actually, it took the help of friends, a large borrowed truck, lots of string pulling and a high interest loan, but it happened. The morning of her birthday, the hubby left before the crack of dawn with a truck full of party supplies, a wedge and a bucket of golf balls to cop a squat at Giggle Hill before anyone else could snag our pavilion. The kids and I woke up at around seven-ish and enjoyed a leisurely breakfast of Honey Smacks out on the lanai at the brand new patio set that the hubby had put together the night before. Then we headed out to the park. A few hours later, it was as bumpin’ as much as any kid party has a right to bump. The jumpy castle was a hit–positively ginormous, with a large area to bounce, a place to climb and a slide. No kids died or were seriously injured even when the generator pooped out. We had a homemade Slip n Slide (10 by 50 feet!). Again, nobody died, but I’m pretty sure that was luck. I went down it while a bunch of bikers from another party cheered me on and didn’t even lose my bikini bottoms in the process. My boss and his keiki were the greatest on the Slip n Slide. Just imagine a bigdaddy bowling ball and a little itty-bitty kid bowling pin and you’ll get the picture. It was classic! And, just because it was a perfect kind of day, who showed up at the park? None other than Chica’s and my high school crush. Sure, we had mixed feelings about it because we had wind blown hair, minimal makeup, husbands on our side and babies on our hip, but it gave us something to giggle about. It was especially gratifying when our husbands agreed that he was totally hot. They later tried to humiliate us by waving him down, but I’m pretty sure he didn’t notice. My favorite part of the day was when my dad–the most competitive person on the planet–coerced the church group next to us into a Tug of War challenge. Let me tell you something right now: there are some really big boys going to church on this island. Not at all bad looking, either. They accepted and we were pretty much doomed since our group consisted of parents and children while theirs consisted of healthy looking young people. We tried hard. But in the end, the power of God overcame Podagee-Power, even though we did have a quarter of the Maui High varsity football team from the mid-nineties on our team. The kids went back to bouncing on the castle while we adults went off to soothe our bruised egos with yet another Redondo’s hot dog and Pepsi. After everyone went home, I lay in the jumpy castle waiting for the breakdown people to come and haul it away and felt really super lucky. Lucky to have such great kids, a fantastic husband, awesome friends and hilarious family. And lucky to have the health and means to celebrate my daughter’s birthday in such a big, overboard way. Mostly though, I’m really lucky that the loan went through. Starr Begley hopes that she’s the only one that’s embarrassed by her column this week.
