Corporate Contributions & Furlough Cage Matches HYPER LOCAL A couple weeks ago I told you about HB2902, a bill that Akaku CEO Jay April warned would “effectively destroy” community access television on the neighbor islands. That bullet appears to have been dodged, and this week I spoke with April about another piece of legislation—SB707—that could give Akaku a much-needed dose of security. Testifying on Oahu, April said the bill, which would “designate an access organization to oversee public, educational, and governmental [PEG] channels on cable television,” safeguards against a potentially capricious state procurement process, which he called “contrary to why PEG access was established in the first place.” SB707 passed through the Senate Judiciary and Government Operations (JGO) Committee and now heads to the House. The House buried a similar bill in 2009, but April told me he’s hopeful “for the first time in years.” Meanwhile, Akaku, like many other nonprofits, has endured significant cutbacks; April said they’ve had to lay off about half their staff. “The old paradigm is changing,” he said. “We have to find creative ways to harness new media.” Two ideas he tossed out: buying a bunch of inexpensive flip cameras and letting them loose in the community for a segment tentatively dubbed “Flipping Out” (I suggested “Flipping Off”) and incorporating more Skype video reports (like the one MauiTime contributed to the now-on-hiatus Maui Daily segment) from all parts of Maui Nui. “Let’s get the bureaucratic stuff out of the way,” April said, “and get back to our mission: expanding our ohana and empowering local voices.”… Gov. Lingle graced us
with her presence last week, appearing February 11 at an event honoring Ronald Reagan and speaking the following day at the Maui Chamber of Commerce’s annual Governor’s Luncheon. A group of Furlough Friday protestors assembled near the King Kamehameha Golf Club in Waikapu where the Regan event was held (go to YouTube.com and search “Lingle Furlough” to see video), but activist and local Democratic Party Chair Lance Holter wrote in an e-mail that “she must [have] been driven through the cane fields because we didn’t see her come by at the entrance.” Considering the nearly two decades she spent as a Maui public official, it’s always amazing how little fanfare accompanies Lingle’s Valley Isle visits. If I didn’t know any better, I’d think she was avoiding us….
LOCAL Meanwhile, Lingle’s war of words with the teachers union rages on. This week, the Hawaii State Teachers Association (HSTA) filed a prohibited practices complaint against the Governor, claiming she didn’t have the authority to kill an HSTA proposal that would have restored some instructional days. In a statement, HSTA President Wil Okabe said Lingle “has never shown the slightest willingness to move off of her position” and instead “clings stubbornly to her mantra.” That’s when Lingle took the gloves off: “HSTA’s latest action proves once again that the union leaders care more about money than educating Hawaii’s children,” she said in a statement of her own, adding that the union “sees their chance to squeeze more money out of taxpayers slipping away.” At this point, we need to throw Lingle and Okabe into a cage and let them have it
out, MMA style. Probably could sell a lot of tickets—maybe enough to get the keiki back in the classroom…. Even if you don’t know it by name, you’re probably aware of the Supreme Court case Citizens United v. FEC, in which the court ruled 5-4 to lift restrictions on corporate-backed campaign ads. It’s the one President Obama referenced in his State of the Union address, eliciting a head wag from Chief Justice John Roberts. There’s another case, closer to home, that you may not be aware of: Tavares v. Wong (the “Tavares” in question is our own dear Mayor). That ruling, which came down in favor of Tavares in August 2007 and was upheld on appeal, also eroded limits on corporate campaign contributions. Now, both cases are being cited by state Sen. Les Ihara, who introduced SB2918, which “prohibits persons other than individuals from making contributions directly to candidates or noncandidate committees, except through noncandidate committees”—not a complete roadblock, but a significant obstacle. “Our freedom of democracy is in peril, unless the legislature takes steps to preserve it,” Ihara said in a joint release with Common Cause Hawaii and the League of Women Voters. Campaign finance reform always faces an uphill battle—it’s like asking foxes to curtail their own access to the henhouse. That said, as of this writing, SB2918 was still alive….

What would the reaction have been after the planes hit the buildings, and it was revealed the perpetrators had the same grievances? Impossible to say for sure, but it’s a safe bet the front page of The Maui News wouldn’t have featured a headline that read “Highjackers’ views on U.S. foreign policy shared by many,” accompanied by a story questioning whether the attacks were an act of terrorism. And yet that’s exactly what we got last week, after a disgruntled tax protestor crashed a plane into a Texas IRS building, killing a government employee. “Man’s views on taxation shared by many” declared the AP story printed on page A1, while another AP dispatch titled “Attack on IRS building prompts a debate over ‘terrorism’ label” appeared above the fold on A7 (to be fair, that story did quote Muslim representatives who pointed out the hypocrisy). People are always complaining about the media’s liberal bias. Ironically, those complaints usually come from extreme, anti-government right-wingers, who are now enjoying pretty much a free pass after a deranged member of their ranks committed an act of, yes I’ll say it, terrorism. Of course, just because a murderer believes some of the same things you do doesn’t mean you’re complicit in his crime. But tell that to the innocent Muslim Americans (and non-Muslims who looked like they might be Muslims to ignorant, frightened bigots) who were attacked and, in some cases, killed after 9/11. Something tells me we won’t see a similar backlash against the Tea Partiers. ■
Imagine if, in the months leading up to September 11, 2001, domestic Muslim groups had held vehement, highly visible protests across the country denouncing the United States’ support of Israel and military presence in the Middle East.

The Merrill Lynch Meltdown Maui County is suing over an investment gone bad, but the State is in even deeper
L
ast Thursday, the story hit that Maui County was suing Merrill Lynch. The County’s primary complaint is that a $32 million dollar investment in Auction Rate Securities (ARS) was recommended by Merrill when the firm knew those investments were on shaky ground. Buried deep in a February 18 Maui News story was a notation that the State of Hawaii has “almost a billion” dollars in these same investments, or about one-third of its total assets. Did you just do a double take? If not, you should have. Although at the federal level a billion dollars doesn’t seem like much, especially lately, at the State level it’s a monstrous number, capable of dramatically affecting our lives for years to come. This is a very big deal and worth examining further. There appear to be three main questions: How much are the ARS the State and County are holding really worth? Why is the interest the ARS are paying so low now? And finally, how did our state and local government get themselves into this situation in the first place: were they incompetent, misled or just unlucky?
Did the State Just Lose a Billion Dollars? These investments do appear to have some value. Last December—when this story should have taken off—state Budget Director Georgina Kawamura met with legislators at a joint briefing with the House Finance and Senate Ways & Means committees. At that hearing she said the State “would take a $200 million actual cash loss if we sold them now, and income from reinvestment would be less than we are getting.” The problem is, no one knows what these ARS are worth because there’s no “market” or place to sell them. In the absence of comparative sales, it’s simply not possible to assign them a value. There’s guidance available in a standard called FASB 157 (Financial Accounting Standards Board), but, based on companies that have applied the standard, it’s obvious that it’s not much help. As of May 31, 2008, 402 publicly traded companies had reported holding ARS on their books, and only 185 had written some of them off. One company, IncrediMail, Ltd., wrote off 98 percent, while Warren Buffet’s Berkshire Hathaway didn’t write them down at all. Both were following the same rules, but the range of write-downs shows this provides no guidance at all. IncrediMail is an unknown company, but if they’re right, the state did indeed lose a billion dollars. Fortunately few
agree with them. The Budget Director’s assessment (that the state has lost $175 million) is right in the middle of the pack relative to the writedowns others have taken, which appears reasonable but not conservative. Yet the possibility remains the ARS are worth far less; until a willing buyer is found and a deal consummated, it’s up in the air. What Happened to That High Interest? When Maui County made these investments, the interest promised was 1.79 percent. Right now, the County’s reportedly getting $4,041 a month. Simple math shows they’re making less than 10 percent of the promised rate, or a 0.15 percent return on a $32 million investment. The state Budget Director also shared that if they held their ARS holding to maturity— which was as long as 35 years given the mix—they’d receive 100 percent of their par value back. Yet when you add a little market knowledge, these two statements don’t

including most of the SLARS (Student Loan Auction Rate Securities) that the County invested in, had no penalty rate, so the borrower had no motivation to repay. How the rate became so much lower than the rate the County bought them at would require an examination of the underlying document for each of the types of SLARS that the County purchased. This might include adjustments for written-off loans during the period, a reset to the current money market rate (currently a small number close to the actual interest), or other provisions of the security not possible to identify without access to them. The County hopefully has examined their holdings and knows why their interest is so low. In general, Thomas is not a fan of these investments. “Six years ago when I worked for the largest Swiss bank…I talked to the trading desks and our fixed income department while doing research…and no one could explain how they were formed, how the interest rates were parsed,” he says. Despite being told “they were just like cash
No one knows what these securities are worth because there’s no “market” or place to sell them. make sense. These investments, if held to maturity, are supposed to represent money loaned to students, municipalities, etc. When issued, most notes pay a fixed rate of interest and also have a fixed value (the loan balance). Over time the investor receives that fixed rate of interest and their principal back as the loan amortizes away. So why did the interest rate drop dramatically? For the answer to this question, we reached out to Brian Thomas, a local money advisor with his own firm who manages tens of millions of dollars for others. He doesn’t know specifically why the County of Maui bonds are paying such a low rate, but he can describe some general principles. These long-term notes normally pay interest at the rate of the last auction, which used to be regularly held. Some of the ARS had a penalty rate that was quite high if the auction failed, which they all did when the market collapsed in February 2008. This forced many of the borrowers to repay the securities to avoid that high rate. However this penalty rate was not a contractual feature of all ARS. Many,

with little risk as auctions rarely ever fail” he ultimately decided not to invest his clients’ money in them when he couldn’t find any third-party research. How Did We Get In This Mess? The market for these products is only about two decades old. The investments themselves and the supporting auctions were created by the largest brokerage firms, and since 1988 those regular auctions have been held generally without incident. However, during the financial crisis in 2008, the liquidity tightened as fewer and fewer buyers came to the market. Many investors, including companies and municipalities, were caught by surprise when the various ARS markets collapsed almost simultaneously. When the investments were originally purchased, these otherwise long-term securities were being regularly traded at an auction, generally held every seven to 28 days, depending on the ARS and the market maker. Since they were resold regularly they > Continued on page 7

> Continued from page 5 were classified as short-term investments, something required by Hawaii law for both State and County investments. Unfortunately, when the open market screeched to a halt, it converted these from short-term cash investments into very longterm holdings, as the provisions of the
fluctuation being the rate of interest they would have to pay, which was reset at every auction. In principal, the buyers were expected to be able to sell ARS to other buyers at the periodic auctions, not force repayment from the borrowers. Knowing this is important to understanding the County’s case against
At the same time Merrill Lynch—which held the ARS auctions—was aware that the auctions were struggling, its salespeople were telling County officials exactly the opposite. security said if the auction failed (which was expected to happen only occasionally) the borrower wasn’t required to repay immediately. For the borrower, the security was a long-term one by design, the only
Merrill. At the same time the company— which held the ARS auctions—was aware that the auctions were struggling, its salespeople were telling County officials exactly the opposite: that there was no
problem with these investments. The County says it was misled, but Merrill is defending itself by arguing the salespeople and the market makers didn’t talk to one another (and weren’t allowed to). Thomas has a different take: he doesn’t trust the major brokerage firms at all. “The brokerage firms could have wrapped this up in an orderly fashion, he says. “Instead of just abandoning the auctions, as they did, they could have stopped buying the market. He points out that Merrill Lynch sold the investments that ultimately bankrupted Orange County, California, more than a decade ago. “When these guys dupe a Warren Buffet, there was no way Georgina or Kalbert [the state Budget Director and County Finance Director] can be expected to know any better. Where Do We Go From Here? Last year, the SEC intervened and forced the major brokerages that created these investments and held the auctions to repay many of the civilian investors they misled. The settlement also required that they make
efforts to settle with municipalities and other investors not included in the settlement by December 31, 2009. This didn’t happen. Thus the County chose to sue for “access to its ARS—which means Merrill would have to buy them at par value. Though Merrill will of course fight the case, it appears likely the County will have the same success that the civil litigants had last year, as the facts are identical. The State, on the other hand, doesn’t seem inclined to follow suit, possibly because, as comments from the state Budget Director indicate, the rate of interest the State is getting on its portfolio is more acceptable than the County’s. In the end, there’s a lot of money in distress that we haven’t heard much about. It appears the County (at least) is on the right track to getting out of this predicament. Whether they—and so many others—will avoid getting caught in the next financial bubble is another matter. ■To share or save this article, type: mt.hy.pr/upfront33

PRIDE COMETH BEFORE THE GAS CHAMBER In all likelihood, convicted murderer Paul Powell would have been sentenced to life in prison for his 1999 crime, but he couldn’t resist gratuitously ridiculing the prosecutor. Powell’s original sentence of death was overturned because of a technicality in Virginia law: The “aggravated circumstance in a murder that warrants the death penalty must be committed against the actual murder victim (whereas the prosecutor had proved only that Powell had also raped the victim’s sister). Powell assumed that the prohibition against “double jeopardy thus ruled out the death penalty and so decided to gloat, calling the prosecutor “stupid and taunting him with details of his crimes. For the first time, Powell admitted that he had also raped the murder victim. That was evidence of a new aggravated circumstance (i.e., no “double jeopardy), and the prosecutor obtained a death sentence. In January 2010, the U.S. Supreme Court rejected Powell’s appeal.
SUCKLES TO BE YOU Women’s rights activists in Uganda finally got the attention of the Western press in December, when London’s The Independent verified the plight of Jennipher Alupot, who for seven years had been periodically forced to breastfeed her husband’s hunting dogs as she was nursing the couple’s own children. Farmer Nathan Awoloi of Pallisa explained that his dogs needed to eat, and since he was forced to send Jennipher’s family two milk cows in order to win her hand, he felt his demands were reasonable.
TAKING (CIVIL) LIBERTIES In January, the Justice Department’s Inspector General released a longanticipated report detailing the FBI’s post-9/11 corner-cutting in obtaining individual Americans’ phone records. Federal law permits such acquisition only with a “terrorism subpoena (“National Security Letter) unless the FBI documents emergency (“exigent) circumstances to a telecom company. The Inspector General found that, from 2002 to 2006, the FBI had representatives of three telecom companies set up in the FBI unit so that agents could request phone records orally, without documentation, and in some cases merely
by writing the requested phone numbers on Post-it notes and sticking them on the telecom employees’ workstations. Some of the acquired records were uploaded to the FBI’s database.
DEARLY DEPORTED Police are still baffled by how Gregory Denny, 37, was able to “deport Cherrie Belle Hibbard from her home in Hemet, California, in January back to her native Philippines. According to Hemet police, Denny, with a gun and fake U.S. Marshal’s badge and shirt, knocked on Hibbard’s door and convinced her that he was there to escort her to the airport and out of the country and that Hibbard’s husband had to buy her the ticket. Denny then accompanied Hibbard through airport security and put her on a flight. Upon questioning by police later, Denny apparently remained in character, continuing to insist that he is a Marshal. Denny was arrested on suspicion of kidnapping, impersonating a peace officer and several other charges.
CLOUDY WITH A CHANCE OF CRAZY Buffalo, New York, television meteorologist Mike Cejka was arrested in December after a brief police chase and charged with trespassing after he was spotted at 4am tinkering with the covering of a motorcycle in a stranger’s yard. Cejka told police he was on his way to work at the station and had merely stopped to admire the motorcycle. He was wearing a dress shirt and shoes and leather chaps topped by a pair of sweat shorts.
THAT’LL WORK In February, the Board of Trustees of Saugatuck Township, Michigan, scheduled a May referendum asking voters for an increase in the property tax in order to cover unanticipated new expenses. The budget overrun was due to the mounting costs of defending lawsuits by people and companies complaining that the Township’s property taxes are too high. ■To share or save this article, type: mt.hy.pr/notw33

Re the February 18 News & Views story “Hidden Costs”: Thank you so much for writing this article. As a small hotel owner on Maui, Expedia, Orbitz, Priceline, etc. have taken a toll on my income. Impressive Feet OluKai supports local lifeguards, native plant restoration and, oh yeah, makes some pretty nice slippahs PHOTO FROM OLUKAI.COM
A
fter a day of running around in your rubbah slippahs, chances are you’ve thought, “Shoot. There’s got to be something better for my feet!” Locals Only footwear may be synonymous with the islands, but it’s not always synonymous with style. Fortunately, there’s a new player in the ocean footwear industry: OluKai (whose shoes are featured in the following pages). OluKai’s spring and summer 2010 line of fancy yet practical slippers and shoes caters a little heavily to men, but has some serious style and technology backing its designs. When Bill Worthington and his partners founded the company four years ago, he says his idea was to satisfy the more complex slipper consumer. “We saw a good opportunity. I felt coming up with a competing brand that catered to sophisticated tastes was a niche not yet exploited,” he says. “Being a shoe guy, I know footwear.” His shoe background started straight out of Art Center College
of Design in Pasadena when he was hired by Nike. After eight years with the shoe giant, he freelanced and worked with smaller footwear companies. Then a gig with a premium sneaker company planted a seed: Worthington wanted to create a legacy for his family and make an impression on the shoe industry. Although the company isn't from Hawaii, Worthington was born and raised on Oahu. He drew on those memories to cater to his ocean-loving clientele, with shoes biomechanically engineered for the mechanics

of the foot. He also wanted to give back to the islands, and donates part of the procceds from specific shoes to various organizations, including the Hawaii Lifeguard Association's Junior Guard Program, which gets funds from sales of both the Kia'i and Kia'i Trainer. The former slipper was nominated as product of the year by the Surf Industry Manufacturing Association, a notable feat for such a young company. 'Ohana is both a company line—featuring five men's and one women's design—and a
reciprocity concept, realized by the 'Ohana Giveback Program. The program has raised funds for Maui Cultural Lands, an effort backed by the Lindsey family to restore native flora in the Honokowai Valley. Every Saturday, Maui Cultural Lands works with volunteers planting, pulling weeds and restoring the area. OluKai employees are among the volunteers. Last May, OluKai hosted its first Ho'olaulea, featuring several ocean sporting events, Hawaiian games, a luau and hula dancing, awards ceremonies and entertainment by Paula Fuga. Events were held at Maliko gulch and the Ho'olaulea was held at Kanaha beach park. “The culture of our brand is to honor the islands,” says Marketing Director Kerry Konrady. “It has been a more fulfilling journey being able to learn from the people of Hawaii. It is teaching our…employees the culture of giving.” ■ To share or save this article, type: mt.hy.pr/ds33

Maui is all about contrasts: warm, surf-kissed beaches and chilly, towering volcanoes; barren craters and lush rainforests; bustling tourist havens and isolated local enclaves. So it is with fashion, as T-shirts and slippers stand sideby-side with chic dresses and designer jewelry. For the 2010 Fashion Issue, we tried to capture this eclectic spirit, letting a group of young people loose on the posh Westin Maui Resort & Spa to hang out, have fun and showcase some of the unique clothes and accessories that define Maui style—in all its contrasts.

is refreshing, especially in an age when a musician’s bedroom affairs are often discussed more than his or her albums. Maybe if more artists shared Matisyahu’s outlook, we’d be hearing an outpouring of quality on the radio instead of mass-produced synth-pop garbage. Febuary 28 won’t be Matiyahu’s first visit to the 50th state; he recalls having

eards are the ultimate facial accessory. You can pierce, pinch and color all you want, but when it comes down to it, the beard was there first. Nothing says, “I’m cool, smooth and in control” like a beard. Think of Moses, Abraham Lincoln and Paul Bunyan—all figures who’ve achieved legendary status, as well as being fine facial hair connoisseurs. Coincidence? I think not. With that in mind, who better to profile for our annual fashion issue than the gloriously bearded and incredibly talented Matisyahu? Matisyahu wasn’t always the calm, collected, magnificently bearded musician that we know today. Born Matthew Miller (Matisyahu is the Ashkenazi Hebrew and Yiddish pronunciation of Matthew), he spent part of his youth bumming around, following the band Phish and giving impromptu drum performances in parking lots. It’s rumored that he was almost kicked out of Hebrew school. But he’s grown from his experiences— grown in his faith and, yes, grown some facial hair. Matisyahu can’t name a point in his life when he became interested in music. “I’ve always liked music,” he says. “I grew up with music, and I wanted to be involved.” Among his influences, he names Bob Marley, The Allman Brothers, Phish, Nas, Outkast and Rabbi Shlomo Carlebach. Marty Goes Mental Scorsese’s latest is deranged and spooky, but not a classic Shutter Island
★★★★★
Rated R/138 min.
F
ederal Marshall Teddy Daniels (Leonardo DiCaprio) and his partner (Mark Ruffalo) are sent to the Ashecliffe mental hospital on Shutter Island to investigate the disappearance of a childmurdering patient, and once they arrive, it’s clear there’s a huge secret the tight-lipped staff isn’t telling. The details of the mystery get increasingly spookier, and Daniels’s grip on reality becomes shaky in the presence of the deranged inmates. This is Martin Scorsese’s first film since winning the Best Director and Best Picture Oscars for The Departed and his fourth collaboration with DiCaprio. While it’s better than the clunky Gangs of New York, it’s not on par with The Aviator or the film it’s been compared to, Scorsese’s remake of Cape Fear, which was a much more playful, tightly constructed thriller. Still, Scorsese is clearly having a lot of fun, with nods to
Psycho, The Silence of the Lambs and other horror and film noir classics. In addition to his remarkable gift behind the camera, the man really loves movies. The film faithfully adapts the Dennis Lehane novel, which I read and admired, but there’s something I need to address. There’s a (superior) movie written and
directed by William Peter Blatty (author of The Exorcist) called The Ninth Configuration, released in 1980, that has a nearly identical plot and the same surprise twist at the end. I’m not accusing Lehane or Scorsese of plagiarizing, but if Blatty decides to file a lawsuit, the makers of Shutter Island may have some ’splanin’ to do.
So next time, we call each other before getting dressed. Agreed?
presents...
DiCaprio’s performance is so intense, you expect his head to explode; as always, he seizes the opportunity to work with a great filmmaker and gives his grueling role everything he’s got. At times, his vocal inflections reminded me of a young Jack Nicholson. Jackie Earl Haley, Patricia Clarkson and Emily Mortimer have standout, scene-stealing cameo appearances, and Ruffalo and Ben Kingsley give performances as layered and thoughtful as DiCaprio’s. Then there’s Max Von Sydow, cast as a questionable authority figure. Scorsese gives him a great visual introduction and it’s no wonder: Von Sydow is 80 years old, has been in more than 100 movies and he’s still a compelling, effortlessly brilliant actor. Though very watchable, this isn’t a Scorsese classic: it’s overlong and, despite terrific scenes and exceptional acting, is mostly forgettable. Given how high Scorsese has set the bar, that’s a letdown. ■ To share or save this article, type: mt.hy.pr/film33

THE CRAZIES - R - Horror - The residents of a small Iowa town start to go a little crazy, and everyone pays attention to Iowa for once. I thought that was called the Presidential caucuses. 103 min.
Now Showing CELINE DION: THROUGH THE EYES - PG Documentary - A documentary chronicling Celine Dion’s 2008-’09 world tour, which, depending on your opinion of Celine Dion, either sounds like a fun date or Dick Cheney-approved torture. 117 min. CRAZY HEART - R - Drama - “Bad” Blake is a hard-living country music singer who’s had way too many marriages, too many years on the road and one too many drinks. And yet, he can’t help but reach for salvation in the form of Jean, a journalist who discovers the man behind the musician. Maggie Gyllenhaal and Jeff Bridges star. 112 min.
I LOVE YOU, GOODBYE - NR - Foreign - A woman is torn between a young flame and an older, but kinder lover. Then things get complicated. In Tagalog and English, with subtitles. 105 min. PERCY JACKSON AND THE OLYMPIANS: THE LIGHTNING THIEF - PG - Action - A teen discovers he is a descendant of a Greek god and sets off on an adventure, presumably stopping on the way to settle a few scores with bullies. Rosario Dawson, Pierce Brosnan, Uma Thurman and Logan Lerman star. 134 min. SHUTTER ISLAND - R - Drama - In 1954, U.S. Marshal Teddy Daniels investigates the strange disappearance of a murderess who escaped from a hospital for the criminally insane. Martin Scorsese directs; Leonardo DiCaprio and Mark Ruffalo star. 138 min. THE HURT LOCKER - R - Drama - An elite Army bomb squad unit lives and dies in a place where everyone is a potential enemy and every object could be a deadly explosive. Jeremy Renner and Guy Pearce star. 131 min. THE WOLFMAN - R - Horror - After returning to his homeland, a man runs into and is bit by a werewolf, meaning full moons seriously suck from now on. Emily Blunt, Benicio Del Toro and Anthony Hopkins star. 117 min.
DEAR JOHN - PG13 - Drama - A conservative college student falls for a soldier who is back home on leave. Channing Tatum and Amanda Seyfried star. 108 min.
TOOTH FAIRY - PG - Comedy - A bad deed on the part of a tough minor-league hockey player results in an unusual sentence: he must serve one week as a real-life tooth fairy. Dwayne Johnson, Ashley Judd and Ryan Sheckler star. 101 min.
FROM PARIS WITH LOVE - R - Action - A young employee of the U.S. Ambassador’s office in Paris teams up with an American spy to stop a group of terrorists planning to attack the city... and they aren’t showing any merci. Jonathan Rhys Meyers and John Travolta star. 95 min.
VALENTINE’S DAY - PG13 - Comedy - The inevitable seasonal rom-com centers on a Los Angeles couple making and breaking up over the pressures and expectations of Valentine’s Day. Jessica Alba, Jamie Foxx and Ashton Kutcher are among the star-studded ensemble. 140 min.

This Week's Picks Feeling Blue?
February 26-March 7 at Seabury Hall Performance Studio, Makawao, $5-$11
Saturday (February 27), 7pm at Mulligan’s on the Blue, Wailea
Les Femmes Savantes sounds seductive in French, yet translates to a prim and proper enough English title—The Learned Ladies. This domestic comedy predates the Brady Bunch and Everybody Loves Raymond by about 400 years, but features themes and characters that are still closeto-home: pretentious poets, an overbearing mother-in-law, a whipped husband. The original French text is set at the beginning of the French women’s liberation movement; the modern English translation by Freyda Thomas takes place in the 1950s, while preserving the original rhyming couplets and overall lyrical tone. In the Seabury production, the learned ladies are played by Tatiana Bradley, Ariella Brandon and Megan Kirton, who are infatuated with a couple of well-versed con-men (Miles Kelsey and Drew Streb). This grinds the wedding plans of Henriette (Scarlett Engle) and Clitandre (Hayden Ezzy) to a halt, to the frustration of their men, (Clyde Engle and Kai Spence) aided by Makena Wright and Gregory Gagliardi. The play is directed by Todd VanAmburgh, and costumes are designed by Marsha Kelly. 573-1257. [Sierra Brown]
In desperate need of a low-stress night? Don’t forget the advantages of being marooned on a pretty little rock in the middle of the Pacific. It’s February, and while elsewhere mothers are busy wrenching the X-box controller out of their teenage son’s hands to get him to help shovel the drive, here at home it’s time to enjoy a little Jazz on the Blue outdoors at Mulligan’s. Treat yourself to a peaceful night in Wailea, listening to some of the island’s best jazz musicians, including Toby Couture on vocal and keyboards, Shiro Mori on guitar, Paul Marchetti on drums, and Doug White on bass. The tunes will be accompanied by an “eat-as-you-please” buffet ($29.95)—yes, they’re trying to say all-you-can eat while sounding high-class. Whatever you want to call it, the offerings sound mouthwatering, especially for seafood fanatics. Start off with New England style chowder with clams, mahi mahi, rock shrimp and crab. For the main course, savor the roast prime rib au jus and seafood lasagna. Please refrain from stuffing the mini Bailey’s chocolate mousse tarts and flourless chocolate tortes with a raspberry coulis into your purse to later be guiltily devoured in bed; that would be the kind of thing someone might do at an all-you-can eat buffet, but god forbid one should be so crass at an eat-as-you-please buffet. Reservations recommended. 874-1131. [SB]

“Fly away to be free/On wings of uncertainty,” sings Makana, but there’s nothing uncertain about his music—it flows effortlessly, his slack key guitar smooth and unencumbered. Makana’s voice is sweet and deep, setting off the warm tones of the guitar nicely. The song “Neckstop Blues” is like a beach at midnight in the middle of summer. The lyrics cry out: “Sweet recycled dreams/ Baby they’re just blowing steam.” For fun insights into this creative mind, read Makana’s blog at blogs.myspace.com/ makanaworld. His recipe for a “Life Smoothie” is delicious, and I plan to mix up an extra-large one myself as soon as I find a blender that can handle “2 teaspoons of curiosity”—which I know is quite crunchy, and probably won’t mix well if my blender won’t even slice up a frozen strawberry. Check out Makana’s musical blend, dubbed contemporary world rock—a chunky rainbow smoothie loaded with rock, jazz, funk, ethnic and bluegrass—this weekend. 242-2787 or mauiarts.org. [SB]
If last night at 2am you were screaming at the coiffed blonde on the Game Show Network that obviously the most important item a man packs on a trip is his pillow, maybe it’s time to stop watching and start playing. It’s easy to coolly chuckle at the fool picking “C” when the answer is obviously “A” from your cozy suede couch, but it’s another matter entirely when it’s your ass in the hot seat. Maui now has its own traveling game show team, Gameshow Fanatics, which will hit Lulu’s in Lahaina next Friday. The first trick of the night is a realistic set for Family Feud. Dick Dawson and Vanna “What?” are sure to rile competitive spirits and stir up a raucous, fun night, reminiscent of the glory days of the ’70s. Keep Dick company by emptying half a bottle of gel in your hair and wiggling into the purple flared jeans lurking behind the socks in the bottom dresser drawer. You know you want to. 661-0808. [SB]

Da Kine Calendar BIG SHOWS MAKANA - Sat, Feb 27. One of the hottest young musical protégés to emerge from Hawai‘i, on both the slack key and world music charts, Makana plays his own style of contemporary world rock. With a firm foundation in the traditions of ki ho‘alu — Hawaiian slack key guitar — Makana adds the influences of folk, rock, ethnic, bluegrass, jazz, traditional, ambient and classical music to create a style all his own. Known as a musical world time traveler, channeling inspirations from many places and times through his voice, fast fingers and guitar, Makana brings them together as one, with ground-breaking new works and reanimated classics. His music transcends category and trend by integrating eclectic elements from diverse musical sources into his traditional Hawaiian slack key, to create his arrangements. The result is pure innovation, and the charting of new sonic frontiers. Tickets: $32. BAMP PROJECT wakes up Maui with artists that challenge themselves and their listeners with their rich, exhilarating music. Matisyahu is a Hasidic Jew who hails from New York and has found, or better said, created, his niche in reggae music that explores religious conviction without sounding trite. His music is accessible to people of all belief-systems, drawing people in on the basis of the passion he himself feels for culture and religion. Matisyahu’s new album, Light, is an exploration of his years studying the Torah, with an emphasis of the story of the Seven Beggars by Reb Nachman, guided by his teacher Ephram Rosenstein. “I feel this theme, though written as a fairytale in the 1800’s, is very relevant to many of the struggles that we face today,” Matisyahu says. “From child soldiers to child sex slaves to everyday people trying to awaken their broken hearts.” $25. 5 p.m. Lahaina Civic Center, ; http://mauivents.com/ uncategorized/bamp-it-up/

661-9913; www.groovetickets.com PINK MARTINI - Thu, Mar 4. Their latest is titled Splendor in the Grass, clever too as their name evokes splendor in a glass. But let’s quit skimming off the top--Pink Martini downright rocks. “Pink Martini is a rollicking around-the-world musical adventure … if the United Nations had a house band in 1962, hopefully we’d be that band,” writes Thomas Lauderdale, bandleader and pianist of the eleven member ensemble. And while I hate to pull from other journo’s work, Variety did a darned-good job saying, “no matter how Pink Martini gets described, there’s always an element being overlooked, a reliance on phrases such as lounge, cosmopolitan rumba or neo-classical, that only tells part of this rich story. Impressive at every musician’s station, this ensemble produces music that’s charming and elegant.” General public tickets go on sale Thursday (Feb 4), so hurry and get yours. Ooh! sign.language.astrology@gmail.com PISCES (FEB. 19-MARCH 20) There’s such a thing as cutting someone too much slack. At some point, enough is enough. If they really suck that bad (or are that flaky, dishonest, or irresponsible), cut them loose. I admire your kindhearted generosity, except when it gets the best of you or those around you. It’s not your job to take in every stray and charity case—especially those who are determined to sabotage anything good in their lives. Let them go hang themselves on someone else’s time and in someone else’s space, if they can find anyone. Don’t be the softhearted sucker this time around.

ARIES (MARCH 21-APRIL 19) You don’t usually need encouragement to step up—sometimes for opportunities, relationships, and scenarios you’re entirely inappropriate for! However, here’s something that would be (relatively) perfect for you, and you’re too shy, lazy, or nervous to actually raise your hand and take it on? I’d be proud of you if you’d managed to avoid one of those messy, sketchy situations you all too often get mixed up in—but this hardly qualifies. Take a closer look. It’s pretty likely you can properly pull this thing off, so jump in quickly, before the window of opportunity closes forever.

TAURUS (APRIL 20-MAY 20) You’re not psychic (at least not in this case), so even though you may think you can predict the future and see how this is all going to play out—you’re dead wrong. There are surprises ahead. However, they’ll only manifest if you’re truly open-minded here. Of course, you can still stubbornly make your predictions into self-fulfilling prophecies, if you prefer—but I hope you don’t (especially since the scenarios you envisage aren’t particularly uplifting or happy ones). Besides, by going that route, you’d be cheating yourself out of a much more interesting, inspiring, and rewarding story.
GEMINI (MAY 21-JUNE 20) Most of us have fallen at least a little short of what we dreamed for ourselves ten years ago (while a lucky few met or surpassed those dreams). However, we’ve all learned a lot—and hopefully those lessons can translate into making our more recently conceived-of goals more achievable. Don’t be disheartened that some of the dreams imagined by a younger, less realistic you have proven to be (at least so far) impossible. Many of those you came up with a decade ago required luck or other elements you simply had no control over. Your new dreams are ones that will test your actual skill and determination—and thus can be ones to be proud of.
CANCER (JUNE 21-JULY 22) We all occasionally have cause to regret or rethink the decisions and choices we’ve made. It’s okay to indulge in these kinds of feelings once in a while—remembering the whole time that there’s pretty much nothing you can do about those choices, which brought you to this place. Longing for the supposedly better life other decisions might have brought you should be limited to occasional wistful (and short-lived) daydreams. The rest of the time, but especially this week, you should concentrate on making good choices. Here’s where you start from, like it or not. Make the best of it.
LEO (JULY 23-AUG. 22) Everyone views the world through distortive lenses (yes, including you). That means that although someone else’s perspective of you might be worth considering, it doesn’t mean it’s necessarily objective, just because it’s coming from an external source. It’s colored by their own experiences and way of looking at the world. That’s not to say you should view all negative criticism (or positive encouragement) as invalid; however, do take it with a grain of salt. If it motivates you to better yourself, that’s fantastic. If, however, it’s only demoralizing and depressing, feel free to mostly disregard it while you get your shit together.

VIRGO (AUG. 23-SEPT. 22) It’s funny and fascinating how you can sometimes feel more connected to animals than to people. That’s because, of course, animals are simpler. It’s not that they give you more—people absolutely have more to offer, if we’re going to be objective about it. It’s that they give you more than you’re willing to actually accept. It’s not that animals are better than people—it’s that you have fewer walls up when interacting with them. Those defensive buttresses are somewhat obsolete at this point. Take some of those walls down, and you’ll notice that your fellow humans are more than willing to give you the same kind of adoration and affection—and more.
LIBRA (SEPT. 23-OCT. 22) It’s my goal this year to become hot (again?). This admittedly rather shallow objective has deeper roots, because eliminating the small spare tire I’ve accumulated in my thirties means also getting rid of some mental and emotional flab and toning my spiritual as well as physical discipline. By the time I’ve gotten to the “hot” place (and I’m already several months into the process), I hope to be a lean mean powerhouse on a number of levels. You’d be best served this week (and in the coming months) by holistic goals that serve you on many levels—try to craft yours to do exactly that.
SCORPIO (OCT. 23-NOV. 21) More than half the time, the reason you can’t have what you want is because you won’t let yourself. That’s right, at least 51% of your unfulfilled dreams, missed chances, and unrequited loves were because you didn’t have the chutzpah, self-worth, or drive to just ask for (or simply go for) what you wanted. I can only remind you so often that you deserve most of the good stuff you hope for—you’ve got to take on the job of reminding yourself, too. When will you stop shooting yourself in the foot like this, and keeping yourself from realizing your own desires? Start this week.
SAGITTARIUS (NOV. 22-DEC. 21) More often than not, love appears to fall into our laps—but in truth, at those times we were at least subconsciously putting ourselves into places and situations where it might happen. If you’re experiencing a dry spell, it’s not entirely by accident. Some of it, at least, is your own doing. Of course, going the opposite extreme won’t do you much good; few people find slutty desperation attractive. But putting yourself out there, along with opening your mind, could get you further than you think. Don’t go out with the intention of finding someone—but do go out. Just try to have fun, and the rest will (eventually) fall into place by itself.
CAPRICORN (DEC. 22-JAN. 19) Sometimes it depresses you at how easily people can be manipulated. However, it’s not your job to make them savvy, wise, or grounded enough to resist blatant emotional exploitation. You can choose, or not, to take advantage of their susceptibility, but I suspect if you spend too much time protecting people from themselves (and any manipulation, accidental or otherwise, from you), you simply won’t get far. You don’t need to take people for a ride, but if a little nudge is enough to get someone onto the same page as you, and your intentions are good, I say go for it.
AQUARIUS (JAN. 20-FEB. 18) There have been times I’ve found old journals, bits of writing, and I don’t recognize them. They’re written in my hand, in my book, so there’s no question they came from me, but I have absolutely no recollection of having ever written them. These fascinating presents from a former self have at times confounded, exhilarated, inspired, and amused me. Write a letter to your future self this week. It doesn’t have to be anything huge or well thought out. “This is how I’m feeling today,” will do. Then forget about it, and don’t visit it for years to come.
