The Battle of Honolua Ridge Why one group of rich people is fighting the even richer Maui Land & Pineapple Co. We don’t usually associate mudclogged drainage inlets, potentially unsafe drainage basins and poorly graded roads with new Kapalua Resort developments, but a new owners’ association report concerning Honolua Ridge is saying exactly that. Official Kapalua Resort publicity brochures and web pages paint the 50 new Honolua Ridge estates in extremely vivid, luxurious colors. “Honolua Ridge offers agricultural home sites perched above Honolua Bay and adjacent to the award-winning Plantation Golf Course,” boasts the Kapalua website. “This exclusive community is part of the gated Plantation Estates at Kapalua and contains the largest home sites ever offered at the Kapalua Resort. Home sites range in size from three to thirty acres.” Three to 30 acres overlooking Honolua Bay. Maui Land & Pine— which owns the whole Kapalua Resort—certainly doesn’t need to hire Eric Estrada to do a 30-minute infomercial to move property like that. By comparison, the nearby “exclusive private gated community” known as Plantation Estates at Kapalua is a Hooverville—52 estates dating back to 1990, no ridge, and they range in size from just two to seven acres. The construction atop Honolua Ridge (HR)—broken into two phases, each holding 25 homesites—is nearly complete. And when it is, that neighborhood holding 50 massive, palatial mansions will become part of Plantation Estates. And that has the Plantation Estates Lot Owners’ Association (PELOA)—the group that represents the current Plantation Estates owners and the eventual Honolua Ridge owners—

really pissed off. On Dec. 20, 2006, then PELOA President Robert C. Miller and structural engineer Florian Barth—representing the Plantation Estates Design Review Committee—completed a 21-page report titled “Plantation Estates: Preliminary Review of Proposed Honolua Ridge 1 (HR1) and Honolua Ridge 2 (HR2) Infrastructure.” According to Miller, the report had taken four months to research. The copy of the report obtained by Maui Time highlighted four main areas: drainage, grading, roads and landscaping. Miller and Barth were uncompromising in their conclusions. “[T]he bottom line is that much of the infrastructure is not [in] a condition that the Board of Directors of the Association believes it could accept,” Miller wrote in a Feb. 23, 2007 letter to all the Plantation Estates and Honolua Ridge owners. “Aside from functionality issues, much of the HR infrastructure is significantly below the standards of the infrastructure of the original Plantation Estates phases… [T]he

installation of this wholly inadequate infrastructure in HR by the developer raises serious concerns that will likely face the Association for some period of time.” “Lack of concern for safety was my main issue,” Miller told me later. “It’s pretty overwhelming.” PELOA attorney Joyce Y. Neeley expanded on that view in a letter, also dated Feb. 23, to ML&P attorney Richard J. Kiefer. “As is detailed in the report, the infrastructure in HR suffers from serious construction and/or design defects which in some instances would make maintenance by Plantation Estates Lot Owners’ Association (‘Association’) impossible or extremely expensive,” Neeley wrote. “Moreover, certain of the infrastructure pose and/or create safety or health hazards.” Such problems posed considerable “liabilities” to the PELOA, Neeley added. “The Board of Directors is understandably concerned that the developer apparently plans to suggest that PELOA should

accept responsibility to maintain this complex and ill designed drainage system,” Neeley wrote. “PELOA is not willing to accept this drainage system or the attendant liabilities.” According to the report by Barth and Miller, maintenance of Honolua Ridge’s drainage system has been “less than adequate” during construction. Barth and Miller report spillways littered with debris, basins that aren’t allowing water to percolate properly into the soil and possibly high long-term maintenance costs. “The developer does not appear to have considered safety issues including unprotected open water features and steep slopes accessible to children and others,” Barth and Miller wrote. “There is another non-potable reservoir in the same park area that creates the same conditions.” The rest of the report’s concerns highlight a variety of issues—grading that doesn’t match design plans, “inadequate” slopes, insufficient road shoulders and a paucity of trees—but aren’t nearly as dramatic as the potential drainage dangers. What’s happening now isn’t clear. Miller declined to comment on the current situation, saying his term as PELOA president ended in March. And current PELOA President Lee Reiswig wouldn’t say much when I called. “We’re in the process of working on a response right now,” Reiswig said of current negotiations with ML&P, but then declined to comment further. Structural engineer Barth similarly declined to coment, and Maui Land & Pineapple Co. attorney Kiefer didn’t respond to two phone calls and a fax seeking comment for this story. There is no joy in pointing the finger of blame at what isn’t working in our community, government, country or world. Yet sometimes we must reveal the pervasive follies and pompous tendency to call them something else. On Tuesday, Apr. 24—the same day the Dalai Lama offered a free teaching at War Memorial Stadium—the Maui Planning Commission met, as they usually do, at the ground-floor conference room in the Kalana Pakui building in Wailuku. The Planning Commission, like other arms of Maui County government, has minimally risen to the challenges set before them in advising and adjudicating responsible planning for our island. With the bar set so low, County planners and private consultants have little incentive to provide more than cursory guidance to assist them in their jobs. My reason for attending was to testify on a request by Hawaiian Cement to continue excavating sand from inland dunes between Wailuku and Waikapu on a parcel owned by Alexander & Baldwin. An application for a County and State Special Use Permit had been pending since July, 2003—nearly four years—and finally the measure had found its way onto the agenda. Back in early 2003, while serving as County Environmental Coordinator, I inherited management of six grants for beach and dune restoration, a one-time appropriation totaling $100,000. Inquiring as to the source of clean sand for these beach replenishment projects, I learned that both Ameron and Hawaiian Cement mined the central Maui dunes and that barges left Kahului Harbor regularly to supply sand to Oahu. That made me question resource conservation, given the high rate of extraction. Concurrently, the Maui-Lanai Islands Burial Council was conducting a review of more than 20 burials encountered by Hawaiian Cement (today the number of disturbed burials has topped 60). Examining the Maui County Code, the Burial Council noted that excava-

tion of sand was not a permitted use in the agricultural district and that the Planning Department should require a Special Use Permit, not just a grading permit. I reviewed the Hawaiian Cement application and provided official comments in October 2003. I noted that the application fell short of meeting the County Code and Hawai`i Revised Statute criteria, and should be deemed incomplete. I listed more than a dozen omissions, inadequacies and inaccuracies, then called for resubmission of a detailed Project Assessment. Among the missing elements were a Biological Inventory Survey for rare plants, traffic analysis and a review by the Cultural Resource Commission. In December 2003 the interested parties discussed the matter in the Mayor’s lounge. Hawaiian Cement’s lawyers argued that a grading permit was sufficient to manage the resource, while noting that Ameron had removed more than three million cubic yards of sand on adjacent Maui Lani parcels in the urban land use district. A representative from their planning consultant, Chris Hart and Partners, postulated that there might still be 50 years of sand left at current extraction rates. Over the next year, I was part of an ad hoc group that defined the scope of an indepth study that the County sent to a contractor at a cost of $12,000. Two years later, in February 2006, the Maui Inland Sand Resource Quantification Study was finished. It differed sharply from Hawaiian Cement’s assurances. In fact, it indicated that there might be no more than five years of sand left and that 70 per cent of excavated sand is being shipped to Oahu. Mayor Alan Arakawa then sent the study to County Council and called for a moratorium on exports until they could craft legislation to conserve the resource. The Council took up the discussion last fall, but was unable to find a way to create an ordinance to limit sand exports. During this time, sand exports accelerated. According to Kahului Harbormaster Steve Pfister, there were 63 sand barge trips in 2004; 96 in 2005; and 86 in 2006,

though a much bigger barge went into service in July. The sand study estimated that a barge load of 4,000 tons of sand is equivalent to 133 semi-truck loads. In other words, nearly 34,000 truckloads of sand left the island in just the past three years. Fast forward to the Apr. 24 Planning Commission hearing. Outspoken new commissioner Joan Pawsat arrived a half hour late. When asked if she’d care to make any remarks at her first official meeting, she leaned forward to the microphone and said, “Not really.” Two hours into the hearing, a Planning Department staffer offered the report on Hawaiian Cement’s application. Chris Hart himself gave a Powerpoint presentation. Commissioners Jonathon Starr, Dr. William Iaconetti and Pawsat expressed concerns that overall export numbers, including Ameron’s totals, were not provided. The Commission adjourned for lunch, but announced that another agenda item would be taken up next, so an Oahu consultant could be assured of making his plane flight. After lunch, discussion of the Pali to Puamana Environmental Assessment dragged on for a couple more hours. By now, I had abandoned my hopes of seeing the Dalai Lama. Finally the

Let me set the scene: the commission has just voted to junk a petition brought to them by a group of determined citizens who want to see a liberalization of the county’s rules governing dancing at nightclubs. Stunned at the accusing questions, arguments and even insults various commissioners hurled at them during the public comment portion of the hearing, the citizens have filed out of the hearing room. With the public gallery empty (save the Akaku camera and me), one commissioner then turned to LC Director Franklyn Silva and asked what the bars and restaurants around the county think of the rules governing dancing. Never mind that the commission had just told a bunch of citizens there was no need to reexamine the county’s prohibition on dancing outside of specially marked dance floors. Now, suddenly, as if none of the preceding hearing had taken place, the commissioners wanted to know what the licensees thought. “I could send a letter to them,” Silva said. “And then report back to the commission.” The commissioners all thought that was a swell idea. And that afternoon, Silva drafted a brief survey—quoting the appropriate part of the liquor rules dealing with dancing—and immediately sent it to the county’s bars and restaurants.

Has this rule assisted you in maintaining control of your premises for the health, safety and welfare of your patrons and employees?” All great questions. Too bad the Liquor Commission has already decided they don’t want to hold any further hearings on dancing.

WEDNESDAY, Apr. 25 Today the U.S. House of Representatives passed a war-funding bill that would require “redeployment” of American combat forces from Iraq beginning Oct. 1 and ending next March. Of course, President George W. Bush has vowed to veto the bill, saying it amounts to undercutting our troops and surrendering. “The President has lost touch with reality,” Congressional Representative Mazie Hirono (D, 2nd District) said in a press release sent out today. “Despite the increasing violence reported by the military, more deadly bombings and more Americans being killed, including nine brave soldiers in one attack, he claims that his surge is working.” Of course Bush thinks his “strategy” is working—the military is telling him that it’s working. “The success of coalition operations continues to disrupt al Qaeda’s operations in Iraq,” U.S. Army spokesman Lt. Col.

Christopher Garver boasts in an Apr. 23 American Forces Press Service release on recent operations in Iraq that killed 50 “terrorists” and captured 110 “suspected terrorists.” (Isn’t it wonderful how we’re always so careful to kill just the confirmed terrorists and leave the suspects unharmed so we can imprison and interrogate them?) “These captures help restrict their freedom of movement and reduce the organization’s manpower pool, diminishing their ability to attack innocent civilians as well as Iraqi and coalition forces,” Garver added. That Garver’s— and Bush’s—logic is completely off base was best articulated four decades ago by Vietnam War reporter David Halberstam, who died in a car crash this week at the age of 73. In 1965, Halberstam reported on an argument between an “American senior officer” and war reporter Neil Sheehan. The official said rising enemy casualty figures “proved” the U.S. was defeating the Viet Cong. “Sheehan insisted, however—and most guerrilla war authorities support him—that this was simply a sign that the war was being lost and that the Government was losing control of the war and the population,” Halberstam wrote in The Making of a Quagmire. “In a successful insurgency, he [Sheehan] insisted, when you are doing well the casualties do not rise; they drop, and the war simply goes away.”

THURSDAY, Apr. 26 Here’s something you don’t read about every day: a federal conviction for the illegal buying and selling of sperm whale teeth. And it’s a local guy, too. According to today’s Honolulu Advertiser, former Whalers Village Museum Director Lewis Eisenberg has pled guilty to multiple counts of violating the Endangered Species Act, Mammal Protection Act and Lacey Act—mmm… lacey—by helping sell half a million bucks worth of illegal sperm whale teeth from a supplier in England to “U.S. merchants who specialize in scrimshaw.” No word yet on a possible sentence, though precedent indicates it could involve some hard time. I mean, didn’t they send Capone away for trafficking in illegal teeth? Oh wait, that was tax evasion.

We hear often of the cost of the out of control war born by U.S. soldiers and Iraqi civilians, but what of the effect on our brave, valiant defense contractors—the giant corporations that build all those milliondollar computerized, GPS-guided bombs and missiles we keep shooting? Turns out losing a war—and all its inherent Congressional scrutiny and budget cuts—means bad things for the companies’ “profit outlook.” “The results are becoming more mixed for contactors,” defense analyst Philip Finnegan told the Associated Press. “It’s no longer the unmitigated positive environment we saw in the past. It’s still positive, but there are clouds on the horizon.” Isn’t it fantastic how analysts can call the first few years of the “War on Terror” an “unmitigated positive environment?” Isn’t the English language a beautiful thing?

SATURDAY, Apr. 28 Is it that people just aren’t complaining enough? Are citizens happy with the way big money contributions influence political campaigns? Or are our elected officials merely addicted to campaign contributions from companies and landowners who have business before state and local governments? I ask these questions because of today’s Honolulu Star-Bulletin story reporting that this legislative session a bill “to publicly fund political campaigns died for the eighth year in a row.” Apparently there was some disagreement between the state House and Senate Judiciary Committees over how much public funding of elections would cost the state, so the bill has just gone away again. This is the irony that keeps this wretched cycle moving—as long as we continue to elect people under the big money system, they’ll continue to pay just enough attention to bills like this to tell voters they care, but not nearly enough to actually throw private money out of elections.

SUNDAY, Apr. 29 Really sad war news in today’s Honolulu

OVERHEARD...

Still crying over those poor, wretched defense contractors, I decided to watch the harrowing 2006 documentary War Tapes. Told from the perspective of three New Hampshire National Guardsmen deployed to Iraq in 2004, the film is uncompromising in its portrayal of meaningless objectives, cheap life and just plain bloody mayhem—and that was from a time when Iraq wasn’t nearly so violent or nihilistic as today. So it was with images of scared guardsmen shooting wildly at insurgent snipers and wondering out loud what the hell they were doing there in the first place that I opened today’s Maui News and read the Associated Press story “Enlistment in Guard up.” “The Hawaii Guard attracted 388 newly enlisted soldiers during the year ending last September,” the AP reported. “That’s better than the annual average of 300 to 350. Nationally, just more than 69,000 people joined the Army Guard last fiscal year, up 40 percent from 49,000 in 2004. The question is: Will it last?” That’s the question? How about: Why is enlistment growing at all? It’s nice to hear that Hawai`i Guardsmen won’t be going to Iraq anytime soon, but considering that country’s rising casualty rates, civil war conditions and Inspector General reports about many American reconstruction “successes” that are actually just glossed over construction disasters, it’s somewhat hard to take such assurances seriously.

NOT SO SUPER FARES Hawai`i Superferry Inc. hasn’t even taken aboard a single passenger or SUV yet, and the company is already announcing fare cuts for children under 12, seniors 62 and older as well as “retired personnel of the United States Armed Services, including the Coast Guard,” said an Apr. 23 company press release. Retired Coast Guard? That’s like, what, five guys? Anyway, claiming “customer demand” is responsible for the price cuts, HSF CEO John Garibaldi is now saying those people mentioned above will only have to pay $41 off-peak and $51 peak for tickets, though those prices don’t include a fuel surcharge. “As we continue preparations for our launch in July,” Garibaldi said, “the excitement has been building and we’ve received many inquiries about the availability of discounted fares.” That’s it? A few complaints roll in that Hawai`i Superferry’s prices are outrageous, and they fold up, just like that? You’d think all that Maui Land & Pine money the company’s taken would have stiffened their backbones.

Afghan nationals who work at NATO’s Kandahar Airfield must use their own “separate but equal” toilet facilities, according to a March dispatch in Toronto’s Globe & Mail. The American officer in charge of administrative contracts said the policy was based on hygiene, in that some locals customarily stand on toilet seats and then squat down, which he said creates unusual messes, but also on some Muslims’ carelessness in cleaning themselves in preparation for prayer, when their water bottles sometimes fall in and have to be fished out.

MOVIE INDUSTRY GOES TO THE DOGS In April, two Labrador retrievers named Lucky and Flo sniffed out another shipment of pirated DVDs (worth about $435,000) in a building in Petaling Jaya, Malaysia. It was at least the second such bust since midMarch, when the U.S. Motion Picture Association of America loaned the dogs to Malaysian authorities because they can detect the polycarbonate and unique chemicals in the discs. So successful are Lucky and Flo that an unspecified crime gang has reportedly put out a contract on them.

CUTTING EDGE SCIENCE American researchers in West Africa believe they’ve found the first instance of an animal (other than humans) building a multi-step weapon, after observing wild chimpanzees grab sticks from one to four feet long, sharpen the ends with their teeth, and murderously jab them into deep tree hollows where delicious bush babies may be nesting. Writing in the journal Current Biology, the team even reported observing the chimps tasting the tips after the stabs,

ZELIG LIVES! Researchers at the Second University of Naples (Caserta, Italy) recently reported the case of a 65-year-old man who, because of damage to the fronto-temporal region of his brain, habitually assumes an identity appropriate to his setting, a behavior reminiscent of the Woody Allen character Zelig. The researchers said the man lacks awareness about his tendency to switch roles and in fact suffers from amnesia about his life since the brain damage, according to a March report by the British Psychological Society.

DO ASK, DO TELL Army drill sergeant Edmundo Estrada, 35, was arraigned in January in Hampton, Va., on charges of indecent assault, on a complaint by a young subordinate who said Estrada prescribed a confidence-building regimen in which the two men role-played from a pornographic movie, with the trainee dressing as a Superman character and Estrada performing sexual acts on him. According to the arrest affidavit, when Estrada “torture[d]” the trainee, the man was to respond by “moaning.” Another trainee accused Estrada of trying to photograph his squad bare-chested, claiming he needed to document their physical growth. ROBREPORT MEDIOCRITY: continued from page 9 Commission resumed discussion of the sand item and public testimony began. I asked for leniency in the threeminute time limit, given my background and knowledge of the issues. I said the Planning Department report still had numerous errors, including the size of the parcel—it was 434 acres, not 494—which I had pointed out three years earlier. Also, a map shown in the Powerpoint presentation did not conform to the one in the report. In fact, the new proposal was for an entirely new 56-acre area within the larger parcel, not the 58 acres originally studied. But no agency comments had been solicited since 2003 to study the new area, except for an archaeological assessment. Basically, I said the application was actually less complete than before. Hedani asked if I felt denying the application was wise, as it would restrict the construction industry. I replied that I hadn’t asked them to deny the application, but just to defer it until they had enough vital data to make informed decisions. Then they might be able to approve it with conditions. Recommended conditions in the Planning report included that Hawaiian Cement not export sand off Maui, and that they make sand available at cost for approved beach nourishment projects. I said that I believed these conditions were great, but didn’t go far enough. Presenting a copy of the 1954 Doak Cox report, The Spreckelsville Beach Problem to the Commission, I said I believed that A&B has a kuleana to provide sand for beach replenishment free of cost, as they had mined sand from the North Shore for at least seven decades in the past century. Hedani cut me off, saying his question had been answered. Then Mercer “Chubby” Vicens, a representative of A&B, stood and addressed the commission. “Anytime you give something for nothing,” he said, “you fail both parties.” Say what? Allocating sand for

replenishment to replace what was taken from the public beach sure sounded like a win-win to me. But then, my thinking isn’t limited to economics, but extends to sustainability and environmental fairness. As the clock ticked closer to 5 p.m., the commissioners grew restless. Starr moved to defer decisions until more detailed information was provided, but the motion failed. The staff planner then read proposed conditions. She amended the wording in two of them, to reflect “fair-share” contributions to pave shoulders on Waiko Road, and to change, “approved beach nourishment” projects to “County funded” projects. Commissioners had no quibbles with the changes. But I did. “County funded” rendered the condition impotent, since there is no existing funding for beach replenishment projects, nor is any proposed for fiscal year 2008. With a motion on the floor to approve the application as is, I stood up to call a point of order, saying that the last minute change meant that the public did not have legal notice to review this proposed condition. Chair Johanna Amorin banged her gavel and stated that public testimony had closed. Exactly my reason for bringing it to their attention, I countered, since the public couldn’t comment on this significant change. Amorin asked if it was the will of the commissioners to reopen testimony to discuss it. It was not. “He already had more than his three minutes,” one grumbled. That was that. I left, frustrated that at every level, everyone seemed content with insufficient data and a minimum of actual public participation in the process. Awareness that something isn’t working is the first step to changing it. Our system of appointed commissioners, approved by County Council, has assured a pro-development Planning Commission for years. Former Commissioner Diane Shepherd, known for doing her homework and asking tough questions, recently resigned, saying she was working too hard and achieving too few positive results. Our system of government works best when citizens participate, beginning with voting. Short of that, we’re unlikely to achieve the level of proficiency required to face a fast-changing future. MTW

The numbers are impressive. Since Maui Bus service expanded last August to seven days a week, and started running with longer service hours, ridership has increased 31 percent, county officials say. In fact, a whopping 79,100 people rode in January. Curious about what these numbers meant in more human terms, I spent a week riding the Maui Bus to find out for myself.

It’s 8:30 a.m. at the Queen Ka`ahumanu Shopping Center in Kahului. This is one of the major hubs where riders can catch five different routes: the Kihei Islander route, the Lahaina Islander route, the Kahului Loop (and its reverse route), the Wailuku Loop (and its reverse) and the Upcountry Islander route. Just a handful of people are quietly waiting for their bus. One woman is trying to catch up on sleep while listening to music with headphones, but I decide to bother her anyway. Justine Defranco says she doesn’t own a car and says the bus is the most convenient form of transportation. Today she’s headed for work near the state building in Wailuku. She’s happy with the bus system in general. But wrinkling her nose, she says that, “at the end of the day it gets kind of gross.” She would like it if they wiped down the fingerprinted-smudged windows and cleaned out the trash people leave on the busses during the day. Her comments make me wary. This is my first time stepping onto the Maui Bus and I don’t know what to expect. When it arrives I find a seat and I’m pleasantly surprised by its comfort. The bus is fairly clean, in good shape and nicely air-conditioned. There are only six people riding, so I don’t have to sit next to anyone. I like my personal space. As people sleep, daydream, read and write, one woman files her nails. Cyd Castro and her five-year-old daughter Daiza are on their way to Maui Memorial Hospital. They started riding the bus last December after their car broke down. Castro says before she knew about Maui County’s public transportation, she took a taxi ride from Kahului to Wailuku that cost her $17. Despite the occasional “smelly” rider she thinks it’s convenient and she’s happy that it’s free (Wailuku and Kahului routes only, all others cost $1). She says the Wailuku and Kahului busses used to be packed full before the county added reverse lines in February. “There was standing room only,” Castro says. Even though busses run on the hour, she and her daughter only have to wait a half hour if they take the reverse route. Bus driver Robert Purdy says adding the reverse busses made a big difference.

“People tend to be in a better mood if they can sit down,” he says. “The busiest time is after lunch, 12:30 p.m. to 3:30 p.m.” People are shopping, tourists are sightseeing and students are off from school. Purdy used to be a tour bus driver and began driving for the county three years ago. “Locals are easier to deal with [than tourists],” he says. “I get to know them better, get closer to them. I met a woman on the bus when I started out and I’m going with her. She used to ride the bus everyday to Wal-Mart.” At the next stop, a woman cheerfully gets on the bus. “Hi, Robert,” she says as she hands him a donut. “How are you doing?” “People bring me gifts, they talk about good times, bad times,” Robert tells me after he pulls away from the curb. “I see them pregnant; I see their children grow up.” A tall, humble looking man sits in the seat opposite from me. He says his name is Steve Crain and he takes the bus at least four times a week to and from the homeless shelter. He’s working on completing a job skills course and the bus helps to get him to his classes. Then he leans in closer, proudly telling me that he’s close to completing the course. That afternoon, at 4:30, I’m at the Kaiser Wailuku Clinic waiting for the bus with a 14-year-old student from Baldwin High. I’ll call him “Bobby.” He says he takes the Maui Bus instead of the school bus to get away from the kids who call him “haole” and throw things at him. He likes the bus’ convenience and the fact that he can ride for free. “I thought they’d be graffitied after a while, but they keep it clean,” he says. Then he gives me the lowdown on some after-school hangout spots that he discovered by taking the bus. Some days he’ll take the bus down to the Queen Ka`ahumanu Center with friends for “unlimited soda refills at Ruby’s” or he might hang out at the small café at Kaiser’s Maui Lani Clinic. “[There’s] snacks and drinks and I can get on the bus and go home,” he says. Rich Toliver has only been riding for a month since his car broke down, but he’s already considered “one of the regulars.” “They know me by name,” he boasts.

The County says more people are riding the bus than ever before. We wanted to find out why.

“You talk to people you might not have met, make new friends.” Toliver works at Café Marc Aurel in Wailuku and also as a freelance photographer. He tells me he gets around town all by bus. “Did you know you can go all the way to Lahaina for a dollar!” he tells me. In fact, Toliver says that he and at least a dozen “new friends” take the 4:30 p.m. Lahaina bus just to see the sunset, have dinner and then ride back. Sounds nice, I think to myself and decide to save that for another day.

Day 2 Today I feel like taking a swim and getting some sun in Kihei. With my backpack beach-chair stuffed with everything I need for the day, I get on the 7:30 a.m. bus into South Maui. Shirley, a former school bus driver, knows how to keep her passengers in line, but in a friendly, caring way. She sees herself as sort of a public counselor. “I told him, brudah you gotta go. You gotta change your life,” she tells me, recounting the story of a rider she had to kick off her bus because his body odor was offending other riders. She believes that treating people with respect gets the best results. After her “counseling,” the offensive smelling rider showed up clean from then on. Shirley’s humor is high. The mood on the bus seems light and fun. I realize that the quality of the ride has a lot to do with the bus driver’s style and personality. Caroline Yoshida laughs at Shirley’s jokes and says she tries to ride Shirley’s bus if she can. Unlike most riders, Yoshida owns a car, but prefers to take the bus to the Grand Wailea, where she works. “[I have to] leave 45 minutes earlier to find parking at Wailea,” she says. But if she rides the bus, she leaves just 15 minutes early and has time to talk story and relax. After a couple hours at the beach, I head back up to the Longs Drugstore parking lot where I hear there’s going to be a Chinese New Year martial arts demonstration. But just minutes after I step off the bus, I find out the celebration is over. That means an hour wait in the hot sun until the next bus arrives. My backpack chair is starting to hurt my shoulders.

I walk over to Star Market for a cold drink and some relief in the cool air conditioning. I wish I had a car, I think to myself, so I could dump my stuff in the back and drive home. Instead I find a nice breezy spot at a nearby beach until the next bus comes.

Day 3 Today my husband and I decide to catch the Lahaina bus to watch the sunset. We pack a picnic, grab our beach chairs and hop on the 4:40 p.m. bus near the state building in Wailuku. As we ride along the Pali, we see whole families of whales breaching and spouting. It occurs to us that when we’re driving, we don’t have the luxury of enjoying the view. This is the first time Hannah Tolentino, 16, and Kim Breceros, 15, are taking the bus. They’re coming back from shopping at the Queen Kaàhumanu Center. I ask them if they would take the bus again. “Next Sunday, Queen Kaàhumanu!” they sing out in unison, then high-five each other and giggle. We get off at the Wharf Cinema Center where other riders catch the Kaànapali route to the Napili route. For us, it’s a quick walk to the beach where we enjoy a romantic picnic dinner watching boats and surfers as the sun sinks into the ocean. The bus back is on time and packed with kids, families and Westside workers headed home. We’re lucky to get a seat. Lots of riders get off at Maàlaea, where they can catch routes to Kihei, Kahului and Wailuku. The ride home seems longer when it’s dark.

Day 4 I take the first bus of the day on the Kahului loop. Bus driver Kelly has the Monday morning blues. I overhear her say her kid is sick and she worked an extra shift late last night. We’re running about seven minutes late. The riders that get on sense her mood. They say hi and then keep quiet. A guy I’ve seen before with matted hair sits in front of me. I move back one row to avoid the strange smell wafting off of him. Other riders glance at my actions and silently look the other away. We arrive at Queen Ka`ahumanu back on schedule just in time for the some 45 riders waiting to board.

Day 5 It’s 7:30 a.m. and Leon Custodio and I are waiting at the Queen Ka`ahumanu Center for the Upcountry bus. He’s got an interview near the Kahului Airport for a job as a taxicab driver. He lives in Kihei and says he wouldn’t be able to get to this interview if it weren’t for the Maui Bus. “That’s why I like the system,” he says. “It’s very convenient.” Custodio adds that he doesn’t need a car. With the $45 monthly pass, he hooks his bike to the front of the bus and gets wherever he needs to go. Later, Custodio tells me a story that reveals the social support a rider feels after riding the bus every day. “When I moved to Kihei, I stopped riding the Lahaina bus,” he says. Then a woman who used to ride the same Lahaina route ran into him one day on the Kihei bus. “She said, ‘I was worried. Suddenly you were not with us everyday.’” I could tell he was happy to be missed. Kelly, the same bus driver I had yesterday, is driving the Upcountry bus today, filling in for a sick coworker. She’s in a much better mood, so I decide to talk to her. “You have to love people,” she says about her job. “A good portion of the riders are homeless. If they’re drinking or on drugs, I say no [meaning they’re not allowed to ride]. There’s lots of handicapped and elderly.” She tells me about a time she helped a mentally ill man get to the emergency room. It’s clear she feels the bus system and her job are a public service. After contemplating my whole experience riding the bus for a week, I realize how the Maui County bus system is crucial in helping people in their daily lives. It is a bridge of survival to food and jobs. It is an escape from harsh weather and for some, the harshness of the outside world. It is an opportunity to find love or at least connect with other people. It provides hope for a better future for those striving for it, for those who need it most. Or as one woman put it a little more bluntly, “We pay for it with our hard-earned tax dollars, so it better be #$*!ing serving the public.” MTW

La Dolce Vita A lifelong love for Casanova Italian Restaurant I don’t remember much about my trip to Europe. Of course, I was 10 years old at the time, which was, like, 20 years ago—or a little more—but I do recall loving Italy. It’s a love and fascination with the culture, the people and especially the food, that has stayed with me even into my old age.

This might help explain why I find Casanova so charming. And this is coming from someone who actually pulled the hectic Ladies’ Night cocktail-waitressing gig a few years back. So yes, even after slinging shots of tequila through the wall-to-wall crowd of scoping scenesters, I can safely say my love for Casanova remains intact. There are obvious reasons: first, its prime upcountry location in the middle of Makawao Town means cool nighttime breezes will encourage romantic snuggling as well as heavy carb consumption. And the dimly lit dining room set aglow with scarlet walls on

which hang seductive paintings by local Italian artist Piero Resta is made cozier by large bouquets of tropical flora and a lushly foliaged waterfall in the corner. A family operated restaurant for more than 20 years, Casanova’s owners—one of whom is always roaming the dining room and offering warm smiles and flirty winks (viva Italia!)— take pride and pleasure in ensuring their guests’ comfort. And the prices are surprisingly moderate for what you get, winks notwithstanding. And then there is the food. In the past I’ve given way to a couple dinner favorites, which meant always ordering either the Paglia E Fieno Al Funghi (linguine with mushrooms in creamy garlic sauce, $15), the Beverly Hills (chicken rigatoni with sundried tomato cream sauce with vodka, $15) or the Margherita (tomato, mozzarella and fresh basil pizza, $12) and ending with tiramisu. Mmm… tiramisu. But recently, I decided to venture out of my comfort zone. That happened when chef David Gemberling treated me to an astonishing—although not unconquerable—feast. We started with the Gamberi E Fagioli Al Rosmarino ($9), scrumptious skewers of charbroiled shrimp served atop white cannellini beans with sweet Kula onions and capers. We also went for the delec-

table Asparagi Al Prosciutto ($9), fresh asparagus sauteed in garlic and then wrapped in prosciutto with Kula goat cheese and a creamy avocado dressing. The L’Insalata Russa ($9) in our second course was a hit. Diced organic beets with cubed potatoes were served with a tangy dill and tangerine dressing on a bed of baby arugula with roasted walnuts and French goat cheese. The richness of the salad paired fabulously with the Insalata Fabiola ($9), light and refreshing Begian endive with pears, arugula, Gorgonzola and walnuts. But one of my favorites came during course three, with the Ravioli De Magro Al Tartufo ($16), homemade ravioli stuffed with

spinach and ricotta cheese with fresh sage cream sauce and a hint of truffle oil. Our fourth course featured a tender and juicy, baked mahi mahi in parchment paper with lemon and dill cream sauce and an incredulously tasty ossobucco ($26), simmered in red wine for three-tofour hours, in classic Italian style. As for the desserts, I don’t remember much at this point, as I also might’ve been simmering in red wine for three-to-four hours, but I do recall loving them. MTW

If You Build It, They Will SK8 Saturday (May 5), 2-10 p.m. at Paia Youth & Cultural Center [SK8PARK FUNDRAISER] You know, kids are funny people. They look so much like us—only, you know, younger—and they act so much like… well… like we did before we finally got things like “freedom” and “independence” and “6.65 percent mortgage rates.” Anyway, the local artists-run Mana Collective—in collaboration with Lahaina Skate Co. and hosted by Paia Youth & Cultural Center—thinks the kids oughta skate. And dammit if they don’t deserve a place to do it! So they’re organizing this here event in order to raise funds for the construction of a West Maui skate park, as well as celebrate Cinco de Mayo and Kodomo No Hi, the Japanese Children’s Day. There’ll be a SK8 competition, interactive graffiti wall, break dancing, firedancing, ono grinds provided by chef Chris L, live music, video and film shorts, a fashion show, and more DJ’s than you can shake a baseplate at, including Max, Sal, Toben, Durty, Nutmeg, Mike Rozak and John Carmichael. The Honolulu StarBulletin once referred to her as a “local beauty.” She speaks Mandarin, Cantonese and English, has a bachelor’s degree in broadcast journalism and a masters in theater studies, both from the University of Hawaiì. She met her husband, a Hawaiì National Guard public information officer, on a blind date. They own two dogs, six cats and five rabbits. Lee, a vegan, enjoys cooking and one day wants her own cooking show. Some of her recipes have already appeared on KITV’s “Cook Healthy Fast” food segment. And this Wednesday, she’ll speak as part of the Vegetarian Society of Hawaiì’s lecture series. Lee will talk about her thoughts concerning health and beauty, as well as give out some of her favorite Chinese vegan recipes. The lecture is free, as are the refreshments. No Bite Spider-Man franchise lays down and dies After bucking the pitfalls of creating a sassy big screen superhero based on a popular comic book, and following it up with an even better sequel, Sam Raimi’s Spider-Man film series has fizzled into a flagging mix of confused passion and diluted villainy. Gone is the bright tempo and unbridled enthusiasm of the first two movies that seemed to offer limitless possibilities for the genre.

I’ve fallen, and I can’t get up! In this third installment that reportedly cost as much as $350 million (precise figures aren’t available), Peter Parker (Tobey Maguire) appears to have been recently pulled from a cryogenic freezer where he spent the past three years since Spider-Man 2. Parker sits in the same dull college science classes, lives in the same one-room fleapit, rides the same yellow moped and hasn’t managed to settle into a stable relationship with his true love Mary Jane Watson (“MJ”—Kirsten Dunst). Director/co-screenwriter Raimi dawdles through an uninspired opening act, wasting crucial Spidey time to elaborate

on MJ’s ill-fated Broadway singing performance and to impart the origin of Spidey’s new archenemy “Sandman” (Thomas Hayden Church) from the person of prison escapee Flint Marko. Marko’s culpability in murdering Peter’s cab-driver father Ben (Cliff Robertson) plays into the picture’s morally driven theme of forgiveness that gets hammered home on several occasions. During a web-hammock stargazing date in Central Park, Peter and MJ are oblivious to a meteor that crashes nearby before releasing a crawling black tar-like substance that attaches itself to Peter’s moped. The twitchy black goo eventually takes over

Peter’s body, turns his Spidey suit black and darkens his mood into an arrogant Goth punk womanizer with a flair for black designer clothes and slick dance moves. Harry Osborn (James Franco) returns to the franchise for a superfluous curtain call to show off his “New Goblin” outfit and flying board with which he hopes to destroy Spider-Man. Harry’s dubious presence goes a subplot too far with his bid to woo MJ away from Peter. More plot fumbling ensues with the initiation of Eddie Brock (Topher Grace) as a rival photographer at The Daily Bugle, attempting to usurp Parker’s freelance

spot and land a staff job under the tabloid’s gentler editor-in-chief J. Jonah Jameson (J.K. Simmons) who manages his earsplitting anger with prescription medication. Grace’s peroxide blonde hair barely conceals the actor’s golly-gee persona that hardly makes an impression. Brock becomes the fall guy for Spidey’s evil-twin war paint when the creeping black tar drips on him from a church tower where Peter uses a bell’s harmonic vibrations to escape the inky snare. Brock consequently turns into a spider-manmonster dubbed “Venom” who joins forces with Sandman. The action sequences in Spider-Man 3 fall flat compared to those of the sequel because they seem like mere re-workings of battles we’ve seen before. The highrise conditions become predictable and there seems to be less at stake for everyone involved. Mary Jane proves to be a fickle object of waning desire and Peter isn’t as excited as he once was about saving humanity. The “forgiveness” message of the story’s moral is nonetheless overrun by a revenge motive that fuels most of the action. Finally, there’s too much abstract villainy going on for the story to pick up an energized thread of momentum. Every performance feels modulated and sloweddown. Thomas Hayden Church fares better than the others due to his character’s CGI construction that draws on available deposits of sand to alter his size, but Church play’s Marko’s melancholy so onthe-nose that his dramatic scenes reek of melodrama. Smiles, Everyone, Smiles! A tour through Ka`anapali’s musical world big, consistently smiling man, beaming Standing in the Hula Grill men’s down from the small stage. I walked through the openair restaurant, noticing the juxtaposition of laid-back, lava flow-sipping visitors and the young, attractive servers and bussers, one careful step at a time across the hot sand floor (that sand literally melted a pair of my shoes long ago when I was a humble Hula Grill bus boy). Going Back to Cali The only journey is the one within. – Rainer Maria Rilke She asked what time I’d be home. And I told her, underestimating by about an hour, as is my way. She figured I needed the time to stop by an In-N-Out on my way into town, and I didn’t correct her. It was a familiar, somewhat seedy feeling. Here I was, an adult on vacation in Southern California, yet I was sneaking away from my mom’s house to visit an old high school fling. Some things never change, I guess. It was weird to see SK—he looked exactly the same as he did 19 years ago… The desert has developed a lot over the past few years I’ve been camping out on Maui. Casinos have apparently sprung out of sagebrush. My Indian-muraled high school has been whitewashed and now has a security fence. There’s a Starbucks where my favorite liquor-store-to-fish-for-wine-coolers used to be. But for the most part in Palm Springs, people are just as old or gay—never both—as I remember and everybody still drives those Jaguars and convertible Bentleys. I spent the next couple days catching up with mom, as we tooled around the desert, looking for shoes and the proper martini: hers—Ketel One straight up, chilled, with a frosted strawberry at Shame on the Moon; mine—vodka with mottled strawberries and basil, drizzled with aged balsamic vinegar at Bing Crosby’s. I also met up with a Desert Sun reporter/Re:Generator magazine editor who had a ticket to sell for Coachella Festival. I didn’t realize it when I planned my vacation, but all my current favorite bands—Peeping Tom, Peaches, Noisettes, Amy Winehouse, Rufus Wainwright, etc.—were going to be playing on the one day I’d finally get to check out this huge fry-fest so I was stoked. One night after dinner with the folks, I went to the bar at The Parker—a hip, upscale hotel that used to be Merv Griffin’s classic resort but in the past few years has been redesigned and was enjoying a fastidious following of the nouveau riche and Hollywood elite. As I walked in, the first thing I noticed was a neon sign that read “Drugs” hanging over a mantel surrounded by cushy love seats. Next to that, a larger lounge area seemingly lined in fur and sueded-tweed couches in half-circles with fluffy sequined pillows, futuristic lamps skewed in different directions and spiderwebby colored yarn art covered walls like graffiti— very Dr. Seuss meets Barbarella. Various palms were placed beside leather stools and white hexagonal tables with gold trim, as the sound of ice clinking in glasses and drunken smooches by kids too rich for their own good filtered through the room of sheepskin chairs and hanging bassinet orbs with hookah shaped lights, and a fire pit that glowed hazily in the center… Although I enjoyed the luxe surroundings, I craved more amiable company. And I got it—at Hair of the Dog in downtown Palm Springs. Surely there can’t be a dive bar in Palm Springs, you say! Ah, but the dive bars are sweetest in the places you least suspect them, my friends. It was a jovial joint, due in large part to a boisterous group of jarheads from the base in Twentynine Palms. After watching them down their umpteenth round of Jågermeister shots, and being introduced to “Matt” just as many times, I thought it best to leave before things got really ugly. It was then that I noticed “Billy” to my right, pouring out some of his beer directly onto the bar. He looked at me and smiled drunkenly. He was a big, tall man but suddenly to me he looked like a sad, little boy. “I went crazy a couple days ago,” he said, with a slight Southern twang. “No, really, I literally lost my mind.” He went on to tell me that he, along with the other guys in the bar, had just come back from an eight-month stint in Iraq—where he was initially told he wouldn’t be going, as he was “just a civilian” in the National Guard. He was angry, incredulous and a bit traumatized by the whole experience. “I saw my friends die,” he said. “And a couple days ago, my best friend was killed. He was a good guy, a really good guy…” Billy poured some more of his beer out on the bar. “I’m just a construction worker!” he said. “This wasn’t supposed to happen!” I stayed a few more minutes, poured out some of my beer in honor of Billy’s friends, introduced my new comrades to the “Duck Fart,” then slipped out to make a quick call back home. “I’m not re-enlisting,” said the boyfriend, even before hellos were exchanged. “You have no idea how happy that makes me,” I said.
