Homeless camp area to be cleared of brush by county
Thomas J. Kendrick Thomas J. Kendrick, 86, of Palm Coast, FL passed away on Wednesday, February 6, 2019. Thomas was born in Brooklyn, NY, to the late, Mary McBrien of Co. Leitrim, Ireland and Patrick Kendrick of Dublin, Ireland. He resided in Brooklyn, Woodhaven, Queens, Breezy Point and Palm Coast, FL. Thomas served in the U.S. Marine Corp Reserves, US Air Force, 49th Fighter Bomber Wing, Fifth Air Force Korea (1950-1952). He was employed by NY Telephone Co. for 30 years. He was a life member of the VFW, American Legion and Knights of Columbus, also a member of Ancient Order of Hibernians, Moose and Catholic Club. Predeceased by his wife of 32 years, Patricia Ann Kendrick nee Kelly. He is survived by Jane Bernard, Robert and Richard Kelly, Virginia Wright, Bridget and John Fahy, many nieces and nephews. Flagler County Land Management is going to clear underbrush in the woods behind the Flagler County Public Library, where officials have recently toured to observe a homeless camp. Public Lands and Natural Resources Manager Tim Telfer said Land Management has cleared underbrush and other vegetation on the 19-acre property, located at 2500 Palm Coast Parkway NW, twice since 2015. Land Management previously discussed using a prescribed burn to clear out vegetation, but that option is no longer on the table. The decision to clear the brush is “tangentially related to the folks taking residency out there,” Telfer said. “But it’s been a fire hazard for a while.” Because the area hasn’t seen a fire in a long time, pine needles that have fallen on the forest floor created a blanket called a duff that holds moisture in. The trees run their roots up into it, so a prescribed fire that is hotter than anticipated can burn root tips, which can cause the pines to die. There’s also a smoke concern for the area’s neighborhoods. “The risks really outweigh the benefits here,” Telfer said. Land Management is currently receiving quotes to either rent equipment or to hire a contractor

to clear underbrush and to remove potentially hazardous trees ahead of hurricane season. The vegetation removal will be largely mechanical. The county wants to employ the use of a special mulching head that can grind up small trees in place. Telfer said the county does not know when the project will start, but, once it begins, he expects it to take at least two weeks to finish. Costs are not known at this time, but could prove expensive. hen six eighth-graders at Indian Trails Middle School found out that the lunch debt in Flagler Schools stands at about $40,000, they were shocked. “That kind of just kick-started our group and powered our determination to try and solve it,” Charlotte Fletcher said. The Community Problem Solvers formed a group called “Student Food Contribution” and set out to reduce their classmates’ debt one at a time. Their first step was to raise money at the First Friday event in Flagler Beach in October. They set up a booth with homemade Halloween carnival games, each costing $1. They ended up raising $100, said Rylee Stives, a member of SFC. This got their momentum going. Next, they passed out flyers at a local trunk or treat to spread the word. For Thanksgiving, they used their own money to buy items like mashed potatoes, corn bread, biscuits and gravy to donate to a local family. “That felt really good

because you can give them something for Thanksgiving so that they can be with their family and not worry about spending more money,” Genesis Santiago-Gil said. In December, Student Food Contribution visited the Palm Coast Elks Club to garner more support in the community. They raised $360 from the Elks, Julieta Kauffmann said. “Not only are they getting other community support, but they’re utilizing their own houses and families and really trying to just get in there and tackle the job,” ITMS teacher Jennifer Colindres said. “It’s like they’ve taken it and really personalized it for themselves.” The group sat down with Flagler Schools Food Services Director Angela Bush to put their fundraising to good use; it cleared or lowered the debt of 21 students who qualified for reduced lunch at ITMS. But that’s where their momentum was halted. EVERY CHILD FED
A kindergartner with wrinkled clothes and smudges on her face used to go through the breakfast line every day at Old Kings Elementary School while Bush was the assistant food manager there 15 years ago. But she couldn’t afford the meal, so every morning, the kindergartner would get a peanut butter and jelly sandwich. At lunchtime, the little girl would go through the line again, and she would get another peanut butter and jelly sandwich. “That was heartbreaking,” Bush recalled. She remembers lunch workers bringing money from home to give to some of the students so they didn’t have to eat PB&J for every meal. The kindergartner was friendly to the food service employees. She even picked wildflowers and
gave them to “Miss Angie.” When Bush was promoted to director of Food Services at Flagler Schools in 2005, she made some changes to eliminate “lunch shaming.” From now on, she decided, every child would be given the same meal, whether they could pay for it or not. It made sense financially, as well as morally, to Bush. Under the previous system, if a child came to the end of the line with a tray of food and realized he or she forgot money, the food was thrown in the garbage for sanitation reasons, and the child was directed to the peanut butter and jelly station. But that was a lot of wasted food, and the cost of the sandwiches was not reimbursed by any federal programs. On the other hand, if the child was given the standard lunch, the federal programs would reimburse at least a portion of the meal. The system works great, but what happens to students like the kindergartner who aren’t in any of the programs but also didn’t pay? That still happens today, and students can accumulate negative balances on their accounts as a result. Who pays for the negative balance? Once it hits $5, Bush said, an automated call goes out to the parents. From there, the Food Services employees might make personal calls to schools or directly to the families. They might send letters to parents. And if it’s still not paid? “I’m unsure about that,” Bush said. “At that point, Food Services doesn’t have any jurisdiction over that. I would say call the principal.” NO CONSEQUENCES
Belle Terre Elementary School’s Dr. Terence Culver is one of Fla-
gler Schools’ most visible principals: He directs traffic in the car rider line every morning and afternoon, and he has even ridden bus routes to give extra support to drivers with unruly students. And he knows that students need to eat, regardless of their ability to pay. “We’re not going to send any kid home hungry,” he said. If students rack up an unpaid account, Cafeteria Manager Linda Mayer and staff encourage the parents to pay and to sign up for free or reduced lunch, where appropriate. But ultimately, Culver said, “We can’t force the parent to pay it.” At the end of sixth grade, with an unpaid account or not, the student can move to middle school. And then high school. And at the end of high school, there’s no real way to collect the unpaid balance, either. Administrative Assistant Odessa Ohree, of Flagler Palm Coast High School, said the student is responsible to settle the account through the cafeteria. When graduation season comes, FPC is not notified of unpaid accounts. Overall, this can add up in a district of 12,000 students. Bush said the balance districtwide is about $40,000, which sparked the interest of Colindres’ students. After Bush helped them to reduce 21 students’ debts, only a handful of reduced-price lunch accounts were left unpaid at ITMS. But the more she thought about it, the more uncomfortable Bush felt. “You can see where we would get into issues if we continued down that road, if those students continued to make money and we were put in a position to determine where it should go.” So who does pay for the unpaid meal accounts? Observer, the district was never able to give a complete explanation of how an individual lunch debt is paid off. “We record our revenues, we record our expenses,” Bush said. “Where the money comes from to cover what we’re calling the debt, I can’t tell you dollar for dollar.” But Bush indicated the approximately $40,000 debt doesn’t cause problems for Food Services, which has an annual budget of $5.7 million, none of which comes from the School Board’s general fund. In addition to federal grants, Food Services also profits from sales of things like Powerade and chips that are sold separately from the regular lunch menu. If more students decided not to pay for lunch, the debt could increase dramatically, in theory. But as of now, there are no clear consequences for not paying. School Board member Trevor Tucker agreed that the unpaid meal accounts have never caused the district a problem and that accepting donations to pay for the accounts would be an “accounting nightmare” for Food Services. The only thing the district can do is rely on the parents feeling personal responsibility. “We can’t lien a house, we can’t kick a child out of school, and we don’t want a child not to eat — that would be very adverse to learning,” Tucker said. “There are no true solutions here. There is no consequence you could enforce.” ‘HOW IT HAS TO BE’
After Bush voiced concerns about where the Student Food Contribution’s fundraised money would really be going, she told the group it would be better to donate the money to organizations not funded by USDA, like the Fed by Grace Backpack Program that provides meals for students when they’re not in school. With the Community Problem Solvers statewide Affiliate Competition approaching in March, the group members are left wondering how this change will affect their project in the judges’ eyes. “They’re going to be glad that we’re doing it because we’re making a difference in our community,” Julieta said. “But at the same time, we made an underlying problem in the beginning of the year, and with that, I don’t think this idea really falls under that. But it is falling under our main idea, kind of. So, I don’t know how the judges are going to feel about that.” Charlotte said the group will have to detail the shift in their goals in a scrapbook they’ll be presenting at the competition, as well as explain the changes to the local organizations that have donated. After meeting with members of AMVETS Post 113 recently, the organization decided to give the proceeds from its Valentine’s Day fundraiser, totaling $1,400, to Student Food Contribution. SFC will attend the AMVETS meeting Sunday to talk about the group’s changes. “I think (the judges are) going to understand because it wasn’t under our control,” Genesis said. “It’s just how it has to be.” Genesis added that this shift will allow the group to help students beyond the walls at ITMS. “I don’t think it’s going to negatively affect us,” Genesis said. “Maybe it’ll do good because they’ll be like, ‘Oh, you stood strong and you did something else and you fixed it in another way you didn’t do it before.’ So, we’re just going to have to wait and see what happens.”

A Flagler County jury of four men and two women found Michael Bowling, 48, guilty of sexually molesting a 15-year-old girl who’d stayed at his home for a sleepover visit with his stepdaughter in June 2016. The jury deliberated for an hour and eight minutes before handing down its verdict on Friday, Feb. 22. The trial started with jury selection on Monday, Feb. 18. It was the second time Bowling was tried on these charges: In an earlier trial held in December, the jury deadlocked, leading to a mistrial. Bowling still faces another trial on charges that he had sexually abused his stepdaughter. The jury in the trial that ended Feb. 22 was not informed of those other charges. It found Bowling guilty of the charges of lewd and lascivious molestation and lewd and lascivious exhibition. Melissa Clark, the assistant state attorney prosecuting the case, called Bowling’s version of events “absolutely unbelievable.” “What motivation would [the victim] have to make this up?” Clark said in her closing argument. “She just met the man, doesn’t know him.” Bowling’s attorney, public

defender William Bookhammer, said the allegations were “completely fabricated” by the victim and Bowling’s stepdaughter. Bookhammer suggested that the stepdaughter had been afraid that Bowling planned to move the family to Kentucky, which would move her away from her boyfriend, and that she was angry because Bowling had hit her mother. The mother said there were no such plans to move away from Flagler. The victim told the jury that the molestation occurred when she visited her friend’s home in Daytona North for the first time, for a sleepover. It started at night after her friend’s mother had gone to bed and after the two girls had tried on homecoming dresses and listened to music. At about 11 p.m. or midnight, when the girls were playing cards in the stepdaughter’s bedroom, Bowling came into the room, the victim said. He made the card game into a game of truth or dare — but, really, there was no “truth” asked of the player who’d lost a round, only dares — and repeatedly “dared” the victim to expose herself to him. She did so after he pressured her, she said. He told the victim not to tell anybody, saying, “What happens in Vegas stays in Vegas,” the victim said. Bowling, on the stand, admitted to playing cards with the girls in the bedroom late at night, and admitted turning the card game into truth or dare. He denied that he’d told the vic-

tim to expose herself to him. After the card game, the victim told the jury, they played a game called “seven minutes of heaven,” in which two people would go into a closet with each other for seven minutes and could do whatever that wanted. Bowling went into the closet with the victim twice, the first time putting his mouth on her bare breast, and the second time stimulating himself sexually in front of her. The second instance happened after Bowling had told the two girls that they’d have to do things to “earn” a bottle of champagne the stepdaughter had asked for, the victim said. After the victim reported the crimes to a school guidance counselor weeks later, investigators checked Bowling’s home and found semen on the closet wall, near where the victim said Bowling had been standing when he’d stimulated himself. They matched it to Bowling’s DNA. Bowling initially told an investigator that there was no reason his semen would be in his stepdaughter’s closet. But he later said, and told the jury, that he’d had a sexual encounter with his wife there. The wife denied that. And even if Bowling’s tale of the incident with his wife had happened, Clark said, “How would [the victim] even know that the semen would be found in the closet? How on earth could the child possibly know that?” Bowling will be sentenced by Circuit Judge Terence Perkins in a hearing at 11 a.m. April 12.

Sheriff ends contract with jail health contractor Staly is unhappy with how the company responded after inmate Anthony Fennick’s death, he said. JONATHAN SIMMONS NEWS EDITOR
Sheriff Rick Staly is ending the Flagler County Sheriff Office’s contact with Armor Correctional Health, the company the FCSO hired last year to oversee medical issues at the county jail. The move comes after the death of an inmate, 23-year-old Anthony Fennick, who had told his parents in the days leading up to his death that he was sick and not getting adequate medical care in jail. Fennick died Feb. 9, after he had a seizure at the jail and was hospitalized with no brain activity. “As sheriff, I accept full responsibility,” Staly said in a news conference Feb. 22. “I promise the Fennick family a thorough and transparent investigation.” With the investigation into Fennick’s cause of death still in progress — it will take the medical examiner 60-90 days to determine a case of death — no one has yet been found responsible. There are also two other investigations underway, handled by FCSO staff: a criminal negligence investigation and an internal affairs investigation. Staly had requested that the Florida Department of Law Enforcement conduct an investigation, but that request had been denied, he said. At this point, there is no indication that Sheriff’s Office employees themselves committed any wrongdoing, Staly said, but the
investigation is early, and things could change. One FCSO sergeant, Staly said, clearly made the right decision by overriding Armor’s direction on how to transport Fennick to the hospital after Fennick’s seizure. “The nurse, as we understand it — now remember, investigations change as we go through — the nurse on duty at the time had told the sergeant, ‘Well you can just transport him in a patrol car to the hospital,’” Staly said. “I am very proud that the sergeant overrode that and called for an ambulance and a paramedic to transport him, which was an appropriate call.” Although wrongdoing has not been determined, Staly is ending the contract with Armor because of how Armor responded to Fennick’s death, he said. “They sent us a bill, and they denied any responsibility,” he said. “I have a death in my jail, and the president of Amor doesn’t call the sheriff of Flagler County? Really? Not acceptable. If you’re going to be a partner with me, you’re in it 100%, not just to collect the check.” The company’s president still hasn’t called, Staly said, but Amor has asked the FCSO for additional money: When the FCSO requested that the two Armor nurses who’d been at the jail during Fennick’s deterioration be removed from duty at the jail and replaced, Armor requested that the FCSO continue to pay for those two

nurses’ salaries — stating that the nurses would be placed on paid leave — plus the salaries for the nurses that would replace them. “My general counsel has asked them to cite where they think that we should pay them, and they have not responded at all,” Staly said. “They know they’re wrong. The contract is very clear.” Armor did not respond to the Palm Coast Observer’s requests for comment by print time. The Sheriff’s Office issued an RFP for a new medical services contractor on Feb. 22, Staly said, and has also taken the following other steps at the jail: All inmate medical concerns will be reported to jail supervisors and administrators. Signs are being added to housing units and the inmate handbook encouraging inmates to report medical issues to jail staff. Inmates will be given medical release forms at booking, so that the jail can legally share medical information with their selected friends or family members. An inmate’s family or emergency contact will be notified imme-
diately if the inmate is taken to the hospital for a critical emergency. The FCSO website will have a dedicated jail medical page with contact information for the medical department. A 24-hour hotline has been created for inmate medical concerns. The following medical services will be offered with no co-pay: follow-up care, mental health services, and for an inmate or staff referral to medical services. “I’ve heard a few say, ‘They are just inmates.’ I disagree,” Staly said. “They are human beings. Anthony Fennick was a son, a brother and a father. He was well behaved in our custody. He was trying to make positive changes in his life, despite past struggles and mistakes. ... To the Fennick family, I am very sorry. I can’t bring Anthony back. But I can work to prevent another family from ever experiencing the loss of a loved one in our custody. BRIEFS Audit: Mosquito Control District failed to develop budget policies The East Flagler Mosquito Control District did not establish proper budget development and monitoring policies and procedures, improperly maintained its records and contravened state law by not using a competitive selection process when it procured architectural services for its new facility, according to a 24-page operational audit report from the Florida Auditor General’s Office. The district’s management, in written responses to the auditors’ findings, concurred with most of the findings and recommendations. Florida Rep. Paul Renner and Sen. Travis Hutson had pushed for the state operational audit after the Mosquito Control District ended up with a $1.1 million budget deficit in 2017 due to an accounting error. East Flagler Mosquito Control Board of Commissioners Chairman Julius Kwiatkowski replied to Auditor General Sherrill Norman in a letter dated Jan. 30, 2018, stating: “We appreciate the opportunity afforded to us to work with your staff and receive these findings and recommendations. Their assistance has already allowed its to make improvements in our operations. More progress needed in revising community cat laws

Unless you’ve been living under a rock, you know there is a serious problem in Palm Coast with stray and feral cats. For many years the city responded with an endless cycle of trap and kill. Thousands of cats were killed. This was, of course, inhumane. It was also counter-productive. The city’s cat problem continued unabated.
Palm Coast resisted TNR, or trap-neuter-return, but after a petition drive with 3,000 signatures, letter-writing campaigns and other efforts by animal advocates, the city gave in and announced the Community Cat Diversion Pilot Program in May 2016. It was not actually a program, but rather a largely unarticulated policy under which local animal organizations and residents could practice TNR and bring cats back to where they had been as long as they were not a “nuisance.” In addition, Animal Control officers were directed to suggest TNR when responding to complaint calls. Let’s be clear who these cats are. The term “community cats” includes feral, unso-

to adjust its regulations. If the city receives a complaint, caretakers have found themselves suddenly treated as owners of the cats and subjected to punitive actions. Ear-tipped cats have been removed. These actions contradict the definition of community cats and further erode trust. Due to these incidents, Barbara Grossman, head of Animal Control, is reviewing the animal code. She brought in speakers from two national animal organizations, Best Friends Animal Society and Alley Cat Allies. Both speakers clearly explained that city ordinances should reflect that community cats are distinct from owned pets and that caretakers are not owners. We need the city to rewrite its animal ordinance to include these changes. They are also the same changes that local animal advocates have been suggesting to city officials for years. The city now says new ordinances will be revealed in the months to come. We community cat advocates are anxiously awaiting but remain frustrated that the city has dragged its feet. We are particularly disappointed in elected officials who ran for office claiming to be TNR supporters but have not acted. Community cat caretakers have learned from the two presentations from Best Friends and Alley Cat Allies. The question is, have city officials educated themselves as well? Most are not suitable for an adoption cage at Flagler Humane Society, and local rescue organizations can’t possibly find enough homes for this outsize population of cats. They are cared for all over Palm Coast by compassionate residents who provide food and water. They should never be re-trapped, relocated or brought to a shelter. Not only is it in the cats’ best interest, but a small colony of fixed cats in a location keeps other cats from moving into the area and helps with rodent control. This pilot program was a good start, but problems have arisen because the city failed

Being homeless in Flagler County is hard enough without having a target placed on your back, and now the secret is out. Thirty-nine of them live behind the library and in several other wooded areas, and there are many more living in their cars, sleeping on couches, paying for hotel rooms and in spare bedrooms, paying $600 just for the room. Now that you know they are here, how are you going to help? I have been there and done that, and I am still doing it — helping, that is. Together
at, food is thrown at them, and then those caring enough who give them money — even that is a problem. What we need is true affordable housing, and I am not advocating Section 8. We need case management, action and accountability, and we don’t need the city of Palm Coast saying it is the county’s responsibility, because after all it’s our community’s fault. If you own rental housing, if you own a car, if you have medical insurance, if you have a job, if you have never been arrested or faced financial setbacks or have been evicted or have good credit — be grateful, because the things you take for granted someone else is praying for. And why isn’t this story being told? Even if it was, I don’t believe anything will happen. Our current county budget has no new dollars or initiatives in it. However, our county staff just built three beautiful cottages at Princess Place that they will be renting out with an expected budgeted income of $250,000, so why can’t this supposedly new income be used to help the homeless? I have done the research and have offered several solutions to the decision makers, but no action has been taken, and this has been for the last three years. We talk and talk, and we do the Point in Time Homeless Count, but where are the results? The homeless are shouted

with some caring friends, we purchased a very old 15-passenger bus (since the county’s policies make it almost impossible for homeless people to ride the county’s buses) to transport the homeless so they can get showers, to do their laundry and to eat, and that is more than our county Social Services, our Transportation Division, our library, and our local government is doing — all combined. And I am being called names like an enabler and a trouble maker since I always try and tell their story to those who will listen. The issue of homelessness is complex enough, but then when you find yourself living in beautiful Flagler County it becomes a nightmare. We share our Social Services with Volusia County and several organizations bear our name, but where are they? And what have they been doing to help? I had to drive a homeless

Matanzas student arrested after alleged threats A 16-year-old female student from Matanzas High School was charged with making written threats to kill on the afternoon of Wednesday, Feb. 20. She had allegedly posted on Snapchat stating her intent to shoot other students that she felt had been bullying her, according to a news release by the Flagler County Sheriff’s Office. The post, circulated on social media, was a selfie of the student with a Snapchat filter. A caption attached to the picture stated: “Stupid a-- b----es know I’ll shot them in the f---ing head with a 12 gauge shot gun.” The student was arrested and taken to the county jail, then turned over to the Department of Juvenile Justice. It was the third juvenile arrest for making threats in the past eight days.

A woman was walking her dog on Colleen Court in Palm Coast the morning of Feb. 20 when a cat attacked her and her dog. The woman, 66, told an FCSO deputy that she’d been walking her schnauzer when she heard a hissing sound behind her. “[The woman] advised there was a black cat stalking her and proceeded to ‘pounce’ on her dog,” the deputy wrote in a case report. “[The victim] advised as she attempted to kick the cat away from her schnauzer dog, the cat proceeded to jump on her and bite her on her left forearm.” The woman had a minor puncture wound on her arm. She told the deputy she’d only contacted law enforcement so they could try to find the cat. The dog was not hurt. The deputy could not find the cat.

County to implement new software package Flagler County is moving ahead with the implementation of a new software package that had created tension between Clerk of Courts Tom Bexley and then-county administrator Craig Coffey last year. List of Palm Coast city manager candidates narrows When Palm Coast’s City Council voted Feb. 19 to advance six candidates for the city’s city manager position to the interview phase of the application process, the city made an error, and included one candidate who should not have been listed. In a special meeting Feb. 26, the council revised its decision, removing that candidate, Ken Kelly, from the list. Another candidate on the shortlist, James Drumm, dropped out of the process before the Feb. 26 meeting, leaving the council with four candidates: internal candidate Beau Falgout, who is currently the city’s interim city manager; Donald Kewley; Matthew Morton and Robin Hayes.
Crime in Flagler dropped 22% from 2017 to 2018 The 2018 Uniform Crime Report report shows that crime in the Flagler County Sheriff’s Office’s primary jurisdiction decreased significantly between 2017 and 2018, according to a news release by the Sheriff’s Office. Total Index Crimes are down 22% from 2017. Violent crime (murder, rape, robbery and aggravated assault) is down 16.3%, and property crime (burglary, larceny and motor vehicle theft) is down 24.7%. Arrests are up 15%, and clearances of reported crime is up more than 32%. “We have a terrific motivated team serving the community, and I attribute the reduction in crime and the increase in arrests to their proactive police work,” Sheriff Rick Staly said in the news release.

Neither Bexley nor Sheriff Rick Staly are satisfied sharing the courthouse. “What should take 15 minutes now takes 30 or 45,” Staly said. “Tasks that should be done on site now can not be. ... This all costs a lot of extra time and money.” Meanwhile, Bexley is no longer able to use the courthouse’s wedding chapel or provide passport photos and fingerprinting. “I don’t disagree with anything that the clerk has said,” Staly said. “My staff and I and my employees are frustrated, just like the clerk, just like the court administration, just like the judges. And it’s been well spoken that this was designed to be a courthouse. … This is not a Sheriff’s Office design, and that’s what we have to get to.” OPTIONS
Of the three potential options the Sheriff’s Office and the county administration presented at the Feb. 21 meeting, the option to consolidate the sheriff at the courthouse, referred to as “Option 3” in a staff presentation at the meeting, would have been the quickest and the cheapest: It could be done in two weeks, for about $10,000. Staly said he believed it was the best option for taxpayers. The additional money that would be spent implementing either of the other two options, he said, “would have been better spent building a new Sheriff’s Operations Center.

Addressing a proposal that the Flagler County Sheriff’s Office’s staff take over the first floor of the courthouse to consolidate the FCSO’s operations — which are now divided between the courthouse and the jail administrative building — Clerk of Court Tom Bexley was blunt. “Using the courthouse and taking the first floor away from me and my operations is unacceptable,” Bexley told the commission during a special commission meeting Feb. 21. “I am not in favor of this, and you do not have my support on this in any way.” The sheriff has staff working out of the courthouse and jail administrative building because the FCSO has been displaced from its Operations Center for nine months due to concerns that the Operations Center is a sick building. Because the division between facilities strains the FCSO, the sheriff and county staff had considered consolidating the sheriff’s operations into the courthouse. But Bexley said that the county government has a legal obligation to provide adequate facilities for the Clerk of Court’s operations, and that the FCSO’s presence has already affected Bexley’s staff’s ability to operate. “I’m not going say you’re in violation of statute, but you’re in violation of statute,” Bexley said to the commission. Bexley’s objection was enough for the commission to decide not to move forward at the meeting with the proposal to have the sheriff take over the courthouse’s first floor. That would have been the least expensive of three options

Because I personally don’t think you can fix the one that’s current.” The county is still waiting on the results of some environmental testing of the Operations Center to determine how to proceed with the evacuated building itself. If the county decides to build a new building, that would take years, and the sheriff needs more adequate space now. And coming up with the money for a new building, County Commissioner David Sullivan added, might require a referendum. The other two proposed interim options would move the sheriff’s operations into modular buildings or office space elsewhere, and would cost either $3.92 million over five years, or $2 million over five years, and would take longer to implement than Option 3. Commission Chairman Donald O’Brien suggested letting the county’s newly hired interim county administrator, Jerry Cameron, meet with Bexley and Staly to find a solution. A total of 27 Flagler County Sheriff’s Office employees plan to sue the Sheriff’s Office for negligence over conditions at the now-evacuated Sheriff’s Operations Center — and they have Sheriff Rick Staly’s sympathy. “This litigation is no surprise to me and should be no surprise to anyone,” Staly said in a news release. “I completely understand why affected employees have been advised to file a lawsuit by their attorney to protect their rights under Florida law.” Bichler & Longo, the law firm representing the employees, sent the FCSO a notice of intent to file a lawsuit, dated Feb. 12. The notice is required by law. The Sheriff’s Operations Center building on State Road 100 has been evacuated since June, at Staly’s order, and is owned by the county. It was constructed on the frame of the old Memorial Hospital building. Since employees started reporting symptoms — rashes, respiratory problems — a series of experts, some hired by the county, others representing the employees, have conducted testing on it, as has the CDC. Some lab results have not come back yet. But when the building’s walls were opened up, experts found evidence of water dam-
age and bat guano, and water had also intruded under the flooring. The county has a legal responsibility to provide facilities for the sheriff, and, for now, the FCSO’s operations are divided between the county courthouse and the jail administrative building. “The nature of this complaint for negligence is that my client, while working for the Sheriff’s Office Operations Center, was exposed to toxins in the workplace,” the notice from Bichler & Longo states. “As a direct and proximate cause of the County’s negligence, my client has suffered bodily injury, incurred medical expenses, suffered pain and mental anguish and a loss of earnings.” Staly noted in the FCSO’s news release that FCSO employees had been assigned to the building before he became sheriff. “As sheriff, I am only a tenant in a building owned by the county,” he stated in the news release. “As soon as I was notified and saw credible evidence about the impact of this building on my employees’ health and well-being, I demanded the county evacuate everyone from it. ... I am sure that the legal and worker’s compensation process will work to achieve a just resolution and I support my employees who work hard to serve our community every day.”

hen the starter fired the pistol into the air, signaling the commencement of the race, the Bulldogs’ Nathan Farrell exploded out of his block and sprinted down the track at Flagler Palm Coast High School. With each hurdle, the gap between Farrell and the rest of his competitors at widened. Farrell finished the boys 300-meter hurdles in 38.01 seconds — a season-best and a meet record for the East Coast Classic. Multiple Bulldogs — boys and girls — set season-bests at the 15th-annual East Coast Classic on the afternoon of Friday, Feb. 22, at Flagler Palm Coast High School. The Bulldogs’ boys team took first place and the girls team finished in fifth. FPC head coach David Halliday was pleased to see his teams’ progress in the third meet of the year. There were 21 teams competing in the event, including teams from the Bulldogs’ conference and district. Some of the top teams in the state also competed. “I thought this was a good barometer to gauge where we are,” Halliday said. In addition to Farrell breaking the meet record in the 300-meter hurdles, the boys 4x400-meter relay team broke the meet record with a time of 3:22.90, and Nelson Paul won the shot put for the second meet in a row. Paul, who starred at defensive end for the Bulldogs’ football team, won the

The girls team graduated several sprinters last year, including state participants Namiah Simpson and Courtney Gales. Although they struggled in the running/sprinting events, the Lady Bulldogs did well in
the jumping events. Prosperity Wright took second with a 10.34-meter leap in the triple jump, and Susann Kaufmann finished fourth in the high jump at 1.42 meters. In addition, Ekatereena Kouzina placed third in the pole vault with a height of 2.45 meters, and Anisa Zwolinski had the best shot put of her career, throwing for 10.31 meters — good enough for fourth place. “We’re making good progress,” Halliday said.

With a 10-run lead in the bottom of the sixth inning, the Pirates needed three more outs to runrule rival Seabreeze on the night of Wednesday, Feb. 20. The Pirates’ Grace Ledrich entered the circle at the Ormond Beach Sports Complex. The first Sandcrabs batter hit a ground ball toward shortstop Ellie Hansen, who snagged it cleanly off the clay and pitched it to Randa Motsinger at first base — out. The second batter popped out to third baseman Kadrianna Grinstead. Ledrich then gave up two singles and two walks, which loaded the bases. On a 2-2 count with the run-rule in balance, Seabreeze’s last batter was struck out swinging. “This team just pushes through everything,” the Pirates’ Isabella Santiago said. “Even if we’re falling flat. We want to push through to the end.” Matanzas jumped on the Sandcrabs early. lead after three innings. In addition, starting pitcher Emma Wood did not give up a hit in those three periods. Ledrich replaced her in the fourth frame. Alexia Moy hit an inside-thepark home run in the fifth, and Motsinger hit a 2 RBI triple in the sixth to vault the Pirates to double-digit runs. The season-opening win comes days after the Pirates crushed Ponte Vedra 10-1 in the preseason. “It’s exciting because we’ve been working on a lot of things,” Matanzas coach Sabrina Manhart said. “There’s a lot of teachable moments. And the things that I’m asking them to do, they’re actually executing in the games.”

Having someone like her push us like that — it’s just making us so much better.” The biggest adjustment for Manhart has been the difference in tempo between the high school and college games. She developed what she thought would be a two-hour plan for the Pirates’ first practice. She ended up having to cut it in half. “Once I made my adjustments, they have really met the challenge every day,” she said. “These girls are good players. They’re hard workers. I think that we can really give some teams a run for their money.”

In her 12 seasons as the head softball coach at Daytona State College, Sabrina Manhart has seen many of her players embrace her coaching style, work hard and succeed. Six All-State selections, two Mid-Florida Conference Pitchers of the Year and 33 All-Conference selections attest to that. In addition, she’s coached players who now play NAIA, Division II and Division I softball, including at powerhouse programs like Florida and Georgia. Manhart, who also played college softball for Daytona State and Bethune-Cookman, stepped down as head coach of the Falcons at the end of last season to spend more time with her family. When Matanzas Athletics Director Zach Rigney first heard of Manhart, his interest was piqued because of her qualifications and for her leadership ability. Rigney hired Manhart to replace Rebecca Bower, who resigned last spring, in August to coach the Pirates’ softball team. Pirates team captain Alyssia Paiz first met Manhart during volleyball season in the fall. They crossed paths in the parking lot at Matanzas High School. At the Pirates’ first practice,

onning gowns and black ties, a ballroom full of people watched a video with personal testimonies about the care done at the Freytag Children’s Rehabilitation Center. Guests watched the pediatric patients smile on the screen, while parents voiced their inexpressible gratitude for what the center has done for their kids. The video inspired guests to give a total of $125,000 at the 10th-annual Moonlit Gala and golf tournament, both on Sunday, Feb. 24, to benefit the future expansion of the pediatric rehab center in Palm Coast, as well as other AdventHealth Foundation and hospital programs in the community. In 2011, the Freytag center first opened at the hospital on Memorial Medical Parkway with a vision to help the children of Flagler County who were living with birth defects. “In only nine months, we had outgrown the facility,” Sue Freytag said. “When Parkview Medical Center opened, it was decided, by the hospital, that the children’s rehab center should move over there. At that time, they increased the size three times above what it was at the hospital. The doctors continued to send their patients there. The children loved it. Many times, they didn’t cry because they had to go, they cried because they had to leave. It did such a good job that now we’re looking for further expansion.” Freytag said that 80% of the pediatric patients at the center are Flagler County kids. “Before that, the closest facility was either in Jacksonville or Orlando,” she said. “That’s a long way to go with a small child. So, I’m very happy that they have spotlighted the future expansion

The fifth-annual Princess Place Pow Wow, Flagler County’s Native American festival, took place the weekend of Feb. 2425. It was complete with dancing, weapons demonstrations, wildlife exhibits, encampments and displays. Parks Manager Frank Barbuti said there were over 50 tribes represented from North and South America. There were demonstrations on a variety of weapons, blacksmithing and flint knapping, the official term for making arrowheads.

A fine art exhibit of sculpture by Joan and Paul Baliker will be on display at the Berkshire Hathaway Gallery, with opening reception 6-8 p.m. Saturday, March 2. With a camera, tripod and shotgun mic, a group of four students filmed a project near the recycling dumpsters in the back of the Flagler Palm Coast High School campus on Thursday, Feb. 21. The short film about identity theft, created by senior Palmer Guthrie, will be one of about 15 shorts at the FPC-TV’s fourthannual film festival on March 1. The event serves as a fundraiser for the FPC-TV program, but it means more than that to the students, said senior Justin Cestare.
The public is invited to the fourth-annual student film festival at Flagler Palm Coast High School.
“It’s a way to support our filmmakers here,” Cestare said. “It’s kind of your first real exposure to having a screening for a film you worked on, so it does fuel that passion to want to go in and make more, better things. It does support us out, but it also supports the kids individually by giving them an audience.” All submissions are PG13 at the maximum and can range from 1 to 15 minutes long. There will be freshly popped popcorn, candy and other concessions available at the festival. A handful of the submissions were made by Matanzas High School students and home-

schoolers, Cestare said. “This year we’ve been a lot heavier on advertising more to the community, as opposed to just the school,” Cestare said. “We have a few films that have come from people out in the community, so it’s not just FPC-centric.” Three judges will determine the winners for each category: drama, horror, comedy and Best in Show. The winners will receive a personalized plaque. Last year, there were about 20 viewers other than the student directors, so Cestare said they hope to have at least 40 guests this year. Once they gain enough momentum, he said they want to host the film festival in the Flagler Auditorium to give students a better “at the movies” screening experience.

It will also be owned by the same company, which is affiliated with Southeast Petro Distributors Inc. Melinda Jo Saffer Hause
Melinda Jo Saffer Hause, 60, returned to her heavenly home on February 22, 2019 after a valiant battle with pancreatic cancer. Her devotion to her family and her firm belief in God supported her in her struggle and ultimately gave her peace. Melinda was born to Joseph Raymond Saffer and the late Martha Louise Davidson, in Jacksonville, Florida. She was a Real Estate Appraiser for 15 years in Orange Park, Florida. In 2003, she joined her husband as a franchisee for Firehouse Subs in Flagler and Volusia Counties. Melinda was blessed with a large and loving family. She married her best friend and soulmate, David Hause on May 13, 1989, in Orange Park, Florida. They enjoyed a beautiful life and raised four children together which Melinda believed was her greatest accomplishment. Later in life she was blessed with grandchildren, which she often said were her greatest joy.
