LETTERSTOTHEEDITOR HAS BONE TO PICK WITH SHPD Having spent almost eight years in various positions as an archaeologist in Hawai‘i, primarily employed in historic preservation, one of the key problems has been the upper administration (“Skeletons in the Closet,” Dec. 6, 2007). With [Administrator Melanie] Chinen gone, [Governor Linda] Lingle on her last legs of her last term, and the hope of a new administrative change in the air at DLNR, one can only hope that the climate for historic preservation will improve. Much of the problem, at least as I viewed it, is due to a lack of true understanding on the parts of island burial councils, archaeologists, and administrative elements. When I began working in Hawai‘i in 1997, things were not pono between these groups, nor did they ever really improve. Certainly, there were times when interaction was positive and voices were heard, but not often enough. Groups spoke at and past each other. Dealing with issues as sensitive as human remains means that all have to be equally heard. As long as there is development there will be strife. Chinen hopes that funding will improve. That would only solve part

of the problem. Hearts and minds have to change and groups must be included in the consultation process. I worked with an excellent firm on Maui and Oahu and know that a spirit of cooperation exists there. Hopefully, with time, relations with developers, archaeologists, all citizens of Hawai‘i, and administrative arms will continue to improve. -John Dockall, via Mauitime.com

SPEED DEMONS (Editor’s note: the following letters are in response to Jared Libby’s Dec. 6, 2007 story “Busted!: One Maui resident feels the sting of the state’s tough new criminal speeding law.”) If we are to move together as elevated society, our citizens have to take responsibility for their REPEATED actions. Obviously, ticketing didn’t work to help Laura Kaplan stop her excessive speeding. Seventy-seven miles per hour is unacceptable speed on the Pi‘ilani Highway. Come to think of it, that speed isn’t acceptable or legal anywhere in the U.S., even on mainland freeways. Maybe a course on driver’s education could help. Or a lesson in driving with aloha. Or learning the concept of what ohana is on these islands. Ironic is the fact that Laura is in the healing arts. She is

also a menace and says she will continue to speed. Assertive and safe speeding? That’s clear arrogance. -Elena Lissone, Pukalani Didn’t the Maui Police Department publish over a month ago that they are doing a campaign to bust ALL drivers traveling more than the POSTED speed limit? People ASSUME they can drive 10 or [more] miles over the limit and be okay. Or just because others are riding your ass you are okay “going with the flow.” I am sure MPD published the fact that they are likely to ticket anyone... so WTF would one think 30 over—even on a “deserted” stretch—is not a prosecutable crime? I didn’t know about the new law, but since I regard posted limits I really don’t even need to know about it. Gotcha! -Anonymous, via Mauitime.com Was this article supposed to evoke sympathy for a stupid driver who can’t keep it in her head that speed kills? Puhleeze! You deserve every minute you got in jail. How do you think she was driving 77 on a mostly crowded highway anyway? -Anonymous, via Mauitime.com Here’s my favorite quote: “I was forced to spend 48 hours in a prison lock-up with long-term inmates, made to sleep on a

concrete floor in a cell with two other women who lived there,” she said. “Locked away 19 hours a day and made to pick bugs out of my food. How is this supposed to make me stop speeding?” Not only does she not understand that speeding is dangerous and not appropriate behavior, I am not sure she understands that she might be risking incarceration. Even after she’s spent a few nights in the gray bar hotel with her new best friends, she still plans on speeding? -Jake Blues, via Mauitime.com

EH BRAH! Send anonymous thanks, confessions or accusations, 200 words or less (which we reserve the right to edit), changing or deleting the names of the guilty and innocent to “Eh Brah!” c/o Maui Time Weekly, 33 N. Market St, Ste. 201, Wailuku, HI 96793 or send an e-mail to

ehbrah@mauitime.com This goes out to the guy who decided to park his piece of crap white sports car in a handicapped spot at the Pukalani Shopping Center. Nice move, brah! Couldn’t you push your little car—which didn’t have a handicapped parking sign—into a regular stall? Oh wait: you had to park close so that your girlfriend wouldn’t have to walk very far. Yeah, that’s legit. And your parking was atrocious! Ever heard of lines? Your front tire was halfway into the access ramp lines. Here’s a thought: do us all a favor and sell your ride for something that’s easier to fit into handicapped stalls, like a Tercel or even an Aspire.

Future Maui condos?

LAND, NO! Man, the Pacific Business News website on Dec. 4 had some great news for local land developers. Let’s start with the story that median condo prices in Maui County went up even more in November, and now top $647,656, which is actually more than a single family home. But most of the best condos on Maui are near the shore, and the longtime viability of living there is very much in doubt. Which segues to the story on a new Organization for Economic Co-operation and Development report that says by 2070 rising sea levels could displace 150 million people around the world. Of course, Maui isn’t mentioned in the report—or Honolulu, for that matter—because it only deals with the biggest, richest cities around the world, but the ocean doesn’t discriminate on the basis of wealth or population. And for land developers like A&B, Maui Land and Dowling, this is great news. It means they’re going to have to build further inland because everything they’re putting up now by the shoreline is doomed! They can’t lose!

And now we read that Tesoro—which runs one of the two oil refineries in the state—is flirting with disaster: “Tesoro Corp said it may spend up to $175 million to upgrade its oil refinery in Kapolei,” reported PBN on Dec. 5. “The project… would essentially enable the refinery to more efficiently turn crude oil into gasoline and improve the quality of the fuel.” Say it ain’t so, Tesoro! If you do that, then you run the risk of being able to refine more fuel, which could possibly, conceivably lower our prices at the pump. And then where will you be? Tesoro, refiners are supposed to bitch and moan about a lack of refining capacity—not actually do something about it! MTW

NEWSOFTHEWEIRD THE MODERN MOTHER Style and environment-conscious Canadian mothers insist on cloth diapers, especially designer labels of flannel, fleece or wool-knit, according to a November report in Toronto’s Globe and Mail. Handmade embroidered diapers—perhaps in tie-dye or camouflage—are priced at up to $80 each (and some babies get to wear them only just after taking care of business in an ordinary diaper).

CULTURAL DIVERSITY In October, Italy’s economic minister, noting that a third of all men over 30 still live with their parents and that rental housing markets are depressed, proposed a tax break worth the equivalent of about $1,400 for each man in his 20s who will finally leave Momma’s house. A week earlier in Sicily, one mother publicly turned her adult son over to the police for staying out too late, and also took away his house keys and cut off his allowance. The son, who immediately complained that the allowance was too small, anyway, is 61 years old.

WAR IS HELL The normal daily tension between India and Pakistan arises in many forms, but one nightly ceremony on the border at Wagah crossing is particularly odd, described by a Los Angeles Times reporter in September as part pomp, part macho posturing, and part Monty Python’s Ministry of Silly Walks. Uniformed guards from both countries march toward each other in their inexplicably complicated headgear, “glower fiercely through their mustaches” and puff themselves up, eyeball to eyeball, in a show of confidence for their respective countrymen. But then they meekly shake hands and

close the border for the night.

LATEST RELIGIOUS MESSAGES “This is a college education that I can use,” said sophomore Emily Felts, 19, as she praised the homemaking curriculum of the Southwestern Baptist Theological Seminary in Fort Worth, Texas (which leads to a Bachelor of Arts in Humanities). Men and women may be equal, the school says, but they have different roles, and for women, that includes “how to set tables, sew buttons and sustain lively dinnertime conversation,” or how to use the Internet to track grocery coupons, according to an October dispatch in the Los Angeles Times. Felts said she enjoys the work (except vacuuming), but it “doesn’t matter what I think. It matters what the Bible says.”

QUESTIONABLE JUDGMENTS In November, a California administrative judge sided with state dental authorities and suspended Dr. Mark Anderson’s license, following complaints by female patients that he had massaged their chests to treat a jaw disorder. Anderson’s lawyer, citing alleged dental journal articles, had asserted that jaw pain was related not only to pectoral muscles but even calf muscles. In November, Anderson was also indicted for sexual battery against patients.

LEAST COMPETENT CRIMINALS In Monticello, N.Y., Steven King, 40, was indicted in October as a result of a traffic stop, for allegedly doing nearly every single thing wrong: intoxicated, driving in oncoming-traffic lanes, with an open beer container, not wearing a seat belt, driving an uninsured car, with expired safety inspection sticker, with license plates belonging to another car, and with his two-year-old daughter-passenger neither in a car seat nor belted in. ROBREPORT

BY ROB PARSONS ROBPARSONS@EARTHLINK.NET

Water, Water Everywhere Are Maui’s water resources properly managed? Last week’s storm-induced electrical outages and water line breaks recalled the line from Samuel Taylor Coleridge’s epic poem “The Rime of the Ancient Mariner”— “Water, water everywhere, nor any drop to drink.” Both before and after the Kona winds blew and torrents of rain fell on Maui, a great confluence of discussion and debate has been taking place about the nature and legalities of our water resources. In Wailuku, the State Commission on Water Resource Management began a contested case hearing on the distribution of the water from the four major streams—Na Wai Eha—of the West Maui Mountains. For more than a century, those waters have been controlled primarily by Wailuku Sugar Company, which changed its name to Wailuku Agribusiness a quarter century ago, and again recently to Wailuku Water Company. A hui of groups, including EarthJustice and the Office of Hawaiian Affairs, is seeking to establish in-stream flow standards for stream wildlife, as has been required by the state Water Code since 1987. The Hui o Na Wai Eha and Maui Tomorrow, partners to the contested case, also join in seeking to preserve traditional and customary water uses, such as growing taro. On Dec. 7, the Maui County Council passed the so-called “Show Me the Water” ordinance, three years after the bill was introduced. Council Water Resources Committee Chairperson Michelle Anderson spearheaded the bill, and brought the debate on the matter to the point that it passed unanimously. For years, the county Department of Water Supply had issued permits with a caveat that water could not be guaranteed at the time a project was completed, though reservations for water meters were often issued well in advance. The new bill, once signed into law by Mayor Charmaine Tavares, will require developers to substantiate a reliable long-term water supply before receiving zoning or subdivision approvals, with some exceptions. Claims by developers that this would impose a de facto moratorium on development tend to underscore the seriousness of the water shortage issue. The Maui Water Resource Forum,

LC Watch Talk to the Fence During their Dec. 12, 2007 hearing the Maui County Liquor Commission made the mighty Maui Land & Pineapple Company buy a metal shipping container. It’s for the new Hawaiian Islands Spirits (HIS) operation in Kahului that would distill some of ML&P’s hundreds of thousands of gallons of pineapple juice they don’t otherwise know what to do with into vodka and, possibly, industrial alcohol. Though the commission granted HIS a license back in July, problems arose when LC officer Michael Kawagishi recently visited the company warehouse for a final inspection. There, instead of the nice big office and lab—housed in a building—that appeared on the commission-approved floor plan, he found an operation that resembled a backyard still, secured behind nothing more daunting than a 10-foot chain-link fence. “It would have been very easy for me to climb in,” Kawagishi told the commissioners. “[I] never found the gate locked. [There was] very little, if any, security.” Kawagishi and LC Director Franklyn Silva recommended disapproval of the HIS liquor license because the company’s operation was so different than what they originally proposed to the commission.

held Dec. 7 and 8 at Maui Community College’s Pa‘ina Building, included a wide variety of topics. Organized by the Maui Tomorrow Foundation and the Sustainable Living Institute on Maui, the “first annual” forum also attracted broad sponsorship from landowners, residents and developers. Interactive electronic voting also provided a glimpse of the prevailing beliefs of attendees: 42 percent believed that implementing water conservation measures and sustainable resource practices should be a top priority; the most popular alternative for sustainable use was rainwater catchment, closely followed by wastewater re-use and reducing overall use; most felt rising costs of providing water could be traced to new residents, along with soaring oil prices (the Department of Water Supply’s pumping requirements for their 750 miles of pipe make them Maui Electric’s top consumer). Retired Supreme Court Judge Robert Klein provided an insightful overview of the legal status of water in Hawai‘i, from the Great Mahele land division in 1848 to the present. By definition in the Hawai‘i State Constitution, water shall be held in a public trust and cannot be owned outright. “The State has

MAUI TIME WEEKLY

an obligation to protect, control, and regulate the use of Hawaii’s water resources for the benefit of its people,” says Article XI, Section 7. Attorney Alan Murakami, Litigation Director with the Native Hawaiian Legal Corporation (NHLC), further elucidated the complex web of water laws, rights and the shortcomings of our government in see WATER, page 11

In response, HIS manager Bob Gunter told commissioners that he was confident in his ability to keep the place secure, was only running a “pilot project” that would produce just 12 cases of booze a day and, if forced, would put a big, lockable container on-site to hold the finished product at night. Besides, he and his attorney said, protecting the booze wasn’t the commission’s responsibility. The commissioners went back and forth on that one. Some, like Arsene “Blackie” Gadarian, favored immediate approval, saying it was far easier to break into a liquor distributor than the HIS operation. Others, like Ron McComber, said product safety “should be our concern.” We try not to tell licensees how to run their businesses, Silva gently told the commissioners, though they probably missed the irony of the statement. In any case, the commission approved the new HIS floor plan with the proviso that the company lock up their booze in a shipping container.

COCONUT WIRELESS THE WEEK IN REVIEW

BY ANTHONY PIGNATARO ANTHONY@MAUITIME.COM

shocking is that the DEA still considers LSD-related anything to be “alarming.” Is this what’s become of our vaunted War on Drugs? Did we suddenly wipe out meth, crack and old-school cocaine, allowing us to focus on what the Central Intelligence Agency once considered a possible mind-control interrogation drug? Don’t know if you’ve noticed, but Rolling Stone this month has an astonishingly good story titled “How America Lost the War on Drugs.” The story lays out in nauseating detail how we as a nation have thrown away $500 billion and 35 years of effort to fight drugs, which remain to this day “cheap and plentiful.” I’d check out the story if I were you—especially if you live in Watsonville.

THURSDAY, Dec. 6

WEDNESDAY, Dec. 5 It’s in the early afternoon, and I’m sitting in my Wailuku office. I’m trying not to think about the rain that’s drenching the state, the little droplets of water falling from the ceiling into three wastebaskets placed on and around my desk, that all email and Internet access suddenly and mysteriously cut out about a half hour ago and especially the condition of my Kihei apartment, which is possibly flooded and certainly without power until at least midnight. Thank goodness I’ve got today’s wonderful Honolulu Star-Bulletin story “LSD bust nets Maui couple” in front of me. Apparently, a couple from Paia (surprise) got busted by the Drug Enforcement Agency (DEA) in Santa Cruz (another surprise), along with 20 grams of LSD—enough for “200,000 doses,” according to the paper. “This alarming amount,” DEA agent Javier Pena told the paper, “could provide every citizen of Watsonville with four doses each.” Watsonville, eh? A town comparable to Wailuku in size and population? That is shocking. What’s even more

Oh, boy! Today I got a press release from the Washington, D.C.-based Alliance for Worker Freedom! If you’ve never heard of the Alliance, it’s because they’re one of those far right-wing pressure groups who not only think On the Waterfront was a documentary, but that it’s still applicable today. They can barely get recognition from Fox News, which probably explains why they faxed today’s release on their annual stateby-state “Worker Freedom” report card to little ol’ me. And it doesn’t look like the Aloha State did very well: “Hawaii scored 0 out of 10, earning the state a ‘F,’” according to the press release from “Director of Policy” Brian M. Johnson. “Hawaii is turning its back on working citizens and alligning [sic] with Big Labor and unionthugs at every chance.” Yeah, Hawaii will do that. Good thing we’ve got the Alliance to stand up for us working slobs. Yeah, stick it to Big Labor and their incessant demands for fewer firings and more modest cuts in health benefits! Screw unionthugs and their poorly-attended informational pickets!

FRIDAY, Dec. 7 It must be Finals Week, because I’m getting state-by-state report cards from everyone. The latest comes to us from two

cials… Oh wait, before I go: did you happen to see the front page of today’s Maui News? There’s a teaser at the top of the page for a story on the anniversary of the 1941 Pearl Harbor attacks that says, I kid you not, “Pearl Harbor upended lives.” Who knew? When I pointed this out to my pal Ron (who served in the navy—ours, I think), he explained that “Pearl Harbor would’ve gotten more press and national empathy had not the Second World War started at almost the same time.”

SATURDAY, Dec. 8 Oh wow, look at this: an “unknown amount of sewage” spilled into the waters off North Beach at Ka‘anapali this week, according to today’s Maui News. The spill, which occurred very close to the Lahaina Wastewater Treatment Plant, led state Is this your idea of “Worker Freedom?” health officials to tell people to stay out of the ocean. Given the fact that this spill comes just three weeks after our cover groups—the Better Government story “Change the Channel!” (Nov. 15, Association and National Freedom of 2007) about West Maui Preservation Information Coalition—which for some Association’s findings of significant reason want to make it easier for citizens bacteria readings in that very same to get documents and records from govarea, can state officials please do a comernments. Anyway, their latest report plete bacteria survey of Honokowai card on state responsiveness to freedom Channel and the surrounding waters? of information requests gives Hawai‘i Is that too much to ask? another big fat F. “The tools available to citizens to enforce their rights under state FOI laws are, with rare exceptions, SUNDAY, Dec. 9 endemically weak,” says a press release Woohoo! Even with all the rains that on the report card. “A stunning 38 states drenched us this week, the drought that’s earned F ratings, with the rest scattered plaguing Upcountry and South Maui is between C and D. ROBREPORT WATER: continued from page 8 implementing constitutional mandates. For instance, the adoption of county and state Water Use and Development Plans, which faced public review in meetings held on Maui this week, has been languishing for 17 years. Murakami says that without these overdue documents, “We have been missing a foundational basis of all our planning.” Murakami said the water wars have shifted from Waiahole on Oahu, where legal tussles over former sugar allocations on the Ewa plain have persisted for 12 years, to Maui. In addition to the Na Wai Eha contested case, Murakami and NHLC have been involved with efforts to restore instream flows to East Maui streams in the Wailua area, continuing legal efforts that were begun a century ago. He said the state Commission for Water Resource Management’s record of stream protection “has been atrocious and needs serious reform.” East Maui Irrigation (EMI), a subsidiary of Alexander & Baldwin, supplies from 160 to 450 million gallons per day of surface water for sugar cultivation and processing, with a small portion treated for the Upcountry domestic water supply. Murakami called this the most significant diversion in the state, with 75 percent of the water coming from state ceded lands and EMI paying less than one cent per thousand gallons of water. Murakami said that when Circuit Court Judge Eden Elizabeth Hifo ordered partial relief to Wailuanui taro growers, it was the first time in Hawai‘i’s history that stream restoration had been awarded from an operating cane company. He said that the Kingdom of Hawai‘i filed a petition 130 years ago against the East Maui water diversion, and were told that native and traditional rights would not be injured. Murakami also said that he objected in 2002 when Meredith Ching, A&B’s Vice President of Governmental Relations and Community Affairs, was appointed to the State Water Commission. William Tam, a Honolulu lawyer who wrote the state water code when he was the deputy attorney general assigned to the commission, called the appointment an “irreconcilable conflict” that puts authorities in “very difficult circumstances.”

before then Na Wai Eha issues would be resolved, but doubted that we’d resolve problems relating to growth. He said that continuing development “brings us a high quality of life and destroys our [traditional] quality of life at the same time.” County water re-use expert Steve Parabicoli reminded the audience that we’re recycling just 22 percent of county wastewater treated to R-1 standards (which we can use for small and largescale irrigation). The remainder is being pumped into the ground through injection wells at treatment facilities in Kahului, Kihei and West Maui. While studies indicate that near-shore algal blooms happen in proximity to each of these areas, other factors also contribute. Limitations in re-use have much to do with the cost of transmission lines for R-1 water. Parabicoli is a strong advocate of aggressive water conservation measures, and said he’s greatly encouraged by the recent hiring of a conservation officer or “water marshal” position in the Department of Water Supply. In California, similar positions allow enforcement of overuse violations like irrigation overspray, wasteful practices such as home car washing with the hose running and failure to comply with storm runoff best-management practices. Properly managed watersheds need not result in massive runoff to the ocean, according to the conference speakers who serve as resource managers. Scott Fisher of Maui Coastal Land Trust, Chris Brosius of the West Maui Mountain Watershed Partnership and Alison Cohen of the Nature Conservancy all described the importance of a healthy upslope watershed as a basic management strategy in our water equation. A student panel further emphasized the point, relating that replanting and refor-

estation efforts are vital. “Once you volunteer, you’re hooked,” one high school student said after helping with replanting efforts with the Leeward Haleakala Watershed Restoration Partnership. “It’s important to put in to the system, not just continually take out.” Such common sense declarations were prevalent over the two days of the Water Forum. Perhaps the most accessible of solutions offered were those explicated by ‘Iao Valley resident John Duey, long time owner of Duey Irrigation and President of Hui O Na Wai Eha. “Something has to be done about our water,” he said. “We can’t go on the way we’ve been doing.” His five-point plan included: • Conservation, which goes hand-inhand with watershed protection. • Recycling. “Why pump usable R-1 water into the ground?” • Recharge. Studies show that stream restoration will replenish our overpumped aquifers. • Condemnation of Wailuku Ag/Wailuku Water Company. These lands and water transmission systems should be held publicly, not privately. • Storage. We should increase county capacity to one billion gallons. “The Water Forum proved two things to me,” Lucienne de Naie, a Huelo farmer, community activist, panelist and Water Forum organizer, said at the forum’s close. “One, that there is considerable interest by many people in our community to see a shift in how we can more fairly share the use of our water resources for the future. And secondly, that this will only happen if we can move from confrontation to collaborative thinking before we are forced to do so by forces beyond our control.” MTW

ard to believe it’s been a year since we last told you that it’s time for you to go out into the cold, rainy weather and buy things. Lots of things. And not for yourself, either—you must buy things for other people. Oh, the joys of living and working in the world’s most

powerful capitalist nation! But you can take heart in the fact that none of us finds this easy, so we’ve taken the step of coming up with a few suggestions for some of the individuals in your life whose potential gifts require a little extra effort beyond that of your typical friends and family. And no, you don’t need to thank us. We do this solely out of the kindness of our hearts, and because we couldn’t think of anything to do better this year. So take care, be safe and have a great holiday. And if you don’t put that incense-burning frog down right now we will totally cut you.

FOR THE SINGLE MOM FRIEND WHO REALLY NEEDS A BREAK:

Baby sitter and Pedicure $8.95/hr for sitting; $26 for the pedicure If there is anyone out there who needs a break, it’s the single mom. Believe us, we’ve been there. Don’t get her a new pair of shoes or even that really awesome pair of earrings that she’s been eyeing, she doesn’t have the time to enjoy them. Get her what she really needs–alone time with a man who will massage her feet. The Ka‘ahumanu Center has both. Kids love Maui Playcare, so she doesn’t even need to feel guilty about it. Le’s Nail Studio, Queen Ka‘ahumanu Center, Kahului, 873-7495. (SB)

FOR THE WOMAN WHO’S ALREADY PRETTY COOL BUT COULD STAND TO BE JUST A BIT COOLER:

Toe ring $18-$159 Toe rings are by far the best selling items in the eclectic Tropical Artware collection. They’re full-circle rings and are custom-fitted to each toe in question. You can get them in gold or silver and in a variety of elaborate styles, which you can also mix and match. Like the sistah, some of the rings are pretty simple—these are the ones in the $18 range—while others get down right complicated. Tropical Artware, Wharf Cinema Center, 658 Front St., Lahaina, 667-7100. (AP)

Commando Low-rise Panty or Thong from Josephine’s

panty or thong $25-$30 We’re torn here on what’s more tacky: the dreaded panty-line or accidentally flashing the bits. Most agree that going commando is a no-no, especially if you plan on getting drunk and sloppy in public. But there are a select few (your friend and some of us included) that venture out

sans panties on a regular basis. The solution? The Commando panty. Under clothes, it looks and feels like you’ve got nothing on, but if your friend happens to pass out spread-eagle in the parking lot you won’t have to fight off a bunch of creepy guys with cell phone cameras. She’ll thank you in the morning. Josephine’s Lingerie, 99 Hana Hwy, Paia, 579-6229. (SB)

FOR THE NEIGHBOR WITH THE GIGANTIC HOUSE WHO DOESN’T LIKE PETS BUT REALLY SHOULD HAVE A COMPANION:

Gigantic Tiger $3,450

Can we just say that this Gigantic Tiger at Serendipity is really, really gigantic? Seriously, it looks larger than even a real tiger—not that we’ve lately stood over a real tiger. Anyway, the tiger is stretched out on the ground, as though resting after devouring a gigantic gazelle or something. It’s magnificently painted in bright orange, but is just artistic enough to let people know that it’s not a real gigantic tiger. As far as we can tell, it eats very little, though we only hung out with it for a few moments. Serendipity, Queen Ka‘ahumanu Center, Kahului, 871-1116. (AP)

FOR THE CAT, AKA “THE HITMAN”:

Neptune’s Napper by Savy Tabby $59.99 Really, who else kills for you? Roaches, mice, and bedroom slippers shiver when your cat is around. While you sleep, he’s out there in the dark, stalking his prey. In the morning, carcasses line your porch like gifts. We know, it’s gross to shake rat guts from your favorite shoes, but he has the best of intentions. This Christmas show your appreciation by getting him a plush kitty-napper shaped like a gigantic goldfish. He’ll get the irony, and you’ll get more rodents. Since “New Dad” came along (conveniently after you paid your own way through college) it’s been yachts, Four Season overnighters and glittery baubles for Mom. So what do you get for a guy who changed your mom from housekeeper to world traveler with one swipe of his credit card? His own boat of course! Considering your student loan payments, he’ll understand that you can’t get him the real thing, but he will appreciate the detail and quality of an expertly constructed replica from Konrad’s. This is great because you can actually trick the child into thinking it’s an authentic animal by saying that it only wakes up in the middle of the night. ONO KINEGRINDS

BY ANTHONY PIGNATARO ANTHONY@MAUITIME.COM

Urban Sophistication Cafe O’Lei helps revitalize Wailuku Town Café O’Lei in Wailuku is the kind of place you normally find in a big city: long and skinny, tables set up on the sidewalk, dishes prepared with a kind of urban sophistication. It fits in beautifully in Wailuku Town, which is in the midst of a long revitalization effort.

Café O’Lei Wailuku 62 N. Market St., Wailuku, 986-0044. Open Mon-Fri. Breakfast: 7:30-10:30 a.m.; Lunch: 11 a.m.-3 p.m. $

There’s a Café O’Lei in Kihei, but the new one in Wailuku is quite different. The biggest reason is that it’s located on the first floor of the new Lokahi Pacific Pono Center in Wailuku Town. Four small apartments and nine offices are available for rent on the second and third floors, respectively, to low-income people. In addition, the majority of the spacious Café O’Lei kitchen is open for hourly rent to those who need access to commercial cooking equipment but

Hot Vegetable & Tofu Salad, Asian Marinated Top Sirloin Steak and Tiramisu with Carmelized Bread Fruit

can’t afford their own. That leaves Café O’Lei chefs Michael Bumanglag and Saul Siasat with a comparatively tiny space to work in, but they somehow manage to put out a surprising variety of really creative and tasty dishes. Mahimahi takes up a good chunk of the menu. There’s Blackened Mahi, served atop white rice with a ginger butter sauce and a tangy papaya salsa. And they’ve got Tempura Mahi and fries, Left to right: Chef Saul Siasat, Chef Michael Bumanglag Below: Onion Soup en Croute and the Crab Club

which is basically a high-end fish ‘n chips. Occasionally they’ll offer specials like Mahi with lilikoi butter sauce or Mahi with lemon caper butter. All come with a “petite salad” (a smaller version of their Caesar salad) and are outstanding. The café’s salads are colorful and creative. The Hot Vegetable & Tofu Salad is nearly a work of art: plenty of stir-fried vegetables and tofu chunks, served with baby greens, peanuts, chilis and a sesame vinaigrette that boasts a good kick. The Curry Chicken Salad is a huge array of chicken chunks covered in curry sauce, julienne vegetables, sprouts, baby greens and papaya salsa. On a rainy day, skip the salad and go for the French Onion soup, which comes with lots of onions and cheese and is served in a big bowl that’s topped with a delicious pastry that’s baked right on top. Even the café’s more pedestrian offerings like the Roast Breast of Turkey sandwich and the Bill Eby Burger are unique. The turkey sandwich is packed with meat, greens, sprouts, avocado and tomato slices

served on wheat toast. The burger is a monster, covered in cheese and grilled onions and comes with fries. But my favorite, the Crisp Boneless Chicken, is a delight—a chicken breast or two, fried, and topped with a wonderful Thai sweet chili sauce. Café O’Lei is only open for breakfast and lunch, but owner Dana Pastula says they should extend their hours for dinner in March, after they get a liquor license. For more information on some of the services Lokahi Pacific offers, call 242-5761 or visit www.lokahipacific.org. MTW

The Sweetest Art Exhibition Ever Friday (Dec. 14), 6-10 p.m. at The Sugarcane Clothing Co., Paia [ART] “Photography is an addiction, pure and simple,” local photographer Jessica Pearl says. “It’s a way of life for me that borders on compulsion.” Pearl (who used to shoot for Maui Time) has artistic compulsions that sound remarkably similar to a nagging sweet tooth. Ironically, this night of fabulous photography and great music is all about the always beautiful and ever controversial sugarcane plant. During the exhibition, DJ Durty will spin tunes while light pupus and wine are flowing. Attendees can also take advantage of a 10 percent discount on photography and 20 percent discount on everything else in the store. Cocktail attire recommended. Tickets: $5 donation to the Paia Youth and Cultural Center suggested. For more information visit www.jessicapearl.com or call 579-8760. [STARR BEGLEY]

ThIS WEEK’S PICKS by Starr Begley

Hawaiian Style Christmas Friday (Dec. 14), 7:30 p.m. at the Iao Theater, Wailuku [STAGE] The kids of St. Anthony Jr. and Sr. High school’s Drama Club are putting on a production of Wayne Moniz’s A Hawaiian Kine Christmas Carol. Good old St. Anthony is my alma mater and I can tell you that, for a fact, this is gonna be good stuff–we Catholic school people know how to put on a good show, especially one about guilt. The play is about a “Scrooge” who lives and learns in, you guessed it, Sprecklesville set in the late 1800’s. I get a good chuckle that Scrooge lives in Sprecks. How apropos. You don’t want to miss this, folks. Tickets: $7, $4 249-0234 or MauiOnstage.com.

Frame of Mind Friday-Saturday (Dec. 14-15) 10 p.m. at Charley’s in Paia [MUSIC] I’m having difficulties describing the sound of the popular, always ontour band Frame of Mind. At first I thought, Red Hot Chili Peppers and then I was like no, this is kind of old school Woodstocky but then finally I decided that I didn’t know what the hell I was talking about. What I can say for sure is that they infuse funk, rock, reggae, Latin, fusion, psychelic and blues sounds and that they are totally groovable and oddly obsessed with the color purple. Purple, I might add, has long signified both royalty and death. Anyway, Charley’s is gonna be decked out in an exotic purple theme and on Friday, the person sporting the best purple costume will win a nifty prize. Dress to impress… in purple. Tickets: $15. For more info call 579-9453 or visit www.frameofmindlive.com.

[MUSIC/DANCE] Makana is considered to be the youngest living master of the Hawaiian Slack Key guitar. Don’t ask me who decides this stuff; I just report what’s being said. It could possibly be that he’s opened for Sting and Santana, had a Grammy nomination in 2006 and has won too many awards to list. Between slack key sets, the Nomadic Dream Belly Dance troupe will be performing, which is just awesome because belly dancers rock. Or would that be wiggle? Whatever they do, they’re hot. Kind of like Makana. Tickets: $20, 874-9642.

FILMCRITIQUE

BY COLE SMITHEY COLE@MAUITIME.COM

No You’re Not Barren Sci-fi Horror Bites the Hand That Wrote it Director Francis Lawrence (Constantine) was clearly not the best choice to helm the latest adaptation of Richard Matheson’s 1954 classic scifi/horror blender. Will Smith plays super-buff military virologist Robert Neville, the last man alive after a cancer-cure virus wipes out all of civilization—at least in and around Manhattan, where Neville hunts deer from his Mustang GTO and holes up inside his West Village home fortress.

I Am Legend

★★★★★ Rated PG-13/100 min.

It’s a sad day when a legend can’t even hail a cab

best horror movie to come along in years. Even A Boy and His Dog in 1974 carried a stronger punch than this visually transformative but thematically weak movie. I Am Legend kicks off with a promising flashback television news interview where an uncredited Emma Thompson plays a doctor demurely confirming that she has discovered a cure for cancer. The cure turns out to be a man-made virus, but it proves to be a narrative ruse as the scene cuts to Neville hunting hordes of deer. The damning thing is that he never even man-

ages to shoot one. When Neville finally gets an easy target in the middle of abandoned Times Square, he gets beat out by a lioness and her male companion. Neville settles for opening up a jar of pasta sauce and canned vegetables. There’s insult added to injury when Sam refuses to even eat the vegetables put on a plate the same size as Neville’s dish. Dream sequences transport us back to Neville’s reality some three years earlier when his wife and daughter attempted to escape New York before its bridges fell

Photo: Darryl Wong

With his German shepherd Sam as his sole companion, Neville works in his home lab to find a cure for the pandemic that has turned infected people into flesh-eating vampires that come out nightly to feed. Once you get past the film’s impressive visuals of a desolate Manhattan moldering amid asphalt-breaking weeds, the story settles into a run-of-the-mill chase movie punctuated by Neville’s emotional pain. Absent is the level of social allegory that make Stephen King’s The Mist the

along with the population of the city. Now, Neville broadcasts an invitation on AM radio for any survivors to meet him at South Street Seaport where he goes every day at noon to wait for any sign of life. With the city crawling with infected zombies Neville excels in capturing rabid test subjects for his research. He straps the toothy hairless creatures down on his examination table to howl at the effects of trial medications he pumps into them while taking copious video notes and keeping a Polaroid bulletin board file that makes him seem like some twisted serial killer. For a movie made up of a few genuine shocks and some memorable special effects, it’s surprising how little suspense there is and how little story the filmmakers expect to coast on. Like most American movies, this one has a revenge theme that runs a mile wide. If our fearless protagonist comes up a little short when he acts irrationally out of rage, it’s all right because a ghost in the screenwriting machine can rescue him. That kind of mechanical device might have worked for filmgoers 50 years ago, but it doesn’t cut it now. By the standards of I Am Legend, humanity was wiped out before the movie was made. MTW

The Bridge Jai Uttal connects the temple and the nightclub through world fusion music I never made it as a Hare Krishna. There were just too many different gods going on. It’s not that I didn’t give it the ol’ college try. The whole Hindu thing seemed really hip for a while—gorgeous temples, interesting people and captivating music. But what it came down to was that it just felt too hedonistic and human-oriented to qualify in my book as a suitable religion. I was baptized Catholic, and we need guilt and pain to feel okay with ourselves. But I continued to focus on hedonism—in the clubs, on the streets and in the backseat of cars. It worked great. With the excitement and liberation of the party scene came ample amounts of things to talk about in the confessional every week. World fusion musician Jai Uttal, who’s bringing his music to Maui on Dec. 16, took a different path. The whole India kirtan, ragas, sarid, baul, chanting thing was what he needed to center himself, and it stuck.

Kirtan is the act of singing sacred hymns–it’s a form of worship and is said to promote healing. The difference between Uttal and many of the other artists who perform this type of music is that he chants to really dope beats. In fact, Uttal describes his music on Myspace as, “Crazy Indian music mixed up with Appalachian hillbilly stuff and some reggae and trip-hoppy hippy jam music and jazz and R&B and electronic with vocals and chants and lots of exotic instruments and hopefully lots of heart and passion and devotion.” Basically, Uttal tries to bridge the gap between the sacred and profane–the

temple and the nightclub. Sounds kinda blasphemous, but the more I think about it, the more sense it begins to make. What better way to reach an audience than by going to it instead of waiting for them to come to you? I mean, Jesus did hang out with tax collectors and prostitutes… In 2002, Uttal’s album Mondo Rama (Everything is God) was nominated for a Grammy as the “Best New Age Album.” Today, he travels the world sharing kirtan with both large and small audiences. Originally from New York, Uttal’s interest in music began as a young child while learning classical piano at the age of seven. He can also play the banjo, harmonica and guitar. But it wasn’t until he traveled to India as an adult, studying Hinduism and Buddhism as well as spending time with the Bauls—the mysterious wandering street musicians of Bengal—that he found the groove which

would become Jai Uttal and the Pagan Love Orchestra. “A few really important things happened in my life,” he says on his Myspace page. “I met my Guru when I was 19 and what was a planet lost and spinning out of control was pulled into an orbit of love, longing and spiritual protection. Of course, I promptly got lost again until, after many years of running, I entered a drug treatment place and restarted my life, my heart and my soul. I actually feel that my Guru saved my life…I guess that over the years music, particularly chanting, has been my salvation, my spirit connection and my life support system.” Amen to that. Or would it be Om to that? MTW

SAGITTARIUS (NOV. 22-DEC. 21) As you revisit half-forgotten haunts from your past, you’ll probably encounter pieces of yourself you thought you’d left behind forever. That’s part of the deal. Luckily, it’s not all bad, and neither are these old incarnations of you. Each of them has positives and negatives, and something to teach or remind you that will enhance who you are today. Try to welcome them like old friends and acquaintances, with as open a heart and mind as you can manage. Chances are, you’ll leave the whole experience feeling better about who you’ve become then you ever have.

CAPRICORN (DEC. 22-JAN. 19) Here’s your week: You’re cruising along the side roads, making steady progress, and finally you pull onto the highway—and your engine dies. At the very moment the road opens up before you, giving you the freedom to really cut loose, something’s likely to keep you from hitting the gas and speeding down it. Don’t get frustrated when gazing down that long, promising, inaccessible highway. Because this is likely to happen, I recommend picking up any sexy hitchhikers you might pass along the way—then at least you’ll have their company while stranded in limbo, which might make it not so bad.

AQUARIUS (JAN. 20-FEB. 18) Jump the gun. Though you’ve been patiently waiting for the starting pistol to go off before you run this race, it’s totally okay (and even wise) to get a head start when you can. This will help a lot when unforeseen (except by me) disasters, delays, and obstacles crop up. Get going now, even if it seems like you have more than enough time to finish this race twice over, so when shit happens, you’ll be so far ahead of the game you’ll manage to finish on time anyway. Anyone who’s got a clue will be seriously impressed.

PISCES (FEB. 19-MARCH 20) Because you’re such complex, multifaceted creatures, many Pisces have trouble bringing all the different aspects of yourselves to the table when tackling any given task. This week is all about learning how to show up for the job with all the useful tools you have in hand, and leave the clown noses and dog collars at home until you actually need them. The most successful Pisces I know are able to change up a situation so that it will bring out the best in them. The sooner you can figure out what you need, and master how to manifest it, the sooner you’ll be able to bring all of yourself to everything you do.

ARIES (MARCH 21-APRIL 19) I know you hate this job, but this week you’re our official Bubble Burster. I think you despise doing this mostly because so many of your own hopes and dreams have been dashed over the years, and you know exactly how awful it feels. Use that experience to make you a kinder, gentler Shatterer of Dreams. Sometimes breaking down someone’s unrealistic expectations is actually the nicest thing you can do, since tearing those down will force them to build up some new, hopefully more achievable goals. Take heart. Those whose hopes you trample may despise you now, but they will love and thank you later.

TAURUS (APRIL 20-MAY 20) This week’s mantra: It’s not your job to educate people. Sometimes that is your job, but I’m afraid in this case these dolts are too stupid to get it, no matter how simply you put it. You’ll just have to work around them. Dispassionately consider them as obstacles, and plan a route circumventing them that will still efficiently allow you to arrive at your destination. Sometimes it’s a good idea to put in the time to try to transform adversaries to allies. These guys, however, just aren’t worth it. They’re speed bumps and lamp posts, no more.

GEMINI (MAY 21-JUNE 20) Be a jellyfish. Forget having a backbone or standing tall but instead be fluid, transparent, and apparently harmless. Remember that most jellyfish are venomous (some lethally so), despite their seeming helplessness and beauty. Being bold and righteous may make you feel powerful, but it’ll only needlessly make you a target. Chill out and act squishy and spineless. You might take a more circuitous route to get there, in the end, but eventually you’ll float gently to your destination without a problem. What’s more, you won’t feel like you had to work that hard for it; it’s likely to feel more like you’re coming back from a vacation.

When you ask advice, you usually already know what you want to do. You’re actually just seeking permission or validation. There’s nothing wrong with that, but it might not be the best strategy when your advisors don’t give you the advice you want. It’s good to listen to your friends’ counsel, but in this case your instincts are paramount. No one else can know what it’s like to be in your shoes. What seems right from their perspective just isn’t, from yours. You know what you want to do. Stop fishing around for reassurance and just do it.

LEO (JULY 23-AUG. 22) I advised your Gemini buddies to chill out and drift and appear helpless this week. I wish I could give you the same advice, but I’m afraid you suck at hiding your power, and you’re already too much of a target for that strategy, in any case. You might as well stand up and take the most direct approach you can think of. That, of course, is likely to make you even more of a target than before. Luckily for you, you’re a tough little Lion, and they probably won’t be able to do much more than slow you down (and perhaps wound your ego just a bit; that, too, however, should be sturdy enough to take it).

VIRGO (AUG. 23-SEPT. 22)

HAPPY HOLIDAYS from the staff of

Bugs don’t get glass. They’ll hurl themselves against it until they die, trying to reach the sun they see. Sadly, I’ve seen humans act like this, too. They’ll hit an obstacle they don’t quite understand and they’ll try the same thing again and again trying to get through it or past it, confounded and confused when they always fail. I root for the bee trapped behind the glass, and hope she’ll try moving two feet to the left, where the open window will allow her egress. I’m rooting for you, too. I hope you’ll soon stop doing the same thing you’ve done a thousand times before, which has never worked except by accident, and instead try something completely different and new.

LIBRA (SEPT. 23-OCT. 22) It’s all about love and hate this week. Basically it’s a simple equation: you’ve got to use what you love to get through what you hate. Without keeping all the people and things you adore firmly in mind the entire time, you might not have the fuel and wherewithal to do what you’ve got to do and finally get it over with. They’re the weight on the other side of the scale that will keep you from going completely out of whack and falling down, hard. They’re also the ones who’ll be there for you when you’ve finally gotten the hard shit done, to comfort and celebrate with you.

SCORPIO (OCT. 23-NOV. 21) Worry, worry, worry! What are you, a Cancer? Since when did you become the zodiac’s chief Nervous Nellie? Sure, you’ve got problems. You’ve got fears. But you’ve never before let them eat away at you like this. Look at you, you’re all in a tizzy. I don’t mean to minimize your concerns; they’re legit. But please recognize that there’s very little you can do about them, at least right now, and, if it does anything at all, worrying is only likely to make everything worse. Do your best to take your mind off that shit and just enjoy what’s actually happening around you. Enlist some help if needed. I’m sure you know at least two people who’ll leap at the chance to distract you by any means necessary.

RESTLESSNATIVE

BY STARR BEGLEY STARR@MAUITIME.COM

The Naughty List I love Christmas. I love the lights and the music. I love that families pretend to get along if even just for a few hours. I like tracking Santa’s reindeer flight on the Internet on Christmas Eve, and I like eggnog. Too much. But this year, Christmas is killing me. At the very least it’s doing nothing good for my irritable bowl syndrome. Like most young local families that don’t gamble on chicken fighting, we’re broke. I’ve been robbing Peter and Paul all month to fill everyone’s stocking. And while this definitely puts a damper on things, the lack of funds isn’t what’s threatening to snuff out my Christmas spirit. It’s the kids. No, not just my kids (though my daughter seems to be trying real hard to get on the Naughty List)—it’s kids in general and the fact that the majority of them seem so damn superficial and materialistic. For example, The Maui News (pg. C12 in their Dec. 6 issue) ran a whole page of letters to Santa written by first and second graders from a local school. When I sat down to read it, I was feeling pretty festive. I love letters to Santa! But by the time I finished, my jaw was hanging open, having just dropped an “F” bomb or two. Not that the way the kids misspelled words wasn’t totally adorable, or that each letter written to Santa was a reflection of who that child was, but the overall effect of the letters was disheartening. Sure, some of the kids wanted normal stuff like Pokemon, teddy bears, fishing poles, make-and-do kits and such, but the majority want stuff that adults are into. IPods were a biggie, as were specific “hip” cell phones. Some kids asked for make-up, and one even specified that she wants Victoria Secret soaps. I understand that kids enjoy emulating their parents and that it’s not a six or seven-year-old’s fault for wanting grown-up gadgets or stuff from a lingerie giant. And a lot of people will argue that there’s nothing wrong with an iPod or cell phone and that lotion is just lotion, even if it’s sold in a catalog that millions of young men hide under their mattress, but still… Don’t you think that there will be lots of time for kids to use technology, and why the hell does a six year old need to smell sexy? Kids need to be taught that there is kid stuff and grown-up stuff. You won’t find my daughter asking Santa for a riding crop and Lucite heels. That’s because she’s a kid and no matter how cool she may think mom’s stuff is, it’s out of her league and she knows it. Of course, one year she came back from her winter trip to the mainland with her dad and after opening the presents, the first words out of her mouth were, “That’s all you got me?” I would have stuffed her bad attitude up the chimney if we’d had one. Then again, she tends to even things out by being equal parts materialistic and conscious. For example, she doesn’t like real Christmas trees because, “It took so long to grow and now it will die… Because of you, Mom.” I have to give her props for that one, even if I can’t take responsibility for her soft heart. I’d totally kill a tree to have my house smell like Christmas for a month. But after reading the letters that other kids her age wrote, I tentatively asked what she planned to ask Santa for this year. Her answer? A trampoline. Shipping it to Hawai‘i costs $500. Suddenly, that iPod isn’t looking too bad. Starr Begley is currently experiencing reoccurring nightmares that involve Hannibal Lector, her husband and a Hibachi, though not necessarily in that order.
