PRICES UP, PROFITS DOWN The price of a gallon of gasoline may be higher than ever before in American history, but that apparently doesn’t seem to be translating into a Golden Age for Texas-based Tesoro, which operates the largest refinery in Hawai`i. On May 6 the Honolulu Advertiser reported that Tesoro lost $82 million in the first quarter of 2008—stunning news for a company that made $116 in profits in 2007. The reason for the catastrophe? “Hawai`i refinery operations, which ran at a lower production rate as the company upgraded equipment and dealt with a power failure and fire that temporarily disabled the Campbell Industrial Park during the quarter,” reported the Advertiser. Actually, this isn’t all that surprising. In November 2007, Tesoro stock sold for about $64 a share; today, the share price hovers around $25. You do the math.

Good news! On May 7 the Hawai`i Tourism Authority convened a special, emergency meeting to authorize spending $3 million from the state’s special, emergency fund to offset the damage done to tourism by the loss of Aloha and ATA and the corresponding rise in airfares. This money “is specifically to stabilize the market’s perception of Hawai`i and Hawai`i’s airfares,” HTA Director of Tourism Marketing David Uchiyama said in the May 8 Honolulu Advertiser. In other words, state tourism officials will buy a lot of advertising trying to convince Middle America that flying to Hawai`i for a vacation isn’t going to be nearly as expensive as they think it will be. We can’t lose! Unless more airlines fail, in which case we’re screwed, but what are the odds of that? MTW
I was never so shocked as the other day when I was at Big Beach. There I was, minding my own business, playing backgammon with my fella while sunbathing topless. Then a group of three boogie boarders sauntered by. “Oh, didn’t you know the nude beach is over the hill?” one of the topless men had the nerve to tell me. I didn’t honor his remark with a retort. Who died and made him king? Besides the fact that he didn’t know the definition of nude, his blatant sexism pissed me off. Women have just as much right as men to be topless at a public beach, and courts here in Hawai‘i and nationwide have consistently upheld this right. Moreover, what kind of guy complains when he sees a topless woman?! If this is your idea of flirting, go back to charm school!

ROBREPORT
BY ROB PARSONS ROBPARSONS@EARTHLINK.NET
Ulupalakua
Seven Consecutive Days
Ranching in the 21st century Far from the Kihei condos, West Maui traffic and the shopping malls of Kahului, there is a region of the island quite serene and sublime. Driving the winding road past Kula and Keokea into the Ulupalakua ranch lands, you find wide-open views and green pastures. Any semblance of stress is likely to disappear like a wisp of smoke dissipating into the blue sky. On a sunny Saturday afternoon, Ulupalakua Ranch President Sumner Erdman stood under the pavilion at the back of the spacious lawn, amid towering century-old trees that grace the grounds around the Tedeschi Vineyard Tasting Room. A wild turkey strutted across the grass, unimpressed with the 20 or so folks gathered at blue palaka (plaid)-covered picnic tables, listening to Erdman talk about ranching in the 21st century. “We are at the place where the breadfruit ripened on the backs of people coming from where it grew, either in Kaupo, or over towards Makawao,” he said (Ulu=breadfruit; pala=to ripen; kua=the back). Erdman said that in addition to native koa and ‘iliahi (sandalwood) forests that grew in the region, native Hawaiians mainly cultivated sweet potatoes. There just wasn’t enough rainfall in the lee of 10,000 foot tall Haleakala, even for dryland kalo (taro). Though the windward slopes of Maui’s dormant volcano may collect as much as 80-100 inches of rain, Ulupalakua Ranch, stretching from sea level to 6,000 feet on the southwest flank of Haleakala, averages only 30-32 inches yearly. But they do experience perhaps 300 days a year of afternoon cloud cover, so our sunny afternoon was a welcome exception to the usual weather pattern. Beginning in 1845, lands in the region were cultivated for corn and potatoes, primarily to be shipped to California gold miners. A decade later, ex-whaling captain James Makee acquired the land and grew sugar and other crops. The remains may still be seen of the sugar mill he built in 1861. During the Civil War, the North was cut off from sugar grown in the South, providing incentive for Makee and other entrepreneurs in Hawai‘i. At one time he even tried planting cotton. Makee moved his sugar operation to rainier Kauai in the 1870’s, and cattle ranching operations began after he

sold the land in 1886. The ranch was owned and operated by the Baldwin family, beginning in 1922. Harry Baldwin bought Ulupalakua Ranch with money made when they sold Lanai to James Dole. “My dad purchased the place in 1963,” Erdman said. “Back then, the economy was depressed and no bank in the Hawaiian Islands would do the financing.” According to ranch history, the peak size was around 40,000 acres, before 20,000 acres was turned back to the State of Hawai‘i Department of Homelands in 1967 and the Department of Land and Natural Resources in 1997. Pardee Erdman began to diversify the cattle ranch, bringing in sheep. In 1973 he sold a 1,000-acre parcel at Makena to the Japanese railway giant Seibu for $7.5 million—more than twice what he paid for the ranch—for golf and resort development. Soon after, he formed a partnership with California wine-maker Emil Tedeschi, and began experimenting to see which grapes would grow best on the volcanic slope. While the vines matured, Tedeschi Vineyards marketed a successful pineapple wine, which still accounts for the majority of its sales.

anch economics are extremely tough,” Erdman said. “The cost of beef increases only one percent a year, while fencing costs are skyrocketing.” He says the price of wire and fence posts has caused them to innovate. They now are installing more solar powered

The Maui County Liquor Control Adjudication Board had been deliberating for about 20 minutes when the people outside the hearing room began to fear the worst. “How long do they normally take?” one woman asked. Off to the side, Ronald Panzo—managing partner of Lulu’s in Kihei— stood silently and waited. If he was nervous, he didn’t show it. At first, there had been reason to be hopeful. Yes, Lulu’s was up on a charge of serving a minor—stung in an LC minor decoy operation last July. The 19-year-old decoy employed by the LC had gone up to the bar and ordered a bottle of Corona, which the Lulu’s bartender had dutifully served her. He’d never even asked to see her ID. But Panzo pled no contest. While speaking before the board, he made no excuses and did not dispute any of the evidence against him. “We take it very seriously,” he told the board. Panzo explained how his bartender was an “outstanding” employee, but he had violated the bar’s policy of checking the ID of everyone who looked less than 30. For that reason, Panzo said, he had fired the bartender. “We had to set an example,” he told the board. Panzo added that Lulu’s now cards everyone who wants a drink, regardless of apparent age. He also said he’s in the process of getting his employees special training. Deputy Prosecuting Attorney Evans Smith had asked the board for just a $2,000 fine. But he also noted that this was Lulu’s second violation for serving a minor in five years, meaning the fine was the minimum punishment the board could hand down. The board usually took between five and 10 minutes to deliberate cases like this. In this case, they took nearly 30. Citing the previous conviction, Adjudication Board Chairman Donald Fujii told Panzo that his liquor license would be suspended for “seven consecutive days.” The LC has yet to say when that suspension will take place.

COCONUT WIRELESS THE WEEK IN REVIEW
BY ANTHONY PIGNATARO ANTHONY@MAUITIME.COM
between Liu and Kolohala. Sure enough: In April 2006, Liu sat on a panel with Kolohala official Michael Pfeffer at some Chinese business seminar thing at the Hilton Hawaiian Village. And later this month, Liu will sit on another business panel at the Manoa Grand Ballroom, this time with Kolohala official Robert Robinson (these are not the extent of Liu’s ties to officials with these firms; rather, they’re the extent of ties that I could find in the five minutes I allotted myself to do halfassed research for this piece). ANYWAY, the point to all this is that Liu seems to have cozy ties with both firms, when in fact he shouldn’t have any ties with firms trying to win his approval for government contracts. In any case, Liu probably doesn’t have much to worry about—the AP says the state Attorney General’s office, which would ultimately decide whether to indict Liu, opposes the whole Senate investigation on the grounds that the hearings are “unfair.”
THURSDAY, May 8 WEDNESDAY, May 7 The Associated Press reported today that a state Senate panel has concluded that Department of Business, Economic Development and Tourism Director Ted Liu broke the law. And the penalty could be losing his job. According to the five-member investigating committee, Liu’s granting of a $8.7 million hydrogen fund managing contract to H2 Energy, LLC was a violation of state law, since another firm—Kolohala Holdings, LLP—was actually the highest-ranked bidder. While not going as far as saying that Liu favored H2 over Kolohala for “personal gain,” the senators are saying that Liu and his staff “intentionally” gave special consideration to H2 and then began “covering it up” to protect Liu—a plan that, if true, was a spectacular failure (even Senator Sam Slom, the lone Republican on the panel, called the actions of Liu’s subordinates “moronic”). Liu, for his part, says he “operated under procedures I understood to be correct.” The problem here, in my estimation, is Liu’s job, which is basically to cozy up to firm that do business in Hawai‘i. For a taxpayerfunded bureaucrat, such a job is fraught with peril. When I first began looking for possible ties between Liu and H2—to help explain why he might favor that firm over Kolohala—I found one in about five minutes: in June 2005, H2 Energy official Barry Weinman accompanied Liu and Governor Linda Lingle on a special governor’s trip to China. Aha! I thought. But then, just for fun, I decided to see if I could find any ties
Now here’s some good news: according to today’s Maui News, our county has an “undetermined amount” of unexploded World War II bombs! And no, I’m not talking about those old unexploded bombs at Molokini or that mysterious little torpedo that was floating around the island a few months ago and then never seen again— according to U.S. Army Corps of Engineers draft reports cited in The Maui News article, four old bombing ranges on Maui and Lanai pose at least some concern: Kanahena Point at Keoneoio, Kanounou Point at Honokohau, Kamaole Beach in Kihei and Manele Bay on Lanai. Of those areas, Kam Beach and Manele Bay aren’t a big concern and probably don’t have any explosives lying around, but the other two could pose problems. Both are remote, located in the extreme south and west of Maui, but that doesn’t change the fact that “explosive hazards” are known to be in these areas. In November 2007, a Parsons Corp. survey team found a .50-caliber bullet and a couple 155mm artillery rounds at Kanahena. And while recently researching the Kanounou, the Corps of Engineers apparently discovered underground “anomalies.” Lovely. Anomalies. We’re doomed, right?
news directly contradicts Governor Linda Lingle’s generally rosy April 25 speech at the Hawai`i Economic Association Annual Conference. “Our state’s economic growth has slowed, but it has not stopped,” Lingle told the conference. “The latest forecast from the University of Hawai‘i Economic Research Organization predicts that our state will not slip into a recession.” That last stat seems to be a bit dated now, though Lingle also cited a Council of Revenues projection that the state would see 3.9 percent growth in 2008, and other state Department of Business, Economic Development and Tourism prediction that we’d see a 2.5 percent uptick. Even so, given the Economic Research Organization’s credibility, it’ll be tough for her to continue to paint a picture of an economically healthy Hawai‘i.
SATURDAY, May 10 But I’m sure she’ll find a way.
SUNDAY, May 11 I mean, has she ever let us down before?
MONDAY, May 12 I thought so.
FRIDAY, May 9 Hawai‘i’s immediate economic future isn’t good, according to a new University of Hawai`i Economic Research Organization study written by UH economists Carl Bonham and Byron Gangnes and Hawai`i Pacific University Professor Leroy Laney. “All four Hawaii counties will see zero economic growth in 2008,” says a Pacific Business News story today on the study. The reason is simply a projected massive drop in tourist arrivals—6.5 percent for Maui County alone. This bad
TUESDAY, May 13 And now I present a statement from county Public Information Officer Mahina Martin in response to my May 8, 2008 LC Watch column announcing that Maui Liquor Commissioner James Viela had resigned following my reporting on his 2005 DUI: “You are correct to point out that it’s historically difficult for the county to fill board and commission vacancies. The County has 31 boards and commissions that involve 287 individuals who vol-
unteer their time to serve the community. Vacancies occur when terms are completed or a member resigns. Many recognize the high profile ones such as the Planning Commission and Board of Water Supply, and others like the Commission on Children and Youth, County Arborist Committee, and Commission on Culture and the Arts often go unnoticed. Finding nearly 300 people who are able to contribute time and energy is no simple task nor is it taken lightly. Suggesting that the Mayor’s office is so desperate that we conduct little or no vetting of applicants is an easy and hasty assumption. Applicants are screened for appropriateness by staff before being reviewed by the Mayor. Once the Mayor decides on the nomination, it is then forwarded to the County Council for review and approval. With regards to your paper’s review of a liquor commissioner who resigned last month after it was disclosed that he had a DUI arrest in 2005, and the question of whether or not the Mayor was aware of it before sending the nomination to the Council for approval— the DUI arrest was not disclosed in the application submitted in January of this year and therefore was not considered.” There you go: Mayor Charmaine Tavares did not know about Viela’s 2005 DUI when she nominated him to the Liquor Commission, which is exactly what Viela said in my May 8 story, because there’s no space on the commissioner application form in which to write such information. Reassured? I certainly am not. Get snarky news and commentary from Anthony Pignataro sent directly to you cell phone. Just text “follow apignataro” to 40404 and we’ll do the rest. MTW

NEWSOFTHEWEIRD THIS WEEK IN TOE CLEAVAGE “Many of my young patients think about getting plastic surgery the way they’d think about getting their hair done,” explained Dr. David Alessi of Beverly Hills, Calif., who is still amazed at women’s willingness to endure “extreme” cosmetic alterations. “Vaginal rejuvenation” (labiaplasty) might be the most sensational procedure, but surgeons also do “forehead implants” and ankle and shoulder liposuction, break and reset jaws to tweak smiles, and lengthen or shorten toes (for “toe cleavage” with certain shoes). Alessi told a Glamour magazine writer for an April story that one 25-year-old recently asked him to “remove” her navel (whereas most umbilicoplasty patients merely request reshaping). Said a bemused colleague, “There’s some consensus about what makes for an attractive ... face, but we have no definition of the ideal navel.”
I WANT MY RIGHTS! Student Vinicios Robacher, 15, said in March he was preparing to file a lawsuit against school officials in Danbury, Conn., over an ear injury. Robacher said that, while he had his head down, sleeping in class, the teacher slapped his desk so hard with her palm, to wake him, that he still has constant pain.
CHUTZPAH! Jerome Kerviel told reporters in April that he is planning to sue Societe Generale bank in Paris for unfair dismissal, even though he is the “rogue” derivatives trader the bank says cost it the equivalent of about $7.5 billion by making risky, unauthorized deals that came to light in January and for which he is

under indictment for fraud. Kerviel pointed to an independent investigator’s conclusion that SocGen management had ignored 75 warning signs about Kerviel’s trades and continued to support him, but SocGen said Kerviel doctored paperwork to disguise trades.
WORLD’S GREATEST LAWYER Oregon public defender Ethan Levi agreed to represent Eric Kincaid, 29, who had been identified by DNA as the man (in a miniskirt, wig and fishnet stockings) who one night last year had hidden in the closet of a woman he did not know before fleeing. Kincaid denied that he meant the woman any harm, maintaining that he had been invited by a mysterious second woman, whom he also did not know, to have sex but had realized after seeing the first woman that he was in the wrong apartment, and he left. In April, Levi convinced the jury to accept Kincaid’s explanation and acquit him of all charges.
WELL, THAT EXPLAINS THAT! Gene Morrill, 57, hoping for a shorter sentence after his conviction for soliciting sex from teenage boys over the Internet, told a court in Fredericksburg, Va., in March about his rough life as a child, beginning with the time Bigfoot sexually molested him.
THAT SACRED INSTITUTION The Al-Shams newspaper in Riyadh, Saudi Arabia, reported in March that Mohammed al-Rashidi, 11, had just married a cousin, who is 10, remarking: “I am ready for this marriage. It will help me study better.” And in April, in a courtroom in Sana’a, Yemen, a courageous eight-year-old girl walked in alone and demanded that the judge grant her a divorce from the 30-year-old man her father had contracted to marry her. The judge, rejecting tradition, granted the divorce. MTW

ROBREPORT RANCHING: continued from page 6 electric fencing and less of the moreexpensive barbed wire and hog wire. They have increased their livestock and grazing numbers, yet reduced the number of ranch cowboys to six. “We brought in the Japanese Quarter Horses,” Erdman said, waiting for someone to get his joke. “You know the ones with Honda and Suzuki on the front.” The use of these all-terrain vehicles allows them to reach some upper pastures, a half-day horseback ride from ranch headquarters, in as little as 15 minutes. The use of Global Positioning System (GPS) technology has also been useful. “It helps us make sure we don’t put fence or a water trough in the wrong place,” Erdman said. They’ve also been able to map the locations of plant populations, both rare native plants and troublesome invasives. “Senecio madagascarensis is the most incredible noxious weed I have ever seen,” Erdman said. Many of his pastures are dusted with the tiny yellow blossoms of fireweed, its common name, which contains alkaloids that can be toxic to cattle and horses. “I’m not a big fan of herbicides, so we’re using ‘biological control,’” he said. By that he meant that they have sheep—which can digest the plants— graze in fireweed-infested pastures. They also use goats for weed control. Glycine is another plant that has found the regional climate to its liking, vining up fences and trees and throughout pastures. It was introduced to Maui back in the 1970’s, as part of a University of Hawai‘i project studying nitrogen-fixing plants in the tropics. While it’s not easy to manage, as a legume it’s high in protein and rivals alfalfa for nutritional content. To the ranch, it’s an asset. “People think we’re in the cattle business,” Erdman said. “We’re in the grass business. We use rotational grazing. Getting that grass into a marketable package is the trick.” Ulupalakua Ranch and five other Hawai‘i ranches market their beef through the Maui Cattle Company. The local, grass-fed product contains no antibiotics or artificial growth stimulants. The Ranch Store and Deli has a following for its burgers, both Angus beef and elk, culled from a small herd of 150 brought in some years ago. Erdman joked about goats actually being better in many respects than cattle: they’re market-ready in one year instead of two, are cheaper and are a “yuppie-food” gaining
Organic Mattresses... popularity with Whole Foods because they’re high in Omega-3s and low in saturated fats. “But there’s sort of a stigma,” Erdman said, grinning. “People have a different impression of cattle ranchers than they do of goat farmers.” eyond their grazing and vineyard operations, Ulupalakua has become a welcome site for telecommunications towers, relay stations and antennae. “In most communities it’s a NIMBY thing— Not In My Back Yard,” he said. “I say, ‘Please put them in my back yard.’” He now leases space to 15 such devices. There’s also been talk of using the ranch for a renewable energy site. “My dad started looking at alternate energy 20 to 30 years ago,” Erdman said. “We’re located on the volcano’s southwest rift zone. We entered into a geothermal agreement back then.” But an open system venting sulfurous emissions at Puna on the Big Island brought geothermal use into a controversial light, and the idea was shelved. Recently, they’ve spoken to companies interested in installing wind turbines, then signed a lease agreement with Shell Wind. Originally there were plans for a 40-megawatt project, with a pump-storage hydropower unit to provide electricity on a more regular basis. Water could be pumped to an upslope reservoir with power produced when the winds blew strongly, and when the winds subsided, the water would then flow down hill, turning a turbine to generate more electricity. But Shell’s discussions with Maui Electric Company have now scrapped the “hydro-banking” component and scaled back the project proposal to around 20 megawatts of output. Shell is now proposing battery storage to even out the intermittent quality of the wind power. They are in the process of preparing a Draft Environmental Impact Statement, one of 18 necessary permits. “How do you like that?” Erdman asked. “The state says it is promoting alternative energy, but it takes 18 permits to get something done.” Unlike some other large Maui landowners, Ulupalakua Ranch has endured changing times without resorting to largescale development, and has retained their unique sense of place. They have partnered in native plant restoration projects on their property, including work with the Leeward Haleakala Watershed Restoration Partnership. As Maui and the world around us continues to evolve, we may look to the adaptability of Ulupalakua Ranch to offer ideas of how we may best use our natural resources for mutual benefit, without exploiting or compromising them for future generations to enjoy. y most standards, 5 a.m. is a brutal hour. A cloudchoked, often intolerably cold volcano summit, cold coffee and the thought of gliding 26 miles downhill only add to the foggy confusion this hour generously offers. Yet thousands of people from across the globe come to Maui to do this very thing. Never mind that sunrise at Haleakala is iffy. Apparently one of the most coveted sights on the planet, it’s completely hit or miss. If the weather is as ugly as you are sleepless, the National Park Service offers no refund. No matter, since you didn’t come here solely for sunrise. You came up here to fly. Yet chance, weather, your health and the allegedly less than prudent practices of some tour operators may spell peril for the unlucky rider. In light of this, the County of Maui hired the consulting firm Kimura International to do a $250,000 study and make recommendations on the safety of Haleakala downhill bike tours. The study, which began in April, will help determine whether the county should adopt an ordinance regulating how the companies conduct the tours, among other things. Kula Community Association president Gina Flammer says that she hopes the Kimura study will lead to industry regulation. “We’re operating in a vacuum now,” she says. “There’s no oversight.”

MAUI TIME WEEKLY
which the word serpentine is an understatement. A handful of companies offer guided and independent bike tours down this road. These tours have operated on Haleakala since the early 1980’s, but some Upcountry residents vocally question their safety. Tour operators were once able to start their descent within the boundaries of Haleakala National Park, but a “safety stand-down” that began in October of last year in response to a rider fatality—the second that year— changed all that. Companies must now begin their tours just outside the national park boundary. Haleakala National Park superintendent Marilyn Parris says park service officials are accepting public comment on their Commercial Services Plan policy until June 10, and will then consider whether to let tours operate in the park once again, albeit in a different capacity. Maui County Councilman Mike Victorino estimates that, prior to the stand-down, bike tour companies brought about 20,000 t0 30,000 people up the volcano each month. At up to 125 bucks a pop, he says, that’s “major, major money” flowing into the local economy. “It’s a very large industry,” Victorino says. There’s no question the stand-down has hurt the industry. Phil Feliciano, who owns Cruiser Phil’s, says today his customer volume is 50 percent of what it was before the National Park Service prohibited bike tours from starting in the park. All those bikes headed down the mountain every morning–and many companies operate two tours daily–can equal serious congestion. Over the years Upcountry residents have been complaining that the tours passing through Kula, Makawao and Paia cause nearly daily headaches for those headed to work in the morning. “There have been complaints for many years,” Jimmy Muschietti, spokesman for Upcountry Citizens for Bike and Traffic Safety, says. Amid Upcountry citizens’ morning commute, Muschietti says the tours have provided “a steady stream of inconvenience” for people trying to go to work or get their kids to school. Muschietti says he used to work on Lower Kimo Drive in Kula. In May 2005, he had close calls involving bike trailers stopping short right in front of his truck. Once, he says, he had to slam on his brakes so hard to avoid hitting a stopped bike trailer that his dog was ejected from the truck bed. Fortunately, the dog survived. But another occasion, hitting the brakes behind a stopped bike trailer caused him to get rear-ended. Other residents have complained about being stuck behind slow-moving tour groups, trailers blowing stop signs and riders drifting over the double yellow lines. Muschietti wrote letters to county officials and published pieces in the local media in an attempt to attract attention to the issue. He even tried to get the bike companies together to discuss possible industry-wide changes. Muschietti also filmed what he considered to be violations of state traffic laws, and says he has over 100 hours of bike tour footage, which his group is editing into a documentary that will soon air on Akaku. But despite his complaints, Muschietti says he’s seen only sporadic improvements within the industry. “They’re really trying,” he says of the companies, but that what he wants is consistency. In his talks with Councilman Victorino over a possible ordinance that would guide bike tour industry policy, they talked about bringing in a “bike czar” in the future to enforce traffic and safety laws. Victorino says he hopes that the final result of the study–which is not expected for at least a year–will help the industry, the county, Upcountry residents and tourists come to a “happy medium.
who was on the County Council when the controversy first erupted, shares Flammer’s sentiment. “This has been an ongoing situation for many years, and it is apparent to all that the bike tour companies need to come under some form of regulation to balance the public’s right to safe, secure streets and unhindered passage on our roadways,” English wrote in an email. “Conversely, the bike tour companies have a reasonable expectation to be able to operate. We have tried selfregulation for the industry, and this has failed. It is time to come up with a regulatory framework that protects all interest and provides first for the safety of our streets and then for the baseline expectations of the bike tour operators.” n the wake of the stand-down some tour companies have beefed up their safety measures. Maui Sun Riders owner Paolo Baricchi says his company gives each rider an extensive safety briefing–and a laminated copy of state traffic laws–before sending them down the mountain. Screening riders for fitness is key. “I think that a big part of the safety issue is the booking process,” he says. When visitors book tours through a hotel concierge, Baricchi says, there’s a higher likelihood that a rider tour companies would normally view as a risk might slip through. “You have to have certain skills,” he says. “We always tell them, ‘You have to be confident on the bike.’” Baricchi says that if his guides see a rider struggling, they can pull him or her off the road to ride in the guide van for the remainder of the descent. Maui Sun Riders isn’t alone. Feliciano of Cruiser Phil’s voluntarily shut his company’s doors in the wake of the stand-down in order to refine safety policies. “We decided that we would change the [rider] restrictions,” he says. They changed the minimum age from 12 to 15, he says, and set the maximum age at 65. He and other tour operators also require guides to attend a first responder course. Attorney Jim Fosbinder, who has represented bike tour companies and is an avid rider, says the accident statistics show nothing particularly alarming. “I would much rather ride my bike up or down the top part of Haleakala than in Midtown Manhattan,” he says. “You take a risk when you do anything.” MTW
I
Vacation memories...
“We realize that many enjoy this terrific experience,” he says, adding that he hopes involved parties can come to a conclusion that will make the downhill bike tour industry “safe, prosperous” and “an industry that all of us can be proud of.” One bike tour operator says things are already much better. Paolo Baricchi, who owns Maui Sun Riders, a company specializing in independent tours, says traffic woes are a thing of the past. Before the stand-down, he says, between 500 and 600 cyclists were headed down the mountain on any given morning. Barrichi says he has experienced the frustration of having to wait behind bike trailers when driving his kids to school. Still, he says, the issue lies in part with the public’s attitude toward bicycle traffic. “To be honest, there are a lot of rude people on the road,” he says. “They just don’t like bikes.” Another tour company driver says Makawao residents would pelt passing cycle tours with donuts from a local bakery as they passed through town. That company now bypasses Makawao. f course, traffic woes are minor compared to the other major concern surrounding the industry: safety. At least 16 lawsuits were filed against tour companies since 1999 over injuries and deaths that occurred during a downhill tour. Estimates of the frequency of injuries, depending on whom you talk to, range from one in 100 to one in 60. National Park Service Public Risk Management Specialist Travis Heggie wrote in a January 2006 report that he estimates that as many as half of injuries that happened within park boundaries in 2004 and 2005 were not reported— a claim bike tour company owners say is inaccurate. “If you have to break out the first aid kit, it’s a reportable incident,” says Phil Feliciano. He says his company saw 17 injuries in 2007 and one so far in 2008. In June 2006 Maui Police Officer Jeffrey Mahoney reported to Chief Thomas Phillips on numerous downhill tour safety risks. According to the report, Mahoney noted narrow shoulders, slow-going groups, too many riders per group and a failure to stop at the stop sign at Crater Road and Haleakala Highway—an intersection that once sported a yield sign, and some believe should do so once again. Mahoney’s recommendations included requiring a certain distance between each group, setting strict rider age and fitness requirements and equipping all bikes
with lights and reflectors. “[P]art of the problem is the attitude and driving behavior of vehicular traffic,” Mahoney wrote. “We must understand that this problem will not go away and that changes need to be made.” Injuries occur due to a combination of factors, Flammer adds. There is an “inherent risk” when people wake up at two in the morning to bike down a volcano in at-times gnarly weather, she says. Throw in high winds, narrow shoulders, traffic and the shape of the rider, and you may have a high-accident likelihood. Though some companies have done better than others, she says. Some riders, KCA’s Flammer and others have said, have not ridden a bicycle in decades or have a health condition that should preclude them from riding. “It’s a nice tour when it’s done right,” she says. “It’s an asset for the visitor industry.” State Senator J. Kalani English (D, Hana, Upcountry),

Sushi Paradise The best sushi place you never heard about It’s been my experience that sushi always tastes better than it sounds. A recent outing to Sushi Paradise in Kihei confirmed that for me. I was told that the salmon skin sushi was a specialty of the house. Okay, I thought, I’m game for a culinary adventure—skin and all—and prepared myself for slippery, chewy and fishy. What I got was crunchy, delicately flavored and beautifully presented, a tiny Impressionist masterpiece. In fact, my meal was as much about presentation as taste. That’s the beauty of sushi—like the hokkigai, or surf clam, sushi that I swear looked like a miniature wave, white with red at the crest. Or the moi, a fish reserved for royalty in the old days. The taste is hard to describe, aside from yummy. Unfortunately, it isn’t always available, and is served mostly on weekends. I also sampled the eel and cucumber roll (unagi for you beginners). If you’re a sushi bar crawler, you’ll know that sushi chefs make many of the same things. It’s how they’re made that sets them apart. Akira Watanabe, Sushi Paradise’s owner and chef, just happens to serve his unagi warm—which really brings out the flavor of the eel. What also sets him apart are his serving sizes. When you watch him work you’ll notice that the rice block is quite small and the fish is usually big enough to drape over it. His
Spanish mackerel sushi, or aji, for example: the fish is shiny pink and silver and looks like it’s hugging the rice rather than just sitting on top of it. And then there’s his speed. I worried for his digits. I’ve been eating sushi for a long time and have never seen anybody work that fast. But I’m not complaining—anything that serves the food faster is okay with me.
Sushi Paradise 1215 S Kihei Rd., # I, 879-3751. Open Tu-Su, 6-10 p.m., karaoke 9-closing. Reservations recommended. $$
For sampling purposes, I ordered individually, but positively drooled when I saw the sashimi and sushi dinners. Remember the Impressionist masterpiece theme? Chef Watanabe was somehow able to make the individual sushi look like a whole fish again, complete with cucumber fins. My culinary adventure continued when Alissa, our waitress and tour guide, suggested the Chawanmushi, or egg custard soup. Who knew egg custard, chicken and spinach would work together so well? Although I couldn’t decide whether it was a first course or dessert.
As committed as I was to the cause, at this point I was starting to flag. So I really didn’t do justice to the sushi guratin (dynamite). I thought it was an unlikely (but delicious) dish for a sushi restaurant. There were vegetables (asparagus, zucchini, broccoli and mushrooms), scallops and shrimp topped with baked cheese. And, at this point it was a little heavy for me. I did revive myself enough for ice cream, especially when I heard it was homemade green tea and adzuki bean sauce. Now I’m a haole girl but I’m nuts for adzuki beans…
and sushi, too, come to think of it. Chef Watanabe and his tiny staff have been providing Kihei with sushi for 14 years. This year they won the ‘Aipono award for Best Sushi from Maui No Ka Oi magazine. But it’s all very low-key; they don’t advertise but do have a website that draws folks from the mainland. And they have a devoted local clientele that often frequent the “bar” once or twice a week. They obviously know something I just discovered. The best places are often the ones you never hear about. Places to satisfy your squid craving FRED’S MEXICAN CAFÉ Now I’ve never eaten here, but my editor has. He says they have the best calamari tacos man can find. Evidently, they fill a soft tortilla with good stuff like cabbage, then stuff it full of thick and tender calamari steaks topped with a spicy chipotle sauce. But mostly when he describes them he uses a lot of big hand motions and unintelligible sounds that I assume mean that they are delectable. 2511 S. Kihei Rd., 891-8600. Open daily 7:30 a.m.-11 p.m. $

SANSEI RESTAURANT AND SUSHI BAR I’m slightly afraid of consuming any animal that’s still in its original form, but for some reason I love the Japanese Calamari Salad at Sansei. According to the menu it’s described as “calamari fritte tossed in spicy kochujang vinaigrette over Kula greens in a crispy won ton basket,” but to put it simpler, it’s the most original calamari on the island. Sweet and spicy, it’s not overly battered or fried. Usually I start with the rings and tell myself that I’ll be satisfied by the time only the little whole squids are left; but then I find myself snarfing down the rest of it like a happy killer whale–or whatever else eats stuff like this. 1881 S. MAKAWAO STEAK HOUSE They have great steak. Whatever—I’ve always felt their calamari steak is better than their beef. We’re talking thick calamari here. In fact, the first time I ordered it my husband–much to my humiliation–exclaimed, “My God! There’s no reason a squid should be that big.” The steak is lightly battered–I think–in a panko crust, then covered with a yummy lemon-butter caper sauce that’s sinfully delicious. You can order the calamari as a side or as an entrée. Whichever way you go about it, it’ll be filling and ruin you in terms of ordering the cheap stuff ever again. 3612 Baldwin Ave., 572-8711. A SAIGON CAFÉ Yum-O. The fried calamari here is a wonderful, greasy addition to all of the light, fresh and healthy alternatives on the menu. It comes with one great dipping sauce, but if you’re nice you can probably request both the lemon butter and a sweet Thai chili sauce. The batter-to-calamari ratio is perfect and the price is probably one of the most reasonable on the island. 1792 Main Street, Wailuku, 2439560. Open daily 10 a.m.-9:30 p.m. $
SERPICO’S PIZZERIA I felt sooo stupid when I realized that calamari was an Italian word. I guess it makes sense because there is no “la” in Japanese, meaning that calamari would be “caramari.” Anyway, I guess Italians eat a lot of the stuff. Who knew? (According to my boss, everyone but me.) ANYWAY, Serpico’s has a great, authentic fried calamari Caesar salad. There is something to be said about their homemade dressing and the way that it goes so well with their perfectly seasoned squid. But now that I know about those Italians, I’d just say that it figures. 7 Aewa Pl., Pukalani, 5728498. Open daily 11 a.m.-10 p.m. $ MTW

Crazy for Canoes Sunday-Saturday, May 18-31, Kamehameha Iki Park & Banyan Tree Park, Lahaina [FESTIVAL] Outrigger canoeing is alive and well on Maui. I know this personally because three weeks ago I had my very first paddling experience in the wild and crazy restaurant races that Lahaina Canoe Club organizes every year. Although my brush with paddling was enlightening–it also left me with two sore arms–I think the day as a whole had more to do with kicking it outside with co-workers, drinking beer before noon and good, old-fashioned competition than actual paddling. But the upcoming Festival of Canoes in Lahaina is all about the history of canoes in the Pacific. Besides the ongoing traditional canoe, tiki and drum carving there will be cultural displays of Polynesian arts, demos on the art of traditional tattooing, the making of poi pounding boards and a really big craft fair with music and dance performances. The festival will open on May 18 with an ancient greeting ceremony by Lahaina’s Hawaiian Warriors group and close on May 31 with the annual parade of canoes and the closing launch ceremony of the newly carved vessels. For a complete list of activities visit www.mauicanoefest.com or call 667-9193. [JESSICA ARMSTRONG]

Upstaged by CGI Prince Caspian plays like The Lord of the Spiderwick Towers of the Golden Terabithia No offense to fantasy film lovers everywhere, but if I have to sit through another movie about a group of kids who are the last hope for a world only they know about, I’m gonna puke fairy dust.

While The Chronicles of Narnia: Prince Caspian is indeed good and a little better than The Lion, The Witch and the Wardrobe, it’s also too familiar, with imagery right out of the Lord of the Rings series, The Golden Compass, Harry Potter, The Spiderwick Chronicles and Bridge to Terabithia. Also, the first hour of Prince Caspian is, sorry to say, dreadfully boring.
Man, I could really use another sword right now
Once again, the actors are so easily upstaged by the CGI creatures. It’s no wonder that the film finally comes alive with the appearance of a sword-wielding mouse that has all the best lines. This time around, the group of four English school children team up with Prince Caspian to save Narnia from a new batch of villains. Peter, arguably the leader of the four, is over his head with power, while Lucy, the youngest, is the only one who has faith all along that Christ-like Aslan the lion will save them. Die hard fans of C.S. Lewis’ books and kids will be the biggest fans of this entry, but really, only the remarkable special effects and thunderous action sequences
are improvements over the equally bland first installment. Even with Peter Dinklage and Warwick “Willow” Davis in the cast, the actors and the characters they inhabit don’t make much of an impression. Then again, it may be difficult to stand out when you’re up against a gorgeous CGI lion speaking with Liam Neeson’s voice. There are great sequences, like a scary ritual Caspian partakes in, a nighttime castle raid, a tense sword fight and the all-stops-out climactic battle. If only this very long film were better paced. After all, the Harry Potter series got off to a rough start but got better around the third entry, so perhaps the Narnia films will continue to improve. MTW

Legends Getting ready to watch the first LIVE Hawai‘i-produced MMA event on pay per view Mixed Martial Arts fighter Egan Inoue was in town on Saturday. Inoue (12-8-0) flew in from Oahu to sign autographs at Solid Clothing in the mall to promote his upcoming fight under the X-1 World Events: Legends card taking place on May 16 at the Neil Blaisdell Arena. I had lunch with him, Mike Hall–president of Fight Agents, which promotes Hawai`i MMA athletes, X-1 president Mike Miller, Maui fighter Dylan Clay and a few other MMA insiders at the Kahului Ale House.
X-1 LEGENDS Friday, May 16 at 7:30 p.m., Neil Blaisdell Arena Tickets: $25 and up, for more info www.X1Events.com Live on pay-per-view: SD Digital Channel 260, HD Digital Channel 1260
Friday will be the first time that a locally produced MMA event will be available live on pay-per-view. The event is being produced and televised by Liquid Planet Studio, based in Oahu. Oceanic Time-Warner will broadcast it. Two Maui fighters are on the card, Dylan Clay (5-0-0) and Brandon Visher (10-1-0). Both are ranked high on MmaHawaii.com. In April, Clay was the top Hawai‘i welterweight and Visher, a featherweight, ranked third. Clay and Visher are both well-rounded fighters, and the thing they have in common is Jeff McKee—coach and trainer from Peak Performance and the Wailuku Boxing Club. During lunch, I sat next to Inoue and found it hard to believe that he’s 42: no wrinkles and a physique that hints he found the Fountain of Youth. Still, I wondered what the hell he was thinking when he decided to get back in the ring to fight Hans Marrero (115-0), a talented submission expert from Arizona who’s just 23. “I’ve been taking these new supplements,” Inoue said. “It seems that my recovery time is better, so I just want

to kind of see where I am, give it a chance. [Marrero’s] won all eleven of his fights by arm bar. I already do a lot of ground work, but I tailored my training a little because of that.” Born and raised in Oahu’s Manoa Valley, he earned his black belt in Tae Kwon Do, Hapkido, Shotokan Karate, Jeet Kun Do and Japanese Jiu Jitsu (he also became a brown belt in Judo). He later took up Brazilian Jiu Jitsu and in 1996 became the first non-Brazilian to win a world championship when he won the Blue Belt division in Rio de Janeiro. The next year, as a purple belt, he took the unlimited weight class championship. Inoue’s MMA career started off by chance when he filled in for his brother Enson for a fight in Japan. He won by submission in the first round and was hooked. Over the next few years, Inoue won five MMA world champion titles and fought in Pride, Shooto, SuperBrawl (Icon Sport) and the Luminex Cup. His last fight, which saw him injured and defeated, was in 2003. Inouye hasn’t competed in nearly five years, but he’s stayed active with his two gyms on Oahu: The Studio, which focuses on family fitness and Grappling Unlimited, where he focuses on training people for competition. Inoue says that fighters want to see him back in the ring, but his students keep telling him that, “you have nothing to prove.” “But win or lose, after getting in the ring, I’ll know where I stand,” he said. “And if I feel like I’m right there, I may go on another run.” MTW (Top) Egan Inoue (Inset) Brandon Visher & Jeff McKee (Far Right) Egan Inoue (Right) Dylan Clay

TAURUS (APRIL 20-MAY 20) What do you do when you throw your heart into something, and all you get back is derision, sarcasm, and spite? While some enlightened part of you may recognize that the negativity coming your way has its roots in jealousy, insecurity, and some people’s built-in defense mechanisms, that doesn’t stop it from hurting. You may be tempted to simply pack up your things, give up, and go home. In fact, it may take every effort of will to not do so, but I hope you can find a way to keep on keeping on. Don’t leave, and don’t lash back. Instead, see if there’s any shred of truth in the critiques you’re hearing. Take that on, and let the rest just roll off your back.
GEMINI (MAY 21-JUNE 20) Unless your parents home-schooled you in the boonies far away from other people, deprived you of television, and didn’t even tell you about the Internet, there’s no way you’re as naïve as you’re pretending to be. You may actually be somewhat innocent here, but trying to play that up would just push it over the top, and everyone would start to have trouble suspending disbelief. Roll with what’s happening. If it’s truly new to you, soak it up like a sponge, instead of making sure everyone knows just how novel it is. You don’t have to be anything other than what you are, but if you decide to push perception in one direction, make us think you’re more worldly and experienced, not less.
CANCER (JUNE 21-JULY 22) Too much information is too much information. Even if you feel that what you’ve got to say is vital for everyone to know, pay attention to the cues you’re getting. Sometimes people just don’t want to know. Of course, you can always force this stuff on them, but why? Let people have their blissful ignorance if that’s what they want. Enjoy the privacy and personal space that gives you as well. It’s not going to hurt you much for them to remain unaware; it might cost them in some way, but that’s their choice—not yours.
LEO (JULY 23-AUG. 22) You’re good, but you’re not godly. This week’s struggle is versus that powerful ego of yours. When you receive well-deserved and hard-earned recognition for what you’ve done, it’s difficult to not let it go to your head. The line between simply feeling proud of yourself (which you ought to), and believing you’re a gift to all humanity gets blurry at these times, and too often you find yourself just a step or two on the wrong side. Grab some modesty and strap it on. Slather yourself in SPF 60 ego-block. Gorge on humble pie. Do whatever it takes to keep your pride from getting the best of you.
VIRGO (AUG. 23-SEPT. 22)
Reservation Deadline:
May 22nd
At first glance, seeing the new person in your life may feel just like looking in a mirror, but as you get to know them, you’ll start to notice more and more differences—some of which are profound. Your first reaction is likely to be alarm. You might be disturbed that this person you thought was so much like you could disagree on such fundamental issues. Don’t flee, though. These cracks in the mirror are where are all the interesting stuff is; here you’ll find opportunities to learn about yourself, to grow, and to experience the exciting sparks that can be caused by that kind of friction.
LIBRA (SEPT. 23-OCT. 22) I’m kicking myself for my own prejudices. Some of my favorite people come from your tribe, but I’ve met so many Librans who bored the hell out of me that I confess I sometimes don’t give you guys the benefit of the doubt. It’s unfair that you may have to start with a kind of deficit when you meet someone, and have to prove how interesting you are before you’ll get your due. Unfortunately, you’ll encounter this kind of thing often. Try not to resent it. After all, if you’re a cool Libra, you’ve got more than enough talent to prove that you’re worth knowing, if you care to, and more than enough friends to not bother proving anything if you don’t feel like it.
SCORPIO (OCT. 23-NOV. 21)
Publishes:
May 29th
You’re feeling fairly strong and hard to topple these days, like a massive sequoia with roots spread deep into the earth, able to withstand hurricanes and forest fires and any other sort of massive calamity headed your way. But remove a small strip of bark from a tree in the wrong spot and it’ll die. This is what you need to watch out for. You’re relatively immune to the big stuff that could go wrong right now; the threat you need to worry about is insidious, tiny and hard to detect, let alone resist. Minimize the chances that it’ll find an opening. You know which weak spots need protection. Defend them well, but remember—it’s best if no one else even figures out where and what they are.
SAGITTARIUS (NOV. 22-DEC. 21) Your Jedi mind tricks won’t work this time. Once, you could dissuade your critics or disarm your opponents with a word or a smile, but these days they’re more persistent. They have more to gain now, and thus your usual tactics are no longer effective. You’ve got to step up your game, too. Your only real chance here is to stay one or two steps ahead of the people who want to trip you up, and that’s going to involve more diligence, guile, and sweat-inducing labor than you’re used to. Don’t rely on clever tricks, charm, or luck. Roll up your sleeves and get to work.
CAPRICORN (DEC. 22-JAN. 19)
is a time of adventure. It's when S ummer we shed much of our clothes and head outside, to bask in the sunshine or dive into the ocean. Yes, Maui's climate affords us the luxury of being able to do that nearly year-round, but seriously—when was the last time you went outside simply for fun and relaxation? Now you have no excuse: our Summer Guide will help you plan your special Maui adventure.
Don’t expect unearned slack, nor even slack you may deserve. Although people really ought to let you get away with what you’re up to this week, considering how much leeway you’ve given them in the past, don’t hold your breath. They’re going to call you on your shit, completely forgetting all the times you bit your tongue when your positions were reversed. Life’s so not fair. Feel sorry for yourself later, though. For now, you’ve got to work on covering your ass and making sure you’ll succeed despite the opposition and finger-pointing you’ll be subject to in the coming weeks.
AQUARIUS (JAN. 20-FEB. 18) Being patient sucks, especially when at the end of your long wait (which you endured as gracefully as possible), you don’t even get what you were waiting for. That’s why this week I’m giving you permission to toss patience out the window. Get out there and seize what you want. Do it as wisely and cleverly as possible, but don’t delay another second. Haven’t you waited long enough? It’s now or never. Since the answer’s going to be the same whether you ask the question immediately or wait, why not find out what it is right away, for good or ill?
PISCES (FEB. 19-MARCH 20) Forget about walls, armor, or psychic forcefields. They’re all worse than useless right now. They can’t keep out unwanted intruders, and they’re only likely to signal that you have something worth protecting (and thus taking). Since you can’t block intrusion with a wall, your chief hope is escaping notice altogether. Go invisible, or as close to it as you can manage. Be subtle, covert, and wear just enough camouflage to blend in with your surroundings. Don’t go overboard—that’s just as obvious as wearing a suit of armor. Luckily, the danger’s clear; you’ll know exactly when it’s safe to come out of hiding.
ARIES (MARCH 21-APRIL 19)

You’re a person of conviction. It’s written all over you, so you don’t usually have to prove yourself. This week, however, requires that you go the extra mile in order to keep people from getting the wrong idea about you. Luckily, you have all the skills you’ll require to navigate this week without hurt feelings, wrongful impressions, or disastrous misunderstandings. Those skills come naturally to you: being direct, forthright, brutally honest, and totally transparent. You may piss off or disappoint people by not telling them what they want to hear, but that’s something you can live with. The anger or disappointment you’d face if you lead them on, even by accident, would be much, much worse.

Recall!

Costco called today–Friday, May 9–to inform us that they’re recalling the May’s Teriyaki hamburger patties, along with about 70,000 pounds of other May’s products, that we bought a few weeks ago because they may be tainted with E. coli. You mean the two boxes that we all snarfed down and I served to toddlers and my elderly grandparents at my daughter’s friggin’ birthday party?! That’s how I wanted to respond, but I was too busy going online to research the incubation period of the bacteria and find the best deal on a family burial plot. I realize that it’s not Costco’s fault they sold a potentially lethal product to the unsuspecting public, just as it’s not my fault for serving the possibly tainted beef to my guests, but it still pisses me off. Who’s to blame? May’s is actually a division of Palama Beef–a company that’s processed about 80 million pounds of flesh over the past 55 years with no recalls until this one. According to the May 9 Honolulu Star Bulletin, Palama Beef says the sample containing E. coli came from the unused portion of some “raw materials” from “an outside vendor.” I’m hoping that they mean raw meat from a guy who raises cattle, but I’m thinking that if it were as simple as that, they would have said so. Furthermore, the Bulletin reports that Palama Beef indicated that by the time the recall was announced, 40 percent of the tainted beef was recovered. Are we supposed to find this comforting or grossly negligent? Does this mean that somehow, the company managed to collect close to 28,000 pounds of beef before letting the public know that there was a problem? The word “recovered” sticks out like a sore thumb and makes me think that it was already on it way to the consumer. I’d think the process of “recovering” something would take at least a little bit of time. What about the people who decided to eat their May’s while the company was busy recovering meat? What if they got sick and it could have been prevented? I decided to check out the May’s website (www.mayshawaii.com) to see if I could get any more info about the recall straight from the horse’s mouth, but guess what? There was nothing, nada, not a single word about the recall on the site. Instead, there was a picture of a delectable looking burger and a newsflash saying that, “May’s Mobile is coming to your local supermarket!” At press time the U.S. Department of Agriculture says there have been no reported illnesses, which is wonderful considering the assumption that most local folk buy May’s patties in bulk to serve at parties or large BBQ’s where a lot of the consumers are young children–those most at-risk for serious complications from E. coli. For those of you that may have eaten recalled meat, the incubation period is between three to nine days. So if you start feeling sick in that time frame, make sure you get to the doctor and hire an attorney fast. Illness from E. coli can be difficult to prove, which means you’ll probably have to bury your pride and subject yourself to giving several fecal samples; but if it’s verified, I’m thinking that you could be compensated a pretty sum. Assuming, of course, that you survive.
