LETTERSTOTHEEDITOR TO HILL WITH IT Regarding the Haleakala bike tour controversy [“All Downhill From Here,” July 24], I’d like to see the county man up and ban this so-called “industry.” The owners know nothing about cycling, their bikes are rusty and in terrible condition, they are sucking up our tax dollars for road improvements exclusively for their own use and the continuous parade of crashes and injuries tie up police and emergency services. Not to mention all the unfortunate people who have to sit there in the traffic jams they cause by driving their vans in the middle of the road at 10 MPH. If the County won’t ban this farce, how about a requirement that all owners and ride leaders must ride one of those crappy bikes UP the volcano, from Paia to the summit, for every tour they bring DOWN? That should keep the numbers down (to zero!). -Mr. Uphill, submitted online at mauitime.com

BLOWING SMOKE Flip-flopped. Reneged. Deceived. However you want to characterize it, Gov. Linda Lingle has gone back on her word to the citizens of Hawaii. Earlier this month, Gov. Lingle vetoed HB 2675, which would have established a temporary task force to examine critical issues affecting Hawaii’s medical marijuana program. Although the Senate voted overwhelmingly (21-1) to override Gov. Lingle’s veto, the House failed to follow suit, which means that questions regarding adequate supply, growing facilities and the inter-island transport of medical marijuana will remain unanswered for at least another year. Gov. Lingle’s veto is directly at odds with a 2002 campaign pledge to uphold Hawaii’s medical marijuana law and her reasoning is shoddy, misleading and contrary to stances she has taken on other issues. -Nathan Miller, Marijuana Policy Project, Washington, D.C.

WEEDING THE WAY The safest future for Hawaii lies in agriculture. We are 90 percent dependent on imported goods. There are serious self-sufficiency issues to be worked on for our future. So I ask our legislators to change one law to help Hawaii prosper economically. Don’t worry, I’m not talking about allowing TVRs. Now that sugar and pineapple are finished, we need a new cash crop. I’m talking about legalizing the growth of hemp. Industrial hemp, medicinal hemp, it’s all weed and it grows well in Hawaii. Maui Wowie, Kona Gold, Puna Butter—patent the names and

4

MAUI TIME WEEKLY

export it. Industrial hemp can be made into paper, fabric, etc. If we legalize it many people will grow it, families will be able to make ends meet. Tourists will come to see how Hawaii has become so prosperous. Is hemp any worse for people to be using than alcohol or tobacco? Stop the corruption that says if the government doesn’t make a profit, it must be illegal. -Ahiena Yamakawa, Makawao

WHAT’S THAT YOU SPRAY? The sign on the Mokulele Hwy. for the past couple of weeks clearly says they’re spraying us with herbicides. Has anyone questioned this? I would like to know what herbicides? An article by Richard Alexander of the State Bar of California says that many commonly used herbicides are dangerous and can cause carcinogenic, reproductive and developmental effects. These chemicals are poison and we are being poisoned. Either through breathing it in the air or eating it as it ultimately goes back into the food chain. Are we just the little people, as the late Leona Helmsley would say? Don’t we get a say in whether we want our environment poisoned by corporate rulers? Can you please tell me who is responsible for this herbicide spraying, as I would like to direct my questions and concerns to them as this is a very serious issue. -Benedict Cummins, Haiku Ed. Note: We’re currently looking into the spraying, which seems to be aimed at keeping invasive weeds at bay along Mokulele Hwy., where landscaping is being done to introduce native plants. An initial response from the Department of Transportation indicated that there are four different subcontractors doing the work, and that it would take “some time” to find out what kind of herbicides they are using. Expect a story on the issue soon.

menting on our coverage, but only if they’re complimentary. If you still wish to complain about something, please have the decency to use plenty of bad punctuation and grammar—that makes it easier for us to make fun of you when we respond. We also reserve the right to edit your letters. Send your letters to the editor via e-mail (letters@mauitime.com), regular mail (Letters to the Editor, Maui Time Weekly, 33 N. The business end A look at the week’s economic winners and losers… The big story of the week is, of course, Maui Land & Pineapple Co.’s announcement that it’s laying off 274 workers—representing over a quarter of its workforce—in what The Maui News artfully termed a “reorganization.” The move, which CEO David Cole (who, according to businessweek.com, pulls in $550,00o a year) called, “difficult but necessary,” will save ML&P about $11 million. The cuts came as a result of (cue familiar music) soaring oil prices and a sluggish economy. According to a statement released by the company, Maui Pine will now look to produce enough fruit to stock local markets and a few Mainland accounts, but will shrink its operations drastically.

In this economic climate, even slight growth is something to tout. It’s the equivalent of not just keeping your head above water in a rising flood, but actually managing to swim a few strokes forward. The Pacific Business News reports that Bank of Hawaii enjoyed another profitable quarter, with shares rising $1 per. Speaking with the measured blandness one would expect from a successful banker, CEO Allan Landon attributed the company’s success to its “disciplined approach to credit and balance sheet management as the Hawaii economy slows.” Yes, folks, when that’s what passes for good news, you can bet the picture is pretty bleak. Alexander & Baldwin saw its second quarter earnings slide 7.5 percent as the company was hit on both the shipping and agricultural fronts, according to Nasdaq figures and PBN. Rising fuel costs (is there an echo in here?) and lower cargo volume were the culprits on the shipping side, where the company did post a profit, but at a significantly lower level than last year. Meanwhile, persistent drought on Maui led to a $5 million agribusiness drop-off, with little rain—or concurrent economic improvement—in sight.

According to a self-congratulatory press release fired off by Maui Electric Company, MECO has been named one of the top ten Solar Integrated Utilities in the country by the nonprofit Solar Electric Power Association. While some might say this designation should be a no-brainer in a place as solar rich as Maui, still…it’s some mildly good news attached to a power company. We’ll take it. If there’s one complaint heard more than any other in the news business it’s that we only report on the grim stuff. So here’s a ray of sunshine, literally. Now a word of advice for MECO: Don’t rest on your laurels. You ranked in the top ten in multiple solar-related categories, but you weren’t number one in any. So there’s work to be done. MTW

ROBREPORT

BY ROB PARSONS ROBPARSONS@EARTHLINK.NET

Totally ‘ag’-gravating Agricultural subdivision loopholes, abuses hinder bona fide farming ailuku Country Estates resident Daneford Wright presented documents to the County Council on July 8 illuminating a number of troublesome developments in the agricultural subdivision where he lives. Situated on lands formerly planted in sugar cane and macadamia nuts by Wailuku Sugar, and later, Wailuku Agribusiness, the neighborhood consists of 184 two-acre lots adjacent to Happy Valley and nestled up against the West Maui Mountains. Wright testified that Wailuku Country Estates has never fulfilled the final subdivision standards required in a contractual agreement with the County of Maui in 2002, at which time the developer (Brian Anderson, son of Hawaii businessman/politician D.G. “Andy” Anderson) posted a $20 million bond. Council members heard that there has been no dedication of roadways or sewer lines to the county, and both an offsite retention basin and a Spreckels Ditch crossing have not been constructed, Even more distressing, Wright related that the county reduced the bond a few years ago to $1.25 million—not even enough to build the retention basin—and that lot owners have seen their ag water allocation dropped from 5,000 to 2,000 gallons daily. Wright maintains that is insufficient supply to sustain the farming activities he has planned for his property. Wailuku Country Estates, along with Launiupoko in West Maui, were two of the last large agricultural subdivisions “grandfathered in” and not required to abide by the limited number of two-acre parcels set forth in the ag zoning revision ordinance in 1998. Previous to that revision, community members and decision makers saw the rapid growth of pseudo-farm “gentlemen’s estates” on large parcels of formerly productive ag land. Many of these subdivisions now sport mansion-sized dwellings, huge lawns and even swimming pools— but little that would indicate real agricultural activity.

recently transferred and subdivided ag lands. Though connected to the county’s drinking water system, WCE homeowners are restricted against using that potable water for agricultural irrigation. Instead, they have a separate ag water line, supplied by Wailuku Water Company (WWC), from their irrigation ditches that withdraw surface flows in the four major valleys of the West Maui Mountains. About a year ago, according to Wright, WWC notified homeowners that their $95 monthly water payment that once allocated 5,000 gallons to each lot was to be reduced by 60 percent, and that any additional usage would face a charge of two dollars per additional gallon. Wailuku Water Company is not a licensed water utility, though they recently petitioned the Public Utilities Commission for that status. Department of Water Supply Director Jeff Eng was among many testifiers who asked the PUC not to issue a license to WWC, particularly while the state Commission for Water Resource Management was still awaiting a ruling on a long contested hearing over that very resource, to determine appropriate instream flows to support stream biota, and appurtenant rights for farming. Apparently, those surface waters being withdrawn by WWC are also coveted as new source for domestic water supply. Alexander & Baldwin, Inc. (A&B) is the parent corporation to Hawaiian Commercial and Sugar (HC&S), currently the largest user of surface waters from Waikapu, `Iao, Waiehu and Waihe`e valleys. But A&B’s retail, commercial and residential property ventures net them far more profits than their agricultural sector, with 36,000 acres planted in sugar cane. Last month. A&B issued an Environmental Impact Statement (EIS) Preparation Notice for a proposal to use those same contested surface waters for a nine million gallons per day Water Treatment Facility (WTF). Though it is not stated in their prep notice, A&B stands to reap half of the treated water from the facility to be built on their Waiale Road property, with the County utilizing the rest, if the collaborative proposal announced by Mayor Tavares is approved. The proposed WTF will likely be considered part of a long-delayed Water Use and Development Plan for Maui County, a required update that has languished for years while development

MAUI TIME WEEKLY

has continued to strain available water resources. In the interim, the County Council attempted to tighten the reins on unrestricted development by passing the so-called “Show Me the Water” bill last December. This new law was addressed in the EIS prep notice, which states, “Current source availability is limited, as evidenced by the recent adoption of Ordinance 3502 relating to Water Availability which requires verification of a long-term reliable supply of water before subdivision approval can be granted.” The document also contains a letter from Yvonne Izu, Deputy Director to the State Commission for Water Resource Management CWRM). It concludes with a caveat over the proposed usage: “We have no objections to the proposed usage of treated surface water as a source for domestic water supply. However, the source of this water is Waihee Stream, and diversions therefrom are subject to a pending petition to restore stream flow….Accordingly, the Applicant and the County of Maui, Department of Water Supply, should be advised that long-term reliance upon water from Waihee Stream as a source for the surface water treatment facility shall be subject to the resolution of these pending actions and the determination of Instream Flow Standards.”

LC Watch The nipple effect Any time you find yourself seated in front of a glowering panel of public officials trying to explain the subtleties of a buttery nipple, it’s safe to say you’re not having a very good day. The details: In February, a woman and her friends were served drinks—including a round of the aforementioned, anatomically dubbed liqueur-based shots—at the Sports Page Bar & Grill in Kihei. The woman then left the bar and was immediately busted for DUI. Flash forward a few months and Barry Tippett, proprietor of the Sports Page, is facing the LC Adjudication Board on charges of serving an already intoxicated individual. In addition to doing an admirable job of not giggling when describing what goes into the buttery nipple, Mr. Tippett, who pleaded no contest, raised an excellent question: How do you know when enough becomes too much, especially when someone’s been drinking before they enter your place? Obviously it’s part of a bartender’s job to make that judgment, and certainly there are cut-and-dried cases where everybody in the room can see that the guy with his eyes halfclosed peeing in the potted plant muttering about his ex probably shouldn’t be given another Heineken. But what about when it’s not so clear? Some people get quiet and reserved when they’re drunk; others are raging alcoholics whose bloodalcohol level can be off the charts while they’re still carrying on a normal conversation about the weather. This doesn’t absolve establishments of the responsibility to avoid over-serving. But it should lead to a whole lot of questions, which didn’t seem to be asked in the Case of One Nipple Too Many. Such as: What, how much and where did the woman drink before entering the Sports Page? This lady likely dipped her beak at multiple bars, but only the last place she stopped for a buttery nightcap caught any heat. And heat they caught, in the form of a $2,000 fine. —Jacob Shafer

ehbrah@mauitime.com To the jerk who smashed my buddy’s face against his surfboard today in the lineup: How do you find it justified to rage on my friend, who did nothing but paddle out into an uncrowded lineup on a small day and hadn’t even attempted surfing a wave yet? As we paddled in, he with a bloody nose and me in total shock, I was reminded of one of life’s most apparent lessons: Life just isn’t fair. My buddy is the type of guy who gets along with everyone and respects the beauty of this island and culture more than anyone I know. His passion for sailing, hiking, surfing, and having the ocean for a playground is contagious and unmatched. If there’s one person, who never takes a single day of living on Maui for granted, it’s him. I think it’s unfortunate that people, especially kids, are looking up to you for winning some local competitions. Hopefully, they just admire your surfing and not who you are as a person. Maybe you could learn a lesson or two from my friend, a person of integrity. I hope your bad karma catches up soon!

COCONUT WIRELESS THE WEEK IN REVIEW

WEDNESDAY, JULY 23

THURSDAY, JULY 24 In a blow to pregnant New Age spiritualists, expecting conceptual artists and knocked up acid heads everywhere, a family court judge in New Zealand has decided to take a stand against parents who saddle their progeny with “creative” (read: wildly inappropriate) names. As reported in the Associated Press, Judge Rob Murfitt ordered that a 9year-old girl from Hawaii named Talula Does The Hula (yes, you read that right) be made a ward of the court so that she could be given a more conservative moniker. The new name of the girl, who was caught up in a custody fight, was not released to protect her privacy. “The court is profoundly concerned about the very poor judgment which this child’s parents have shown in choosing this name,” the judge wrote. “It makes a fool of the child and sets her up with a

social disability and handicap, unnecessarily.” True enough, but this has got to be the mother of all slippery slopes. Deciding what constitutes a name given with “poor judgment” is like trying to define pornography—which, coincidentally enough, is what I’m planning to name my unborn daughter. Pornography Shafer…has a nice ring, doesn’t it?

FRIDAY, JULY 25 The pictures of Barack Obama speaking before a sea of people in Berlin during his recent Let me Prove How Presidential I Am overseas tour were pretty aweinspiring, no matter how much McCain and the American right may try to dismiss the whole thing as a trumped-up publicity stunt. Sorry, no. Standing on the deck of an aircraft carrier in a flight suit and comically robust codpiece backed by carefully posed troops and an unfortunately labeled banner—that’s a publicity stunt. Getting 200,000 Germans to show up to your speech and not having one of them toss an egg at you? That’s impressive, and not something even the savviest PR team could manufacture. Whether Obama is the solution to all the world’s problems is a separate question (hint: he’s not). But it’s pretty clear his election would go a long way toward repairing our tattered image in the international community. And that’d be a start.

SATURDAY, JULY 26 We get into the Maui Land & Pineapple layoffs in our new segment The Business End, but it’s just too big of a story to not mention it here, too. Whatever your take on the economic logistics of the situation, any time hundreds of people lose their jobs in one fell swoop, it’s a dark, dark day. And at the risk of being labeled a raving Marxist, it has to be said: When the going gets tough, it’s always the workers on or near the bottom that are hit the hardest, while the CEOs say somber, regretful things and then go cash their big fat paychecks. It’s just business, some will tell you. But for those now dangling over the yawning chasm of unemployment, it’s also very personal.

Photo: Kai

With the deadline to file for the upcoming election having come and gone, the races (and non-races) are now set. We don’t have the space here to dissect and break down all the intrigue but rest assured, we’ve got you covered. In the coming weeks we’ll start running a semi-regular spread featuring brief bios of the candidates and more in-depth looks at some of the issues and match-ups that matter most, at both the county and state levels. And we’ll have plenty of election related fun in this space, injecting the enterprise with the all the requisite snarkiness. Stay tuned.

Next stop: Saving blind puppies in Denmark.

just since February. The bottom line is that fuel efficiency is now more than merely a good idea espoused by tree huggers and Al Gore; it’s a downright economic necessity. And while that’s bad news short term for our wallets, it’s good news long term for the health and stability of the planet. Now excuse me while I take out a second mortgage on my imaginary house to fill my tank with regular.

SUNDAY, JULY 27 Look, rising gas prices suck for everyone but Dick Cheney and his oil company cronies. Nobody’s pretending otherwise. But they can also have a decidedly silver lining—forcing people to make green-tinted lifestyle alterations. Case in point: The Maui News reports that various county departments are turning to conservation methods including checking tire pressure and cutting down on unnecessary driving in an effort to stay within their $4.4 million fuel budget. That figure represents a 15 percent bump over 2007, but gas prices have climbed more than twice that much

MONDAY, JULY 28 Speaking of fuel conservation, there’s no better method than taking cars off the road. And the most effective way to do that (other than getting rid of a bunch of people, which is an idea for another time) is to follow the lead of our friends in Europe and get the public transportation ball rolling in a big way. It looks like, at least theoretically, the political will is there. A survey commissioned in part by The Honolulu Advertiser shows that some 60 percent of Oahu residents would support a rail line if the matter were put

to a vote. That’s a promising figure, though I’m reminded of a fake-but-sadlyreal headline run by The Onion (which I realize I’m quoting for the second straight week, but those guys are pretty damn insightful): ’98 percent of U.S. Commuters Favor Public Transportation for Others.’

TUESDAY, JULY 29 Sharks have no gratitude. After last week’s cover story about how we’re a greater threat to them than they are to us, what happens? How do the sharks of the world repay us? By biting Ryan Seacrest, that’s how. According to Fox News (They Report on Ryan Seacrest Related Incidents, You Decide), the American Idol host and professional sycophant was swimming off shore at a resort in Mexico when a sand shark nibbled on his toe. Not exactly Jaws, but Seacrest did divulge on his radio show that he “needed to take an Advil.” Wait…why are we telling you this again? MTW

DOMESTIC DISPUTE Police, including SWAT officers, were called to an apartment in Mesa, Ariz., in June after neighbors reported a fight between a man and woman that included yelling and breaking things inside. When they arrived, they found only a 21-year-old man, conducting the fight by himself, alternating a highpitched voice with a low-pitched one. He was referred for a medical exam.

QUESTIONABLE JUDGMENTS In March, a jury acquitted the former parking manager for Fresno, Calif., Bob Madewell, of all misuse-of-funds charges, including one count for reducing the minor league baseball Grizzlies’ parking fees in exchange for tickets for his brother and himself, and another count in which he paid a female worker $300 in city funds to let him touch her breasts. Juror Trish Riederer, in an interview with the Fresno Bee, said she and her fellow jurors believe that Madewell did everything that prosecutors say he did but that the city did not have clear procedures in place about Madewell’s scope of authority.

SIZE MATTERS Ronald McDade, charged with raping a teenager in Lansdale, Pa., in January, petitioned to be allowed to submit a plaster cast of his penis to the jury, to demonstrate that, since he is an “extremely large” man (according to his lawyer), he could not physically have penetrated the girl without causing genital injury (and no such injury was found). News of the Weird has reported previously on rape defendants offering to give the jury either a photograph, or a live exhibition, to make the same point. MTW

Artist Michael Fernandes’ exhibit in Halifax, Nova Scotia, in June caused a commotion because it was merely a banana on a gallery’s windowsill, and Fernandes had it priced at $2,500 Canadian (down from his original thought, $15,000). Actually, Fernandes changed bananas every day (eating the old one), placing progressively greener ones out to demonstrate the banana’s transitory nature. “We (humans) are also temporal, but we live as if we are not,” he wrote. Despite the steep price, two collectors placed holds on the “work,” requiring the gallery’s coowner, Victoria Page, to get assurance from callers. “It’s a banana; you understand that it’s a banana?”

The European Union allows fruits and vegetables to be sold only in prescribed sizes and colors (such as its 35 pages of regulations governing 250 varieties of the apple, or rules that cucumbers must be straight and bananas curved). In June, British marketer Tim Down complained that he was forced to discard 5,000 kiwi fruit because they were 1 millimeter in diameter too small and one-fourth of an ounce too light. (It is illegal even to give them away, as that would undermine the market price.) “Improvements” in the EU system continue, according to a July Washington Post dispatch from Brussels: Despite 10 pages of standards on the onion and 19 amendments, the Dutch Ministry of Agriculture recently issued a report urging further refinements, using 29 pages and 43 photographs.

ROBREPORT AG-GRAVATING: continued from page 6 lso apparently vying for water from the same source is Patricia Bragg and the Living Waters Land Foundation, owners of a 553-acre parcel in Waiehu, purchased from Wailuku Agribusiness for $1.1 million in 2002. Bragg’s attorney, Brian Jenkins, sent a letter to Maui Time Weekly in response to the Nov. 22, 2007 Rob Report column, “Ag Lands and the ‘M’ Word.” In the letter, published in the Feb. 21 edition of MTW, Jenkins insisted that the reason they asked the County of Maui to formally recognize 25 historic lots on the large parcel was because, “it was essential to ensure that the appurtenant water rights that were part of the title to some of these lots were reserved.” Jenkins went on to state, “Ms. Bragg expressly purchased these lands to preserve and protect them from the type of development that has been the fate of other lands formally owned by Wailuku Agribusiness Co., Inc., and to continue farming on the lands.” To that end, Bragg is leasing about 20 of her 553 acres in Waiehu to a dozen or so farmers, according to Anthony Pignataro’s Feb. 28 cover story, “In the Name of the Father.” The irrigation water for the twenty acres being farmed was secured through an agreement between Living Waters and Wailuku Water Company. That in itself is curious considering that Living Waters has been a petitioner with standing in the Na Wai Eha contested case hearing against Wailuku Water Company. Subsequent to the county’s determination of the 25 historic lots that had been consolidated in one tax map key by Wailuku Sugar, Jenkins has filed for a consolidation and re-subdivision of eight lots. In a preliminary subdivision application submitted earlier this month by Jenkins, and signed by Bragg, there is indication that the subdivision would use a private water system. The application calls for a “Statement of source, quality, and quantity of water.” However, an attached, unsigned sheet on the letterhead of Newcomer-Lee Land Surveyors, Inc., mentions both the irrigation water from WWC and a private water well, “that could be used for domestic and irrigation purposes, should it become necessary.” It further states that they believe a statement of source, quality and

A

BY ROB PARSONS ROBPARSONS@EARTHLINK.NET

quantity would be required concurrent with building permit applications on the new lots. While stating that no drainage or flood control improvements are planned or anticipated, nor any other improvements by the subdivider, their application also admits that sewage disposal would be dealt with, “by individual wastewater systems to be approved by the Dept. of Health at the time of development.” (Emphasis added.) So, it raises questions as to whether there is an effort to submit subdivision permit requirements in a piecemeal fashion, where preliminary approvals may be attained without divulging full impacts of the possible development of subdivided parcels on water and other resources. One might also question whether the

recognition of the historic lots on the parcel had more to do with appurtenant water rights, or future subdivision. t remains to be seen if the Department of Public Works will require accurate water data at this time, abiding with the intent of the “Show Me the Water” ordinance. In the case of Daneford Wright’s allegations of the developer’s and county’s failure to fulfill fiduciary and contractual responsibilities for Wailuku Country Estates, Council members pledged to bring the matter before the Publics Works and Facilities Committee. Said Wright in his transmittal to Council members, “It is with respect that I give the County of Maui a chance to right the wrong and make it pono.”

I

Committee co-chairs Mike Victorino and Bill Medeiros may or may not wish to bring the matter up in the months before the election, but the community needs to hear more about what really happened, in order to rectify the matter and see that similar situations don’t occur. At present, it seems there are a number of loopholes big enough to allow a bulldozer to drive through. With a groundswell of voices calling to augment our island food supply with homegrown crops, we need to do everything we can to safeguard our water resources and enhance existing provisions for those truly wishing to farm ag lands. awaii’s role in the transformation of surfing from what many considered to be a pastime for drug-crazed counter-culture rebels to a multi-billion dollar sport is examined in debut director Jeremy Gosch’s documentary about the group of Australian and South African surfers that “broke down the door” for pro surfing to take hold. At the same time, the film reveals a clash of cultures and values that goes beyond the Hawaiian sport of kings and its various Western incarnations and speaks to issues dating back to the early days of foreign occupation in Hawaii. Actor Ed Norton narrates the storyline, which traces competitive surfing from the 1965 inception of the Duke Kahanamoku Invitational Surfing Classic that invited a crew of audacious surfers who, in the winter of 1975, would showcase a previously unseen approach to surfing. Their daredevil efforts would be the harbinger that announced surfing as an athletic event befitting several industries worth of monetary support. Shaun and Michael Tomson came to Oahu’s North Shore from Durban, South Africa, at the same time that Australian Gold Coast natives Mark Richards, Wayne “Rabbit” Bartholomew, Peter Townend, and Ian Carins arrived at Sunset Beach to hone their skills in the months leading up to the 1975 Kahanamoku Invitational. Born in the ‘50s, the crew shared idealist and reactive personality types set on throwing their lives on the sword of Pipeline in a do-or-die stab at fame and fortune. Unknown to the established surf world, Rabbit and Shaun especially carried the weight of troubled family backgrounds that contributed to their risk-taking approach in developing tech-

niques that amazed anyone who saw them. Although local Maui surfing icon and instructor Buzzy Kerbox refutes the film’s claims that his former competitors created any new moves at Sunset, Off the Wall or Pipeline there is a distinctly expressive way that Rabbit, Mark Richards and the Tomsons surfed that is mesmerizing to this day. When I spoke to Buzz by telephone, thanks to an assist from Maui Time friend Barry Rivers, he was quick to uphold the lasting effect that his Australian surfing friends and rivals had on the surfing industry as it contributes to Maui’s economy. The former 6th placed world championship surfer, Buzz said he enjoys windsurfing these days, but a visit to YouTube will give an idea of his tremendous affection and respect for surfing Peah’i. ustin’ Down the Door uses a number of exciting surfing sequences from famous ‘70s surf films Free Ride and Tubular Swells that feature the Aussie crew in action, to contextualize the energy and brilliant techniques the young men were showing off at the time. There are priceless examples that serve as a veritable instructional clinic. In the same way that Skateboarder magazine would later help elevate skateboarding to the status of an accepted sport, Surfing and Surfer magazines helped push their sport of choice ahead with exciting photos

and profile pieces that captured the imagination of millions of fans and would-be surfers. The magazines presented a readymade media vehicle that the self-titled “Bronzed Aussies” immediately identified and mastered in the same way that rock stars of the day promoted themselves with an outlaw swagger. Giving print, television and press conference interviews became a chance for the athletes to put forth a philosophy and vision that was at once fresh and ambitious. Marketing became the means that the young underpaid surf masters predicted would pay off in big dividends sooner rather than later. Dubbed the Three Marketeers, Ian Cairns, Peter Townend and Mark Warren pushed their advertising savvy to get international press. Dressed in matching jumpsuits or sweat jackets the trio represented surfing’s first commercial ambassadors, and de facto surf team. It was a ploy that was looked down on by surfing purists, but also a stroke of genius that would help usher in an industryendorsed appeal previously lacking in the sport. Although the movie doesn’t mention it, Rabbit was deemed inappropriate to be in the Bronzed Aussie club, and his exclusion may have contributed to his writing of a balls-out article that nearly ended his surfing career, as well as that of his mates, but not without some help.

The Bronzed Aussies’ marketing strategy could have passed as selfsatire were it not at odds with the brutal candidness of Ian Cairns in a magazine interview where he boasted about his group’s success against Hawaiian surfers as coming, “because we seem to be able to push ourselves harder than the Hawaiians do. Our surfing, as a group, has improved outrageously; whereas theirs, as a group, has stagnated.” Cairns’ opinion might have held a grain of truth, but it was also indicative of the grandstanding that was pressing surfing to a critical mass of cultural influence, for better and for worse. At the height of surfing’s newfound popularity Wayne “Rabbit” Bartholomew (AKA “Bugs”) was given the moniker “Muhammad Bugs” by a certain magazine that photographed him wearing an Everlast boxing robe. Inspired perhaps too much from Muhammad Ali’s pervasive influence at the time, Rabbit took the identification to heart when he was asked by Surfer magazine to write an article on what it was like to break through in surfing. Rabbit took advantage of the editorial opportunity to shoot from the hip and compare himself to Ali in the same way that he and his peers had boasted about being “number one.” Irony would come later when Rabbit would win the title of surfing’s World Champ in 1978. But before then, Rabbit’s cover feature article for Surfer, titled “Bustin’ Down the Door!”, allowed the articulate young surfer to wax philosophical about the “material world” and expound the Zen aspects of his vigorous

art. The article’s lead line explained that, “When you are a young emerging rookie from Australia or Africa, you not only have to come through the backdoor to get invitations to the pro meets, but you have to bust down the door, before they hear ya knockin’.” From a rock ‘n’ roll marketing perspective, it was an honest piece full of bravado and repeatable quotes. But it also served to reopen the wounds of occupation and colonization that Hawaii had suffered at the hands of the U.S military less than a hundred years before. n 1893 the United States military arrested Queen Liliuokalani and jailed her inside her palace under her fierce yet restrained protest, which she eloquently expressed in a note to the Hawaiian people that ended with “Aloha, aloha, aloha.” In effect, the Queen tramped down the effect of the malicious takeover with an elegant message of hope that rose above the atrocity being committed against her and her people. It was a history lesson the brash young Aussie surf crew would have done well to learn, one that might have spared them the steady stream of violent attacks and threats that would force them into an uncomfortable exile in Kuilima. It wasn’t until lifeguard and surfer Eddie Aikau came

I

forward to act as a peacemaker, calling a ho’oponopono, that tensions would be relieved at more than a cost of bruised egos. The story of the cultural zeitgeist that enabled surfing to break open the floodgates of commercial viability came at a huge personal cost to the men who dared to think outside the box and act on a stage whose size was unfathomable to most. It also marks a bittersweet transition that cannot be reduced to world title trophies or corporate revenue streams. When I asked him, Buzzy Kerbox wouldn’t comment on the rift between the Aussies and their rivals that was settled in a conference room at the Kuilima Hotel under the guidance and goodwill of Eddie Aikau. I understood why. I also understand that it marks a significant moment in surfing and in modern Hawaiian history that is worth discussing. Surfing is important. It’s also important how we relate to one another and how we act when we’re not surfing, or performing whatever act of routine passion we commit as a vocation or pastime. In the end, as a film and a cultural metaphor, is Bustin’ Down The Door as entertaining as recent surf docs like Riding Giants or Step Into Liquid? Yes, and I’d say it’s a little bit more than that. Whisked to New Mexico Santa Fe Cantina offers a transporting taste of the Southwest rom the moment you step into Santa Fe Cantina in Lahaina, you begin to forget you’re in Hawaii. That may sound like not such a good thing to those of us who love living on this island paradise, but hear me out: You’re not so much transported away from Maui as you are taken to somewhere else. That somewhere else is the American Southwest, a singular land of adobe buildings, big sweeping skies, strikingly gorgeous red rock formations—and some seriously delicious cuisine. The eats at Santa Fe are mostly reminiscent of what you and I would call “Mexican food,” but the dishes actually

F

bring together a desultory array of styles and influences. “New Mexican food

incorporates Mexican, Native American and Anglo ingredients,” the back page of

Santa Fe’s menu informs you. And, indeed, you’ll notice a subtle but marked difference between the fare at Santa Fe and more traditional Mexican restaurants. The pork al pastor tacos are an excellent example. Wrapped in a soft corn tortilla and garnished with onion, cilantro and lime, the tacos are made truly special by their filling. A delicate, mouthwatering combination of marinated red chile (different in spelling and style from the Tex-Mex “chili”), pineapple and slow-roasted pork, the concoction is a perfect balance of sweet and savory, with just a touch of spice. That same balance is struck in the

grilled steak chimichanga, though here the culinary scales are tipped slightly more on the spicy side. Wrapped in a crisp fried tortilla and augmented by lettuce, tomato, beans and Spanish rice, the steak has a wonderfully distinct taste and texture. But what really unifies the dish is what it’s smothered in: a red, green or mixed “Christmas” (which I opted for) chile sauce that’s got enough of a kick to bring water to the backs of your eyes but that doesn’t overwhelm the other flavors. If your palate needs cooling, there are a number of intriguing libations available, including the Maui Margarita, a mix of tequila, lime and triplesec, plus mango

Places to go fresh off the plane ISLAND TACO After five hours aboard a stuffy 767 and a couple more spent rounding up my rental car and dropping my suitcase at my new Wailuku digs, I was ready for a quick-yet-hearty meal. And I found one at this wonderful little taco stand. Their menu is simple— tacos filled with fish, pork, chicken, beef and other fixins and hot dogs—but you can’t go wrong; everything is tasty and cooked up fast. Plus, they’ve got comfortable shady seating and it’s easy on your wallet, which is a good thing whether you’ve been here 45 minutes or 45 years. N. Market St., Wailuku.

I admit I’m being a bit Wailuku-centric here (we’ll expand our focus in a moment, I promise) but that’s where I wound up when I first hit the island, and so that’s where I ate. My first priorities were things that, as I said, were easy, fast and relatively inexpensive but that tasted good and filled me up. And while a gas station may not be the first place that comes to mind when you mull those criteria over, their food is actually quite good. They’ve got a variety of hot items to choose from, plus a cold case featuring a very decent turkey wrap, sushi, salads and pre-made sandwiches. Plus, there’s a nice big fridge full of beer, which can be a great panacea for the time change blues. 2085 Main St., Wailuku, 244-0869.

DA KITCHEN We’ve left Wailuku, but we’ve taken our desire for big satisfying portions that don’t break the bank with us. And on both counts, Da Kitchen serves it up. My wife ordered the regular chicken katsu plate for herself and the child portion for our 1year-old son. What arrived was enough delicious breaded chicken strips to feed a small army. That meal alone got us through to lunch and a snack the next day. But more importantly it was good, just like everything else on the menu. 2439 S Kihei Rd #107A, Kihei, 875-7782; 425 Koloa St. #104, Kahului, 871-7782.

MILAGROS After hitting Baldwin Beach to establish a little base tan, we headed into Paia in search of some grub. It’s a town chock full of fine eating establishment, as Maui Time’s Best Of winners list will attest. We were drawn to Milagros because of the covered outdoor seating area and the promise of pancakes. The shade was nice; the pancakes were even nicer. Big, fluffy, stuffed with bananas and macadamia nuts, slathered in maple syrup—the mere memory has my stomach rumbling. We also ordered a delicious breakfast burrito, providing the savory offset to our shared sweet dish. Yum. 3 Baldwin Ave., Paia, 579-8755.

[MUSIC] The Katchafire groove caught me pretty much right off the plane when I got to Maui. They played a show on the lawn at the MACC that was my first official reggae “thing” here on the island. Of course, there have since been many of those (a girl can’t throw a rock without hitting a reggae show around here) but, like a first lover, Katchafire has a special place in my heart. What I remember most about that show, besides the incredibly laid-back roots sound, was the reggae-induced, swaying, singalong trance that the whole audience seemed to be captured in. Katchafire weaves their musical web with slow, dreamy rhythms and irresistible, horn-drenched grooves. This weekend they’ll be jammin’ with Rebel Souljahz, Dani Girl and Ten Feet. [Block Party] Yes, I realize that we plug the First Friday celebrations almost every, well, first Friday of the month, but these guys on the Wailuku Community Association keep coming up with more and better ideas and themes that make us want to stroll down Main Street, linger on Market and dance the night away on Vineyard. This month’s going to be a retro throwback to the ‘60s with a classic car show, groovy music by Soundwave, a costume contest, ‘60s inspired art and—I actually double checked this—a fuzziest sideburns contest. There will also be on-site painting by celebrity artist Jay April of Akaku: Maui Community Television and performances by Team MauiSLAM, Sing Sing Laugh Laugh, Uncle Dirty and Musk Buddies. Don’t miss a chance to revisit the ‘60s, Wailuku style. 249-9710 for more info. [JA]

[BOOK RELEASE] The much anticipated fourth and final book in the Twilight series by Stephenie Meyer is being released with a serious bang. I hadn’t heard of the books before this one, but apparently the author’s got quite a cult following of young adults frothing at the mouth to get their hands on her vampire-based romance/drama novels. Here’s a very basic outline of the series’ plot: Bella falls in love with the “vegetarian” vampire, Edward, but he runs away for fear that she’ll get hurt. Then she makes friends with Jacob, a kind-hearted werewolf and the love triangle unfolds. Fans of the series (or curious bystanders) are invited to hit up Barnes and Noble to get a midnight copy of the new book as soon as it’s released. To make the waiting fun, there will be an introduction to astrology (at 7pm by Clorinda Vasu Kramer), vampire trivia and giveaways. Oh, and I can’t forget about the prom theme. If you’ve got a sense of humor dig that tux or fluffy dress out of the closet and dust it off to get a “prom photo” taken. 622-1300 for more info. [JA]

FILMCRITIQUE

BY COLE SMITHEY COLE@MAUITIME.COM

All ‘X’d out Belief isn’t what it’s cracked up to be his borderline sci-fi soap opera could have benefited from a more visionary treatment from a director like David Lynch or William Friedkin instead of from the film’s writer/producer/director Chris Carter. Carter’s rote script requires Gillian Anderson and David Duchovny to call each other Scully and Mulder so many times that you’ll wish the writer had paid attention to screenwriting laws laid down by John Cassavetes or David Mamet. A missing female FBI agent is cause

for the government organization to call in former agents Fox Mulder (Duchovny) and Dana Scully (Anderson) to help solve the case with the dubious aid of Father Joseph (Billy Connolly), a psychic former pedophile priest in search of redemption.

The X-Files: I Want to Believe

★★★★★ Rated PG-13, 104 min.

Severed body parts buried in snowy parts of Virginia and West Virginia give clues to a black-market organ transplant operation responsible for the serial killings of many people. For all of the fan hullabaloo around its plotline, The X-Files: I Want to Believe is little more than an extended if atmospheric version of the former televi-

sion show. One particular false-bottom death scene after a routine chase sequence corrupts any suspension of disbelief. Nevertheless, there is some pleasure to be had in seeing Duchovny and Anderson reprise their best-loved roles, even if shrill performances from Amanda Peet and Xzibit drag down the movie. Where the first X-Files movie (1998) catered so exclusively to fans of the TV show that it alienated moviegoers unfamiliar with the series, the sequel plods through every plot point as if it were an early birth. As the constant repetition of the names “Scully” and “Mulder” indicate, it is a movie so in love with itself that it challenges the audience to abstain from being lulled into a mystery that Sherlock Holmes would have had a lot more fun solving. After Scully encourages Mulder to

join her sleuthing efforts with the FBI, she almost immediately does an about face, ostensibly because she is so repulsed by the idea that their chief psychic took advantage of 37 altar boys. In traditional cinema parlance, you could make some deductions about the filmmakers’ attempt at making an ethical, if not moral, statement through such a break in character but here the theme lines remain little more than tawdry dashes of exploitation elements. Chris Carter’s overuse of the film’s snowy atmosphere to send chills of desolate isolation down the spines of its audience never takes hold because his actors never acknowledge the harsh conditions. Where the characters in the Coen Brothers’ Fargo interacted with the snow as an integral part of their motivation, Mulder and Scully ignore the frosty conditions as if they were on a two-day vacation from San Diego. Mulder walks around with his coat unbuttoned, never wears a hat or gloves, and his demeanor is too smarmy to make you believe that much is going on in his jaded brain other than a distant memory of what he ate for breakfast. He’s glib to a fault, and Mulder’s trademark sarcasm only goes so far in buoying the melodrama around him. The irony is that in the film’s one blinkand-you-miss-it-moment of pure narrative abstraction when a character dies, it briefly snaps up all expectation and achieves a drop of terror that gets negated in the very next scene. The X-Files: I Want to Believe doesn’t know what to believe— and neither will its audience. MTW

Need for speed Finding your soul mate in four minutes or less h man, this is a little awkward. The guy sitting across from me is definitely my friend’s dad. He doesn’t know who I am, but I know who he is. If I stop smiling and nodding, I’m pretty sure I’ll start freaking out. This was my formal introduction to speed dating on Tuesdays at Wow-Wee Maui Kava Bar and Grill. Don’t worry, things get better.

Why am I speed dating in the first place? It’s not that I don’t enjoy being single. It’s just sometimes, late at night while I’m laying alone in the dark, I wish someone had caught all the vague pop culture references I made that day. This, coupled with curiosity, is what had me seeking out speed dating. The speed dating process is simple: First, you register at the front desk.

time is running out. What he doesn’t tell you is that in that last minute you’ll be doing more grappling than a wrestler. Depending on your partner, this minute can extend to eternity, or be over in a second. If you’re female, get comfortable. In an act of modern day chivalry, it’s the men who go from table to table, sort of like a bee going from flower to flower. Speaking of flowers, the women were presented with complimentary orange roses as well as gift bags containing some dating essentials: dark chocolate and condoms. A waitress routinely checks on each table to see if you want another dating essential. While speed dating, you write down and circle the numbers of the people you clicked with. When the dates end (there are usually enough people to have eight dates), you give back the form to the front desk. They’ll be the ones to discern if you’re a match for anyone. If you are, Maui Wowee will contact you by email, then later by phone. Some people like to make a big show of writing down your number and circling it, others…not so much. The good news is, after the awkward moment with my friend’s dad things started looking up. I enjoyed the experience, even though I didn’t find my soul mate. Hey, there’s always next Tuesday. Hopefully I’ll see you there. MTW

Summer reading Sex, Drugs, and Cocoa Puffs: A Low Culture Manifesto By Chuck Klosterman Apparently, only pretentious English majors and high school students read classics during the summer months. Well, since the average Maui Time reader is already educated and worldly, Sex, Drugs, and Cocoa Puffs: A Low Culture Manifesto should help take care of that. The book is a collection of essays by Gen X jokester Chuck Klosterman, who expresses his observations on pop culture with sarcastic wit. Want to know how Saved by the Bell relates to your daily life or how the failings of the American Dream are illustrated by the Pam/Tommy sex tape? Read this book. Sex, Drugs, etc. would be among one of my favorites if only it weren’t for that irritating, Oxford, comma, in, the, title.

You think you have a dysfunctional family? Try being given away by your mother to her crazy psychiatrist and his equally bizarre family. At the Finch house, the Christmas tree is up year ‘round, divine messages are sent via toilet bowl readings (these lucky omens are then scooped out of the toilet and left in the sun to dry) and it’s OK for a 13-year-old boy to have a boyfriend more than twice his age. Maslow must be doing cartwheels in his grave. This is one of those books you read during those boring summer days while waiting for something to happen. Sure, maybe Augusten’s formative years were more exciting than yours, but in this instance, that’s a good thing. I mean, college is hard enough to pay for—but to have therapy alongside it?

Catch-22 By Joseph Heller All right, maybe you’ve seen this book floating around on the assigned summer reading for the high schools. In fact, I was assigned this book in high school. But, if you haven’t read Catch-22, you should. I’m not going to bore you by talking about themes, allusion and analogies, though. Catch-22 is awesome because it is a shining beacon of satire that questions bureaucracy and integrity in such an absurd and playful manner. Furthermore, while it was written a while ago, it’s still as pertinent as ever. That, and well, any book with murderous hookers is a worthwhile read. Don’t let Catch-22’s thickness scare you away; if anything, think of it as a potential pillow as you’re kicking back and soaking up the sun.

LEO (JULY 23-AUG. 22) Although you have your introspective moments, you’re mostly a social creature, luckily. Everyone wants a piece of you this week, and by all means you should try to give it to them. Visit with everyone. Cram your schedule with pleasurable social activities and try to dole out quality time liberally. It’s nice to be so popular and loved, but things will only stay that way if you take the time to give the love and attention back to those who’d lavish it upon you. Vow to give better than you get and you won’t go wrong.

VIRGO (AUG. 23-SEPT. 22) You hate being a hardass. You avoid having to tell the harsh truth to people or make difficult, unpleasant decisions. This is one of the reasons you’re happy to leave someone else in charge and just do all the labor to make their ventures successful. Sometimes, however, you’re stuck doing this kind of dirty work, too, and must let someone know they’re being cut because of poor performance. “Why me?” you may wail, but you already know. It’s because you’re simultaneously kind and effective. You’ll get the job done, but in a much more compassionate way than anyone else would. You can’t shirk dishing out the “killing blow,” but at least you can make it as swift and painless as possible.

LIBRA (SEPT. 23-OCT. 22)

Remove Your Frown Lines! before

after

Sometimes you may have to lie to get what you want. This isn’t one of them, though. In fact, any lie you tell right now is a million times more likely to backfire and ultimately drag you further from your dreams and goals. Unfailingly tell the unvarnished truth, even if it isn’t what you think people want to hear. You might be surprised. Even if you can’t bring yourself to spill the entire honest story, at least don’t embellish it with fabrications. Just stick to frank disclosure when you can, and simply shut up when you can’t.

Although you have no problem being brutally honest with people when you must, you often find it expedient to mislead or misinform them instead, or at least let them carry on with their delusions. While bursting someone’s bubble can feel like an incredibly callous and cruel thing to do, sometimes you’re doing them a kindness—albeit one they’ll probably never thank you for. This kind of cruel compassion is actually one of your strengths. Exercise it this week. You won’t experience any gratitude for your efforts, but if you can steer people to paths more suitable for them (or harden their resolve so they might actually succeed at the goal they’re pursuing), that should be its own reward.

SAGITTARIUS (NOV. 22-DEC. 21) Be picky. Spread before you is a magnificent buffet. However, if you try to take a little bit of everything, you’ll be stuffed before you’ve sampled half of it. You need to recognize the limitations you’re stuck with and pick and choose which things you’ll pick up to taste, and which you’ll have to regretfully pass by. Sure, you might accidentally miss out on something that looks horrible but tastes great, but that’s always a risk. Being choosy now will make you more likely to discover the flavors your soul is craving than being gluttonous ever could.

CAPRICORN (DEC. 22-JAN. 19) Screw the office. Wherever you usually work is doing more to stifle you than make you productive. Do what you can to get out of that place this week. Luckily, if you’re creative and resourceful enough, you should be able to find a way to go someplace new, and probably get paid while you’re there. Now that you know this is probably an option, I can’t imagine why you wouldn’t pursue it. This is a win-win. You get a change of pace, and will consequently produce more and better work. All you have to do to make it happen is to convince someone else that that’s true.

AQUARIUS (JAN. 20-FEB. 18) Just when you thought it was all over, one last chance rises from the ashes, phoenix-like. Ride it. You may be able to get the job, the lover, or the opportunity after all, just as you’d given up on it. It’s a slim possibility, but that’s more than you had yesterday. All you have to do is be ready to leap on it when it appears. Don’t give up yet! You still may have to let this dream go, but save that for next week. For now, get ready to grab at this thin thread of hope. It might be strong enough to climb all the way to the top. How cool would that be if you did?

PISCES (FEB. 19-MARCH 20)

– – “Na– ‘Oiwi ‘Olino – People Seeking Wisdom” 6:30a.m. – 9a.m. weekday mornings on

Relax! Why are you getting so tense about this? Oh, I get it. You have the feeling that you can actually control the outcome here, so you’re straining and stressing to have it go the way you want it to. I should be able to relieve you of that burden. Like so many other things, this, too, is out of your hands. That apparent influence and control you have is actually an illusion. There, isn’t that a relief? Be ready to do your best; beyond that you can just let it go. Now, go chill out.

ARIES (MARCH 21-APRIL 19) You’re probably foaming at the mouth for some of the big changes you see coming down the pike. It may feel like it’s taking forever for your new chapter to kick in, but it’ll be here before you know it. For now, instead of building up the new stuff inside your head, try to enjoy the old stuff while it’s still around. Even though you think you’re sick of it now, you’ll actually miss it once it’s gone forever. Since you know without a doubt that the next chapter will be kicking in soon, can you just slow down and savor the last few paragraphs of this one?

MAUI TIME WEEKLY

Who do you trust to be fair and compassionate, but willing to cut through the bullshit and tell you how it is? You desperately need someone like this in your life right now. Chances are, they won’t just step forward on their own and tell you what you need to hear. They need to be sincerely invited and encouraged to do so. Once you do that, you truly need to be cool with what they have to say, even if it’s not at all what you wanted to hear. My suggestion is to ask them, then really trust and heed them. That would lead to the best-case scenario. If you don’t think you can do that, then don’t bother asking them at all; it’s probably better you remain where you are a bit longer.

GEMINI (MAY 21-JUNE 20) Simplify, simplify, simplify. Trusting people to be able to wrap their heads around the big complicated ideas you’re juggling these days would be a mistake. You need to break things down for them, into bite-sized chunks, or else set yourself up for infuriating disappointment followed by frustrating failure. Don’t tell yourself that people ought to be able to handle what you can. That’s true, they should be able to hack it—only they can’t. Recognize that, so you can adapt to it, and make things work in spite of it. Until you’re able to let go of your ideas about what ought to be, and instead embrace what is, success will be entirely out of your reach.

CANCER (JUNE 21-JULY 22) Let’s pretend you decided to produce, direct, and star in a theatrical production. You’d already decided which role you’d like for yourself. Since you’re calling the shots, the role’s yours if you want. However, someone else may come along this week who’s more qualified to step in and play that part, probably better than you could. Can you be generous and selfless enough—and devoted enough to the overall success of the venture—to step aside and let them have it? There’ll still be other parts you can play, and you can take solace in the fact that without you it wouldn’t happen at all. That’s the question of the week: Which will make you happier? Fulfilling your personal desires, or more fully realizing a bigger dream, albeit while playing a smaller part in it?
