Ferry Godmother On Tuesday morning, after a full month of pleadings, testimony, and cross-examination in Maui Circuit Court regarding Hawaii Superferry, Judge Joseph Cardoza issued the longawaited ruling on a request to keep the ferry service docked until an environmental document is prepared. The standing-room only crowd in his fourth floor courtroom listened intently, hanging on every word. “It is not our place to rewrite the laws,” Cardoza spoke. He read verbatim from portions of Chapter 343 of the Hawaii Revised Statutes, adopted in accordance with the Hawaii Environmental Policies Act. He explained that HRS 343.5, “sets forth a process which must be followed, requiring acceptance of a final document [Environmental Assessment or Environmental Impact Statement] prior to commencement of the proposed action.” Cardoza concluded that after, “careful, thoughtful, thorough analysis of the issues, the law gives the court a clear, concise direction.” He ordered an injunction preventing Superferrry’s use of Kahului Harbor facilities previously exempted from environmental review, and declared the Operating Agreement between the Hawaii Department of Transportation and Superferry to be void. In the halls outside the courtroom after the hearing, a barrage of Honolulu television cameras and lights surrounded Isaac Hall, attorney for three Maui groups that challenged the DOT’s original exemption of the project from environmental review. “I think it’s about time that Hawaii Superferry started telling the truth to the people in Hawaii,” stated Hall. He explained that one of the corporation’s directors had just revealed that the long-range plan would eventually encompass five fastferry vessels shuttling between the islands, not just two.

Representatives of environmental groups, and even Maui’s mayor expressed their gratification at Judge Cardoza’s ruling, upholding the integrity of Hawaii’s environmental laws. It vindicated that concerns over Superferry impacts first raised three years ago were indeed valid. Yet, Tuesday afternoon, Governor Linda Lingle met with Senate President Colleen Hanabusa and House Speaker Calvin Say to discuss convening a special legislative session to consider passing a law to allow Superferry to sail. Hall was asked to comment on the possibility of a special session. “It’s always been a terrible idea to bail out one business or corporation that made a bad business decision,” he replied. “Because the state and Hawaii Superferry chose the path of putting their heads in the sand and trying to deny that an EA was required, they’re in this situation now.” Governor Lingle recently said she had, “never experienced the level of rudeness,” as she did appearing before a crowd of around 1,000 citizens on Kauai, where the intent of the meeting was to explain security measures to be implemented in the harbor upon the next arrival of Hawaii Superferry. Perhaps Lingle forgot the treatment she herself gave to Kauai citizens months ago, when they arrived at her Honolulu office to present a petition with 6,500 signatures, seeking an EIS before implementing ferry service. Lingle and her staff turned away the Kauai contingent, without accepting the petition or giving them audience. Will Lingle, the “ferry godmother”, add fuel to the fire of Neighbor Island discontent by encouraging a special session to undermine existing environmental laws? Judge Cardoza, in his preamble to the final ruling, sought to diffuse the divisiveness of the issues. “We can have different view,” said Cardoza, “but we do not need to have a divided community. Show respect and concern for your fellow citizens, and work to resolve the issues before us today.” Wise words, indeed. –MTW

The little fire ant, found on the Big Island in 1999, poses great risks to humans, animals, and the future of agriculture in Hawaii. While the stinging insect has not become established on Maui, recent Circuit Court testimony regarding the Hawaii Superferry revealed the likelihood of introductions between islands, and the shortcomings of Department of Agriculture’s ability for rapid response and eradication of transported pests. Native to Central and South America and the Caribbean, the little fire ant (wasmannia auropunctata) is a mere sixteenth of an inch long— about as long as a penny is thick. Yet it packs a painful stinging bite when disturbed. The sting raises large, red welts, which may last for days, with intense itching. Like many other Hawaii invasive pest species, it is likely that it hitchhiked over in shipped nursery stock. Originally detected in the Puna area eight years ago, the little fire ant has since been identified at more than 50 infestation sites. Kauai eradicated a colony which appeared in 1999, only to find more in the Kalihiwai area in 2004. A Cooperative Extension Service Alien Pest Alert from May of that year stated, “Containment actions are being taken, but limited resources and personnel, and pesticide label use restrictions, have made it difficult to eradicate all the infestations there.” Such is the case, in general, for alien pest eradication efforts statewide. Incoming passengers and freight on route to Hawaii are not afforded the same degree of inspection as those leaving the state. Noble efforts by Invasive Species Committees on each island are limited by funding appropriations. The Hawaii Department of Agriculture hasn’t come close to filling the nineteen inspectors and three dogs recommended in a 2002 risk assessment at Kahului airport. DOA’s Plant Quarantine Branch manager Carol Okada testified recently in Maui Circuit Court, regarding an injunction to keep the Superferry in port until mandated environmental studies are complete. She stated, “[Invasive pests] will continue to move as it’s doing now. It’s just a matter of time. ...As long as people move and cargo moves, invasive species will move.”

“We don’t expect Superferry to be able to detect pests or disease on a plant, that is our job,” she said. But, the diminutive little fire ant, barely detectable to the human eye, is unlikely to be successfully screened, even by trained inspectors. There are now more than fifty verified infestation sites covering several hundred acres in Puna, Hilo, up the Hamakua coast, down to Kalapana, and to Mountain View. But Tommy Thompson, researcher with the UH College of Tropical Agriculture says, “It’s way more than that,” noting that there are pockets of ant colonies, “all over Hilo, in many neighborhoods”. Thompson has been testing to see what registered pesticides and baits can help control the little fire ant. Currently, they use Amdro, which he says, “will knock them down, but not out”. Without ongoing treatment, they will bounce back to their original numbers within 5-6 weeks. Amdro, says Thompson, was also developed for a different kind of ant–and in dry areas such as Texas–not in rainy Hilo and Puna. Moreover, this ant is “unbelievably

adaptive,” says Thompson. Rather than spot colonies, there tends to be blanket coverage in infested areas. And, these tiny ants are arboreal, so pesticide baits aren’t effective where they reside in trees, often underneath bark, moss, or lichen. Workers brushing branches in macadamia nut or fruit orchards may find ants dropping on them, stinging them repeatedly. The little fire ant, “wiped out the coffee industry in the Galapagos Islands,” says Thompson. It presumably has not yet been carried to the Kona side of the Big Island, known for its world famous coffee, but it may just be a matter of time. Even if there were an intra-island quarantine to prevent transport of plant materials from Hilo to Kona, the ant might find other ways. Thompson reported finding a single macadamia nut with a tiny hole bored in it. Inside was an entire functional colony, with queens, workers, and brood. “The biggest thing right now is that we don’t have the tools necessary to fight it,” said Thompson. DOWLING GOES DOWN Just checked out Makena developer Dowling Company’s website (www.dowlingco.com) and discovered that it’s, well, really green. The Dowling Co., Inc. logo is green, the copyrighted phrase “Building In Balance” is green, the site’s wallpaper is green—even the U.S. Green Building Council Member seal at the bottom of the page has this green tint to it. The webpage exemplifies Dowling’s interest in promoting his development firm as environmentally friendly, which is great except that it’s totally irrelevant. Well, 70 percent irrelevant. According to a Sept. 27 MediaPost Publications article on a new study by the firm Ipsos Reid, that’s the percentage of Americans who believe that it’s just a “marketing tactic” when companies call themselves “green.” When you break the results down by gender, the study indicates that 75 percent of men and 65 percent of women think the “green” label is just about marketing. Now the reason Dowling didn’t drop further is that the study also found that, marketing tactic or not, 10 percent of Americans absolutely would pay more for “green” home building products and other 46 percent of Americans “might” pay more for “green” home products. By my math, that adds up to 56 percent, which is more than the 44 percent of Americans completely or somewhat unwilling to pay more for “green” building products. So I guess there’s hope for him yet.

It talked about a new poll showing support for Superferry. “The poll was conducted by QMark Research, owned by the marketing firm Anthology Marketing Group, which is handling the Superferry account through its public relations firm, McNeil Wilson Communications,” said the story. Um, okay. In other news today, Hawaiian Airlines is suing Mesa Airlines (the owners of go!) for using unauthorized trade secrets to get ahead. In today’s Honolulu

Maui News reported today on a meeting called by Marilyn Parris, the woman in charge of Haleakala National Park. She announced that there’ll be no commercial bike tours in the park for 60 days while they study why three people have died on bike tours this year. The irony is one competitor’s client was actually killed by another competing company’s van. Obviously this is a serious and horrendous accident and evidently the bike rider simply lost control. But, there’s still an obvious elephant in the room here. And, it’s not that the park superintendent is female. Honolulu Advertiser reports that Disney’s coming to Oahu to open a themed hotel. The theme? Hawaiian. Whoa. Imagine a Disney hotel in Manhattan with a Jewish theme. What about a Disney hotel in Wisconsin with a cheese theme? That’s goofy.

Here are a few examples: The Associated Press (AP) reports today that there’s trouble at Oral Roberts University which was started by preacher Oral Roberts when, he says, God came to him and told him to open the school. The report details dozens of alleged instances of misconduct. Among them: The university jet was used to take one daughter and several friends on trip to Orlando, Fla., and the Bahamas. The $29,411 trip was billed to the ministry as an “evangelistic function of the president.” And, Mrs. Roberts was given a white Lexus SUV and a red Mercedes convertible by ministry donors. Where the heck was Tammy Faye when this stuff was going down? She’d have had them back on the road to piety in no time. Reporters at the Aspen Daily News asked waiters and waitresses if they added a li’l somethin’ somethin’ for themselves when they batched credit cards. When guaranteed anonymity the overwhelming response from the servers was: “hell yeah, you better believe it.” Then there’s the Honolulu Star Bulletin story today detailing the conclusion to one of the largest fraud cases in the state: “(The) fraud cases began when auditors noticed the huge price tag for four plywood planters for holiday poinsettias at the airport: $14,000.” Basically airport personnel rigged the bidding system so that overly high bids would be accepted and they’d make off with the extra cash. After bilking Hawaii’s taxpayers of over $3.8 million, three of the perpetrators are getting jail time.

MONDAY, Oct. 8 Today’s news consisted of things that couldn’t be finished. The decision on whether the Superferry could run while an environmental assessment was conducted was supposed to be announced today. But, to add suspense to the whole drama, Judge Cardoza announced he needed an extra day to think about it. And, the Chicago marathon was cancelled half-way through–one person croaked, and hundreds were hospitalized because of high temps.

In state marijuana news, the Honolulu Advertiser fronts a story on the sprouting number of indoor growing operations. Police busts on indoor cannabis growing green houses has gone up 700% in five years and jumped forty-fold on the Big Island from 2002-2006. But still, the indoor crop is much smaller than the outdoor variety. And so, the real story might be the statewide massive decrease in numbers of plants “eradicated” between 2001 and 2006. The numbers went way, way down: roughly 525,000 in 2001 to 189,000 in 2006. So, either the police aren’t doing nearly as much “eradication” these days, or there’s a serious decline in toking. And, after an unscientific poll conducted by your’s truly, it was discovered that the former must be case.

The Browns had challenged the federal government’s authority to levy income taxes, a stance that won support among antigovernment activists, many of whom visited the Browns during their stand.” So much for hospitality–they were arrested by two U.S. marshals posing as supporters. “They invited us in. We escorted them out,” said one marshal. Perhaps owners of Maui vacation rentals deemed illegal can hole up in the unit and have guests come and go. They could charge them the normal rate, but without tax, and stay in business for at least another eight months.

ROBREPORT ANT: continued from page 8 Australian pesticide product called Xtinguish that is not currently registered for use in Hawaii. Baited with insect pupae, lipids, and proteins, the product fits in a standard caulk gun for easy dispersal. It has been used elsewhere in the Pacific where this ant has caused big problems, such as Papua New Guinea, New Caledonia, and the Solomon Islands. In a paste form, it is more water resistant, and thus better suited to East Hawaii’s wet climate.

United States Geological Survey biologists Lloyd Loope and Forest and Kim Starr did a Maui island survey of ant species–specifically looking for the little fire ant. None were found. They used a standard protocol of using peanut butter baited chopsticks to collect and identify the ants, especially in high risk areas such as new landscape plantings within new developments. The same methodology is used by Department of Agriculture inspectors for shipments from plant nurseries from the Big Island. In one case, ant-infested plants arrived on Maui, were detected and refused. In another case, the peanut butter bait helped reveal the ants before the shipment was made. Sometimes it seems that there’s trouble in paradise almost anywhere you turn. Threats to our native ecosystems, tourist and agriculture economy, and to our quality of life seem overwhelming–straining our resources and our ability to keep up with them. The recent appearance on Maui of the nettle caterpillar, which also packs a painful sting, reveals our vulnerability to introduced pests on incoming plant materials. The Department of Agriculture’s response to this new pest has been far less than the all-out blitzkrieg necessary for total eradication. Yet, with alien invasive species, the adage, “An ounce of prevention is worth a pound of cure.” seems especially apropos. Measures of prevention may not be limited to the dollars we allocate, but may extend to insistence upon compliance with our environmental laws, to properly assess risks before they occur and multiply. The New Zealand model of inspections and rapid response is looked upon as the gold standard of invasive species control. New Zealand successfully eradicated an introduced infestation of a larger, even nastier relative–the red imported fire ant. But Hawaii has yet to take the drastic measures to protect our resources that New Zealand has done, with the accompanying funds to insure a higher level of effectiveness. The little fire ant may be confused with another stinging variety, the tropical fire ant. This more aggressive species, three times larger, has been in Hawaii for probably a hundred years. But it doesn’t have the unicolonial characteristics of the little fire ant, and is deemed less of a threat than its tiny cousin. It has not been detected east of Kahului, or in Upcountry Maui. “Ecologically, this is a disaster waiting to happen,” says Thompson. Right now, the range of the little fire ant is limited to non-pristine eco-systems. Limitations of altitudes are not yet known. Should the range spread to native eco-systems, Hawaiian insects, spiders, and birds could all be imperiled. “These things are bad news to whatever gets in their path.” Thompson warns. Little fire ant stings are also known to harm animals, including pets and livestock; multiple stings in the eyes can cause blindness in pets or even the death of newly born small animals. Thompson is concerned for native bird populations in Lower

Puna, where the ant colonies are already found. Biologists have recently tracked two species of honeycreepers, the amakihi and elepai`o, whose populations have rebounded in this area. Probably, they have developed a resistance to avian malaria, which is spread by mosquitoes and has weakened and decimated native bird populations statewide. Thompson believes that spreading colonies of ants throughout trees in the area may threaten these resurgent bird populations, attacking nests and their hatchlings.

Jane Balogh, 66, was informed in September that she will not be prosecuted for defrauding elections officials in Seattle, despite having illegally registered her dog, Duncan M. MacDonald, to vote. Balogh, protesting how easy officials have made it for people to vote illegally, put her home phone account in Duncan’s name, which is all the proof required for registration, then signed him up, and when an absentee ballot arrived, she went public about her scheme. However, despite the public confession, Duncan continued to be sent official absentee ballots for the two subsequent election cycles.

Just when Internet newspaper sites appear to be gaining ground as replacements for printed editions, a 70-year-old woman identified only as Maggie told the Edmonton Sun in September that her paper edition of the Sun is a crucial part of her daily diet, literally. She eats it, in strips, and has, she said, for the past seven years because it tastes good. “I can’t explain it,” she said, and it was only when she recently experienced a blockage of her esophagus, and doctors found a ball of paper, that she revealed her obsession. Doctors cited by the Sun said that except for the blockage danger, newspaper eating is not unhealthful.

JUST SAY NO In September, police in Hertfordshire, England, stood fast under criticism for their program of placing posters around the area reading, “Don’t Commit Crime.” Said a police spokeswoman, “If stating the obvious helps to reduce crime or has any impact at all, we will do it.” The police also installed signs at gas stations: “All Fuel Must Be Paid For.”

NEWS THAT SOUNDS LIKE A JOKE At about 9 p.m. on Aug. 23, a fire broke out in the Comedy Zone nightclub in West Knoxville, Tenn., right in the middle of an act in which a hypnotist had just placed 10 audience members into a trance. However, despite an “everyone for himself” attitude that typically marks such emergencies, the 10 hypnotized subjects somehow managed to make it out of the club safely.

In Bay Shore, N.Y., in September, a 32year-old man wielding a tire iron and attempting to mug Bruce Ferraro, 74, on the street was forced to abandon the job and run for it when Ferraro took the iron away from him. Police captured the mugger nearby when his car stalled.

UNDIGNIFIED DEATHS A 24-year-old woman in Lawrenceville, Ga. in July and a 59-year-old woman in Lincolnton, N.C. in August were killed after failing to negotiate driver’s-side devices allowing them entrance to, respectively, a gated parking lot and an automatic car wash. The Georgia woman had leaned out her window to insert a card into the gateopening machine when her car lurched forward and pinned her head between the car and the door. The North Carolina woman had reached out her open car door to punch in a code for the wash when her car lurched forward, similarly pinning her head. Police in both cases said that the cars should have been in Park. MTW

t’s doubtful he knew why we were laughing at him. He just stood there, holding his keys, as the metal detector beeped and flashed and the rest of us chuckled. We were standing on the fourth floor of Hoapili Hale in Wailuku. Just out of the elevator, we were lined up behind that floor’s metal detector. It was really quite simple—you walk up, place your spare change, keys, wristwatch, cell phone and any other metal in these little cups, place the cups on an x-ray conveyor belt and then walk through the detector. But this guy was having problems. He placed his keys and change and phone in the cup all right, but then he—for whatever reason—decided to carry it through the metal detector, which promptly went off, giving all the rest of us some much-appreciated laughs. We were, after all, doomed. There are few pieces of paper that strike more terror into the heart of an American than a Jury Summons. In school, we learn about the wonders of our legal system: placing the burden of proof on the State, the right of cross-examination of witnesses and evidence and, above all, the right to a public trial by a jury of our peers. And these concepts are reassuring, even if we haven’t read the latest on China or Myanmar. Reassuring, that is, until the State decides that we’re now considered “peers.” Then we’re screwed. Being a government document, the Summons itself isn’t exactly inviting, with its frequent use of words that are underscored or written in bold type, all caps, italics or all of the above. “PURSUANT TO HAWAII REVISED STATUTES SECTION 61219, YOU ARE HEREBY SUMMONED TO APPEAR FOR JURY DUTY,” read my summons, which assigned me to the Circuit Court of the Second Circuit, in Wailuku. “All jurors must call AFTER 5:00 P.M. ON FRIDAY, SEPTEM-

BER 7, 2007. THE COURT WILL NOT INFORM YOU PERSONALLY ABOUT ANY CHANGES.” Anyway, I called, and my courtroom was indeed going to be in session. So on Sept. 10, 2007 I put on long pants, nice shoes and a nice collared shirt—these acts were surprisingly difficult for me—and reported to Hoapili Hale so I could place my keys and cell phone into a small cup, walk through a metal detector and then, possibly, hear evidence and deliberate on a verdict. But first I had to get through the metal detector, which for some reason was placed directly in front of the elevator doors, making standing in line more than a little awkward.

Going to jury duty (some government officials prefer the softer sounding “jury service,” but the State of Hawai‘i refreshingly embraces the word “duty”) was never a question for me. Sitting on a trial for more than a few days was going to wreck havoc with the paper, but I also knew there would be few sympathetic ears at the courthouse listening to that particular excuse. Also gnawing at the back of my head was this line near the bottom of the summons: “FAILURE TO COMPLY AS HEREIN ORDERED MAY RESULT IN THE ISSUANCE OF A BENCH WARRANT FOR YOUR ARREST AND/OR OTHER PENALTIES AS

ties actually happened to people who tossed their jury summons. “Rarely,” he said. “I can’t recall that happening.” Arakawa said that those who don’t respond to the first summons would get a second letter, and then a third—each increasingly threatening. Failing those, a judge could “force them to appear.” Still, Arakawa said the court didn’t set out to be harsh. “People put the notice on the refrigerator, and then they forget,” Arakawa said of those who might just not show up to court. Those people would get a “mild chastising” and a rescheduled date of appearance. Arakawa said he didn’t have “hard numbers” documenting how many people simply disregarded their jury summons, but said “most” show up in court when called. Of course, not everyone has to do jury duty. State law allows all elected officials, judges, police officers, firefighters, paramedics, members of the armed forces “on active service and deployed out-of-state,” people who live more than 70 miles from court and those at least 80 years old to “claim exemption from service as a juror.” A few bills floated around the state Legislature this term that would add dentists and those at least 75 years old to the list of exemptions, but they’ve been carried over to the 2008 session. udge Richard T. Sworn in as a 2nd Circuit Court judge in April 2005, Bissen is a former Maui County Prosecuting Attorney who previously served as Governor Linda Lingle’s First Deputy Attorney General. His comments to the 50 or so prospective jurors were straightforward, but friendly. As Bissen outlined the day’s case— alleged child abuse—and said the attorney’s estimated it would probably take just two days, and then the court clerk began pulling random poker chips out of a bowl to see which of us would end up in the jury

friend once told me he’d trade his right to have a trial by jury for never having to deal with jury duty again. His reasoning was that he figured it was “highly unlikely” that he’d wind up in court (I think he too casually dismissed the idea of civil litigation, but no matter) and that, even if he did, he trusted that the judge would be fair. I tried not to roll my eyes too obviously.

issen began reading off the names of the attorneys and the defendant. He asked the 12 prospective panelists and the rest of us still sitting in the gallery if we knew them. I was counting on this part to get an early ticket out, but try as I might, I couldn’t recall ever hearing of them before. As the prosecutor and then the public defender began asking the panelists questions, I started doing quick arithmetic in my head on my chances of getting called up. I only vaguely listened as clues to the case began unfolding. The defendant, a male, was from Micronesia. One prospective juror knew one of the witnesses against him—his young daughter—from an upcountry school. I alternated between staring at the back of the defendant’s head, watching the attorneys very politely ask jurors if they’d ever been convicted of crimes and the allimportant bowl that held my number.

Every once in a while the judge or an attorney would ask a prospective juror to the bench, and then they’d huddle and talk while white noise played over the court speakers. Then attorneys would start exercising their preemptory challenges—booting jurors for whatever reason they wanted—and my probability arithmetic would accelerate. An hour went by, and we went on break. Sept. 10 happened to be the first day of the Superferry hearing in Judge Joseph Cardoza’s courtroom, so I spent my breaks heading over there to chat with witnesses about how things were going. By noon, it was all over. Bissen swore in 12 jurors and one alternate with me still sitting in the gallery. “Please don’t cheer too loudly on your way out,” he told the dozen or so of us who’d never heard our numbers called, and we left. We were free! Free to go back to work! Woohoo! Waiting for the elevator, I started chatting with one woman I knew (her daughter works for the paper as well) who’d sat in the gallery with me and also never got called. It turned out we had identical plans on what to do had we actually gotten called up. As the attorneys questioned the prospective panelists, it became clear the case was hinging on the issue of corporal punishment. Both attorneys were probing the would-be jurors’ views on spanking: Did you believe there was a “range” of legal punishment options for children, which included spanking? And if you didn’t believe in it, what would you do if you married someone who used it on his or her children? If called, I was simply going to say that I absolutely did not believe in any form of physical punishment for children. I would say that I accepted that spanking was legal, but that I abhorred it and would never do it—absolutely true opinions, but I’d use the harshest terms I could muster. Chances are, given what the woman and I witnessed in the courtroom, that she and I would have been excused for advocating such views. In fact, everyone we watched who either came out strongly for or against corporal punishment was eventually excused. But was this necessarily a good thing? Did believing that corporal punishment was awful constitute pre-judging the defendant’s guilt, even if I believed that corporal punishment was legal? If not, was it wise to kick people off juries because they held strong opinions on issues central to the case? Neither of us knew. Shrugging my shoulders, I looked around. That guy who earlier that morning had walked through the metal detector still holding his keys was also waiting for the elevator. Assigned to another courtroom, he’d also evidently missed getting on a jury panel. And that, more than anything else I witnessed that day, gave me hope for our legal justice system. MTW

box, I began thinking about how much easier all this was here than on the Mainland. In the early and mid-1990s, I served on two jury panels, both in Los Angeles, California. Both cases took place in the famed Clara Shortridge Foltz Criminal Justice Center, which back then was known simply as the Criminal Courts Building. It’s where they tried O.J., Robert Blake, and most recently, Phil Spector. It’s also home to a cavernous, incredibly depressing place known as the Jury Assembly Room. There, hundreds of strangers mill about, reading, watching TV or just staring vacantly out the window at the downtown streets below, waiting for a disembodied voice to call out their names and send them to one of a few dozen courtrooms. In 1992, the year I first served on a jury, service was tough. It was 10 days minimum, regardless of whether you actually sat on a panel. Pay was a miserly $5 a day. On my first day I wound up on a jury panel in a case of alleged attempted murder. We heard evidence for three or four days and then deliberated for a day. After we rendered a guilty verdict (the would-be victim survived the attack and positively identified the defendant both in court and to a witness immediately after the attack), the judge sent us back to the Jury Assembly Room to finish out our 10 days. Thoroughly sick of the place, I went to a jury clerk and asked to be excused early. I said I’d already served on a panel (true) and college was starting up again in a few days (a slight exaggeration), but I still had three days left of service. To my surprise, she immediately cut me loose. All that has changed. These days, in LA and on Maui, if you’re not picked for a panel on your first day of service, then you’re excused. The pay here is $30 a day, and they pay your gas mileage both to and from the courthouse. And given Maui’s small size, jurors are sent straight to courtrooms, rather than massive Assembly Rooms.

Comfort Food Smoothies soothe and bento’s nourish the hungry at Thida’s Curbside Café Every parent knows that the quickest way to soothe a screaming child is to stick a popsicle into their mouth. This works especially well after a visit to the doctor where bumps, bruises and vaccinations pale in comparison to the promise of frozen Red Dye #40 and high fructose corn syrup.

entrance into the clinic with my child. What I found there was a lot more than just kidfriendly treats. Thida’s offers a great selection of espresso drinks that are way, and I mean way better than any of that corporate-coffee stuff. My favorite is the ice-blended Caramel de Leche which is creamy, sweet and strong with a bold shot of espresso. They also offer a Coco Mocha Nui, White Chocolate, Extreme Coffee Toffee and a Chai blended coffee. If you’re not in the mood for something fancy, you can always get a good ol’ cup of joe. They use Maui Coffee Roaster’s house coffee, which just happens to be my favorite. In the food department, Thida’s has pretty much everything: Redondo’s hot dogs, polish dogs, homemade chili, bagels with cream cheese or smoked salmon. They also offer fresh salads, bentos, turkey, beef, boca or veggie burgers with all the fixings and, according to faithful customers, “the best tuna melt” on the island. “It’s a family thing,” said Thida Gepkan as she grilled up a hamburger–fresh and made to

order–for me the other afternoon, “My sister Thavy’s son and daughter run the one at Kaiser Wailuku.” The curbside café over at Kaiser Wailuku has been up and running for about ten years and the menu is similar to the café at Maui Lani, except they don’t have a hot grill–so no burgers. Let’s talk about those burgers. Thida’s cheeseburger is awesome. A fresh and juicy beef patty on a sesame bun with mayo, mustard, ketchup, lettuce, tomato, onion, pickle and sprouts. In fact, I even chose to have cilantro on mine. I love cilantro and it’s great on burgers. Thida’s also has a great selection of snacks, like chips, candy and

soft drinks. The prices are fair and the service is good. Next time you’re hungry and in the area, make sure to check it out. Just so you know, you don’t have to have an appointment at Kaiser to go to Thida’s. In fact, you don’t even need to be a Kaiser member. It’s not like they ask for your medical record number or anything, and there’s always lots of parking.

Displeasing the Queen Shekhar Kapur’s “Elizabeth” Sequel Tarnishes Disappointment seeps through every element of director Shekhar Kapur’s ineffectual sequel to his superior 1998 precursor Elizabeth, which introduced the world to the exceptional acting abilities of Cate Blanchett.

Elizabeth: The Golden Age

★★★★★ Rated PG-13/114 min.

In spite of her familiarity and ease as the woman who reinvented 16th century England, Blanchett’s best efforts are routed by an overly compartmentalized script that seeks to add a romantic groundwork to the character. Screenwriter Michael Hirst (Elizabeth) teams up with William Nicholson (Gladiator) to detail Elizabeth’s jealous relationship with Sir Walter Raleigh (Clive Owen), while giving scope to her ruling abilities in the context of waging war with Spain. Elizabeth: The Golden Age waffles most in pinning its narrative gist on Elizabeth’s vulnerable alliance with Sir Walter Raleigh. Once Raleigh

boldly introduces himself to the Queen during a public court, a soap opera tone wafts over scenes of the two skirting around his appeal for her to finance a voyage to America, and her desire to keep his charming company beside her. Since much of Elizabeth’s perceived power lies in her designation as the “Virgin Queen,” there is no place for the plot go. As engaging as Raleigh is, the part as written casts a shadow of ulterior motives upon him. It’s a gray area that could have provided the story with essential nourishment had the writers bothered to flesh it out. From this corner-painted position, the film distracts with equally benign subplots about things like a misinformed assassination attempt and Elizabeth’s decision to dress in full armor to lead her short-numbered army into combat. The brief battlefield scene comes off as little more than a movie poster photo opportunity. Shekhar Kapur has pasted together bubbles of historic anachronisms–Queen Elizabeth would have been 52 at the time the story takes place—filled with worthy but unjustified performances. The movie wants to be as much about Sir Walter Raleigh as it is about Queen Elizabeth, but the filmmakers seem to avoid investing in his character–probably

for fear of upstaging the regal Queen they attempt to make “human.” However, there’s no denying that the actor’s performances help compensate for the film’s lack of narrative cohesion– Samantha Morton creates an intriguing character as the Queen’s duplicitous cousin

Mary Stuart while newcomer Abbie Cornish is beguiling as Raleigh’s more tangible love interest, and Geoffrey Rush is ever reliable as Sir Francis Walsingham–even if they are not given sufficient screentime. Here, the Golden Age is converted to pewter. MTW

It was walking distance from my paternal grandparents house, which was the same house that my dad grew up in. My dad was a Wailuku boy. My childhood is filled

Nowadays there’s Cafe Marc Aurel which has great coffee and the best hummus and tomato bagel on the island and Ohana Cafe–the best place to get a “pick me up” spirulina blueberry smoothie. The Iao Theater is still there, but it’s busy and active these days. I can’t remember the last time there wasn’t a cool event either on stage or Graffiti artist, Flewnt Sevns in the works there. Back in the day, shows were few and far between_ with the biggest event being the Rocky Horror Picture Show every October. Under the Wailuku banyan tree there’s a farmers market with fresh Hawaii produce, and a stage a where local musicians often play. You can find sushi, get acupuncture, shop for stiletto’s, get your shoes repaired, buy property, eat croissants, have a glass of wine, admire fine art, have your watch repaired, visit a pawn shop, hire a lawyer... You name it and you can find it, eat it or do it in Wailuku. Now Wailuku even has a monthly blockparty. Last Friday after work, the family and I strolled through Market and Main Street with hundreds of other Maui resDJ Boomshot idents in the first ever “First Friday” event. The atmosphere was festive and I was struck at how

It’s astonishing how some of the most educated people (and most of the least) seem to completely lack the ability to truly think. Analytical thought, the kind that allows you read between the lines, penetrate smokescreens and mirrors, and perceive layers beyond what’s being presented, is a rare and valued talent. You happen to be good at it, most of the time, when you don’t let your emotions cloud your vision too much. The problem is you haven’t been practicing it much lately. You can’t afford to slack off like that. After all, you’ve got to compensate for all the ignorant oafs who can’t be bothered to question what they’re told. This week, turn your Superman vision back on and start blasting through walls and lies. Someone should.

PISCES (FEB. 19-MARCH 20) Your mind is a river, and you’ve spent far too much time and energy lately attempting to row upstream. While I appreciate and applaud your efforts to at least steer the ship of your thoughts in those changing currents, you’re trying too hard. Let’s face it—you’ll never be as driven and focused as an Aries or a Virgo. Their strategies won’t work for you. Part of your process involves incorporating tangents and detours, while remembering your ultimate goal. When those kinds of distractions beckon this week, don’t ignore them. (You can’t.) ARIES (MARCH 21-APRIL 19) This week, shed some outdated habits of mind. Let’s say you figured out ten years ago that you don’t like cauliflower, to use a rather mundane example, and so you never bothered revisiting that idea. Of course, many or even most of the things you figured out in past chapters will still hold true today—but not all of them. TAURUS (APRIL 20-MAY 20) Don’t slide from hard-nosed realism into irredeemable pessimism, Taurus. CANCER (JUNE 21-JULY 22) A woman in Brazil gave birth to her own twin grandchildren last month. Her daughter was having trouble having children, so she offered to be a surrogate for her. This loving (and yes, slightly odd) gesture was probably beyond the call of motherly duty. Having said that, you’re likely to be called upon this week to deliver more than is strictly your responsibility, though probably not someone else’s babies. I hope you rise to the occasion, anyway, although you’re certainly under no obligation. However, you’ve often leaned on people often in the past, right? This, then, is your chance to make it up to them.

I was at a card game the other night and one of the players told a story about how his daughter’s preschool teacher phoned him and asked that he talk to his little girl about calling the other kids “dumb ass” in school. Maybe it was time, he said, to stop swearing in front of the kids. Later, in a seemingly unrelated tangent, I overheard him lamenting that since starting school his daughter had picked up bad habits from the other kids. None of these habits included swearing–mostly just regular kid stuff like fibbing, eating boogers and armpit farts. I understand completely. See, I have a potty mouth and I don’t see what the big deal is. Part of the dilemma, I think, is that I am a lover of words. It’s hard for me to think that a word can be “bad.” Words are simply descriptive. If anything is offensive, it’s what the word is describing. For example, I find it amusing that on the radio you can say “He likes to take it up the ass by large man-meat” and “Yeah, butt-sex is awesome!” but you can’t call someone a “shit-head.” Seriously, what’s more offensive? According to the Motion Picture Association of America (MPAA—they hand down movie ratings), use of the “F” word in a sexual way brings an automatic R rating. On the other hand, if a movie is chill besides the line, “I hope your limbs fall off and dogs eat your eyeballs you Jewish fuck-face,” the MPAA might give the moviemaker a pass with a PG-13. Another gross example of the stupidity of movie ratings is the renaming of the French Film Baise-Moi. In French, the title means, “Fuck Me” but this was apparently too offensive for us Americans so we renamed it “Rape Me.” Yeah, like that’s not off-putting at all. Which brings me to the idea that vulgarity is all a mater of perspective. Now that we know what “baise” means, does it offend us? Probably not, even though it translates to the great big, notorious “F” word. If someone called you a cocksucker, you’d probably be offended. Possibly even reading the words makes you uncomfortable, but how about being called a “bennie?” It seems benign, but if you were familiar with the term you would know that you were just called a person who likes to perform oral sex on prostitutes. The information available on the origin of the word “fuck” is pretty crappy. No one really knows for sure how it came about, but it’s clear that we’ve been using it for a long time–perhaps as early as the 15th century. People have speculated that it started as an acronym for “Fornication Under Consent of King” and was posted on the doors of couples granted permission to have sex; or maybe it was a badge standing for “Found Using Carnal Knowledge,” forced on promiscuous Puritans as a scarlet letter for their evil deeds. But the most likely origin of the word comes from the Dutch word “fokken,” which literally means “to breed cows.” While researching the word, I found that throughout history, many politicians like Pierre Trudeau of Canada have been caught using the word, which they tend to blatantly lie about and say stupid things like, “I said ‘fuddle duddle’” or “I called him a dumb ‘faker.’” Fuckin’ politicians.
